    GOVERNMENT OF MAHARASHTRA

    RULES OF ADMISSION TO FIRSTYEAR OF FOURYEAR FULL TIMEDEGREE COURSES IN ENGINEERING/TECHNOLOGYAND INSTITUTE INFORMATION FORTHEACADEMICYEAR2009 2010

    These rules are approved vide Government Letter No.: TEM 2009/(96/09)/TE-4 dated 8th

    May, 2009 issued by theHigher and Technical Education Department, Mantralaya Annexe, Maharashtra State, Mumbai-400020

    1.0 Introduction

    The entrance examination for the selection to all Health Science Courses, Engineering

    and Pharmacy degree courses i.e. MHT-CET 2009, in the State of Maharashtra for the

    academic year 2009-10 was conducted by the Competent Authority appointed by the

    Government of Maharashtra.

    This brochure gives the rules and information regarding the Distribution of seats under

    various heads i.e. Home University, Outside Home University, Institute level seats, Minorityseats, AIEEE seats etc.; details of the Reservation of seats, Fees concession offered to

    eligible candidates, details of the Centralized Admission Process (CAP), details of the

    Admission rounds, Institute/course wise Information etc.

    The Admission process for the Autonomous Institutes [viz. i) Veermata Jijabai

    Technological In stitute (VJTI), Mum bai, ii) College of Engineering (COE) , Pune,

    iii) Institute of Chemical Technology (ICT), Matunga, Mumbai, iv) Shri Guru

    Gobind Singhji I nstitute of Engineering & Technology (SGGSIET), Nanded and v)

    Walchand College of Engineering(WCE), Sangli vi) Vishwakarma Institute of

    Technology (VIT), Pune] is being separately carried out by the Competent Authority

    appointed for these institutes.

    These rules also incorporate the guidelines (Annexure-II) for the rules of admissions,which are to be carried out by the Unaided institutes for Institute level seats and for theseats remaining vacant after the Centralized Admission Rounds.

    1.1 Role of Competent Authority in the process of Admission to FirstYear of Engineering.

    a) The Competent Authority duly appointed by the Government and headed by the Director ofTechnical Education, Maharashtra State, shall be the authority for Centralized AdmissionProcess and direct the students as per their allotment through CAP to all colleges.

    b) Competent Authority shall be the sole authority to effect admission through CAP for Govt.,Govt. Aided, University Department, University Managed colleges.

    c) Competent Authority shall also effect admissions to a certain number of seats in UnaidedEngineering colleges, for which such institutions have given consent.

    d) Competent Authority shall also deal with the representations received from the candidatespertaining to allotment and admissions in Govt., Govt. Aided, University Managed colleges,University Departments and Unaided colleges which acts as Grievance Redressal Authorityand Appellate Authority at State level.

    e) To scrutinize the branch-wise list of the students admitted to First year, by all UnaidedEngineering colleges submitted through the office of the Joint Director, Tech. Education ofrespective regional offices in the State of Maharashtra.

    f) All the decisions taken in relation to Admission to First Year of Engineering/Technologycourses, by the Competent Authority shall be final and binding on all concerned.

    2.0 Seats available for admission through Competent Authority

    2.1 Seats available for admission through Centralized AdmissionProcess (CAP):These are the seats for which admission is carried out by the Competent Authoritythrough CAP. The details of such seats are as shown in the following table.

    which may be published from time to time. The exact distribution of seats available for allotmentshall be notified on the website before submission of option forms of Centralized AdmissionProcess.

    2.1.1: Additional Seats available for admission through CAP under the seatsAgainst AICTE Tuition Fee Waiver Schem e (AICTE notification No. 37- 03/Legal/2007

    dt. 9thApril 2007) -The AICTE has announced the scheme of Tuition Fee Waiver for thebenefit of meritorious students belonging to Physically Handicapped, Woman andEconomically weaker sections of the society.The salient features of the schem e are:-

    1. Under the Scheme, the Competent Authority for admissions shall be the same as for regularadmissions.

    2. Institutions shall provide tuition fee waiver up to 10 percent of its sanctioned intake ofstudents. Typically for every 60 sanctioned intake in a branch/discipline of study, tuitionfee waiver shall be given to two woman students, three economically weaker students(Annual income of Parents/Guardians less than Rs. 2.50 lakhs from all sources) and onephysically handicapped student based on merit.

    3. In the event of non-availability of students in a specific category as above, the benefit willbe given to any other candidate of other categories according to merit.

    4. The AICTE approved technical institutions shall inform the number of the tuition fee-waivers, branch wise to the admission authorities of the concerned state and give anundertaking that the institution will not charge tuition fee for the duration of the coursefrom the beneficiaries.

    5. The State Governments, Affiliating Universities of the concerned state shall allow equalnumber of seats over and above the present sanctioned strength subject to maximum of

    10% of the approved intake in the same branch in lieu of number of the Tuition FeeWaivers.

    Tuition Fee Waiver scheme shall be implemented as follows:

    The list of the institutions who have volunteered to avail the scheme is available inannexure IV.

    The admission to these additional seats will be done along with the admission toMaharashtra State seats available for CAP (mentioned in rule 2.1) by the Competent

    Authority.

    All such additional seats shall be treated as GENERAL seats of Maharashtra state quota.Out of these 6 additional seats, 4 seats will be merged with the available GENERAL HomeUniversity (HU) CAP seats and 2 seats will be merged with the available GENERAL Other

    than Home University (OHU) CAP seats. The detail of Tuition fee waiver seats against the sanctioned intake is given in the table

    below:

    The candidates opting for admission against the additional seats under this schemeshould note that the tuition fees for the additional seats is as specified in Rule No. 7.1 &7.2

    Candidates willing to opt for these additional higher fees seats of Government/Govt aidedinstitutes; University Managed Departments will have to specify their willingness in theoption form.

    As the fees for additional seats under this scheme in unaided institutes is same as feesapplicable to them as approved by Shikshan Shulka Samiti, candidates need notseparately mention about their willingness for these seats.

    Maharashtra State candidates (on the basis of score of MHT-CET-2009) will be admittedagainst such additional seats.

    The beneficiaries will be decided as per the final merit list of admitted candidates aftercompletion of CAP process prepared on the basis of score of MHT-CET-2009.

    Guidelines for the institutions for the selection of beneficiaries of Tuition FeeWaiver Scheme:

    Beneficiaries should be selected from the candidates admitted against the Maharashtrastate quota of CAP process only.

    Candidate will not be treated as a beneficiary of the scheme if he/she is opting for feeexemptions through any other scheme.

    Institution will not charge tuition fee for the entire duration of the course to thebeneficiaries irrespective of the total number of enrollment in each year of the course orfailure of the beneficiaries.

    Students, either beneficiaries or additional students admitted under this scheme are notentitled for change of branch in the same institute or change of the institute through outthe duration of the course.

    While selecting the number of beneficiaries, institutes are required to consider totalnumber of candidates admitted through CAP only. In any case, institutes are notsupposed to consider institute level filled seats.

    An illustrative example is given below -Sanctioned intake for the course = 6020% Institute level seats = 12

    65% Maharashtra State quota seats = 3915% AIEEE seats = 0910 % Additional seats under Fee Waiver scheme = 06Number of candidates to be admitted through Maharashtra State CAP quota = 39 + 06

    After the completion of CAP process:No of candidates admitted through Maharashtra state CAP quota = 45 i.e. 39 + 06

    In such a case, institute will be exercising Fees waiver scheme for 06 students in thespecified categories from the 39 seats only.However, though the allotment is made to 39 + 06 students but the number ofcandidates. Actually admitted are 39 + 04, then the fee waiver will be given to 04candidates within 39 seats.

    In order to clearly understand the distribution of the seats to the beneficiaries forsanctioned intake 60 following table is given.

    2.2 Seats available for Jammu & Kashmir Migrant Candidates:

    Provision of one Seat in each course over and above the sanctioned intake in allGovernment, Government aided, University Managed and Un-Aided EngineeringColleges/Institutes except LIT, Nagpur and Institute of Chemical Technology (ICT),Mumbai, University Departments of SGB Amravati University, North MaharashtraUniversity, Dr. BAMU is made for;

    J-1 Type: The children of citizens who are displaced from Jammu & Kashmir to any partof India or from unsafe border area of J & K to a relatively safer place in J & K from 1990onwards due to terrorist activities.

    J-2 Type: The children of officers belonging to Indian Administrative services, IndianPolice Services, Indian Forest Services, other officers and children of the staff belonging tomilitary and paramilitary forces, transferred to Jammu & Kashmir to combat terroristactivities and joined the post on or before the last date for submission of application form.

    J-3 Type: The children of staff of J&K Police engaged in combating terrorism.Admission against these seats is made strictly on the basis ofinter semerit ofcombinedsingle merit list of all eligible J & K Migrant candidates. The candidates seeking admissionagainst the seats reserved for J&K migrant have to submit relevant Certificates shown inproforma J/K/L in support of their claim at the time of admission. Candidates seekingadmission under this provision shall submit their application forms to the representative of

    Candidates admitted under this provision are not allowed to change course or collegein any year of study. Candidates who are eligible to apply against the provision of Jammu &Kashmir M igrant Candidate seats as well as against the Maharashtra Stateseats are entitled to claim for only one of these seats.

    2.3 Seats available for Government of I ndia Nominees:Provision of a specified number of seats is made for the nominees from states andUnion territories, which lack the facility in Technical Education. The Ministry of HumanResource Development (MHRD), Government of India determines these seats every year.These seats are over and above the sanctioned intake for the courses in whichadmissions against these seats are provided.

    The admission procedure for these seats is as under: The respective State selects the candidates for the seats earmarked for their state. The Competent Authority of the respective State issues the course and college

    allotment letter to the candidate. Candidates along with course and college allotment letter reports tothe Directorate Of

    Technical Education, Maharashtra State, 3, Mahapalika Marg, Dhobi Talao,Near Metro Cinema, Mumbai 400 001 for scrutiny of original certificates and forcollecting the admission letter on or before 31st August of the current academic year.

    No GOI Nominee candidate shall report directly to the Institute. In case suchcandidate reports directly to the Institute, the Principal of the institute shouldnot admit such candidate and ask th e candidate to approach above mentionedoffice.

    These admissions are subject to t he following conditions: Candidates nominated by the concerned States shall be admitted only and only if they

    fulfill the condition of eligibility. The candidates so admitted will have to obtain eligibilitycertificate from the University in which admission is secured.

    If the candidate does not fulfill the minimum eligibility criterion, he or she will not beconsidered for admission even though he/she has been nominated as a GoI nominee.

    The backward class category GOI candidates nominated from the respective States willget relaxation in educational qualification for eligibility as in the case of Maharashtra statebackward class category candidates. However GoI nominees belonging to backward classcategory does not get any exemption in tuition fee.

    Candidates admitted under this provision are not allowed to change course or college insubsequent years.

    2.4 Seats available with other authorities:The seats as mentioned below are not covered under the CAP and the respectiveInstitutions are the authority for admissions to these seats.     2.6 Allocation of Seats2.6.1 Types of Seats under CAP: -

    I) Maharashtra State Seats (MHT-CET-2009):

    Home University seats (HU Seats): Certain percentage of seats of every institute isreserved for Home University i.e. for the University under the jurisdiction of which that

    institute is situated. Home University seats are available for allotment through CAP for the

    Maharashtra candidates having their Home University status as that University. For

    example, candidates having their home university as RSTM Nagpur University will be

    eligible admission to the Home University seats of those institutes which are located inthe jurisdiction of RSTM Nagpur University.

    Seats for candidates belonging to Universities other than Home University(OHU seats):

    Certain percentage of seats of every institute is reserved for Other Universities i.e. for the

    Universities other than the Home University under the jurisdiction of which that institute

    is located. Such seats are called as OHU seats. Candidates can opt for seats of any other

    University (excluding his/her home university) under this provision of OHU seats. For

    example, candidates having their home university as SGB Amaravati University will not be

    eligible for the OHU seats of those institutes which are located in SGB AmaravatiUniversity. Candidates having their home University other than SGB Amaravati University

    are eligible for these OHU seats of the SGB Amaravati University.

    2.6.3 Admissions to VJTI Mum bai, COE Pune, ICT Mum bai, SGGSIE&T Nanded, WCESangli, and VIT, Pune

    As per Government Resolution(s), admissions to these institutes will be carried out

    separately. These institutes will not be considered under Centralized Admission Process.Common Entrance Test for the admissions to these institutes will remain same as that of

    MHT-CET-2009 conducted for Engineering, Pharmacy & Medical Degree courses by the

    Competent Authority of Govt. of Maharashtra. Candidates are required to fill up separate

    application form for admissions to these institutes. Admissions for all the seats of these

    institutes will be carried out on the basis of MHT-CET-2009 marks as per the inter-se

    merit of the Maharashtra State candidates who have applied separately for admission to

    these Institutes as per the relevant rules. Statutory reservations for candidates belonging

    to backward class categories as per the relevant rules and resolutions of the Government

    of Maharashtra will be applicable for admissions to these institutions.

    2.6.4 Sanctioned intake for various Courses in various Institutes for the year2009-10:

    Sanctioned intake for various Courses in various Institutes for the year 2009-2010 ismentioned in the Institute information part of the brochure.

    The AICTE has communicated to the State Government the approved new institute/s, thevariations in the existing intake capacity of different courses and introduction of the newcourses in the existing institutes on or before 15th June 2009.

    Approvals to start a new institute/course and variations in the intake capacity of theexisting courses communicated after the 15th June 2009 will not be considered foradmission during the academic year 2009-10.

    Approvals to start a new institute and changes in the intake capacity for the course inexisting institutes communicated by AICTE after the printing of the information brochureshall be displayed on the website http://www.dte.org.in/fe2009 and will not be separatelynotified in any newspaper. This information will also be made available at all the Regionaloffices of the Directorate of Technical Education.

    The final Institute Information displayed on DTE web site will be treated as authentic foradmissions for the year 2009-10. Candidates are instructed to refer the web site for therevised and final Institute Information before filling the Option/Preference Form.

    3.0 Reservations:

    All the reservations given below shall be applicable to candidates belonging to

    Maharashtra State only subject to the fulfillment of the eligibility criteria specified by

    respective authorities from time to time.

    3.1 Reservation for Backw ard Class category Candidates:

    The percentage of seats reserved for candidates of backward class categories belonging

    to Maharashtra State is as per the details in table given below. The percentages of

    reservation are the percentages of the seats available for Maharashtra candidates, which

    are coming under the purview of the Competent Authority (Refer notes 1-5 given below

    for details). These are the minimum percentages of reservation exclusive of the backward

    class candidates securing allotment through General Merit by virtue of merit. Backward

    class candidates shall claim the category to which they belong to at the time of

    submission of application form for Centralized Admission.

    during the allotment stage-I and no separate seats are earmarked before the start of the

    allotment process.

    4. Even if the candidate belonging to Backward Class Category secures admission against aseat belonging to the General category by virtue of merit, such candidate has to produce

    all the necessary documents in support of the category claimed both at the time of

    admission and while filling up of the CAP admission form.

    5. All OMS candidates are treated as GENERAL/OPEN candidates and are not eligible toclaim reservation for Backward class category candidate.

    3.2 Reservation for sons/ daughters of Defence service personnel:

    Five (5) % seats of the total sanctioned intake for an institute, subject to a maximum offive (5) seats in each institute coming under CAP shall be reserved for

    Children of ex- service personnel who are domiciled in Maharashtra State (DEF-1). Children of active service personnel who are domiciled in Maharashtra State (DEF-2). Children of active service personnel (DEF-3)

    Who are transferred to Maharashtra State but are not domiciled in MaharashtraState,

    Who are not domiciled in Maharashtra State but their families are stationed inMaharashtra State under the provision of retention of family accommodation at the

    last duty station on grounds of childrens education provided further that, such

    candidate should have appeared and passed the HSC (Std.XII) examination of

    Maharashtra State Board of Secondary and Higher Secondary Education or its

    equivalent examination from a school/college situate in the State of Maharashtra.

    These seats are within the sanctioned intake capacity and are available as State Level

    seats. A combined single merit list of all eligible DEF1, DEF2 & DEF3 candidates shall beprepared. Admission against the Defence category seats will be made strictly on the basis

    of inter se merit of combined single merit list of all eligible DEF1, DEF2 & DEF3

    candidates.

    Note:-This provision is NOT available to the children of CIVILIAN STAFF has worked in theIndian Defence Service who is working/ who.

    3.3 Reservation for Physi cally Handicapped Candidates:As per the provisions in Clause 39 of Equal Opportunities, Protection of Rights and Full

    Participation Act 1995, three percent (3%) seats of total sanctioned intake capacity of allthe institutions coming under CAP shall be reserved for physically handicappedcandidates.

    visually impaired (blind) candidates (P1) speech & hearing impaired (deaf & dumb) candidates, (P2) Orthopedic disorders, learning disabilities, Dyslexia, Dyscalculia, Dysgraphica, Spastic (P3)

    Allotment of the seats reserved for the Physically Handicapped candidates shall be doneon the basis of a single combined merit list of such candidates. These seats are availablein 70% Home University area seats only.

    Note:-It should be noted that the physically handicapped candidates on admission toEngineering / Technology degree course will not be given any exemptions or additionalfacilities in the academic activities other than those which may be provided by therespective Universities. Further it is specifically brought to the notice of PhysicallyHandicapped candidates that, they should submit the certificates strictly as per theProforma F/F-1.

    3.4 Reservation for Female candidates:As per the provisions in Govt. Resolution No. GEC-1000/ (123/2000)/ Tech. Edu.-1, dated17th April, 2000, 30% seats available for Maharashtra State CAP shall be reserved forfemale candidates in all the courses of the institutions coming under CAP. Thisreservation shall be applicable for General, SC, ST, DT/VJ(NT-A), NT-B, NT-C, NT-D andOBC categories. Seats reserved for Female candidates are available under both the 70%Home University seats and 30% Other than Home University seats coming under the

    CAP. There shall be no reservation for Female candidates under Defence, PhysicallyHandicapped and SBC categories.

    IMP ORTANT: All such candidates who fail t o substantiate claims made (suchas reservation category, PH, Defence etc.) with supporting necessarydocuments shall be converted to GENERAL category and/or such applications

    6.0 Rules of Admission through Centralized Admission Process (CAP)-This section briefly explains the various stages and procedure adopted for the CAP.Candidates seeking admission to Engineering/Technology courses are required to appearfor MHT-CET 2009/AIEEE-2009 conducted by the respective Competent Authority.

    For the academic year 2009-2010, the Competent Authority shall conduct total Four (4)rounds of Centralized Admission. The CAP shall consist of first three (3) rounds ofCentralized Allotment wherein eligible candidates of respective rounds (both Maharashtraand AIEEE) will fill & confirm fresh Online Option forms for respective rounds. TheMaharashtra Candidate eligible for All India Seats (AIEEE) is required to submit onlysingle option form for both Maharashtra and All India Seats. Fourth round of CAP shall beconducted by way of counseling, only for the eligible Maharashtra State candidates.

    Major Steps in the CET, Admission through CAP and tentative schedule aresummarized below:

    Above mentioned schedule and procedure is tentative and shall be taken as a suggestiveguideline. A notification giving details such as schedule, procedure of Centralized

    Admission will be displayed on the website and published in leading newspapers.

    In order to participate in the CAP, the aspiring & eligible candidate is required to submitand confirm the Application Form for Centralized Admission to Engineering (in June2009) at the ARC.

    The scheme of allotment through Multiple Rounds and Rules of Reporting presentedbelow is designed to prevent loss of academics and to make the CAP Rounds meaningfuland effective rather than formal and ineffective in view of the previous experience of thisDirectorate as also the facts and figures available with this Directorate as to the seatsremaining vacant at the end of each Round(s) and especially at the end of all theRound(s) of such Centralized Allotment Process. The rounds are so designed with thepurpose that, maximum vacant seats are filled in, without creating further resultantvacancies on account of shifting of students to whom already allotment has been made inearlier rounds of CAP.     Institutes (institutes mentioned in rule 1.0) are not eligible to participate inany of the CAP rounds-I/II/III/IV conducted by the Directorate of TechnicalEducation , M.S., Mumbai .

    Candidates who have confirmed admission in any one of the CAP roundsI/ II/ III / IV conducted by DTE will not be able to participate in any admissionrounds conducted by the Autonomous In stitutes (institutes mentioned in rule1.0).

    If a candidate cancels his/ her admission, which w as confirmed in earlier CAPround(s) or in the Autonomous I nstitutes, will not be eligible to participate inthe subsequent CAP round(s) conducted by DTE and in the Admission

    Round(s) conducted by Autonomous Institutes, even after cancellation ofsuch admission.

    Details of eligibility for participating in each round of CAP, method ofreporting after each CAP round, availability of seats for each CAP round andother details are given in theAnnexure-I of this Inform ation Brochure .

    Seats remaining vacant after completion of CAP will be filled at the Institute level. Theguidelines for vacancy round of admission and for admission against Institute level aregiven in theAnnexure-II of this information brochure.

    Only one round of admission by counseling for J&K Migrant seats will be conducted.(Refer rule 6.3 for details)

    Various steps in the process of admission to Engineering courses are also given in theAnnexure-I . The steps include issue of Information brochure, filling up & confirmationof Online CAP Application form, filling up & confirmation of Option form for each round ofCentralized Allotment, Allotment process and Reporting Rules etc. Candidates arerequired to read carefully the details of CAP given in the Annexure-I and followinstructions given therein.

    6.1: CAP Rounds I/ II / II I by allotment and Round-IV by Centralized

    Counseling for Maharashtra State candidates (Type A,B,C,D,E,F)

    Eligible candidates: - All the eligible Maharashtra State candidates (Type A-F) whohave a valid MHT-CET-2009 score and have been assigned Maharashtra State Meritnumber and whose name appear in the merit list for respective CAP rounds prepared bythe Competent Authority shall be considered for allotment in these Rounds.

    Seats available: Refer Rule 2.6.1, 2.6.2 and 2.6.3

    6.1.1 CAP Rounds I/ II/ III: Direct Al lotment:- Allotment of seats for Home University seats and OHU seats for other universitycandidates coming under CAP is carried out as per the logic explained in the rule 6.1.3.

    For the CAP Round-I, Stage-I, Stage II and Stage-III of rule 6.1.3 shall be executed.Seats remaining vacant due to non-allotment and non-reporting will be available forallotment in CAP Round-II.

    For the CAP Round-II, Stage-I to Stage-V of rule 6.1.3 shall be executed. Seats remainingvacant due to non-allotment and non-reporting will be available for allotment in CAPRound-III.

    For the CAP Round-III, Stage-I to Stage-VI of rule 6.1.3 shall be executed. Seatsremaining vacant due to non-allotment and non-reporting will be available for admissionthrough counseling in CAP Round-IV.

    The seat tags i.e. Reserved category, PH, DEF, HU, OHU, Ladies,AIEEE etc.shall be maintained during allotment in CAP Round-I, II and II I.

    6.1.2 CAP Round I V- Admission by Centralized Counseling:CAP Round-IV of admission will be conducted only for eligible Maharashtra StateCandidates whose names have appeared in Maharashtra State Merit list (subject toeligibility of participation as set out in the Annexure-I). During this round of admission byCounseling, no seat tag will be applied i.e. seats available shall be treated as GENERALseats and shall be allotted solely on the basis of inter-se merit of eligible MS candidateswithout any reference whatsoever to the category of the candidate(s) (open /reserved) or

    the category to which the vacant seat belongs (such as Home University, other thanHome University, Backward Class, Physically Handicapped etc) and also all the vacant

    AIEEE Seats shall be treated as GENERAL seats and will be offered to MS candidatesfrom Maharashtra State Merit list as stated above.

    The number of the seats, type of seat tag etc. will be made available on

    website to th e eligible candidates before fil l ing up of the option forms for CAPRounds I, II and III .

    General Notes: Allotment for Home University seats and Other than Home University seats will be carried

    out as per inter semerit of University area merit list and Maharashtra State merit listrespectively of CAP Round-I, II & III.

    Seats will be allotted to candidates as per their inter semerit, as per the options filledand the number of seats available at that point of time in the stage of CAP Round-I, II,III.

    All candidates eligible for a particular stage of allotment will be considered for allotmentfor a seat in that stage, even if they have been allotted/not allotted a seat in the previousstage.

    During the allotment of any stage, the candidate may get upward shift in the allotmentwith reference to the options filled by the candidate according to availability of seats atthat point of time.

    All reserved category candidates (including SBC in their original category) shall beconsidered for allotment (whether they are allotted any seat in earlier stage or not) in allstages.

    Due to upward shifts, the seats falling vacant shall be considered for allotment in furtheriterations of the same stage as per the provisions of that stage of allotment and as perinter semerit.

    Allotment against the first available option in the order of options filled is retained as finalallotment.

    During Round I, Round-II and Round-III stage I & II will be repeated twice after stageIII for upward shifts to the all the candidates due to allotment to SBC candidates in stage

    III. The allotment will be displayed on DTE website http://www.dte.org.in/fe2009. The

    allotment list displayed will show only the provisional allotment offered to the candidates. No personal communication/Allotment letters in this regard will be issued to

    the concerned candidates. The logic for the following stages will be implemented using computer software for the

    direct allotment. The candidates securing allotment will confirm the admission by reporting at the institute

    mentioned in allotment along with the original certificates needed for admission, bypaying necessary fees on or before the last date specified for the same. No personalcommunication in th is regard will be issued.

    The admission will be confirmed at the Respective Institute only after scrutiny ofdocuments and payment of fees as prescribed by the Shikshan Shulka Samiti, Mumbai.(Please refer Annexure-I for details)

    6.1.3 Logic for Allotment:The seats available for the implementation of this logic will include the Home Universityarea seats and State level seats for other university area candidates coming under thepurview of Competent Authority. (Refer the Table given in Rule 2.6 for details)

    Stage I: For all the candidates

    All the candidates (open/reserved/male/female) of all the categories shall be consideredfor allotment as per their inter semerit.

    Backward class category candidates shall be considered for allotment in open categoryseat by virtue of their merit or in their respective category of reservation if open categoryseats are not available at their merit.

    SBC category candidates shall be considered for allotment in Open category by virtue oftheir merit or in their original category of reservation, if open seats are not available asper their merit

    Physically handicapped category candidates shall be considered for allotment for theseats reserved for them by virtue of their merit or in open category as per their inter-semerit if the seats reserved for physically handicapped are not available at their merit.

    Defence category candidates shall be considered for allotment for the seats reserved forthem by virtue of their merit or in open category as per their inter-se merit if the seatsreserved for Defence category candidates are not available at their merit.

    For the female candidates, the availability of seat shall be checked in the following order:1. in the seats reserved for females in open category,2. in the general seats in open category,3. in the seats reserved for females in respective caste category as applicable,4. in the general seats in their respective caste category as applicable.

    Stage II : For respective Backw ard Class Candidates

    On completion of Stage I, if any of the backward class categories mentioned above donot get the required number of female candidates for the percentages laid down, theseats so remaining vacant shall be considered for allotment to male candidates belongingto respective Backward Class category.

    Stage II I: For Special Backward Class category candidates

    On completion of Stage-II, if any of the backward class categories mentioned above,does not get the required number of candidates for the percentages laid down, the seatsso remaining vacant shall be considered for allotment to all the candidates (male andfemale taken together) of Special Backward Class (SBC) category, as per their inter semerit, limited to the extent of two percent seats of Maharashtra State seats which arecoming under the purview of Competent Authority for the course.

    Stage IV: For respective groups of B ackward Class category candidates

    All the Backward class category candidates will be considered for allotment in this stagein the groups as mentioned below.-Group 1: i) Scheduled Castes and Scheduled Castes converted to Buddhism (SC)

    ii) Scheduled Tribes including those living outside the specified areas (ST)Group 2: i) Vimukta Jatis/De-Notified Tribes (VJ/DT) NT(A)

    ii)Nomadic Tribes 1 (NT-B)Group 3: i) Nomadic Tribes 2 (NT-C)

    ii) Nomadic Tribes 3 (NT-D)iii) Other Backward Class (OBC)

    On completion of Stage III, the seats remaining vacant in the respective group ofcategories as mentioned above, shall be considered for allotment to the candidates ofrespective group as per the inter semerit of the candidates.

    Stage-V: For all Backward Class category candidates

    The seats reserved for Backward class category candidates remaining vacant aftercompletion of Stage IV, shall be considered for allotment to the candidates of all thereserved categories together, on the basis of their inter semerit.

    Stage VI: For all candidates (without any type of reservation)

    The seats remaining vacant after completion of StageV, shall be considered forallotment to all the candidates (open/reserved/male/female) on the basis of their inter semerit.

    6.2 Direct Allotment-CAP Rounds I , II & II I for the All India seats(AIEEE)-

    These rounds will be carried out for All India (AIEEE) seats which are coming under thepurview of the Competent Authority for AIEEE qualified candidates who have applied foradmission to degree courses in Engineering/Technology.

    Eligible candidates: All the eligible candidates who have a valid AIEEE-2009 (Paper-1)score (i.e. total score is positive) and have been assigned All India (AIEEE) Meritnumber/rank and whose name appear in the merit list for respective CAP roundsprepared by the Competent Authority shall be considered for allotment in these Rounds.

    Seats available: Refer Rule 2.6.1, 2.6.2 and 2.6.3.

    General notes:

    Allotment for these seats will be carried out as per inter semerit of All India (AIEEE 2009paper-1) merit list prepared by the Competent Authority of State of Maharashtra.

    Seats will be allotted to candidates as per their inter semerit, as per the options givenand the number of seats available at that point of time.

    Maharashtra Candidate eligible for All India (AIEEE 2009-Paper-1) and MHT-CET 2009 willbe allotted only one Seat as per the options given and the number of seats available atthat point of time.

    Allotment against the first available Preference in the order of choices mentioned in thePreference form is retained as final allotment.

    The allotment lists will be made available on DTE Website www.dte.org.in/fe2009 .The allotment will show allotment in respective allotment Rounds-I/II/III.

    6.3

    Counseling Round Centralized Round for J&K M igrant seats:Eligible candidates:

    Candidate should be an Indian National and should have passed the HSC (Std.XII)

    examination of Maharashtra State Board of Secondary and Higher Secondary Education

    or its equivalent examination with subjects English, Physics, Chemistry and Mathematics

    and secured minimum 50% marks i.e. 150 marks out of 300 marks in the subjects

    Physics, Chemistry and Mathematics added together.Assignment of merit number:Each eligible J&K Migrant Candidate who has filled and confirmed the online applicationform for Centralized Admission on or before the last date will be assigned a provisionalmerit number.

    Merit of all eligible J &K Migrant candidates will be based on the total marks obtained inPhysics, Chemistry and Mathematics in HSC (Std. XII) only; relative merit in case of a tie(i.e. equal marks in Physics, Chemistry and Mathematics taken together out of 300) shallbe resolved in the order of preference as given below:

    This round will be conducted by counseling as per inter semerit of J&K Migrant merit listand the number of seats available at that point of time during counseling.

    These Admissions will be made strictly in the order of merit from amongst the candidateswho present themselves for admission at Sardar Patel College of Engineering, Andheri

    (West), Mumbai, as per schedule, against the seats available in the various institutes atthe point of time when the candidate actually reports for admission.

    Candidate will have to confirm the admission by the paying the requisite amount of fee tothe respective institute and producing ALL documents in original, to which admission isgranted as per the schedule.

    Admissions once confirmed shall be final and candidate shall not be allowed to seektransfer of their admission to some other institute and/or some other course during entireduration of the course.

    A candidate, who reports later than the time when his / her rank in the merit list requiredhim / her to do so, will be considered for admission against the seats that are vacant andare available at that point of time in various institutions. He / She will not be eligible and

    will not be considered for admission against a seat that would have been offered to him /her at his / her rank in the merit list had he/she reported on time.

    6.4 Reporting of candidates of CAP Rounds, J&K Migrantcandidates:

    Principals/Directors of respective institutes are required to carefully scrutinize all therequired documents submitted by the candidates at the time of reporting. Anydiscrepancy in the claims as type, category, eligibility etc. made by the candidates and/orsuch claims which are not supported by relevant documents should be immediatelybrought to the notice of the respective Regional Office of the Directorate of TechnicalEducation before confirming the admission of such candidates. The Principals/Directors of

    the Institute shall be responsible for issues/litigation arising out of such admissions.

    After the display of allotment of CAP Rounds, candidate should report to the respectiveInstitutes where they have been allotted a seat as per the notified schedule of theadmission process.

    Candidates shall report to the concerned institute with ALL original certificates needed tosubstantiate the claims made in the application regarding eligibility and reservation.

    If the candidate fails to report to the allotted institute within specifiedschedule i.e. on or before the last date of reporting after each allotm ent round,then such a candidate forfeits the claim on the allotted seat.

    If a candidate fails to substantiate the claims made at the time of submitting necessaryoriginal documents within the reporting time for CAP Round, the candidate forfeits theclaim on the allotted seat.

    If a candidate is unable to produce original certificates at the time of his/heradmission on account of admission already secured to some other institution, he or sheshall produce a certificate from the head of the institution where he/she has alreadytaken admission indicating that he/she has been admitted to a particular course in thatinstitution on a particular date and hence original certificates have been retained in thatinstitution. The candidate shall produce the attested copies of the certificates duly

    attested by the Head of the concerned institution. Such candidates shall be required topay the fees immediately at the time of admission and such candidates shall be permittedto submit the required original certificates within 04working days after the date ofpayment of fees.

    After scrutiny of original documents, the candidate will have to pay prescribed full feesimmediately in the form as prescribed by the concerned institute and confirm theadmission offered. In the case of Government, Government aided, University Managedinstitutes and University Departments, candidates are required to pay the tuition fees inthe form of Demand draft in favour of the Principal /Registrar/Director as the case maybe.

    If candidate fails to pay the prescribed full fees within the reporting time for CAP Round,the candidate forfeits the claim on the allotted seat immediately.

    If a candidate is offered admission, his or her original School / College Leaving Certificate(after qualifying examination) will be retained by the concerned Institute. This originalSchool / College Leaving certificate will not be returned to any candidate once admittedto a course at the institute unless the candidate cancels his/her admission. All othercertificates will be verified by the Institute at the time of admission & returned to thecandidate.

    6.5 Counselling Round for vacant seats after CAP Round-IV at Dr.Babasaheb Ambedkar Technological University: for thecandidates passing qualifying (Std.XII ) exam ination from Thane,

    Raigad, Ratnagiri and Sindhudurg districts only: Only those Maharashtra State candidates who have qualified in MHT-CET-2009 for

    Engineering/Technology Degree Courses conducted by the Competent Authority ofGovernment of Maharashtra for the academic year 2009-10, in addition to eligibilitycriteria as regards to educational qualification, will be considered eligible.

    The seats within sanctioned intake reserved for backward class category candidatesfalling vacant shall be made available first to the respective backward class categorycandidates passing qualifying examination from Thane, Raigad, Ratnagiri and Sindhudurgdistricts as per their inter se merit in the merit list of the respective category.Subsequently, vacant seats within sanctioned intake shall be made available to all(open/reserved/male/female) the candidates eligible for this round.

    6.6 Additional Round(s): Counseling Round at Govt., Govt. Aided,University Managed and University Departments only: For all theMaharashtra State candidates on the basis of MHT-CET-2009only.

    If any vacancies remain after the end of CAP Round-IV, the respective Principal / Directorof the Institute/Department shall conduct additional round of admission for all theMaharashtra State candidates (open/reserved/male/female) of all the categories whohave applied through CAP as per their inter semerit of MHT-CET-2009 score.

    The no. of vacancies and schedule of admission should be displayed on the website ofthe Institute, published in a local newspaper and on the notice board of the Institute.

    At the end of the round as mentioned under rule no. 6.5, if any seats of Dr. BabasahebAmbedkar Technological University, Lonere remain vacant, then these seats will be filled

    6.7 Admissi ons to the Seats remaining vacant in Unaided institutionsafter CAP round-IV: (For eligible Maharashtra State candidates and OutsideMaharashtra State candidates)

    The Principal/Director of the un-aided institution has to carry out the admissions for thevacancies after the CAP Round-IV as per the guide lines given in Annexure-II.

The revision in the fees if any, by the Shikshan Shulka Samiti will bebinding on the students who will be admitted in the year 2009-10 and the students takingadmission in these institutes will have to pay the fees accordingly.

    Fees for Additional seats against Tuition Fee Waiver Scheme: same as the feesas approved by Shikshan Shulka Samiti for regular seats.

    Note: No additional fees other than the University Fees as specified by therespective University and Hostel Fees in case of candidates opting for hostel

    accommodation shall be charged at institute level from th e candidates.

    7.3 Fees for J&K Migrant Candidates and GoI nominees:

    Jammu and Kashmir Migrant candidates shall pay the same fees as that of the fees of theGovt. institutes to respective institutes where they have secured the admission.

    Government of India Nominee candidates shall pay the same fees as that of the fees ofthe Govt. institutes to respective institutes where they have secured the admission.

    7.4 University fees:

    Candidates shall be required to pay fees as prescribed by the concerned University fromtime to time.

    7.5 Caution Money deposits:

    Caution money deposits received from the students shall be refunded after successfulcompletion of the course or after canceling the admission. Unless there is any recovery,no deduction shall be made from the caution money deposit. However, the amount ofcaution money deposit shall be transferred to Students Aid Fund in case of Un-Aidedcolleges and credited to Government in case of Government and Government-AidedCollege, if candidate does not apply for refund, within 3 complete financial years after thestudent actually leaves the institution; or, within 3 complete financial years after the dateof successful completion of the course, whichever is earlier.

    7.6 Concession in tuition and other fees:

    All the schemes given below, regarding concession in tuition & other fees shall beavailable to candidates belonging to Maharashtra State only subject to the fulfillment ofthe eligibility criteria specified by respective authorities offering such concession in feesfrom time to time.

    7.6.1 E.B.C. Concession:

    Candidates claiming concessions for Economically Backward Class (E.B.C.) shall produce acertificate from the Executive Magistrate to the effect that the candidate belongs to EBCcategory at the time of admission. They shall, on admission, also submit an application in

    the prescribed form for being granted the concession of free education, to theappropriate authorities through the college to which they are admitted within one monthfrom the actual date of joining of college or as may be required. The students shall notethat applications received after the due date may not be considered and in that case,they will have to pay the necessary fees.

    The concessions in tuition fee at the time of adm ission will be given only forGovernment, University Managed and Government-Aided Institutions.

    The scheme/mode of concessions, scheme of loan scholarship (if any) foreligible EBC candidates, in tuition & oth er fees in the Un-Aided Institutions w illbe announced by the State Government .

    7.6.2 Concession for sons and daughters of teaching and Non-teaching staff ofPrimary, Secondary and higher secondary schools:The candidates claiming concessions for sons and daughters of primary, secondary schooland higher secondary schools (Junior colleges) teachers or non-teaching staff shallproduce at the time of admission,

    (i) A declaration in a format as prescribed by the Govt.(ii) A certificate from Head of school or college in support of the statement made indeclaration duly endorsed by the Education Officer of the Area.The candidate shall, on admission, also submit an application in the prescribed form forbeing granted the concession of free education, to the appropriate authorities throughthe college to which they are admitted within one month from the actual date of joiningof college or as may be required. The students shall note that applications received afterthe due date may not be considered and in that case, they will have to pay the necessaryfees.The concessions in tuition fee at the time of admission w ill be givenonly forGovernment, University Managed and Government-Aided Institutions.

    In case of Un-Aided colleges, such candidates will be required to pay the fees at the time

    of admission. The fees paid by such candidates will be reimbursed by the respectivecolleges only after the concession (if any) is granted by the respective Authority.

    7.6.3 Concession in fees for Backward Class Category Candidates (belonging toMaharashtra State only) in Unaided Private Institutes:

    For SC/ ST/VJ DT NT(A)/N T(B)/N T(C)/ NT(D)/SB C /OBC category candidatesThe scheme/mode of concessions, scheme of loan scholarship (if any) forel igible SC/ST/VJ DT NT(A)/NT(B)/NT(C)/NT(D)/SBC /OBC categorycandidates, in tuition & other fees in the Un-Aided Institutions will beannounced by the State Government .

    However, these candidates will get only that amount of waiver as notified in the circulars

    issued by the Social Justice and Tribal Welfare Departments from time to time, subject tofulfillment of various norms and conditions laid down by these Departments.Note:-

    Candidates claiming for the fee concession under reservation category shall produce therequisite certificates as may be specified by the respective Social Justice and TribalWelfare Departments.

    Strict action will be taken by the State govt. against the institutes violating these norms.7.7 Cancellation of Admission :

    The candidate should have taken admission by paying necessary tuition fee and shouldhave submitted original certificates before he/she applies for cancellation. In case

    candidate fails to submit any of the original documents within the allowedtime lim it, the admission shall be treated as cancelled.

    The candidate desirous of canceling admission shall apply for cancellation in the proforma O and get the printout of the receipt of the online cancellation

    It is mandatory to the Principal/Director of the institution to cancel the admission of thecandidate only through online system and issue the receipt of cancellation to thecandidate.

    7.8 Issue of College Leaving Certificate:

    If during the course of studies, candidate desires to discontinue studies for any reasonwhatsoever, he or she shall be allowed to do so and it shall be presumed that he or shehas cancelled admission at that stage. The Principal shall issue College Leaving Certificateand fees shall be refunded as per the rules mentioned.

    If the admission is cancelled on or before 20 days from the last date of reporting of eachCAP round, the original school or college leaving certificate on the strength of which acandidate was admitted shall be returned.

    If the admission is cancelled after 20 days from the last date of reporting after eachround of CAP, the leaving certificate from the institution where the candidate was finallyadmitted should be issued. A true copy of the original school or college leaving certificate

    retained by the institute may be issued, if requested by the candidate, duly attested bythe Head of the Institute.

    7.9 Refund of Tuition, Development and Other fees after cancellation of

    admission secured through CAP rounds-I/II/III/IV, in Institute level round(s)

    and Vacancy Round(s) of admissions in Government, Aided, University

    Departments and Unaided Institutes:

    The candidate who has been provisionally admitted may cancel admission by submittingan application in duplicate, in the prescribed pro forma - O and may request for refund offees. The refund of fees as applicable shall be made in due course. It is made clear thatsuch application for cancellation will be considered if and only if the admission is

    confirmed by paying the prescribed tuition fee and other fees in full and by submittingthe original documents. Refund shall be made after deduction of the cancellation chargesas shown below:

    8.0 Miscellaneous: The medium of instruction for degree course in Engineering/Technology in all

    the Universities is English.

    Admission of candidate who has been admitted to any course at any college will betreated as finally confirmed only on production of the Eligibility Certificate from theUniversity to which the college is affiliated.

    Physical fitness: Head of the institution at his or her discretion may refer any candidate tothe appropriate medical authority for ascertaining the physical fitness of the candidate toundergo the requirements of the course. The report of medical authority shall be

    submitted to the Regional Head of Technical Education for further necessary action. It isto be noted that physically handicapped candidates are not provided with any additionalfacilities as far as the academic activities pertaining to the course is concerned.

    Head of the institution may verify the antecedents of any candidate through theappropriate police authority. The report received from police authority shall be submittedto the Regional Head of Technical Education for further necessary action.

    9.0 Hostel accommodation in Government/ Government aided andUniversity Departments etc. and in Unaided Institutes:

    Accommodation in Hostel cannot be guaranteed to all the admitted candidates. Hostelfees payable etc. should be ascertained by the students from the Principal of the collegeto which they intend to take admission. The candidates (both boys and girls) are advisedto verify personally whether the hostel accommodation is available or not, by contactingPrincipals of colleges where they are intending to seek admission. The Principal of thecolleges shall consider sympathetically on priority the applications of physicallyhandicapped candidates, sons and daughters of Jammu and Kashmir candidates and GoInominees for Hostel accommodation.

    10.0 Conduct and Discipline for all students & colleges:

    10.1 Notwithstanding anything contained in these Rules, if the Govt. takes any policy decisionpertaining to F.E. admission, then the same shall be brought in to effect at that point oftime as per the directives from the Govt. from time to time.

    10.2 Students while studying in any college, if found indulging in anti-national activitiescontrary to the provisions of Acts and Laws enforced by Government or in any activitycontrary to rules of discipline, will be liable to be expelled from the college without anynotice by the Principal of the college.

    10.3 Action against Ragging:Maharashtra Prohibition of Ragging Act 1999 w hich is in effect from 15 th May 1999has the following provisions for Action against Ragging.

    a) Ragging within or outside of any educational institution is prohibited,b) Whosoever directly or indirectly commits, participates in, abets, or propagates ragging within or

    outside any educational institution shall, on conviction, be punished with imprisonment for aterm up to 2 years and / or penalty which may extend to ten thousand rupees.

    c) Any student convicted of an offence of ragging shall be dismissed from the educationalinstitution and such student shall not be admitted in any other educational institution for aperiod of five years from the date of order of such dismissal.

    d) Whenever any student or, as the case may be, the parent or guardian or a teacher of aneducational institution complaints, in writing, of ragging to the head of the educationalinstitution, the head of the educational institut
