sectionl4Aand section 14 B of the Energy Conservat ion Act, 2001 (52 of 2001) , t he

Cent ra l Governm ent hereby m akes the fo l low ing ru les , nam ely : -

1 .

Short title and commencement.- (1) These rules may be called the Energy

Conserva t i on (Ene rgy C onsum pt i on N orm s and S tanda rds f o r D es igna ted C onsum ers ,

Fo rm , T im e w i t h i n w h i ch , and M anner o f Prepa ra t i on and Im p lem en t a t i on o f Schem e,

Procedure for Issue of Energy Savings Certificate and Value of Per Metric Ton of Oil

Equiva lent o f Energy Consumed) Rules, 2012.

(2) They shal l come into force on the date of the i r publ icat ion in the Of f ic ia l Gazet te.

2 .

Def in i t ions. - (1) In these ru les, unless the context otherwise requi res, -

( a )

Ac t m eans the Energy Conserva t i on Ac t , 2001 ;

( b )

base line year m eans the year i n wh ich the base leve l o f energy consum pt ion i s

used as a reference point for establishm ent and assessm ent of perform ance

w i t h r e g a r d t o c o m p l i an c e o f en e r g y c o n s u m p t i o n n o r m s a n d s t a n d a r d s u n d e r

ru le 4 and ru le 6 respect ive ly ;

( c)

ce r t i f i ca t i on m eans t he p rocess o f ce r t i f y i ng t he ve r i f ica t i on repo r t o r check -

verif ication report by the accredited energy auditor to the effect that the

ent i t l em ent o r requ i rem ent o f energy sav ings cer t i f i ca te i s quant i f ied accura t e ly

in relation to compliance of energy consumption norms and standards by the

des igna ted consum er dur ing the ta rge t year ;

"t arget year" m eans the year by which a designated consumer shall achieve

compl iance wi th the energy consumpt ion norms and standards; .

( n ) ver i f i ca t ion m eans a thor ough and independent eva lua t ion by the accred i ted

energy auditor of t he activities undert aken by t he designated consumer for

compl iance w i th t he energy consump t ion norm s and standards i n t he ta rge t year

compared to the energy consum pt ion no rm s and s tandards in th e basel ine year

and consequent ent i t lement or requi rem ent of energy savings cer t i f i cate;

( o )

y ear m eans the f inanc ial year beg inn ing on the 1

st

day o f Apr i l and end ing on

the 31

st

day of March following.

Words and expressions used herein and not defined but defined in the Act shall

have the meanings respectively assigned to them in the Act.

3 .

Establishment of energy consumption norms and standards.-(1)The Central

G overnm en t , i n consu l t a t i on w i t h t h e Bu reau , sha l l es tab l ish , am end o r r esc ind t h e

energy consumpt ion no rm s and s tandards fo r des igna ted consumers as no t i f i ed und er

clause (g) of sect ion 14 .

( 2 )

The energy consumpt ion norm s and standards shall be specific for every

des igna ted consumer and sha l l be de te rm ined as under : -

( a )

where energy audit of the designated consum er' plant has been completed,

energy saving measures and action plan for their implementation has been

f ina l ised in consul tat ion wi th the energy manager of the p lant under regulat ions 4

and 5 of t he Bureau of Energy Efficiency (Manner and int ervals of Tim e for

Conduct o f Energy Aud i t ) Regu la t i ons, 2010 , the energy consum pt ion norm s and

s tandards sha l l be based on t he t im e ly submission o f Fo rm 2 and Form 3 un der

Rules 2008;

( b )

where energy aud i t o f t he des igna ted consum ers ' p lan t has no t been com ple ted

or undertaken, the energy consumption norms and standards shall be

determined tak ing in to account the fo l low ing fac tors , namely : -

( i )

average rate of reduction in specific energy consum ption across all t he

des igna ted consum er secto r s ' de te rm ined on t he bas i s o f t he ana l ys is o f

data o f the las t th ree years ;

( i i )

policy obj ectives of k eeping t he t arget of reducing the specific energy

consum pt ion a few percen tage po in ts above the average ra t e o f reduc t ion

keep ing in v iew th e incen t i ve p rov ided th rough t he i ssue o f energy sav ings

cert i f icate.

( 3 )

Where the energy consumpt ion no rm s and standards have been de te rm ined in

accordance w i th c lause (a ) o r c l ause (b ) o f sub- ru le (2 ) , t he sa id m ethodo logy sha l l no t

be rev iewed a f te r the com m encem ent o f the energy consum pt ion no rm s and s tandard

not i f ied under c lause (g) of sect ion 14.

( 4 ) The designated consumers shall achieve compliance with the energy

consum pt ion norm s and stand ards as no t i f i ed under c lause (g) o f sec t ion 14 w i th in a

per iod of three years f rom the date of comm encement of t he said not i f i cat ion.

4 .

Procedure f o r es tab l ishm en t o f ene rgy consum p t i on no rm s and s tanda rds . - ( 1 )

For the purpose of establishment of energy consumption norms and standards, the

technical commi t tee set up by the Bureau shal l -

(a) ca lcu late speci f i c energy consumpt ion in the basel ine year and pro jected speci f i c

energy consum pt ion i n t he ta rge t year cover ing d if f e ren t f o rms o f ne t energy go ing

into the boundary of the designated consumers' plant and the products leaving it

over the relevant cycle on a gate-to-gate basis;

(b)

( i)

convert the calor i f ic values of al l forms of energy sources into a single uni t ,

nam ely, ton of o i l equivalent us ing the conv ers ion form ulae speci f ied in the

G overnm en t o f I n d ia , Min is t r y o f Pow er n o t i f icat i on num ber 8 .0 .39 4 (E) ,

dated the 12th March, 2007;

( i i )

consider all form s of energy t hat is, electricity , solid fuel, l iquid fuel,

gaseous fuel, or any other form of energy import ed into the plant for

consumpt ion as energy for product ion o f output ;

(iii)

not take into account energy consumed in the colony attached to the plant,

temporary or major construction work, and for outside transportation

system or energy consumed through renewable energy sources not

connected to the grid;

( i v )

t ake in to accoun t the energy expor t ed ou t o f t he des igna ted consumers '

boundary ;

( v )

i f any des ignated consumers ' p lant does not have d isaggregated f igures

fo r energy consum ed, cons ide r th e ne t energy consum ed fo r ca lcu lat ion

both in base line year and in the target year :

Provided that the said designated consumer shall give adequate

reasons that it was not feasible to make adjustment for energy

consumed in the co lony . tem pora ry o r m a jo r const ruc t ion work :

Provided furt her t hat such designated consumer shall m ake

necessary arrangement s for disaggregation of dat a for energy

consumpt ion to ensure tha t ac tua l energy consumed fo r p rodu c t i on is

considered in the next cyc le;

( v i )

where m ore than one product is produced, select the m ain product

produced o r an equ i va len t p roduc t w o rk ed ou t f r om the p roduc t m i x as

per s tandard p rac t i ce p reva len t i n t he concerned des igna ted consum ers

sector :

Provided that where the production of the said main product is

stopped, the des ignated consumer sha l l in form the necessary deta i ls

in that regard to the Bureau and the concerned state designated

( c)

calculate the speci f i c energy consumpt ion for the basel ine year as wel l as for the

target y ear and norm al ise it by tak ing in to account t he capaci ty ut i li sat ion, m ix of

grid and captive electr icity , and any other factor which affects energy

consum pt ion as spec if i ed i n t he Schedu le ;

( d )

calculate the annual specific energy consumption in the baseline year by

verifying the data in the previous three years, year-wise, using the data

submi t ted by the designated consumers ' under Rules 2007 and i f ver i f ied, under

Rules 2008;

calculate the ef fect of capacity ut i l i sat ion and other factors i f any, on the specif i c

energy consum pt ion for the prev ious three years;

calculate the specif i c energy consum pt ion, pr oduct ion, capaci ty ut i l i sat ion, in th e

baseline year by t ak ing th e average of the prev ious three years in the f i rst cyc le

and for subsequent cyc les, the prov isions of ru le 14 shall apply;

take in t o considerat ion t he ef fect on capacity ut i l i sat ion or th e p lant load factor or

average energy consumpt ion in the t arget y ear on account of any of t he

fo l low ing fac tors , namely : -

( i )

natura l d isaster ; o r

( i i )

r iot ing or socia l unrest; or

( i i i )

major change in the Governm ent policy including environmental

standards; or

( i v ) impact of market (shortage of raw material or sales) in any of the

previous three y ears.

( 2 )

( 3 )

The Bureau sha l l exam ine the repor t subm i t t ed under sub- ru le (2 ) and f i na li se

i t s repor t con ta in ing i t s r ecom m endat ion regard ing the energy consumpt ion norm s and

s tandards fo r each des igna ted consumers ' p lan t .

( 4 )

The details regarding methodology used, formulae adopted, exceptions

considered, principles adopted, for preparation of energy consumption norms and

stand ards shal l be as speci f ied in t he Schedule.

( 5 )

The Bureau shall submit the report referred to in sub-rule (3) to the Central

Government .

des igna ted agency w i th a copy t o Bureau, wh ich m ay i nc lude -

( a )

6 .

Assessment of performance.-(1) Every designated consumer, within three

m onths o f the conc lusion o f the ta rge t y ear f rom the base l ine year sha l l subm i t to th e

State designated agency, wit h a copy to t he Bureau, t he perform ance assessment

docum en t i n Fo rm ' A ' cove r i ng t h e pe r fo rm ance f o r t he re l evan t cyc l e spec if y i ng t he

comp l iance w i th energy consum pt ion no rm s and s tandards, du ly ve r i f i ed toge ther w i th

ce r t i f ica te in Form 'B ' g iven by the acc red ited energy aud i to r and accom pan ied by t he

f o ll ow ing docum ents , namely : -

( a )

copy of unique num ber of regis t rat ion g iven to the designated consum er ;

( b )

proo f o f t im e ly subm iss ion o f repor ts i n Form 1 und er Ru les 200 7 fo r the

( 2 )

to the State designated agency, wi th a copy to the Bureau, for i ssuance of propor t ionate

energy sav ings ce r t i f ica tes cover ing th e pe r fo rm ance fo r a pe r iod o f no t l ess than one

year from the date of not ification specifying t he energy consumpt ion norms and

s tandards , du l y ver i f i ed toge t her w i th cer t i f ica te i n Form 'B ' g i ven by accred i ted energy

audi tor a long w i th the documents ment ioned in sub-ru le (1) .

( 3 )

The accredited energy auditor shall independently evaluate each activity

under taken by the des igna ted consumer fo r comp l iance w i th the energy consumpt ion

norm s and standards and en t i t l em ent o r requ i rem ent o f energy sav ings ce r t i f i ca te , to

ensure that they meet w i th the requ i rements o f these ru les .

( 4 )

The accredited energy auditor, in order to assess the correctness of the

i n fo rmat ion p rov ided by the des igna ted consumer regard ing t he comp l iance w i th energy

consum pt ion norm s and s tandards sha ll -

( a )

apply s tandard audi t ing techniques;

( b )

fo l low th e ru les and regu la t ion f ramed under t he Act ;

( c)

in tegra te a l l aspects o f ver i f icat ion , and cer t i f icat ion fu nct ions;

( d )

make independent technical review of the opinion and decision of t he

ver i f icat ion team ;

( e )

a lso take i n to cons idera t i on , a s i t ua t i on where a par t i cu la r ac t i v i t y m ay or

may not form part of t he activities related to t he compliance with t he

energy consumption norms and standards, and the procedure for the

assessment shal l inc lude, -

(A) document rev iew, invo lv ing-

( i )

review of data and its source, and inform ation to verify t he

correctness, cred ib i li ty and in t erpre ta t ion o f p resented in form at ion;

( i i )

c ross checks be tween in fo rm at ion p rov ided in the aud i t repor t and , i f

com parab le i n fo rm a t i on i s ava i lab le f r om sou rces o the r t h an t h ose

used in the audi t repor t , the in form at ion f rom those other sources and

(B)

( i)

ensure that no re levant in format ion has been om i t ted or , over or under

valued;

( i i i )

rev iew of th e appl icat ion of form ulae and calcu lat ions, and repor t ing of

the f indings in the ver i f icat ion report.

( 5 )

The accredited energy auditor shall report the results of his assessment in a

ver i f ica t ion repor t and th e sa id repor t sha ll conta in , -

( a )

t he sum m ary o f t he ve r i f i ca t ion p rocess, resu l t s o f assessm ent an d h is op in ion

along w i th the suppor t ing documents ;

( b )

the deta i ls of ver i f i cat ion act iv i t ies car r ied out in order to ar r ive at the conclus ion

and op in ion , inc lud ing the det a i ls captu red dur ing the v er i f i ca t ion process and

conclusion relating to com pliance with energy consum ption norm s and

standards, increase or decrease in speci f i c energy consumpt ion wi th reference to

the speci fi c energy consumpt ion in the basel ine year ;

( c)

t he record o f i n te rac t ion , if any , be tw een the accred i ted energy aud i to r and the

des ignated consum er as wel l as any chang e m ade in h is assessm ent b ecause of

the c lar i fi cat ions, i f any, g iven by the d esignated consum er .

( 6 )

I f t he accredited energy auditor r ecords a positive opinion in his verification

repor t , t he Bureau shal l consider that a l l the requi rem ents wi th r egard to th e compl iance

w i th ene rgy consum pt i on no rm s and s tanda rds , en t it l em en t abou t i ssue o r l i ab il it y t o

purchase energy savings cer t i f icate have been m et .

( 7 )

After submission of duly verified Form 'A' by designated consumer, state

des igna ted agency m ay convey i t s com m ents , i f any , on Form 'A ' to the Bureau w i th in

f i f teen days o f the las t date o f submiss ion o f Form ` A ' .

7 .

Procedure for m onitoring and v erification.- (1 ) The designated consumer in

consultation wit h th e accredited energy audit or, shall put in place tr ansparent,

independent and credible monitoring and verification arrangements for energy

consum pt i on and p roduc t i on based on t he Bu reau o f Ene rgy Ef f ic iency (M anner an d

I n te rva ls o f T im e fo r Conduc t o f Energy Aud i t ) Regu la t ions , 2010 fo r comp l iance w i th

the energy consum pt ion norm s and standard, and the said ar rangem ents shall inc lude, -

(a) preparation and maintenance of quart erly data reports by the designated

consumers-

( i )

on the per form ance of the p lant and pr oduct ion processes;

( i i )

on t he i n te rna l f i e ld aud i t s o f p lan t and produc t i on p rocesses fo r t he purpose

of ident i f i ca t ion o f fac tors inh ib i t ing im prov em ents in energy e f f i c iency and

conserva t ion , and tak ing o f m easures to reduce energy consum pt ion and to

imp rove energy e f f iciency.

(b) preparation and m aintenance of yearly data r eport s by t he designated

consumers -

( i)

on the per formance

o f p lan t and p roduc t ion p rocesses ;

( i i )

on th e outcom e o f in te r na l f ie ld aud i ts o f p lan t an d produ ct ion processes

identifying factors inhibiting im provement s in energy efficiency and its

c o n se r v a t i on , a n d t a k i n g o f m e a su r e s t o r e d u c e e n e r g y c o n su m p t i o n a n d

improve energy e f f i c iency and measures taken to improve the e f f i c iency o f

the product ion processes dur ing each year ;

( i i i )

regard ing a year -w ise repor t on p roduc t ion ach ieved , energy consumed,

and specific energy consumption achieved, specific energy consumption

reduc t ion ach ieved , m easures adop ted fo r energy conserva t ion and q uan t i t y

of energy saved;

( c )

preparation and m aintenance of the end of the cycle data r eports on

production achieved, energy consumed, specific energy consumption

achieved, specific energy consum ption reduction achieved, m easures

adopted for energy conservat ion and quant i ty of energy saved.

(2 ) A l l t he ac t i v i t i es under t aken by the des igna ted consum ers under th ese ru les sha l l

be scrut inised by t he accredited energy auditor for th e purpose of preparation of

ver i f i cat ion repor t an d the designated consum er shal l furn ish the fu l l and comp lete data,

prov ide necessa ry docum en ts and o t he r f ac il it i es r equ i red by t h e accred i t ed ene rgy

audi tor for the p urpose of per forming t he funct ion of ver i f i cat ion under t hese ru les.

8. Check-verification.-(1) The Bureau may on its own, or on receipt of a complaint

regard ing any er ror or inconsis tency or m isrepresentat ion, wi th in one year f rom the date

o f subm iss ion o f the com p l iance repor t o r w i th in s ix m on ths f rom the da te o f i ssue o f

energy savings certificates, w hichever is later, shall initiate action for review of

compl iance repor t in accordance wi th the prov ision of sub- ru le (2) .

(2) The Bureau shall in it ia te act ion in accordance wi th t he fo l lowing p rocedure, nam ely-

( a )

a notice shall be issued to the designated consumer as well as to the

accred i ted energy aud i to r w ho had subm i t ted the ve r i f i ca t ion repor t w i th a

copy to re levan t s ta te designa ted agency , to p rov ide com m ents in rep ly to

t he sa id no t i ce w i th in t en w ork ing days f r om the da te o f r ece ip t o f a fo resa id

calculated having regard to the fo l lowing factors, namely: -

The State designated agency may furnish its comm ents on the report within ten

days from the receipt of the report from the sa id accredited energy auditor and in case zyxwvutsrqpon

no comments are received from the concerned state designed agency, it shall be

presum ed that they have no com m ents to o ffe r in the m at ter .

the n um ber of energy savings certificates wrongfully obtained by the

designated consumer on the basis of ver i f i cat ion repor t found to be wrong

and fa lse on check-ver i f icat ion ;

b)

the number of energy savings certificates which the designated consumer

was liable to purchase for non-com pliance with the energy consu mption

norms and standards as found in the check-verification report;

c)

details of the misrepresentation if any and the unfair gain due to such

misrepresentation;

d)

the cost of check- verification.

15) The State designated agency within two months from the date of the receipt of

the report referred to in sub-rule

( 9 )

shall initiate-

( a )

ac t ion t o r ecove r f r om the d es igna ted consum er t he l oss t o t he C en t ra l

Government by w ay of unfair gain to the designated consumer;

b)

penalty proceedings against the persons mentioned

i n the sa id repor t ,

under intimation to the Bureau;

c)

register complaint for such fraudulent unfair

gain i f des ignated consumer

does not pay penalty and loss to t he exchequer in t he specified tim e

m ent ioned in the penal ty proceedings.

Where the check-verification has been initiated on the basis of a complaint

received by the Bureau, the cost of check-verification shall be borne by the com plainant,

establishment of new plant specific energy consumption norms and standards for

designated consumers for the next cyc le.

Specification of value of energy.-(1) The value of per metric ton of oil equivalent

of energy consumed shall be determined by applying the following formula, namely:-

Where-

P =price of one metric ton of oil equivalent(ltoe);

Pc=average price of delivered coal;

Po=price of fuel oil as declared by Indian Oil Corporation Limited;

Pg=price of gas as declared by Gas Authority of India Limited;

Pe = average price of one unit of electricity for industrial sector in the States of

Chattisgarh, Gujarat, Maharashtra, Madhya Pradesh and Tamil Nadu as

specified by the respective State Electricity Regulatory Commission;

all prices shall be as on 1st April of the year for which value of energy is being

specified.

sources of energy in a plant operational boundary t o produce one unit of product, which is defined
