Welcome to Employsure! We are delighted that you have joined the growing number of businesses that are turning to us to assist them in managing their staff.

We have put together this guide to help you get the best out of our services and to set out the service standards that you can expect from us. Helping you to understand what we can do for you is to our mutual benefit. The more that you engage with us, the less likely it will be that you face a dispute with your staff. Ultimately, that is what we are about: helping you to avoid disputes with your staff so that you can staff focused on growing your business.

Before getting into the detail of our services, a bit of information about Employsure and our values. Employsure assists business across Australia, helping them to manage their staff. Our clients range across industries, including manufacturing, retail, transport, education and professional services. They are big and small, from 1,000’s of staff, through to just a handful. The only thing that they all have in common is that they have recognised the risk that their businesses face from staff, if not managed well. We help them with that risk and enable them to get the full potential out of their employees.

The quality of the service that we provide to you is crucial to our success. As part of the Peninsula Group of Companies, almost 25,000 businesses across the globe rely on us to help them day to day. Overview

Did you know that almost 1 in 5 businesses across Australia face some form of claim or investigation for a workplace relations issue each year? That does not include all of those businesses who face difficulties on a day to day basis that do not result in formal action. The statistics are mind boggling really.

Employsure’s clients are far less vulnerable. Under 1 out of every 150 of our clients face a claim after they have engaged our services and those clients then have the comfort that they are not exposed to the cost of litigation. We achieve this through our simple 4 stage process, shown opposite, which provides you with a complete workplace relations solution. This model is tried and tested, with the Peninsula Group of Companies having helped businesses in this way for almost 30 years.

The key to successfully using our services is understanding what we can do to help and when to engage us. Please read this guide carefully as it will help to explain this to you.

A complete review of your workplace relations framework, including practices, employment contracts and staff handbooks, to identify and areas in which you are not complying with current requirements.

Advice

Unlimited expert advice 24 hours a day, 7 days a week, 365 days a year on your day to day workplace relations issues, helping you to prevent issues becoming disputes and disputes becoming claims.

Representation

In the event that a claim does arise, representation in courts and tribunals by Sparke Helmore, one of Australia’s leading workplace relations law firms.

Fair Work Cover

$2million of insurance cover underwritten by QBE for loss suffered as a result of workplace relations claims, including legal fees, compensation, damages and sums payable under settlement.

How it works

HOW IT WORKS 05

You should, by now, have been contacted by one of the consultants from our Compliance team to welcome you to our services and arrange a time to conduct a review with you.

The Compliance team is responsible for reviewing your current practices and workplace documentation, identifying any compliance issues that you face and remedying them.

With your assistance, we aim to complete the compliance review within 2 weeks of our initial welcome call.

The compliance review will conclude with the provision of a compliance report and the installation of a system to ensure your compliance with relevant legislation.

what to expect:

— A dedicated consultant to manage your compliance review process.

— A thorough review of current practices and documentation with issues identified in a compliance report.

— Creation and implementation of a compliant documentation system, including contracts, a handbook and stationery for matters such as leave requests.

— Ongoing support as and when required, including up to date documents when amendments to the relevant legislation occur and additional contracts, if required.

— Up to 2 site visits per year from one of our consultants. Please note that your specific entitlement to site visits depends on the nature of the contract entered into with Employsure. Please see your welcome letter for detail.

— Regular contact from your allocated consultant.

— Additional consultancy services on-site on request. Details of the additional services offered, together with the cost are set out later in this guide.

Our advisers’ skills and knowledge spans industries. We acknowledge that no two clients are the same and our advisers are therefore trained to provide answers that suit your specific business needs. You will not get the rules read back to you. You will get commercial and pragmatic assistance with the problems that they face.

The advice service is unlimited. We do this for a reason. It enables you and your management to take advice without the fear of additional cost. This enables us to be on your side and by your side every step of the way.

Compliance review 24 hour advice1 2

IN DETAIL 06

In the event that you receive a claim from a current or former employee, let our advisers know immediately.

From there, we will compile a report to QBE, who underwrite the Fair Work Cover policy, to see whether the claim is covered. We take complete responsibility for this process, providing updates where necessary.

Assuming the claim is covered, we will help bring it to a conclusion for no additional fee. Where necessary, Sparke Helmore lawyers will be brought in to represent your interests.

The services provided by us and Sparke Helmore include attending hearings, preparing documents for court and conducting any negotiations. We will work with you throughout the claim, helping you to understand the strengths and weaknesses in your position and helping you to make the right commercial decisions.

If the claim is not covered, you will be informed in writing and told the reason why. You will then be offered our consultancy services at the rates described later in this guide to help you bring the matter to a successful conclusion.

Our services are backed by an insurance policy specifically created for us by QBE called Fair Work Cover.

The policy, subject to terms and conditions, provides you with $2million of insurance against claims per year, with a sub-limit of $200,000 per claim.

Providing you seek and follow our advice at the earliest opportunity, the policy covers claims for:— wrongful, constructive or unfair dismissal;— breach of employment contract;— discrimination or harassment; and— whistleblowing;

The sums covered include your legal costs in defending the claim, plus any compensation awarded and any sums paid in settlement.

Please note that cover for any particular claim is determined by all of the terms, conditions and exclusions of the policy depending upon the specific facts assessed at that time.

Additional consultancy services

Our consultants can be engaged to carry out additional consultancy services outside the boundaries of your contract with us.

Please call your allocated consultant to ask them about specific project, but potential engagements might include:

onsite investigations of difficult disciplinary or grievance issues

hands on involvement in performance management processes

workplace mediations

independent opinion on staffing issues

onsite involvement in redundancy processes

development of HR documentation

in house training

coaching and development

The cost of these services is as follows:

*Ex GST. Training and workplace mediation will be quoted separately.

ADDITIONAL CONSULTANCY SERVICES 08

Our promises to you

In providing you with Employsure’s services, we make the following commitments:

— You will be contacted by a consultant to arrange a time to conduct the compliance review within 2 business days of entering into an agreement with us.

— Subject to when you can provide us with any requested information, you will receive a compliance report within 2 weeks of your compliance review meeting.

— If a further visit is required to assist with implementing your new documentation system, this will be within 2 weeks of the compliance report being provided, subject to your availability.

— The telephone advice service is available to authorised callers 24 hours a day, 7 days a week, 365 days a year.

— Any emails sent to our advisers will be responded to within 24 business hours.

Complaints are taken seriously and are dealt with in a uniform way. You will receive a first acknowledgment from us within 2 working days. A proposed resolution to the complaint will then be issued to you within 10 working days. If for any reason there is an unavoidable delay in issuing a response to the complaint you will be informed and a new deadline issued/agreed.

what can i get help with?

In short, any workplace relations issue. This covers:

will Employsure provide us with employment contracts?

Yes, if required. Some clients need completely new contracts, which we provide. Others just need their existing ones updated, which we also do for them. There is no extra charge regardless of how many new contracts you need.

i don’t have any documents, what happens to me?

A number of our clients have simply been too busy to get employment contracts in place, others are just starting up. In this case, we review any verbal agreements in place with existing employees and reflect these in new documents.

what other documents do we get?

Everything that you need to achieve compliance. This ranges from an employee handbook, to leave forms, to template letters to support our advice service.

FAQ’S 10

How much advice are we allowed to get?

There is no limit to the amount of advice that you can ask Employsure for. Some of our clients call us every day and we encourage that. We want to help to avoid minor issues from becoming claims by assisting at the outset.

The Fair work ombudsman has told us they will be auditing our business. what do we do?

Call us. We will help you to manage any Fair Work Ombudsman investigation and identify any problems, so that you can prepare for them. Our team deals regularly with the Fair Work Ombudsman and can give you clear and sound advice in respect of any investigation.

we already have a claim against us, can Employsure help?

Yes. A number of our clients start with us with problems. We can help to resolve them. However, you should be aware that pay-outs for pre-existing claims are unlikely to be covered under the terms of the insurance policy.

Can you help with independent contractors?

Yes. We will review their status as part of the compliance process. If they in fact appear to be employees, we will let you know.

who are the advisers?

Our advisers come from a range of backgrounds, some from law firms, others were previously barristers or worked for an employer association or union. The mix gives us an excellent breadth of specialisms, helping us to provide you with the highest quality advice.

where can i get the insurance policy terms?

Group training

As an Employsure client, you have exclusive access to client training sessions at no additional charge. These are typically half day sessions on topical workplace relations issues held at a venue close to your business. Recent topics have included:

— the practical effect of the amendments to the Fair Work Act

— complying with Modern Awards

— managing by appraisal

You will be invited to any upcoming sessions that are close to your business and will be entitled to have two staff attend.

We also run client training by webinar, which you will be notified of by email.
