functions, tasks, powers and organizational

DECIDES:

Article I.~ To approve adjustments and

supplements to the master plan on developmentof Vietnam's inland waterway transport up to

2020, with the followingprincipal contents:

I. Viewpoints ond objectives fot' the

development of Vietnam's inland waterwaytransport up to 2020

1.Development viewpoints

- To make the best use of natural conditions

and, at the same time, make planned intensiveinvestmentinorderto takefull advantageofinland

waterway transport (transport of cargo in bulk,

extra-longandextra-heavy cargowithlowfreight,minimizing environmental pollution) for the

development of inland waterwaytransport tomeet

socio-economic development and internationalecononuc integratIOn requirements and ensure

sustainabledevelopment.

- To develop in a coordinated mannerwaterway transport in terms of channels, routes,

ports,wharves, loadingandunloadingequipment,

means of transportandmanagerialcapacity so asto meet the fey uirements on cargo and passenger

transport with safety, increasingly improved

quality and at reasonable freight and fare rates.

- To invest in inland waterway infrastructure

linked with other transport networks in order to

form a continuous and smooth transportsystem.

Tocombine the developmentof inlandwaterway

transport with other sectors such as inigation,

hydropower, etc.

- To develop a flC"C"J ofnew ships and a rationsI

structuresuitable to waterwaychannels,ensuring

transportsafety.

- To diversify sources of investment capital

for inlandwaterwayinfrastructuredevelopment.

The Statewill investin renovating, upgrading and

maintaining waterway channels and routes andtogetherwithenterprises, investin importantkey

ports.

2. Deselopment objectives

-Transport:

To meet social requirements on high-qualityand competitive transport services at reasonable

freight and fare rates; to expand some new

transport routes such as coastal, international,containerand LASH routes.Todevelopa fleet of

new ships(with an average age of 5-7years) and

a rationalstructure (pullingand propellingships:30-35%; self-propelled ships; 65-70%); the fleer's

total tonnage will be 12 million tons.

- Infrastructure:

Toextend thelengthof managedand operated

inland waterways; to ensure the same level of

navigationin some major waterway channelsandroutes; tomodernizethesignahngsystem; to build

canalsforriversections crossing bigurbancenters.

Tomodernize some major ports in keyeconomiczones and special-purpose purls; lu increase the

rate of mechanizedloadingand unloadingin local

pons; tobuildsomepassengerports and wharves.

- Building of new inland waterway vessels:

To developshipyardsin thenortherndeltaandMekong RiVCT delta regions which wi IIbe capable

of building and repairing all inland waterway

vessels.

II. Principal contents of the master plan

1. Transport development planning (seeAppendix I.):

- The annualcargo transport growth rate will

be6.73-7.02% on average in tonsand 7.02-9.6%in ton-kilometers; 6.93~8.32%in passengers and

8.3-11 %inpassenger-kilometers. Specifically, by

2020, 190-210 million tons of cargo will behandled and 530-540 million passengers

transported.

- Transport fleet: By 2020, there will be 12milliou tons uf crafts and one million passenger

seats, with self-propelled ships accounting for

65% and pulling and propellingships, 35%.

propellingships: 1,200-1,600 tons;self-propelled

ships; d"500 tons; riverway-cum-seaway ships:I ,000-2,000 tons; a normal-speed passenger ship

will have50-120 seats; and an express passenger

ship will have 50-90 seats.

No. 16/2000/QD-TIg of February 3, 2000, to

supplement the planning on some routes andadjust technical parameters and grades of the

followingroutes:

In the northern region (seeAppendix 2):

To adjust the planning on oroutes: eua Day­

NinhBinh, LachGiang-Hanoi, QuangNinh-Ninh

Binh (through Dao river, Hai Phong), QuangNiuh-Hai Phong-Hauoi (tluough Duung ri ver),

and QU3JJg Ninh-Pha Lai.

- To supplement the planning on 7 routes;Quang Ninh-Ninh Binh through Lach Tray

Estuary (in order to reduce cargo volumes

transported throughDaoriver, HaiPhong); Hanoi­

Viet Tri-Lao Cai; Vie; TIi-TuY\:;II Qual 19-N a Hang,

Hong Da Tjunction-Hoa Binh port; Pha Lai-Da

Phuc; PhaLai-ALu;and Ninh Binh-Thanh Hoa.

In the southern region (see Appendix 3):

To adjust the planning on 4 routes: CuaTieu­

Cambodia, Dinh An Estuary-TanChau, Sai Gon­Ca Mau (through Xa No canal), and Sai Gon­

Kien Luong (through Lap Vocanal).

To supplement the planning on 10routes: SaiGon-Ca Mau (coastal); Sai Gon-Kien Luong

(crossing Dong Thap Muoi and Long Xuyen

Quadrangle); Sai Gon-Ben Sue; Sai Gon-BenKeo; Sai Gon-Moe Hoa; Moe Hoa-Ha Tien; Sai

Gon-HieuLiem; Phuoc Xuyen Canal-Canal 28;

Rach Gia-Ca Mau; and Vung Tau-Thi Vai­

Mekong River delta.

In Central Vietnam(secAppendix4):

Tosupplementtheplanningon 10routes: LachTrao-Ham Rang, Lach Sung-Len Bridge, Cua

Hoi-Ben Thuy-Do Luong, Cua Sot-Nghen

- Cargoports: To adjust the sizeof? ports and

supplementthe planningon 34 ports, including5

new ports.

and supplement the planning on 4 ports.

- In the Hanoi regron: To study the

transformationofHanoi port into the one serving

tourismin combinationwith clean cargo loadingaud unloading. To tum Pliu Dong port into the

one specialized in container loading and

unloading. In the Nam DiOO region, Nam Dinhport will be transformed into a passenger-and clean

cargo port; the cargo loading and unloading port

will berelocated to a suitable place.

In the southern region (see Appendix 6):

- CaD Lanh, My Thoi and Vinh Long pons

were approvedby thePrimeMinister in DecisionNo. 1024/2005/QD TTg on seaport group No.6

(which are not included in the list of inland

waterway ports under this master plan).

- To supplement the planning on 26 cargo

ports, including 5 new ones, and 15 passenger

ports.

To supplementthe planning on 6 cargo ports,

including one new port.

4. Major solutionsand policies

aJ Infrastructure development investment

policies:

-TheStatewillinvestinrenovating, upgradingand maintaining waterway channels and routes

anddevelopingmajor ports in importantareas inorder to ensure the proactive operation of the

system of inland waterway ports for socio­economicdevelopment.

-The Stateencouragesandfacilitates domestic

andforeignorganizations andindividuals to invest

capital in building works on waterway transportroutes and ports under the approvedmaster plan

in the form of BOT contract or joint venture

according to current regulations.

- For state budget-funded new ports and

wharves, theStatewillgradually allowenterprises

to hire infrastructure for commercial operation,and recover pan of investment capttal,

- The State encourages different economicsectors to provide transport services. State

enterprises will hold only 10-15% of the market

share in order to play their pivotal role,concentratingon major commodity items.

- To further specify such specialized laws as

the Law on Cooperatives and the Law onEnterprises forpromotingproduction andcreating

a healthy competitive environment in transport

activities, firstof alla modelcharter for transportcooperatives.

cl Human resourcedevelopmentpolicies:

-Tointensify investment inspecialized traininginstitutions and enable them to keep up with the

transportsector'sdevelopment, acquireand applymodemtraining sciences andtechnologies tomeetthe country's development and internationaleconomicintegration requirements.

- To adjust in an appropriatemanner trainingdurations and contents at each level, especially

for professional certificates of shipmasters,chief

engineersand specializedtechnical managers.

- To formulate criteria for state managementtitles.

- To provide basic and advanced training formanagers who havenotyetobtainedprofessionalqualifications as required.

dI Renewal of specializedstate managementorganization:

- To reorganize the strucmre of the VietnamInlandWaterwayAdministration accordingto theLaw on InlandWaterway Transportas an agencyperforming specialized state managementnationwide.

- On the basis of reviewing, assessing and

drawing experience in the pilot equitization ofriverway management sections, to study andpropose suitable models, mechanisms andpolicies

applicable totheremainingriverway managementsections.

- To increase the number of port authoritiesformanagingcentrally managedtransportroutes.

reorganization. to pay attention to financial

mechanisms applicable to port authorities.

- To increase inspection forces to reach each

length of rivers and canals. To apply packaged

staff and finance mechanisms in and, at the same

time. define specific tasks of waterway

inspectorates in order to avoid overlapping the

functions and tasks of waterway police and

registry offices.

Article 2.- Organization of management and

implementation of the master plan

1. Ministries, branches and provincial I

municipal People's Connnittees shall, within the

ambit of their functions. tasks and powers.

coordinate with the Ministry of Transport in

implementing the objectives of the master plan

on inland waterway transport development,

ensuring uniformity and synchrony with the

implementation of socio-economic development

plans of branches and localities.

2. Management of the master plan

- The Ministry of Transport shall decide the

adjustment at ports under the master plan. In case

the adjustment or supplementation of the master

plan is proposed by investors and provincial-levelPeople's Committees based UII their actual

conditions, Vietnam Inland Waterway

Administration shall submit such adjustment or

supp1cmcntiltion propoMJ to the Ministry f OT

consideration and approval according to its

competence to meet socio-economic development

requirements.

-The Vietnam InlandWatelWay Administration

is responsible before the Minister of Transport for

managing the master plan and coordinating with

local functional agencies in organizing the

implementation of the approved master plan.

- Investments in renovating, upgrading or

bui lding inland waterway channels and routes as

well as ports and wharves must suit the approved

master plan and comply with investment and

construction management regulations.

- Before approving their local inland waterway

transport development plannings, People's

Committees of provinces and cities shall reach

agreement with the Vietnam Inland Waterway

Administration in order to avoid overlapped

investment and ensure uniformity fromthe central

to local levels.

- The building of river-spanning works and

irrigation works on waterway transport routes such

as road and railway bridges, power grids. water­

partition and -taking sluices, etc., must be

consulted with the Vietnam Inland Waterway

Administration in order to ensure the suitability

of their works' sizes to inland waterway grades

under planning.

Article 3.- This Decision takes effect 15 days

after its publication in "CONG BAO."

Article 4.- The director of the Ministry's

Office, the director of the Planning and Investment

Department, the director of the Vietnam Inland

Waterway Administration and heads ofconcerned
