A few years ago banks were reluctant to participate in mortgage finance because of a number of limitations
such as the fact that their sources of funding (deposits) were short term and housing finance by nature is long term. Other limitations included:
Unfriendly land laws;
Absence of real estate developers
High costs of collateral enforcement
A court system that tended to favour borrowers
High level of borrower moral hazard
To solve the short-term source of funding, the government, through the Bank of Tanzania, established the Tanzania Mortgage Refinance Company Limited (TMRC) on January 29, 2010 to provide long-term liquidity to participating banks in order for them to offer long-term mortgage products to individuals.
Participating banks own TMRC. There are, so far, 11 member banks of TMRC, each contributing no less than Sh500 million and the World Bank financing over $30 million. Further financing is expected to be from corporate bonds.
The enactment of the Mortgage Finance (Special Provisions) Act 2008 and the Unit Titles Act of 2008 brought about the most
practical reforms to facilitate mortgage financing, consolidating the reforms of 2004.
The reforms included a 60 days’ notice of intention to sell mortgaged property, down from 90 days; permitted the sale of collateral in respect of a dwelling house or any land for agricultural use purposes without recourse to the courts.
The reforms provided statutory right of immediate possession to a buyer of a mortgaged property purchased through the exercise of the power of sale upon accepting the bid in a public auction.

REFORMS
• Relax the limit on long-term mortgage loan repayment period from current 20 years maximum to 30 years as current period of 10-15 years is too short given average salaries.
• Amend the definition of “public interest “in the Land Acquisition Act, R.E 2002. Currently, property may be acquired to be given to another person and no provision for recognition of a bank’s interest in such property.
• Amend the Evidence Act to provide for electronic evidence admissibility, which is necessary for the secondary mortgage market.Given that Tanzania has one of the lowest mortgage debts to GDP at 0.30 per cent ratio and that the estimated demand for housing is estimated at 2.2 million units, there is a case for Tanzania to complete the reforms.Written by: Eve Hawa [email protected], 4th July 2013
a borrower takes action to stop a sale, the court may exercise the power under the Land Act to stay the sale but it has to be certain that the borrower is likely to be able, within a reasonable period, to pay any sum due under the mortgage and that there is sufficient value in the mortgaged property that despite the delay, in the event that the borrower fails to pay the sum due, the bank will likely recapture the amount of its entire claim from the sale of the property
The Unit Title Act 2008 introduced, for the first time, sectional property ownership including the right of a unit owner to mortgage his unit and for the unit to be transferable.
Perhaps one of the most significant reforms is the amendment to the Civil Procedure Code to provide for summary procedure for suits arising from Mortgages in order to shorten the time it took to realize collateral. Too often borrowers misused court process to buy time making it very costly for banks to realise collaterals. The amendment restricted the grounds by which a borrower may be allowed to defend himself to two namely that the loan has been repaid or that the
loan was not taken.
What more reform?
• Provide legislative framework for proper transfer of mortgages. The current provisions require payment of the underlying loans which makes the transfer of mortgages impossible because if the loan is repaid what mortgage charge could a paid lender have to pass on.
• Permit real estate developers to own right of occupancy over the properties in their names so as to transfer them easily to individuals. Currently, a foreign real estate developer has to obtain a derived title from Tanzania Investment Centre. The problem for such a developer would be how to transfer title from a company that holds a derivative title to individual Tanzanians entitled to non-derivative title. In Tanzania nobody owns land. It is owned by the President on behalf of the people. A derived title offers no further protection and is strange to our laws.

The data suggests that the nationwide average amount recouped for a bathroom remodel is about 58%. For a new roof, it’s even less. TIME SHARING a form of property ownership under which a PROPERTY is held by a number of people, each with the right of POSSESSION for a specifi ed time interval. Time – sharing is most commonly applied to resort and vacation properties. Often there is a network whereby vacation dates and location can be exchanged.Example: Ingram is an owner in a time- sharing arrangement for a lake front cottage.
