1. I am over eighteen (18) years of age and arn competent to testify to the matters set fonh

herein fi-om my personal knowledge. Further: I am aware of the allegations of the Amended

Ceinipiaint in. this action.and ?m familiar with the events underlying the aliegations in the Amended

Complaint.

This affidavit is being submitted in suppon of the Motion 1'or Summary Jud¢mentof

Defendants Ohici Department of Commerce and Director Kimberly 7urz.

I am the Chief of the Bureau of Labor and Worker Safety ("LAWS"). Division of

Industrial Cornpliance and Labor, for the Ohio Department of Commerce. In my capacity as Chief

of 1r1WS, I assist Ohio Department of Cotrunerce Director Kimberly Zurz in administering

compliance>vith Ohio prevailing wage law, R.C. 4115.03 et seq: and am familiar with the process

for deterniining whether a prevailing wage law violation has been committed:

4. W}ren a complaint alleging failure to pay prevailing wkee is lodged with LAWS: we

review the compl?int for validity throuah doeunicnted ev-idenee. If a complaint is vqlid. a

Commerce investieator is assigned to detetmine wliether the contractor who is the subject of the

cotiiplaint actually paid the prevailing wage o the project at issue.

The investigator scnds a letter to the contractor and asks for several different types of

documentation. including but not limited to certified payroll docunients. canc.eled checks.

timesheets. fl'inue benefit doctnetnation, apprenticeship progratns, aiid anv other docutneitts

evidencing work hours of or payment to employees. A true and accurate copy of an Audit Letter

sent to Gaylor on one of its projects is attached as Exhibit A to this Affidavit.

b. Contractors have the opponunity to paiticipate in the audit process with tltc invesligator

and to provide any documentation or other evidence showing they paid their employees in

accordance with Ohio prevailing wage law. They also have the opportunity to discuss with the

investigator his or her preliininary findines. A irve and accurate copy of a Preliminary Finding

Letter sent to Gaylor on one of its projects is attaclied as Exhibit B to this Affidavit.

7. Based on the information provided by the contractor and, in some cases. other sources,

the investigatur conipletes the audit and makes a recommendation to me.

8. 1 review the investigator's recommendation and the file. If the investigator finds no

violation and. based on my review I aeree the contractor paid the prevailing waee on a project,

LAWS does not issue a finding of violation and closesthe file.

9. If the investigator recommends a findine of unintentional violation, and I agree that the

contractor failed to pay the prevailing wage on a project but that the failure was unintentional, I

issue a written notice to the contractor of that findine. A nve and accurate copy of a Determination

Letter sent to Gaylor on one of its projects is attached as Exhibit C to this Affidavit.

10. The Determination Lener infonns ihe contractor that the aud'at revealed violations of

Ohio's-prevailing wase law and_that it has been determined tliat back wages are due the employees

who perfotmed work on the project under audit.

11. The Determination Lettet' also dcmands payment of the back wages owcd to the .

employees and the statutorilymandated penaltv withinthitty (30) days and advises that sixty (60)

days after.the date of the 1-etter. unpaid ponions of that aaxiount will be forwarded to the Ohio

Attomey General's Office.

12. If the contractorpay& the_fall amo.unt within sixty (-60) days. LAWS distributes thefitnds

to tlie employees and closes the file.

13. ]f the contractor does not pay the full amount within sixty (60) days of the rlate of the

Determination Lztter. I forward the file to the Ohio Auorney General's Office. Labor Relations

Section. to commence legal proceedings to enforce the findina:

14. If the contractor disasrees with the finding. it can refuse to pay the determination

mnount and litisate the issue in cour[ with the Ohio Attornev Gencral's Office. Every vear. at least

several dozen contractors litigate ihe prevailing wage enfor'cement action ratlter. than pay the

detetmination amount.

15. In certain circutnstances. in addition to recommending a finding of violation. an

investiaator makes an additional recommendation to mc that the violation is intentional.

16, If the investigator recommends a finding of intentional violation, and 1 agree that the

contractor failed to pav the prevailing wage on a project a.nd that the failure wa5 intentional, l issue a

written notice by certified mail to the contractor of'tltat finding. A true and accurate copy of a Form.

Intentional Violation Lxtter has been attached as Fxhibit D to this Affidavit.

of Industria] Cotnpliance and Labor, for the Ohio Department of Commerce. In my capacity as

Assistant Chief of LAWS, I assist Ohio Department of Commerce Director Kimberly Zurz in

adniinistering compliance with Ohio prevailing wage law, R.C. 4115.03 et seq. and am familiar

with the process for detennining whether a prevailing wage law violation has been committed.

4. On December 23, 2009,1 received a request from Richard Myers, the Assistant Director,

Public Facilities Management for Franklin Goupty, for all complaints and determitiaticins by our

office against severai contractors, including Gaylor, Inc. ("Gaylot"). I have attached a true and

accurate copy of the Myers Rcqnest as Exhibit A to this Affidavit.

5. ln response to Mr. Myers' request, t searched our database and, with specific respect to

Gaylor, found fourteen records of prevailing wage compaints and/or detertninations. I have

attached a true and accurate copy of thc Gaylor Records as Ezltibit B to this Affidavit.

6: 1 subsequently forwarded the Gaylor Records to Mr. Myers.

7. The Gaylor Records show that Gaylor has failed to paythe prevailing wage on several

projects, but in each instance of a finding of violation, it has made restitution.

8. LAWS has never pursued a finding of uitentional violation against Gaylor. nor. has it

ORDER

A continued preliminary pretrial conference was held on May

12, 2009. All parties were represented.

Plaintiffs intend to seek to join additional plaintiffs, which

will impact the issues addressed in the motion to certify and to appoint

lead counsel, Doc. No. .7. Under these circumstances, and with the

agreement of plaintiffs, the current motion, Doc. No. 7, is WITHDRAWN

without prejudice to the filing of a new motion no later than July 15,

2009. Defendant may have thirty (30) days thereafter to respond.

Motions addressing the parties or pleadings may be filed, if

at all, by July 15, 2009.

The parties may, without further leave of Court, agree to

exceed the limits on discovery established by the Federal Rules of Civil

Procedure or the Local Rules of this Court. Absent agreement, the

parti-es will arrange a conference with the Court.

Disclosures relating to primary experts must be made by

October 31, 2009. Responsive disclosures.must be made by November 30,

2009. If the expertis specially retained, the disclosures must conform

substance ofthe testimony expected to be provided by the expert and (3)

the bases of any opinion expected to be offered by the expert.

All non-expert discovery must be completed by September 30,

2009. All expert discovery must be completed by December 31, 2009. The

parties are advised that the discovery completion date requires that

discovery requests be made sufficiently in advance to permit timely

response by that date.

Motions for summary judgment may be filed no later than

E'ebruar.y 15, 2010.

This case will be available for final pretrial conference in

May 2010, or as soon thereafter as the Court's calendar permits.

If any date set herein falls on a weekend orlegal holiday,
