COUNCIL MANAGEMENT REPORT Agenda Item 6.1 27 February 2007 FENCELINE EXTENSION APPLICATION AT SIDNEY MYER MUSIC BOWL FOR THE 2007 FUTURE MUSIC FESTIVAL Division Commerce and Marketing Presenter Scott Chapman – Director Commerce and Marketing Purpose 1. To request approval from Council for the extension of the fenceline at the Sidney Myer Music Bowl (SMMB) for the 2007 Future Music Festival on 11 March 2007. Recommendation from Management 2. The fenceline extension for SMMB contravenes the “ Guidelines for sustainable management of events staged in the City of Melbourne’s Parks and Gardens”. 4. The Kings Domain Garden is Crown Land permanently reserved as a “Public Park” under the provision of the Crown Lands (Reserves) Act 1978 and over which the Council has been appointed Committee of Management. 5. Any extension of the current fence line of the SMMB limits the public’s use of and ability to enjoy a public park and could be perceived as a commercialisation of the parklands. In the past resident groups have expressed strong objection to any increase in the capacity of the SMMB. 6. Events conducted within SMMB operate under different regulations to those conducted in Kings Domain. Time Frame 7. The Future Music Festival is scheduled to be conducted on 11 March, 2007. City Plan 2010 Strategic Direction 3.5 – “ Protect Melbourne’s distinctive physical character and ensure it continues to develop a strong ‘sense of place and identity’” has the objective to: 8.1.1. Provide and maintain a variety of quality parklands and informal public spaces to meet the passive and active recreational needs of the community ”.

Purpose

1. To request approval from Council for the extension of the fenceline at the Sidney Myer Music Bowl (SMMB) for the 2007 Future Music Festival on 11 March 2007.

Recommendation from Management

8.2.2. “Support and encourage cultural activity within the public domain”.

8.3. City Plan 2010 Strategic Direction 3.9 – “Attract, facilitate and maximise benefits of major City events and festivals” has the objective to:

8.3.1. “Facilitate the provision of event facilities and encourage major city events and festivals in a range of public spaces throughout the City”.

Consultation

9. Discussions with the Melbourne South Yarra Residents Group has indicated a strong objection to the extension of the SMMB fence-line for events.

10. The Victorian Arts Centre Trust would support the extension of the SMMB fence-line for selected events.

Government Relations

11. The Department of Sustainability and Environment representing the Minister responsible for Crown Land (Minister for Planning) has advised

”--- any use of the Kings Domain Gardens would need to rely on an appropriate tenure under the Crown Land (Reserves) Act 1978 (the Act). The Kings Domain Gardens have been previously certified by the Governor in Council under Section 17(1) of the Act, which allows the Council, as Committee of Management to grant licences or enter into agreements to operate services and facilities for any purpose consistent with the purpose of the reservation for a term not exceeding three (3) years.”

12. The Department has also advised that while the regulations for the Kings Domain Gardens allow for Council to give permission for events to occur and for the construction of booths, tents, and other structures, there is no provision allowing for the direct charging of entry fees by Council. However, provision could be made for such entry fees to be part of a licence agreement with the event operator.

13. There are no direct financial implications for Council arising from the recommendations contained in this report.

Sustainability

15. The additional area of parkland sought has a large number of established trees located within the extended fence. These trees form part of an important collection of trees proposed under the domain Master Plan to comprise the Domain Parklands Arboretum. The root zone of these trees together with the general lawn areas would be subject to increased compaction from crowd movement, and particularly dancing. The cumulative effect of this is a concern for the long-term health of the trees. Previous events held in this area have revealed that climbing of trees by event patrons frequently occurs and is difficult to prevent.

Comments

16. The SMMB fenceline extension approved by Committee on 10 October 2006 for the 2007 Summadayze event resulted in no adverse impact on the parklands.

17. Future Entertainment, the event organiser of the Future Music Festival, is well regarded and conducts a number of well attended events within the City of Melbourne.

Background

18. Future Entertainment has applied for a fenceline extension for their Future Music Festival to be held within the SMMB on 11 March 2007. This extension request is the same as that approved by the Marketing and Events Committee on 10 October 2006. As a result of this resolution Future Entertainment included approximately 700-800 square metres of public land within the fenceline surrounding the SMMB for the 2007 Summadayze Festival.

19. At the Marketing and Events Committee on 10 October 2006 a resolution was passed requesting a report be presented to the Marketing and Events Committee exploring the options presented in the Management Report. This report is on the scheduled agenda for the 13 March Marketing and Events Committee.

FENCELINE EXTENSION APPLICATION AT SIDNEY MYER MUSIC BOWL FOR THE 2007 FUTURE MUSIC FESTIVAL

The SMMB and Kings Domain each has its own Committee of Management under the Crown Land (Reserves) Act 1978 and is subject to differing regulations under that Act.

The Regulations in respect to the Kings Domain prohibit the bringing, carrying or taking into the reserve of alcohol or its consumption.

If the Future Music Festival allows alcohol, it will be necessary for the operators to ensure patrons do not take alcohol from the SMMB area into the area of the extension.
