Chapter III:  Registration of Establishing :

 

Sec 7:

 

The employer makes a triplicate application within 30 Days form the

AP Rule 26:

 

The application shell be accompanied by a treasury receipt showing payment of

fee.

The fee payable as specified below if the no of workmen on any day is as follows:

AP Rule 32: An establishment requiring the employment contract labour

immediately and such employment is not more than 15 days the principal

employer or contractor may apply for a temporary certificate of registration or

license.

Chapter IV: Licensing of Contractor

 

Sec 12:

 

Any contractor make an application in form IV (Under rule 21 (1) to the licensing

officer.

 

No contractor shall undertake or execute any work through contract labour

except with a license issued by the licensing officer.

 

Required documents to apply for license:

 

1. Application form (Form IV) (Under AP rule 21 (1))

2. Certificate of principal employer (Form V) (Under AP rule 21 (2))

3. Work Order

4. Undertaking letter form principal employer

5. Security deposit: (AP rule 24:)

The contractor shall be deposit at the rate of 50/- for each workman to be

employed at the time of application applied for license

 

Note: if the central labour dept it should be DD, if state labour dept treasury

challan

 

License Fee: (AP rule 26):

 

The fees payable by the contractor shall be as specified below:

AP rule 27 :  Every license shall remain in force for 12 month from date it is

granted or renewed.

 

AP Rule 29:  Every contractor shall make not less than 30 days before the date

on which the license expires.

 

Chapter V:  Welfare and Health of contract labour

 

AP Rule 40:

 

The contractor is the responsible for providing

 

Sufficient Drinking Water

Washing Facilities

Rest room

 

Latrines:

 

1 latrine for every 25 male/ female workers for the first 100

if more than 100 workers 1 latrine for every 50 male/ female workers

Separate latrines for man and woman workers shall be provided and

notice displaying sex shall be kept in language understood by majority of

the workers

 

Urinals:

 

1 Urinal for every 50 male/ female workers for the first 500

if more than 500 workers 1 Urinal for every 100 male/ female workers

Separate Urinals for man and woman workers shall be provided and notice

displaying sex shall be kept in language understood by majority of the

workers

 

 

First Aid Facilities:

First aid boxes shall be provided and maintained so as to be readily assessable

during all working hours at the rate of not less than 1 box for 150 contract labour

or part thereof ordinarily employed.

 

For an establishment the first aid box (in which the no of contract labour

employed ) shall contain the following equipment:

Canteen:

Where employment of contract labour is likely to continue for the 6 (Six months)

and the number of contract labour employed is 100 or more, an adequate

canteen has to be set up within 60 days form the date the commencement of

work.

 

The canteen shall be maintained by the contractor or principal employer, as the

case may be in an efficient manner.

 

If the contractor fails to provide the canteen within the time laid down, the same

shall be provide the principal employer within sixty days of the expiry of the time

allowed to contractor.

 

Chapter V:   Wages

 

A contractor shall be responsible for payment of wages to each worker employed

by him as contract labour.

 

(AP Rule 64):

 

The contractor shall fix wage period but not accessed 1 (One) month.

 

(AP Rule 65):

 

Date of payment:

 Employees less than one thousand (1000)

Employees more than one thousand (1000)

before expiry of the seventh (7) daybefore the expiry of tenth (10) day

after the last day of wage period

 

(AP Rule 66):

 

Any worker terminated by the contractor, the wages earned by shall be paid

before expiry of second working.

 

(AP Rule 67):

All payments of wages shall be made on a working day at the work place and

during the working hours.

 

Final payment shall b made within 48 hours of the last working day.

 

(AP Rule 70): Deductions:

 

Wages shall be paid without any deductions of any kind except those specified

by the state government and permissible under the payment of wages act 1936

 

(AP Rule 73):

 

The authorized representative of principal employer shall record under his

signature a certificate at the end of the entries in the register of wages in the

following form:

 

"Certificate that the amount shown in column No ____________ has been paid to

the workman concerned in my presence on ______________ at ___________"

 

Chapter V:   Registers & Records

 

Every principal employer shall maintain the following registers:
