There is no industry or economy that can boast of any level of progress without research, so it is with great pleasure that I welcome all our delegates, exhibitors and visitors to the International Construction Research Conference and Exhibition (ICORCE 2018).

Having seen the conference grow from an idea to the forum that it is today, attracting thousands of delegates and visitors and showcasing the best different nations have to offer is a moment of pride for the Ministry, and we will continue to offer our support to ensure its growth and recognition not just regionally but globally.

The Kenya Government Pavilion, one of the side events featured during the conference is a testament to our country’s commitment to easing both the cost and efficiency of doing business in the construction industry. We are also proud of the partnership with the Big Five Construct East Africa, which further demonstrates the strength of international cooperation.

The Big Four Agenda is our country’s main focus at the moment, and as the Ministry prepares to unveil social and affordable housing for all, we are preparing to leverage on innovative building materials and technolgies, some of which we expect to see showcased this week.

The global economy relies on trade in order to grow, and this conference, through its different platforms including the Construction Industry Business Forum, is providing an environment conducive to attracting both internal and external investors.

As we open the 2018 edition of ICORCE, I urge all of us to derive as much benefit as possible from these next few days, and to also contribute as much as possible. If we all make that commitment, then we will have nothing short of an incredible experience.

Research is undoubtedly the cornerstone of any industry’s development, which is why ICORCE remains a critical forum not just for this sector but for the country’s economy as whole. The Big Four Agenda has been echoed in all sectors this year, aimed at achieving food security, affordable housing, manufacturing and affordable healthcare for all. The realization of all of the above can only be bolstered by embracing technology and innovation.

Research affords efficiency and cost effectiveness, the easiest route to fast tracked development. As a State Department, we recognize the need for this forum, because it is necessary to ignite conversations in order to foster growth. We may not always appreciate the role of research, but it underpins progress, especially in the construction industry. If it wasn’t for the physicists and engineers times past, we would be unable to erect sky scrapers over 150 stories high, or ensure the resilience of structures to natural disasters such as earthquakes, or even build over water.

Now, we can construct an entire building in a matter of weeks, or even 3D print a fully functional stainless steel bridge. The possibilities are virtually limitless.

I remain positive that this conference will have progressive ideas that will yield tangible results, yet another step towards ensuring the continuous development of the industry and the country at large.

A warm welcome to the 2018 ICORCE Conference delegates. This year's event, just like previous years, derives its theme from the industry's National Construction Research Agenda (NaCRA), this time exploring how harnessing the potential of the legal and institutional framework positively contributes to inclusive and sustainable growth in the construction industry.

The industry is currently overhauling various policies that directly affect construction in the country, including the Building Code. The Authority has been tasked with spearheading the main Construction Industry Policy, an overarching reference point that will inform, guide and serve as a blueprint for the achievement of the sector’s objectives and realization of Vision 2030.

The process has been a consultative and collaborative effort with various industry stakeholders in order to offer comprehensive and exhaustive solutions to the industry’s multi-faceted, multi-dimensional problems. The agenda for the policy was set after the 2016 conference, and its formulation was instigated by the different challenges facing the industry such as construction works with compromised quality and safety, inadequate funding for expansion, lack of access to plant equipment and machinery, insufficient dissemination of skills to build capacity among the sectors players, procurement bottlenecks, fierce competition from international service providers and corruption, among others. The policy aims to address thematic areas that will include; business development, quality assurance, materials and technology, sustainability, capacity building, research, ethics and the legal framework.

This year’s edition provides yet another platform to discuss the above, and we look forward to solutions that will create an enabling construction environment, encourage public-private involvement in infrastructure development and provide clear guidelines towards rehabilitation of existing infrastructure, further streamlining the regulatory and administrative regimes to minimize document processing time. It is our sincere hope you enjoy the process.

On behalf of the National Construction Authority, I am delighted to welcome all delegates to this year’s conference.

This is the third edition, but the first in the new biennial format, now stylized as the International Construction Research Conference and Exhibition. Another first for this year is the addition of two new and exciting side events, the Construction Industry Business Forum (CIBF) and the Kenya Government Pavilion.

CIBF is a business networking forum bringing together key stakeholders in the country, allowing them to expose their brands, brainstorm on challenges and possible solutions as well as generate constructive business leads, both locally and internationally.

Our delegates and guests will also have the benefit of visiting the Kenya Government Pavilion, a mini exhibition featuring key state agencies involved in the construction industry value chain. This will assist potential and existing investors navigate their way through the industry’s statutory requirements. We are proud to host the Kenya Revenue Authority, the Department of Immigration, the Kenya Investment Authority, Kenya Bureau of Standards and other key agencies at the Pavillion, and we are sure they will be of great assistance to our delegates.

The conference in 2016 attracted over a thousand delegates and over 8500 visitors to the exhibition held in conjunction with our partner, the Big 5 Construct East Africa. We look forward to a productive event, filled with learning and knowledge sharing towards bridging the gaps within construction research in the region.

This event would not have been possible if not for the tireless efforts of the ICoRCE Planning Commitee, made up of various stakeholders across the industry. The Authority extends its warm appreciation.

42 years after the 1969 Engineers Registration Act took effect, estab-lishing the Engineers Registration Board, the Engineers Act of 2011 was enacted, effectively putting in place the Engineers Registration Board.

The new Act was necessitated by the desire to create capacity in the engineering profession, critical to the implementation of Kenya’s Vision 2030. This was part of the wider reforms in the infrastructure sector, focusing on strengthening the human resource element.

Eng. Nicholas Musini, the Regis-trar and Chief Executive Officer (CEO) of the Engineers Board of Kenya (EBK) states, “The enact-ment of the Engineers Act has provided a wider legal mandate and as well as an opportunity to create an institution that is dedi-cated to the growth and regulation of the engineering profession in

line with global best practices.”

EBK Chairman D.M Wanjau echoes the same, saying, “We are proud to be working closely with other government agencies to meet the objectives of Vision 2030’s economic blueprint in order to facilitate development, as engi-neers play a critical role in the core pillars.”

7 years on, the Board has man-aged to register 12,000 engineers.

Global nature of the practiceGlobally, the engineering profes-sion is recognized to be regulated in two phases: engineering educa-tional standards and professional competence. EBK has been realigning the practice in the coun-try to meet international standards as it seeks to provide a platform for the global mobility of engineering professionals.

Since its formation, EBK has been working towards the establish-ment of robust accreditation systems as well as providing professional examinations for the advancement of engineers in line with best global practices.

Eng. Musuni is proud of the fact that the Board has overseen the number of institutions accredited to offer engineering programs increase from four (4) in 2014 to ten (10) currently. Two more (Tech-nical University of Kenya and Jomo Kenyatta University of Agriculture and Technology) also have programs at advanced stages of accreditation. Some private universities, such as Strathmore, have also shown the intention of offering engineering programs.

“The Board has also overseen the increased registration rates of engineers from an average of sixty about five years ago to 180 during

the year 2017/2018. The number of professional and consulting engi-neers now stands at 2200 up from 1700 in 2014, representing close to a 30% increase in just four years, “ he adds.

The increased numbers are encouraging, so much so that the Government is now having discus-sions towards granting the Board seed money to implement the Graduate Engineers Internship Program (GEIP) in the current year.

EBK Chairman Eng. Wanjau continues: “As practitioners and regulators, we must brainstorm on possible enabling laws that can promote the growth of the engi-neering profession within this relatively new area of application in our continent.”

The 2018 Supreme Court Ruling The Supreme Court ruling deliv-ered on 17th July 2018 was a setback to the Board, specifically on the matter of registration of graduate engineers.

The judgement was a culmination of a long drawn court dispute between the then Engineers Reg-istration Board and past students of Masinde Muliro University of Science and Technology and Egerton University. The students sued the Board for refusing to recognize their degrees as adequate for practice.

The High Court determined that the ERB under the repealed Act did not have powers to accredit programs and that it should have recognized the degrees and regis-

tered the students. However, the Board was dissatisfied and appealed to the Court of Appeal.

The Court of Appeal in a three judge bench arrived at a unani-mous decision and determined that the ERB acted within its man-date and that the Universities were at fault for not addressing the concerns raised by the Board on the quality of the programs. The students moved to the Supreme Court which, in a majority decision, set aside the Court of Appeal ruling and reinstated the High Court decision. The Board has been compelled to register all the petitioners as directed by the Supreme Court.

According to the Board, the issues of the quality of the graduates to be registered has not been resolved, given that there were no remedial measures prescribed by

the Supreme Court to attend to the concerns of the training of the graduates. Neither is there clarity on whether those programs are now recognized, given that some of the programmes are no longer being offered by the institutions.

In a public notice published in August 2018, the Board further called on all persons holding an engineering degree dating to the ERB days to submit their applica-tions. It is reviewing the applica-tions with a view of admitting those affected as graduate engineers.

Eng. Musuni confidently states, “The Board has assured the public that under the new legal frame-work, it is empowered to legally accredit programs for the purpose of practice and is working with the Council for University Education for seamless accreditation of programs.”
