CONSTITUTION OF THE UNIVERSITY OF THE PHILIPPINES ASIAN INSTITUTE OF TOURISM STUDENT COUNCIL PREAMBLE We the students of the University of the Philippines Diliman   Asian Institute of  Tourism in our desire to establish a Student Council that will embody ideals and aspirations to unite the whole AIT studentry, promote and protect students’ rights and welfare, and foster a closer relationship among the students and the different sectors of the tourism industry, do hereby ordain and promulgate this constitution. ARTICLE 1 GENERAL PROVISIONS Section 1:  This council shall be known as the “University of the Philippines Asian Institute of Tourism Student Council” herein referred to as AIT SC. Section 2. The Student Council shall be based at the Student Council Office, 1 st Floor, Asian Institute of Tourism, University of the Philippines, Diliman Section 3:  This constitution shall be known as the “Constitution of the University of the Philippines Asian Institute of Tourism Student Council” which will govern the members of this body. Section 4: For the purpose of this Constitution, unless the context indicates otherwise: 4.1 “University” signifies the University of the Philippines in Diliman. 4.2 "Institute" refers to the Asian Institute of Tourism in the University of the Philippines, Diliman 4.3 “Asian Instit ute of Touri sm Student Council” or “AIT SC means the duly constituted central student government of the UP Asian Institute of Tourism 4.4 “Chairperson”, “Vice-Chairperson”, “councilors” and “Year L evel Representatives” refer, respectively to the officers and members of the Student Council so designated and duly elected. 4.5 “Council  Member” pertains to the any officer of the Student Council as officially elected and inducted. PREAMBLE

ARTICLE 1

GENERAL PROVISIONS

Section 1:  This council shall be known as the “University of the Philippines

Asian Institute of Tourism Student Council” herein referred to asAIT SC.

Section 2. The Student Council shall be based at the Student Council Office,1st Floor, Asian Institute of Tourism, University of the Philippines,Diliman

Section 3:  This constitution shall be known as the “Constitution of theUniversity of the Philippines Asian Institute of Tourism Student

ARTICLE 2

DECLARATION OF PRINCIPLES AND OBJECTIVES

Section 1: The Asian Institute of Tourism Student Council shall at all timesstrive to:1.1 Cultivate a harmonious co-existence among students,

administration, university, UP community, alumni and thetourism industry;

1.2 Epitomize effective leadership and good governance;1.3 Defend and promote the rights and welfare of the Asian

Institute of Tourism students;

1.4 Spearhead activities gearing towards the protection of students’ rights and welfare promotion of camaraderie among them;

1.5 Uphold the interest of an ideal student ensuring a holisticdevelopment intellectually, socially, culturally andphysically.

1.6 Serve as an active forum for student’s ideas and sentimentsand shall deliver appropriate measures to address thestudents;

1.7 Establish a sense of service, responsibility and dedicationamong the students and for the betterment of the Institute;

1.8 Develop social awareness and instill national consciousnessto the students;

1.9 Coordinate with various sectors of the industry in thepursuit of common interests and expansion of networks forthe benefit of the students and the institute;

1.10 Promote the Asian Institute of Tourism as the premiereinstitution offering tourism management course in thecountry.

ARICLE 3

ORGANIZATIONAL STRUCTURES

Section 1: The AIT SC shall be composed of the following, which comprises of the General Assembly:One (1) ChairpersonOne (1) Vice-chairpersonFive (5) Councilors, andOne (1) Representative for the each year level.

Section 2: The General AssemblyIt shall be composed of the duly elected officers of the Studentcouncil. It will have a quorum defined as a simple majority to be50% + 1 of all the members of the Student Council present and

voting.Section 3: The said officers shall have the term of one academic year, starting

from the summer of the previous year and shall conclude at theend of the second semester of the next academic year.

Section 4: No council member shall hold the office as president of any of thepresent student organizations based in UP Diliman, furthermore,no council member shall hold any office of any of the presentorganizations in the institute.

Section 5. Powers and duties of the student council 

5.1: The AITSC shall adopt its own internal rules of government.5.2: The primary duty and responsibility of the Student Council

shall be to serve and uphold the rights and welfare of the AIT 

students.5.3: The AITSC shall represent the whole AIT studentry in any

occasion or event if necessary.

5.4: The AITSC has the right to collect a student fee amounting toPhP 75, PhP 60 of which shall go the the funds of the AITSC, while the remaining PhP15 shall be turned over the officialnewsletter of the Institute as a publication fee. The total sumof this publication fee shall therefore be provided for theLakbay staff and shall be given to them a month after thecollection period.

5.5: The funds raised by the Student Council shall be solely used

for the realization of the different projects and activities thatshall be approved by the body and that are geared towardsthe benefit of the Institution primarily the student body.

ARTICLE 4

THE OFFICERS

Section 1: The Chairperson shall be the chief executive officer of the StudentCouncil. It shall be his/her duty to:1.1 Exercise general supervision over the Student Council to

ensure that powers, duties, and responsibilities granted by

this constitution are strictly and truthfully executed;1.2 Sign all resolutions, communications, and documents of the

Student Council;1.3 Implement policies, programs and projects within his/her

 jurisdiction and upon consultation to the General Assembly;1.4 Preside over all meetings of the Student Council;1.5 Represent the Student Council in any occasion or event if 

necessary;1.6 Oversee all functions, responsibilities and activities of the

members of the body and require them to provide a statusreport during the General Assemblies;

1.7 Facilitate in the evaluation of performance of the StudentCouncil;

1.8 Decide for the whole body in case of a tie;1.9 in case there is no General Assembly and a decision has to

be made immediately, the Chairperson’s decision shall betaken account;

1.10 Issuance of a Memorandum for the intention of strictlyimplementation of the contents of the memo.

1.11 Create Ad Hoc Committees, whenever they are needed1.12. Act as the official co-signatory of financial documents and

the Asian Institute of Tourism Student Council bank account1.13 Perform such other duties as may be necessary or incidental

to the discharge and performance of the functions of his/her

office;

Section 2: The Vice-Chairperson shall aid the Chairperson. His/her specificduties and responsibilities include:2.1 Provisionally assume the position of the Chairperson in

his/her absence.2.2 Represent the Student Council in his/her official capacity as

the Vice-Chairperson on occasions and events where thebody needs representation;

2.3 Perform other duties as may be assigned to him/her.2.4 Perform such duties, as may be necessary or incidental to

the discharge and performance of the functions of his/heroffice;

2.5 Be the core head for all the leaders and representatives of every AIT based organizations.

Section 3: The Councilors shall:3.1 Be composed of five (5) duly elected councilor members of 

the council who have equal ranks and function3.2 Head any Standing Committees as assigned by the assembly3.3 Have the power to search for suitable members to work on

his/her assigned committee3.4 Become a member of any Standing Committees

3.5 Be a head or member of any Ad Hoc Committees created bythe Council Chairperson as needed

3.6 Inform the Chairperson and Vice-chairperson before anydecisions should be made

3.7 Notify the Chairperson and Vice-chairperson every now andthen of their assigned committees

3.8 Perform other duties as may be assigned to him/her.3.9 Perform such duties, as may be necessary or incidental to

the discharge and performance of the functions of his/heroffice;

Section 4: The Year Level Representatives shall be the respective head of a year level and shall:4.1 Head all internal activities of his/her respective year level;4.2 Make sure that their Batch mates are well informed and up

to date with the issues and concerns of the university..4.2 Be accountable to the General Assembly in all questions that

may arise regarding his/her respective year level;4.3 Be responsible in creating and disseminating oral and

written proposals and propaganda concerning activities of his/her respective year level;

4.4 Perform other duties as may be necessary or incidental tothe discharge and performance of the functions of his/heroffice;

4.5 Should take part in any of the committees of the council;4.6 Perform duties as may be specified and assigned to him/her;

ARTICLE 5

POWERS AND FUNCTIONS OF THE COMMITTEES Section 1. The Secretariat Committee shall

1.1 act as the secretariat in the organization of the records of theStudent Council

1.2 Record and maintain the minutes of all meetings of the AIT SC

1.3 Record, document and maintain all activities of the AIT SC

1.4 Make Available these records to the students of the InstituteSection 2 Finance Committee shall

2.1 be in-charge of the funds of the Student Council2.2 open a bank account for the AIT SC with the head of this

committee and the Chairperson of the AIT SC as signatories2.3 ensure the financial integrity of the AIT SC2.4 properly allocate the funds in cooperation with the council

members2.5 prepare the financial documents of the student council2.6 make these documents available to the students of the

institute

Section 3 Ways and Means Committee shall3.1 Be at the forefront of the marketing efforts of the AIT SC3.2 Spearhead income generating projets for the AIT SC3.3 prepare marketing letters for every event3.4 be in charge of the AIT souvenirs as implemented by each

student councilSection 4 Mass Media Committee shall

4.1 focus on the promotions of the Student Council or anyprojects deemed necessary for the purpose and establishaffiliations of the Student Council among otherorganizations.

4.2 establish and maintain mechanisms to promote the differentevents and activites of the student council

Section 5 Education and Research Committee shall5.1 maintain the academic integrity of the institute and its

students5.2 make available a set of books for the students of the

institute.Section 6: The Adhoc committees are those stated in the Article 5 Section

1.11, created by the Chairperson or the Council at any time during

the Council’s term, to perform specific function for a specific,limited period of time. 

ARTICLE 6

ELECTIONS

Section 1 Elections shall be held within a month before the official end of classes for the second semester in every academic year, inaccordance with the rules promulgated by the College ElectoralBoard and the provisions of the College Election Code. 

Section 2: Every candidate for membership in the AIT SC must:2.1 Have at least one year residence in the Asian Institute of 

  Tourism prior to elections, except for the freshmenrepresentative

2.2 Academically be in good standing as defined by the rules of the College Electoral Board, which should have not incurreda failing and/or incomplete grade the semester prior tohis/her candidacy resulting to less than the normal loadprescribed for that semester.

2.3 carry the normal load prescribed by the Institute.2.4 Not have been found guilty in any disciplinary action of any

act involving moral turpitude.2.5 Still have two (2) semesters to enrol in the Institute

Section 3. A Council officer seeking reelection must tender his/her

resignation before the start of the election campaigns, inaccordance with the rules promulgated by the College ElectoralBoard.

Section 4. Every Council officer shall hold office for one (1) year or untilhis/her successor shall have been duly elected, proclaimed, andassumed into office, provided that any council member who fills upa vacant seat in the course of the term shall only be in office forthe remainder of the term of his/her predecessor.

Section 5. A College Electoral Board shall be formed in accordance withArticle X of this Constitution.

Section 6. Induction of newly-elected AIT SC officers shall take place not later

than two (2) weeks after they have been elected and proclaimed winner by the College Electoral Board. The Dean of the College orhis/her duly authorized representative shall administer the oath of office of the new Student Council.

ARTICLE 7

VACANCIES

Section 1 “Vacancy” exists when the office of a Council member has been

vacated by reason of death, resignation, impeachment, expulsionfrom the university, or a permanent illness preventing him/herfrom performing the functions of his office. It is also in the reasonof mental or physical incapacity, detention, or any other reasonresulting to failure of resuming his/her duties before the expiration

of his/her term.Section 2: If any vacancy occurs in the position of the Student Council as:

2.1 Chairperson, the Vice-Chairperson will automatically be takethe place of the Chairperson

2.2 Vice-Chairperson, the councilor having the highest numberof votes in the preceding elections will automaticallypresume the position

2.3 Councilor, the candidate for councilor having the sixthhighest number of votes in the preceding elections willassume the position.

2.4. Year Level Representatives, the candidate with the 2nd 

highest number of votes in their batch

ARTICLE 8

COLLEGE ELECTORAL BOARD

Section 1: The College Electoral Board is a body created to oversee theelections for the AIT SC.

Section 2:  The AIT SC is tasked to nominate the student members of theCollege Electoral Board.

Section 3: The College Electoral Board shall be composed of 4 membersrepresented by the different sectors of the institute: administration,faculty and students, with the institute secretary as the

Chairperson, 1 faculty member and 2 student members to bechosen by the chairperson form the list of nominees submitted bythe AITSC

Section 4: The College Electoral Board shall:4.1 Set and announce specific schedule prior to election dates4.2 Receive nominations and authenticate the eligibility of the

candidates running for the position4.3 Formulate election procedures necessary for the execution of 

the college election4.4 Canvass election votes and returns; declare winners and act

as a decision making body during the whole election.

ARTICLE 9

IMPEACHMENT AND DISCIPLINE OF STUDENT COUNCIL MEMBERS

Section 1: Verbal and written warning shall be given on the followinggrounds:1.1 If a council member incurs two (2) consecutives absences in

official meetings and activities of the student council withoutinforming the body of his or her reasons why he or she hasnot been working with the council.

1.2 Intentionally disregarding his/her task or other dutiesassigned to him/her. Intentional may be in the form of 

failure to deliver the assigned task on specified time,rejecting the given work to his/her and neglecting the powerof the members to delegate tasks.

Section 2: Any member of the student council can be dropped from the roll if he/she fails to attend four (4) consecutive regular council meetings without informing the body of his/her status or the reasons whyhe has not been attending or working. He/she shall henceforthcease to be a member of the council.

Section 3: Any dropped member who wishes to return should explain and justify his side. He/she can be reinstated into the council if there

is an affirmative vote of the quorum (50% +1) of all the Councilmembers.

Section 4: Any member of the Council may be impeached or suspended, asmay be determined by the council, for any of the following causes:4.1 Any willful disregard of this Constitution;4.2 Gross neglect of duty;4.3 Malversation of funds4.4 Exploitation of authority;4.5 Any disorderly behavior during council meetings;4.6 Any other form of misconduct which undermines the

integrity of the Council;

4.7 Gross incompetence;4.8 Loss of good academic standing;4.9 Upon receiving of not more than four (4) written warnings of 

an officer based on the grounds indicated in Section 1 Article6.

Section 5: The verdict of impeachment case shall be termination from office.Section 6: For the purpose of impeachment, an affirmative vote of at least

two-thirds (2/3) of the General Assembly shall be required.

Section 7: For purposes of suspension, an affirmative vote of at least two-thirds (2/3) of the members of the Council provided that the

suspension shall not exceed 30 days.Section 8: The respondent(s) shall have no right to vote in any of the

disciplinary proceedings.

ARTICLE 10

AMMENDMENTS

Section 1: proposed amendments may be subsequently amended with the

approval of the quorum (50% +1) of the General Assembly.

Section 2: The constitution of the AITSC shall only be amended or revisedtotally or partially by the two-third (2/3) votes of the GeneralStudent Body.

Section 3: Amendments or revision shall be implemented immediately one

semester after ratification.

ARTICLE 11

EFFECTIVITY

Section 1: This Constitution shall take effect upon the approval of the CollegeElectoral Board and its ratification in plebiscite called for thispurpose, by a majority of all the votes cast by the studentsqualified to vote. It shall supersede all previous Constitutions andshall take precedence.

Section 2: Any rule contrary to this Constitution shall be void and null.
