Overview of the Community Involvement Plan

EPA developed this Community Involvement Plan to facilitate two-way communication betweenthe community surrounding the Midland Products Superfund Site and EPA and to encouragecommunity involvement in site activities. EPA will utilize the community involvement activitiesoutlined in this plan to ensure that residents are continuously informed and providedopportunities to be involved.

This Community Involvement Plan addresses Midland Products’ relationship to the communityand EPA (Section 2.0), provides a background of the community (Section 3.0), presents EPA’scommunity involvement program (Section 4.0), and provides a listing of resources available(Appendices). EPA drew upon several information sources to develop this plan, includingcommunity interviews and site files. EPA’s Regional Office will oversee the implementation ofthe community involvement activities outlined in this Plan.

Section 2.0Capsule Site Description

2.1 Site History

A sawmill/wood preservative processing plant operated at the site from 1969 to 1979 and thesite area, less the lagoon area, was sold to the Plainview-Ola Economic Development Trust, Inc.,in 1981. The property was subsequently deeded to the Ola School District (now Two RiversSchool District).

2.2 Site Description/Location

The total site is approximately 37 acres, with two acres of the site formerly occupied by lagoonsand the former treatment building (known as the "plant" area) located approximately 50 milesnorthwest of Little Rock, Arkansas, North of Highway 10 within Yell County, one-half mile eastof Ola, Arkansas

The site is on a flat area with a gentle north-northwest slope (2-3%) and there were formerly seven process lagoons that ranged in surface areas from approximately 125 square feet to 7,200square feet and had maximum depths of 3.5 feet and 6 feet. There are runoff paths from thelagoon area that feed into an intermittent stream which continues off-site.

A residence sits at the southwest corner of the site and the nearest drinking water well isapproximately 400 feet west of the southwest corner of the site.

2.3 Site Inspections and Cleanup Activities

A Remedial Action contract was awarded to Chemical Waste Management on March 1, 1991.

An on-site incineration of the waste materials was completed in May 27, 1993, with thetreatment of 102,000 tons of creosote contaminated sludge and soil. As a result of theincineration of these contaminated materials, a source of contamination that could affect thenearby community of Ola has been removed. The cleanup will prevent future contamination ofthe shallow ground water which could impact the nearby wildlife refuge.

Construction of the ground water wells and treatment facility was completed in September 1993and pumping and treatment began in January 1994. The pump and treatment remedy of theshallow ground water has reduced the remaining contaminants at the Site.

The Five-Year Review Report was completed by the Arkansas Department of EnvironmentalQuality (ADEQ) and approved by EPA on March 1, 2001. The Five-Year Review determinedthat the remedy for the Midland Site is protective of human health and the environment.

An Amended Proposed Plan is being issued by EPA and ADEQ to address the contamination atthe site. The EPA is proposing to change the remedy to Monitored Natural Attenuation for thedissolved contaminant plumes with a Technical Impracticability Waiver for the highlycontaminated area. (Monitored Natural Attenuation (MNA) is defined as “biodegradation,dispersion, dilution, and adsorption” of contaminants in ground water.) A TechnicalImpracticability Waiver may be adopted if it is not practical to clean-up aquifers. A TechnicalImpracticability Waiver is not a “walk away” decision and Institutional Controls will beimplemented to protect human health and the environment.

Members of the Public may comment on the Amended Proposed Plan at the Public Meeting to beheld June 30, 2005 or submit written comments during the Public Comment Period which beginsJule 14, 2005 and ends July 13, 2005. A copy of the Amended Proposed Plan will be in the Administrative Record file, which contains complete documentation of the site and is availablefor public review at the listed information repositories.

Section 3.0Community Background

3.1 Community Profile

According to a 2000 Census approximately 1,204 people live in this agricultural area. An Environmental Justice Analysis shows that approximately 75 people live within a one mile radius of the site with a 1.3% minority and with 41.9% economically stressed.

3.3 Key Community Concerns

Original areas of concerns were site security in that the site was not adequately fenced; afear that children would try to swim in the contaminated lagoons; and, whether or not thesite could be re-opened to treat poles.

Politicians and residents were extremely concerned with the costs of the RI/FS.

3.4 Response to Community Concerns

The EPA responded to public comments in the Responsiveness Summary attached to the1988 Record of Decision (ROD). As a result of public comments, EPA collectedadditional offsite samples in Keeland Creek. These samples showed no significantdownstream migration of contamination.

3.5 Summary of Communication Needs

Possibly need Spanish translations.

Section 4.0EPA’s Community Involvement Program

The overall goal of EPA’s community involvement program is to promote two-waycommunication between citizens and the EPA and to provide opportunities for meaningful andactive involvement by the community in the cleanup process. EPA will implement thecommunity involvement activities described below. The following plan is based on the results ofthe community interviews described earlier; it addresses each issue that was identified as beingimportant to the community.

Issue 1: Meetings

Activity 1A: Public Meeting

• Objective: To receive public comment on an Amended Proposed Plan.

• Method: To meet with Community members in a format designed to obtain theirthoughts and concerns regarding the Amended Proposed Plan.

• Timing: June 30, 2005

Issue 2: Keeping the public informed and up to date.

Activity 2A: Designate an EPA Community Involvement Coordinator (CIC).

• Objective: To provide a primary liaison between the community and the EPA,and to ensure prompt, accurate, and consistent responses and informationdissemination about the site. In those instances where EPA’s CIC may be unableto provide adequate information (such as on technical issues), inquiries will bedirected to the appropriate EPA contact.

Method: EPA will designate an EPA CIC to handle site inquiries and serve as a point ofcontact for community members. The CIC is appointed by the Region 6 headquarters. Phyllis Hoey is the EPA CIC assigned to the site. She will work closely with GaryMiller, EPA’s Remedial Project Manager for the site.

• Completed: The CIC was designated on May 5, 2004.

Activity 2B: Prepare and distribute site fact sheets and technical summaries.

• Objective: To provide citizens with current, accurate, easy-to-read, easy-to-understand information about Midland Products site.

• Method: Fact sheets will be mailed to all parties on the site mailing list. Inaddition, copies will be available at the information repository and in variouscooperating business locations in the community.

• Timing: EPA will prepare and distribute fact sheets as needed.

Activity 2C: Provide a toll-free “800 number” for the community to contact EPA.

• Objective: To enable citizens to get the latest information available when theywant it, rather than having to wait for a meeting or a fact sheet, and withoutincurring any cost.

• Method: EPA will activate the 800 number and publish it periodically in the localpapers and in all fact sheets.

• Timing: The line is currently operational (1-800-533-3508).

Activity 2D: Maintain a mailing list for the Site.

• Objective: To facilitate the distribution of site-specific information to everyonewho needs or wants to be kept informed about the site.

• Method: EPA will create a mailing list that includes all residences adjacent to thesite, in known or suspected paths of migration, or those otherwise affected by thesite. EPA will also solicit interested parties via fact sheets, newspaper articles,public meetings, public availabilities, etc.

• Timing: EPA will begin working on this mailing list immediately and willreview/revise it periodically to keep it current.

Activity 2E: Establish and maintain Information Repositories.

• Objective: To provide a convenient location where residents can go to read andcopy official documents and other pertinent information about the site and EPAactivities.

• Method: The repository is a reference collection of site information containingthe Administrative Record file, other site-specific information, the CommunityInvolvement Plan, information about the Technical Assistance Grant program,and the general Superfund process. The Community Involvement Coordinatorwill work with a local contact to establish the local repository. This repositorywill be accessible to the physically challenged, will have copier facilities, and willbe available to residents during normal business hours and at least some eveningand/or weekend hours. Additional repositories may also be established, includingone at the EPA Region 6 headquarters in Dallas, Texas and at ADEQ, Little Rock,Arkansas.

• Completed: EPA established the local repository on June 2, 2004 located in theoffice of the Superintendant’s Office, Two Rivers School District, 307 West HillStreet, Ola, Arkansas. EPA adds new documents as they become available.

Activity 2F: Provide Site and Superfund information on the Internet.

• Objective: To provide key resources for searching and listing both general andspecific information about Superfund and hazardous waste issues.

The Record of Decision (ROD) for the site is placed on the internet when completed. The Proposed Plan was prepared by EPA after the Site Investigationwas completed and remediation alternatives were evaluated. In the ProposedPlan, EPA notified the public about the preferred remediation alternative andinvited public comments. Following the public comment period, and afterconsidering all public comments received, the EPA selected the site remedy in theRecord of Decision (ROD).

• Timing: Site Status Summaries are periodically updated.

Activity 2G: Provide Technical Assistance Grant (TAG) information.

• Objective: To provide resources for community groups to hire technical advisorswho can assist them in interpreting technical information about the site.

• Method: EPA will provide information about the TAG program at publicmeetings and in site fact sheets. EPA will also provide briefing sessions tointerested groups if so requested. EPA will provide TAG applications to qualifiedgroups, and will provide assistance to the group in completing the application.

• Timing: EPA will continue to promote TAGs until one is awarded.

Activity 2H: Establish and maintain the Administrative Record.

• Objective: To provide residents with a paper trail of all documents, resources,etc. used by the Regional Project Manager and Site Team in reaching all decisionsabout the site and its cleanup.

• Method: EPA will provide at least three sets of the Administrative Record for thesite, one in the EPA Region 6 offices located at 1445 Ross Avenue, Dallas, Texas;one located in the local Information Repository near the site; and one at theADEQ in Little Rock, Arkansas.

• Timing: The Administrative Record is opened as soon as site investigation beginsand remains open as long as hazardous substances remain on-site above health-based levels.

Issue 2Y: Provide adequate and meaningful opportunities for community involvement.

Activity 2YA: Hold public meetings.

• Objective: To update the community on site developments and addresscommunity questions, concerns, ideas and comments.

• Method: Refer to Appendix H for suggested meeting locations. EPA willschedule, prepare for, and attend all announced meetings. EPA will provide atleast two weeks’ notice of the scheduled meeting. The Regional Project Manager,Community Involvement Coordinator, and other appropriate EPA staff willattend.

• Timing: A public meeting is required during the Proposed Plan comment period(see below). EPA will hold other public meetings as appropriate.

Activity 2YB: Make informal visits to community.

• Objective: To help keep community members informed about the site, whileproviding EPA with feedback about site activities and the community’s opinions.

• Method: EPA will establish a presence in the community through informal, oftenunscheduled visits to talk spontaneously with local residents.

• Timing: Throughout the entire Superfund process.

Activity 2YC: Solicit comments during a Public Comment Period.

• Objective: To give community members an opportunity to review and commenton various EPA documents, especially the Proposed Plan. This provides thecitizens with meaningful involvement in the process and also provides the SiteTeam with valuable information for use in making decisions.

• Method: EPA will announce each comment period separately. Announcementswill appear in local newspapers and EPA fact sheets; they will include particularson duration, how to make comments, where to submit comments, etc. EPA maysolicit comments on the following information/draft documents: draft CIP, draftsummary of test results (not individual tests) and initial interpretation, preliminaryfindings on the RI and a list of possible remedies likely to be considered,

preliminary findings of the FS and a brief summary of the leading contender forthe proposed remedy, and preliminary plans for implementation and construction.

• Timing: Comment periods will be announced as appropriate. A comment periodis required in conjunction with the announcement of the Proposed Plan and willlast a minimum of 30 days.

Activity 2YD: Prepare and issue a Responsiveness Summary.

• Objective: To summarize comments received during comment periods, todocument how the EPA has considered those comments during the decision-making process, and to provide responses to major comments.

• Method: EPA will prepare a Responsiveness Summary as a section of the Recordof Decision. The Responsiveness Summary will include four sections: 1.Overview; 2. Background on Community Involvement; 3. Summary of commentsreceived and Agency responses; 4. Remedial Design/Remedial Action concerns. All information, both technical and nontechnical, will be conveyed in a mannerthat is easily understood.

• Timing: EPA will issue the Responsiveness Summary as part of the Record ofDecision.

Activity 2YE: Revise the Community Involvement Plan (CIP).

• Objective: To identify and address community needs, issues, or concernsregarding the site or the cleanup remedy that are not currently addressed in thisCIP.

• Method: The Revised CIP will update the information presented in the previousversion of the CIP.

• Timing: EPA will revise the CIP as community concern warrants or at least everythree years until the site is closed out.
