DEPARTMENT OF FISHERIES, JAIPUR, RAJASTHAN 1. BACKGROUND NOTE OF PROJECT & TECHNICAL SPECIFICATION

The Government of Rajasthan is introducing Fish Cage culture in reservoir to enhance the fish production of the State. The cage culture activities are unique in nature, which will be conducted in reservoir of tribal area of rajasthan(1. Jaisamand 2. Mahi bajaj sagar 3. Kadana Back Water 4. Badi Talab 5. Jakham 6. Som kamla 7. Ladeshwar 8. Sehi Dam 9. Surwaniya 10. Bhagora 11. Udaisagar 12. Harchand 13. Bodigama 14. Sonariya) with assistance of National Fisheries Development Board Hyderabad in phase manner. However, the Cage floating material, the design of G.I.Pipe cage should be reservoir specific, sturdy, long life, easy to maintain and economically viable. Same 8 places should be lined from top to bottom with 8 – 12 mm PP Rope and connection at bottom middle. Bottom should be flat closed with same webbing. Second PP rope lining should be after 0.75 m ring position and place should be perpendicular to first top PP Rope lining.

2.2.6 CAGE PREDATOR NET:

Shape : Rectangular. Size : 7 Mtr. x 5 Mtr. Depth : 5 Mtr. Bottom : Closed Flat Twine Size : 8 ply or 12 ply Eye Size : 20 mm Material : Nylon Material Specification : 210 D Nylon Knotless Net Cage Predator Net Top should be lined with 10 mm PP Rope with 8 rings of SS of 12 mm Thickness & 1.5 inch Diameter at 8 places at equal distance. Same 8 places should be lined from top to bottom with 12 mm PP Rope and connection at bottom middle. Bottom should be flat closed with some webbing. Second PP rope lining should be after 0.75 m ring position and place should be perpendicular to first top PP Rope lining. Webbed according to the dimensions and bottom of the net should be line with led weights of 50 gms each by leaving space of 100 mm at equal distance. solar lights(Complete) to be fitted on the both cage batteries at appropriate place and Working sheds. Main catwalk of each battery should be of 1 meter breadth and half meter breadth at cat walk on along-side of cages.

2.2.7 WORKING & STORAGE SHED:

Readymade 6x5 M Pre-fabricated Frame Structure mountable on Floating Frame with PPGI Sheet Roof and Wall Panels to provide an Enclosure for Rest of Workmen & Storage of Daily necessary items and should be provided with windows for cross ventilation. 3. SCOPE OF WORK:

3.1 Site Inspection. 3.2 Preparation of Drawing, design, quantity calculation of materials (item wise) required for the work. 3.3 Alternative drawing / design & its Power Point Presentation as per requirement of Department. 3.4 Installation at site as per requirement of department. 3.5 Repair & Maintenance of the asset during project period of 18 months from the

commencement of culture operations. 3.6 The cost towards Operation & Maintenance of the asset including more machineries required will be borne by the Agency till completion of entire project Operation period.

4. TERMS AND CONDITIONS OF TENDER BID :

4.1 The respective bidder shall sign on all reference, information and certificates certifying suitability, technical know-how or capability of the applicant.

4.2 The proposal completed and signed shall be submitted in a sealed Envelope. Cover- I (Technical Bid) contain following documents for eligibility criteria

a) Factory/Manufacture unit b) Material c) Supply certificate of last three years and provide details about production, supply to government sector/central institute/ICAR etc. for pisciculture purpose. d) PAN Card e) VAT Clearance certificate f) EMD in shape of Bank Draft in favor of Commissioner of Fisheries, Rajasthan, Jaipur. g) Cost of tender form in term of bank draft. h) Processing fee in shape of Bank Draft in favor of M.D.RISL jaipur. i) Valid company registration certificate/Firm of Partner Registration. j) Work capability statement in separate sheet should be submitted. k) Bidder should submit last 3 years balance sheet/profit & loss account. 4.3 Cover- II (Financial Bid) contains the offer price in Annex-B for supply of fish

cages & other items.

4.4 The cost incurred by applicants in preparing this application, in providing clarifications of attending discussions in Connection with this document shall be borne by the applicant.

4.5 The Bidders are subject to be disqualified if they have:

a) Made misleading or false representations in the forms, statements and attachments submitted in proof of the qualification requirements; and/or .

b) Record of poor performance such as abandoning the assignment, not properly completing the contract, inordinate delays in completion, litigation history, or financial failures etc; and/or.

c) Participated in the previous bidding for the same work and had quoted unreasonable prices and could not furnish rational justification to the Officer-incharge.

d) Indulged in unlawful means in obtaining bids.

e) Been black listed/ their registrations cancelled by the competent authority.

5. COST OF BIDDING:

5.1 All the rates and prices in the bid shall cover all taxes, viz Central or State Sales Tax, Octroi, Value/added/tax or any other local taxes, ferry, tollage charges and royalties and any other charges.

5.2 The successful bidder shall make his own arrangement for supply of fish cages etc. F.O.R. at destination place.

6. ELIGIBILITY CRITERIA:

6.1 The Bidder should be a producer or Authorized Supplier of cages and must be a well established having Capability and experience in undertaking similar nature of work capability statement in separate sheet should be submitted along with the technical bid. .

6.2 Bidder whose tender is accepted shall supply the full items mentioned in the supply order in phased manner within 30 days from the date of issue of supply order ensuring quality & description as per the approval of the purchase Committee.

6.3 The Bidders are required to produce the original documents for verification by the Tender Committee as and when determined/required.

6.4 Qualified firms will be intimated to attend the opening of cover II (financial bid). The venue will be intimated separately.

7. FINANCIAL CRITERIA & TIME SCHEDULE

The Bidder should be financially sound and a proof of turnover in shape of audited balance sheet by Chartered accountant/ Firm should be attached with the technical bid.

The basic consideration and the essence of the contract shall be strict adherence to the quality and time schedule for performing the works services.

For carrying out the job is 90 days from the date of award of work and complete maintenance work during operation period of 18 months from the commencement of the culture operations.

Tenderer must have to exhibit the fabrication / construction of the assignment at his workshop / factory / side along with a clear list of materials used within a stipulated period of 2 months from the date of award of work. The final inspection will be made by the department officers within the stipulated time frame at the factory site / fabrication site.

8. VALIDITY:

Bids are remain valid for a period 1 year from the opening of the financial bid.

9. TECHNICAL APPRAISAL:

The Bidders should provide the details about the production/ Supply of cages to Govt. farm/Central Institute/ICAR for pisciculture purpose. 10. TEST OF SAMPLES:

The Bidder has to arrange the samples of material used for the construction of cages.

11. DEPOSIT OF EARNEST MONEY:

11.1 The Bidder shall deposit earnest money of Rs 1.35 lakh (Rupees one lakh thirty five thousand) only in shape of Bank Draft in favor of Commissioner of Fisheries, Rajasthan, Jaipur.

11.2 The EMD deposited by the unsuccessful Bidder will be refunded as early as possible after the tender is finalized and the EMD of successful Bidder shall be adjusted in the security.

12. SUBMISSION OF BID:

12.1 Bid document should be submitted in a stitched bound copy /Book with signature & stamp of the Bidder in each page.

12.2 The proposal should contain the details called for, a letter intimating their acceptance of the tender conditions, a copy of tender documents duly signed by the bidder on each page as well as documents in support of the minimum eligibility criteria stipulated in Cover-I.

12.3 The cover-I (Technical Bid) & Cover-II (Price Bid) should be separately mentioning Cover-I and Cover-II.

12.4The outside of the State agency/ Firm has to apply for VAT regulation if

found successful in the Bid in the state of Rajasthan prior to release of any payments.

12.5The financial proposal has to be submitted in the format for price bid annexed to the tender document. The bidder is required to quote a firm offer inclusive of all prevailing taxes, duties, transportation as applicable for the assignment.

12.6All duties, taxes including VAT and other levies payable by the Bidder under the contract, or for any other cause shall be included in the rates, prices submitted by the bidder, Sales tax, purchase tax, turnover tax or any other tax on material in respects of this contract shall be payable by the Bidder and Government will not entertain any claim whatsoever in respect of the same.

12.7 Transportation of cages to the Project sites of reservoirs of tribal area as mentioned above will be the sole responsibility of the Bidder. Venue of supply will be intimated as per project requirement and will be intimated to bidder with supply order.

12.8 In case of any bid where unit rate of any item/items appear unrealistic, such bid will be considered as unbalanced and in case the bidder is unable to provide satisfactory explanation such a tender is liable to be disqualified and rejected.

13. RIGHT OF ACCEPTANCE / REJECTION OF TENDER

The right of acceptance of tender rests with the Commissioner of Fisheries who does not bind himself to accept the lowest tender and also reserves the right to reject any or all the tender(s) received without assigning any reason whatsoever. Any dispute that arises in future will be finalized by the Commissioner of Fisheries, Rajasthan, Jaipur.

If any dispute arises out of the contract with regard to the interpretation, meaning and breach of the terms of the contract, the matter shall be referred to by the parties to the Secretary (Fisheries) who will appoint one of his senior officers, who will not be related to this contract, as the Sole Arbitrator of the dispute and whose decision shall be final.

All legal proceedings, if necessary, arising out of any dispute between the parties shall have to be lodged in courts situated in Jaipur city (Rajasthan) only & not elsewhere.

14. AWARD OF CONTRACT:

14.1 The officer inviting the bid will award the contract to the bidder in phase manner whose bid has been determined to be substantially responsive to the bidding documents and who has offered the lowest evaluated price as will be accepted by competent authority .

14.2 On acceptance of the tender, the Bidder shall give in writing the names of his accredited representative(s), who would be responsible for taking instructions from the Department.

14.3 Commissioner of fisheries, Rajasthan, Jaipur reserves to himself the right of accepting the whole or any part of the bid and the bidder shall be bound to perform the same at the rate quoted.

14.4 After fulfillment of criteria in the evaluation process and approval from competent authority the L.O.I. (Letter of Intent) supply order will be issued in favor of successful Bidder.

14.5 5% of the accepted value will have to deposit by the bidder as Security in shape of draft at the time of signing of agreement.

14.6 The tenderer shall not sublet the work to any other person/agency.

14.7 Quantity of items may decrease/increase.

15. OPENING OF BID:

15.1 The Bids received from tenderers will be opened on in presence of the bidders/ their authorized representatives present at that time. Only the Cover- I (Technical Bid) will be opened. Evaluation of the technical bids will be carried out on the basis of the required document. Date of opening of price bid will be intimated to qualified bidders separately.

15.2 Price Bid (Cover-II) of qualified bidders for evaluation will be opened in their presence in presence of their authorized representative.

15.3 The participation in opening of Cover- I does not in any way entitle any applicant to participate in the price.

16. PAYMENT PROVISION:

16.1 No advance payment towards cost of cage and related items or for any other thing will be made to the approved Bidder.

16.2 The Bidder should produce delivery challan and invoice in Duplicate for obtaining payment.

16.3 Payment Schedule will be as under:- (i) 1st Instalment – 20% of the contract value is to be paid after the supply of material/items of cages on the site after the inspection by monitoring committee..

(ii) 2nd Instalment – 40% of the Contract value on verification of fabrication and installation of half of the cages at site after the inspection by monitoring committee.

(iii) 3rd instalment – 40% of Contract Value after successful installation & commissioning of the assignment after the inspection by monitoring committee..

17. Income Tax surcharge as applicable & Sale Tax / VAT as applicable will be deducted from the bill of Agency. 18. The security deposit can only be refunded after satisfactory completion of supply of cage as per contract. 19. No interest shall be given on money deposited by tenderer in form of security deposit. 20. No extra work beyond the scope of the Agreement shall be allowed without prior permission from competent Authority. 21. The tenderer is to bear required Sales Taxe, Octroi Taxes/ all other taxes and royalties etc. as applicble at his own cost & risk. 22. The minimum wages fixed by Rajasthan Government from time to time are to be paid by the Tenderer to the labourers engaged by him in the work. 23. The work should be restricted to the available funds. 24. Forfeiture of Security Deposit:- Security amount in full or part may be forfeited in the following cases:- (a) When any terms and conditions of the contract is breached. (b) When the tenderer fails to make complete supply are satisfactorily. (c) Notice of reasonable time will be given in case of forfeiture of security deposit. The decision of the Purchase Officer in this regard shall be final. 25. Forfeiture of earnest money: The earnest money will be forfeited in the following cases: (a) When Tenderer withdraws or modify the offer after opening of tender but before acceptance of tender. (b) When tenderer does not execute the agreement, if any, prescribed within the specified time. (c) When the tenderer does not deposit the security money after the supply order is given. (d) When he fails to commence or /and the supply of the items as per supply order within the time prescribed.

26. The expenditure should at no time exceed the allotment available therefore, a written undertaking is to given by the Agency prior to the drawl of Agreement stating therein that they will not claim anything in any shape from the Government if the work is curtailed or stopped at any stage for want of funds. This will form a part of the contract. 27. Arbitration proceeding if required, shall be held at Jaipur, Rajasthan, India and the language of the arbitration proceedings and that of all documents and communication between the parties shall be in English. 28. NO CLAIM OF COMPENSATION FOR SUBMISSION OF TENDER:

No Bidder shall be entitled to claim any expenses /charges incurred by him or incidental therein connection with submission of Tender. 29. EXTENTION OF COMPLETION DATE: i) The time allowed for execution of the supply of cage as specified in the Contract data shall be the essence of the Contract. The execution of the supply shall commence from the 15th day or such time period as mentioned in letter of Award after the date on which the department issues written orders to commence the supply of cages. If the Agency commits default in commencing the execution of the supply as aforesaid, Government shall without prejudice to any other right or remedy available in law, be at liberty to forfeit the security deposit absolutely.

ii) In case of delay occurred due to any of the reasons mentioned below, the Agency shall immediately give notice thereof in writing to the department but shall nevertheless use constantly his best endeavors to prevent or make good the delay and shall do all that may be reasonably required to the satisfaction of the department to proceed with the works.

(1) Force major, or

(2) Abnormally bad weather, or

(3) Serious loss or damage by fire, or

(4) Civil commotion, local commotion of workmen, strike or lockout affecting any of the trades employed on the work, or.

(5) Delay on the part of other Agency or tradesmen engaged by officer in-charge in executing work not forming part of the Contract.

(6) In case a Variation is issued which makes it impossible for Completion to be achieved by the Intended Completion Date without the Agency taking steps to accelerate the remaining work and which would cause the Agency to incur additional cost, or

(7) Any other cause, which, in the absolute discretion of the authority mentioned, in Contract data is beyond the Agency control.

iii) Request for reschedule and extension of time, to be eligible for consideration, shall be made by the Agency in writing within fourteen days but not later than the last due date of completion of work of the happening of the event causing delay. The Agency shall indicate in such a request the period for which extension is desired.

iv) In any such case a fair and reasonable extension of time for completion of work may be given with or without liquidated damages. Such extension shall be communicated to the Agency by the Department.

(v) Extension in delivery period:- In case of extension in the delivery period with liquidated damages the recovery shall be made on the basis of following percentages of value of stores which the renderer has failed to supply :-

(a) Delay upto one fourth period of the prescribed delivery period - 2.5%

(b) Delay exceeding one fourth but not exceeding half of the prescribed delivery period - 5% (c) Delay exceeding half but not exceeding three fourth of the prescribed delivery period - 7.5% (d) Delay exceeding three fourth of the prescribed delivery period 10%

30. Other Conditions:-

30.1 The rate offered should be written both in figure and words and no cutting or over writing/overcoming shall be entertained and rate should be quoted in the prescribed form in cover-II (Price Bid)

30.2 The rate should be quoted inclusive of all charges and taxes including transportation. However, details of taxes etc. included in the rate may be mentioned separately.

30.3 Delivery is to be made as per of supply order.

30.4 Rejected items shall be taken back by the tenderer at his own cost immediately on the notice of rejection.

30.5 The Department of Fisheries, Govt. of Rajasthan Jaipur shall be free to resort to any punitive actions ranging from recovering of losses to Black listing of the erring rate contract tenderer for any kind of malpractices, involving the tender terms and conditions.

30.6 Tender bids imposing any extra conditions of their own will not be entertained.
