Dear Mr. Parran:

Thank you for your recent letter in which you expressed your opposition to the provision in the Senate-passed trade bill requiring advance notice to employees of plant closings and layoffs of 50 or more employees during any 90-day period.

The Administration will insist on removal of the Senate provision during the House-Senate conference on the trade bill. Contrary to the objectives of trade legislation, mandatory advance notice would make America less competitive, not more.

In his most recent letter to the Senate on this legislation, the Secretary of Labor stated that inclusion of any mandatory plant closing provisions would make it impossible for the President's senior advisors to recommend approval of a trade bill.

Dear Mr. Hosie:

Thank you zor your messages expressing the concern of the Sun-Diamond Growers of California about the u.s.-EC dispute over EC pasta imports and the possibility of EC retaliation against U.S. walnut exporters. I am pleased to say that we have reached an agreement which will end this dispute and avoid a destructive trade war.

Under the terms of the agreement, which takes effect October 1, the EC's export subsidy on pasta will no longer apply to fifty percent of the EC's exports to the United States. Furthermore, the duty r~fund will be reduced by 27-1/2 percent on the remaining 50 percent and is expected to be reduced further in the months ahead. The ugreement will be monitored closely to ensure that the EC abides by its. terms. The EC has agreed not to intrcduce new subsidies for pasta exported to the U.S. and not to operate its existing subsidy ::>ystem in a way that would violate tha agreement.

This issue was an extremely difficult one to settle and required compromises on both sides. Negotiations were long and complicated. In the end, however, the United States achieved a settlement that, I believe, will bt::!ne f it American pasta-makers.

I am relieved that a confrontation over this issue was avoided at the last minute, but I am aure you will agree that we should not have to go to the brink of a trade war every time a. trade dispute a.rises. This case exemplifies not only why we need stronger international rules to settle trade disputes, but also the dangers of the p=oposed legislation that would require the United States to retaliate on a legislatively mandated, inflexible schedule. Had such legislation been in etfect in this case, we would have found ourselves in a trade war instead of concluding the constructive, ·-trade-liberalizing agreement we reached.

Thank you for forwarding the letters written by your American History students concerning the POW/MIA issue. It is ~eartening to both the President and me that they care so deeply about our missing raen and their families.

When President Reagan assumed office in 1981, he directed that a priority effort be nade to achieve the fullest possible accounting of o ur men still listed as missing in Southeast Asia. f.,.t that time, intelligence priorities were down, no negotiations had been ongoing, and the =umilies of these men felt ignored by their own government.

Since then , great progress has been made and man~· :!:.?-111ilif:~s have received answers to their uncertainty. Long and intense negotiations have been conducted by the Reagan Administration for the past few y~ars , in~elligence priorities are at their highest, and more progress has been made in the past three years than at Rny time since the end of the war.

Early this year, President Reag.:1.n nam.:;d :orrner Chairman of the Joint Chiefs of Staff, John Vesse~', as his specitll emissary to Hanoi on this issue. He returned from Hanoi last month with new agreements that, if honore<l by the Vietnarr.ese, will bring even greater progress.

As your studentG will be able to see from the enclosed material, the problem is not in Washington , but Hanoi. The President is determined to continue this orioritv effort for the remainder of his term. We hope we can co~nt on the support cf a concerned American citizenry to demonstrate to Vietnam and ~aos our united stand on this important issue.

The President recently signed ~hiG legislation, which was urgently needed to help troubled thri f t institutions whose problems have contributed to a weakening of that industry. The "Competitive Equality Banking Act of 1987" contains most of the provisions included in the Adoinistration's original plan to recapit<llize the Federal Savings and Loan I nsurance Corporation (FSLIC) and provides an a cceptable level of f unds to help resolve the large caseload of savings and loan insolvencies. :n addition, it provides iroportaut new tools that banking and thrift regulators can use to handle troubled institutions.

UP.fortunately, the legislation does not include any measures to help modernize our financial s y stem, which continues to operat~ under antiquated laws that elate irom the 1930s. Theso laws, including portions of the Glass-Steagall Act, the McFadden Act, and the Douglas amendment to the Bank Holding Company Act, have become increasingly outdated as a result of the iast-changing global f inancial services marketplace with its explosion 0£ new products and services designed to satis f y conswners' changing needs.

Instead, the legislation .includes a number of restrictions and prohibition::> that stand in the \·1ay of heightened competition, lower costG, and increased efficiency in the delivery of ~inancial services. These restrictions include th~ closing of the so-calltid ''non-bank bank:' loophole {which provided consumers the s ubstantial competitive bene:!:'its of new entrants into the financial system) and a moratorium on expanded banking servic 1~s that is even more restrictive than the antiquated Glass-Steago'.11-;. provi3ions. As you }~now, the rl<lministration has consi::;tently raised concerns about the adverse effects such restrictions may have on both the competitive position of U.S. =inancial :irms anu consumers' needs for a variety of competitively priced products and :.H=rvices-.

! certainly share your view that everyone interested in this complex but critically important issue must work together over the coming year to develop a reasonable approach. A financial ~ystem that is composed of institutions that are profitable and risk-diversified through increased competition can only serve to promote the sa f ety and soundness of our nation's financial system. The Administration is confident that all members of that system, including insur<:mce agents, securities firms, real tors, banks, thrifts and others, will benefit from the incre ased competition that restructuring can provide.

As you may know , we are committed to working closely with the leadership in both the House and the Senate to produce a trade bill that is sound. Clearly, provisions that are country specific , GATT illegal, or trigger mandatory retaliation would be contrury to that goal, as you also point out.
