09/30/2015 388 MINUTE entry before the Honorable Young B. Kim: The city's motion to lift thediscovery stay 289 is denied. In its motion, the city seeks to move forward with alldiscovery against Defendants Purdue Pharma L.P. and Purdue Pharma Inc. (together,"Purdue") because the assigned District Judge has ruled that the city is entitled topursue a portion of its claims against Purdue. Specifically, on May 8, 2015, theassigned District Judge partially denied Purdue's motion to dismiss, ruling that onlycounts one and two out of the eleven-count complaint can proceed against it. (R. 288at 34.) In August 2015 the city filed a second amended complaint reasserting many ofthe claims the District Judge dismissed. (R. 328.) At a status hearing on September 22,2015, Purdue argued for the discovery stay to remain in place because it plans to moveto dismiss the second amended complaint. Purdue argues that discovery should notbegin until there is certainty as to the issues to be litigated in this case. The citycountered at the status hearing that discovery should move forward because the coreconsumer fraud allegations against Purdue remain the same. The court agrees withPurdue's position on this point. While the city is correct in its representation that thiscase boils down to whether Purdue (and other pharma companies) engaged in fraudand deception when promoting and marketing its opiods, the contours of theallegations now pending against Purdue are immensely broader than the contours ofthe allegations that survived Purdue's first motion to dismiss. The only claims of fraudand deceptive practice that survived the first motion to dismiss were based on theallegation that Purdue misrepresented its products when promoting them through"their own websites." (R. 288 at 29.) The claims against Purdue in the secondamended complaint, however, are much more robust and include many of the samecounts and allegations dismissed from the first amended complaint. The court findsthat if the second amended complaint remains in-tact after the anticipated motions todismiss, the scope of discovery will be much more expansive than the scope ofdiscovery this court would permit based only on the claims that survived the firstmotion to dismiss. The court weighed the possibility of permitting the parties toengage in discovery to address only the website allegations while waiting for a rulingon the anticipated motions to dismiss, but the issues pertaining to the websitesconstitute only a sliver of the claims against Purdue set forth in the second amendedcomplaint. Starting any discovery now, before the District Judge has a chance to ruleon the anticipated motions to dismiss the second amended complaint, would notpromote efficiency in managing discovery in this case. Also, there is no suggestionthat discovery pertaining to the websites allegedly controlled by Purdue would bedestroyed or lost if discovery did not commence immediately. Although there can besome benefit from collecting necessary discovery during the motion to dismiss phase,here any such benefit does not outweigh the complication and added burden thatnecessarily would be imposed on the court and Purdue (and potentially the otherpharma companies) from having three or more separate discovery tracks. For thesereasons, the most prudent approach is to wait to see what claims and allegationssurvive the second round of motions to dismiss. The discovery stay remains.
