I. Program Funding

As of the end of September 2010, four Proposition 0 bond sales have totaled $322,500,000 and bond interest earnings have totaled $11,501,835.

II. Standard Urban Stormwater Mitigation Plan (SUSMP) Waivers

Pursuant to Council File No. 99-0951, the Bureau of Sanitation is to notify Council when waivers from the SUSMP are requested and granted. Number of SUSMP waivers requested and granted during this period: None.

Ill. General Highlights of the Month

Program staff, in coordination with Public Affairs Office staff, coordinated the September 29 Riverdale Avenue Green Street Pilot Project Ribbon Cutting Ceremony celebrating the grand opening of the Riverdale Avenue Green Street project. Council President Eric Garcetti and Board of Public Works Commissioner Paula Daniels along with City officials and representatives from various non-government organizations and community residents were in attendance. Coordination efforts included sending out an E-vite to program stakeholders, promoting the event on Facebook and various web pages, and staffing the event. In addition, staff provided follow-up support by posting video clips and photos on program websites and social media sites.

IV. Public Education Section

1. Stormwater • Program members outreached to the public with program materials by participating

in the Budlong, Juliet!, Catalina (BJC) Community Resource Fair (CD 1 ), the Del Amo Action Committee Community Resource Fair in Torrance, Northridge Lowe's Safety Fair (CD 12) and the Runyon Canyon Park Emergency Pet Fair (CD 4).

• Program staff attended the Best Friends Strut Your Mutt held in Santa Monica and distributed 400 dog waste bags.

• Program staff received and filled a request from the organizers of the weekly Highland Park Farmers' Market. Staff provided them with various Stormwater Program educational materials to distribute at their booth.

• Program staff provided Stormwater public education materials to the promoters of the film Beautiful Islands. The materials were included in the goody bags being distributed to attendees at a screening of the film at the Directors Guild of America.

• Pet e-Updates are created and sent out to pet owners to inform them on how the Stormwater Program is working to protect pets and keep Los Angeles (LA) clean. During this reporting period, we received 85 new subscribers to our pet e-Updates bringing the total number of subscribers to 1 ,384. At the beginning of September, staff distributed the dog e-news to 1,237 dog owners, which generated 96 requests for dog waste bags and 90 responses to our online dog owner survey. In addition, during the month of September, we received 56 new subscribers to our pet e­Updates bringing the total number of subscribers to 1 ,440.

• The LA Stormwater You Tube Channel allows viewers to get the latest on program news and share comments. During August, the LA Stormwater channel had five new subscribers, 136 channel views and 65 uploaded views. During September, the LA Stormwater channel had one new subscriber, 106 channel views and 95 uploaded views. The total number of subscribers is now 16.

• Coordination with Tetra Tech (EPA Consultant) regarding updates to materials and contact information in EPA's "Toolbox".

• Coordination with Public Affairs Office, WPD Enforcement Section, WPD Management, Sanitation Executives and our consultant regarding preparation of flyers advertising locations for RV owners to dispose of their waste. Two locations have been established (Hyperion and Gaffey Street) and flyers are being distributed.

• Program staff and the PAO coordinated the Green Bus Tour in conjunction with the Clean Water America Alliance Conference.

• Completed the taping of the Rainwater Harvesting Video with Human Resources Development Division (HRDD) staff. Project is now in the editing stage.

• Program staff submitted a pet article about the importance of picking up after your pet to Wagville to be included in their newsletter.

• Program staff placed materials and information in stores to educate both store staff and customers on pollution prevention. During August, staff visited ten automotive stores, one pet store, one paint store, one hardware store, one home improvement store, and one gardening center for a total of 15 stores (CD 15). During September, staff visited 16 automotive stores, seven pet stores, three paint stores, one hardware store, three home improvement stores, and seven gardening centers for a total of 37 stores (CD 11, CD 12).

• Division staff continued an online customer satisfaction survey. The initial survey concluded on May 31'1, which was distributed to approximately 5,000 program stakeholders. We received 802 responses during the time it was initially opened. Staff continued the survey testing various markets. An additional 1,357 responses were received during the month of August, bringing a total of 2,238 responses. During August, 11 tote bags were distributed to those that took the survey. An additional 183 responses were received during the month of September bringing to a

total of 2,421 responses. Many of these responses were due to the survey going "viral" on various "free" websites. Analysis continues to be done on the survey responses to identify which responses are actually from City of Los Angeles residents.

• Program staff provided the Public Affairs Office with materials (media guides, tote bags and !-shirts) to be distributed to the media at a Low Flow Diversion media tour. Program staff provided the Echo Park Public Library with Stormwater Program outreach materials to be distributed to dog owners.

• Program staff responded to a request from Chatsworth Neighborhood Council for dog waste bags to be distributed to their stakeholders.

• Program staff responded to a request from CD #4 for dog waste bags to be distributed by their offices to their constituents.

• Program staff received and filled 32 requests in August from residents for various program materials (29 dog poop bags, 20 pet post cards, posters, stickers, etc) and 3 requests were received in September.

• Program staff received and filled a request from the Paris Baguette Restaurant chain for Restaurant BMP posters to display in their employee areas.

• Program staff received and filled a request from San Jose for Stormwater Program educational materials.

2. Graphics Support • Completed updates to LA Stormwater website. Updates to LAStormwater.org

included adding items to the What's New page (invitations and information to the TMDL Stakeholder event and the Sun Valley Watershed Projects event, RV Vouchers for Venice and San Pedro areas), the Water Quality Protection and Enhancement Page (LA River Revitalization announcement) and updated LID page(s).

• Completed updates to LA Prop 0 website. Regular monthly updates include Current News (included information about the Sun Valley Watershed Projects event and updates to the Machado Lake/Wilmington Drain pages in the Outreach and Environmental Documentation section), COAC and AOC meeting notices, agendas and minutes, and the monthly report from the Bureau of Engineering.

• Assisted the Public Works Operations Department of the City of Bellingham, Washington with graphics for the Restaurant Industry Best Management Practices Poster.

V. Enforcement Section

1. Industrial/ Commercial Facilities Inspections Program • WPD Enforcement staff conducted 982 industrial and commercial facility inspections

during August and September. • WPD Enforcement staff conducted 606 restaurant inspections during August and

September. • WPD Enforcement staff conducted 17 industrial and commercial facility follow-up

inspections during August and September.

2. Illicit Connection/Illicit Discharge Elimination Program WPD Enforcement Section Hotline: There were 179 calls received through the hotline during the month of August. Specifically, WPD received 84 reports of possible illicit

discharges, 74 reports of abandoned hazardous waste, 6 reports of illegal dumping, and 14 reports of spills, and 1 report of illicit connection. In September, there were 172 calls received through the hotline. Specifically, WPD received 61 reports of possible illicit discharges, 89 reports of abandoned hazardous waste, 10 reports of illegal dumping, 11 reports of spills, and 1 report of an illicit connection. • WPD Inspectors investigated 145 reports of possible illicit discharges. The

discharges were cleaned up and identified responsible parties were cited. • WPD Inspectors responded to 163 reports of abandoned hazardous waste and 6

reports of illegal dumping throughout the City of Los Angeles, and supervised the clean-up efforts by the Bureau's Hazardous Waste Remediation Contractor.

• WPD Inspectors responded to 25 spill incidents and supervised the remediation efforts.

• WPD Inspectors responded to 2 illicit connection complaints and found no evidence of illicit connection at the site.

• Through the month of September, WPD inspectors conducted daily surveillance of the Venice area for illegal RV dumping to the public right-of-way. One unoccupied RV, which was leaking sewage to the street, was towed and impounded. The spilled sewage was cleaned up by the Bureau's Remediation Contractor. The RV owner will be cited and the case will be referred to the City Attorney's office for prosecution.

• WPD inspectors supervised the clean-up efforts by the Bureau's Spill Remediation Contractor of a Culver City sanitary sewer overflow to the Centinela Flood Control Channel and the tributary storm drain line. The clean-up operation continued into October. ·

3. Development Construction Program • WPD Inspectors completed three construction site follow-up inspections during

August.

4. Monitoring and Reporting Program -Two days of upstream/downstream sampling of Ballona Creek were performed due to a sanitary sewer overflow at 6161 Centinela.

5. Enforcement Activity • Citations

o During the months, 7 Notices of Violation and two Notices to Comply were issued for violations of L.A.M.C. Sec. 64.70. All citations involved illicit discharges to the storm drain system.

6. RV Disposal Facilities • WPD and Hyperion staff established an RV domestic sanitary waste disposal facility

at the Hyperion Treatment Plant for RV's in Venice. • WPD inspectors distributed flyer/vouchers to RV owners throughout Venice.

o WPD inspectors monitored the Hyperion disposal facility during operational hours Monday through Friday.

VI. Total Maximum Daily Loads (TMDL) Development Section

• 303(d) List of Impaired Waterbodies (Sampling water bodies to be delisted)­Requirements for the 303(d) list submittal were sent out to the State Water Resources Control Board and the Environmental Protection Agency (EPA) on August 20, 2010.

These documents provide the information to re-evaluate the status of pollutants of concern for six waterbodies.

• Meeting with Environmental Protection Agency (EPA) Representatives - Staff provided information at a September 281

h briefing given by WPD management to EPA representatives. The EPA was given an overview of WPD, projects, challenges, and was taken on a field trip to see "green" solution projects.

• Workshop on Los Angeles River (LAR) Recreational Uses Re-evaluation - On August 31, the Los Angeles Regional Water Quality Control Board (LARWQCB) sent a notice for a workshop to reevaluate the recreational uses of LAR. WPD staff attended the Regional Board's workshop on re-evaluation of recreational beneficial uses in the Los Angeles (LA) River watershed held last September 27'h. The purpose of the workshop was to solicit stakeholder participation and input on Regional Board's approach to "re-evaluate the recreational [REC] beneficial use designations for all engineered channels within the Los Angeles River watershed." This re-evaluation process is motivated by two factors: [1] it was categorized by the Regional Board as a high priority for the 2008-10 Triennial Review process, and [2] numerous comments received during the draft comment period and oral testimony prior to adoption of the LA River Bacteria TMDL. The re-evaluation process could ultimately lead to Use Attainability Analyses (UAAs) and re-designation, de-designation and/or sub­categorization of REC uses. Staff plans to participate in committee meetings for further discussion of the re-evaluation process.

• EPA Listening Sessions About Rulemaking and Water Quality Standards Changes - TMDL Development Section staff set up and attended EPA Listening sessions on the water quality standards. EPA is planning to propose a limited set of targeted changes to the water quality standards to improve its effectiveness in helping restore, maintain the chemical, physical, and biological integrity of the nation's waters. The issues EPA is considering include anti-degradation, uses, triennial review, variances, and reflecting court decisions. The proposed rule will be published in summer of 2011 with 60 days comment period.

• Machado Lake Toxic TMDL - Staff gave testimony at the September 2"d Regional Water Quality Control Board (RWQCB) Hearing on adoption of Machado Lake PCB and Pesticides TMDL. RWQCB made requested changes to require additional monitoring by other jurisdictions if they do not divert all storm drain discharges from Machado, and added a re-opener.

• Dominguez Watershed/LAH/LBH metals/Toxics TMDL - TMDL Development Section staff attended the stakeholder meeting at the Regional Board on August 31 to discuss development of the implementation and compliance work plans. The Port of Los Angeles (POLA) developed a straw man for the implementation plan. It had some detail for the ports' implementation plan, but just an outline for the other areas. This was discussed in detail. Staff participated in the September 1'' conference call with EPA, RWQCB, and stakeholders on allocations sections. EPA holds these stakeholder calls for input during the development of this section. Staff, Port of Los Angeles, and consultants held several conference calls to discuss allocations and other items being prepared by EPA for the TMDL.

• Stormwater Monitoring Coalition Projects - TMDL Development Section staff presented two PW Board Reports for two Stormwater Monitoring Coalition (SMC) Agreements (Regional Bioassessment Project and 5-year Research Agenda Development) at the Public Works Board Hearing on August 23'd. Both Agreements were approved by the Board.

• Echo Park Lake and Lincoln Park Lake TMDLS - Staff and consultants held a conference call with EPA to discuss comments submitted to them on Echo Park Lake and Lincoln Park Lake. The City's concern is that even after implementing all lake management options including aeration, emptying the lake and refilling it with potable water, the Lincoln Lake would be healthy but nutrient targets may not be met due to the elevated TN and TP in potable water.

• Ballona Creek Toxic TMDL - In the third workshop for the development of TMDL Implementation Plans for the Ballona Creek (BC) watershed, TMDL staff and Steve Bay from SCCWRP gave a presentation on Sediment TIE study. This was the first time that the public learned that Pyrethroids (new generation pesticides) are the main cause of toxicity in the BC Estuary and potential alternatives to reduce on the use of these products on residential and commercial land uses.

• Legislation

SB 346 SB 346 was signed by the governor on September 27. Specifically, SB 346 calls for: o Copper in brake friction materials sold in California to contain no more than 5 percent

copper beginning January 1, 2021, and no more than 0.5 percent copper beginning January 1, 2025.

o A timeline that would allow manufacturers of replacement brake friction materials to deplete their non-compliant inventory.

o The creation of an advisory committee to assess alternatives to 0.5 percent copper and an extension process for manufacturers if alternatives are not yet available.

o No fees other than an assessment to help pay for the costs of administering extension requests.

o An exemption for brake friction materials used for certain motor vehicle classes, as well as an exemption on the sale of vehicles or brake friction materials manufactured prior to certain dates.

o Requirements to ensure that alternatives to copper do not create unintended environmental or human health impacts.

AB 1998 This bill would have put significant requirements on retailers regarding plastic bags. Most significantly, it would have required recycle centers, and the phasing out of single­use plastic bags. This bill failed to pass the state senate. City Council has suggested that they might ban plastic bags if it did not pass legislature.

AB 1834 This bill allows a homeowner to install a rainwater "recapture" system to irrigate landscape or recharge groundwater. While it exempts non-potable uses of rainwater from meeting drinking water standards, it requires them to meet Porter-Cologne standards for non-potable water and also any other federal, state, or local requirements for the protection of groundwater from contamination from storm water drainage. It also encourages rainwater capture.

VII. TMDL Implementation Santa Monica Bay I Ballona Creek Watershed

• Santa Monica Bay Beaches Bacteria (SMBBB) TMDL- In August, WPD staff met with the Flood Control District of the County of Los Angeles to discuss the various provisions of a Memorandum of Agreement (MOA) for the operation and maintenance of a proposed rubber dam as part of the Low Flow Diversion (LFD) expansion in Santa Monica canyon. WPD staff also continued working with the property management of the identified restaurant located down-stream of the LFD at West Channel Road to divert their groundwater discharge from the storm drain to the sewer collection system. Finally, the implementation section of the SMBBB TMDL provided comments regarding the upcoming new Santa Monica Bay off-shore/near shore debris TMDL. In September, WPD staff met with the Wastewater Collection Systems Division staff to discuss and exchange information on Low Flow Diversions (LFDs) operation and maintenance activities and performance, and to establish a routine monthly meeting for better communications. WPD staff also visited the LA County Flood Control District to learn rnore about the remote operation of rubber dam. Also an inspection and field visit of the identified restaurant located down-strearn of the LFD at West Channel Road has been scheduled to rnake arrangements for the property severance of their Storrn Drain connection.

• Ballona Creek Metals and Ballona Estuary Toxics TMDLs - In August, WPD coordinated with the Bureau of Engineering (BOE) in order to develop electrical schematics for use in developing the electrical design to bring AC power to the autosamplers. The MOA has been approved by the Board of Public Works and the Mayor's Office and is currently being executed by the agencies. WPD and EMD are currently developing annual monitoring report templates in order to compile the monitoring report to be sent to the Regional Board. The autosampler construction project was completed at the end of May 2010, with final Los Angeles County Flood Control District inspector sign-off in June 2010. All five autosamplers are now ready for sampling of future storm events, but are operated on battery power. WPD conducted a site visit of the autosamplers with BOE staff in order to better aid them in the electrical schematic designs. All agencies have submitted their executed MOAs for Metals and Toxics to WPD. WPD and Environmental Monitoring Division (EMD) developed annual monitoring report templates which are currently being populated by EMD. WPD also received the draft executive summary of the final Toxicity Identification Special study conducted by Southern California Coastal Water Research Project (SCCWRP).

• Bailon a Creek TMDL Implementation Plans Development - WPD is currently drafting the responses to Regional Board's comments on Metals Implementation Plan. WPD conducted the 3rd stakeholder workshop on September 21, which focused on the progress update of the Implementation Plan activities and development of Estuary Toxics Implementation Plan along with a description of the Toxicity Identification Evaluation (TIE) study performed by SCCWRP in the Ballona Estuary. WPD and Ballona Creek Watershed Agencies reviewed Section 1 to 6 of the Toxics TMDL Implementation Plan and are working with the Consultants to complete the draft plan before mid October. The Metals Implementation Plan is currently being prepared for final submittal on October 11, 2010. WPD has also met with Northeast Trees to explore options for working together for Ballona Creek Implementation Plan projects and selected two project locations for grant submittal. All agencies have submitted their executed MOAs for Implementation Plan development.

• Marina del Rey Harbor Toxic Pollutants TMDL - WPD staff assisted County of LA staff at the CLA permit counters in order to help them best determine the types of permits they would need to install their temporary autosamplers within the CLA public right of way. WPD staff also reviewed and commented on the County of LA design plan for those temporary autosamplers.

VIII. TMDL Implementation Los Angeles River Watershed

• Trash TMDL - West Coast Storm continues catch basins (CBs) opening screen installations in County-owned facilities within the City in the San Fernando Valley area. For the month of August, 1,216 new opening screen covers were installed bringing the total for the Phase Ill retrofit project to 19,639.

• Machado Lake Nutrient TMDL - Finalized Lake Water Quality Management Plan (LWQMP) and submitted to Regional Water Quality Control Board (RWQCB).

• Los Angeles River Metals TMDL - SB 346 (Brakepad Copper phase-out bill) passed Assembly (70-3) and Senate with Assembly amendments (31-6). Senate Bill (SB) 346 (Brakepad Copper phase-out bill) was signed by the governor on September 251

h. The Coordinated Monitoring Plan (CMP) Annual Report was submitted to the Regional Board on September 23'd

• State Bond-Funded Projects o Manchester Neighborhood Greenway Project - The Watershed Protection Division

submitted grant applications for the Clean Water Act 319(h) Nonpoint Source Grant Program and the California Natural Resources Agency Environmental Enhancement and Mitigation Program.

o Garvanza Park Best Management Practices Project - The quarterly report and deliverables required by the Prop 40 grant were submitted to the State. The Board of Building and Safety Commissioners heard and approved the Import-Export application on September 141

o Riverdale Green Street - The pilot study for evaluating Bio Clean Environmental Services, Inc. media filters was completed in August. A ribbon cutting ceremony and neighborhood celebration was held on September 29 to mark the completion of the project and the adoption of Green Street standard plans by the Board of Public Works. Speakers at the event included Councilmember Eric Garcetti and Board of Public Works Commissioner Paula Daniels.

o Downspout Disconnection Program- The consultant, Malcolm Pirnie, Inc., submitted the final report, titled "Rainwater Harvesting Pilot Program Evaluation: Recommendations for City-Wide Program Implementation."

• Green Streets Initiative o Green Street Committee (GSC) - The Department of Water and Power hosted the

committee's monthly meeting on August 10 and September 14. A presentation was given on the "North Hollywood Alley Retrofit Best Management Practice Demonstration Project" (by Eric Yoshida, DWP).

o The Green Streets Committee's "Green Infrastructures Program Status Report," approved by the Board of Public Works, was forwarded to the City Council and Mayor for approval.

X. Program Compliance Section I Development Planning - Plan Check Review Program

• Stormwater Annual Report - In conformance with the provision of the NPDES Municipal Stormwater Permit, a Stormwater Annual Report must be completed and submitted to California Regional Water Quality Control Board. With the assistance of WPD staff, the 2009-2010 Stormwater Annual report was completed and submitted on August 31, 2010.

• Los Angeles RECARGA Workshop - A workshop was conducted that introduced this application to WPD's technical staff. The development of this computer application was funded by the stormwater program and it models the performance of biofiltration/rain garden system.

• Public Agency Activities Committee (PAAC) Meeting - The Program Compliance Staff conducted a Public Agency Activities Committee (PAAC) meeting on Wednesday, September 29th. The following items were discussed: the 2009-2010 Stormwater Annual Report, new requirements for the new General Construction Permit and annual stormwater training.

• Training - Mr. Kosta Kaporis of WPD attended the Qualified Stormwater Pollution Prevention Plan (SWPPP) Developer (QSD)/Qualified SWPPP Practitioner training held by the Constructions Management Association of America (CMAA).

• Augustus F. Hawkins Constructed Wetlands- PAS responded to a request from the Council District #9 Office to investigate the reason why the aeration system was not working properly in the wetland area. PAS staff discovered a leak in the air supply line. The problem was referred to the Department of Recreation and Parks' plumbing crew.

• Mar Vista Recreation Center - PAS staff initiated dry weather sampling at the Mar Vista Stormwater BMP project. Samples were collected for indicator bacteria, metals, and TSS.

• Los Angeles River Flow Study - PAS conducted dry weather flow measurements at monitoring sites for the Los Angeles River Metals TMDL (Coordinated Monitoring Plan). The study was conducted to examine if manual measurements correspond to values reported by permanently installed stream gages.

• Los Angeles River Metals TMDL - PAS staff attended the Metals TMDL Technical Committee meeting on September 81

h. Staff presented preliminary results of the metals translator study, cost estimates for future flow monitoring, results of the special flow study, and dry weather metals data for the month of July 2010. On September 281

• Los Angeles River Beneficial Use Study - PAS staff attended the Regional Board workshop that introduced the Board's plan to re-evaluate the recreational uses that occur in Los Angeles River.

• Internship Program - Randal Curtis (PAS intern) was recognized at an award ceremony on September 291

h for her participation in the Bureau of Sanitation/Community Development Department internship program. Staff was also present at the ceremony. The internship was funded through the American Recovery and Reinvestment Act (ARRA).

XII. Proposition (Prop 0) Section

• Administrative Oversight Committee (AOC) - The committee's regular meeting scheduled for August 26, 2010 was cancelled. The committee held its regular meeting on September 301

h. The Administrative Oversight Committee (AOC) approved a move­out plan by which the Metropolitan Transit Authority (MTA) will vacate the buildings on the South Los Angeles Wetlands Park project site in two phases - by September 30, 2010 and January 11, 2011, respectively. The AOC requested the Department of Recreation and Parks complete a new lease agreement with the MT A, in consultation with the Bureau of Engineering (BOE) and the City Attorney. Rent payments made by the MT A would be used to reimburse the BOE for costs associated with the MTA's compliance with the new lease agreement.

• Citizens Oversight Advisory Committee (COAC) - At its meeting on August 18, the committee instructed staff to prepare the concept report for the Albion Dairy Park project. The committee held a special meeting on September 15 at the Sun Valley Park Recreation Center. Prior to the meeting, City and County staff, and the Los Angeles and San Gabriel Rivers Watershed Council, led the committee on a tour of the Elmer Avenue Green Street, Strathern Wetlands Park, and Sun Valley Multi-use Facility project sites. Other tour participants included a representative from the 61

h Council District, Public Works Commissioner Paula Daniels, TreePeople, and members of the community.
