RE: Twaalfskill Creek Drainage Request for Proposals
Dear President Noble:
In as much as the Twaalfskill Creek carries a base flow and stormwater runoff from at least ten distinctwatersheds, is the largest stormwater conveyance structure in the City, encompasses several stormwaterconveyance structures in poor condition, and exhibits some meandering that endangers private property; arequest for proposals to identify the nature of the stormwater flows the system experiences under variousconditions has been advertised.
The information gleaned by this work will set the flow capacity boundaries for future repairs/replacements ofthe Chapel Street Culvert, the Brook Street Culvert, the South V/all Street Culvert, and the uncontrolled channelmeandering along Wilbur Avenue identified on our Capital Projects List. The assumed budget for this project isunder $100,000.

Dear President Noble,
This is a request for placement on the agenda of the next appropriate Committee, expected to theFinance and Audit Committee, to discuss resolutions required for the advancement of grant projects
Broadway Streetscape Project: The City is about to receive executed contracts for theEnvironmental Facilities Corporation Green Infrastructure Grant Program and Department ofEnvironmental Conservation Climate Smart Communities awards. We are requestingresolutions to expend funds in the first instance for these grant awards. In addition, we arerequesting that the Council pass a bond in the amount of $490,000 to appropriate funds forconstruction of the Broadway Streetscape Project. The City is expected to contribute a total of5922,000 in matching funds to grants received for the project. A previous bond for $432,000was passed in May 2017, and we are now requesting the difference to ensure we have the matchfunds for the project and advance the project in a timely manner. It is possible that the Citymay obtain more grants that could replace the bond funding before the project goes toconstruction.

Dear President Noble,
As you are aware, the NYSDOT is finalizing plans and specifications for the construction of the KingstonRoundabout to replace the existing signalized intersection atl-587 and Albany Avenue.
The proposed work will impact our existing sanitary and potable water infrastructure in that the new work will likelydisturb or in some way affect the integrity of our utilities that cannot always be detected during the course of thework. In addition, upon completion, our utilities will still be 7 5 - 1 00 years old, and in some cases, difficult to service,with new transportation facilities over. The stormwater improvements will be replaced as part of the new work, so weneed not concern ourselves with impacts to that system. Our options include, do nothing, which really isn't an option,or upgrade our affected facilities within the DOT's overall project as "betterment" to the DOT Project.
I recommend authorizing the Mayor to sign a Utility Work Agreement, attached, by recommended resolution, also
attached, and providing for the replacement of affected sanitary sewers.

As a follow up to our July 14, 2017 letter regarding the Department's above referencedproject and your intentions to replace your sewer facilities within our project limits, we herebysubmit a preliminary estimate for the proposed work.
Please review the attached estimate and provide any comments or concems you may have bySeptember 28, 2017. Please be advised the attached preliminary estimate includes a líYoengineering cost for our Department to conduct the necessary engineering and prepare the
contract documents. If your Department wishes to conduct the engineering yourselves this 15%
can be deducted from the preliminary estimate. If your Department elects to conduct theengineering, please be advised all contract plans, details and specifications must meet NYSDOTstandards.
If your Department is agreeable with the attached estimate, we can proceed with the
Betterment Utility V/ork Agreement. In addition, a City Resolution will be necessary. Form I{C-140 is attached for your reference and a draft resolution is attached as well. We can assist indrafting the resolution, if necessary.

Contract documents for the above referenced project must be complete by June 7, 2018. TheBetterment payment will be due at that time. Bid opening is currently scheduled for September 6,2018. At that time, we will review the item prices and adjust the Betterment cost accordingly. Ifthe bid prices are higher than our estimate your Department will be responsible to remit paymentbefore the contract can be awarded (typically within 45 days of the bid opening) for thedifference. If the bid prices are lower, your Department will be credited.

maintain the faciiity in accordance with allapplicable codes, standards and regulations, including his
obligation, where applicable, to remove any or all of the facility from the highway at the order of the
Commissioner of Transportation, all in accordance with the Rules and Regulations Governing the
Accommodation of Utilities within the State Highway Right-oÊWay. All compensable claims covered
by this agreement will be included in one of the following:
A. Privately Owned Property Agreement executed prior to the performance of the work.
B. MunicipalAgreement executed prior to performance of the work.C. Reimbursement Agreement executed prior to performance of the work.

AUTHORIZING PAYMENT TO THE STATE FOR REqUESTED WORK
Resolution
WHEREAS in connection with Contract PIN 881L.26, for the construction of a roundabout at the
intersection of l-587 and Albany Ave., S.H. 75-30, City of Kingston, Ulster County by Resolution
No adopted , 20L7, requested and authorized the State Department
of Transportation to proceed with the necessary arrangements to incorporate new sewer
facilities in the contract for a roundabout, S.H. 75-30, with the cost of said sewer facility and
necessary work in connection therewith to be borne by the City of Kingston, and
WHEREAS THE City Council desires that the said sewer facility, the City's share of which based
on the "additional cost" method is estimated to cost S be constructed at the sole
expense of the City of Kingston, in connection with the above mentioned State contract, as set
forth in the plans for said project.
NOW THEREFORE BE lT REOSOLVED, that pursuant to Section 10, Subdivision 27 of the New
York Highway Law, the sum of is hereby appropriated to cover the cost of the
new sewer facility, and the City Treasurer is hereby authorized and directed to deposit such
sum with the State Comptroller ninety (90) days prior to the contract bid opening, and be it
FURTHER RESOLVED, that a copy of this resolution be filed with the State Comptroller and with
the State Commissioner of Transportation; it being understood that upon completion of the
said roundabout, in the City of Kingston, the Commissioner of Transportation of the State ofNew York shall transmit to this City Council a statement showing the actual costs and expenses
of such work and shall notify the City Treasurer of the amount due from or to be returned tothe City, as case may be, and that any sum due the State of New York shall be paid by the City ifKingston within ninety (90) days after the date of transmittal of said statement, and the funds
thereof shall be raised according to the statutes in such cases made and provided; and be it
FURHTER RESOLVED, that the City of Kingston will maintain said new sewer facility after
construction thereof as set forth and will make ample provision each year for such
maintenance, and
BE lT FURTHER RESOLVED that the Clerk of this City Council is hereby directed to transmit five(5) certified copies of the forgoing resolution to the New York State Department ofTransportation.

Dear Pres. Noble:
On behalf of the City of Kingston Tree Commission we are pleased to have been awarded a 550,000 grant toconduct a Tree lnventory throughout the City. The focus is to be on public street trees and if fiscally possible
we will expand to our municipal parks.
ln completing a Tree lnventory, the City will be best informed about where additional plantings are needed,
how to best address tree maintenance, and will be positioned to inform and complete an urban treemanagement plan and pursue additional funding sources to aide in complimenting and replacing our
vegetation which has been lost to several recent storms.
This award requires no local match of funding. We are under an accelerated timeframe for the project which
was only just awarded on October 20,20t7. We have already begun to formulate a Request for Proposals
(RFP)to be circulated through our Purchasing Department.
Therefore, to accomplish our next action item the following is requested consideration of:
A resolution be adopted by the Common Council which:
o Accepts the Grant from the NYS for an Urban Forestry Grant in the amount of $50,000, forpurposes of undertaking a street tree inventory,
o Authorizes the Mayor to execute any and all documents as may be necessary to carry outthe objectives of the project,
o Authorizes the City Comptroller to establish an expenditure line within the FY 2018
Planning budget in the amount of $50,000, along with a revenue line in the FY 2018 Budget
for $50,000. These wif I offset each other for a net zero budget change.

After consulting with my staff and members of the parking work group, I have drafted the enclosed off-streetparking proposal for 2018. As you will see, this proposal includes three different payment options for users ofthe metered parking lots, based on the frequency of their use. In addition, this proposal introduces the
implementation of a "participatory budgeting" project for the first time in the City's history. I request that thismatter be referred to committee for consideration as part of the 201 8 budget and will make myself available toattend the Finance Committee scheduled for V/ednesday, November 15th, which is when I would anticipate thismatter being discussed.

In an effort to accommodate the needs of various users of off-street metered parking lots*, the City of Kingston will offerthree payment options:
1) Hourly fee- 75 cents per hour through parking pay stationa. Pay by coinb. Pay by credit cardc. Pay by Whoosh! mobile app
About this option:Pay by hour is the idealoption for infrequent users of the metered parking lots.
2) Monthly Permit- $20.00/montha. Purchase a permit by credit card on-site through the parking pay station
About this option:Purchasing a monthly permit is the ideal option for frequent users of the metered parking lots who wish to access a permiton-site, who are parking for a significant enough period of time that the hourly fee would become burdensome, andlorwho want a discounted rate but who do not anticipate needing extended parking for more than a few weeks or months.Finally, the monthly permit offers a lower upfront cost than the annual permit.
3) Annual Permit- $100.00/yeara. Purchase a permit online by credit card at www.kingston-ny.gov/parking or by check or money order by
postalmail.
About this option:Purchasing an annual permit is the ideal option for very frequent users of the parking lots, The annual permit is by far themost cost-effective option, averaging out to less than $ 10 per month.
*Paid parking lots include: all 3 North Front St. lots; the Cornell St. lot; the Prince St. lot; and the Dock St. lot.
Participatory B udgetingBased on this proposed fee schedule, the City estimates a total revenue collection of $60,000. Of that, half ($30,000)would be distributed equally to the three business districts (S10,000 per district) to be used for projects developed by thepublic through a participatory budgeting process. If revenue is raised in addition to the $60,000, that revenue would besplit between the three districts for additional projects.
Snow EmergenciesDuring snow emergencies, all metered lots will be free for the duration of the snow emergency. An alert will be posted onthe screen of the parking pay station to inform users of the suspension of parking fees. All vehicle owners willbe requiredto adhere to instruction by the Department of Public Works when lots are posted so that the snow can be cleared.

Dear President Noble,
As part of the development of the 20 1 8 budget process, my senior staff and I have identified vehicle needs inthree different departments. Instead of bonding for these purchases in 2018, I recommend that we purchasethese vehicles in 2017 through use of the Contingency Fund, which cunently holds $417,000. The vehiclepurchases would be for the following:
1) Kingston Police Department - 4 Four Ford Escape Police Vehicles - $30,000 x 4: $120,0002) Kingston Comptroller's Offrce - I Ford Pick Up Truck with lift-gate - $32,000 x I : $32,0003) Building and Safety Division - 3 Electric Vehicles (Make TBD, based on State Mini-Bid) $25,000

The total amount requested from the Contingency Fund would be $227,000. This would allow us to make muchneeded improvements to our vehicle fleet in various city departments.

RESOLUTION APPROVING THE DEVIATION BY THE ULSTER
COUNTY INDUSTRIAL DEVELOPMENT AGENCY RELATING TO
THE TERMS AND CONDITIONS OF A CERTAIN PILOT
AGREEMENT TO BE ENTERED INTO BETWEEN ULSTER
COUNTY INDUSTRIAL DEVELOPMENT AGENCY AND
LANDMARK PRESERVATION, L.P. IN CONNECTION WITH THE
LANDMARK PRESERVATION, L.P. PROJECT.
BE IT ENACTED by the Common Council of the City of Kingston, New York (the “Common
Council”), as follows:
WHEREAS, pursuant to Title 1 of Article 18-A of the General Municipal Law of the State of
New York, as amended (the “Enabling Act”) and Chapter 787 of the 1976 Laws of New York, as
amended, constituting Section 923 of said General Municipal Law (said Chapter and the Enabling Act
being hereinafter collectively referred to as the “Act”), the County Legislature of Ulster County has
heretofore appointed the Chairman and members of Ulster County Industrial Development Agency (the
“Agency”) and has duly caused to be filed in the office of the Secretary of State of the State of New York
the certificates required by Section 856 of the Act; and
WHEREAS, to accomplish its stated purposes, the Agency is authorized and empowered under
the Act to acquire, construct, reconstruct and install one or more “projects” (as defined in the Act) or to
cause said projects to be acquired, constructed, reconstructed and installed, and to convey said projects or
to lease said projects with the obligation to purchase; and
WHEREAS, in November, 2017, Landmark Preservation, L.P. (the “Company”) submitted an
application (the “Application”) to the Agency, a copy of which Application is on file at the office of the
Agency, which Application requested that the Agency consider undertaking a project (the “Project”) for
the benefit of the Company, said Project consisting of the following: (A)(1) the acquisition of an interest
in (a) an approximately 2.90 acre parcel of land located at 295 Broadway (tax map no. 56.34-9-1) in the
City of Kingston, Ulster County, New York (the “Broadway Land”), together with an approximately
69,000 square foot building located thereon (the “Broadway Facility”) and (b) an approximately 2.30 acre
parcel of land located at 1 Albany Avenue (tax map no. 48.80-1-12.11) in the City of Kingston, Ulster
County, New York (the “Albany Land” and collectively with the Broadway Land, the “Land”), together
with an approximately 107,000 square foot building located thereon (the “Albany Facility” and
collectively with the Broadway Facility, the “Facility”), (2) the renovation and rehabilitation of the
Facility, and (3) the acquisition and installation therein and thereon of certain machinery, equipment and
other personal property (collectively, the “Equipment”) (the Land, the Facility and the Equipment being
collectively referred to as the “Project Facility”), all of the foregoing to constitute a Section 8, senior and
handicapped housing facility to be owned by the Company and leased to residential tenants and any other
directly and indirectly related activities; (B) the granting of certain “financial assistance” (within the
meaning of Section 854(14) of the Act) with respect to the foregoing, including potential exemptions
from certain sales and use taxes, real property taxes, real estate transfer taxes and mortgage recording
taxes (collectively, the “Financial Assistance”); and (C) the lease (with an obligation to purchase) or sale
of the Project Facility to the Company or such other person as may be designated by the Company and
agreed upon by the Agency; and

WHEREAS, in connection with the undertaking of the Project, the Company will execute and
deliver a certain payment in lieu of tax agreement (the “PILOT Agreement”) by and between the Agency
and the Company pursuant to which the Company will agree to pay certain payments in lieu of taxes with
respect to the Project Facility; and
WHEREAS, the Company is seeking to have the PILOT Agreement provide for a thirty-five (35)
year tax exemption for the Project Facility, during which the Company will make fixed payments in lieu
of taxes to the affected tax jurisdictions with respect to the Project Facility, said fixed payments to equal
$346,015 in the aggregate annually, with a 2% increase each year during the term of the PILOT
Agreement; and
WHEREAS, the annual payments described above will be allocated among Ulster County, the
City of Kingston and the Kingston City School District pro rata based on the tax rates of the taxing
entities; and
WHEREAS, these payment terms constitute a deviation from the Agency’s Uniform Tax
Exemption Policy (the “Policy”); and
WHEREAS, under the Agency’s Policy, prior to entering into a payment in lieu of tax agreement
that deviates from the Policy’s standard payment terms, the Agency shall (1) notify each affected tax
jurisdiction, and (2) attempt to obtain the written consent of all the affected tax jurisdictions; and
WHEREAS, the Agency desires that the City of Kingston, through its Common Council, as one
of the affected tax jurisdictions with respect to the Project Facility, adopt a resolution indicating whether
the Common Council agrees to the terms of the proposed PILOT Agreement;
NOW, THEREFORE, BE IT RESOLVED by the Common Council, as follows:
Section 1. For the purpose of satisfying the requirements contained in the Agency’s Policy, the
Common Council hereby approves the payment terms described above, including the proposed deviation
from the Agency’s Policy outlined above.
Section 2. The Mayor of the City is hereby authorized, on behalf of the City, to execute and
deliver the PILOT Agreement for the purpose of evidencing its approval to the proposed deviation from
the Agency’s Policy, said PILOT Agreement to contain the payment terms substantially in the form
presented at this meeting, with such changes, variations, omissions and insertions as the Mayor of the
City shall approve, the execution thereof by the Mayor of the City to constitute conclusive evidence of
such approval.
Section 3. The officers, employees and agents of the City are hereby authorized and
directed for and in the name and on behalf of the City to do all acts and things required or provided for by
the applicable provisions of this Resolution in order to ensure compliance with such provisions as they
relate to the execution and delivery of the PILOT Agreement, and to execute and deliver all such
additional certificates, instruments and documents, and to do all such further acts and things as may be
necessary or, in the opinion of the officer, employee or agent acting, desirable and proper to effect the
purposes of the foregoing resolution.
Section 4. This resolution shall take effect immediately.

We represent K&R Preservation with relation to two properties they are hoping topurchase in the City of Kingston - the Governor Clinton building at 1 Albany Avenue and the Yosman Apartments at 295 Broadway. K&R intends to make a significant investment in theproperties including $10M in improvements that will refurbish every apartment (new kitchens, bathrooms, paint, etc) as well as all common areas and mechanical systems. They will make a commitment through HFA and Freddie Mac that the apartments will remain affordable housing under the section 8 program for 40 years.
Because of that commitment and the investment they will make, K&R is seeking PILOT assistance through the Ulster County IDA. The PILOT would be for a period of 35years. To ensure that none of the taxing jurisdictions will lose any revenue, K&R is proposing to pay the existing taxes on the properties ($346,000 yearly) and add an additional 2% eachyear during the 35 year term.
We are under a very tight time frame, especially given the coordination requiredwith the City, County, IDA and school district. Our transaction must close by the end of the year. We ve met �with the Mayor, County, IDA and district. On Wednesday the IDA voted to hold the required public hearing on our application. The timing is such that we have to have a resolution from the City Council before the IDA takes a final vote in December. The only way to do so given the meeting schedules, as I understand it, is to have the City Council refer the resolution to the finance committee next week. We, of course, are prepared to meet with and give presentations to the Council and the members of the Finance Committee as necessary.
Attached is the resolution that was drafted by Counsel to the IDA.

Continuing G rout Removal Operations
Dear President Noble:
Grout removal operations within the Washington Avenue Tunnel continue. At this juncture, roughly 45% of theauthorized funding (5374,000) for construction activities has been expended, and roughly 4O% of that amount (S154,000)used to assess existing conditions, develop an appropriate health and safety plan, mobilize manpower and equipment,install by-pass pumping for sanitary flows, and remove solidified grout within the storm channelto provide needed access
for grout removal in the sanitary sewer. Grout clearing efforts have utilized robots with a variety of specialized grindingwheels, chipping tools and chain flails. We continue to evaluate different tools for their effectiveness, and would like toreview the Project, as it stands, with the Finance Committee at their November Meeting; at that time we will be able toprovide a complete assessment of means and methods.
As you may recall, the work was awarded to a local, responsible contractor, Arold Construction, lnc., for an amount ofS863,000. The contract documents were developed using daily rates for various activities, as production rates wereunknowable, and therefore, a unit cost basis would have been "Unþj!þþ!e".
