BE IT ENAOTED by the Governor of the Colony ofKenya, with the advice and consent of the Legislative Councilthereof , as follows :-

1. This Ordinauce may be cited as the Asian Civil short title.Servants (Proportionate Pensions) Ordinance, 1935.

Notwithstanding anything contained in the Non- certainEuropean Offtcers' Pensions Ordinance, 1932, or in the pqrsons per-

mztted toRegulations made thereunder, or in any other 1aw under which retirepensions m ay be granted to Asian civil servants in the service upon pro-

porqonateof the Colony, each of the persons mentioned in the flrst pezmons.

OBJECTS AND REASONS'.

In order to ease retrenchm ent m easures all the olcerswhose names appear in the Schedule to tlais Bill were allowedto retire voluntarily, and have since their retirement beenin the enjoyment of pensions, which pensions have beenapprovetl from time to time by the Govetnor in Council. Thepayment of these pensions must, however, be legalized by thelegislatm e, and this Bill is introducecl for the purpose of suchlegalization.

The penkions ancl gratuities granted under the schemehave amounted to approximately :9 ,220 in respect of gratuitiesantl :4,423 per annum in respect of pensions.

The buildings shall be ofstone, burni briek or conerete, on proper founda-tions, and those to be erected on plots Nos. 2433and 2434, 5th Avenue, must be of not less thantwo stories in height, ancl must be ol a value o;t hotless than eents 90 per eubie foot of building content.Those to be ereetecl on Plots Nos. 2426-2432, in-

elusive, m ust be of a value of =ot less than sents70 per cubic foot of building content.10. W ithin twelve m onths of the comm encement

The Cominissioner of Lands, or sueh otlzerperson as he may appoint for the purpose, shallwitllin one mouth ol the approval of the plan by tlleNairobi M unicipal Council, notify the grantee of hisapproval or otherwise of the plans, and Bhall alsonotify the date by which sueh buildings shall beerected.Tf the ereetion of the buildings in aecordance wifh

the approved plans and specifications be not com -pleted by the prescribecl date, the said Comm is-sioner znay, on good and reasonable cause beingshown, grant sueh extension as he m ay deemsufllcient, subject to such eonditiong as he may pre-seribe. .Provided tllat if the yrantee .shall receive no

intimation from the Com mlssioner within one monthof the date on whieh the plans have bean approvedby the Nairobi M unieipal Council, he m ay proceedwitll the erection of the building in accordance witlathe plans submitted, and the Com missioner shallnot have the power to cause to be m ade any altera-tion or variation in the plan or the date.

12. Subject to the proviso contained in clause 11hereof , no building shall be ereetecl on the plotunless plans (incltiding a block plan showing tlaeposition of the buildings), drawings, elevations andspeeifleations thereof shall have been previouslyapprovetl by the Comm issioner o.f Lands or sucllother person a: he may appoint. N OTICE is hereby given that the undermentloned goods wili be sold by publicauction at Kilindini, on the 4th June, 1935, if not cleared before that date and theproceeds will be applied as follows :-

Firstly, in the payment of the expenses of the sale ;
