Maybe you’ve noticed - the Salinas Valley Chamber of Commerce has been working on“sprucing up the place.” We’ve completely retooled our email communications (are you on our list? Please check out page 8 in this issue to see what’s in it for you, and how to be added). We’ve been posting interesting tidbits on Facebook. (What, you haven’t Liked us yet? Shame!) We’ve got more things we’re working on, but at this time we are proud to present (drums are rolling loudly), our newly revamped website!! www.SalinasChamber.com (You’re smart and you probably guessed the website.) This website is much more than just a website. It’s actually a pretty face that is sitting on a very powerful (but largely unseen) body. That body is the new Chamber management software we’ve implemented. The SalinasValley Chamber has made the investment to go from an old, oh, let’s just call it“clunky” software…all the way up to the state of the art best software out there. The old software was not integrated with our website, nor with our payment processing…it wasn’t really integrated with much. What that means for members is that staff time was wasted in manually checking and reconciling different systems. Not only was that a waste, it also allowed the introduction of data entry errors. Our time should be spent on doing things that add value to our members. (I know, shocking concept!) We’re getting there, and I believe this software migration is a huge step along that path. What’s in it for me? I love that question. Some people are afraid of it, but ultimately, it’s important that we always ask. Each Chamber member will be able to access the site so they can update their own information, register for events, access payment histories/receipts and make payments, learn about and take advantage of Chamber marketing options online, and more. Retailers will be able to post“Hot Deals”(more on this later). If you’re a good citizen and want to patronize the businesses that support our community, it’s going to be easier than ever to use the Chamber to find those businesses. It’s going to take some time, because we have to really scrub our database (don’t worry, we’re not using Ajax or harsh abrasives so the data won’t get any scratches). We’ll have to revisit each of our members’profiles and re-consider and update their“attributes.” When we’re done, you’ll be able to use our website to find Chamber member restaurants who serve Italian food and offer catering or private banquet space for 50. Not that you have to do that too often, but when you do, our website will help. Simple, simple, and useful Those are three pleasant words, especially“simple.” Our new website has more valuable content in an easy-to- find format. We’ve all been frustrated by those“needle-in-a-haystack”websites. Don’t drown me in info; help me find what I need, quickly. We hear you and we agree. Rome was not built in a day (I heard it took about 3 weeks), and some of the new features of our website will be rolled out in stages. Because there’s a lot going on behind the scenes and we want to make sure we’ve thought through those devils in the details…we’ll be releasing some of the features over time. But most of it is ready to go right now. Documenting Employee Performance

Oneofthemostdifficultaspectsofbeinganemployerisevaluatingemployeeperformance.Supervisorsresponsiblefortheseassessmentsoftentellanemployeethatheorsheisdoingagoodjobtoavoidhurtfeelingsorbecausetheydon’twanttodiscouragetheemployee.Afailuretobehonestwithemployeesisnothelpfultotheemployeeandcanresultinliabilityfortheemployer.Manyemployershavean“atwill”policy,whichmeansthattheemployerortheemployeecanendtheemploymentrelationshipwithorwithoutnoticeandwithorwithoutcause.However,anemployercannotterminateanemployeeforanunlawfulbasissuchasadiscriminatoryorretaliatoryreason.Ifanemployerdoesnothavedocumentationthatsupportsitsreasonsfordisciplining

orterminatinganemployee,itmaybesusceptibletoaclaimthattheactiontakenwasforanunlawfulreason. Whatshouldanemployerdo?Itisimportanttoletemployeesknowone’sexpectationsthroughpoliciesonstandardsofperformance.Thepoliciesshouldbeinwritingwithanacknowledgmentofreceiptforemployeestosignconfirmingthattheyreceivedandunderstoodthem.Supervisorsshouldbetrainedinthepolicies.Atthetimeofhire,thenewemployee’ssupervisor,ortheHumanResourcesDepartment,shouldreviewthepoliciesindetailwiththeemployee.Supervisorsshouldalsoregularlyreviewpolicieswithemployeesduringstaffmeetings. Asimportantasitistohavepolicies,consistencyinfollowingandapplyingthepoliciesiscritical.Ifanemployeralwaysgivesoneemployeeanannual

performanceevaluation,thatshouldbedoneforallemployees.Ifoneemployeeisfiredforbeinglatetoworkfivetimesinathree-monthperiod,thesamepolicyshouldbeappliedtoallemployees.Largeremployerswithvariousdepartmentsandsupervisorsshouldensurethatsupervisorsareconsistentwithintheirdepartmentsingivingperformanceevaluationsandintakingdisciplinaryactions. Whatshouldgointoaperformanceevaluation?Itshouldassessskillsthatarerelevanttotheemployee’sposition.Ifanemployeedoesn’tdealwiththepublic,anassessmentofhisorherskillswithcustomerswouldnotberelevant.Manyperformanceevaluationformsarenumericalorhavea“meets/doesnotmeetexpectations”standard.Ifanemployeeisratedas“doesnotmeetexpectations”onaparticularskill,theexpectationsshouldbedescribed,aswellasdetailsprovided

ofhowtheemployeehasfailedtomeetthem.Forexample,ratherthanwrite“Pathasabadattitude,”theevaluationshoulddescribetheemployee’sconduct.“Patfailstomeetdeadlines.OnMarch1shewasgivenasegmentofateamprojectandwasgivenadeadlineofMarch7.Shedidn’tturnhersegmentinuntilMarch11.Asaresultthewholeteamprojectwaslate.”Thissametypeofdetailshouldgointodisciplinarynotices. Bydocumentingemployeeperformanceissues,employeescanknowwhattheyneedtodotoperformtheirjobswell,andemployerscanreducetheirliability. Jerry Brown Says Environmental Law Overhaul Unlikely For Now

GovernorJerryBrownacknowledgedhelikelywon'tbeabletooverhaulCalifornia'ssignatureenvironmentallawinthecurrentlegislativesession,citingoverwhelmingoppositionfromfellowDemocrats. TheCaliforniaEnvironmentalQualityAct,Browntoldreportershere,"issupportedbysomekeygroupswithintheDemocraticParty,andIthinkitwouldbedifficultfortheLegislaturetomovethatprocessforward." Brownsaidheremainscommittedrelaxingprovisionsofthelawbutthathehasalargeagenda,includingthe

statebudget,waterinfrastructureandhigh-speedrail.Hesaid"theappetiteforCEQAreformismuchstrongeroutsidethestateCapitolthanitisinside." Brownsaid,"Thisisnotsomethingyougetdoneinayear,butIbelievebeforeIdepartthisstagewewillseereforminCEQA."Askedabouttheprospectofaballotinitiative,Brownsaiditis"alwaysapossibility." TomMartella’sveryfirstexposuretotheChamberofCommercewasatamembershipmixer.IttookplaceinwhatwasthentheMontereySavingsandLoanbuildingonthecornerofMainandAlisalStreets.Hisfirstthoughtswere“I’mtheyoungestpersoninthisroom!”Forty-fouryearslateratamembershipmixerthispastFebruary,hisfirstthoughtwas“I’mtheoldestpersoninthisroom!”Onethingthatdidstayconstantduringthattime,though,hasbeenthewelcoming,friendlyattitudeoftheChamberstaff,volunteers,andboardmembers.TomhasstayedactiveanddirectlyinvolvedinvirtuallyeveryChambereventandfunctionduringallthattime.Oneofthemosthumorousoccasionswasinthelate1970’swhenaformerExecutiveDirectororderedfliersforoneofthemajoractivitiesoftheyear.Thatshelistedherhomephoneinsteadoftheofficephoneasanrsvpnumberneverregistereduntilshestartedgettingphonecalls.Thatwasn’ttoobad,butmostmembersassumedfromthenonthattheChamberhadanewnumbersoittookagoodwhileforherhomephonetostopringing! Martella’smostenduringinterestintheChamberhasbeenwiththeGovernment

RelationsCommittee.Hehasfoundtheinformationlearnedthroughthesemeetingstobethesinglegreatestsourceforcurrenteventsthatareorwillsoonaffectthebusinesscommunity.Topicscoveredarethought-provoking,evenconfrontational;thereforetheformationofpublicopinionisoftentestedatthesemeetings. BeforeservingonthecurrentChamberboard,MartellahadservedinvariouscapacitiesincludingchairoftheCommunityExpoandGovernmentRelationsCommittee.Otherrecentcommunityinvolvementincludes

membershipinRotary,PastPresidentofTheWesternStage,TheOldtownSalinasAssociation,andtheSalinasElksLodge(whereit’scalled“ExaltedRuler”).Thelistofotherorganizationshehasbeeninvolvedinencompassesabroadcross-sectionofthecommunity.MartellatakesparticularprideinhavingestablishedtheMontereyCountySpecialOlympicsprograminthelate70’s. Tomhasexperiencedtheconstantchangeintheprintindustry,ashehasownedMartellaPrintingforforty-plusyears.Onlyonethinghasremainedconstantforhimandhiscompany:a

persistent,continuouscommitmenttocustomerservice.Hebelievesthisisthemostimportantreasonforthecompany’s83yearsofsuccess. WhenTomisnotattendingChamberfunctionsorvolunteeringinotherorganizations,heenjoysdoingmasonryworkanddrivingandtinkeringwithhissportscaronnicedays.Heenjoysscubadiving,butonlyinclear,warmtropicaloceans!AthirdgenerationnativeofSalinas,heliveswithhiswifeNancy.Theirtwosons,ErikandShawn,arebothgrownandpursuingcareersinthewineandfinancialindustriesrespectively.

Daniella,whoisaveteranoftheUnitedStatesMarineCorps,earnedaBSBAdegreefromSullivanUniversityinKentuckybeforereturninghometoSalinas.In2005,HurricanesKatrinaandRitahittheGulfCoastandDaniellainstantlyfeltthedesiretohelp.ShestartedvolunteeringfortheAmericanRedCrossandwasabletocommit6monthstoassistingthevictimsofthedisaster.UponreturninghomefromherRedCrossserviceinTexas,shewashiredastheMontereyBayAreaChapter’sHealth

andSafetyManager.Sincethen,shehasheldvariouspositionsincludingastintasInterimCEO.AnativeofMontereyCounty,DaniellalivesinSalinaswithherhusbandDannyandthreedaughtersLovea,Persais,andAudrina. DaniellaservesasadiplomatoftheSalinasValleyChamberofCommerce,wheresheenjoysengagingwithcommunitymembers,hearingtheirstoriesandfacilitatingnetworkingforthebenefitofall.DaniellacanbereachedforinformationabouttheChamberortheAmericanRedCrossbycalling(831)[email protected].

NadinePedersen(formerlyRodriguez)istheeldestof5childrenborntoJuanandClaraRodriguez.SheattendedlocalschoolsincludingHartnellandgraduatedfromSalinasHighSchoolin1994. In2004,NadinerealizedhercallingtohelpthecommunitywhenshebecametheresidentliaisonfortheCreekBridgeLuxuryApartments.Nadinequicklybecamethe“goto”personandhelpedtokeepoccupancyforthecommunityabove98%.ShewasinchargeofplanningallresidentandcommunityeventsandfunctionsforCreekBridge,includingtheHauntedHousefundraiserthathelpedraiseover$6,000forourlocalschools.

ShewaspromotedtoAssistantManagerin2008andthefollowingyear,shewaspromotedtohercurrentpositionofCommunityManager.Shecelebratesfouryearsinthatpositionthismonth. HavingbecomeaChamberDiplomatin2008,NadinerepresentstheChamberatribboncuttingsandmixersandotherevents.ShehasbeenpartoftheChamberCommunityExpocommittee,SalinasJaycees,andtheHauntedHousehostedbyCreekBridgeandbenefitingPeacockAcres.ShealsovolunteersforRelayforlife,CaliforniaRodeo,AlisalRotary,MontereyCountyReadsprogram,FerrasciLittleLeague,and2011OldTown’sPassporttoCherry’scommittee. NadinewouldnotbeabletobesoinvolvedwiththeSVCCandthecommunitywithouttheloveandsupportofherhusbandJustinandsonDevin. BeinginvolvedwiththeSalinasValleyChamberhasnotonlybeenagreatassettoherbusiness,buthashelpedbuildwonderfulandlastingrelationshipswithfriendsandcolleagues.NadineisgreatlyinvolvedinpromotingSalinasandthesurroundingareaasagreatplacetoliveandplay!

DiversityisoneoftheassetsthatgivetheCityofSalinastheopportunitytoattract,supportandfosterawideswathofbothcitizensandbusinesses.Evidenceofthiscanbeseenateveryleveloflocalgovernment,includingtheCityCouncil,cityemployeesandouryouthwhoarereadyingthemselvesfortheirfuture.WiththerecentexpansionofHartnellCollegeacademicprogramsthatwillprepare

OnApril18th,aceremonytookplaceannouncingthatSalinaswillstarttheprocesstobuildTatum’sGarden,aplaygroundareawhereallchildrenwithorwithouthandicapsordisabilitieswillsafelyplaytogether,sidebyside.SparkedbyTatum’sdynamicparents,Shawnand

AmandaBakker,andenjoyingplentyoflocalsupport,Salinaswillsoonhaveaone-of-a-kindplaygroundwitha“vegetablegardentheme”inSherwoodParktohonorouragricultureheritage.Itwillbethefirst“fully-inclusiveandaccessibleplaygroundtobebuiltinSalinas!”LifeastheMayordoesnotgetanybetterthanthis. TheCityCouncilwillsoontakeupthesubjectofhowtospendexcessMeasureVandEmoney,basedonrecommendationsbythecitizensontheMeasureVOversightCommitteeandwiththecommentsfromthecouncil’sFinanceCommittee.Thesesextrafundsareaone-timeshotatboostingimportantprogramsthroughoutthecity.Parkimprovements,

librarybooksandcomputers,upgradesandpaintingatvariousyouthfacilities,allwillseefundingalongwithcriticalroofrepairsattheRecCenterandSherwoodHall.Vitaltothecity’sabilitytooperateistheneedtoreplacethecoolingsystemforthecomputerroomthatessentiallyistheheartofcityoperationsandwithoutwhich,thecitywouldbeunabletoconductnecessarybusiness. MypersonalthankstothemembersofboththeCitizen’sOversightCommitteeandthosecouncilmembersandstaffwhospentliterallydozensofhoursdiscussing,consideringandworkingtogethertodeterminethemostjudicialuseofthisfunding.Youreffortsareverymuchappreciated.Welldone.

Theoperationandmanagementofanybusinessisachallenge.Indeed,thereareahostofissuesandresponsibilitiesthatemployersmustfacejusttoremainuprightintoday’scompetitivemarketplace.Whilemostemployersrealizethatmonitoringandsupervisingemployeesisoneoftheirongoingandcriticalresponsibilities,whatmanyemployersdonotrealizearethepotentiallegalpitfallstheyfaceiftheyfailtoadequatelysupervisetheiremployees. Forexample,ifanemployeecommitsanegligentactduringthe“courseand

CaliforniaisprimedforastrongmonthfortaxrevenueaftertheLegislature'stopbudgetadvisorsaidTuesday,April15,wasamongthebiggestdaysfortaxcollectioninstatehistory. Thestaterakedin$2.7billioninincometaxesTuesday,accordingtothelatestfiguresfromtheLegislativeAnalyst'sOffice. Aprilisthemostcriticalmonthoftheyearforincometaxes,whichareexpectedtosupplymorethan60%ofgeneralfundrevenueforthecurrentbudget. Sofarthismonth,thestate’sincometaxrevenuehastotaled$6.02billion.TokeeppacewithtargetssetbyGov.Jerry

Brown'sadministration,theLegislativeAnalyst'sOfficesaid,thestateneeds$8.5billionforthemonth. “Withtoday’stotal,theoddsareverygoodwewillexceed"thatgoal,saidJasonSisney,adeputyattheanalyst'soffice. Post Foreclosure Liability For Waste Of Property

by Patrick Casey, L+G, LLP Californiahasstrictstatutesthatsignificantlyrestrictapropertyowner’sliabilityforanydeficiencyonaloanafterthelenderhasnon-judiciallyforeclosedontheproperty.Thereareverylimitedexceptionsthatallowalendertopursueaborrowerforpaymentafteranon-judicialforeclosure,oneofwhichisaborrowerhavingcommittedwastetotheproperty.AnewCaliforniacaseprovidessomeguidanceastowhenaborrowermaybeliableforwasteoftheproperty. Inthiscase,thedefendantpurchasedacommercialpropertyfromtheplaintiff.Thedefendantsignedapromissorynotetotheplaintiffandthenotewassecuredbyadeedoftrustrecordedagainsttheproperty.Whenthepurchaseoccurred,therewasabuildingontheproperty

thatwasingoodcondition.Thedefendantthendemolishedtheexistingbuildingandintendedtodevelopthepropertyintoamixeduseproject. Thedefendanteventuallystoppedmakingpaymentsonthepromissorynote.Theplaintiffthenforeclosedonthepropertyandatthattime,thepropertywasworthlessthantheoutstandingbalancedueonthepromissorynote.Theplaintiffsuedthedefendantforbadfaithwasteandallegedthatthedefendanthadcommittedwastebydemolishingthebuildingandtherebyreducingtheproperty’svalue.Thedefendantsucceededinhavingthetrialcourtdismissthecasebaseduponthedefendant’sargumentthattherewasnoevidenceofanyimproperintent

todemolishthebuildingbecausethedefendanthadintendedtobuildanewbuildingontheproperty(whichconstructionneveractuallyoccurred). TheplaintiffappealedtotheCaliforniaAppellateCourtandtheAppellateCourtoverturnedthetrialcourt’sdecision.TheAppellateCourtdeterminedthat“anywastethatisnotcommittedsolelyorprimarilyasaresultoftheeconomicpressuresofamarketdepressionqualifiesas‘badfaith’waste.”Aborrowerisnotliableforwasteofapropertyifthewasteoccurredbecauseofarecessionorasignificantdropinpropertyvalues.However,ifapurchaserfailedtomaintainthepropertyforanyotherreasons,thenalendermightbeabletomaintainacaseagainsttheborrowerforbadfaithwaste.

TheAppellateCourtdeterminedthattheplaintiffdidnotneedtoshowthatdefendantactedmaliciouslyorrecklesslyinitsactionsontheproperty.Inthiscase,thedefendantdemolishedthebuildingbecausetheyintendedtobuildanewbuildingontheproperty.Thiswasavoluntaryactionbaseduponthedefendant’sintendeduseofthepropertyandnotbecauseof“economicpressuresofamarketdepression.”Therefore,theAppellateCourtallowedtheplaintifftoproceedwithalawsuitagainstthedefendantforbadfaithwaste.
