Project Description 1. Need

Chandler Heights Road is identified as a phased four-lane major arterial street per the City of Chandler (City) Transportation Master Plan Update and does not meet the City’s standard major or minor arterial street cross-sections, and is inadequate to serve the vehicles, pedestrians and bicyclists.

2. Purpose

The purpose of this project is to add capacity of Chandler Heights Road to enhance regional mobility and complement the freeway system. The project will bring this section of Chandler Heights Road into compliance with the City’s standard major or minor arterial street cross-sections.

3. Scope of Work

The project is located along Chandler Heights Road from approximately 0.2 miles west of Sunland Drive to Senate Street. The project also includes improvements along Arizona Avenue (SR 87) from Lynx Place to Wood Drive. The scope of work includes:

Widening Chandler Heights Road to accommodate two thru lanes in each direction, bike lanes,

a raised median island, curb, gutter, and sidewalks Constructing a third southbound thru lane and raised median island in the southern leg of the

Arizona Avenue intersection Modifying the existing pavement striping for southbound traffic in the northern leg of the Arizona

Avenue intersection to accommodate the third southbound thru lane Reconstructing existing driveways and sidewalk ramps to meet ADA requirements Constructing new drainage improvements such as scuppers, inlets, retention basins and storm

drain Removing existing signs and providing new signing where signs are impacted by the widening Pavement markings Modifying traffic signal at Chandler Heights Road/Arizona Avenue and Chandler Heights

Road/Crossbow Way intersections Installing LED street lighting Improving signal interconnect and street light improvements and converting all existing HPS

street lights to LED street lights Widening roadway and coordinate UPRR signal to four-lane configuration at UPRR crossing Widening existing box culvert to ultimate six-lane configuration and roadway to four- lane

configuration at SRP Consolidated Canal crossing, including relocation and modification of SRP irrigation and reclaimed water facilities.

Modifying Paseo Trail crossing to accommodate widened roadway; existing solar lights will remain in place or be relocated if not compatible with the design

Installing or restoring landscaping and irrigation Installing or rehabilitating public water, sanitary sewer, and reclaimed water systems Relocating overhead electric and underground electric, gas, fiber optic, telephone and cable

The purpose of the air quality analysis is to ensure that there will be no contribution to any new localized CO and PM10 violations or increase the frequency or severity of any existing

CO and PM10 violations in the CO and PM10 non-attainment and maintenance areas by constructing an additional thru lane in each direction along Chandler Heights Road and an additional southbound thru lane along Arizona Avenue, south of Chandler Heights Road. This project has been determined to generate minimal air quality impacts for Clean Air Act criteria pollutants and has not been linked with any special MSAT concerns. As such, this project will not result in changes in traffic volumes, vehicle mix, basic project location, or any other factor that would cause a meaningful increase in MSAT impacts of the project from that of the no-build alternative.

Moreover, EPA regulations for vehicle engines and fuels will cause overall MSAT emissions to decline significantly over the next several decades. Based on regulations now in effect, an analysis of national trends with EPA’s MOVES2014 model forecasts a combined reduction of over 90 percent in the total annual emissions rate for the priority MSAT from 2010 to 2050 while vehicle-miles of travel are projected to increase by over 45 percent (Updated Interim Guidance on Mobile Source Air Toxic Analysis in NEPA Documents, Federal Highway Administration, October 12, 2016). This will both reduce the background level of MSAT as well as the possibility of even minor MSAT emissions from this project.

Barn swallow (Hirundo rustica) activity and nests were observed in the box culvert crossing the Consolidated Canal during field reconnaissance. Since the box culvert is suitable nesting habitat and will be impacted (saw-cut on both ends to allow for extension) during construction, there is the potential for construction activities to impact nesting swallows, a species protected under the MBTA. Therefore, mitigation measures are required.

Contractor Responsibilities (continued):

The contractor shall not cause injury or death to swallows, including eggs and nestlings, and shall avoid work within 100 feet of nesting swallows from February 1 to August 30 of any calendar year. If work will occur within 100 feet of nesting swallows between February 1 and August 30, the contractor shall adhere to the following: o The contractor shall completely remove all existing swallow nests within 100 feet of work areas after August

30 but prior to February 1 to prevent swallows from reusing those nests. o The contractor shall implement exclusionary measures to prevent swallows from building new nests within

100 feet of work areas. Exclusionary measures shall be implemented in all areas where swallows are likely to nest, and may include (a) continually removing nesting materials during early nest construction when eggs or nestlings are not present, (b) installing exclusionary netting (wire or plastic mesh 0.75 inch or less in diameter), (c) installing deterrent spike strips, and/or (d) installing polytetrafluoroethylene (Teflon) sheeting.

o The contractor shall not disturb any active swallow nests (completed or partially completed nests that contain eggs or nestlings). If any active nest is discovered within 100 feet of construction activities, work shall stop and the Arizona Department of Transportation Environmental Planning biologist shall be contacted (602.622.9622 or 602.712.7767) to evaluate the potential for disturbance of nests.

o The contractor shall monitor and maintain the effectiveness of exclusionary measures used daily. Netting shall be maintained such that it remains in place without any loose areas or openings that could trap and/or entangle birds. Spike strips shall be maintained such that they remain in place. Teflon sheeting shall be reapplied as often as necessary to remain effective.

o The contractor shall remove all exclusionary measures after project completion to the satisfaction of the Engineer.

Prior to construction, all personnel who will be on-site, including, but not limited to, contractors, contractors’ employees, supervisors, inspectors, and subcontractors shall review the attached Arizona Department of Transportation Environmental Planning “Western Burrowing Owl Awareness” flyer.

If any burrowing owls or active burrows are identified the contractor shall notify the Engineer immediately. No construction activities shall take place within 100 feet of any active burrow.

If any burrowing owls are located during construction, the contractor shall stop work at that location and notify the Engineer immediately. The Engineer will contact the Arizona Department of Transportation Environmental Planning biologist at (602.622.9622 or 602.712.7767) to determine whether the owls can be avoided or must be relocated. If owls must be relocated, the City of Chandler will employ a biologist holding a permit from the US Fish and Wildlife Service to relocate burrowing owls from the project area, as appropriate.

To prevent the introduction of invasive species seeds, the contractor shall inspect all earthmoving and hauling equipment at the equipment storage facility. No changes to the golf course access would occur during construction, as access is provided from Riggs Road. Use of the golf course would be maintained during construction of the project. Upon completion of the project, use of the golf course would be the same as under existing conditions. The golf course would continue to be maintained and operated as it is under existing conditions. Site AZ U:9:234(ASM), the Consolidated Canal East Branch, has been determined eligible for inclusion in the NRHP under Criteria A (event) and C (design). The canal is associated with a broad historical pattern or event (Criterion A) and possess distinguishing characteristics of design, artistry, engineering or craftsmanship (Criterion C). The canal within the APE is in-use and maintained and it retains integrity of design, workmanship, association, and location. A 1989 Memorandum of Agreement between the Reclamation, SHPO, and other parties determined that HAER documentation constituted adequate mitigation to present and future adverse impacts to the Consolidated Canal, and other main canals within the SRP.

The project plans for the Consolidated Canal East Branch include widening the existing box culvert to an ultimate six-lane configuration and the roadway to a four-lane configuration. A delivery gate and turnout structure will also be relocated. The current project would not adversely affect the canal because the planned widening of Chandler Heights Road is in a location where modern improvements have previously occurred. Because Consolidated Canal has been determined NRHP-eligible under Criteria A and C, it is subject to the protection provisions of Section 4(f) of the Department of Transportation Act (Title 23, Code of Federal Regulations, Part 774). A de minimis finding for these resources was made based on SHPO’s signed concurrence on a finding of “no adverse effect.”

The contractor cannot start work associated with load bearing structures that will be renovated and/or demolished until 10 (ten) working days have passed since the submittal of the notification to the regulatory agency. 

The City of Chandler project manager will contact the Arizona Department of Transportation Environmental Planning Hazardous Materials Coordinator (602.920.3882 or 602.712.7767) 30 (thirty) days prior to bid advertisement to determine the need for additional site assessments and confirm that the asbestos report is still valid.

Contractor Responsibilities:  

If suspected hazardous materials are encountered during construction, work shall cease at that location and the Engineer will be notified. Yellow and white pavement striping contains lead; therefore, the contractor shall notify their employees prior to any disturbance where lead is present in the paint below the 0.5 percent US Department of Housing and Urban Development/US Environmental Protection Agency action levels, but above the US Department of Labor Occupational Safety and Health Administration detection level. As part of the notification, the contractor shall make the US Department of Labor Occupational Safety and Health Administration publication_number_3142-12R_2004_Lead_in_Construction (http://www.osha.gov/Publications/osha3142.pdf) available to workers.

Findings and mitigation This project was evaluated using the “Arizona Department of Transportation’s Noise Abatement Policy,” July 13, 2011. The FHWA-approved Traffic Noise Model version 2.5 (TNM 2.5) was used to predict the highway traffic noise levels. Highway traffic noise levels are dependent on several variables such as roadway geometry, topography, traffic volume, vehicle type, vehicle speed, terrain types, and location of noise receptors. Future build (2035) traffic noise analysis and modeling predicted that there will be no impacts to any of the noise sensitive receptors. Consideration for noise abatement measures was not warranted for this project. Construction noise will be controlled in accordance with the Arizona Department of Transportation Standard Specifications for Road and Bridge Construction, Section 104.08 (2008 Edition), special provisions, and local rules or ordinances.”

Protected native plants within the project limits will be impacted by this project; therefore, the City of Chandler will determine if Arizona Department of Agriculture notification is needed. If notification is needed, the City of Chandler will send the notification at least 60 (sixty) calendar days prior to the start of construction.

If previously unidentified cultural resources are encountered during activity related to the construction of the project, the contractor shall stop work immediately at that location notify the Engineer and shall take all reasonable steps to secure the preservation of those resources. The Engineer will contact the Arizona Department of Transportation Environmental Planning, Historic Preservation Team, (602.712.8636 or 602.712.7767) immediately, and make arrangements for proper treatment of those resources.

If vegetation clearing will occur during the migratory bird breeding season (March 1 - August 31), the contractorshall avoid any active bird nests. If the active nests cannot be avoided, the contractor shall notify the Engineer toevaluate the situation. During the non-breeding season (September 1 - February 28) vegetation removal is notsubject to this restriction.

The contractor shall not cause injury or death to swallows, including eggs and nestlings, and shall avoid workwithin 100 feet of nesting swallows from February 1 to August 30 of any calendar year. If work will occur within100 feet of nesting swallows between February 1 and August 30, the contractor shall adhere to the following:

o The contractor shall completely remove all existing swallow nests within 100 feet of work areas after August30 but prior to February 1 to prevent swallows from reusing those nests.

o The contractor shall implement exclusionary measures to prevent swallows from building new nests within100 feet of work areas. Exclusionary measures shall be implemented in all areas where swallows are likelyto nest, and may include (a) continually removing nesting materials during early nest construction when eggsor nestlings are not present, (b) installing exclusionary netting (wire or plastic mesh 0.75 inch or less indiameter), (c) installing deterrent spike strips, and/or (d) installing polytetrafluoroethylene (Teflon) sheeting.

o The contractor shall not disturb any active swallow nests (completed or partially completed nests thatcontain eggs or nestlings). If any active nest is discovered within 100 feet of construction activities, workshall stop and the Arizona Department of Transportation Environmental Planning biologist shall be contacted(602.622.9622 or 602.712.7767) to evaluate the potential for disturbance of nests.

o The contractor shall monitor and maintain the effectiveness of exclusionary measures used daily. Nettingshall be maintained such that it remains in place without any loose areas or openings that could trap and/orentangle birds. Spike strips shall be maintained such that they remain in place. Teflon sheeting shall bereapplied as often as necessary to remain effective.

o The contractor shall remove all exclusionary measures after project completion to the satisfaction of theEngineer.

Contractor Responsibilities (continued):

Prior to construction, all personnel who will be on-site, including, but not limited to, contractors, contractors’ employees, supervisors, inspectors, and subcontractors shall review the attached Arizona Department of Transportation Environmental Planning “Western Burrowing Owl Awareness” flyer.

If any burrowing owls or active burrows are identified the contractor shall notify the Engineer immediately. No construction activities shall take place within 100 feet of any active burrow.

If any burrowing owls are located during construction, the contractor shall stop work at that location and notify the Engineer immediately. The Engineer will contact the Arizona Department of Transportation Environmental Planning biologist at (602.622.9622 or 602.712.7767) to determine whether the owls can be avoided or must be relocated. If owls must be relocated, the City of Chandler will employ a biologist holding a permit from the US Fish and Wildlife Service to relocate burrowing owls from the project area, as appropriate.

To prevent the introduction of invasive species seeds, the contractor shall inspect all earthmoving and hauling equipment at the equipment storage facility. All vehicles and equipment shall be washed and free of all attached plant/vegetation and soil/mud debris prior to entering the construction site.

Western Burrowing Owl Awareness

The purpose of this flyer is to provide ADOT employees 

and contractors, working on roadside projects, with basic 

knowledge to reduce the risk of incidental take of 

Western Burrowing Owls.  

Legal Status: 

Western Burrowing Owls (Athene cunicularia) are protected under the Federal Migratory Bird Treaty Act 

of 1918. All migratory birds and their parts are fully protected. They are also protected under Arizona 

State Law in Title 17‐101, Title 17‐235, and Title 17‐236.  

What to look for:  

• Description– small, ground‐dwelling owl. 

• Length– 19.5‐25.0 cm (7.68‐9.85 inches) 

• Wingspan– 58.42 cm (23.0 inches) 

• Mass– about 150 grams 

• Males are typically slightly larger than females.  

• Round head, lacks ear tufts. 

• Distinct oval facial ruff, framed by a broad, puffy 

white eyebrow. 

• Eyes contain a bright yellow iris.  

Identifying an active burrow: 

• Owls use burrows constructed by ground squirrels, badgers, coyotes and tortoises. They can also 

use pipes, culverts, and ditches.  

• Presence of excrement (whitewash) near entrance to burrow. 

• Burrowing owls frequently decorate entrance of burrows with cow or horse manure, feathers, 

vegetation and trash items.  

How to avoid them: 

• Scan ahead prior to arriving at a sign location.  

• If burrowing owls are observed within the project area, stop and move at least 100 feet beyond 

the owl or occupied burrow before resuming work.  

If you think your work may potentially impact a Burrowing Owl or active burrow, please stop. 

Move at least 100 feet from the animal or burrow before resuming work.
