CARBONDALE & RURAL FIRE PROTECTION DISTRICT MINUTES OF THE MEETING BOARD OF DIRECTORS CARBONDALE FIRE HEADQUARTERS OCTOBER 11, 2017 The Board of Directors of the Carbondale & Rural Fire Protection District met for their regular meeting on October 11, 2017 at the Carbondale Fire Headquarters/Training Building. President Gene Schilling called the meeting to order at 5:52 p.m. Directors present were Mike Kennedy, Tom Adgate and Michael Hassig. Also present were Ron Leach, Jenny Cutright, Rob Goodwin, Bill Gavette, Frank Nadell and Mike Wagner. Directors Tom Adgate and Gretchen Stock Bell were absent. CHANGES TO AGENGA There were no changes to the agenda. Gene Schilling requested this item be removed from the regular agenda. The Board of Directors verbally agreed. CONSENT AGENDA The items on the consent agenda were:

Approve the Minutes of September 13, 2017 Regular Meeting Approve Current Bills and Balances

MOTION: made to approve the consent agenda as noted. It carried and passed 3-0. PERSONS PRESENT NOT ON THE AGENDA There were no members of the public present other than staff. 2018 BUDGET Present Preliminary 2018 Budget Ron Leach presented the 2018 preliminary budget. He reviewed the property tax line item. Ron Leach said that the preliminary budget represents a status quo budget, other than the 1.75 mill levy that expires on December 31, 2017. Ron Leach said that ambulance service contributes to the overall budget. He said about 65% of ambulance calls are Medicare patients. He reviewed the Medicare billing process noting that they Medicare bills are closely securitized. He added that the ambulance billing is handled in-house. He said that Kat Bernat is a subject expert on Medicare billings. He said the District has very few denials because of the work that Kat Bernat does. He added that she goes to an ambulance billing training annually. Ron Leach said that she is a recognized ambulance billing expert in our area. Ron Leach said that the District commissioned an audit on the Medicare calls. He said that 165 claims were reviewed and the report came back very positive. He said that there were three calls

that should have been billed differently. He noted that the report confirms that Kat Bernat is doing the District’s ambulance billing correctly. Ron Leach said the other component of Medicare scrutiny is what the medics write on the narrative. He said that our crew does a great job of writing reports properly. He added that Kat Bernat educates the crews on narrative writing. Rob Goodwin reviewed how reports are written and how Kat Bernat and the crews work together to properly write narratives. Ron Leach reviewed the wages line item. He said $2.4 million of the budget, or roughly two-thirds, is allotted to personnel expenses. Ron Leach said there is as 3% cost of living increase budgeted for the staff, along with a full-time employee. He said one of the keystones of the mill levy continuation request is to staff four per shift, so two calls can be staffed at the same time. He said that three people were hired in 2015 when the mill levy passed to accomplish this. Ron Leach said that the District is entering in to an agreement with the Town of Carbondale to provide more fire prevention and inspection work than the fire district has been doing. He noted that one employee has been assigned to this job description, so one of the shifts lost a staff member that needs to be replaced. Ron Leach said that the cost of health insurance is high. He said that the fire district is experiencing the same problem as the rest of the country. Ron Leach said that the increase in premium is 5% for 2018. He added this is a great benefit for the employees. He noted the wildfire wages and said that those costs will be reimbursed. He added that the District makes money on the wildfire assignments. Ron Leach said that the audit costs are going up. He added that he will be sending the audit engagement letter to the auditor. He said that public outreach is a newer line item, it was recommended in the master plan. He said that the staff has worked hard on public outreach. Ron Leach reviewed the other line items noting the TABOR reserve line. He said 3% of the expenses is required to be budgeted. He said that about $80,000 of the 2017 TABOR reserves were used for the Marble fuel release project. Ron Leach said that the estimated 2017 expenses are $2,968,539 and the 2018 budget for expenses is $3,174,814. He said that would keep the district with just under $1 million in reserves, if the mill levy continuation does not pass. He noted that the unofficial board policy is to keep $1 million in reserves Ron Leach said there are no capital items budgeted if the mill levy continuation does not pass. He noted the ladder truck lease payment is included, saying that the truck gave the district 4 of the 5 ISO point needed to reduce the ISO to a 3. Ron Leach reviewed the bond fund, noting the bonds were refinanced in 2017 to save the taxpayers money.

Ron Leach reviewed the volunteer pension fund and how it is funded. Ron Leach reviewed the budget that will be used if the mill levy override extension passes. He noted that the reserves will increase with this budget. He added that there will be needed capital purchases, including an ambulance. Consider Approval of a Public Hearing Date for 2018 Budget Ron Leach said the Board needs to set a public hearing for the 2018 budget. Ron Leach recommended the November 8, 2017 regular meeting. The board verbally approved the date for the public hearing. Consider Approval of Public Information Plan for 2018 Budget The Board of Directors directed staff to post ads as needed, including the Sopris Sun and the Crystal Valley Echo, spending up to $400. STAFF REPORTS November 2017 Election Update It was noted that ballots will be mailed next week. OLD BUSINESS Discussion regarding Fire Code IGA Ron Leach said that the District has not received the final fire code IGA. Discussion regarding Ambulance Purchase Rob Goodwin said that the staff is getting bids from three companies. He reviewed the companies. He said that he and Kevin Greene have been test driving ambulances. Ron Leach said that he hopes to have the bids in for the November 8 meeting. General discussion regarding ambulances followed. Marble Fuel Release Update Rob Goodwin said the plan was approved by the State of Colorado. He said the dirt was removed, testing soil as the dig occurred. He said after testing the District received approval to fill the hole and that part of the project is complete Rob Goodwin said that there will be two more ground water tests, and as long as they are clean no further action will be needed. Gene Schilling said that this item could be removed from the monthly agenda. He said he would like an update when the water samples are done. Grand Avenue Bridge Construction Rob Goodwin said it has gone very smooth. We have had no trouble getting to the hospital when needed.

Fire District Board of Directors meeting  CRFPD Community Open House On Saturday, October 14th, CRFPD held a community open house event at the Headquarters building and Station 81 Operations building.  The open house event was by any measure, a huge success. Between 400 and 500 people from all over the fire district and beyond attended the event. We provided lunch for folks who came and ended up cooking and serving  lunch  to approximately 400 people. The  stations/activities  that were available  to  the public included: 

Sparky the Fire Dog (live!) 

Fire Truck Rides 

CRFPD apparatus tours 

Burgers, Brats and Hotdogs etc, for lunch 

Free Safety Information and Swag Giveaways (a big hit) 

2 Story Fire Safety House in the Maintenance Bays. (Borrowed from GVFD) 

Face Painting for Anyone 

Classic Air Medical Helicopter Tours and Demonstration (In the HQ parking lot)  

20+ volunteer and paid  staff members helped  to put on  this excellent event. Our public education and outreach person, Paul Herr was  the  incident commander  for  the open house and he did an outstanding job, not only with the public but in ensuring that the CRFPD staff and volunteers were able to be successful at their individual positions.  The  feedback  that we have  received  from  the public  about  the open house event has been extremely positive and our folks went above and beyond in making sure that everyone was safe, happy and well fed. You should be very proud of the job that these folks did at our open house.

October Highlights:

Several CRFPD members completed a Hazardous Materials Awareness and Operations course.

Several staff trainings were conducted on the new Garfield County EMS protocols.

Several staff in service trainings were conducted on our MSA Thermal Imaging Camera.

Certification Management:

I assisted one member in the renewal of his Colorado Paramedic certification. All training records, EMS continuing education credits and Firefighter Job

Performance requirements (JPRs) records are up to date through the end of the month.

Training Hour Totals:

19 individual trainings were conducted throughout the month of October. Total man hours of training for October 2017 = 204 hours Total Man Hours of training in 2017 through October 31st =3919 hours

  INTERGOVERNMENTAL AGREEMENT FOR FIRE AND LIFE SAFETY SERVICES

This Intergovernmental Agreement for Fire and Life Safety Services ("Agreement") is entered into by and between the Town of Carbondale, Colorado a home rule municipal corporation of the State ("Town"), and the Carbondale & Rural Fire Protection District, a political subdivision of the State of Colorado organized pursuant to C.R.S. § 32-1-101, et seq. ("Fire District"). The Town and Fire District are each referred to individually as a “Party” and collectively as the "Parties."

RECITALS

WHEREAS, the Parties have a common and compelling public safety interest in planning and providing for high quality, uniform fire and life safety services for the existing and future citizens and property within their respective jurisdictions. To this end, the Parties also have a common and compelling interest in enforcement of building and fire codes, including consistent plan reviews and building inspections, for both new and existing construction; and

WHEREAS, pursuant to C.R.S. § 32-1-101, et seq., the Fire District provides fire suppression, fire prevention and public education, related inspection and investigatory activities, rescue, hazardous materials, and emergency medical services to the citizens and property within its jurisdiction, and to individuals passing through its jurisdiction (District Services). The Fire District's jurisdiction includes all property within the Town's boundaries; and

WHEREAS, the Town Board has adopted the Uniform Fire Code, 1988 Edition, (“Fire Code”) for enforcement within the Town's boundaries, pursuant to Chapter 18, Article 8 of the Carbondale Municipal Code; and..

WHEREAS, the Parties desire for the Fire District to assist the Town in its enforcement of the Fire Code through the provision of District Services in the Town, including plan reviews and fire safety inspections, and all fire investigations within the Town's boundaries.

NOW, THEREFORE, the Parties covenant and agree as follows:

AGREEMENT

1. Authority. The Town shall continue to be the jurisdiction having exclusive regulatory authority to adopt and enforce the Fire Code within the Town's boundaries.

2. Fire Code Development and Enforcement. The Parties will work together to review, develop, and amend the Fire Code to be adopted by the Town Board from time to time, and to review, develop, and amend those portions of the Town's building, mechanical, and electrical codes that relate directly or indirectly to enforcement of the Fire Code. The Fire District will assist the Town in enforcing the Fire Code, as adopted and from time to time amended by the Town Board, within the Town's boundaries, including conducting any maintenance inspections required by the

Fire Code. Records of all such inspections shall be kept by the Fire District and made available to the Town upon request. The Fire District will also assist the Town in enforcing the Town's building, mechanical, and electrical codes, as adopted and from time to time amended by the Town Board, within the Town's boundaries. As provided in C.R.S. § 32-1-1002(3)(b), the Fire District will refer a Fire Code violation or a suspected arson to the Town Attorney for prosecution in the Carbondale Municipal Court or to the District Attorney for Garfield County for prosecution in the County or District Courts.

3. The Fire District shall have and maintain all licenses, certificates, credentials and education as required under state or federal law, the Town’s building code, and the Fire Code to perform plan review, issuance of alarm/sprinkler permits, and inspect structures relative to fire safety (including fire sprinkler) and Fire Code compliance.

4. Plan Review Process. To ensure that all existing and new buildings, facilities, and other properties within the Town are constructed, developed, and maintained in accordance with the Fire Code, the Parties hereby establish the following plan review and building inspection process for all modifications to or renovations of existing buildings, facilities, and other properties, and all new construction and development within the Town (collectively, "Construction"):

a. The Town will direct all owners/occupants to submit their Construction drawings, blueprints, plans, and other working drawings (collectively, "Plans") to the Fire District. The Fire District will review the Plans within 14 calendar days following their submission.

b. Following the Fire District's review of the Plans, the Fire District's Fire Chief, Fire Marshal, or other designee of the Fire Chief (“Fire Code Official”) will recommend that the Town approve or deny the Plans' compliance with the Fire Code in writing. The Town will issue a Construction permit to the owner/occupant only after the Fire Code Official has reviewed and commented on the Plans through the Permit System.

c. After the Construction is complete, and periodically during the Construction if required or permitted by the Fire Code, the Fire Code Official will inspect the completed Construction for compliance with the Plans and the Fire Code. Following the final inspection of completed Construction, the Fire Code Official will recommend approval or denial of the completed Construction's compliance with the Fire Code in writing. The Town will issue a Certificate of Occupancy to the owner/occupant only after the Fire Code Official reviews and comments on the completed Construction.

d. The Fire District shall not be liable for any injury or loss of life, or any property damage or destruction, that may occur as the result of Fire Code violations or other fire and life safety hazards present in buildings, facilities, other properties. The Fire District shall assist the Town in taking such administrative, legal, or equitable actions as the Town deems appropriate to correct Fire Code violations in or about any building, facility, or other property that the Town or

Fire District discover have been issued a building permit or certificate of occupancy in violation of the Fire Code.

5. Development and Enforcement. To ensure uniformity in Fire Code interpretation and enforcement, the Parties will work together to review, develop, and amend the Fire Code to be adopted by the Town Board from time to time, and to review, develop, and amend those portions of the Town's building, mechanical, and electrical codes that relate directly or indirectly to the enforcement of the Fire Code. The Fire District will assist the Town in enforcing the Town's Fire Code, as adopted and from time to time amended by the Town Board, within the Town's boundaries. The Fire District also may request that the Town commence an enforcement action in Garfield County District Court, utilizing the Town’s legal counsel.

6. Change in Use or Occupancy. The Town will notify the Fire District of any change in the use or occupancy of a commercial facility within the Town's boundaries of which the Town is aware. The Fire District will determine whether such change in use or occupancy requires the owner/occupant to take new or additional Fire Code compliance measures beyond those then existing at the commercial facility. If the Fire District determines that new or additional Fire Code compliance measures are required, the Parties shall follow, and the Town shall require the owner/occupant to follow, the process described in Paragraph 3 in order to achieve Fire Code compliance.

7. Cooperative Arson Investigations. The Parties agree to cooperate in investigating all fires within the Town’s boundaries by which property is destroyed or damaged. The Fire District will determine origin and cause of all fires. Immediately upon determining that a fire is of suspicious origin, the Fire District will preserve the scene and will present the facts of the investigation to the Garfield County Sheriff's Office, which will have primary responsibility for any further investigation and prosecution of the case. The Fire District will have the primary responsibility for collecting evidence at any suspected arson scene, or may delegate such responsibility to the Multi-Agency Fire Investigation Team (MAFIT) or the Garfield County Sheriff's Office. The Fire District will turn over to the Garfield County Sheriff's Office at the earliest practicable time all evidence collected at any suspected arson scene so that the Garfield County Sheriff's Office may process and store it pending possible prosecution.

8. Notice. Any notice required or permitted under this Agreement must be in writing and must be delivered by hand delivery or certified or registered mail, return receipt requested, to:

If sent by certified or registered mail, the notice shall be deemed delivered three calendar days after it is mailed.

9. Effective Date. This Agreement will be effective as of the date the last Party signs this Agreement ("Effective Date").

10. Term and Termination; Non-Appropriation. The initial term of this Agreement will begin on the Effective Date and continue for five years ("Initial Term"). Thereafter, this Agreement will automatically renew for successive five- year periods ("Renewal Term(s)") until terminated as provided herein. Either Party may terminate this Agreement for any reason upon 90 days prior written notice to the other Party. Additionally, should the governing body of either Party fail to appropriate funds sufficient to meet that Party's obligations under this Agreement for the next fiscal year, this Agreement will automatically terminate on the first day of the fiscal year for which funds have not been appropriated and neither Party will have any further obligation under this Agreement. Paragraph 4(d) will survive termination of this Agreement for any reason.

11. Governmental Immunity. Nothing in this Agreement is intended, and shall not be construed, as a waiver by either Party of any rights or protections afforded to them under any federal, state or local constitutional, statutory, or common law, including but not limited to the Colorado Governmental Immunity Act, C.R.S. § 24-10-101, et seq.

12. Additional Provisions. Colorado law governs this Agreement. Jurisdiction and venue lies exclusively in the Garfield County District Court. This Agreement is the entire agreement between the Parties and there are no oral or collateral agreements or understandings regarding the subject matter of this Agreement. This Agreement may only be amended by a document signed by the Parties. Course of conduct, no matter how long, shall not constitute an amendment to this Agreement. If any provision is held invalid or unenforceable, all other provisions shall continue in full force and effect. Waiver of a breach of this Agreement shall not operate or be construed as a waiver of any subsequent breach of this Agreement. Neither Party may assign its rights or obligations hereunder without the prior written consent of the other Party. In any dispute arising from or relating to this Agreement, the prevailing Party shall be awarded its reasonable attorneys' fees, costs and expenses, including any attorneys' fees, costs and expenses incurred in collecting upon any judgment, order or award. This Agreement may be executed in

several counterparts and by facsimile or electronic pdf, each of which shall be deemed an original and all of which shall constitute one and the same instrument.
