San José Adopts Ordinance December 2010
• Applies to all retailers.
• Prohibits single-use plastic bags.
• Promotes reusable bags.
• Allows recycled paper bags with store charge.
• Allows protective bags without handles to
prevent cross-contamination.
San José Single Use Bag Ordinance
• Itemized receipts showing store charge.
• Maintain 3 years of sales records for store
charge.
• Minimum store charge 10¢ for first two years.
• Minimum store charge 25¢ after January 1, 2014.
• Store charge retained by retailer.
• Alternative method for review of long-term records
may be approved on a case-by-case basis.
Store Charge Requirements
• Made of at least 40% post-consumer
recycled content paper.
• 100% recyclable (including handles).
• Contains no old growth fiber.
• Printing Requirements:
• Words “Recyclable” and “Reusable.”
• Name and location of manufacturer.
• Percentage of post-consumer recycled
content.

OR
• Durable plastic with handles, at
least 2.25 mil thick, and
specifically designed and
manufactured for multiple reuse.
