MISSION AND VISION The Delaware Academy of Public Safety and Security (DAPSS) is a charter high school dedicated to providing a rigorous academic curriculum that meets State of Delaware standards as well as providing cadets practical career training in the public safety field.

As a model of excellence in the public safety field, DAPSS will strive to earn the respect of the

community. DAPSS will develop disciplined and responsive individuals that will become the

trusted and preferred choice of public safety organizations and/or post-secondary institutions.

DAPSS graduates will exhibit the core values of fidelity to others, diligence to succeed, and

scholarship in the classroom.

HEAD OF SCHOOL’S MESSAGE Dear Cadets and Parents: Welcome to the Delaware Academy of Public Safety and Security. The Cadet Handbook is designed to provide you with information about the policies and regulations that will govern cadet life at DAPSS. All cadets and parents should review this book carefully and keep it for reference throughout the year. DAPSS has a mission focused both on college readiness and career preparation in the areas of first responders. As a college preparatory academy with a career focus, DAPSS will open up a world of opportunities for cadets while developing and expanding both their individual knowledge and personal skill sets. DAPSS cadets will represent discipline, honor and structure. Our core values of Fidelity to Others, Diligence to Succeed, and Scholarship in the Classroom serve to help all cadets succeed both now and in the future. Thank you for selecting DAPSS. It is important for our success that our entire community embraces a willingness to grow and improve. A MUST READ FOR PARENTS In order to minimize the number of forms parents are asked to sign and return in the beginning of

the year, all parents need to know:

1. It is important that the emergency medical information card (yellow card) be

completely filled out and returned immediately. Should your cadet have an accident, this

information is necessary to reach parents/guardians. Should any information need to be updated

on the emergency medical information card, please notify the nurse.

2. Cadets are sometimes photographed or filmed during activities, and the pictures/videos

are included in some of our public relations materials. If you DO NOT want your cadet

photographed or filmed, please put your request in writing to the administration. This does not

apply to pictures related to the yearbook or class portraits.

3. As the parent of a cadet, I have received, read, and understand the Internet Safety

Policy. In addition, I reviewed this policy with my cadet and answered questions he or she asked.

If either my cadet or I have further questions, I will ask the administration. I agree to have my

cadet abide by the requirements of the policy, and my cadet understands that if he/she violates

the policy, he/she is subject to Level III Violation consequences and could be subject to local,

state, and federal legal recourse. If you DO NOT want your cadet to use the internet, please put

your request in writing to the administration.

4. Parents of juniors or seniors who DO NOT want cadet information disclosed to

military recruiters must put their request in writing to have their cadet excluded and send their

request to the administration before October 1st.

5. This handbook references some external policies that are available in full from the

office or the DAPSS website. Parents and cadets are assumed to have read each policy in its

entirety. These policies include but are not limited to: cell phone, uniform, expulsion procedures,

discipline for cadets with disabilities, bullying, grading, summer school, and driving/parking

procedures.

CADET HONOR CODE DAPSS offers all cadets a unique opportunity to learn and experience a challenging high school curriculum and professional career training in first responder areas. To accomplish our mission, it is vital that cadets understand that they are held to a higher standard of behavior. Below is the cadet honor code which helps to define and differentiate our academy. DAPSS cadets are expected to adhere to all expectations and procedures. Cadets are expected to act with respect towards themselves, staff and guests, other cadets, and our facilities and campus.

Honor Code I am a cadet of the Delaware Academy of Public Safety and Security and as such will conduct myself in a manner which will bring credit to myself and the academy.

I do not lie, cheat or steal and will always be accountable for my actions and deeds.

I will work hard to improve my mind and strengthen my body.

I will wear my uniforms properly, showing pride in my academy.

I am respectful and will treat others with dignity.

I am punctual, prepared to work and will devote my best effort to the task at hand.

I am a model steward of all campus facilities and equipment.

I will seek the mantle of leadership and stand prepared to improve my community.

I am loyal and dedicated to serve others.

I am the future of public safety.

CADET CODE OF CONDUCT The successful operation of our academy requires the cooperation of many people. All cadets enrolled in the Delaware Academy Of Public Safety and Security (DAPSS) have been enrolled at their request. Therefore, it is assumed both the cadet and his/her parent/guardian desired enrollment based on the expectation that DAPSS will uphold high standards of academic achievement and personal conduct. If at any time a cadet feels that he/she is unwilling to abide by the rules and procedures set forth in this handbook, the cadet may request transfer to the high school in their district at the end of the current year. The professional staff and Board of Directors have established rules and guidelines for maintaining high standards for cadet conduct. Upon entering DAPSS, the cadet is responsible for his or her actions both in and out of the academy. Any serious violations of academy policy and/or illegal or immoral behavior will result in serious disciplinary action. This is especially true in cases where the good reputation of the academy with the neighboring community is jeopardized.

What is the Cadet Code of Conduct? The code is an official declaration of DAPSS policies which:

Specifies the rights and responsibilities of cadets Provides examples of some, but not all, conduct that disrupts a positive environment Standardizes procedures for disciplinary action Defines grievance procedures Incorporates excerpts from State and Federal laws and regulations

Provisions in the Code of Conduct apply to all cadets. Cadets and parents/guardians are presumed to have reviewed the Code and by attending DAPSS, agree to abide by its terms. The DAPSS Code of Conduct and Honor Code falls within the guidelines established by the Delaware Administrative Code, Title 14 Education, 600 Discipline and School Climate and 614 Uniform Definitions for Student Conduct Which May Result in Alternative Placement or Expulsion. These regulations may be found at: http://regulations.delaware.goc/AdminCode/title14/600/614 When is the code in effect? The code is in force:

On school property prior to, during and following regular academy hours While cadets are on the bus for any purpose At all academy sponsored events and any activities where the academy has jurisdiction over

cadets, and when a cadet’s conduct to and from DAPSS has a harmful effect on other cadets or on the orderly educational process

When a cadet's out-of-school conduct indicates that he or she presents a threat to the health, safety or welfare of the other cadets and/or staff, or when that conduct jeopardizes the image or partnerships with public safety agencies and/or the community.

What if I have a question about the Code of Conduct? All questions about the Code of Conduct should be directed to the administration.

Returning Cadet Requirements Cadets wishing to return to DAPSS in subsequent years must abide by this handbook and our established policies and procedures. Delaware allows its students to attend non-feeder pattern schools through the choice system. This system requires compliance with basic school tenants to remain at a choice school (regular attendance, minimal behavior violations, adequate academic effort, etc). DAPSS follows these guidelines and cadets who have not complied with these basic tenants, our handbook, policies, or procedures will be dismissed, and will not be re-enrolled for the following year.

CADET RIGHTS AND RESPONSIBILITIES The Delaware Academy of Public Safety and Security (the academy) guarantees cadets’ rights allowed by state and federal laws and the rules and regulations of the State Board of Education, and the Delaware Department of Education (DOE). The academy Board of Directors recognizes and supports cadets’ rights and the corresponding cadets’ responsibilities. The administration of DAPSS has the responsibility and authority for maintaining an orderly educational process. Nowhere is it stated or implied in this document that the academy should give up its authority and responsibility. Attendance

Philosophical Basis: Academy administrators have an obligation under State Law to enforce compulsory attendance. Cadets have an obligation to take advantage of the opportunity for a public school education.

Rights Responsibilities

To academy policies that clearly defines legal absence, unexcused absence, and tardiness. To appeal a decision concerning an absence

(excused or unexcused) and shall not be penalized in any way for excused absences. Participation in an academy-approved activity shall be considered an excused absence. Where feasible, to make up assignments missed

during any excused absence, according to the academy’s regulations concerning makeup assignments following an absence.

To take advantage of their educational opportunities by attending all classes daily and on time. To provide the academy with a note explaining

the reason for an absence. To request the makeup assignments from their

teachers upon return to the academy and to complete the work according to the Homework section of the code.

Consultation

Philosophical Basis: Personal needs or concerns can seriously threaten and interfere with the educational development of cadets. The academy has the responsibility to notify parents and/or cadets of available counseling services within the academy setting and to inform parents and cadets of the services of other agencies.

Rights Responsibilities

To be informed accurately as to the nature of the guidance services available. To appropriate counseling for personal

and educational problems. Access to consultation services within a reasonable amount of time should be assured.

To use counseling services for their educational and personal development, where appropriate and available To schedule appointments in advance unless the

problem or concern is of an emergency nature. Parents and cadets have the responsibility of informing the academy of information that may be useful in making intelligent educational decisions.

Curriculum

Philosophical Basis: The degree of cadet involvement in curriculum development depends upon the age, grade and level of maturity of the cadet. Curriculum is designed for cadets; therefore, the cadet opinion can be extremely important and deserves careful analysis and full consideration.

Rights Responsibilities

To have access to clear and precise curriculum descriptions that will help them to make informed choices. To participate in available programs

appropriate to their individual needs at all grade levels. To study all subjects in an atmosphere

free from bias and prejudice. Within their level of maturity and within

the scope of their course, to study any issue which relates to the course; and they have the right of access to all available information that relates to the issue. To equal access to any available

extracurricular activity corresponding to their interests and abilities.

To seek clarification, if necessary, from the informed persons in the academy. To strive for mastery of skills by participating in

available programs. To contribute toward the development of a

positive climate in the academy that will lead to wholesome learning and living. To respect the rights of other individuals who

have different viewpoints and become informed about issues being studied. To explore any available extra-curricular activity

that corresponds to their abilities and interests.

Grades

Philosophical Basis: Grades are one indicator of the cadet’s demonstrated knowledge or skill at a particular time. A cadet’s grades should reflect the teacher’s best assessment of the cadet’s academic achievement.

Rights Responsibilities

To receive a written copy of a teacher’s grading systems at the beginning of each course. To receive an academic grade that is

based on the teacher’s grading system and that reflects the cadet’s academic achievement. To be given appropriate notice of when

assignments are due. To receive written notification of

unsatisfactory progress at any time during the marking period. Not to have grades used as a disciplinary

tool. A cadet who engages in academic dishonesty (cheating, plagiarism, copyright infringements) forfeits this right and will receive no credit for the assignment.

To ask for an explanation of a grading system which they do not understand. To maintain standards of academic performance

according to their abilities and to ask for explanations of grades which they do not understand. To present assignments when due. To share notice of unsatisfactory progress with

their parents and to improve their performances. To conduct themselves in a manner which

contributes to a good learning environment.

Free Speech/Expression

Philosophical Basis: One of the basic purposes of schools is to prepare cadets for responsible self-expression in our society. Self-expression is permitted under the 1st and 14th Amendments to the U.S. Constitution. Cadets may inquire, question, and exchange ideas. Self-expression must not interrupt the orderly educational process of the academy or be in violation of the Code of Conduct. Free expression must not be obscene, libelous, or disruptive.

Rights Responsibilities

To participate in patriotic activities. Cadets also have the right to be excused from any patriotic act that is against their religious beliefs or deep personal convictions. Cadets who do not wish to participate in patriotic activities shall not be forced to do so. To request in writing to be excused

from any activity which is against their religious beliefs. To petition and survey cadet opinions by

following established procedures. To express their own opinions on issues

in a reasonable manner at acceptable times and places determined by the administration. To assemble peaceably on academy

property at a time and place designated by the administration. This right will be denied if it endangers the health or safety of others, damages property, or disrupts the activities of others.

To act in a respectful manner during patriotic activities whether actively participating or not. To inform the academy of activities which are in

conflict with their religious beliefs. To make reasonable requests to conduct surveys

and petitions. The results obtained must be reported accurately. To be well informed about issues and to express

their opinions in a reasonable manner at a reasonable place and time. To plan, get approval, and hold activities that are

based upon educational objectives.

Grievance Procedures

Philosophical Basis: When a cadet feels unfairly treated or has not been afforded due process, a grievance may be filed. The academy is responsible for providing a means for cadets to express and resolve their grievances, this procedure is outlined in Cadet Grievance.

Rights Responsibilities

To a procedure for expressing and resolving their grievances. This procedure specifies lines of communication, time lines, and a method of appeal. To participate in the evaluation of and

suggest modification to the grievance procedures in a recognized cadet group.

To discuss and to try to resolve their complaints with the person(s) involved before using the grievance procedure. To state the grievance clearly, to follow the

established procedures for resolving the grievance, and to abide by the decision that comes as a result of this process.

Marriage, Pregnancy, and Parenthood

Philosophical Basis: Cadets who are married, expectant parents, or parents, do not lose their right to a free public education. Cadets are encouraged to continue their education through programs designed to meet their special needs.

Rights Responsibilities

To remain in the regular school program or to attend a special program designed to meet their needs. To be referred to a marriage, pregnancy,

or parenthood agency for counseling if they request it.

To attend classes regularly or to take advantage of special programs designed to meet their needs. Students who are pregnant should seek professional medical advice regarding attendance. To request counseling for marriage, pregnancy,

or parenthood.

Cadet Records

Philosophical Basis: Cadet records are defined as any materials concerning individual cadets kept in any form by the academy or its employees, except for personal notes of teachers and other academy personnel intended for their use only. Cadet records are maintained to provide information that can be used to develop the best possible educational program for each cadet. Care must be exercised by the academy staff to make sure that cadet records are treated confidentially and that the information contained therein is accurate and appropriate.

Rights Responsibilities

Cadets who are eighteen years of age or older and parents of cadets who are under eighteen years of age have the right to release, inspect, review, and challenge the information contained in the cadet’s records within academy guidelines. See the Release of Cadet Information section. Cadets have the right to be protected

from the release of personally identifiable information to unauthorized persons.

Eligible cadets and parents have the responsibility to give academy personnel ample notice that they want to inspect and review their records. Eligible cadets and parents have the responsibility to meet their financial obligations as it relates to academy fees or fines. Eligible cadets and parents or guardians have

the responsibility to release information to those individuals or agencies that are working in a positive manner for the benefit of the cadet. The permission to release information, where required, must be in writing.

Publications

Philosophical Basis: One of the important rules of the academy is to provide effective ways in which cadets may express themselves on a wide range of subjects. Official academy publications, such as newspapers, should reflect the policy and judgment of the cadet editors and should include viewpoints representative of the entire academy community, with the approval from supervising academy staff.

Rights Responsibilities

To possess, post, and distribute literature that will not disrupt the academy program and which follows the academy’s guidelines for responsible journalism. To be free from censorship of their

publications within the guidelines previously agreed upon by cadets and administrators.

To use only those bulletin boards or wall areas assigned for use by cadets and cadet organizations. Cadets must also accept responsibility for the effect that the posting, publication, or distribution of this literature might have on the normal activities of the academy. To refrain from publishing libelous and obscene

materials; to seek full information on the topics about which they write; to observe acceptable standards of good taste; and to observe the normal rules for responsible journalism.

Search and Seizure

Philosophical Basis: Cadets shall be free from unreasonable search and seizure of property as guaranteed by the 4th Amendment of the U. S. Constitution. This individual right is balanced by the academy’s responsibility to protect the health, safety, and welfare of others. DAPSS lockers are school property and may be subjected to search at any time, with or without reasonable suspicion. This process is further explained under Search and Seizure section.

Rights Responsibilities

To privacy in their personal possessions unless the administration or his/her designee has reasonable cause to believe that illegal, harmful or non-academy related items are in their possession, such as, but not limited to, electronic or communication devices that are being used to disrupt the educational process or endanger the health, safety, or welfare of others.

Not to carry or conceal any materials that are illegal and that may disrupt the educational process, or endanger the health, safety, or welfare of others. Cadets are responsible for the contents of their lockers and of all personal belongings.

Climate/Environment

Philosophical Basis: A good academy environment is free from distractions, frictions, disturbances, drugs, weapons, and harassment. It is also the presence of a friendly, yet businesslike, atmosphere in which cadets and academy staff work cooperatively toward recognized and acceptable goals.

Rights Responsibilities

To have a safe and positive academy environment. To attend classes without distractions,

frictions, and disturbances. To attend an academy free of drugs and

weapons. To attend the academy free of

harassment. To participate in academy activities and

programs free of harassment. To a prompt and fair investigation as

possible. To not fear any retaliation for making a

complaint under any of our policies.

To conduct themselves in a safe and responsible manner. To abide by the rules and regulations set forth

by the academy and classroom teacher. To refrain from possessing, carrying, or using

illegal drugs and/or weapons. To respect all persons as individuals who have

rights. In cases of harassment where the harasser is a

cadet: (A) to communicate directly to the person that their behavior is unacceptable and they want him/her to stop; (B) to inform and seek the advise of a teacher, counselor, or administrator; and (C) to report the information to the Head of School if the situation is not resolved, or if the person informed pursuant to (B), supra, fails to take action to investigate and/or stop the alleged harassment or bullying. In cases of harassment where the harasser is an

employee or adult: (A) to immediately inform the Head of School of the objectionable behavior and/or actions of the adult, as well as the person’s identity; or (B) if the Head of School is the person identified in the complaint, or if the cadet and/or parent are uncomfortable communicating the complaint to the Head of School, for any reason, then to the Board of Directors.

ACADEMICS

Grade Advancement To be promoted to the next grade level and retain enrollment in DAPSS, cadets must successfully pass all required courses below during the year or at summer school.

If a cadet has a credit deficiency they may attend summer school or Groves to secure sufficient credits. Detailed Groves and summer school policies are available on the DAPSS website and from the guidance office.

It is expected that DAPSS cadets and parents will use all resources available to maintain communication about cadet grades. DAPSS supports and encourages the use of Home Access Center (HAC) to monitor grades, attendance, etc. by both the parent and the cadet inside and outside of the academy, and to regularly communicate with course instructors. A detailed grading policy is available on the DAPSS website and from the administration.

Grading Scale DAPSS uses a “10-point” grading scale throughout the building to determine grades. The grading scale is as follows: A = 90% - 100% D = 60% - 69% B = 80% - 89% F = 59% and below C = 70% - 79%

Final Course Grades Final grades will be calculated as follows: 20% for each quarter grade plus 10% for each semester exam. (25% for each quarter grade for classes without exams.) Final grades with .50 or greater will be rounded up.

Graduation Credits Delaware requires 24 credits before graduation, however most cadets will graduate with more. All DAPSS cadets must meet minimum state graduation requirements before a high school diploma will be issued. Credit requirements for graduation are:

English 4.0 Mathematics 4.0 (must include Algebra II) Science 3.0 (must include Biology) Social Studies 3.0 (must include US History) Spanish 2.0 Career Pathway 3.0 (Public Safety courses) Health 0.5 Physical Education 1.0 Electives 3.5 TOTAL Credits needed for Graduation

To receive a community service credit from the state, cadets must complete 90 hours of volunteer community service with approved non-profit organizations over any two semesters or summers. Detailed information is available from the Volunteer Delaware website. Verification documents must be properly submitted to the guidance office in order to request approval of the credit from the state. TacOps cadets should check with the Senior Director for appropriate documentation, verification, and submission procedures.

Physical Education All first responder career fields demand a high level of physical fitness, likewise DAPSS provides a physical education program. If a cadet is unable to participate, they must present a written excuse from their doctor or certified medical professional stating the reason, extent, and time of limitations from regular physical activity. DAPSS reserves the right to verify all excuses. The nurse and the physical education instructors supervise these exceptions. Any cadet limited from normal activity in such circumstances will be required to complete and alternate assignment. Cadets must also provide written approval from their doctor to return to full activity.

Foreign Language Requirements The study of a foreign language is a graduation requirement and is not an elective. These credits must be in the same language. Currently, Spanish is the academy’s only language course. Transfer cadets should refer to Delaware code, Title 14 Section 505 for course requirements and eligibility.

Learning Differences DAPSS employs a phasing system of class difficulty whenever possible. Special Education services are available.

Homework Cadets should expect homework every day. All assignments must be completed in accordance with each teacher’s instructions. If a cadet is absent from class it is the cadet's responsibility to obtain missed work/material AND arrange a timeline for completion with each instructor. Otherwise assignments are due the next class period after the absence. Unexcused absences and suspensions do not grant extra or extended time.

Academic Cheating Academic cheating is the intentional or unintentional act or instance of deception in preparing or presenting any work or assignments as a cadet's own authentic work when it is not.

and pasting from webpages, etc. (plagiarism) Refer to Level III Violations for cheating/plagiarism. Note that any instance of academic cheating will result in no credit on the work.

ACADEMY POLICIES AND PROCEDURES

Regulations The authority and responsibility for directing the activities of our academy have been given to the professional staff as determined by the administration and board. No set of regulations can be exhaustive. Recognizing its responsibility to safeguard its good name and the welfare of its cadets, DAPSS reserves the right to respond as it sees fit to the actions of its cadets, even if those actions take place outside of academy hours or off academy property.

Attendance Delaware State Law requires attendance for children age 5 to 16. DAPSS requires regular and consistent attendance for all cadets enrolled in the academy’s programs. DAPSS (and the State of Delaware) recognizes the following legal and necessary absences: illness of the cadet, attested to by a physician if necessary; the presence of contagious disease in the cadet's home; death in the immediate family or in the home of the grandparents. Excused time will not exceed one week.

Additional or extended absence may be granted for: Ceremonies held at long distances from the cadet's home Legal business relating to or involving the cadet Documented health treatments Prearranged visits to a college or university and/or other educational experiences as

approved by the academy Emergency situations as determined by the administration Religious holidays

No unexcused absences during state testing or semester exams unless approved well in advance by the administration. Written documentation from a parent or legal guardian is required for any absence during these times. All excuses are subject to verification by the academy before alternate testing arrangements are made.

All unexcused absences receive no credit for the day's work. Any cadet who has an excused absence can make up class work and assignments missed as arranged with each instructor. The cadet's grade will reflect any failure to comply. (See “Homework” above)

Cadets absent from the academy, or who do not attend the majority of a day will not be permitted to participate in DAPSS activities for that day (athletic events, dances, Groves, etc.). Cadets arriving late must arrive by 10:20am, and cadets dismissed early may not leave before 12:20pm in order to be considered the majority.

Attendance Records Each cadet's attendance will be recorded daily in compliance with State regulations. Following state law (Title 14, Chapter 27), cadets are considered truant after 3 unexcused absences. This policy refers to a cadet’s daily building attendance. DAPSS uses the following policy: Upon accumulating 10 absences, the academy will contact parents. Failure to produce valid documentation when requested will result in unexcused absences being recorded. A staff member from the academy will visit the cadet’s home. Upon accumulating 15 unexcused absences, the cadet’s parent(s) or guardian will be notified by certified mail to appear at the academy within 10 days of notification for a conference and counseling. Each parent or guardian of a cadet shall sign a contract with the academy agreeing they will make every reasonable effort to:

Have their child or children abide by the academy’s code of conduct; Make certain their child attend the Academy regularly; and Provide written documentation for the reasons for any absences

This contract will include the “no credit” status policy for excessive absences and retention due to incomplete coursework. NOTE: In accordance with Delaware school choice policy, cadets who fail to comply with basic academy tenets (regular attendance) will not be re-enrolled the following year When 20 unexcused absences have been recorded, charges of truancy will be filed and the academy will refer the case for prosecution.

No Credit (NC) Status Since our school utilizes a block schedule with cadets in 80-minute classes every other day, class attendance becomes even more crucial for success. Therefore, cadets cannot be absent from class without experiencing consequences to their learning and their grades. This policy refers to a cadet’s class period attendance. After 9 class absences (or 10% of total classes) cadets and parents/guardians will be notified by the instructor that the cadet is in danger of receiving no credit (NC) for the course. (A period absent is defined as missing more than 50 minutes of an 80-minute class.) After 18 class absences (or 20% of total classes) cadets and parents/guardians will be notified by the guidance counselor that the cadet is denied credit for the course. If at the end of the year the cadet has maintained a passing numerical average in that class, he or she may submit a written appeal to receive the course credit to the administrative team (to include the course instructor). The NC appeal form is available from the guidance office.

Tardy/Late to Class Policy Cadets have four minutes between classes to get from one room to the next. It is expected that a cadet shall arrive on time and be in the classroom prior to the late bell or have a pass from a teacher explaining the lateness. Being late to class is a Level IV Honor Code violation. In addition, if a cadet is late to a class three times in a marking period they will receive a detention. Cadets will receive another detention for every three lates to a class. Any cadet in the hallway without a signed pass during a hall sweep, will receive an automatic detention.

Late to the Academy Cadets arriving late to the academy must be signed in at the main office. Cadets will only be marked “Late: Excused” if written documentation is provided for reasons such as personal illness, medical appointments, or court appearance. Cadets and parents should know that a written note does not automatically cause the late to be “excused.” Cadets will be marked as “Late: Unexcused” for reasons such as car trouble, personal business, heavy traffic, child care, needed at home, etc. The policy for late/tardy to class, applies equally to late to the academy. (i.e. cadets arriving late to the academy, unexcused, 3 times in a marking period will receive a detention, etc.) It is expected that all cadets arriving to the academy late will sign in at the main office, proceed to their lockers and then directly to their appropriate class.

Early Dismissals All early dismissals require a written request from the parent or guardian, even if the cadet is 18 years of age. A parent/guardian must come to the office to sign the cadet out for early dismissal. Only cadets with a valid DAPSS parking permit will be allowed to leave campus unattended for early dismissal. Medical appointments should be made after academy hours, but concessions can be made if appointments must fall during academy hours. Cadets should return to the academy if there is time remaining in the day to help ensure course completion and success.

Driving Privileges Authorization to park on campus is limited to juniors and seniors. Cadets may not have failed more than two classes nor have been suspended at anytime in the previous year or marking period. If the number of qualified applicants for parking exceeds the number of available spaces a lottery will be held. DAPSS parking permits cost $50.00 and are non-refundable if revoked. Additional parking privilege information is available from the website or Driver’s Education department.

Search and Seizure Cadets shall be free from unreasonable search and seizure of property as guaranteed by the 4th Amendment of the U.S. Constitution. This individual right is balanced by the academy’s responsibility to protect the health, safety, and welfare of others. Lockers are academy property and may be subjected to search at any time, with or without reasonable suspicion.

DAPSS presumes a cadet possesses and is responsible for all items in a cadet’s assigned locker, book bag, and any other container used to carry personal property. Personal cars parked on campus are included in this policy.

Cadets have the right to privacy of their personal possessions, unless the administration has a reasonable suspicion of a cadets' possession of alcohol, drugs, drug-like substance, and drug paraphernalia or of a cadet’s unauthorized possession of a weapon, stolen property, or dangerous instrument in the academy environment.

Locker Use Cadets are assigned their own lockers for academy use and are issued a lock. Cadets are responsible for maintaining the lock, locker, and its contents. Cadets are not permitted to share lockers. Issued locks are the only locks authorized for use at the academy. Replacement costs for lost or damaged locks are the responsibility of the cadet/family.

Bus Policy Safety is the number one concern as cadets are being transported to and from DAPSS or academy sponsored activities. Bus transportation is a privilege, which can be withheld. Cadets have the responsibility to abide to all bus rules and regulations. Failure to abide may result in a cadet being suspended off the bus or denial of bus transportation.

The following bus rules can be enforced only with the cooperation of every person concerned with transportation:

1. Follow the driver’s directions and rules. 2. Cadets are to conduct themselves on the bus in such a way that will not distract the driver.

Distracting the driver puts everyone on the bus at risk. 3. Outside of ordinary conversation in a normal tone, classroom conduct is to be observed

when on the bus. The driver has authority to prohibit any conversation. 4. Cadets should help keep the bus clean, sanitary, and orderly. They must not damage or

abuse bus seats or equipment. 5. Cadets are not to leave the bus without the driver's permission, except on arrival at their

assigned bus stop or at DAPSS.

Lunch/Cafeteria Rules During the lunch period, cadets must be in the cafeteria or other space as assigned by staff. Cadets are free to talk quietly with those around them, but shouting and excessive movement from table to table, inside the cafeteria, or outside is prohibited. Cadets are expected to show respect and follow any requests given by teachers or administrators. Cadets may not leave the cafeteria without permission from a teacher or administrator. Cadets must have a signed pass prior to arriving at lunch in order to leave. No food or drink is permitted outside of the cafeteria, except for plain bottled water in a clear container. General eating or drinking in the hallways or classrooms is not accepted.

After-School Activities Policy Cadets who remain after normal academy hours must be in their assigned areas, with their assigned instructor, and with permission. Loitering after hours, or “hanging around” is not acceptable. Only cadets staying after for an organized activity with permission will be allowed to remain in the building. Violation of this policy will result in the denial of a cadet’s privilege to remain after hours. After completing their activities, all cadets will be directed towards the gym lobby to await their transportation home.

Sports Program DAPSS considers athletics an integral part of the educational experience. However, all DAPSS athletes are cadets first and athletes second. Refer to the Athletic Handbook for information defining the interscholastic policies and procedures for all cadets participating in our academy’s athletic programs.

Uniform Policy Cadets of the Delaware Academy of Public Safety and Security are a direct reflection of the academy’s central principles of: Leadership, Discipline, Organization, and Teamwork. Academy pride is reflected by both the cadets’ conduct and appearance. Therefore, it is imperative that cadets adhere to our uniform policy. The DAPSS uniform policy was written to be industry aligned, economical, and enforceable. All first responder organizations demand employees adhere to both the intent and spirit of the organization’s dress code. Similarly at DAPSS, the administration reserves the right to determine whether a cadet’s attire is within the limits of decency and modesty. Cadets must follow the uniform guidelines. Uniforms will be inspected daily and non-compliance will result in parental notification and disciplinary consequences, up to and including academy expulsion. Violation of the uniform policy is a Level IV: Honor Code violation. Cadets should refer to the most updated uniform policy available from the office or from the DAPSS website.

DISCIPLINE POLICY

The opportunity for education is the right of every cadet, but education is a privilege gained only by those responsible cadets whose behavior and attitudes enable them to derive the most from their experience. To ensure that each cadet receives fair and equal treatment every cadet will have prior knowledge of the conduct required and prohibited, and have an opportunity for rebuttal regarding the incident (including to place a written response in the cadet's file together with any incident report).

Insubordination is the failure of a cadet to follow the reasonable directives of any teacher or staff member during the day and at all academy activities. Insubordination and defiance are identified as Level III violations below. Criminal activity outside the academy environment can also be cause for disciplinary action by DAPSS against a cadet, if the conduct indicates that he or she presents a threat to the orderly functioning of the educational process or a danger to the health, safety or welfare of the other cadets and/or staff, or when that conduct jeopardizes the image or partnerships with public safety agencies and/or the community. Cadets arrested outside of the academy (S0161: Attorney General’s Report) will automatically be referred for a disciplinary hearing/expulsion.

Disciplinary System (Detention, Suspension, Expulsion) DAPSS uses a referral system for cadets who break rules and policies. This serves as a learning process for those who violate regulations and as a deterrent for those who may be tempted to do so. Cadets are referred to the Disciplinarian for major and repeated offenses. The academy will keep track of referrals and detentions, etc., and will notify parents as certain violation levels are reached (see below). Referrals also help detect and record patterns of behavior that require correction. Cadets issued a detention from a referral, will serve a 120-minute after-school detention. Three detentions in one marking period will result in an automatic out-of school suspension and a parent conference with the administration. Each cadet is afforded three classroom interventions (when applicable) before a referral. These may include moving seats, teacher debriefings, etc., or Honor Code consequences (see Level IV: Honor Code Violations).

Detention Detention is held on a regular basis at a location designated by the Disciplinarian or designee. Detentions are held Tuesdays and Thursdays after school starting at 1430 and ending 90 minutes later (subject to change based on the academy schedule). Saturday detentions will be assigned and scheduled as needed by the administration. No bathroom passes will be issued during detentions, unless medically excused. Cadets assigned detention shall report to the designated location on time and in full academy uniform. Any cadet that arrives late to detention and/or not in uniform, will not be permitted to enter and will need to serve the detention on the next scheduled day. Arriving late and/or not in uniform to the next scheduled detention results in an automatic one-day suspension. All cell phones and electronic devices are to be surrendered to the staff member upon entering. Any cadet caught with a cell phone/etc. while in detention will be

issued a second detention, the device will be confiscated, and returned to a parent/guardian after conferencing. Refusal to surrender a cell phone is an automatic suspension. Cadets are not permitted to eat or drink during detention at any time. Talking and/or sleeping during detention is also prohibited. Cadets will be given one warning for sleeping. If the cadet continues they will be removed and issued a second detention. Cadets who refuse to serve the assigned detention time, fail to show for an assigned detention, or are disruptive during their detention will be assigned a one-day suspension. Detentions are issued by the Disciplinarian for a variety of infractions. All detentions will be scheduled by the Disciplinarian. Cadets will be provided, when possible, with a 48-hour notice of detention and are required to serve the detention on the assigned date. Cadets receiving three detentions in one Marking Period will receive an automatic one-day suspension and parent/guardian conference.

Suspension – Out of School Notification shall state the cause and duration of the suspension. In all events, an attempt shall be made to notify the parents/guardians by telephone. Cadets whose parents cannot be reached by telephone will be retained at the academy until the end of the day. However, if this is not feasible or if the immediate removal of the cadet from the academy is necessary to protect the safety of individuals, property, or the integrity of the educational process, the necessary notice and hearing will follow as soon as possible. Any suspension for 3 or more days requires a conference with the administration, parent/guardian, and cadet before the cadet is allowed to return to the academy. Upon the fourth suspension in an academic year, the Head of School or designee may refer the cadet for an expulsion hearing and dismissal.

Expulsion In instances where a cadet’s behavior or violations result in a referral for dismissal, the Head of School will follow the Delaware Academy of Public Safety and Security’s Expulsion Hearing Procedures. A detailed copy of these procedures is available upon request from the office or electronically from the academy’s website. The administration may, at their discretion, refer any cadet to a homebound instructional program, online alternative program, or other alternative educational program in place of or as a component of expulsion.

Levels of Infractions DAPSS utilizes a level system of infractions when dealing with cadet behavior. Honor Code violations are immediately correctable offenses and are contained within Level IV violations. Multiple or repeated infractions (S0333) or violations of behavior contracts (S0103) will result in disciplinary hearings and possible additional consequences.

Level IV: Honor Code Violations The following list of infractions identifies behavior that is considered a violation of the cadet Honor Code. This list does not contain the all-inclusive definition, and conduct not specifically stated may still constitute an honor code violation.

Disruptive Behavior (S0091): Language, gestures or actions that produce distractions, frictions or disturbances that interfere with the effective functioning of the teacher, another cadet, class, or any academy activity. This includes, but is not limited to, yelling or running in the hallway, sleeping in class, eating or chewing gum during class, dishonesty, unprepared for class, violating classroom procedures, etc. Inappropriate Language (S0011): Any profane language or derogatory, disrespectful comments that are not specifically directed. Loitering (S0071): A cadet’s unauthorized presence in any academy area. Possession of Non-School Items (S0131): Any item or device that may be deemed by staff as disruptive or having the potential for causing disruption (that is not a weapon). Unexcused Tardy (S0031 or S0032): Anytime a cadet is late to class. Note: Three (3) lates to a class constitutes an automatic detention. Violation of Uniform Policy (S0291): Any correctible uniform infractions, including accessories, outerwear, untucked shirts, etc. Violation of Public Safety Culture and Environment: Actions by a cadet that violate or disrupt the culture and environment unique to DAPSS.

(Level II) Bullying and Cyberbullying (D0701): Bullying is any intentional written, electronic, verbal or physical act or actions against a cadet, DAPSS volunteer or employee that a reasonable person, under the circumstances should know will have the effect of: (1) placing a cadet, DAPSS volunteer or employee in reasonable fear of substantial harm to his or her emotional or physical well-being or substantial damage to his or her property; or (2) creating a hostile, threatening, humiliating or abusive educational environment due to the pervasiveness or persistence of actions or due to a power differential between the bully and the target; or (3) interfering with a cadet having a safe environment that is necessary to facilitate educational performance, opportunities or benefits; or (4) perpetuating bullying by inciting, soliciting or coercing an individual or group to demean, dehumanize, embarrass or cause emotional, psychological or physical harm to another person.

Cyberbullying means the use of uninvited and unwelcome electronic communication directed at an identifiable cadet or group of cadets, through means other than face-to-face interaction which (1) interferes with a cadet’s physical well-being; or (2) is threatening or intimidating; or (3) is so severe, persistent, or pervasive that it is reasonably likely to limit a cadet’s ability to participate in or benefit from the educational programs of DAPSS. Communication shall be considered to be directed at an identifiable cadet or group of cadets if it is sent directly to that cadet or group, or posted in a medium that the speaker knows is likely to be available to a broad audience within the DAPSS community.

reasonable cadet of the same grade and other circumstances as the victim. 2. The place of origin of speech otherwise constituting cyberbullying is not material to whether it is considered cyberbullying under this policy, nor is the use of any DAPSS materials.

Social media refers to any electronic outlet of communicating with another person. The following social mediums where posting of speech will be presumed to be available to a broad audience within the school community, regardless of privacy settings or other limitations on those postings, shall include: Facebook, Twitter, MySpace, YouTube, Snap Chat, Instagram, Pinterest, Secret, YikYak, or similar type of social media applications. This list is NOT considered exclusive and any social media outlet or electronic communication, such as e-mail, texting, instant messaging, which allows for communications that may be viewed by the intended victim shall be considered as an electronic medium for the purposes of enforcing the electronic/cyber bullying aspects of the DAPSS Bullying and Cyberbullying Prevention policy. Internet sites such as “blogs” which may be created and used by individuals for the specific purpose of bullying as defined above shall also be treated in the same manner as other publicly accessible internet portals.

(An act is intentional if it is the person’s conscious objective to engage in conduct of that nature.) The Code of Conduct will be enforced for any verified act of bullying, as defined above, committed off campus against a DAPSS cadet if the administration determines that the act of bullying interferes with the educational rights of another cadet and/or causes a substantial or material disruption of the DAPSS environment.

Discipline of Cadets with Disabilities In some cases a cadet’s need for a modified learning environment may also require operating under a modified disciplinary procedure. DAPSS conforms to all state and federal laws in such instances. A detailed outline of these procedures is available upon request from the office or the Director of Cadet Services, and electronically from the academy’s website.

Reporting Crimes to Police Appropriate law enforcement agencies will be notified when DAPSS encounters any of the following activities, or as stated by Delaware Law:

1. Felonies, or evidence that suggests the commission of a felony 2. Assaults 3. Evidence that suggests the commission of an assault and extortion against a cadet, or an

assault, offensive touching, terroristic threatening or extortion against an academy employee

4. Evidence that suggests violation of the laws concerning controlled substances and alcohol

5. Evidence that suggests incest, sexual abuse, the neglect, or other abuse of children 6. Evidence that suggests the use, possession, or sale of dangerous instruments or deadly

weapons, e.g., knives, firearms, ammunitions, explosives, or blasting caps 7. Evidence that suggests moral offenses 8. Evidence that suggests organized gambling 9. Evidence of offenses involving academy property 10. Reports of suspicious persons/unauthorized persons on or near academy grounds or

property 11. Rumors, information, or observations of gang rivalries or activities.

Bullying Policy A detailed copy of the DAPSS bullying policy is available online from the academy’s website or in print from the main office. Any member of the DAPSS community who believes that an unlawful harassment of a cadet has occurred must report the information and expect the enforcement of this policy. The policy: forbids bullying and retaliation against those who report bullying, defines bullying, supports an academy-wide prevention program, requires the academy to review and supervise non-classroom areas, sets reporting requirements and investigative procedures, requires reporting to Delaware DOE of all confirmed bullying incidents, sets an appropriate range of consequences for bullying, sets procedures for notification to cadet/caregiver for information on bullying, and is implemented all year.

Physical Contact No employee of DAPSS may inflict or cause to be inflicted physical harm on a cadet. This subsection of the discipline policy does not prohibit an official or professional employee of the Delaware Academy of Public Safety and Security from:

Using reasonable and necessary physical contact to quell a disturbance or prevent an act that threatens physical injury to any other person;

Using reasonable and necessary physical contact to obtain possession of a weapon, other dangerous object, controlled substance, or drug paraphernalia within a cadet’s control;

Using reasonable and necessary physical contact for the purpose of self-defense or the defense of others;

Using reasonable and necessary physical contact for the purpose of protecting academy property;

Using reasonable and necessary physical contact for the purpose of removing a disruptive cadet from the academy premises or motor vehicle or from academy-sponsored activities;

Using reasonable and necessary physical contact to prevent a cadet from inflicting harm on himself or herself;

Using reasonable and necessary physical contact to protect the safety of others; and Using incidental, minor, or reasonable physical contact to maintain order and control.

Per the Memorandum of Understanding, the Tactical Operations Command’s physical fitness discipline system and procedure is not classified as physical harm and does not fall under this provision of the handbook. Physical discipline is used within the unit as an educational and motivational tool, not as a means to exact revenge and is limited to use at the discretion of the Senior Director.

Cadet Grievance A cadet grievance may be presented, within 10 school days of the alleged infraction, when a cadet or parent/guardian believes that the cadet has been treated unfairly. A person may not file a grievance about a situation in which he/she has no personal involvement. The grievance procedure is as follows:

The grievant, whenever possible, shall request a conference with the teacher or person(s) who allegedly treated the cadet unfairly. If the conference does not resolve the complaint, the grievant should proceed to the next position on the DAPSS Operational Chain of Command.

If the conferences fail to resolve the complaint, the grievant may file a written grievance with the Head of School. The Head of School, or his/her designee, shall schedule a conference to hear the grievance within a reasonable time following receipt of the notice of appeal and shall render a decision, in writing, after the grievance conference. The decision of the Head of School is subject to review by the Board of Directors.

If the cadet's grievance is with the Head of School, this process may begin by contact with the Board of Directors.

GENERAL INFORMATION

Change of Address The academy must be notified immediately of any change of address or phone number so that the academy records may remain accurate. An original power bill or lease statement is required. The original document must be given to the office. The original document will be returned after a copy is made for our records. All change of address documentation is handled through the main office.

Liability for Property Cadets bring, use, and leave their property at the academy at their own risk. DAPSS does not accept liability for any personal property brought to the academy that is lost, stolen, or damaged.

Telephones and Messages DAPSS staff cannot routinely deliver personal messages to cadets and cannot call cadets to the telephone. Please make all arrangements at home before classes. Exceptions will be made for emergencies.

Personal Electronic Devices Cadets are prohibited from using or displaying personal electronic devices (Mp3 players, iPods, hand-held electronic games, digital cameras, etc.) during academy hours (from the first until the last bell), unless they have permission from an instructor to do so as part of a classroom activity. Use of a cell phone includes any function or feature. Cell phones must be turned off and put away (not visible). Cadets needing to make emergency calls to or from parents may do so through the office or classroom phones with permission. Refer to Level III Violations for detailed consequences. Refusal to surrender a device to any instructor is not an option and will be treated as defiance/insubordination. Volunteer fire, ambulance, or rescue squad personnel who serve an essential role in the emergency or rescue squad may apply to the Director of Public Safety for an exemption for fire department issued paging devices. Violation of this exemption constitutes defiance/insubordination. Cadets assume all responsibility for loss, theft, damage or misuse of any personal electronic device.

Cadet Medications All medication is kept in the nurse’s office. Cadets are not permitted to carry any of their own medication. If you send medication to school it must have the pharmacy label with instructions on it, or be in the original container if it is an over-the-counter medication. This is state law. A medication administration permission form must be completed and signed by the parent or guardian. Your child will not

receive medication unless these regulations are followed. It is recommended that all cadets with asthma and/or allergies have their medication at school for emergency use. This would include quick relief inhalers, nebulizer medication with tubing, EpiPens and/or Benadryl, and an emergency action plan completed by your cadet’s doctor. Exceptions: After clearance from the nurse, cadets with asthma and allergies may carry their EpiPens, rescue inhaler, or diabetic supplies with them during the school day. However, a note from the prescribing physician that states the cadet may carry the medication with them and includes instructions for use must be given to the nurse. A release must also be signed by the parent or guardian. Cadets are strongly encouraged to keep spare supplies with the school nurse in case of emergencies.

Policy on Electronic Devices During Standardized Testing

DAPSS, under direction of DOE, must enforce this strict policy during standardized testing to maintain test security. This policy applies to all DeSSA administered assessments that are identified in the table below. If parents or family members need to contact a cadet during testing days, they may call the main office. The term electronic device includes any personal, non-educational device with an on-off switch, with the exception of medical equipment, most commonly, but not limited to the following: cell phones, smart phones, MP 3 players, iPods, or other music players, iPads, tablets, laptops, or other computers, pagers (personal and fire department issued). The academy is clearly informing cadets that: 1. Bringing an electronic device into the testing area violates academy and state policy. 2. Violation of this policy is grounds for confiscation and a search. The following procedures must be followed when test materials are distributed:

• Electronic devices must be turned completely off. They may not be on “silent” or “vibrate” modes.

• Electronic devices may not be on a cadet’s body, including in pockets or otherwise stored in clothing.

• Electronic devices must be stored in a secure location away from cadets. If an electronic device is found on a cadet during testing, the academy will adhere to the following procedures:

• Confiscate the electronic device. • Check the device for pictures, texts, transmissions by applications (such as Facebook), and

any other recent use to ensure secure testing items were not shared. • Continue testing the cadet. • Contact the Test Coordinator, and/or the administration. • On completion of testing, interview the cadet regarding use of the device. • Enforce Academy disciplinary action. • Report the test security incident to the state via SysAID.

DeSSA administered assessments include the following:

Release of Cadet Information Report cards, state test scores, and other correspondence regarding the cadet or the academy will be sent only to the parent/guardian with whom the cadet primarily resides. The parent/guardian has the right to set up an appointment to come into the academy to review the cadet’s permanent record, unless there is a court order in the cadet’s folder that is contradictory to this practice. In the case of transfer or withdrawal, permanent cadet files will be sent directly to the district/school office upon official request. In addition, all formal documentation will reflect the name of the cadet indicated on the birth certificate. Name changes will only be granted with appropriate court documentation.

FERPA Rights The Family Education Rights and Privacy Act (FERPA) affords parents/guardians, and cadets over 18 years of age, the following rights: Inspection and Review Parents/guardians may submit to the Commissioner a written request identifying records they wish to inspect. The Commissioner will notify them of the time and place and place at which records may be inspected. Access shall be provided within 45 days of the receipt of the request. Amendment and Records Parents/guardians may ask the academy to amend a record they believe is inaccurate by submitting to the Commissioner a written request identifying the part of the record they want changed and specifying why it is inaccurate. If the academy denies the request, the academy will notify them of the decision, advise of the right to a hearing, and provide the hearing procedures.

Disclosure Without Consent Disclosure of personally identifiable information contained in the cadets’ education records requires parent/guardian consent with the following exceptions: 1. Such records may be disclosed to academy officials with legitimate education interests. Academy officials include academy employees, members of the Board of Directors, a person or company retained by the academy to perform a special task (for example, an attorney, auditor, medical consultant, or therapist). An academy official has a legitimate educational interest if the official needs to review an education record in order to fulfill a professional responsibility. 2. Upon request, the academy discloses education records without consent to officials of another school district in which a cadet seeks or intends to enroll. Complaint Parents/guardians may file a complaint with the U.S. Department of Education concerning alleged failures by the academy to comply with the requirements of FERPA by submitting a complaint to:

Use of Surveillance Equipment for Safety and Security To help assure the safety and security of the cadets and staff, the academy uses cameras and audio devices to monitor public areas or accesses to restricted areas in the academy or on academy property. Recordings from devices installed for safety and security may be used as the basis of disciplinary actions, or, if appropriate, criminal prosecutions against persons committing violations on academy property. This section does not preclude the installation of recording or monitoring devices as part of a criminal or administrative investigation in compliance with pertinent authorities, laws, and procedures for the conduct of such investigations. The use of video cameras is subject to pre-approval by the Head of School.

Academy Visitors Parents/guardians, and prospective cadets and their families are always welcome to visit the academy. If parents/guardians wish to meet with the administration or staff, they must make an appointment. For the protection of the cadets, all visitors must sign in at the main office upon entering the building and are not permitted to walk around the building without a staff or cadet escort and visitor tag. Entrance to the building during academy hours is only permitted through the main entrance in the parking lot. Access to the building will not be granted to parents/guardians, guests, or visitors who attempt entrance through the gym lobby. Pick Up and Drop Off locations are likewise at the main entrance in the parking lot.

Closed Campus For the safety of cadets and staff, DAPSS operates a closed campus policy. Upon entering academy property (whether by car, foot, or bus), cadets may not leave campus unless authorized to do so. The parking lot is off limits during normal academy hours. Returning to campus after leaving without permission constitutes reasonable suspicion to conduct a search.

Health Examination Requirement The State of Delaware requires all entering 9th grade cadets to have a health examination including updated and complete immunizations within 2 years. In addition, all entering 9th graders starting in the 2016 academy year will be required to have 1 dose of Tdap (adult booster) and 1 dose meningococcal in addition to their previously required vaccines. DAPSS complies with this state requirement and accepts any completed physical form from a medical office, the official Delaware School Health Examination form, or the DIAA Physical Evaluation form.

Unmet Obligations Cadets with unmet obligations to the academy at the end of a year will have their official records (including final grades, diplomas, and transcripts) held in the main office until such obligations are met. Unmet obligations may include missing or damaged textbooks, locker keys, athletic equipment or other academy supplies, and outstanding sports/club fees. Failure to return or replace missing or damaged material or property in a timely manner is considered an unmet obligation until remedied.
