Hakeem Sultaana moves pursuant to Ohio Criminal Rule 47 to have this court turn over the Jury

verdict form for appeal purposes and other substantial reasoning,

This verdict form is needed to contest several issues which Hakeem Sultaana has a right to raise

in his pending direct appeal and other pending post conviction relief seek-age.

This issue is a procedural defect that will amount to substantial United States Constitutional

right violations if this form does not surface.

BRIEF IN SUPPORT OF MOTION

The brief ii1 the above captioned case is due on October 29, 2014. This Court previously

granted the undersigned counsels' recluest for a generous extension of time based on the volume of

the case and the fact that imdersigned are both cas7ying a heavy caseload. In granting that

extension, this Court noted that it would not coalsider further extension. Nevertheless, counsel

require a slaort additional extension, to and inchading November 4, 2014, to get Mr. Sultaana's brief

on f l.e.

For ojze thing, Mr, Sultaana has been actively involved in his appeal - so involved that he

required frequent coininunication between counsel and Sultaana regarding the issues to be raised on

appeal. DLUing those coinmunications, it has become clear that the jut•y verdict forms figure

prominently in. N11r; Sultaana's ur.iderstanding of his direct appeal. Accordingly, obtaining and

properly filing those foi-n-is has become asa issue that has occasioned some delay.

In addition, both und.ersigned counsel are carrying extremely heavy appellate dockets (the

Piib1ic Defender's Appellate Division has been agaiul reduced to three lawyers, notwithstanding the

expansion of their docket), as well as their involvegnent in trial court matters. Further, both lawyers

have been working intensivel.y on trial and Suprezne Court matters. Mr. Sweeney has been

preparing for trial in .Stat^. v. ?"higpLiz, CR-12-56300'j, an aggravated inuzder prosecution in the

Court of Common I'leas set to coinmence on November 4th. Ms. Cunliffe has been briefing

nuinerotis pretrial issues in State v. Mcr.dison, CR-13-579539, a capital murder prosecution in the

Cou.rt of Co;ninon. Pleas; in addition to new briefing ordered by the Ohio Supreme Court in State v.

14nt13onv Sowell, 2011-1921.

Ultimately, Ivlr. Sult.aana's case raises important complex issues that caunsel need time to
