1 . Section 2 o l the Coasral Fisitcrirs Protecrion Act is amended by adding the following In alphabetical order:

"NAFO Regularor)- Area" means {hat pair of the following area, bclng the Convent~on Area of the Nonlwesr Arlanlic Fisheries Organnation, that 1s on the high seas.

(a) the waters of the N O ~ ~ W C S I Atlantic Ocean north of 35O00' nonh latitude and west of 3 linc extend~ng due north from 35000' nonh Iatitudc and 42O00' west longitude to 59000' nonh latltude, thence due west to 44O00' west longitude. and thence due nonh to thc coasr of Grccn- land. and

(6) the W a t C d of the Gulf of SI. Law- rcnce, Davis Strait and Baffin Bay south of 7g010" north latitude;

"straddling slock" means a prescrlbcd stock of fish.

2. The Act is amended by addlng the following after section 5:

5.1 Parliament, recognizing

(b) that those stocks are threatened with extinction,

(c) that there IS an urgent need for all fishing vessels to comply in both Canadian fisheries waters and the NAFO Regulatory Area with sound conservation and management measures for those stccks, notably those measures that are taken under the Convention on Furure Multilorwol Coop- eration In the Northwest krlanrrc Fisheries, done at Ottawa on October 24, 1978, Canada Treaty Series 1979 No. 1 1, and

3. Section 6 of the Act i s amended by adding the following after paragraph (b):

(b.1) prescribing as a straddllng stock, for the purposes of sect~on 5.2, any stock of fish that occurs both within Canadian fisheries waters and in an area beyond and adjacent to Canadian fisheries waters,

(8.2) prescribing any class of foreign fishing vessel for the purposes of section 5.2; (6.3) prescribing, for the purposes of section 5.2,

(2) A protection officer may exercise the powers refemd to in paragraph 7(b) without a wwant ~f the candttions far obtaining a warrant exist but, by reason of exigent circumstances, it would not be prac~ical to obtain a warrant.

5, The Act is amended by adding the fallowing after section 8:

8.1 A protection officer may, In the manner and to the extent prescribed by the regulations, use force that 1s tntended or IS llkely to drsable a foreign fishing vessel, if the protection officer

(a) is proceeding lawfully to arrest the marter or other person in command of the vessel; and

( b ) believes on reasonable grounds that the forcc is necessary for h e purpose of arresting that masteror other permn.

6. (1) The portion of subsectton 18(1) of the Act before paragraph (a) is replaced by the following:

(a) In the NAFO Regulatory Area on bbard or by means of a foreign fishing vessel on board or by means of which a contravention of section 5.2 has been commilted: or

18.2 (1) Every power of arrest, entry, search or seizure or other power that could be exercised ~n Canada in respect of an act or omission referred to In section 18.1 in the circumstances referred to in that section may be exercised

(a) on board the forelgn fishing vessel: or

(b ) where pursuit has been commenced, at any place on rhe seas, other than a place that 1s in the terrjtonal sea or internal waters of a state other than Canada.

(2) A justice of the peace or judge in any terntorial division In Canada has jurisdict~on to authorize an arrest, entry, search or seizure or an invest~gat~on or other ancillary matter related to an offence referred to in section 18.1 In the same manner as if the offence had k e n commitred In that territorial division.

(3) Where an act or omission that is an offence by virtue only of sectlon 18.1 i s alleged to have been committed on board or by means of a vessel that is registered or licensed under the laws o f a state other than Canada, the powers referred to in subsection ( 1 ) may not be exercrsed outside Canada with respect to that act or omission wrthout the consent of the A t t m e y Genera! of Canada.

( b ) to compile and maintain statistics and records and to publish or dis- sernlnate reports, information and materials pertaining to the f i~heries of the Ccinvent~on Area, including environmental end ecological factors affecting these f~sheries;

3. The Contracting Parties shall fur- nish to the Scientific Council any avail- able statistical and scientific information requested by the Council for the purpose of this Article.

Proposals adopted by the Commis- sion for the aliocetion of catches in the Regulatory Area shall take into account the interests of Commission members whose vessels have traditionally ilshed within that Area, and, in the ellocat~on of catches from the Grand Ranks and Flem- ish Cap, Commiss~on members shall give special consideration to the Contracting Party whose coastal communities are primarily dependent on fishing for stocks related to these iishing banks and which has undertaken extensive efforts to ensure the conservation of such stocks through rnternatlonal action, in particular, by providing surveillance and inspection of international fisheries on these banks under an international scheme of joint enforcement.

Upon the entry into force of this Con- vention, each proposal that has been transmitted or i s effective at that time under Article VIII of the International Convention for the Northwest Atlantic F~sheries, 1949, ("the ICNAF Conven- tion") shall, subject to the provisions of the lCNAP Convention, become a measure binding on each Contracting Patty with respect to the Regulatory Area immediateiy, i f the proposal has become effectwe under the ICNAF Convention, or a t such time as i t becomes effective thereunder.
