Êîãàòî ïîëèòè÷åñêèòå ñèëè â Áúëãàðèÿ ñëåä äúëãà è ìú÷èòåëíà äèñêóñèÿ ñòèãíàõà äî ñúãëàñèå äîêóìåíòèòå íà áèâøèòå òàéíè ñëóæáè äà ñå ñúáåðàò è ñúõðàíÿò çà èñòîðèÿòà, à ãðàæäàíèòå äà ïîëó÷àò äîñòúï äî òÿõ, ìíîçèíà íå âÿðâàõà, ÷å òîâà ùå ñå ñëó÷è. Äíåñ, åäâà ëè èìà ÷îâåê, êîéòî äà ñå ñúìíÿâà, ÷å òîâà âå÷å å âúçìîæíî. Ñ äåéíîñòòà ñè êîìèñèÿòà äîêàçà, ÷å Çàêîíúò çà äîñòúï è ðàçêðèâàíå íà äîêóìåíòèòå è çà îáÿâÿâàíå íà ïðèíàäëåæíîñò íà áúëãàðñêè ãðàæäàíè êúì Äúðæàâíà ñèãóðíîñò è ðàçóçíàâàòåëíèòå ñëóæáè íà Áúëãàðñêàòà íàðîäíà àðìèÿ å ðàáîòåù è ñòðèêòíî ñå ïðèëàãà.

Íàé-ïîñëå õîðàòà âå÷å ðåàëíî ñå äîêîñâàò äî äúëáîêî ïàçåíèòå ïîä ãðèôîâå çà ñåêðåòíîñò äîêóìåíòè. Âÿðíî å, ÷å åäíè ïîëó÷èõà îãðîìíî ðàçî÷àðîâàíèå ïîðàäè îñâåòåíàòà èì òàéíà çàâèñèìîñò îò ñåêðåòíèòå ñëóæáè íà êîìóíèñòè÷åñêàòà âëàñò, íî âÿðíî å è òîâà, ÷å äðóãè ïîëó÷èõà òàêà äúëãî ÷àêàíàòà ñïðàâåäëèâîñò çà îêàçâàíàòà âúðõó òÿõ ïîëèòè÷åñêà ðåïðåñèÿ.

Èñòèíàòà, êàçâàò, ÷å áîëè. Íî ñàìî ïðè íåéíîòî ìàêñèìàëíî ðàçêðèâàíå ìîæå äà ñå ïèøå îáåêòèâíà èñòîðèÿ. Óìåíèåòî íà åäíî îáùåñòâî äà ÷åòå çàäúëáî÷åíî èñòîðèÿòà ñè, äà ÿ àíàëèçèðà è äà èçâëè÷à ïîóêè îò íåÿ, å äîáúð çàëîã çà íåãîâîòî ïî-äîáðî áúäåùå.

Îñòàâè íà ïóáëèêàòà äà èçáèðà äàëè äà ðúêîïëÿñêà èëè äà îñâèðêâà àêòüîðèòå, ðåæèñèðàíè îò íÿêîãàøíèòå òàéíè ñëóæáè. Åòî, ÷å çàâåñàòà å âäèãíàòà. Âëàñòòà å ïî-ïðîçðà÷íà, çàäêóëèñíèòå çàâèñèìîñòè îò ìèíàëîòî ñà âñå ïî-îãðàíè÷åíè. Îáùåñòâîòî èìà ñâîáîäàòà äà îöåíÿâà. Íåãîâî ïðàâî å äà ñúäè ïî ñâîÿòà ìîðàëíà ñêàëà. Êàêâî ïo-äåìîêðàòè÷íî îò òîâà?!

The curtain is lifted

When long and intense political consultations culminated in an agreement to collect and preserve the written legacy of the former Bulgarian secret services for history’s sake, under a policy of open and free access, many were skeptical. Domestic audiences were unimpressed with what they believed to be another attempt to dull the collective consciousness and memory with short-lived leg-islation. The law was pronounced dead at conception, and the general opinion was that it would soon be repealed as a failed piece of law-making.

Today, there are hardly any skeptics left to doubt the effects of this action. Within its competence, the Committee has succeeded to effectively and strictly implement the Law on Access to and Disclosure of the Documents and An-nouncement of Affiliation of Bulgarian Citizens to the State Security and the Intelligence Services of the Bulgarian National Army.

Access to the secret world of classified documents is no longer an illusion but a reality. While some were greatly disappointed with their affiliation to the com-munist secret services being publicly announced, justice was finally restored for others who had been victims of political repressions and persecution.

While the truth hurts, acknowledging the truth in its entirety is the best way for-ward and the only credible instrument to examine past events as objectively as possible. Society’s best hope for a better future lies with its ability to engage in an in-depth reflection on its history, analyse and learn from the past.

From the beginning of its mandate, the Committee refused to live up to the expectations to be a judge or a critic. It had the specific task to pull back the curtain and report the truth as it happened. It was left to the audience to choose whether to cheer or jeer the actors dancing on the strings of their SS puppet masters. The curtain is lifted. Government is more transparent now; backstage bargaining of the past takes place less frequently. Members of our society are free to make choices while staying true to their moral compass. What is more democratic than that?!

ïîëçâà, ñúõðàíÿâà è ñå ðàçïîðåæäà ñ äîêó-ìåíòèòå íà Äúðæàâíà ñèãóðíîñò è ðàçóçíà-âàòåëíèòå ñëóæáè íà Áúëãàðñêàòà íàðîäíà àðìèÿ. Ðàáîòàòà º å îòêðèòà è ïðîçðà÷íà, çàùîòî âñÿêî âçåòî îò íåÿ ðåøåíèå ñå êà÷-âà íà èíòåðíåò ñòðàíèöàòà íà Êîìèñèÿòà, à äåéíîñòòà º ñå îò÷èòà íà âñåêè øåñò ìåñå-öà ïðåä Íàðîäíîòî ñúáðàíèå.Ïî çàêîí ÷ëåíîâåòå íà Êîìèñèÿòà íå òðÿá-âà äà èìàò ïðèíàäëåæíîñò êúì Äúðæàâíà ñèãóðíîñò è êúì ðàçóçíàâàòåëíèòå ñëóæ-áè íà ÁÍÀ, êàêòî è äà íå ñà ñëóæèòåëè íà äíåøíèòå ñïåöèàëíè ñëóæáè. Ëóñòðàöèÿ, â ñìèñúë íà ó÷àñòèå â èçáîðíè è âëàñòî-âè ñòðóêòóðè íà õîðà ñ ïðèíàäëåæíîñò êúì ÄÑ è ÐÑ íà ÁÍÀ, å ïðèëîæåíà ñàìî â òîçè çàêîí. Äðóãîòî óñëîâèå å äà èìàò ðàçðåøå-íèå çà äîñòúï äî êëàñèôèöèðàíà èíôîðìà-öèÿ. ×ëåíîâåòå íà Êîìèñèÿòà ñå èçáèðàò ñ ìàíäàò îò 5 ãîäèíè.Ïðåç àïðèë 2012 ã. èçòå÷å ïúðâèÿò ìàíäàò íà Êîìèñèÿòà, à ïðåç ìàé 2012 ã. 41-òî Íà-ðîäíî ñúáðàíèå èçáðà íîâ ñúñòàâ – Ìàíäàò âòîðè. Çà ïðåäñåäàòåë íà Êîìèñèÿòà áåøå èçáðàí Åâòèì Êîñòàäèíîâ (âòîðè ìàíäàò), çà çàìåñòíèê-ïðåäñåäàòåë – Àéðóø Õàä-æè, à çà ñåêðåòàð – Ìàðèàíà Äàðàê÷èåâà. Çà ÷ëåíîâå íà Êîìèñèÿòà áÿõà èçáðàíè Àïîñòîë Äèìèòðîâ (âòîðè ìàíäàò), Áîðèñ Ìèõàéëîâ, Ãåîðãè Ïàíãàðîâ, Âàíÿ Æåêîâà, Åêàòåðèíà Áîí÷åâà (âòîðè ìàíäàò) è Îðõàí Èñìàèëîâ (âòîðè ìàíäàò). Âúïðåêè ðàçëè÷íîòî ïîëèòè÷åñêî ïðåä-ñòàâèòåëñòâî íà ÷ëåíîâåòå íà Êîìèñèÿòà, îáùîòî â òÿõíàòà ìîòèâàöèÿ îñòàâà ñòðèêò-íîòî ïðèëàãàíå íà çàêîíà è ðàçêðèâàíåòî íà èñòèíàòà çà áèâøèòå òàéíè ñëóæáè ïðåä îáùåñòâîòî.

The Committee is an independent body en-trusted with ensuring access to, disclos-

ing, using, keeping and handling the archives of the former state security and the intelli-gence services of the Bulgarian National Army (BNA). The principles of accountability and transparency apply to every aspect of work. All resolutions are published on the website of the Committee, while activity reports are produced and submitted to the National As-sembly on a semi-annual basis.The members of the Committee must meet the criteria to have no former connections to the State Security and the intelligence ser-vices of the BNA, and to not be employees of the special services of today. The principle of lustration, as far as membership of persons affiliated to the State Security and BNA intel-ligence services in election and government structures is concerned, is only employed in the relevant law. Authorisation to access clas-sified information is a further requirement for membership. Committee members are elect-ed for a five-year term.This Committee’s first term of office ended in April 2012. Second mandate members were chosen in May 2012 by the 41st National As-sembly as follows: Evtim Kostadinov (Chair-person, second term), Ayrush Hadzhi (Deputy Chairperson), Mariana Darakchieva (Secre-tary), and members Apostol Dimitrov (sec-ond term), Boris Mihaylov, Georgi Pangarov, Vanya Zhekova, Ekaterina Boncheva (second term), Orhan Ismailov (second term). Regardless of their political affiliation, all members of the Committee are united by the simple motivation to strictly follow the law and publicly expose the truth about the former se-cret services.

T o say the truth out loud is the hardest thing to do. It is even harder when this truth is painful,

affects human lives, undermines people’s trust, and generates social tension. This I wrote in my statement of motivation as a first-term Chairman of the Committee. The truth of these words is ap-parent to me now more than ever. It can be difficult, sometimes to the extremes. But I also learned that only the truth in its most essential form, unbur-dened by emotion or personal and political bias, can tell the story as it happened. It is the proper way to look at the past with no prejudice in mind and draw lessons for the future.

Within its first term of office the Committee pur-sued strict application of the law and largely ac-complished the main tasks entrusted thereto: determining and announcing affiliation of public figures to the former secret services, ensuring open access to their classified records, and estab-lishing centralised archives for their safekeeping. This second mandate is meant to carry through the process. We will continue our extensive ef-forts, on an even larger scale, to update public knowledge on the architects of the transition pe-

Äíåñ, îò äèñòàíöèÿòà íà âðå-ìåòî, îùå ïî-ñèëíî óñåòèõ, ÷å òîâà å òàêà. Íå ñàìî å òðóäíî, à ïîíÿêîãà äîðè å ìíîãî òðóäíî. Íî ðàçáðàõ îùå, ÷å ñàìî êîãàòî îñ-âåòåíàòà èñòèíà íå å ïîäâëàñòíà íà åìîöè-èòå, íå å çàáóëâàíà îò ëè÷íè è ïîëèòè÷åñêè èíòåðåñè, à å ïðèçâàíà äà ðàçêàæå èñòîðèÿ-òà òàêàâà, êàêâàòî å áèëà, ìîæå îáåêòèâíî äà áúäå îñìèñëåíî ìèíàëîòî è äà áúäàò èç-âëå÷åíè íàé-âàæíèòå ïîóêè çà áúäåùåòî.Ïðåç ïúðâèÿ ìàíäàò Êîìèñèÿòà ñëåäâàøå ñòðèêòíî çàêîíà è äî ãîëÿìà ñòåïåí èçïúë-íè ñâîèòå îñíîâíè çàäà÷è – äà óñòàíîâÿâà è îáÿâÿâà çàâèñèìîñòèòå îò áèâøèòå òàé-íè ñëóæáè íà ïóáëè÷íèòå ëèöà, äà îñèãóðè äîñòúï íà õîðàòà äî äîêóìåíòèòå íà òåçè ñëóæáè è äà èçãðàäè öåíòðàëèçèðàí àðõèâ, â êîéòî äà ãè ñúõðàíè. riod that shaped social awareness. To help soci-ety arrive, as close as possible, to the truth about the identity, methods, motivation and objectives of behind-the-scenes power actors, is crucial to understanding why Bulgarian transition turned out the way it did. As new opportunities emerge for growing public exposure of the archives, so take shape the foundations of a future Institute for Na-tional Remembrance.

Ñ ïðåäîñòàâÿíåòî íà âñå ïî-ãîëåìè âúçìîæíîñòè çà ïóáëè÷íîñò íà àðõèâíèòå äîêóìåíòè ùå ñå ïîñòàðàåì äà ïîäãîòâèì îñíîâèòå íà åäèí áúäåù Èíñòèòóò çà íàöè-îíàëíà ïàìåò.

F rom my deep personal ex-periences I find motivation

to work and be part of the Com-mittee. The list of reasons is long; long enough to be consis-tent with a life with more than its fair share of hardship. Both in terms of time and pain, righ-teous anger, fight for human rights and freedoms.

As I close my eyes and look back in time they flash before me, first stories around the fireplace, sights and memories of defending my name and religion, the sense of violated dignity, five years of imprisonment, horror of solitary confinement, tor-ture, humiliation... Strangely how the pain of it all did not break me, but instead made me stronger. Then 10 November 1989 came with my faith in justice restored. My dream of democracy came true and another truth dawned upon me: freedom, especially one coupled with authority, is a tough moral burden to bear.

I believe that political power must go hand in hand with morality. I yearningly waited to see this moral-ity in action. It was unacceptable that a true demo-crat at heart could be like a coin – two-faced. I needed to re-examine the nature of men. Why are we the way we are? Who made us that way? How does this development take place?... I wish for my efforts to help fostering a culture free of puppet strings in life and politics. I look forward towards the revival of the ideal of democracy we used to fight for. It is human to err, but a man must be big enough to admit his mistakes, smart enough to profit from them, and strong enough to correct them.

M y transition from life in the province to the

benches of the 41st Nation-al Assembly, and now the Committee for the Secret Police Files, was guided and motivated by the con-cept of Truth. What are the nature and dimensions thereof? What is its part in life’s design and how it in-terferes with human exis-

tence?I found out that the Truth was almost always stifled by deceit, but never subdued in the end. Yet, the lack of morality is not a crime in the big books of law. Law covers all types of crime, but immoral is not illegal, and immorality never made it to court. Quite on the contrary, the court, the law, society have always dealt with its victims only, for the law does not concern itself with the unseen, but with the works of the wicked.

of office as a member of the 40th National Assembly and assume membership in the Committee. Even those closest to me, relatives

and friends alike, could not understand why I had come to this decision. I was mostly driven by the motivation to find out the truth about the State Se-curity. I admit to have had feelings of respect for the institution that was responsible for our nation’s safety.

ceptions circulating in public discourse. The topic of secret police files is surrounded by am-biguity and shrouded in specu-lations. I approach the subject with the curiosity of a child and the focus of a young man, un-burdened by the baggage of the past, free of prejudice, as-

sumptions, preconceptions and judgement. It is the truth I am interested in. The truth about the State Security as it was: its nature, its faces, its impact on every dimension of societal relations. I want to know if repressions took place and who was involved. I want to find out what, how and, above all, why? Answers to these questions will lay my mind to rest, knowing that what we have done has not been in vain.

A law is made up of a strict set of mandatory provisions forming articles, paragraphs and

sub-paragraphs. A functional law requires more than the good will of the people who are under the obligation to implement it. It has to demonstrate its value in practical terms; it has to be a law that works. And this law does.

The Committee for Disclosing the Documents and Announcing Affiliation of Bulgarian Citizens to the State Security and the Intelligence Services of the Bulgarian National Army (CDDAABCSSISBNA) is the only body in charge of the implementa-tion of the law which is authorised to establish and announce the affiliation of Bulgarian citizens to the State Security bodies and the intelligence services of the Bulgarian National Army. Affiliation is announced through a resolution published by the Committee on its website and in its bulletin is-sued on the grounds of article 14 of the law.

All actions dealing with disclosing, using and preserving the documents of the institutions re-ferred to above, and making them available to the public as required by law, fall within the exclusive competence of the Committee. These powers strictly apply to documents of the State Security bodies and the intelligence services of the Bulgarian National Army during the period be-tween 9 September 1944 and 16 July 1991.No other institution or individual person has the right to publicly announce affiliation or disclose any information of this nature. Violators of this rule are subject to the penalties provided for in article 273 of the Criminal Code. The research and publishing work is conducted in compliance with the Access to Public Information Act. Such activity does not confer a right to make public any information con-cerning the affiliation of an individual to the former security services, or reveal personal data of a third party mentioned in their documents.

II. What are the powers of theCommittee?

1. Determining and announcing Bulgarian citizens’ affiliation to the bodies of the former State Security and the intelligence services of the Bulgarian National ArmyIt was the aim of the legislator to further public awareness and establish transparency regarding holders of public positions or public functions, such as for example: the president and vice-president of the Republic; National Assembly and European Parliament members; the Prime Minister, deputy prime ministers, ministers and deputy ministers; members of the Constitutional Court; the ombuds-man and his/her deputies; representatives of dif-ferent state agencies, commissions, local authori-ties, heads and members of representative bodies of religious communities, media owners and edi-tors-in-chief, rectors of institutions of higher edu-cation, heads of supervision and monitoring bod-ies, and many more.

The law provides for the possibility of non-dis-closure and non-release of documents, the dis-closure or public announcement of which would harm the interests of the Republic of Bulgaria in the field of international relations, or endan-ger the personal life and safety of individuals. Such documents are to be filed in a separate fund of the centralised archives, which is under the direct control of the Chairperson of the Com-mittee. The latest amendment to the law (De-cember 2012) removed the restrictive §12 of the Transitional and Closing Provisions prohibiting determination of affiliation for persons who oc-cupied high positions at the Military Information Office and the National Intelligence Service after 16 July 1991. The scope of public figures subject to examination was extended altogether.

2. Acquisitions, use and preservation of the documents in the Centralised archives of the documents of the State Security and the intelligence services of the Bulgarian National Army.

Until the transfer of the documents of the former security services is fully completed (set to hap-pen before the end of the second mandate of the Committee) action will be taken in accordance with article 16, paragraph 2 of the applicable law. The bodies mentioned in article 1 thereof are ex-pected to deliver written reports compiled in ac-cordance with the formal requirements of the law, as well as all documents concerning examined persons that the Committee may request. The reports are merely supplementary material, as it is entirely within the competence of the Commit-tee to determine whether or not there is evidence of affiliation to the State Security bodies and the intelligence services of the Bulgarian National Army. The hand-over of documents is defined as a physical transfer of those documents to the Committee. Upon receipt, all items must be filed in its centralised archives established for this very purpose pursuant to article 1, paragraph 3 of the law. The organisation and maintenance thereof is a responsibility of the Committee.

III. Which people are subjectto examination?

The following individuals are subject to mandatory examination for affiliation:1. persons registered at the election

commissions to run in presidential and vice-presidential elections, National Assembly and European Parliament elections, mayor and municipal councillors elections. The election commissions are required to submit the lists of candidates to the Committee within 24 hours after registration. The Committee will then com-plete and publicly disclose the outcome of the examinations, regardless of whether or not the candidates have withdrawn their nominations;

2. former or current holders of public positions and persons who have performed public ser-vice from 10 November 1989 until examination took place;

3. newly appointed or elected officials in public positions or public functions, in the case of per-sonnel changes;

4. people who were listed as debtors or were members of a management or supervisory body of an undertaking included in the list of debtors published in the bulletin under article 3, paragraph 2 of the Act on Information regarding Non-Performing Loans.

IV. How will preliminary examination take place?

The procedure described as preliminary ex-amination is regulated by article 27 of the law. A political party may, for example, request prelimi-nary examination for affiliation to the bodies re-ferred to in article 1 of the law in relation to those of their members who intend to run in elections or hold positions in the executive branch. Should affiliation be established, their nominations may be withdrawn, if so demanded by the organisation concerned. Preliminary examination shall be car-ried out upon written requests by:– political parties, coalitions and organisations

with respect to their members;– bodies from the legislative, executive and judicial

branch with respect to the people to be elected or appointed to public positions;

– professional, public, religious and scientific bod-ies, trade unions and other civil society organi-sations and associations with respect to their members.

The request should bear the signature of the person representing the body or organisation. A preliminary examination is not allowed without the prior written consent of the examined person which must accompany the request. It is often the case that parties or organisations file applications for examination of non-members of the requesting body. Such requests violate the requirements of the law and are therefore not to be granted. The outcome of the preliminary examination is brought to the knowledge of the applicant, and, if affiliation is determined, communicated to the examined person as well.

IV. Êàê ñå èçâúðøâàïðåäâàðèòåëíàòà ïðîâåðêà?

Çàêîíîäàòåëÿò å ïðåäîñòàâèë è âúçìîæíîñòòà îò òàêà íàðå÷åíàòà ïðåäâàðèòåëíà ïðîâåðêà (ðåãëàìåíòèðàíà â ÷ë. 27 îò çàêîíà). Íàïðèìåð, àêî äàäåíà ïîëèòè÷åñêà ïàðòèÿ ïîèñêà ïðåäâà-ðèòåëíà ïðîâåðêà çà ïðèíàäëåæíîñò êúì îðãà-íèòå ïî ÷ë. 1 îò çàêîíà íà ëèöàòà, êîèòî âúçíà-ìåðÿâàò äà ñå êàíäèäàòèðàò â äàäåíè èçáîðè èëè çà ó÷àñòèå â èçïúëíèòåëíàòà âëàñò è àêî ñå óñòàíîâè òàêàâà, òå ìîãàò äà ñå îòêàæàò, àêî ñúîòâåòíàòà îðãàíèçàöèÿ äúðæè íà òîâà óñëî-âèå. Ïðåäâàðèòåëíàòà ïðîâåðêà ñå ïðèëàãà ïî ïèñìåíî èñêàíå íà:– ïîëèòè÷åñêè ïàðòèè, êîàëèöèè è îðãàíèçàöèè

ïî îòíîøåíèå íà òåõíèòå ÷ëåíîâå;– îðãàíè íà çàêîíîäàòåëíàòà, èçïúëíèòåëíàòà

è ñúäåáíàòà âëàñò ïî îòíîøåíèå íà ëèöà, çà êîèòî ïðåäñòîè èçáîð èëè íàçíà÷àâàíå íà ïóáëè÷íà äëúæíîñò;

– ïðîôåñèîíàëíè, ñèíäèêàëíè, îáùåñòâåíè, ðåëèãèîçíè, íàó÷íè è äðóãè ãðàæäàíñêè îð-ãàíèçàöèè è ñäðóæåíèÿ ïî îòíîøåíèå íà òåõ-íèòå ÷ëåíîâå.

Èñêàíåòî ñå ïîäïèñâà îò ëèöåòî, ïðåäñòàâëÿ-âàùî îðãàíà èëè îðãàíèçàöèÿòà. Ïðåäâàðèòåë-íàòà ïðîâåðêà å íåäîïóñòèìà, àêî ïðîâåðÿâà-íîòî ëèöå íå å äàëî ïèñìåíîòî ñè ñúãëàñèå çà íåÿ, êîåòî ñúãëàñèå ñå ïðèëàãà êúì èñêàíåòî.  ïðàêòèêàòà ÷åñòî ñå èñêà ïðîâåðêà ïî òîçè ðåä çà ëèöà, êîèòî íå ñà ÷ëåíîâå íà ïàðòèÿòà èëè îðãàíèçàöèÿòà, êîåòî ñúùî å íåäîïóñòè-ìî. V. How will affiliation bedetermined?

The Committee determines affiliation on the basis of documents that are found in the archives and collections of the former State Security services. Article 25 of the law makes reference to the per-sons and the relevant types of documents which serve as grounds for determining affiliation:– regular staff – data from the personal staff file,

regular work schedules or pay-roll forms;– part-time employees – data from the personal

staff file, regular work schedules or documents certifying receipt of payments;

– secret collaborators - declaration for collaboration, handwritten or signed by the person; handwritten information and intel-ligence provided by the person; documents certifying receipt of payments; documents handwritten or signed by the person and men-tioned in operative reports; documents com-posed by supervising staff members or part-time employees attached to them; as well as information found in the reference database (registration diaries and file indexes), proto-cols for destruction of records or other pieces of information in relation to collaborators.

The mere mention of a person’s names and aliases in the file index or registration diaries of these institutions provides enough grounds for announcement. The Committee is required, how-ever, to make a reference in its resolution to the absence of any other information mentioned in article 25, sub-paragraph 3. This legal solution rules out any argument as to whether affiliation should be announced in the absence of a hand-written and personally signed declaration for collaboration, handwritten intelligence reports, etc. If a person has a registration file in his/her name, it is the obligation of the Committee to an-nounce affiliation under the terms and conditions of article 29, paragraph 3. Affiliation must be announced if so much as a single document re-ferred to in article 25, sub-paragraph 3 exists, re-gardless of whether or not it was produced by the examined person. was adopted in view of the fact that a large vol-ume of files had been destroyed (what is left of these files are registration documents and a handful of other pieces of information). Anything other than this would work to the interests of the people who ordered the destruction of those re-cords.Having determined and announced the affiliation of public figures or holders of public functions to the former structures of the state security and the intelligence services of the Bulgarian National Army, the Committee has to publish a resolution on its website and in its official bulletin released in compliance with the law.

VI. What type of information shall not be published?

1. Information about deceased individuals shall not be published.

2. Information about persons who have reported or have consented in writing to report to the state security services before reaching the le-gal age of 18 years shall not be published.

3. Persons who had been subject to preliminary examination under the provisions of article 27 may avoid the announcement of their affiliation to the State Security. They can do so by with-drawing their nominations for public office or public service within three days upon receipt of a written notification of the outcome of the examination. This option does not apply to people who were registered at election com-mittees to run in elections. Information on their affiliation will be made public regardless of whether withdrawal takes place or not.

4. Persons who were born after 16 July 1973 shall not be subject to examination.

VII. What are the rights of citizens?

Everyone is entitled to:1. access to information collected about them or

their deceased spouse or relatives up to and including the second degree in a direct line of descent;

2. access to the documents of the bodies re-

VI. Êîè äàííè íå ñå ïóáëèêóâàò?

1. Íå ïîäëåæàò íà ïóáëèêóâàíå äàííèòå çà ïî-÷èíàëî ëèöå.

2. Íå ïîäëåæàò íà ïóáëèêóâàíå äàííè çà ëèöå, êîåòî å èçðàçèëî ïèñìåíî ãîòîâíîñò äà äàâà èëè å äàâàëî èíôîðìàöèÿ äî íàâúðøâàíå íà 18-ãîäèøíà âúçðàñò.

3. Ëèöå, êîåòî å áèëî îáåêò íà ïðåäâàðèòåë-íà ïðîâåðêà ïî ðåäà íà ÷ë. 27, ìîæå äà èç-áåãíå ïóáëèêóâàíåòî íà äàííèòå çà íåãîâàòà ïðèíàäëåæíîñò êúì ÄÑ, àêî â òðèäíåâåí ñðîê îò ïèñìåíîòî ìó óâåäîìÿâàíå çà ðåçóëòàòà îò ïðîâåðêàòà îòòåãëè êàíäèäàòóðàòà ñè çà çàåìàíå íà ïóáëè÷íà äëúæíîñò èëè èçâúðø-âàíå íà ïóáëè÷íà äåéíîñò. 4. Ëèöàòà, ðîäåíè ñëåä 16 þëè 1973 ã., íå ïîäëåæàò íà ïðîâåðêà.

VII. Êàêâè ñà ïðàâàòàíà ãðàæäàíèòå?

ferred to in article 1 for research and publish-ing purposes by virtue of the Access to Public Information Act.

The access to documents involves the right to personally consult the records, obtain document copies and request disclosure of the names of the persons who provided information in the case. This right is exercised by means of a written application which has to contain an explicit request for revealing the identity of those persons.Having been granted access to the resources, ap-plicants have the opportunity to personally con-sult the documents in the reading room of the Committee. If the documents contain references to third par-ties, the mention of which may seriously affect the rights and legitimate interests of the parties, and no explicit written consent for disclosure is given by those parties or their heirs, copies of documents shall not include the information regarding those third parties. In such a case, the applicant shall sign a declaration of non-disclosure of the circumstances which have come to his/her attention. In practice this means that applicants, as a rule, have the right to personally examine the original documents, but if no consent is given by the third persons mentioned in those documents, all information regarding the latter will be removed from the copies.Persons whose affiliation has been announced in a resolution of the Committee have the right to examine the documents in their personal and working files. It is their right to appeal the de-cisions of the Committee in accordance with the provisions of the Administrative Procedure Code. An appeal nevertheless shall not sus-pend the publication of these decisions on the website and in the bulletin of the Committee.

VIII. What are the obligations of citi-zens and institutions?

1. Physical persons, legal entities and institutions do not have the right to publish or announce in any other way documents or parts

of documents that provide evidence for affiliation to the bodies referred to in article 1. Violators of this prohibition bear criminal responsibility under article 273 of the Criminal Code. There is, however, no legal requirement which pre-vents physical persons from announcing their own affiliation.

2. Physical persons, legal entities and institutions which are in possession of original documents of the bodies referred to in article 1, have the obligation to submit them to the Committee. Failure to fulfill this requirement will result in a penalty according to article 313b, paragraph 2 of the Criminal Code.

3. If officially invited, officials and citizens are obliged to appear before the Committee within seven days upon receipt of the notifica-tion and submit the requested information and documents.

4. Òhe reference aids and archival documents of the bodies referred to in article 1 can only be used upon permission of the Chairperson of the Committee.

5. It is the duty of the heads of the security services to have the undercover officials and collaborators holding public positions or public service functions removed from oversight, and notify the Committee thereof. Any failure to fulfill this obligation will lead to actions taken in accordance with article 284b of the Criminal Code.

3. Äëúæíîñòíèòå ëèöà è ãðàæäàíèòå, êîèòî áúäàò ïîêàíåíè, ñà äëúæíè â 7-äíåâåí ñðîê îò ïîëó÷àâàíå íà ïîêàíàòà äà ñå ÿâÿò ïðåä Êîìèñèÿòà è äà ïðåäîñòàâÿò ïîèñêàíèòå îò òÿõ ñâåäåíèÿ è äîêóìåíòè.

4. Èçïîëçâàíåòî íà ñïðàâî÷íèÿ àïàðàò è àð-õèâíèòå äîêóìåíòè íà îðãàíèòå ïî ÷ë. 1 ñå èçâúðøâà ñàìî ñëåä ïðåäâàðèòåëíî ðàçðå-øåíèå íà ïðåäñåäàòåëÿ íà Êîìèñèÿòà.

5. Ðúêîâîäèòåëèòå íà ñëóæáèòå çà ñèãóðíîñò ñà äëúæíè äà ñâàëÿò îò îò÷åò ñëóæèòåëèòå ïîä ïðèêðèòèå è ñúòðóäíèöèòå, çàåìàùè ïóá-ëè÷íà äëúæíîñò èëè èçâúðøâàùè ïóáëè÷íà äåéíîñò, è äà óâåäîìÿò Êîìèñèÿòà çà òîâà. Íåèçïúëíåíèåòî íà òîâà çàäúëæåíèå ñúùî ñå ñàíêöèîíèðà ñïîðåä ÷ë. 284 á îò ÍÊ.

The rules of procedure of theCDDAA BCSSISBNA is the second most im-portant document after the law regulating theactivity, structure, organisation of work and number of posts in the administration of the Committee. The rules define the membership requirements and powers of the Committee. The latter is a collegial body intended to implement the national policy on disclosing, announcing and preserving the documents of the State Security and the intel-ligence services of the BNA by means of:� finding, collecting, studying, analysing, apprais-

ing and preserving documents about the oper-ation of the State Security and the intelligence services of the Bulgarian National Army;

� determining and announcing affiliation of Bul-garian citizens to the State Security and the intelligence services of the Bulgarian National Army;

� administering the centralised archives;� delivering documents certifying the affiliation of

physical persons to the State Security and the intelligence services of the Bulgarian National Army;

� granting access to the archives;� engaging in research, document publication

and exhibition, conferences, etc.� cooperating with similar domestic and foreign

institutions;� publishing an information bulletin on a regular

basis;� submitting activity reports to the National As-

sembly on a semi-annual basis.

The Committee is represented by its Chairper-son, who is also in charge of the budgeting. S/he is responsible for managing the imple-mentation of resolutions and communicat-ing activities to the public through the mass media. The Deputy Chairperson provides as-sistance to and substitutes the Chairperson in his/her absence, while the Secretary ad-ministers ongoing activities. Members of the Committee are of equal status and act on its behalf in conformity with the LADDAABCS-SISBNA. The Committee meets to deal with

2. Specialised administration is involved in:� acquisition, preservation, digitalisation, res-

toration and conservation of archival docu-ments;

� coordination of the overall cycle of activities: search, study, analysis, appraisal and access granting as far as files are concerned;

� drafting of the resolutions of the Committee determining and announcing affiliation;

� research and production of documents for educational and information purposes;

� management of the contacts between the Committee and international bodies and in-stitutions.

When performing their operational duties, ad-ministrative employees act in accordance with the detailed internal rules of procedure.

The Committee’s structure of administration is di-vided into directorates, departments and sections. It is the objective of our dedicated staff of 103 employees, mostly young and highly motivated people, to further public knowledge on the reality of the past. This task is accomplished by means of acquiring and preserving the historical records of national secret services of the recent past, ensur-ing access thereto for researchers and the gen-eral public and engaging in awareness raising and publishing activities.

The issue of opening access to the archives of the former Bulgarian secret services was

raised in the wake of the democratic changes in the country. Many informal civil society organi-sations which emerged on the national scene at the end of the 1980s identified it as their priority to dismantle the heritage of the former State Se-curity. Their main interest was to take the names of political informants, who covertly reported op-ponents of the regime, out of the secrecy folders. The first mass democratic protests of the oppo-sition at the end of 1989 and the beginning of 1990 were mainly held under the motto ‘Expose State Security informers’. The secret files of the collaborators of State Security’s Sixth Director-ate (also known as political police) were among the hotly debated topics in the then-emerging free press. The subject remained relevant dur-ing the talks at the round table (January–May 1990).

It was at that time that the process of dissolution of the repressive organs of the State Security began. It mainly affected the institution of the political po-lice housed under the Ministry of the Interior and the military intelligence bodies of the People’s De-fence Ministry. By order of the Minister of the Inte-rior at the time, General Atanas Semerdzhiev, the damaging records kept at the ministry’s archives were largely destroyed.On 23 August 1990, under pressure from the public, the 7th Grand National Assembly estab-lished a seven-member committee presided over by Bulgarian Socialist Party MP Georgi Tambuev, tasked to investigate the archives and announce the names of State Security collaborators who were also members of the Grand National As-sembly. Tambuev Committee’s activity ceased before any results were achieved due to a series of publications in the Fax Newspaper announcing the names of 33 members of parliament, who had been collaborating with the Sixth Directorate of the SS. This was not an official document, but it raised a commotion and the process of opening the files of the former political police was brought to a deadlock.In 1992, action was taken against Reserve Gen-eral Atanas Semerdzhiev and Reserve General Nanka Serkedzhieva for destroying 144,235 files of the former State Security. On 13 December of that year, the retiring Prime Minister, Philip Dimitrov, issued Ordinance No. ÊÂ 215, which specified that members of parliament would be able to obtain a document from the Ministry of the Interior, stating whether they had collabo-rated to the former State Security. Certificates would be issued against a payment of 100 Bul-garian leva.In 1993, the 36th National Assembly, acting on pro-posal by Lyubomir Pavlov (member of the Union of the Democratic Forces and of parliament), adopt-ed Resolution No. 14, which read as follows, ‘the information on the methods, means and reports provided by SS agents for the time period until 13 October 1991, is not deemed state secret’. ate of the General Staff, adopted in 1997 by the 38th National Assembly, was the first of its kind. Having investigated the archives of the Ministry of the Interior, the committee, established by virtue of this law and presided over by the then Minister of the Interior General Bogomil Bonev, read the names of 23 politicians and civil servants who used to work for the former State Security before the National Assembly. Fourteen of them were members of parliament at that time. This law was not focused at lustration. However, it was not long before the powers of the Bonev Committee were hampered by force of Ruling No. 10 of the Con-stitutional Court. It was a decision which stated that, if a registration file is the only evidence left connecting a person to the former secret services (that is, if a person fell within the category of the so called indexed ones), announcement of affilia-tion would not be allowed.Four years later, in the year 2001, amendments were made to the Law on Access to the Documents of the Former State Security and the Intelligence Director-ate of the General Staff. The scope of examinations was extended to include the documents of the for-mer intelligence department of the Border Troops. Two new bodies were established in the place of the Bonev Committee: a seven-member permanent body, chaired by Metodi Andreev, and a non-perma-nent body with Chairman Georgi Ananiev. The latter could be summoned at the request of the chairman of the former and had the ultimate competence to determine affiliation to the former SS or the Intelli-gence Directorate of the General Staff. According to this law, the files remain in possession of the special services.On 30 May of that year, the Constitutional Court was once more approached by 54 members of parlia-ment who contested the legality of some passages of the new law. This time the Court passed a judg-ment that the law did not generally violate the Consti-tution, with the exception of a single segment, which was repealed accordingly. The Andreev Committee produced ten reports altogether, dealing with the announcement of affiliation of public figures. It had acted on the applications of 23,000 citizens and had examined 44,000 mayor candidates and municipal councillors, and 1,504 candidates for high positions.

Íà ìÿñòîòî íà Êîìèñèÿòà „Áîíåâ“ ñà ñúçäàäåíè 2 êîìèñèè: ïîñòîÿííî äåéñòâà-ùà 7-÷ëåííà ñ ïðåäñåäàòåë Ìåòîäè Àíäðååâ è âòîðà, êîÿòî íå å ïîñòîÿííî äåéñòâàùà, ñ ïðåäñåäàòåë Ãåîðãè Àíàíèåâ, êîÿòî ñå ñâèêâà ïî èñêàíå íà ïðåäñåäàòåëÿ íà ïúðâàòà Êîìè-ñèÿ è óñòàíîâÿâà îêîí÷àòåëíî ïðèíàäëåæíîñ-òòà íà äàäåíî ëèöå êúì áèâøàòà ÄÑ èëè ÐÓ íà ÃÙ. Ñïîðåä òîçè çàêîí àðõèâèòå îñòàâàò âúâ âëàäåíèåòî íà ñïåöèàëíèòå ñëóæáè.Íà 30 ìàé ñúùàòà ãîäèíà 54-ìà äåïóòàòè ñåçè-ðàò ïîðåäíî Êîíñòèòóöèîííèÿ ñúä ïî òåêñòîâå íà ïðèåòèÿ çàêîí. The Andreev Committee remained functional for less than a year. On 24 April 2002, the 39th National As-sembly passed the Classified Information Protection Act repealing the law on access to the documents of the former State Security. On 29 September of that same year, the Constitutional Court dismissed the claim of 57 members of parliament that the Clas-sified Information Protection Act violated the Con-stitution. That same month, the Supreme Court of Cassation sentenced General Atanas Semerdzhiev and General Nanka Serkedzhieva to imprisonment of four years and six months, and two years, respec-tively, on charges of destruction of SS files. On 6 December 2006, the 40th National Assembly adopted a new Law on Access on and Disclosure of the Documents and Announcement of Affiliation of Bulgarian Citizens to the State Security and the Intelligence Services of the Bulgarian National Army (LADDAABCSSISBNA). This was the outcome of a long and intense discussion with the involvement of the special services and the marked participation of the community. The nine-member committee pre-sided over by Evtim Kostadinov was elected by the National Assembly on 5 April 2007.Seventeen years after the changes, a national agreement was reached for the archives of the former secret services to be collected, preserved, stored and made public for the sake of history and remembrance.

The Committee provided a comprehensive ac-count of its activities during its first mandate in

a report presented at an international conference held in Sofia in February 2012.

I. Examination, determination and an-nouncement of affiliation

In compliance with the law, it is the priority of the Committee to announce the affiliation of Bulgar-ian citizens holding public positions or public func-tions to the SS and the intelligence services of the BNA. Official announcement of affiliation of public figures is preceded by mandatory examination as prescribed by law. More than 124,000 persons have been exam-ined for affiliation to the State Security and the intelligence services of the BNA from 2007 till the beginning of 2012. Persons registered to run in elections make up the highest share of manda-tory examinations – over 72,000, followed by for-mer or current holders of public positions or public functions – over 45,000.

II. Establishment of centralisedarchives

In compliance with legal requirements, the Com-mittee has established centralised archives to house the documents of the SS and the intel-ligence services of the BNA. Work commenced immediately on acquiring and putting together re-lated historical records. Meanwhile, the construc-tion of a modern site began in Bankya. The two buildings of the archives are end destinations and state-of-the-art shelving facilities that main-tain a controlled temperature and humidity envi-ronment, prolonging the useful life of the original materials.

III. Preservation of documents

All documents of interest are collected from the bodies referred to in article 1 of the applicable law and handed over to the Archives Directorate, comprising the Specialised Archives and Card-index Department (SACI) and the Acquisition and Preservation of the Archives Department (APA). Data files on secret collaborators, files of staff employees, archival diaries, registers and regis-tration diaries, files on operative targets, destruc-tion protocols, files on archive groups are kept at the Specialised Archives and Card-index Department. Archival files are kept safe at the Acquisition and Preservation of the Archives Department (APA). In this first period of stock-taking the centralised archives have become the end destination for 817,021 paper files of over 8,000 linear metres, 5,651 photographic negatives of documents, 5,353 documents in electronic form and 250 video recordings taken on 35-millimetre film for demonstration purpos-es. The number of items processed and depos-ited on the new storage premises is estimated to have reached more than two million paper documents within the first year following the opening of the centralised archives. Numbers increase when account is taken of information in electronic and analog format, negatives and remaining reference material.

The rising curve in the chart below illustrates the growing number of documents received at the archives over the relevant period.

The number of visitors to our reading room reached 7,697 by 20 February 2012. 12,635 applications requesting access to the files were submitted.

5,770 applicants have exercised their right to ac-cess the records centre under the Political and Civil Rehabilitation of Victims of Repressions Act.

The centralised collection of records draws in-creasing attention from the general public and experts alike. Reference aids and search mecha-nisms devised to facilitate information retrieval are made available for the specific purposes of research and study. Observations reflect a grow-ing appeal among foreign scientists and analysts to take a closer look at the historical facts. The archives became a source material for scholars and writers. V. Research and publicity of thearchives

In pursuit of the idea of wider publicity, the Committee launched its publishing efforts within the year follow-

ing its establishment. A Journey through the Archives of the State Security is a series of collections compiled of duplicates of original documents on a variety of top-ics. The public release of former secret files met with considerable interest from the public and mainly from researchers. These publi-cations were widely welcomed by the community and highly ap-preciated by the academia of his-tory. The first term of office of the Committee saw the publication of nine collections of records of the State Security and the intelligence services of the BNA: The KGB and the Bulgarian State Security

Service. Connections and Dependences; State Se-curity – Main Documents; The State Security and Changes in Bulgaria (September 1944–December 1947); International Terrorism in the Documents of the State Security; State Security – Political Police; State Security and Education; State Security and the Prague Spring; State Security and the End of Totali-tarianism; Military Intelligence under Communism. An extended selection of the researched materials was made available on DVD to supplement each of the above. More than 20,000 pages of documents have been published in the process.The Committee for the Secret Police Files has re-leased eight bulletins and two brochures to announce its decisions and report its activity, respectively. It was involved in the producing and pre-production of the documentary The Secret File on the State Se-curity.The Committee provided comprehensive accounts of its activities during its first mandate in ten activ-ity reports presented before the National Assembly, each received without significant comment.

I. Impact

The Committee will continue to successfully ful-fill its mandate under the commitment to main-

tain its present policy to operate independently of political interference and bias, and uphold impar-tiality. One year into its second mandate, the mem-bers of the Committee applied the highest levels of objectivity, neutrality, efficiency of work and competence. The Committee, through its commit-ment, has made a valid contribution to promoting the image of Bulgaria as an established modern European democracy under the rule of law. This collegiate authority aims to strengthen coopera-tion with its key partners on a national and com-munity level.The Committee’s objectives, principles and values are taken up in the new Development Strategy ad-opted for the period 2012-2017.

V. Mission

It is our mission to implement the strict require-ments of the applicable law in terms of:� determining and announcing affiliation to the

SS and the intelligence services of the BNA of Bulgarian citizens former or present holders of public positions or persons who have, now or in the past, performed public service;

� completing the transfer of the documents of the bodies referred to in article 1 of the law composed in the period between 9 September 1944 and 16 July 1991 to the centralised archive;� ensuring access to these documents.

In performing its tasks, the Committee aims at obeying not only the letter of the law, but the spirit of the law as well. The spirit of the law is contained within the phrase ‘The truth sets free’. It is our goal to further reduce opportunities for behind the scene interference, string pulling and intimidation of political actors through foul play and intentional misuse of documents of the State Security and the BNA intelligence services for harmful purposes, thus ensuring transparency in the political arena and revealing the identity of those setting up the standards of morality in society. Enhancing the performance of the Committee is essential, if the long-term objectives set by our in-stitution are to be achieved. It has therefore been placed highest on the list of priorities for the 2012–2017 mandate. Efforts will be narrowed down to three priorities: archives, research work, promo-tion of the archives and service to citizens.

records allow;� completing the transfer of card indexes of

the National Intelligence Service at the First Head Directorate of the State Security relat-ing to collaborators and operative targets;

� completing the transfer of the reference aids of the Military Information Office under the Minis-try of Defence.

� carrying out restoration, digitalisation and conservation activities with respect to the ar-chives.

Research and publicity of the archivesIt is this mandate’s priority objective to shape the foundations of a future Institute for National Re-membrance by taking forward to implementation the following tasks: � carrying on the publication of documentary

collections from the series A Journey through the Archives of the State Security by releasing declassified originals on topics of economic and social relevance. As a step in implement-ing this agenda, in 2012, the second mandate saw the publication of the collection of docu-ments under the title The State Security and the Jewish Community in Bulgaria;

� commencing preparation of education and public awareness exhibitions intended to pres-ent an overall picture of the methods and prac-tices of the former secret services by way of photographs and text. A thematic exhibition on the decade following Stalin’s death, the chang-es in Eastern Europe and the turning points in the nature of the Cold War is planned to that end;

� extending the network of partnerships with state institutions, non-governmental organisa-tions and the academia within the framework of joint large-scale projects. The first step has already been taken by signing a new Frame-work agreement with the Sofia University St. Kliment Ohridski;

� concentrating efforts on promoting the re-search, exploration and analysis of the documental heritage kept at the centralised archives of the Com-mittee through a vari-ety of new initiatives. Preparations are un-der way to organise a week-long film lecture on the topic of The Presence of the State Security in the Cin-ema, set to take place in 2013;

� diversifying participa-tion in a growing num-ber of public events, conferences and seminars at home and abroad;

� upholding the tradition of organising internation-al conferences on a vari-ety of topics reflected in

documents from the archives;

� keeping the website of the Committee up to date and seeking maximum public exposure on every step of implementation of the applicable law. The website has been upgraded to include an advanced English version. Suggestions on extending the scope of information and creating new modules are under consideration.

Service to citizensIn pursue of added possibilities to further extend access to the documents of the State Security and the intelligence services of the Bulgarian National Army to a wider audience, the Committee suc-cessfully achieved its priorities to:

The Committee has taken it upon itself to con-duct its work in the spirit of openness and in co-

operation with state institutions, non-governmen-tal and public organisations. While the Committee is a frequent promoter of a rich variety of repre-sentative international conferences, its members are regular participants in scientific forums, dis-cussions and events home and abroad. The Com-mittee has set up a platform for researchers and opinion-makers to investigate the legacy of the former secret services in the light of the documen-tary evidence it left behind. A significant aspect of the Committee’s activities is the close cooperation with the academia. Bilateral agreements for col-laboration in research work and joint analysis of the documents of the archives have been signed with the Sofia University and the New Bulgarian University. These cooperation activities include a comprehensive mix of research, education, pro-motion and administration activities pertaining to the processes of exploration, processing, digitali-sation and dissemination of the documentary heri-tage. In 2013, work has also started on a common project to be implemented by the Committee and its reliable partner in the face of the Archives State

Agency. The initiative is scheduled to end with the publication of a collection of documents and a dis-play exhibition. A number of other shared initia-tives to be carried out together with the Bulgarian National Film Archive are underway. The Committee for disclosing the archives of the Bulgarian communist secret services of the past has attracted wide international attention from the very beginning. On 16 December 2008, it joined its array of partners from former Eastern Bloc countries to become one of the founding member organisations of the European Network of Official Authorities in Charge of the Secret-Police Files consisting of seven member countries (Bulgaria, Germany, Po-land, Romania, Slovakia, Hungary and the Czech Republic) and four observer countries (Estonia, Latvia, Lithuania and Slovenia). Participation in the European Network will broaden the options of its member states to develop the focus on the social and public significance of the opening of the files, legally certain access thereto and independent re-search. Between July 2011 and February 2012 the CDDAABCSSISBNA held the presidency of the

European Network of Official Authorities in Charge of the Secret-Police Files. The Committee’s primary task for the 2012-2017 mandate is to concentrate its international efforts and future operations to continue to collaborate with partner organisations from the European Network of Official Authorities in Charge of the Secret-Police Files and actively participate in joint partnership ac-tion. The Committee is taking steps to apply for the presidency of the European Network (which is based on the rotation principle) for a second time.

The Committee has set itself the objectives of:� participating in research initiatives and pro-

grammes of partner organisations;� engaging in joint projects;� taking part in public forums and events promoted

by its international partners from the European Network;� encouraging its members to participate as speak-

ers in international science meetings;� extending international cooperation to other non-

member countries of the European Network.

When, in 2008, the Committee assumed its active duties the attention of the public was not greatly

excited with the topic of the secret files. Doubts and suspicions of the role and function of the newborn in-stitution took the upper hand. It was rather a matter of public skepticism than politically driven lack of confi-dence. A whole variety of reasons were at play. There were, on the one hand, hesitations on the credibility of information and legitimacy and integrity of the archives, and, on the other hand, doubts whether all collabora-tors of the former State Security would be brought out in the open. General fears were constantly played on by the statements of elected political figures, analysts, persons already examined or pending examination. The Committee was perceived as an instrument in the hands of authority figures to be twisted and ma-nipulated to the benefit of political power actors. Mere 17% of the participants in the survey expressed any interest at all in the dealings of the Committee for the Secret Police Files. Meanwhile, public opinion and at-titudes were, as a whole, in favour of the legislation governing its operations. 44% of poll participants took a positive attitude towards the public announcement of affiliation to the communist secret and intelligence services for all public figures, while 25% objected the idea. The percentage of people with no opinion on the subject was standing at a relatively high 31%. One year later, in 2009, analysts were already of the opinion that the work of the Committee is recognised as a worthy mission and a significant historical contri-bution. The sense that things are finally coming into place had generated a 6% drop in the level of distrust towards the Committee over the period of one year. Within the same time interval, opinions solidified and stable attitudes were formed towards the announce-ment of affiliation of all public figures to the communist secret and intelligence services. Half of Bulgarians demanded a lasting solution to the problem.The bias towards the Committee, manifested in the assumption that its work is used to the prejudice of the national interests and jeopardises national security, is on the decline. This is a direct result of the working methods adopted and practiced by the Committee so far, as well as the teamwork and partnership between its members.According to a large portion of poll participants inter-viewed in 2009, the Committee needed to exert maxi-

mum effort to build an archive for the files of the former secret services, which would go down in national his-tory as an important documentary contribution. More-over, support for this idea pointed to awareness of the importance of preserving historical memory for gen-erations to come and of the significance of ‘a solid evi-dence base’ for the treatment of the issue. A reminder of our most recent history, secret police files are not an issue to remain vague and, above all, unresolved for the younger generations of Bulgarians. However, it did not prove easy to involve young people with the subject, attract their attention and provoke their inter-est at a time when the process of investigating and announcing affiliation is still underway. The interest of members of the Bulgarian community in the business and decisions of the Committee con-cerning public figures of the day, continued to further increase in 2010. The Committee made itself more

landscape, enhance its image in the public eye, and achieve two-way communication with the wider audi-ence. The share of respondents convinced that full disclosure of the identity of all public figures formerly affiliated to the state security services is the way to go is high and growing. This further indicated a steady increase in public approval rates for the Committee, its proceedings and the outcome thereof.Bulgarian society was warming up, albeit slowly, to this idea of publicity and was beginning to recognise and accept the image of the Committee for the Secret Police Files and acknowledge the effects of its work. Permanent and, above all, positive changes in pub-lic sentiments were taking place at a slow pace to a lasting effect. Perceptions of the Committee as law-abiding institu-tion acting in strict compliance with the rule of law and avoiding tension and conflicts remained unchanged over the years.Halfway through the first mandate, the consciousness of the public was still occupied primarily with concerns about the ethical implications of judgements. Those were all questions concerning moral and ethical stan-dards which had to be addressed to a satisfactory con-clusion. This would involve discussions on fundamen-tal moral principles where account would be taken of the activities of the Committee in the context of more universal ethical questions facing modern societies.The positive change taking place in the mentality of the general public, as regards matters within the scope of competence of the Committee, is taking place slowly but surely to become a permanent state of mind. The ethical implications of judgements remain a major concern for the public. These are all questions con-cerning moral and ethical principles which remain to be dealt with in search for satisfactory answers.In the beginning of 2012, 23 years since the onset of democratic changes, some 48% of Bulgarians hold the opinion that the former State Security was a re-pressive apparatus. Other respondents find this de-scription to neither fit, nor describe the modus ope-randi of the former services of the State Security. The number of the latter is five times less than the number of the former.Bulgarian society is experiencing a steady increase in the numbers of citizens insisting that affiliation of all public figures to the former state security services

sion and activities when facts could be presented in a calm and reasonable manner, interpretations of events would not trigger disturbance and commotion, and the archives would ensure a prominent place for the secret police files in recent history. Thus, the new generations became increasingly aware and informed about a wide range of topics. The performance of the Committee for the secret po-lice files has received generally rather positive assess-ments over the years. The Committee is recognised for its efforts to raise public awareness and attention to the topic of the secret files by one-fourth of Bulgar-ians participating in the survey. This represents a 10% increase in the recognition of its status since its estab-lishment. According to results of the 2008 polls, the number of respondents maintaining the opinion that the Committee is failing in its duty to engage the atten-tion of the public and promote the topic was twice the number of poll participants insisting on the exact op-posite. The tables are reversed now. An equal number of respondents feel positive and negative about the impact of the Committee. About two-thirds of those closely following its proceedings acknowledge the accomplishments and role of the Committee in raising awareness and enhancing the popular-ity of the topics on its agenda.Online visitor traffic to both the website of the Commit-tee and specialised online news media on the subject has increased over the recent years. This trend has highlighted the need and demand for trusted sources of reliable information.In the beginning of the second mandate of the Com-mittee nearly one-third of Bulgarian citizens declared approval of potential changes to the relevant legis-lation on the secret police files. 25% were looking forward to see the scope of examined persons extended, a development brought about by the lat-er amendments to the law. Older generations who shared the view believed that before turning this page of history, we need to read it in a loud and intelligible voice. A safe assumption can be made that the ease of use and access to this kind of information will shape the awareness of young generations of the history of secret police files.
