Vancouver SunEvan Duggan, 604605-2297, [email protected] Service Issues - Downtown Vancouver

Background: Reporter notes that many outlets sold booze to people all day long which fuelled the riots. He hasspoken to Ian Tostenson with the Be Restaurant and Foodservices Assoc.

Questions:Who is in charge of liquor store closures? Is it time to revisit or think about closing restaurants and bars during big events?Do you feel confident that licensees were managing their l iquor sales/service obligations properly? Is there going to be a review of what happened? What does the lCLB th ink wentwrong? What does lCLB think needs to be done to move forward?Suggested Response:

The authority to order early closure rests solely with the Liquor Control and LicensingBranch general manager under the Liquor Control and Licensing Act.

Like all other agencies with a related role or responsibility, we wil l be receiving

information and feedback from staff and others. Once we have a clear picture we wil l assess what steps we took and consider what

steps may be taken in future fo.r these types of events. We are committed to working with our partners to do what we can to make sure

    similar events aren't repeated.

Thanks. I think that everyone was expecting the closures - that's certainly the response that staff who delivered theletters received from the stores. It does present more of a challenge for the police, as those coming into the core wil l bemore motivated to BYOB.We have had a few questions about liquor off-sales and whether they were shut down as well. They are not, but we dohave a contingency plan in place so that if one or more off-sales become a problem, we will be able to act qUickly toclose that location.Karen

Surprisingly quiet today on the Liquor Store Closure matter, no media calls on it at all. Media were more interested inthe Minister commenting on police preparations and we had a question on the overall increase in liquor sales revenueon game days.

    .....RITISH

    COLUMBIA

    June 14, 2011

Dear licensee,Further to my letter of June 13, 2011, large capacity crowds are expected again tomorrowevening in the downtown core of Vancouver to attend public events spaces and to viewthe final game of the Stanley Cup series. Based on the experience during the series, andthe information provided to me, I have concluded that there is a real and serious threat topublic safety tomorrow evening from public consumption, intoxication levels and publicdisorder that would be facilitated by the purchase of liquor from liquor retail outlets in thearea,The early closure of both public and private liquor stores last evening was one of a numberof strategies employed to minimize access and consumption of alcohol on the streets, andto address the pUblic safety risks, By all accounts, the early closure of liquor stores had asignificant and positive impact on consumption, intoxication levels and public disorder.Under section 6 of the LiquorControl and Licensing Act, the General Manager has astatutory duty to supervise the conduct of all licensed establishments, Under section 23 ofthe Act, the General Manager may suspend or impose conditions on a licence for a periodnot exceeding 24 hours if, in the opinion of the General Manager, it is in the public interestto do so, Based on the information provided to me, I have concluded that it is in the publicinterest to close liquor retail stores early, consequently I am imposing a term andcondition on your retail store licence that the store must close at 4 p.m. onWednesday, June 15th, 2011, rather than 11 p.m. as indicated on your liquor licence.Government liquor stores will close voluntarily at 4 p,m. as well.

Further to my letter of June 13, 2011, large capacity crowds are expected again tomorrow evening in the downtowncore of Vancouver to attend public events spaces and to view the final game of the Stanley Cup series, Based on theexperience during the series, and the information provided to me, I have concluded that there is a real and seriousthreat to public safety tomorrow evening from public consumption, intoxication levels and public disorder, that wouldbe facilitated by the purchase of l iquor from liquor retai l outlets in the area,The early closure of both public and private liquor stores last evening was one of a number of strategies employed tominimize access and consumption of alcohol on the streets, and to address the public safety risks, By all accounts, theearly closure of liquor stores had a significant and positive impact on consumption, intoxication levels and publicdisorder,Under section 6 of the Liquor Control and Licensing Act, the General Manager has a statutory duty to supervise theconduct of all licensed establishments, Under section 23 of the Act, the General Manager may suspend or imposeconditions on a licence for a period not exceeding 24 hours if, in the opinion of the General Manager, it is in the publicinterest to do so, Based on the information provided to me, I have concluded that it is in the public interest to closel iquor retail stores early, consequently I am imposing a term and condition on your retail store licence that the storemust close at 4 p.m. on Wednesday, June 15th, 2011, rather than 11 p.m. as indicated on your l iquor licence,Government liquor stores will close voluntarily at 4 p,m, as well. Please be assured that I am acutely aware of the sales and business impacts an earlier closure has on your licensee retailstore business and on your customers, however I must balance that consideration with the overriding need to protectpublic safety and the public interest in the sale and consumption of liquor,Sincerely,Etc,Karen AyersAssistant Deputy Minister and General ManagerLiquor Control and Licensing Branch(250) 952-5791

Page A09By Ethan BaronI don't believe injinxes. So, with the Stanley Cup final down to Game 7 right here in Vancouver onWednesday, I'll go ahead and tell you what emergency personnel have been saying: Hockey crowds have so farbehaved very well.Vancouver police spokeswoman Const. Jana McGuinness must not believe in jinxes either. I asked her ifthe highest-stakes-of-all game on Wednesday was going to put police on a heightened footing."We're prepared for anything," McGuinness said.McGuinness has reason to express confidence, and risk that potential famous-last-words evaluation ofthe force's level of preparation. Although public drinking has been rampant -Vancouver and transit copspoured out liquor nearly 3,000 times on Game 5 night Friday -police have had no serious incidentsrelated to the Cup, McGuinness said."We've seen relatively few problems apart from the open drinking," McGuinness said. "We've been verybusy with street disorder. We're dealing with alcohol-fuelled fights in the later hours of the night."The level of mayhem, however, has not been drastically different from that occurring on some summer nightsin the downtown entertainment district, McGuinness said. When 100,000 revellers took to the streets Friday, police arrested 24 people and issued 120 tickets. Some ofthose apprehended and cited had been fighting, but McGuinness could not provide a specific number related toviolent incidents. The 5 p.m. start times have had a positive effect on the downtown atmosphere, said Vancouver police crowd-control unit Sgt. Matt Clarke. "It makes a more diverse crowd, all ages, and it's more fun," Clarke said. "Youget families coming down. There's genuine excitement about the hockey."Paramedics have been attending to a variety of medical issues among Cup throngs, said B.C. AmbulanceService spokeswoman Kristy Anderson."What we've been seeing are what you sort of normally see in crowds: the slips and falls, rolled ankles on thesidewalks, sick people, fainting," Anderson said."We really have been seeing great crowds and people have generally been well-behaved. It's been a goodexperience for us."Proprietors of two Granville Street nightclubs behaved quite badly, according to the Vancouver FireDepartment. Both had received verbal warnings after fire inspectors found their premises over legalcapacity on the night ofthe first Cup game June 1.On Friday night, inspectors found the two clubs had almost double the number of permitted patrons, said Les SzikIai, deppty chief of fire prevention for the Vancouver Fire Department. "One of [theproprietors) said, 'Well, uh, a bunch of people came and they wanted to come in. How could I turn themdown?'" SzikIai said. "Itwas unacceptable."The club owners face fines up to $100,000, he said.

Wednesday, of course, could change the crowd dynamic significantly, particularly if Canuck fans' hopes for aStanley Cup victory are crushed, and drunkenness and disappointment boil over into violence.Police are hoping the Canucks take the Cup, though it would mean a very long night."With a win, it'l l be dusk to dawn for crowds," McGuinness said Monday near the downtown outdoor-viewing areas. "We'll be out here working till the sun comes up."Karen AyersAssistant Deputy Minister and General ManagerLiquor Control and Licensing Branch(250) 952-5791

Large capacity crowds are expected this evening in downtown Vancouver as a resul t of the VancouverCanucks Stanley Cup run. LCLB staff, VPD, and the BC Ambulance service have reported escalating crowds andpublic disorder in an ascending scale since the playoffs began. For this past Friday night's game, VPD reported2,300 l iquor pour outs and the Greater Vancouver Transit Authority reported over 800 l iquor pour outs.Given there is a real and ser ious threat to public safety this evening from public consumption, intoxication anddisorder, I have ordered private l iquor retail outlets in downtown Vancouver and the West End to close at 4pm. Government liquor stores, VQA and independent wine stores are closing voluntarily at the same time.

June 13,2011Dear Licensee,Large capacity crowds are expected this evening in the downtown core of Vancouver toattend public event spaces and celebrate the Vancouver Canucks Stanley Cup run. TheVancouver Police (VPD), my staff, and the BC Ambulance Service report escalatingcrowds and public disorder in an ascending scale since the hockey playoffs began. Forthis past Friday night's game VPD report 2,300 liquor pour outs and the GreaterVancouver Transit Authority report over 800 liquor pour outs.VPD and my staff say the demographics of the crowds are younger and less familyfocussed leading up to, during and especially after the game than what was experiencedduring the Olympics. My staff have reported numerous and continuous incidents ofimpaired minors. Both agencies describe the crowds around liquor stores as chaotic.Especially troubling are incidents of bootlegging where liquor is being purchased fromlicensee retail stores and is immediately being resold to minors for public consumption. The pre-game, game time, and post game purchases of l iquor by those who have alreadyconsumed as a means to refuel is of significant concern. Police report impairedindividuals going through the crowds and indiscriminately assaulting individuals. BCAmbulance Service reports that they were unable to do their work at the levels necessarydue to the crowds and incidents of intoxication. VPD also report post game levels of grossintoxication and public disorder of the same nature that has led to violence in the past.As a result ofthe above, I have concluded that there is a real and serious threat to publicsafety this evening from public consumption, intoxication levels and public disorder thatwould be facilitated by the purchase of liquor from liquor retail outlets in the area.Authorities are employing various strategies to minimize access and consumption ofalcohol on the streets, and to address the pUblic safety risks. During the Olympics, by allaccounts, the early closure of both public and private liquor stores had a significant andpositive impact on consumption, intoxication levels and public disorder when there was anequivalent risk to public safety. Arguably the risk may now be even greater.

Unfortunately, LDB posted a notice to their website informing their customers that they would be closingtheir downtown stores at 4 pm, and they attributed it as due to a request f rom the VPD. They've sincecorrected tha t but VPD is asking that we put out a statement to clarify who's decision it was to shut storesdown early, as they have received 20 to 30 calls. I know we wanted to avoid doing a proactive release inadvance, bu t the horse has lef t the barn. on Friday and we have a responsibility to ensure everyone can enjoy public events and celebrations in a safemanner. The Liquor Control and Licensing Branch received information from, and consulted with, provincial liquorenforcement staff, Vancouver Police, the BC Ambulance Service and Vancouver Coastal Health. The generalmanager of the Liquor Control and Licensing Branch has concluded there is a real and serious threat to publicsafety from the public consumptiori of alcohol, intoxication levels and public disorder. Therefore, the generalmanager has ordered that the 6 public and 13 private liquor stores in downtown Vancouver close at 4 p.m.today. This was done during the Olympics and there was an immediate reduction of alcohol-related violenceand disorder. The decision to close liquor outlets early is made on a day-by-day basis and the decision is not taken lightly. We are aware of the inconvenience for customers and the impact on the businesses that must close early. However, protecting public safety must be our overriding concern.Police will be out early to meet the crowds coming into the downtown core. Officers will be concentrating onliquor enforcement at SkyTrain stations, the Georgia Street fan zone and in the Granville Entertainment Districtthroughout the evening.Let's show the world once again that British Columbians know how to celebrate in a safe and responsiblemanner.

BACKGROUND:The general manager of the Liquor Control and Licensing Branch, afterspeaking with the Vancouver Police Department, reps from BC AmbulanceService and St Paul's Hospital, is ordering all liquor stores in downtownVancouver and the West End to close at 4 p.m. on Monday, June 13, 2011 - bothpublic and private stores. The authority to order early closure rests solely with the general manager underthe Liquor Control and Licensing ActThe decision to adjust store hours is made under section 23 of the Liquor Controland Licensing Act which gives the General Manager of the Liquor Control andLicensing Branch the power to temporarily suspend or impose conditions on aliquor licence for up to 24 hours where it is in the interest of public safety to do so.The decision to order liquor stores to reduce their hours is made on a day-to-daybasis.

During the Olympics the general manager exercised the authority to temporarilyalter the terms and conditions of licensee retail stores by ordering them to closeearly on four days.Process for altering the terms and conditions of l icensee retail stores:If, based on information from local liquor inspectors and/or the VPD, the LCLBgeneral manager determines that an extraordinary situation exists wherepublic safety is at r isk and reducing the hours of liquor retailers indowntown Vancouverwill help protect public safety, she will draft a writtennotice of the change of the terms and conditions of the liquor licence and localinspectors will hand-deliver the letter to each liquor retailer that is affected. The temporary change to l iquor store hours of operation will be in effect forthat day only. The general manager will assess the situation on a daily basis todecide if public safety remains in jeopardy and therefore warrants additional earlyclosures.
