BAYSHORE/GATEWAY TRIANGLE COMMUNITY REDEVELOPMENT LOCAL ADVISORY BOARD MINUTES OF THE DECEMBER 3, 2019 MEETING

The meeting of the Bayshore/Gateway Triangle Community Redevelopment Advisory Board was called to order by Chairman, Maurice Gutierrez at 6:05 p.m. I. Roll Call: Advisory Board Members Present: Maurice Gutierrez, Dwight

Oakley, Steve Main, Al Schantzen, Steve Rigsbee, Larry Ingram, Karen Beatty and Michael Sherman. Camille Kielty Excused Absence. CRA Staff Present: Debrah Forester, CRA Director; Tami Scott, Project Manager, Shirley Garcia, Operations Coordinator.

II. Pledge of Allegiance: The Pledge of Allegiance was led by Chairman Gutierrez.

III. Adoption of Agenda: Steve Main made a motion to adopt the agenda as

amended adding VI e. Isles of Collier update as Maurice Gutierrez requested. Al Schantzen seconded the motion, passed unanimously.

IV. Approval of Minutes: Steve Main made a motion to approve the minutes, Mike Sherman, seconded the motion. Passed unanimously.

V. Community / Business - Presentations

VI. Old Business:

a. South Bayshore Drive Cleanup- Ms. Forester mentioned the Community Cleanup held on November 16 and noted it was very successful and the option to do more clean ups in the neighborhoods including the gateway triangle area. She thanked Al Schantzen for attending. Ms. Forester expressed her gratitude to Solid Waste and Code Enforcement for assisting with the dumpsters and volunteering their time. Al Schantzen and Karen Beatty wanted to send out their thanks specially to Code Enforcement for doing a great job.

b. Public Master Plan Update. Ms. Forester provided an update on the public arts master plan and mentioned it would be presented to the Board at the December 10th Board of County Commissioners agenda. She noted the minor change to the Scope of Services which added another presentation to the Board of County Commissioners which added $300 to the total. Ms. Forester mentioned that if the Board approves the plan, the information gathered from the Public Arts Plan will provide insight into the Branding efforts discussed last month. She will meet with the Paradise Coast marketing company in January to discuss the scope of work for branding the

two areas – Bayshore and Gateway Triangle. Maurice Gutierrez asked if the County Master Plan would be ready in January but Ms. Forester thinks it will be ready in February. Karen Beatty mentioned that Laura Burns would be a good person to discuss the 17acre site, Ms. Forester mentioned that we could put it on the Joint Meeting and maybe have Ms. Burns attend and discuss it then.

d. January 7, Joint Meeting – Ms. Forester reminded the Advisory Board that

the MSTU’s will be attending the January 7th joint meeting but wanted to ask if the meeting can start at 5pm per the request of the Haldeman Creek Advisory Committee. All the Board members were good with starting at 5pm.

e. Isles of Collier – Minto Update Ms. Scott wanted to update the board and community that the project manager of Mintos would be attending the next CRA meeting. She wanted to give everyone time to get all their questions and concerns written down before the meeting, so they have the opportunity to get some of the answers they needed. Maurice Gutierrez asked if part of the development is in MSTU boundary and part of it is not, should the whole development get included into the boundary since they will have the benefit of egress into Bayshore. Mr. Gutierrez mentioned his concern on who will pay for the road due to traffic impact because of the development. Ms. Scott wanted to recommend that they keep an eye on their traffic impact statement when they submit it and make sure that it reflects the true impacts that it will have on the Street. Steve Main thinks they should have only emergency vehicles enter in and out of the South Bayshore entrance not the entire development. Ms. Forester wanted to mention they as an advisory board they can recommend these changes to the planning commission and the Board of County Commissioners who approve these projects.

VII. New Business: a. CBIG Application- 6023 Bayshore Dr. - Ms. Forester provided the

application for the Commercial Improvement for 6023 Bayshore Dr, the Popcorn Shop. The improvements would allow the Popcorn Shop to have some security shutters since the business has been broken into 3 times. The glass and doors have been broken and the improvement would allow some extra security for the business. Ms. Forester went through the cost estimates. Karen Beatty made the motion to approve the grant, Mike Sherman seconded the motion. The motion passed unanimously.

a. Project Manager Report: Tami Scott highlighted a few projects on the

list, Sabal Shores Traffic Calming count was completed for the out of season count, Thomasson Dr project is on track. Under Commercial Activity there are new businesses that are coming, a design showroom that does interior design is next to the American Legion on Tamiami Trail, Bayshore Wine Venue, will be on the vacant lots next to the daycare on Bayshore Dr. This development will be Rebecca Maddox new project. A boutique gallery to be located on Bayshore has not submitted anything yet but the owner did meet with staff about applying for the CBIG. Naples Botanical Garden is building a horticultural recycling center, this is an amendment to their existing plan they submitted. Naples Beach Brewery rented a building in the Gateway Triangle on Linwood and will be renovating the old building. MHK purchased the Coliseum and will be putting his new architectural office in there. Woodspring Suites should be open sometime in December, Racetrak has opened already, Food Truck parking lot is close to completion, Steve Rigsbee requested an update on the Hookah Lounge, stating there has been no activity and there is more garbage in the lot and no one maintains the property so he has concerns for the street. John Johnson, Code Enforcement, stated he would review. CRA Parking lot, submitted the site plan and have received one set of comments and resubmitted and still waiting for additional comments to come back, Meridian Landings will not be able to attend the January 7th but will attend the February CRA meeting. In December, the Transportation Department will set up 2 speed stands for two weeks that will detect the speed for the cars on the Bayshore Drive. Maurice Gutierrez asked again how to lower the speed limit on Bayshore Dr, Ms. Scott will check and have the information on the January meeting.

b. Financial Report: Ms. Forester provided the financial report and noted some adjustments to the line-item budgets adjustments to cover other contractual services and remove money from office rental since we no longer pay rent for office space. There will be a budget amendment in the future to cover the Crown Castle final payment and the parking lot construction.

c. Maintenance Report: The maintenance report was provided for Nov-Dec, Ms. Forester went over the report. Karen Beatty asked about the sign on Coco and Basin and wants them to be replaced. Ms. Garcia will send a request to transportation to replace the sign.

d. Transit Subcommittee October 31 Summary Minutes- Ms. Forester provided the summary minutes from the transit meeting, the survey created by the PTNE staff was reviewed and asked if there were any other recommendations for the survey, hearing none the staff will continue to work with the subcommittee to finalize.

A. Collier County Code Enforcement: Al Schantzin asked about the

building at the corner Coco and Bayshore Drive. Ms. Garcia stated that Mr. Bowein, the owner, contacted the CRA office and asked about incentives to repair the building and the process to apply for a CBIG grant to renovate the building and parking lot. John Johnson provided a report for the community that identifies the code cases for the last 60 days. Closed case list and open cases specifically for the Bayshore area. Karen Beatty asked about a double lot on Coco Ave where someone is illegally dumping on the lot and Code is working with the owner of the lot. There were a lot of questions on some properties of concern, Mr. Johnson will drive by and take a look at some of their concerns.

B. Collier County Sheriff’s Office: no representative attended.

X. Communications and Correspondence: a. Paradise Coast Blueway Paddling Festival – A flyer was provided for

anyone interested in attending the paddling festival held at Sugden Park on December 8th. b. Small Business Administration – Hurricane Dorian Disaster

Loan – Information on small business loans available for any business who had to close during the Hurricane Dorian preparedness was provided along with contact information.

XI. Public Comments: Alex McEwing wanted to find out if Isles of Collier is asking for more exits and entrances off of Bayshore and Ms. Scott has not seen the plans yet so she will look at the request when they submit. She stated at this time what is approved is one off of Bayshore Dr and one access point off of Hamilton Ave.

XII. Staff Comments: none XIII. Advisory Board General Communications: Karen Beatty mentioned the

events the Bayshore Arts and Business Association on promoting for the holiday season and encouraged everyone to participate - Christmas Parade on December 10th in downtown Naples and Christmas Caroling on Bayshore Dr on December 14th, to meet at Sicilia at 5pm and bring a flameless candle. Steve Main requested double sided packets in their advisory board books to save costs on paper.

BAYSHORE BEAUTIFICATION MSTU MINUTES OF THE DECEMBER 4, 2019 MEETING

The meeting of the Bayshore Beautification MSTU Advisory Committee was called to order by Chairman Maurice Gutierrez at 5:00 p.m. at the Naples Botanical Garden, 4820 Bayshore Drive, Naples, FL 34112. I. Roll Call: Advisory Board Members Present: Chairman Maurice Gutierrez, Susan Crum, George

Douglas, Sandra Arafet, Sheila Dimarco, Robert Messmer and James Bixler. MSTU Staff Present: Debrah Forester, CRA Director; Tami Scott, Project Manager; Shirley Garcia, Operations Coordinator;

II. Pledge of Allegiance: Led by Chairman Maurice Gutierrez.

III. Adoption of Agenda: Bob Messmer made a motion to accept the Agenda. Second by Sandra Arafet.

Passed Unanimously.

IV. Adoption of Minutes: November 7, 2019 Minutes was presented, Sandra Arafet made a motion to pass the Minutes as amended. Second by George Douglas. Passed Unanimously.

V. Landscape Report:

A. Update on Landscaping—Aaron Gross, Ground Zero Landscaping— Aaron Gross gave his landscaping report, the plants were fertilized, the irrigation had a main break and the north side of the celebration food park. Mr. Gross will lay down the mulch as soon as staff can send him the PO to purchase. The Bougainvillea’s on the bridge are doing well and has some color, the other plantings also have some new color coming in. The banners are up.

VII. Old Business:

A. Thomasson Dr Update- Tami Scott provided the update and the legal ad was provided to the Committee that it went out to bid and due back on December 17, 4 contractors bid on the job.

B. North Bayshore Renovation project update- Mike McGee attended to provide a base plan and now it is in the design phase. Mr. McGee provided 3 alternatives for the Committee to look at, no decisions need to be made tonight but looking for a general idea on what the Committee likes. Mr. McGee shows the existing conditions with some updated sections some of the changes could be new pavers or colored concrete instead, west side of the road there are existing trees on the back of the curb and on the backside of the sidewalk, the existing trees are causing damage, lifting up the sidewalk. The Option A is taking the whole area from the back of the curb and going to the right of way, there is 11.68-foot-wide area that could have a widened sidewalk. That would

mean taking out the trees that are causing damage. There would be a need to do a landscape agreement with the property owners along the way. The lighting fixtures would not be contiguous, and he shows how they would look on the design. Option B, replacing all the utility covers with clay type material and removing all the hedges and shrubs, some of the discussions were asking what would be planted or replaced with the old trees that were removed. Ms. Forester asked if he put in a 10 ft. wide sidewalk would he be able to use the 1 ½ foot wide to straighten out the path and not zig zag. Maurice asked if they put lights in the medians would the MSTU be able to get rid of the Cobra Lights that are on the street and Mr. McGee said yes. Ms. Scott asked about the sidewalk and what material would they like to have, painted concrete, regular concrete or the decorative pavers. Option A provides a way for bikers to ride on the sidewalk and the street, option B provides a wider sidewalk but no bike lanes on the road. The committee was not interested in option C.

C. Holiday Lights Update- Two Quotes were received; Option 1 Holiday Decorations plus leaving the white lights on the Palm trees for 12 months: First quote: $11,900 and Second Quote: $224, 837. Option 2: Holiday decorations and white lights on Palm Trees through season First Quote: $8.900 and Second Quote: $104,887.28. After discussion, Motion to approve Option 1 for $11,900 made by Sandra Arafet , seconded by Sheila Dimarco. Passed unanimously.

D. January 7th Joint Meeting-time confirmation- Debrah Forester wanted to confirm the joint meeting and ask if 5pm starting time would work for everyone since CRA and Haldeman Creek already agreed to the time. There was a unanimous consensus.

Mintos will be coming in the January 7th, joint meeting to present and Ms. Scott recommends everyone get their questions ready for that. a design showroom that does interior design is next to the American Legion on Tamiami Trail, Bayshore Wine Venue, will be on the vacant lots next to the daycare on Bayshore Dr. This development will be Rebecca Maddox new project. C. Maintenance report: The maintenance report was provided for review, Ms. Forester noted the few stop signs that needed to be replaced and trip hazards that are still being monitored.

X. Correspondence and Communications: A. Paradise Coast Blueway Paddling Festival – A flyer was provided for anyone interested in

attending the paddling festival held at Sudgen Park on December 8th. B. Small Business Administration – Hurricane Dorian Disaster Loan – An application for

any business who had to close during the Hurricane Dorian preparedness was provided to anyone needing a small business interest loan if they had to close and lose any business during the week of the storm.

HALDEMAN CREEK MSTU MINUTES OF THE NOVEMBER 7, 2019 MEETING

The meeting of the Haldeman Creek MSTU Advisory Committee was called to order by Chairman Jack Bonzelaar at 4:35 p.m. at the CRA Office, 3750 Bayshore Drive, Unit 102, Naples, FL 34112. I. Roll Call: Advisory Board Members Present: Chairman, Jack Bonzelaar,

Kate Riley, Roy Wilson, Jim King. Excused Absence, Joseph Adams.

MSTU Staff Present: Shirley Garcia, Operations Coordinator; Tami Scott, Senior Project Manager, Debrah Forester, CRA Director.

II. Pledge of Allegiance: Led by Chairman Jack Bonzelaar.

III. Adoption of Agenda: Jim King made a motion to approve the agenda, Roy Wilson second. Approved unanimously.

IV. Adoption of Minutes: Jim King made a motion to approve the minutes, Kate Riley

second, approved unanimously.

VII. New Business: a. 2020 Meeting Calendar- Ms. Forester presented the 2020 meeting calendar and

asked if the Advisory Committee wanted to participate in a joint meeting with CRA and MSTU on January 7th and not have a regular meeting on January 9th. Jack Bonzelaar asked if we could start the meeting earlier than 5:30pm. Ms. Forester will confirm with the other boards. Ms. Forester asked if they accept the calendar as it is written with the change of January 9th meeting be moved to the joint workshop date of January 7th. Roy Wilson made a motion to accept the schedule and the change, Kate Riley second the motion. Approved Unanimously.

VIII. Staff Report: a. Project Manager’s Report- Tami Scott provided her project updates report and noted a few highlights. The pagoda has been painted and a new sign was installed, the creativity logo was used. She noted it is a temporary sign until a new branding and logo is determined. The total costs was approximately $1500 not including staff time. Celebration parking lot has been approved and a fence permit was issued and work has begun. The Isles of Collier Preserve, Ms. Scott attended a pre-app meeting regarding the Isles interest in purchasing 100 acres south of Holly Ave which would require an amendment to their current PUD, and approval for an additional 230 units. It appears the intention maybe to use the existing construction access as permanent access to South Bayshore Drive and there is a concern on the

traffic impacts to South Bayshore. Courthouse Shadows next meeting is on November 12th with the Board of County Commissioners for final approval. Meridian Landing submitted their PUD rezone and their growth management plan amendment for the 127-unit plan. A notice to proceed has been issued to repair the lights on Bayshore Drive from the IRMA damage which will begin in January. Jim King asked if the Haldeman Creek MSTU could send an official letter to the Commissioners before they vote to approve Courthouse Shadows that staff ensure all the parcels in the Courthouse Shadows be included in the Haldeman Creek MSTU and be on the record from the Board. Al Schantzen wanted to mention that the Board does listen to the Community so sending a letter to the Commissioners to ensure the project is included will go a long way. Road Maintenance - South Bayshore Dr Vegetation Control – Ms. Forester noted that Road Maintenance has started their minimum road maintenance on South Bayshore Dr. mowing along the right of way of vacant lots. Improvements to the dirt road at the end of South Bayshore Drive began today, this project is a partnership between the CRA and Road Maintenance.

X. Public Comments: Regina Rhodes a resident/property owner form Sandpiper Club

Apts. off of Marlin Dr. wanted to introduce herself and also talk about some concerns she had for the property that was owned by Mr. Hack the parcel number is 00388160002, located around the backside of Sandpiper Club. She was inquiring on a project that a developer who recently purchased the property was trying to build with a substantial amount of docks located on Haldeman Creek. Ms. Rhodes was asking if the staff or the Committee members has knowledge about the project and would docks be allowed since Sandpiper was limited when building their docks. Ms. Forester stated that staff was not aware of any proposed projects, but staff would monitor if the project was submitted to the County and provide information back to the committee.

Bayshore Beautification MSTU Advisory Committee

This 7 member committee was created on December 16, 1997, by Ordinance No. 97-82 to assist the BCC in carrying out the purposes of providing curbing, watering facilities, plantings and maintenance of the median strips of roadways within the MSTU; providing traffic calming improvements; and beautification and maintenance of other areas within the MSTU. Members will prepare and recommend an itemized budget to the Board of County Commissioners. Members must be permanent residents or owners of commercial or residential property within the MSTU. Terms are 4 years.

Bayshore Transit Subcommittee Meeting Minutes

November 22, 2019

I. Call to order

Debrah Forester called to order the regular meeting of the Bayshore TransitSubcommittee at 3299 Tamiami Trl E. Ste 103.

II. Introductions/Participants

Debrah Forester, CRA Director, Michelle Arnold, PTNE Director, Omar Deleon,Transit Manager, Zachary Karto, Transit Senior Planner, Mike Sherman, CamilleKielty, Shirley Garcia, CRA Operations Coordinator, Al Schantzen. Absent was LexayReina and Karen Beatty.

III. Draft Summary Minutes - Ms. Forester reviewed the draft Summary Minutes with thechanges. No one had further comments, the summary will be submitted to the CRAAdvisory Board on December 3rd meeting.

IV. Follow up from previous meeting

a. Survey PTNE- Zachary Karto and Omar Deleon presented a survey link and thediscussion with some changes the committee recommended were to add thequestion for the residents, how many vehicles in the household, and to expand themap for the Bayshore District.

b. Vehicle Types with estimated costs – a website for the vehicle types with estimatedcosts that was discussed at the last meeting were presented. Shared rides withvehicle types and costs and the electric moto vehicle were the most favorable. Moreinformation will be pursued on these vehicles. The Committee requested to getmore information from the Company Via for the shared rides and staff would reachout to Lee County who uses the Electric Moto Vehicle for more feedback fromthem since that County runs those type of trams now. Camille Kielty recommendedstaff look at charging station locations and consider now. Ms. Foresterrecommended looking at Sudgen Park to put one in there. Michelle Arnold wantedto add the question to the survey would they use this type of service and ride thistype of vehicle.

c. Reaching out to business owners with feedback- Zach Karto wanted to reach out tobusinesses for their endorsement of the survey.

d. Slider- Ms. Forester reached out to the owner of slider but the owner has notreturned her calls.

e. Electric Bikes- Camille Kielty contacted Pedego and they have bikes they sell aswell as rent and she asked if they were interested in setting up charging stations andpartnering up with the CRA. These would be their bikes they set up, theirresponsibility to maintain and rent if they choose to do so.

On December 26, 2019, we received your request for verification of exemption to perform the

following activities:

To maintenance dredge Haldeman Creek, Class II Florida waters, between depths -3.0 feet and -

5.0 feet Mean Low Water, removing approximately 31,600 cubic yards of material from an

approximate 23.8-acre area of sovereignty submerged landswest of Bayshore Road and in the

man-made canals, and east of Bayshore Road. The creek/bay dredging will have a bottom width

of 20 feet for the first 300 feet west of U.S. 41 and 40 feet for the remainder of the project. The

canal portions will have a bottom width of 20 feet, in Sections 11, 12, 13 and 14, Township 50

South, Range 25 East, Collier County. The spoil shall be removed and deposited in uplands with

the final spoil disposal location at the collier county Landfill at 3730 White Lake Blvd., Naples

FL. 34117.

Your request has been reviewed to determine whether it qualifies for (1) a regulatory exemption,

(2) proprietary authorization (related to state-owned submerged lands), and (3) federal approval

that may be necessary for work in wetlands or waters of the United States.

Your project did not qualify for the federal review portion of this verification request.

Specifically, the activity is not covered by the State Programmatic General Permit. Additional

authorization must be obtained prior to commencement of the proposed activity. This letter

does not relieve you from the responsibility of obtaining other federal, state, or local

authorizations that may be required for the activity. Please refer to the specific section(s) dealing

with that portion of the review below for advice on how to proceed.

1. Regulatory Review – VERIFIED

Based on the information submitted, the Department has verified that the activity as proposed is

exempt under Chapter 62-330.051(7)(a), Florida Administrative Code, and Section 403.813(1)(f)

of the Florida Statutes from the need to obtain a regulatory permit under Part IV of Chapter 373

of the Florida Statutes.

This exemption verification is based on the information you provided the Department and the

statutes and rules in effect when the information was submitted. This verification may not be

valid if site conditions materially change, the project design is modified, or the statutes or rules

governing the exempt activity are amended. In the event you need to re-verify the exempt status

for the activity, a new request and verification fee will be required. Any substantial modifications

to the project design should be submitted to the Department for review, as changes may result in

a permit being required.

2. Proprietary Review - GRANTED

The Department acts as staff to the Board of Trustees of the Internal Improvement Trust Fund

(Board of Trustees) and issues certain authorizations for the use of sovereign submerged lands.

The Department has the authority to review activities on sovereign submerged lands under

Chapters 253 and 258 of the Florida Statutes, and Chapters 18-18, 18-20, and 18-21, Florida

Administrative Code, as applicable.

The activity appears to be located on sovereign submerged lands owned by the Board of

Trustees. The activity is not exempt from the need to obtain the applicable proprietary

authorization. As staff to the Board of Trustees, the Department has reviewed the activity

described above, and has determined that the activity qualifies for a letter of consent under Rule

18-21.005(1)(c), Florida Administrative Code, and Section 253.77 of the Florida Statutes to

construct and use the activity on the specified sovereign submerged lands and as long as the

work performed is located within the boundaries as described herein and is consistent with the

terms and conditions herein.

During this term of this Letter of consent you shall maintain satisfactory evidence of sufficient

upland interest as required by paragraph 18-21.004(3)(b), Florida Administrative Code. If such

interest is terminated or the Board of Trustees determines that such interest did not exist on the

date of issuance of this Letter of Consent, this Letter of Consent may be terminated by the Board

of Trustees at its sole option. If the Board of Trustees terminates this Letter of Consent, you

agree not to assert a claim or defense against the Board of Trustees arising out of this Letter of

Consent.

Special Consent Conditions

1. The applicant agrees to indemnify, defend and hold harmless the Board of Trustees and the

State of Florida from all claims, actions, lawsuits and demands in any form arising out of the

authorization to use sovereignty submerged lands or the applicant’s use and construction of

structures on sovereignty submerged lands. This duty to indemnify and hold harmless will

include any and all liabilities that are associated with the structure or activity including

special assessments or taxes that are now or in the future assessed against the structure or

activity during the period of the authorization.

2. Failure by the Board of Trustees to enforce any violation of a provision of the authorization

or waiver by the Board of Trustees of any provision of the authorization will not invalidate

the provision not enforced or waived, nor will the failure to enforce or a waiver prevent the

Board of Trustees from enforcing the unenforced or waived provision in the event of a

violation of that provision.

3. Applicant binds itself and its successors and assigns to abide by the provisions and conditions

set forth in the authorization. If the applicant or its successors or assigns fails or refuses to

comply with the provisions and conditions of the authorization, the authorization may be

terminated by the Board of Trustees after written notice to the applicant or its successors or

assigns. Upon receipt of such notice, the applicant or its successors or assigns will have thirty

(30) days in which to correct the violations. Failure to correct the violations within this

period will result in the automatic revocation of this authorization.

4. All costs incurred by the Board of Trustees in enforcing the terms and conditions of the

authorization will be paid by the applicant. Any notice required by law will be made by

certified mail at the address shown on page one of the authorization. The applicant will notify

the Board of Trustees in writing of any change of address at least ten days before the change

becomes effective.

5. This authorization does not allow any activity prohibited in a conservation easement or

restrictive covenant that prohibits the activity.

General Conditions for Authorizations for Activities

All authorizations granted by rule or in writing under Rule 18-21.005, F.A.C., except those for

geophysical testing, shall be subject to the general conditions as set forth in paragraphs (a)

through (i) below. The general conditions shall be part of all authorizations under this chapter,

shall be binding upon the grantee, and shall be enforceable under Chapter 253 or 258, Part II,

F.S.

(a) Authorizations are valid only for the specified activity or use. Any unauthorized deviation

from the specified activity or use and the conditions for undertaking that activity or use shall

constitute a violation. Violation of the authorization shall result in suspension or revocation

of the grantee’s use of the sovereignty submerged land unless cured to the satisfaction of the

Board.

(b) Authorizations convey no title to sovereignty submerged land or water column, nor do they

constitute recognition or acknowledgment of any other person’s title to such land or water.

(c) Authorizations may be modified, suspended or revoked in accordance with their terms or the

remedies provided in Sections 253.04 and 258.46, F.S., or Chapter 18-14, F.A.C.

(d) Structures or activities shall be constructed and used to avoid or minimize adverse impacts to

sovereignty submerged lands and resources.

(e) Construction, use, or operation of the structure or activity shall not adversely affect any

species which is endangered, threatened or of special concern, as listed in Rules 68A-27.003,

68A-27.004, and 68A-27.005, F.A.C.

(f) Structures or activities shall not unreasonably interfere with riparian rights. When a court of

competent jurisdiction determines that riparian rights have been unlawfully affected, the

structure or activity shall be modified in accordance with the court’s decision.

(g) Structures or activities shall not create a navigational hazard.

(h) Structures shall be maintained in a functional condition and shall be repaired or removed if

they become dilapidated to such an extent that they are no longer functional. This shall not be

construed to prohibit the repair or replacement subject to the provisions of Rule 18-21.005,

F.A.C., within one year, of a structure damaged in a discrete event such as a storm, flood,

accident, or fire.

Structures or activities shall be constructed, operated, and maintained solely for water dependent

purposes, or for non-water dependent activities.

3. SPGP Review - NOT APPROVED

Your proposed activity as outlined on your application and attached drawings does not qualify

for Federal authorization pursuant to the State Programmatic General Permit and a SEPARATE

permit or authorization shall be required from the Corps. You must apply separately to the Corps

using their APPLICATION FOR DEPARTMENT OF THE ARMY PERMIT, ENG FORM 4345,

or alternative as allowed by their regulations. More information on Corps permitting may be

found online in the Jacksonville District Regulatory Division Source Book at:

Authority for review - an agreement with the USACOE entitled “Coordination Agreement

Between the U. S. Army Corps of Engineers (Jacksonville District) and the Florida Department

of Environmental Protection, or Duly Authorized Designee, State Programmatic General

Permit,” Section 10 of the Rivers and Harbor Act of 1899, and Section 404 of the Clean Water

Act.

Additional Information

Please retain this letter. The activities may be inspected by authorized state personnel in the

future to ensure compliance with appropriate statutes and administrative codes. If the activities

are not in compliance, you may be subject to penalties under Chapter 373, F.S., and Chapter 18-

14, F.A.C.

NOTICE OF RIGHTS

This action is final and effective on the date filed with the Clerk of the Department unless a

petition for an administrative hearing is timely filed under Sections 120.569 and 120.57, F.S.,

before the deadline for filing a petition. On the filing of a timely and sufficient petition, this

action will not be final and effective until further order of the Department. Because the

administrative hearing process is designed to formulate final agency action, the hearing process

may result in a modification of the agency action or even denial of the application.

Petition for Administrative Hearing

A person whose substantial interests are affected by the Department’s action may petition for an

administrative proceeding (hearing) under Sections 120.569 and 120.57, F.S. Pursuant to Rules

28-106.201 and 28-106.301, F.A.C., a petition for an administrative hearing must contain the

(a) The name and address of each agency affected and each agency’s file or identification

number, if known;

(b) The name, address, and telephone number of the petitioner; the name, address, and telephone

number of the petitioner’s representative, if any, which shall be the address for service purposes

interests are or will be affected by the agency determination;

(c) A statement of when and how the petitioner received notice of the agency decision;

(d) A statement of all disputed issues of material fact. If there are none, the petition must so

indicate;

(e) A concise statement of the ultimate facts alleged, including the specific facts that the

petitioner contends warrant reversal or modification of the agency’s proposed action;

(f) A statement of the specific rules or statutes that the petitioner contends require reversal or

modification of the agency’s proposed action, including an explanation of how the alleged facts

Time Period for Filing a Petition

In accordance with Rule 62-110.106(3), F.A.C., petitions for an administrative hearing by the

applicant and persons entitled to written notice under Section 120.60(3), F.S., must be filed

within 21 days of receipt of this written notice. Petitions filed by any persons other than the

applicant, and other than those entitled to written notice under Section 120.60(3), F.S., must be

filed within 21 days of publication of the notice or within 21 days of receipt of the written notice,

whichever occurs first. You cannot justifiably rely on the finality of this decision unless notice of

this decision and the right of substantially affected persons to challenge this decision has been

duly published or otherwise provided to all persons substantially affected by the decision. While

you are not required to publish notice of this action, you may elect to do so pursuant Rule 62-

110.106(10)(a).

The failure to file a petition within the appropriate time period shall constitute a waiver of that

person's right to request an administrative determination (hearing) under Sections 120.569 and

120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent

intervention (in a proceeding initiated by another party) will be only at the discretion of the

presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C. If you

do not publish notice of this action, this waiver will not apply to persons who have not received

written notice of this action.

Extension of Time

Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the

Department’s action may also request an extension of time to file a petition for an administrative

hearing. The Department may, for good cause shown, grant the request for an extension of time.

Requests for extension of time must be filed with the Office of General Counsel of the

Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-

3000, or via electronic correspondence at [email protected], before the deadline for

filing a petition for an administrative hearing. A timely request for extension of time shall toll the

running of the time period for filing a petition until the request is acted upon.

also seek appellate review of this order before the Land and Water Adjudicatory Commission

under Section 373.114(1) or 373.4275, F.S. Requests for review before the Land and Water

Adjudicatory Commission must be filed with the Secretary of the Commission and served on the

Department within 20 days from the date when this order is filed with the Clerk of the

Department.

Judicial Review

Once this decision becomes final, any party to this action has the right to seek judicial review

pursuant to Section 120.68, F.S., by filing a Notice of Appeal pursuant to Florida Rules of

Some candidates are making theirprofessed loyalty to President Trump akey part of their platforms, somesuggesting Rooney was not loyalenough when it came to impeachmentand the border wall.

The primary election is Aug. 18 fol-lowed by the general election Nov. 3.

Recreational pot in Florida?

A push to make it legal to use mari-juana recreationally in the SunshineState is ramping up.

California-based MedMen, a majorcannabis industry player, is backing aproposed constitutional amendmentthat could make it to the ballot in 2020and has started a political action com-mittee called Make it Legal to raise mon-ey and collect signatures.

Such efforts have fallen short in thepast. In August, a group called RegulateFlorida expected to have collected morethan 100,000 of the 766,000 signaturesneeded to put on the ballot an amend-ment legalizing recreational marijuanause.

The two groups’ amendments differon the specifics of how the sale and useof recreational pot would be regulated.

On the heels of 2016’s overwhelmingapproval of medical marijuana in Flori-da – 71% of voters approved thatamendment – backers of legalizing rec-reational pot see an opening.

It remains to be seen whether it willgo up in smoke.

Toll roads

The new year is expected to see somemilestones for three proposed toll roads

through rural parts of Florida, includingbetween Collier and Polk counties.

Florida Department of Transporta-tion chief engineer Will Watts told aFlorida House committee in Octoberthat preliminary routes would be un-veiled as soon as January.

DOT task forces are expected to de-liver their recommendations for each ofthe roads by October 2020.

They would stretch for more than300 miles and could cost $10 billion andtake until 2030 to build, according to astate timeline.

The Polk-to-Collier connector wouldstretch for 150 miles. Others are plannedto extend the Suncoast Parkwaythrough the Panhandle to the Georgialine and extend the Florida Turnpike onthe east coast.

The project also calls for bicycle andpedestrian trails and a plan for extend-ing water, sewer and broadband lines.

Task force members have called formore public input, and a group of envi-ronmental groups calling themselvesthe Roads to Ruin Coalition have joinedforces to block the roads.

Republicans who back the roadbuilding plan say it is about economicdevelopment and staying ahead of Flor-ida’s predicted population growth.

Buckle up: The debate is just begin-ning.

Climate change compact

A fledgling effort in Southwest Flori-da to bring various cities and countiestogether to search for ways to respond toclimate change could gain steam in2020.

Lee, Charlotte, Collier and the re-gion’s 10 cities began discussions in2019 to create the Southwest Florida Re-gional Resiliency Compact. It would bethe state’s fourth regional climate com-pact.

Florida Gulf Coast University marinescience professor Michael Savarese hasbeen coordinating the talks.

Savarese and scientists and comput-er modelers from the University of Flori-da, the University of Miami and the U.S.Geological Survey are using a $1 milliongrant from the National Oceanic and At-mospheric Administration to develop avulnerability assessment for Collier. Itcould be completed in 2020.

Meanwhile, another communitypartnership aimed at educating South-west Floridians about climate changesolutions is getting off the ground in2020.

Growing Climate Solutions — Path toPositive Southwest Florida, under theauspices of the Conservancy of South-west Florida and with funding from theCommunity Foundation of CollierCounty, plans to tap faith-based com-munities, medical professionals andbusinesses to elevate the the climatechange discussion.

A Conservancy survey in 2019 foundthat three-quarters of Southwest Flo-ridians believe climate change is hap-pening and that most worry about it.

Will the hand-writing turn into ac-tion in 2020?

The arts knock on Collier’s door

On Jan. 29, Collier Countians can seethe first draft of the county’s historicfirst arts and culture strategic plan. It isintended to be a document on wheels.

Representatives from the California-based Cultural Planning Group, the con-sultant working with the county, haveemphasized this is an action plan. Itcombs the priorities to match them to anorganization that will commit to fulfill-ing the challenge. Those that are notadopted by advocates will be shelved.

“We pride ourselves on plans that areimplemented,” said Linda Flynn, a rep-resentative of the group. The group hastabulated surveys and held at least sixcommunity forums at locationsthroughout the county.

Collier County’s first arts and culturestrategic plan bubbled up from a conflu-ence of events:

❚ A drastic 93% state budget cut inarts and humanities funding in 2018,from its $35 million request to $2.65million. (The new state fiscal budget hasincreased that to $21.2 million, still lessthan half the $43 million requested. )

❚ Results of a national arts survey,the Arts & Economic Prosperity study,that showed 1.4 million people attendedarts and cultural events here in one year,61% of them visitors who came express-ly for an event.

❚ The realization sports proponentswere asking for, and getting, supportthat the arts could share. Barely a day

before the United Arts Council reportedits survey’s tabulation that the artspump $44 million annually into CollierCounty — $880 million over 20 years —commissioners approved a hotel tax fora sports complex projected to bring in$468 million in that same time. Further,other city arts officials have pointed outthat national grantmaking organiza-tions look for an existing communityplan when they consider requests.

❚ The desire of local agencies, nota-bly the budding Bayshore Arts District,to address questions of public art andart/performance regulations with coun-ty-designed rubrics.

Laura Burns, executive director ofthe United Arts Council of Collier Coun-ty, heads the local liaison to the consult-ants. She said she’s excited about thecoming plan.

“This plan is about making CollierCounty known as the arts destination itis. It’s about making arts accessible toeveryone here, on all income and agelevels, and bringing more communityinvolvement through arts and culture,”Burns said.

The draft presentation, open to thepublic, is 6-8 p.m. Jan. 29 at Naples Bo-tanical Garden.

17 Acre Cultural Arts Village Site:

4265, 5315 Bayshore Drive, Folio 6440960 I 03. CRA staff is working in house with other Collier County agencies to explore varies options as directed by the Board of County Commissioners. Staff will request direction from board at April's joint meeting.

CRA Triangle Property:

Gateway Triangle land purchase 1936 Davis Boulevard, Folio 77 510240008 Scheduled to close summer of 2020, staff is working on storm water plan with developer and adjacent property owner and coordination with FDOT regarding US41 safety improvements.

Cell Tower Relocation:

2370 Kirkwood Avenue: Folio 22721240004 Building permit was issued on September 14, 2019, to date no inspection have been called or approved. Tower install delayed until mid to late January.

Fire Suppression System- Phase 2:

Phase 2 includes Becca A venue and Pine Street Preconstruction meeting held with Douglas Higgins Inc. 4485 Enterprise Ave. Naples, Florida 34104. Project has been delayed, staff will schedule a stakeholder meeting prior to the construction start, anticipated start date of April 20, 2020.

Fire Suppression System- Phase 3:

Phase 3 includes Areca A venue, Coco Ave, Basin Sh·eet, Canal Street and Captains Cove. CRA staff is working with City of Naples for the Construction Documents, documents are at the 30% stage. Staff will dish·ibute documents to stakeholders when available.

Master Pump Station 306:

Thomasson A venue and Thomasson Drive Project is currently under construction, foundations for the new pump station building has been poured. Building above grade sh·ucture has begun and all walls are up as of January I, 2020. 20" Force Main along Thomasson Lane has been run from the existing site to the new. Landscaping is estimated to begin in September 2020. Project completion which included the demolition of the existing pump station is estimated to be completed January 2021.
