President's Message

In my last column, I mentioned thecontinuing need for BASF to be focusedon helping both our industry and ourcommunity. I recalled our responsibility asa group of professionals to work within ourenvironment to maintain it for our future.

Readers responded positively to thosecomments. They reflect what seems to be agrowing awareness of the advantages ofsmart planning and building. “Smart” and“green” are close cousins. Together they areredefining the use of sustainable materials,energy efficient design and cost-effectivesteps from start to finish. Computer andelectronic techies are designing occupant-controllable systems for temperature,lighting, maintenance and other greenconcerns. These smart systems can work forall structures in which people live and workand play. They work best if used from thebeginning. That calls for effective planning.

Many issues face South Florida in the 21stcentury. They call for more and better com-prehensive planning that considers all ofthose issues and their impact on each other.We have traffic problems. We need gritty,

realistic solutions that capture more efficientuse of mass transit, cars and trucks. And thebreakthroughs that engineers devise to avoidcostly fuel. Prior lack of planning in SouthFlorida has accelerated our need for afford-able housing. Future plans for our availableland need to consider more efficient use ofareas outside the UDB. Sure, we should plugin the advantage of recycling existing neigh-borhoods and building vertical. But theyalone won’t salvage our quality of life andprepare it for future growth.

Our association of professional builders,developers and affiliated suppliers and tradescontributed enormously to the orderlygrowth of South Florida’s population sincethe recovery days following WWII. We cancontinue BASF’s helpful role in futureplanning throughout the three counties ofour membership. We already have talentedpeople on staff who interact with officialsat municipalities, counties, school boards,planning agencies, environmental and othergroups that rub up against our industry.

We are a lead dog in the hunt for a betterSouth Florida, and I am certain that others

who seek a betterfuture for our landand water will wel-come a partnership.

We don’t come late to the table. BASFhas previously worked harmoniously withplanners in preparing developments whereland was scarce or where existing structurespermitted adapting for density. Sometimes,those best-laid plans were tossed out whenvotes by officials were counted.

Miami-Dade County’s parks staffrecently unveiled a new master plan for thenext 50 years that improves planning forstreets, sidewalks and public parks. Theywant to interconnect green spaces, linkneighborhoods with small parks anddo other things that leave something goodfor our kids and our grandchildren.

It seems to me that we are all readingfrom the same book. It recognizes theparadise we live in and its limited size andresilience. It urges everyone to work for acommunity and for homes we can callwonderful. Imagine the resources BASFmembers could bring to those plans.

High-Rise Council

BASF members and guests filled The Havana Clubatop the Wachovia Tower in downtown Miami onFebruary 27 to watch a cold front arrive, enjoy a warmbreakfast and hear experts comment on a South Floridamarketplace roasted by bad headlines.

Co-chair John McQueston of Stewart Title Guarantywelcomed everyone to the year’s first High-Rise CouncilForum. Because they had arrived on the 55th floor byelevator, he observed a collective relief that power hadbeen fully restored following a regional outage the daybefore. The meeting was sponsored by Comcast Cable,Countrywide Home Loans, Sherwin-Williams, FloridaHome Builders Insurance, Regions Bank, The HomeDepot, The Green Companies, Matrix Employee Leasing

and The Miami Herald. Thesubject—“Down From theStratosphere: Re-PricingHigh-Rise Costs in aChanging Market.”

Opening remarks byMichael Cannon suggesteda conclusion that theother speakers largelysupported: South Florida’sreal numbers are not asbad as people say they are.Cannon, the executivedirector of Integra RealtyResources, revealed hardnumbers that showed areturn to a normal marketwhen the days of “easymoney and Monopolyfaded and the fantasy cycleended in 2005.” SouthFlorida isadjusting after excessiveexpansion andover-pricing and is ina “pay back” period,according to Cannon.

The housing market’s true direction will unfold in 2008,maybe into 2009, depending on variables that include abetween-census unknown population, job numbersimpacted by arriving international companies, realisticprices and tax assessments, a possible increase in public/private partnershipsand yet-uncoveredfraudulent mortgagetransactions.

Based on hardnumbers he hastracked for years,Cannon is bullishon Miami if moneycontinues to flowand internationalbuyers continuelooking. “High rises are expected and will continue tobe built because we’re going urban,” added Cannon.“We have to go up.”

The banker on the panel echoed the importance ofcomplete, hard numbers and asked members to be waryof media headlines born of opinion makers with fullagendas and incomplete data. James Dockerty, executivevice president of BNY Mellon Bank of Florida’s construc-tion lending in Florida, said his bank is financially sound

HIGH-RISE COUNCILand is making deals, but not with “easy money.” Lots ofbanks are in good shape, said Dockerty, but some largeloans need syndication with partner banks and “they readnegative headlines about Miami and go shy. We’ve done10 large buildings and five are paying off now. The worstone had an 80 percent closure rate. That’s no failure.”Dockerty added that most bad deals involve bad buildingsin bad places. He is upbeat about Miami-Dade County,especially the strong markets in Coral Gables, CoconutGrove, Key Biscayne, Aventura, Miami Beach and WatsonIsland. “Like 1993, 2008 is a transition year.”

City of Miami Commissioner Joe Sanchez ischairman of that body and chairman of the DowntownDevelopment Authority. He, too, sees vertical growth ina more urban Miami and wants to create a world-class24-hour urban experience for future residents thatincludes better services, more landscaping, attention tocultural activities and a street car system. “The tunnelis a necessity,” said Sanchez. “We’ve got to get those18-wheelers off our streets.”Hector Torres wants to make lemonade out of

lemons. The vice president of development at A.I.Florida Holdings advised dealing with negative marketforces and bad press reports. “You can’t control them,”said Torres. Inexperienced developers are waiting forthe sky to fall, he said, “but those with experience areadapting and managing the market cycle.” Due diligenceand good planning are necessary and yesterday’s ordertakers will have to learn how to sell surplus inventory.Today’s market may require a focus on infrastructureand services, according to Torres. “Identify today’sopportunities and do your best,” he said.

Repositioning projects for other uses is anothersolution offered by Jose Moreno, Jr., president ofBCM Construction Management. In the wake ofrising construction costs, some structures may berestructured from residential to hotel to mixed-useto survive today’s cycle. And now may be a good timeto huddle with contractors, said Moreno. Some maytrim costs to keep jobs alive, especially if the cost ofmaterials retreats.

In closing, Rick Horton of The Green Companiesindicated that BASF may develop a CommercialConstruction Council similar to one at the NationalAssociation of Home Builders to address regulatory andlegislative issues, provide educational and informationservices for members who are commercially activeor diversifying into light commercial building andremodeling, and track commercial building trends,techniques and issues, and best business practices. Hesaid, “but those with experience are adapting andmanaging the market cycle.”

Rejoice! The dust has settled and construction hasbeen completed. BASF unveiled its newly remodeledoffice and conference room at the January 17Executive Committee Meeting.

The new conference room prominently features agranite conference table and an adjoining area thatcomfortably seats 48. The room will be used to hostmost of the BASF committeemeetings and continuingeducation courses.

The conference room table is unique and distinctivewith BASF’s logo prominently displayed inthe center of it. International Builders’ ShowLaying the Foundation for 2008

From flooring to lighting, no topic was overlookedat this year’s International Builders’ Show® (IBS).More than 92,000 building industry professionals,including more than 200 BASF members, visited thisyear’s IBS. The more than one million square feet ofexhibit space at the Orange County Convention Centerwas transformed into a true builders’ pavilion as an IBSrecord 1,900 companies exhibited their products andservices.

Innovation and environmental awareness werethe leading themes of the show as a host of exhibitorspremiered new products to make the homeowner’sexperience easier and more enjoyable.

Kitchens are becoming more sophisticated and areboasting restaurant-grade technology on a homeowner’sbudget. Ovens can now prepare meals 15 times faster thanconventional methods. Those same ovens can also doubleas a fireplace when entertaining.

The futuristic world often seen in films is becomingmore of a reality with the introduction of homeautomation systems that allow homeowners to controllighting, heating and air-conditioning, security, garagedoors, irrigation, spa and pool temperatures, camerasand more from anywhere in the world with practicallyany Internet-connected device.

The show also featured the first ever Green Day,celebrating all things Green in the building industry.The day began with a session by William McDonoughon The Promise of Cradle to Cradle Design: SustainableArchitecture for the 21st Century. In addition, greeneducation was held throughout the day and NAHBofficially launched the NAHB National Green BuildingProgram and the Certified Green Professionaldesignation.

ThroughoutGreen Day, exhibitorsintroduced ways tocreate homes that areboth pleasing to thehome buyer and canbe designed, builtand maintainedto leave minimalenvironmental impact.

New flooringoptions featurehardwood products,which use reclaimedwood, including pineoak, and chestnut;reclaimed woods are recovered from old buildings andrecycled for new use. Solar hot water systems are designedto reduce water heating bills by 50 to 80 percent. Thelatest electric fireplaces use technology to provide thewarmth and ambiance of a real fire without producingcarbon monoxide or greenhouse gases.

Other show highlights included the Daily FeaturedSpeaker sessions by Mark Jarvis, Chief MarketingOfficer at Dell and Ken Schmidt, formally withHarley-Davidson Motor Company. The Food NetworkStar of “Dinner Impossible,” Chef Robert Irvine,helped to kick off the show during Thursday’sLuncheon Impossible.

With four days overflowing with education, exhibitsand special events the 2008 International Builders Showwas an event everyone enjoyed.

Broward Legislative UpdateBroward County CommissionCreates Blue Ribbon Panel toDiscuss Foreclosure Issues – TheBroward County Commission hascreated a blue-ribbon panel todevelop recommendations thatwill assist property owners in foreclo-sure. The goal is to bring expertstogether to look at this problem andcome back with recommendationsusing information and funding that isalready available. The blue-ribbonpanel will include Mayor Wexler,five city officials, a number of housingexperts. Broward County estimatesthat there were 24,672 foreclosurefilings in 2007, although that numbermay include duplicate filings on asingle residence from entities suchas a homeowner’s association, secondor third mortgages, etc. The panelwill meet during the next six monthsand come back with recommendationsfor the Broward County Commissionto review.

Hometown Democracy PetitionDrive Falls Short – On February 1st,the Florida Division of Electionsofficially announced that the so-called"Hometown Democracy" amendmentdid not qualify for the Novemberballot. This marks the third time thatthis radical proposal has failed to reachthe voters. With growth managementsuch an important issue in our state,it begs the question: Why would anamendment like "HometownDemocracy" fail to collect the neededsignatures? The answer is simple:It is an extreme, overreaching andflawed proposal. It will make ourgrowth-management problemsworse, not better. What does thismean for 2010? Their petitions aregood for four years. Some that theyhave now will expire, and the totalnumber of signatures they need isdictated by the voter turnout in thisyear’s Presidential election, thus, theywill need to collect a higher thresholdto make the ballot in 2010. A coalitionof organizations, including BASF andthe Florida Home BuildersAssociation, is working to educate

Floridians about thismisguided proposal, and willcontinue to work against its passage.

Possible Restrictions on theConversion of Golf Courses toResidential Uses – Broward Countystaff was directed to study the issueof golf course redevelopment. Ifapproved by the Broward CountyPlanning Council, the County landuse plan could be amended todiscourage existing golf coursesfrom being converted to other uses.BASF does not believe any changesshould be made to the land use plan,and decisions on an individual basisshould be made by the cities in whichthe golf courses exist. This issuewill be discussed before the BrowardCounty Planning Council at theirnext meeting. BASF is closelymonitoring this situation.

School Board Approves IncreasedSchool Impact Fees – BASF staffhas spent the past 18 months workingto analyze impact fee increasesproposed by the Broward CountySchool District. These fees have notbeen increased since 1997, and thisis the first update to their studentgeneration rate study. When we beganthis process their consultantrecommended a maximum fee of$11,554 per unit in one of the landuse categories. BASF hired our ownconsultant to dispute theirmethodology and through thisprocess a dialogue ensued with staff,the Superintendent and the SchoolBoard members. While we arguedthat any fee increase in this housingmarket is inappropriate, pointed totheir student enrollment decliningthe past two years, and opined thattheir teachers and other essentialservice personnel would benegatively affected, a new fee schedulewas adopted this week based on theirconsultants report. Unfortunatelyat the end of the day the politicalpressure to adopt updated fees wasinsurmountable. However, we arepleased to report that there will be

a three year phase in of the new fees,and the newly proposed increaseswere altered downward representinga minimum of a 25% decrease in theindividual land use categories. If youwould like a copy of the new feeschedule, please contact BASF. Thenew fee schedule will commence onApril 21, 2008.

Miami-Dade Legislative UpdateCOUNTY BUDGET CUTSCOULD MEAN LESS STAFFKey County Departments cuttingbudgets, staff – due to a slow-downin the construction industry, and thecommensurate drop in tax revenuesand legislatively mandated tax cuts,development-related countydepartments are proposing leanerbudgets – and cutting staff to meettheir budget shortfalls. Some arelooking to increase fees to cover thelost revenues, while others are simplytelling the public that fewer staff willbe available to service all types ofpermit applications. Our members aremeeting with staff, telling them aboutthe depth of the industry’s slow-down,and how that is rippling throughoutthe entire economy. If you hear of anyproposed fee increases, please contactBASF immediately!

WATER ISSUESWater Conservation Manual inpreparation – as part of the County’stwenty-year water use permit andother water conserving mandates,WASD is developing a water-useefficiency manual. All industrymembers are participating in thisimportant effort, which will be comemandatory on all new developmenton July 1, 2008. All new development(commercial, residential, industrial,etc) would be required to install themost water-conserving plumbing fix-tures currently available, as outlined inthe manual. Among other things, themanual will establish the phased-inuse of EPA’s WaterSense conservingfixtures. We urge all builders to takenote of this effort as it could impactexisting, long-term agreements whichbuilders have with fixture manufactur-ers, too. A series of working meetingswill be held from March through May.Public hearing is likely in mid-June tomeet the July 1 legal enactment date.

SCHOOL RELATED ISSUESStatus of school concurrency andinterlocal agreement – At theirFebruary 5 meeting, the CountyCommission made several majorchanges to the resolution adopting

this agreement. Most revisions areidentical or similar to those supportedby the School Board. However, out-standing issues include: which entitywill prepare student generation rates,vote requirements for future changesto the agreement, and which costindex to use if school facilities must bebuilt for mitigation purposes. Charterschools as a mitigation option is notincluded in either version of theagreement. The School Board didnot consider the amended interlocalagreement at either their Februaryor March meetings. At press time,it was unclear if the School Boardwill consider this at their Aprilmeeting. However, until the CountyCommission and School Boardadopt the same interlocal agreementand the County subsequently adoptsan amendment to incorporateschool concurrency into its MasterPlan, school concurrency cannotbe implemented for any projects inthe county.

AFFORDABLE HOUSINGSurtax fund renewal debated –at various County Commissionmeetings, the more efficient use ofsurtax funds for affordable end-loanswas discussed. BASF supports surtaxfund use to directly assist more fami-lies buy homes, and less so now forthe production of new communities,with a few exceptions. However,BASF members are opposed to theunlimited renewal of this fund unlesscertain changes are made to fundadministration. They include: a 10%cap on administrative fees, an annualaudit and presentation about the totalfund, number of families receivingassistance, etc., and a possiblelimit/prohibition on the use of surtaxfunds for new construction. BASFMembers will be meeting with keyCounty staff to discuss their concernsto ensure that the funds are properlyadministered and spent. Benefit toBASF Members: safe-guarding morefunds for builders to provide to theirhome buyers for purchasing affordablypriced homes.

Building Permit Moratorium inMobile Home Parks extended 90days – at the February 5 meeting theCounty Commission extended theexisting building permit moratoriumfor 90 days. The Commission directedstaff to review for a second time theneed for a separate zoning categoryfor mobile home sites. The originalreport prepared by staff sets forth fiverecommendations, among which are:working with existing organizations tohelp relocate displaced mobile homeresidents, introduce State legislationto increase relocation funds providedto mobile home park residents, pre-pare exit ordinance to provide moremoney for relocation assistance, andincrease the supply of all other afford-able housing programs. (County agen-da item no. 080414). The next andpresumably final report will be thesubject of a hearing in May 2008.

Dr. David Crowe, the Senior StaffVice President for Regulatory andHousing Policy at the NationalAssociation of Home Builders flew infrom Washington, D.C. to testifybefore the Davie Town Council inMarch regarding their mandatoryinclusionary zoning ordinance. Dr.Crowe heads the NAHB regulatoryand housing policy group that isresponsible for advocating homebuilding issues before federal agenciesas well as credible policy analysesof federal, state and local laws,regulations and policies that affectthe industry including housing impactson local economies. Through theleadership of Toni Pacelli-Hinkleyand BASF’s Governmental AffairsDepartment, securing Dr. Crowe’stestimony was a key component towardeducating the elected officials on thenegative effects mandatory inclusionaryzoning can have on the buildingindustry and local government.

New “cobra” drivers are beingpurchased by BASF’s big hitters andfoursomes are busy getting in theirpractice rounds in advance of thisyear’s annual BASF golf tournamentset for Friday, May 16 at the famedDoral Country Club & Resort.

Should Water Availability Control LocalGovernment Land Use Decision MakingBy: John J. Fumero & Steve A. Walker

Recently, the Florida Departmentof Community Affairs (“DCA”)objected to a series of Miami-DadeCounty Comprehensive PlanAmendments based, in part, uponthe fact that certain amendmentsencompassed lands outside the UrbanDevelopment Boundary (“UDB”).To a large degree, the DCA’s positionwas derived from South Florida WaterManagement District’s (“SFWMD”)comments on the Comprehensive PlanAmendments relative to water supply.

This commentary is intended toidentify potential legal and publicpolicy pitfalls raised by state andregional agencies becoming involvedin land use decision making that hastraditionally been within the solepurview of local government.

The Legislature enacted Chapter373, F.S. in 1972, to institute astatewide approach to water useregulation by establishing regionalwater management districts. TheLegislature recognized that Florida’swater use policy and decision-makingshould reside in a neutral regionalwater management district governingboard having the technical knowledgeand expertise to assess wateravailability, resource impacts and toachieve the full beneficial use of thewaters. In part this was accomplishedby preempting the regulation of theconsumptive use of water to the stateand delegating it to the watermanagement districts, (subsection373.217(2), (3) and (4), F.S.). Thegoal was to ensure the State’s waterresources are managed on a regionalbasis, rather than on a local basis,with the purpose of avoiding localwater supply conflicts that historicallypreceded the statute’s enactment.However, it was never the Legislature’sintent to allow the water managementdistricts to preempt local land usedecisions.

Land and Water Planning LinkagesIn response to growing concerns

that local governments were notsufficiently addressing watersupply availability as part of theircomprehensive plans, the Legislaturedirectly linked water supply planningand land use/development decisions oflocal governments in 2000, requiringlocal governments to develop a 10-yearwater facilities work plan, and tyinglocal government potable water andcapital improvement plans to district’sregional water supply plans. The watermanagement district reviews the10-Year Water Facilities Work Planfor consistency with the appropriateregional water supply plan. Thedistricts also reviews proposedcomprehensive plan amendmentsfor consistency with existing potablewater consumptive use permits andthe regional water supply plan.

In 2004 and 2005, the Legislaturefurther strengthened the linkagebetween growth management andwater supply management, requiringthat “adequate water supplies” be inplace and available to serve proposednew development no later than thetime when building permits would beissued for such developments (watersupply concurrency), (See Section163.180(2)(a), F.S.). Moreover, priorto the issuance of a building permit,the local government is now requiredto consult with the appropriate watersupplier or utility to determinewhether there are sufficient watersupplies available.

Both local governments and thewater management districts have beenworking to implement these legislativemandates. The water managementdistricts have been intensifying effortsto understand the sustainable limitsof the State’s complex system ofaquifers and surface waters. Localgovernments have been working

to develop10-year facilitieswork plans,and the watermanagementdistricts havebegun reviewingtheir workproducts.However, withthe adventof thisunprecedentedlevel ofinteractionbetweenthe watermanagementdistrict’s, theDCA and localgovernments,problems havearisen, such as the recent clashbetween SFWMD, DCA and Miami-Dade County over the extent to whichland use decisions can be governedby water supply availability. Theseclashes inherently involve fundamentalquestions of where local government’sauthority and jurisdiction ends and thewater management district’s authorityand jurisdiction begins.

The “Catch 22” For LandownersIt appears that the SFWMD

and the DCA are struggling to findthe appropriate balance and agencyjurisdictional limits as it relatesto land and water planning.Landowners seeking changes to alocal government’s comprehensiveplan seem to have been placed in theproverbial “catch 22” scenario. Onthe one hand, proposed comprehensiveplan amendments which have beenapproved by local government aresubsequently rejected by DCA,based on comments from the watermanagement district regarding the

permitted allocation of water for thelocal public water supply utility. Onthe other hand, the water managementdistricts do not allocate water to apublic water supply utility until thelocal land use approvals are in place.Thus landowners are left in themiddle, unable to obtain thecomprehensive plan change, due toadverse comments from the watermanagement district, and the localwater supply utility cannot obtainthe water allocation necessary tosupport the comprehensive planchange, until the comprehensiveplan is actually amended.

The solution is for the waterconcurrency test to be applied at thetime of building permit issuance, ascontemplated by the Legislature, not

at the time the comprehensive planamendment is considered. If thelegislative plan was followed, thewater management district’s role atthe comprehensive plan amendmentstage would be focused on broaderresource availability and infrastructureplanning issues, which, once identified,would provide the local governmentand affected land owners withguidance on the availability ofwater to meet the future needscontemplated in the proposedcomprehensive plan amendment.

As all three agencies struggle to findtheir respective “turf”, and as localgovernments are just now submittingtheir first 10-Year Water FacilitiesWork Plans to be reviewed by DCAand the water management districts,

the extent and limits of land and waterplanning integration will continue toevolve. Whether this effort results in asmoothly functioning, predictableplanning and regulatory program,respecting each government’s properand traditional role in the processremains to be seen.John J. Fumero and Steve A.

“It was a great opportunity forthe BASF leadership, to meet withRobert, Emmett and Dave to goover some of the pressing legislativeissues we have to face this year andto become acquainted with theleadership and goals of BASF,”said Toni Pacelli-Hinkley, BASFexecutive vice president.

Robert, Emmett and Dave saidthat they are making it their mission tomeet with local HBA leadership to getto know local leaders and to betteridentify local problems and concerns

that are affecting ourindustry. They did notwant to be just nameson the FHBA websiteand letterhead. Theywanted the BASFleadership to becomeacquainted withthem so that they aremore effective inserving our needs inTallahassee.

The FHBA's legislative prioritiesand agenda for the year were animportant focus of the meeting.Construction in Florida is the secondlargest economic engine employingmore than 473,000 Floridians andpumping more than $42 billion intothe state's economy. There weretwo items of unfinished businessfrom last year that are still high on

the priorities agenda --propertyinsurance,and property taxes.Added to the list of prioritiesareaffordable/ workforce housing,building code mitigation, growthmanagement, impact fees, and onsiteand springshed protection.

Items on the agenda were thefocus of the FHBA Spring Board ofDirectors and Legislative Session inTallahassee April 5-8th.

BASF would like to express its deepest sympathy to the family of George Berlin, Turnberry Associates.George entered the construction industry in New York after serving as a naval officer in Guam during WWII.In 1971, he moved with his family to Florida and played an integral part in developing Aventura.

George was an active member of the community and held numerous leadership roles, includingpresident of BASF in 1982, an inductee of the BASF Hall of Fame and trustee and president of Temple Sinai.He was also appointed to numerous governmental boards and commissions. His office walls, filled with awardsand plaques, stand testament to his hard work and dedication to the industry and his community.

George was a visionary, a builder, a community leader, and a family man. He is survived by his wife of nearly57 years, Lila, four children, 10 grandchildren, his sister Terry and his devoted assistant, Debbie Lazar with

whom he worked most closely since 1975.

Safety AllianceWhat is a Safety Alliance?

A Safety Alliance is a partnershipamong builder/developers, tradepartners and subcontractors withsafety experts. The Alliance focuseson all construction for residentialas well as commercial construction.It welcomes all size companiesregardless of the number ofemployees, pulled permits or payroll.

What is the purpose of aSafety Alliance?

The primary purpose of a SafetyAlliance is to reduce work placeaccidents through awareness andeducation. It features include:

• Establishment of minimum safetyrequirements to eliminate confu-sion from one jobsite to another

• Monthly 2 hour training sessionsof variety of topics, including butnot limited to: electrical, fallprotection, PPE, trenching, cranesor any other subpart found in theCode of Federal Regulations 1926(Construction Industry) or 1910(General Industry).

• Recognition from OSHA TrainingInstitute (OTI) and the Universityof Southern Florida (USF) for yourefforts to create safe work site.

• Potential reduction of finespossible if good faith is shown.

• The ability to join together as alocal to share best practices,openly discuss ideas and obtainconsultative expert opinions

• Comprehensive library ofresources: safety manuals, articles,organization and website.

• Continuing education creditsavailable on some educationalsafety material.

A secondary purpose of the Allianceis the ability to partner with twoimportant safety resources: the OSHATraining Institute and the USFSafetyFlorida Consultation Program.With completion of the 12 trainingmodules (12 months), you couldqualify for acceptance into a specialprogram that would provide as muchas a two-year amnesty from receivingany citations from the OSHACompliance Division.

Who should attend theAlliance meetings?

A designated safety representative orthe individual responsible for conduct-ing safety training within your organi-zation is the appropriate person.

What are the benefits of theSafety Alliance to my business?How will this impact myday-to-day operations?There are two compelling benefits to

joining a Safety Alliance:•OSHA Compliance – With regular

participation in the Alliance’straining program, you will be ableto comply with OSHA’s sitetraining. By attending monthlysafety workshops, training yourstaff within 30 days from thedate of the training sessions andcompleting the appropriatedocumentation, you meet theneeded requirements.

• Reduction of Workplace AccidentsThe long term goal of a successfulAlliance program is the reductionof work place accidents. Throughthe combined efforts of alliancesacross the state, the builders ofFlorida can demonstrate how theconstruction industry does not needto be classified as a high hazardoccupation and as a result, enticemany competitive workerscompensation carriers into the statealong with the reduction of rates.The financial savings will be theability to access more insurers andcompetitive rate plans.

Will being involved with anAlliance put my business atrisk by OSHA?

No, not only will your business notbe at risk, but also if for some reasona Compliance Officer does visit yourjobsite, you can use your Alliancemembership as evidence that you areworking towards improving safety.While it may not eliminate any poten-tial citations, the Alliance membershipmay help you to receive a reduction inany fines or penalties.

How do I qualify for membership?You must be a member of BASF.

Does it cost anything to join aSafety Alliance?Yes. Membership dues are determinedby the number of employees.The fees are as follows:

0 - 8 employees $300 (1 attendee)9 – 15 employees $600 (2 attendees)16+ employees $900. (3 attendees)

Who dictates what the subjectmatter of the training is?You do, along with the othermembers of the BASF safety alliance.The Partnership requires a 2-hourtraining program each month;however, you and your peers decidewhat training you would like to havefor your job sites.

Are there any other benefits to theSafety Alliance Program?

Each month the selected safety-training topic will be presented toyou for submission into your SafetyAlliance binders. Along with the train-ing material, you will also receiveshortened version for you to take tothe job site and train your employees.In addition, there will also be a sign offsheet for your employees to sign indi-cating they have received the trainingonsite. At the end of the twelvemonths, you will have at least 12 safetytopics covered, at least 24 hours ofsafety training, a complete manual ofsafety training subjects along with theappropriate sign off sheets. If, for anyreason a Compliance officer visits yourjob site, you will be able to showwithout any hesitation that you havea safety program in place along withthe required sign off sheets.

In addition, at the end of 12 months,you will receive a certificate fromUSF SafetyFlorida indicating youhave been a member of a recognizedSafety Alliance for you to post onyour jobsites.
