ROBIN KICK

CO N S U LTA N T

Robin is an independent wine consultant,

fine wine specialist, wine judge, journa-

list and educator. While working as an

English lecturer at the Université de Nice,

she changed career paths in 1998 following

studies at the BIVB in Beaune, Burgundy

and the Université du Vin in Suze-la-

Rousse, France.

In 1999, she moved back to the U.S. to

work as a wine auction specialist for

Christie’s in Beverly Hills, California, where

she helped procure, estimate and authen-

ticate wine collections, including that of

the great Henry E. Singleton. Four years

later, she relocated to the UK where she

spent ten years working within the London

wine trade, pre-eminently as the fine wine

buyer for an award-winning merchant

renowned for its Burgundy and Bordeaux

list. Today, she is only one of five Masters

of Wine residing in Switzerland amongst

342 worldwide.

Switzerland. At the age of 20, he discovered

the world of fine wines in which he showed

immediate interest with the help of the best

local experts who told him all you need to

know about wine tasting.

In 1983 he opened the first vinothèque, in

the Canton of Valais, Vinothèque Nobilis.

Three years later he was launching the first

Wine Competition of the Valais canton,

which is the only official contest today.

Dominique Fornage has sat on a number of

national and international panels of judges.

He also leads masterclasses on wine and

wine tasting in several government schools.

As an expert, his preference goes to the

finest regional wines throughout the world,

from the French motherland to Argentina.

Today his exclusive wine masterclasses are

famous throughout the whole of Europe.

V ICTOR QUEVAL

CO N S U LTA N T

Victor was born in Paris and lives in the

Asia-Pacific region since 1999. His passion

for wine started during his childhood while

on summer holidays in Medoc.

After his studies in Australia, Victor

moved to China in 2002 to organize

several high profile events such as the World

Economic Forum opening dinner in Beijing.

Since then, he has developed his own wine

& spirit business by designing custom made

wine cellars for Chinese celebrities.

Victor is a member of the prestigious

Bordeaux wine society “La Commanderie

du Bontemps” and holds the Swiss Hotel

Association Diploma in International Hotel

Management. He speaks French, English

and Chinese Mandarin.

Michael Ganne is originally from the

Médoc region of Bordeaux and naturally

chose to dedicate himself to the wine

business. Yet his unswerving taste for novelty

spans beyond the great Bordeaux wines.

A graduate of the International Vine

and Wine Office with a Master of Wine

Management, Michael has visited more

than twenty-four countries and met with

the most influential people in the business.

We owe Michael some of the most

glamorous world records when he was

Head of Continental Europe for the Wine

Department at Christie's, such as the most

expensive Bordeaux Cheval Blanc 1947 or

a Burgundy Romanée Conti 1945.

Strong promoter of the great vintage

bottles he unearths and relentlessly looking

for new perspectives, Michael became

Executive Director of Baghera in 2015.

Ju l i e Ca r pen t i er’s pa st i s deeply

rooted to the Loire valley. These regio-

nal origins may very well have given her

the desire to take the plunge and work

in wineries and vineyards. Yet it may

simply have been the encounter with her

husband-to-be, an accomplished winema-

ker… In a former life, Julie studied Art and

Archaeology at the École du Louvre before

joining Christie's Wine Department where

she dedicated her expertise to wines and

spirits.

A graduate from WSET also, Julie has

shown a remarkable understanding of

native varietals together with an overall

taste for exceptional and unique products.

Thus, when Michael asked her to join

Baghera, she did not hesitate to be part

of the venture as Wine Strategy Advisor

within the team.

Emmanuel Mercé studied History and

Art History in Paris. A whisky connoisseur

and lover, at the age of 25 he launched on

an epic journey of the finest distilleries in

Scotland. Fate had him knock on the door

of Christie's Wine Department ; a fortunate

coincidence since it led him to meet with

Michael Ganne with whom he was to work

at Baghera ten years later.

the Wine & Spirit Education Trust,

Emmanuel organised auctions in Paris

and Geneva and was involved in several

projects for the United States as well as

China. He particularly enjoys supervising

charity auctions which he believes fully

are at the heart and soul of wine.

Dear friends,

After the exhilirating launch of our Wine o'clock sales last

March – which we sincerely hope you enjoyed – we are proud to

invite you now to share our Master Cellar sale. We took great

pleasure in preparing it and have designed it to be absolutely

memorable in all ways !

The title “Master Cellar” quickly made sense to me. I’m leaving

the battle for record figures to others, but it is absolutely exceptional

to have access to a wine cellar which offers more than 1,400 bottles

of Domaine de la Romanée-Conti wines, preserved in perfect condi-

tion for years in the Port Franc safes in Geneva. The Domaine, who

know this collection well, have always had the earnest ambition that

connoisseurs should take pleasure in opening, tasting and sharing

their wines.

I was very amused by the reading of a French "Roman noir", in

which the hero, madly passionate about wine, finds himself on a long

waiting list to buy Henri Jayer’s wines directly from the domaine.

This man, incapable to resign himself to such a long wait, decides

to hunt down and kill every person preceding him on the list in

order to have direct access to the Holy Grail… Those on the waiting

list for the Domaine de la Romanée-Conti shouldn’t worry : 266 lots

of D.R.C. in this sale should satisfy many of its eager amateurs !

Reducing this Master Cellar auction to the Domaine de la

Romanée-Conti only would be unfair, as the Bordeaux selection is

also a pure delight.

How can you not tremble when faced with the most prestigious

wines from both ends of Bordeaux ? Is it not every collector’s dream

to be magically transported back in time and purchase rare bottles

of Yquem, sometimes as old as 170 years of age, all coming from

one of the greatest Swiss wine cellars which have been protecting

the precious beverage…

While sharing an 1876 Yquem with the seller, a real character,

vibrant with innovation and enamoured of tradition, I understood

to what point his taste for sharing, his simple and sincere hedonism

should be essential aspirations for us all, whatever our ambitions

and our means.

The notion of “luxury” that we lock wines into so quickly,

cannot be reduced to the label on the bottle, but should be appraised

on the quality of the land and the producer. It’s through these

criteria that the exceptional and even the irrational are revealed !

We reserve special temptations to Cigar connoisseurs at the end

of this catalogue, at a time when Cuba is opening its doors. This

selection invites you to end your evenings with the inexplicable,

adolescent-like pleasure of blowing smoke rings.

This whole sale would not be possible without the enthusiastic

support of the whole Baghera “family”, whom I thank graciously.

And again, I would also like to pay a tribute to the wine producers'

hard work, who, come wind, come snow, pass on their exceptional

nectars to us wine-lovers, thirsty for rarity and refinement ; this

catalogue is a homage to these people and their wines – we are only

spreaders of joy. I leave you with full access to our wine cellar…

Burgundy but in all of France, (and possibly the world),

which is often referenced by only its abbreviation - DRC.

Unique in many respects, it is also one of the few within the region

to produce exclusively grand crus (apart from an occasional 1er cru

produced from declassifi ed grands crus) of which the majority lie in

what historically is known as “Le Perle de la Côte”, Vosne Romanée.

Desp i t e be i ng t h e u nqu est ion ed lu m i na ry of t h e Côt e

d’Or, the domaine still prefers doing things slowly, simply and

traditionally. For example, up until and including the 1999, its

wines were generally bottled barrel-by-barrel, artisanal beyond

comparison. Though today they are blended for better consistency

(6 barrels at a time), barrel-by-barrel bottling was a practice that

trickled down through the generations. For years they have included

the stems that fed their grapes through the growing season in the

fermentations of their wines – a practice that dates from centuries

back. And despite being a long-forged tradition, their use of “whole

bunch” has inspired the present and next generation of winemak-

ers across the world, and as far as the West Coast of America and

New Zealand.

How e v e r , de sp i t e t h e i r t r a d i t iona l ta k e on t h i ng s ,

Domaine de la Romanée-Conti has long been experimenting with the

way they do things, such as with vineyard treatments, whole bunch

amounts and barrel sizes to name a few, just to fi nd the perfect

tuning instruments to enable their wines to sing at perfect pitch.

I t s e e m s t h a t t h e y w i l l n e v e r j u s t r e s t o n t h e i r

laurels and when Aubert de Villaine, its current curator, passes the

torch to his nephew, Bertrand, its eternal fl ame will continue to burn.

separates the Romanée-Conti vineyard from the outside

world is what many might consider standing before the

Holy Grail. Despite its towering stone cross placed fi rmly at the

threshold, asserting its sacredness, it is actually a modest looking,

quiet vineyard – much like the domaine itself. Yet, the power there

is real.

O n e won der s a bou t t h e e xt e n t of t h e m ag ic t h at l i e s

on the other side. It, of course, produces the most profound, and

storied wines even amongst other deifi ed crus, but could Romanée-

Conti’s enchanted soil also give eternal youth, redemption or the

same infi nite luck that the Blarney Stone might bestow with a

kiss? Very few know its secrets. Even if one’s conscience does not

instinctively kick in, there is a gentle sign asking you to respect

the vineyard and not enter. In any case, true magic is best left

undisturbed.

H ow e v e r , i t i s no s e c r e t t h at Rom a n é e- C o n t i i s a

once-in-a-lifetime wine. If one is fortunate to savour it more than

once, he or she is amongst the most blessed. Even Aubert de Villaine

never spits Romanée-Conti and the fresh sawdust in the bucket at

the foot of the barrels is proof to that.

It i s not a w i n e t h at i s e a s y to u n der sta n d, how ev er .

It is rarely open when young and demands the discipline of a

Cistercian monk to wait for the right moment in its maturity to

drink it. But the depth and complexity are unmistakable at any

age, and despite it being the most brooding, mineral, powerful and

even stoic of the Domaine de la Romanée-Conti stable, it remains

wonderfully refi ned, ethereal, transcendental. What other wine can

carry these attributes forward vintage-after-vintage? None other

La T â c h e i s a r g u a b l y t h e m o s t r e v e r e d r e d

Burgundy and while it has undeniable density and power, it is

its consistent sweet fl esh, limitless layers and perfume that

entrances, causing even the most cynic and strong-willed to weaken

at the knees. From a magical fi rst sip of the 1979 in magnum in

1999 to the most recent tasting of its 2014 in barrel, from lesser

vintages and exceptional ones, it is utterly mesmerizing. Tasting its

latest vintage amidst a choir of barrels, I could not help but feel

that La Tâche was like a siren’s song, pulling one in, enchanting

the spirit and drowning out all reason.

Th i s m y t h ic a l w i n e h a i l s f rom 2 d i f f er e n t c l i m ats –

La Tâche, its historical core, and the larger Les Gaudichots ou

La Tâche. This last climat has an unusual, somewhat unclear history

which was originally only called Les Gaudichots, a name, which

is still used for 3 small parcels of premier cru vineyards and even

one village, though the premier cru is fairly rare.

According to Allen Meadows in The Pearl of the Côte ,

in the past wine produced from Les Gaudichots was often labelled

as Tache, Tâche-Romanée, Tâche-Gaudichots and even La Tâche,

while the sale of some of its parcels were also referenced as La

Tâche, though not coming from the actual La Tâche vineyard. This

led to an eventual renaming to “Les Gaudichots ou La Tâche” in

the fi rst half of the 20th century. Today, both parcels combine to

create this extraordinary wine. La Tâche is the Domaine’s largest

Musigny that is amongst the most cited for being the most

sensual, perfumed, intense, desired. Even its name, which

rolls off the tongue like velvet, evokes something of beauty and luxury

- like a Rodin sculpture or Titian’s rendition of “Venus of Urbino”.

Allen Meadows, Burgundy’s most revered critic, declared in his book,

The Pearl of the Côte, “Richebourg conveys every aspect of a great

Burgundy: a soaring and decadently spicy nose, seductive richness,

power and energy, all wrapped in a mouth coating, velvety and mineral-

driven fi nish that knows no boundaries.” And “Yes, Richebourg can

be as dramatic as Romanée-Conti when it fi nally matures.”

It i s not t h e on ly con n ect ion t h at R ich ebou rg h a s to

Romanée-Conti. Parcels within the two vineyards were the last to

be replanted by the domaine in 1946 following the 19th century

phylloxera devastation. The ancient pre-phylloxera Richebourg vines

were picked and vinifi ed separately from the newer plantings up

until (and including) 1945 and were labelled as “Vigne Originelle

Française Non Reconstituée” or “Richebourgs Vieux Cépage” [sic].

Needless to say, these pre-phylloxera bottlings embody another level

of density and complexity and are incredibly rare…and dear.

Richebourg is a stupendous, soul stirring wine. It was the wine with

which I was fortunate enough to celebrate the achievement of my

Rom a n é e St. Vi va n t i s proba bly cons i de r e d b y

most to be the most elegant, ethereal, lacy and refi ned

of all the Vosne-Romanée grand crus. Apart from the

monopole vineyards of La Grande Rue, La Romanée, La Tâche and

Romanée-Conti, it has the fewest number of owners at 10. Like all

of their other Côte de Nuits vineyards, Domaine de la Romanée-

Conti is the largest owner by far with 5.28 ha out of a total of 9.44.

Th e i r e xt ens i v e hol di ngs a r e d i v i ded i n to 4 d i f f er en t

parcels, which are viewed at different quality levels with the least

“good” parcel – which ironically lies right next to Richebourg – often

being declassifi ed and sold off to another producer. Yes, one could

drink Domaine de la Romanée-Conti’s Romanée St. Vivant (albeit

not the one they intended) and not even know it.

Be f or e t h e a r r i va l of DRC’s Cort on i n 2 0 0 9 , t h e i r

Romanée St. Vivant was considered the “new kid on the block”.

They received the parcel in 1966, making it, well, not new. But the

condition of the vineyard and the quality of the vines were not in the

most stellar condition, and so over the years the domaine has given

this vineyard much need care and attention to attain the potential

quality level that is achieved in its other vineyards.

Today, i t v i e s for 4 t h p l ace j ust beh i n d R ich ebou rg i n

the domaine’s qualitative hierarchy. But an important consideration

is the context in which a wine is enjoyed. Sometimes a gentle and

beautiful ballet such as Giselle feeds the soul far more than Wagner’s

Die Walküre and in these moments, Romanée St. Vivant would be

Despi te “Gr a nd” be ing part of i ts name, Gr a nds-

Échézeaux was not titled as such from being a more

qualitative version of Échézeaux. Rather, it originates

from its original name, Échézeaux du Bas, which was the larger

half of the original Échézeaux vineyard, Échézeaux du Haut, now

called du Dessus. Nonetheless, it is also a much bigger, more struc-

tured wine.

It i s a rgua bly on e of t h e l e a st k now n or u n der stood

grand cru vineyards within Vosne-Romanée, as it does not have

the same tenderness as Échézeaux, nor the allure of Richebourg

nor the off-the-chart intensity and complexity of Romanée-Conti.

Its “m a r ket i ng progr a mme” per h a ps di d not gi v e i t the

attention that it deserved either, as it is thought to have been

blended for many years into neighbouring Clos de Vougeot (by

other producers than DRC), so older bottles are challenging to fi nd.

In addition, its holdings amongst producers tend to be small, apart

from Domaine de la Romanée-Conti and Mongeard-Mugneret its two

largest owners, making it a lesser visible grand cru.

Yet t hose w ho u n der sta n d a n d k now t h e w i n e s , r at e

them highly, and its greatest bottles are generally considered

more profound, sleek and muscular than any either of its direct

neighbours.

Au bert de Vi l l a i n e e x pl a i ns t h at de sp i t e h i s Gr a n ds-

Échézeaux parcel almost touching neighbouring Les Pouillaillères (of

Échézeaux), its soil is completely different. The topsoil is deeper and

more clay-based which casts a rigid framework to its core, making

Grands-Échézeaux one of more masculine, taut and chiselled grand

crus in Burgundy and as a result, more discreet with a less overt

personality. As would be expected, boots are required for several

days after a rainstorm.

A v i n e ya r d of m a n y vo ice s , Éch éze au x h a s t h e

most climats of any grand cru in Vosne-Romanée and

only ranks second to Clos de Vougeot in the Côte de

Nuits in size. A notable 11 lieux-dits reside within the Échézeaux

appellation and as a result its incarnation could have a number

of personalities depending on the quality of its terroir. The fi nest,

though, tend to offer an appealing gentleness, freshness, refi nement

and subdued complexity – a harmonious completeness in itself.

Th e Éch éze au x at Dom a i n e de l a Rom a n ée-Con t i on ly

comes from 2 of these climats – Les Poulaillères, the largest of the

climats which produces 90 % of their Échézeaux, followed by Clos

Saint-Dénis, the second smallest parcel amongst the climats. These

soils are more upslope and less shallow than neighbouring Grands

Échézeaux, and according to Aubert de Villaine, one can walk in

the vineyard in slippers several hours after a rainstorm!

owner amongst 84 in total, making this vineyard along with Clos de

Vougeot, the most owned grand cru in the Côte de Nuits.

Sm a l l e nough to be cons i de r e d Dom a i n e de l a

Romanée-Conti’s unicorn wine (only 2000 – 4000 bottles

produced annually), but perhaps not a unicorn amongst

unicorns. In this latter case, it is its Bâtard-Montrachet that is its

true rarity, where a mere 0.13 ha is used to produce a “house” wine

for entertaining purposes. Nevertheless, it is its Montrachet that has

garnished the reputation as the greatest white wine in the world.

Even the rarer Bâtard might be jealous.

Th e v i n e ya r d i t se l f h a s long be e n k now n to produce

exceptional wine with prices to refl ect its quality. Jasper Morris MW

states in Inside Burgundy that Thomas Jefferson, the 3rd American

president and keen oenophile, wrote in a journal that Montrachet

was worth 8 times the amount of Meursault 1er Cru La Goutte d’Or.

vintage that I ever tried, and though it was from just an average

vintage, I understood why Alexandre Dumas called Montrachet, a

wine to drink "on bended knee, with head bared." It was transcen-

dental, unlike any other white Burgundy that I had had at the time.

greatest Burgundy domaines, Domaine Rousseau would be

among them. The domaine has been in the family for four

generations, and while there feels to be a seamless fl ow from one

generation to the next, they each have added their own unique and

important contributions.

A r m a n d Rousse au, not on ly fou n ded t h e dom a i n e bu t

was amongst the fi rst wave of Burgundy producers – alongside

Ponsot, Roumier, Gros, Lefl aive, Gouges and D’Angerville - who

began bottling his own wines in the 1930s rather than selling to

négociants. Armand’s son Charles created their extensive export

ties, and by the 1970s their wines were found as far as Australia,

New Zealand, the Far East and Brazil – an incredible network for

a Burgundy estate at the time. His work was further extended by

his son, Eric and Eric’s daughter Cyrielle will no doubt add her

own contributions to this exceptional domaine as well. It is sad

but true that if you want an allocation today, the queue might be

about 20 years long!

Rousse au’s v i n e ya r d hol di ng s w i t h i n t h e com m u n e of

Gevrey-Chambertin are the most impressive, and this is true even

amongst the goodly number of excellent domaines found here. Out

of the nine grand cru vineyards, they have vines in fi ve of them,

including its two greatest – Chambertin and Clos de Bèze – plus

in the Morey Saint Denis grand cru, Clos de la Roche. They also

produce wines from three of the best regarded 1er crus – Clos St.

Jacques, Lavaut St. Jacques and Cazetiers.

Bu t i n a ddi t ion to t h e i r w i n e s’ u n dou bta bl e l i n e age ,

one cannot help but be moved by their inimitable grace and style.

Pure, perfumed and elegant, they are ethereal yet profound and

never mask their underlying terroir.

I have been tongue tied about writing a tasting note…Rousseau’s

1985 Chambertin. It was so perfect in that moment that any sort

rolling hillsides and gorgeous weeping willows that

decorate the property’s lakes and gardens, Château

Lafi te could easily be the setting of a Fragonard painting or a

home in Gone with the Wind. It is situated on one of the most

elevated plateaus in the Médoc at a mere 27 metres high above sea

level. Compared to other wine regions like the Mosel, Côte Rôtie

or Barolo, its hills are actually more like mounds, which under-

standably inspired the Château’s name (“fi te” meaning “mound”

in Médocain).

While , i ts Château is certa in ly a stately home, r eplete

with paintings depicting hunting scenes and Rothschild ancestors

and richly coloured walls, it still feels congenial and understated.

So, when tasting its wines, one is not surprised by their refi nement

either. Brilliant ruby rather than purple, poised rather than muscular,

the ethereal style is one of pure elegance at its fi nest and one

cannot help but wonder if the wines made at the estate 200 years

ago were similar. Despite the advancements in grape growing and

winemaking, one could easily imagine so.

Bu t ev e n Bor de au x’s most t r a d i t iona l Fi r st Grow t h

can surprise. A wine savvy friend was once given a white wine to

taste blind at a dinner party. The bet was that if he guessed the

wine correctly, the one who started the bet would buy him a case

of 1959 Lafi te – quite an impressive prize.

Th e on e w ho m a de t h at bet k n ew h i s propos i t ion c a m e

with little risk because the white wine was in fact… Lafi te Blanc

1955 – one of the rarest wines ever produced. At one point, the

Château made small amounts of white wine, called Vin de Château

Lafi te, from mostly Sémillon accompanied by Sauvignon Blanc. Its

last vintage was 1960 – a notable a 56 years ago. A unicorn amongst

unicorns… and a sure bottle to ensure a losing bet !

The old a dage stat i ng, “don’t j udge a book by i ts

cover”, of course means that some things look different

than they actually are. But in terms of many Bordeaux

châteaux, I have found that their properties’ exteriors are often

refl ected in their wines. Château Latour is no exception.

Unl ike the fem in ine turrets of M a rgaux or H aut Br ion

or the lush Loire Valley-like gardens of Lafi te, Latour casts a differ-

ent stance with its sturdy dovecote, its closed-in courtyard and its

imposing gated entrance – the effect is almost museum-like rather

than that of a wine estate.

Their Gr a nd Vin i s gener a lly not for those w ho prefer

a light touch. Rather, it tends to command like the greatest generals

and sometimes takes no prisoners. The most closed, dense, powerful

and opaque wine I ever had in my life was the 2005 Latour when

tasted out of barrel. It was mind-blowing in its intensity, and it took

one full year, when I retasted it again, before I could see what might

become of this behemoth. Perhaps a bit of a modern day 1961.

Non et h e l ess , L atou r i s a w i n e t h at h a s ch a nged ov er

the years as well, and today one might describe it as the most

modern of the First Growths in style due to its intense purple colour,

density and concentration of fruit.

A n u m b e r o f f a c t o r s h av e c o n t r i b u t e d t o t h e s e

changes. Like top performers in the region, yields have been cut

and for First Growths like Latour, the production of their Grand

Vin has decreased dramatically, in fact sometimes as much as by

half since the 1982 vintage. The primary reason for this is that

they now use only the best barrels while those of lesser quality are

blended to produce other wines.

Th e i n t roduct ion of a bl e n di ng vat l a rge e nough to

house an entire harvest (or 3 Olympic-sized swimming pools) in

2000 also ensures greater bottle consistency. And in recent years,

they have been experimenting with biodynamic farming, and gentler

viticultural practices such as horse-ploughing to make the soil less

compact.

Yet, desp i t e i t s moder n i sat ion a n d i n novat ion, i t st i l l

feels very much like a family-based operation. Much of its staff

has worked there for many years, some as many as 25 or more.

It also owns small and unique properties in Burgundy (Domaine

d’Eugénie), the Rhône (Château Grillet) and California (Araujo),

further suggesting that deep down they remain very much a wine-

beautiful in the Médoc with its Napoleonic-era plane trees

lining its entrance and its inviting butter-yellow exterior.

In many ways it looks like it might have been swept from the pages

of a Jane Austen novel – a nobleman’s abode in the Cotswolds or

Somerset, where waistcoated men on horseback and barking dogs

prime themselves for a fox hunt. It is classical and stately, but

not pretentious. Many of those same attributes can be found in its

wine as well.

Very few Bor deaux propert i es m a ke the i r ow n ba r r els,

but those that do include Château Lafi te, Château Petrus and Smith

Haut Lafi tte and Château Margaux, though for the latter, they

only for about 30% of their needs. Nonetheless, their support of

an artisanal trade adds to the Château’s classic appeal. Plus, it

enables them to control the entire quality of their production from

the growing and picking of their grapes to the vinifi cation and

ageing of their wines.

D e s p i t e b e i ng c or r e c t ly v i e w e d a s v e r y m uc h o f a

traditional château, after 205 years, they decided to embark upon

a substantial renovation of their cellars in 2015. Norman Foster,

the architect behind such revered creations as “The Gherkin” in

London, designed their new facilities to include separate vinifi cation

rooms for both red and white wines, a renovated cooperage area as

well as a glass-walled tasting room. Though most of the changes

are underground (apart from the new vinifi cation facilities), those

visible to the visiting eye were intended to have similar lines as

their old cellars. So, tradition remains, but with a modern touch.

It i s n o s e c r e t t h a t M o u t o n -R o t h s c h i l d wa s a

latecomer to the Premier Grand Cru Classé party. While

there has been discussion over the years as to whether it

deserved this title, for the last several decades, it has more than

demonstrated that it can deliver stunningly good quality, an in

some vintages has even produced what many would call the “wine

of the vintage”.

A mong st r ec e n t v i n tage s , t h e 2 0 0 6 i s a n i ncr e d i bly

impressive wine while their 1982 remains one of my utmost favour-

ites. If a bottle has been well-stored, the 1982 remains fl eshy, with

sweet, vibrant fruit and mouth-coating velvety tannins. As the taster

in charge of opening and checking cases of 1982 First Growths at

a charity event several years ago, I also discovered that it was also

the most consistent amongst its peers on that specifi c day, with little

bottle variation. The experience echoed what the inimitable Baron

Philippe de Rothschild poetically stated upon Mouton’s ascension

into the prestigious First Growths, "Premier je suis. Second je fus.

Mouton ne change." (First I am. Second I was. Mouton does not

change").

It s w h i ms ic a l “l e a p i ng l a m b” l a be l de s ign ed by Joh n

Huston, American fi lm director and artist has further added to this

wine’s iconic status and is also a reminder that wine, and notably

Mouton’s 1982, can bring such joy. But other compelling labels

have also graced Mouton’s bottles as part of their artist programme.

Works by Picasso, Chagall, Mirò, Francis Bacon, Dali, Warhol and

even HRH Prince Charles have decorated various vintages, but

arguably the most controversial one was Balthus’s sketch of a nude

reclining nymphet for the 1993 vintage.

It i s a l a bel that the Château descr i bes a s “the dream y

adolescent girl, wilful, graceful and fragile… All the hypnotic power

of a style that is both limpid and full of mystery, leading us away

to distant lands of fantasy and desire.” It was too steamy for some

and to respect a part of public opinion, the Château removed the

nymphet from the label for wines bound to the United States, leaving

only the beige background in place.

Wh i l e t h e 1993 wa s not t h e Ch ât e au’s most profou n d

creation, its two labels have become highly sought after amongst

Haut Brion as the “quiet” First Growth, through-

out its history, it has actually been one of the most

dynamic estates and could even be considered as a fi rst amongst

Firsts. For example, it was the fi rst of its peers to be established in

the early to mid-1500s and within one century was already pouring

its namesake wine for guests. It was also the fi rst wine to have had

a professional wine review in 1663 by Samuel Pepys, a distinguished

naval administrator and member of parliament who was famed for

both his diary and his vinous adventures. In addition, in 1666 its

then owner, was the fi rst to open an offi ce overseas in London to

promote and sell its wines. Finally, as if to crown its unbroken 300

years of success, in 1855 it was the fi rst (and only) Graves property

to be included in the Médoc classifi cation.

In terms of w inemak ing, i t was the f irst to age i ts w ines

in barrel longer, creating a more ageworthy wine and in 1961, it was

the fi rst to introduce stainless steel tanks for vinifi cation (Château

Latour followed their lead in 1964).

For many collectors, Haut Br ion is a lso their favour ite.

Poised, powerful and noble, it often has the feminine charm of

Margaux, allied with Zen-like harmony of Lafi te and the fl amboyancy

of Mouton. Due to its clay subsoil, it also has the most Merlot

planted of all the First Growths with almost 50%, which may come

as a surprise to some. As a result, there are vintages where Merlot

is the dominant grape variety, and this contributes to its lushness,

particularly in warmer years.

While not t i n y i n product ion at a pprox im ately 1 40,000

bottles per year, it still only amounts to about 30% of Château

Lafi te’s annual production and about half that of Latour’s, Mouton’s

and Margaux’s, making Haut Brion the scarcest First Growth that

all of the Right Bank. Located at the end of a slinky

steep road and perched atop St. Emilion’s Roman ruins

and famed limestone cliffs with beautiful vistas overlooking the 11th

century village, one feels on top of the world, yet gently protected.

There is a sense that life is calmer, slower and more genteel here,

quite different from the hustle and bustle of village activities below.

I t i s on e o f t h e f e w gr a n d p rope rt i e s i n B or de au x

which is still owned and run by one family, the Vaultiers. Even

rarer, they are only the 3rd family to own this incredible estate

since its creation.

I n m a n y r espects, i t i s r em in iscent of a top Burgundi a n

estate in the continuity of its ownership and to a lesser degree, its

limestone and clay-based soil, which is the envy of wine producers

across the entire Bordeaux region. Its website, well, it just doesn’t

exist – at least not at the time of this writing. There is no pomp or

pageantry, just a selection of incredible wines from their entry-level

St. Emilions to their Grand Vin, Château Ausone.

D u e t o t h e c h a r ac t e r i st i c s of t h e i r so i l a n d t h e i r

meticulous winemaking, Château Ausone’s Grand Vin displays

notable minerality and purity and is one of the most ethereal wines

of the region, despite embodying notable power and intensity. While

the quality of their wines has reached even higher plateaus since the

1990s, their rare, older bottles, tell another side to Ausone’s history

and character – one of gentle enchantment and charm.

A n u m be r of y e a r s ag o , a grou p com pr i se d of

some of the greatest Bordeaux specialists in the world,

including Masters of Wine, long-established journalists

and renowned merchants, were asked which single Château they

would choose to own strictly on the characteristics of its wine. The

majority without hesitation chose Château Cheval Blanc.

Wi t h on e s i p of i t s v e lv et y t e xt u r e , on e i s e nch a n t ed

by its seductive curves yet subtly fi rm backbone. Its distinctive

style is a combination of its fl irtatious personality and intellectual

prowess, which is due to at least two different phenomena. The fi rst

is its unique location, straddling the soil types of both St. Emilion

and Pomerol. The second is its blend. It is reputed to have one of

the highest percentages of Cabernet Franc on the Right Bank, the

region’s unsung hero, of 49 % with the rest being majority Merlot

and a splash of Cabernet Sauvignon.

Desp i t e i t s r ece n t ly r e novat ed ce l l a r s be i ng wort h y

of a James Bond fi lm set, its wine has never been featured in any

of the Bond movies unlike a certain newly promoted neighbour.

However, it did play a signifi cant role in one of the wine world’s

most infl uential movies, Sideways.

Throughou t t he mov i e t he psychologic a l ly st ruggl i ng

protagonist expresses his contempt for Merlot and his disappointment

in Cabernet Franc. But, in a scene near the end of the movie,

he reverently opens his only sacred bottle of 1961 Cheval Blanc.

The embedded irony between his dismissive words about these

grape varieties and his overt admiration of a wine that is based

on those varieties, naturally enough engendered much discussion

about the intrinsic contradiction of the role Cheval Blanc played.

And while sales of Merlot plummeted afterwards, Cheval Blanc still

remained one of the most sought after wines in the world, proving

yet again that the world’s greatest wines are always more than the

taking village with perched plateaus, naturally

sculpted limestone rocks and even a vast network

of underground tunnels, Pomerol remains quiet, remarkably fl at and

unassuming. Just driving through it, one would never to expect to

fi nd some of Bordeaux’s greatest and most expensive wine estates

such as Le Pin, Lafl eur, and Evangile. There were even stories that

if you sneezed or did not look carefully, one might even drive right

by Petrus unknowingly. It was that discreet.

For a long t ime, i t rema ined one of the most tr adit ional

cellars you could visit. Old fashioned eggshell white concrete vats

painted with red trim à la 1950s, complemented barrel rooms that

looked as though they had been untouched for decades. There was

pleasure in seeing its wine’s rustic upbringing juxtaposed against

its utterly genteel, noble lineage. But in 2005, a renovation was

deemed necessary and the cellars and barrel rooms were upgraded

and its sign became a much more visible fi xture.

It s en t i r e e stat e l i e s on 40 m i l l ion-y e a r-old Smect i t e

blue clay, an incredibly dense soil which is unique to Pomerol. But

Petrus is also the only wine property in the region to have it exclusively.

This clay contributes greatly to Petrus’s intense, structured and

daresay masculine style, which demands years of cellaring for its

true character to emerge.

Bu t ce l l a r i ng i s not a l l i t s r equ i r em e n ts. Of a l l t h e

times that I have tasted Petrus blind at a dinner, it has never come

out fi rst… or even second. Rather, it was at the end of dinner,

and when the other wines were fading, Petrus started to blossom.

Why ? Because Petrus is not like other wines and to truly appreciate

its genius, it requires aeration and proper decanting, the timing

of it all depending on the vintage and age of the bottle, of course.

within the region of Sauternes. No other château even

comes close to effortlessly combining lace with power,

culminating into a form of feminine prowess. Some have even

wondered if its magical elixir might have transformative proper-

ties since even just a small sip is rumoured to lift a soul into the

heavens above.

Since the late 18th century, it has burnished its reputation

as France's fi nest sweet wine and in doing so, captivated dignitaries

such as Thomas Jefferson and Napoleon, noblemen and the world's elite

collectors with its nectar-like persona. It further added to its reputation

by capturing the only top position of the 1855 Sauternes classifi -

cation as Premier Cru Supérieur.

It i s sa i d t h at on e v i n e produces on e gl a ss of Ch ât e au

d’Yquem, compared to one bottle per vine for Bordeaux's top reds.

This demonstrates not only the incredible concentration necessary

to produce such fi ne Sauternes, but also their high, uncompromising

level of selection. They are even known to declassify an entire crop

in years such as 1910, 1915, 1930, 1951, 1952, 1964, 1972, 1974,

and 1992 and as recently as 2012.

Fro m 19 59 u n t i l 1 9 9 6 , w h e n t h e b o t r y t i s wa s n o t

bountiful or consistent, they occasionally produced “Y” or Ygrec, a

white wine that encapsulates the unique fl avour profi le of Sauternes,

but which is dry. However, beginning with the 2004 vintage, they

began producing “Y” every year, and it remains one of the most

unusual wines in all of Bordeaux.

I n e f fort to c a p t u r e a b i t of i t s m ag ic a l propert i e s ,

in 2006 following 30 years of research, Dior cosmetics collaborated

with the Château to produce a face cream and serum, L’Or de Vie,

from the sap of its Midas-kissed vines. They describe their sap as

an “exceptionable anti-oxidant with unequalled power”.

Wi t h i t s a p pa r e n t a n t i -ag e i ng p rop e r t i e s , i t i s no

surprise that d’Yquem is also one of the longest lived wines…

or in the words of Jancis Robinson MW, “apparently almost immortal”.

Even the legendary 1811, the “year of the comet”, has been

portrayed as still having incredible fruit and intensity. In 2011,

one of these exceeding rare 1811 bottles was purchased for £ 75,000,

making it the most expensive white wine ever sold. Its new owner,

former sommelier at Paris’s La Tour d’Argent and participant in

the legendary 1976 Judgment of Paris tasting, indicated that it

would be opened in 2017, some 206 years later. Immortal, indeed.

DESCRIPTION

Baghera Wines indicates conditions of the lots according to

four criteria : capsules, corks, labels and levels.

Even with the best of care, labels may be stained or damaged

because wines are stored in damp conditions. Such storage

conditions are beneficial to the preservation of the wines. It

is our duty to catalogue and report on wines as accurately as

possible at the time of going to press. High resolution photo-

graphs are available upon request. The actual condition of the

wine within the bottle is not necessarily linked to its outward

appearance. You are strongly advised to examine any lot you

are interested in before the sale to form your own opinion (or

have it examined on your behalf).

CORKS AND ULLAGES

Ullage refers to the space between the base of the cork

and the wine itself. Acceptable ullage levels tend to increase

with age. When speaking of Burgundy wines, commonly

acceptable levels are as follows :

• Under 15 years old – less than 4cms

• 15 to 30 years old – up to 5cms

• Over 30 years old – up to 6cms

It should be noted that ullages may change between publica-

tion of the catalogue and the sale. This may be caused by the

ageing of the cork or by a change in the temperature of the

storage conditions or the shipment of the wine. We will only

accept responsibility for descriptions of conditions at the time

of print of this catalogue and cannot accept responsibility for

any loss resulting from failure of corks either before or after

this point.

PARCELS

Same wines (producers, appellation, vintage, etc.) may be

regarded as part of a parcel.

The successful bidder on a lot in a parcel has the possibility to

purchase each of the remaining unsold lots in this parcel at the

same price, at the time of the bidding.

Note that, in this catalog, a parcel notice indicates all the

numbers of its constitutive lots on its heading line.

CAUTIONARY NOTES

– Descriptions and estimates in this catalogue may be

amended at our own discretion. Information is given orally

or in writing, before or during the sale.

– Note that some producers tend to over-fill their bottles and

a small quantity of wine may be trapped between the cap-

sule and the cork and seep. This should not be confused with

ullage (ullage is a natural occurrence in older wines, which may

be accelerated due to poor provenance).

– Although we try to indicate if a lot of wines comes from

different importers, this detail may be overlooked during ins-

pection. However, having different importers is not a defect or

grounds for returning a lot.

– On request of our sellers, the serial numbers on the bottles

may have been erased on the photographs in this catalogue.

These conditions of sale govern the contractual relations between Baghera

Wines Auction & Trading SA (“Baghera Wines”), the seller whose details are

indicated in the Sales Commission document (“Seller”), any participant in

the auction or traded or over-the-counter, as well as any bidder and the highest bidder,

excluding contractual relations between Baghera Wines and the Seller.

In case of conflict between these conditions of purchase and the terms and conditions of

sale, the general terms and conditions of sale shall prevail. These purchase conditions

can be modified at any time, in writing or orally during the sale. By participating in any

capacity whatsoever in an auction or a private sale organized by Baghera Wines discretion,

you agree to be bound by these conditions of purchase.

1. BUYER

The last bidder at the stroke of the gavel (the “Buyer”) wins the bid on the lot of items

(the “lot”). In case of dispute between two or more bidders, the lot will immediately

be relisted.

2. AUCTION PROCEDURE

The bailiff accepts the bids of those present at the sale, phone bidders as well as

absentee bidders. The stroke of the gavel indicates the final bid awarding the lot to

the Purchaser. The bailiff speaks out and records the name or number of the Buyer.

3. TRANSFER OF RISK AND PROPERTY

Once awarded to the Buyer, the risks and ownership of the lot pass to the Buyer.

4. ABSENTEE BIDDING

Baghera Wines can place bids on customers’ instruction, if you are unable to attend

the auction in person, Baghera Wines and its employees or agents cannot be held

responsible for failure in the transmission of these instructions during the auction.

In the case where two identical bidding instructions match the highest bidding, the lot

will be awarded to the first bidder.

Baghera Wines reserves the right in its sole discretion, to refuse bids from a buyer’s instruc-

tions in case the information and documents submitted as proof of identity, i.e. the identity

of the beneficial owner, should prove to be false, incomplete, ambiguous or inadequate.

5. TERMS OF AUCTION

The bailiff has the right at its absolute discretion to refuse any bid, to advance the

bidding as it may decide, to withdraw or divide any Lot, to combine any two or more

Lots. Any bid must be at least 10% higher than the previous bid. The bailiff can, however,

change this percentage during the auction. The Seller as well as any person instructed

by the former cannot bid on their own lots. Only Baghera Wines may bid on behalf

of the Seller.

6. ESTIMATE

The estimate of each lot is based on prices reached during previous auctions for similar lots.

It is subject to change and does not constitute any guarantee or indication of the actual

final sale price. The estimate does not include costs such as the buyer’s commission or VAT.

7. RESERVE PRICE

The reserve price is the confidential minimum price at which the Seller agrees to sell

the Lot. If the reserve price is not reached, Baghera Wines may reject the last bid and

set a new starting price equal to or above the reserve price. In case no bid matches or

is above the reserve price, Baghera Wines shall withdraw the lot without adjudging it

to anyone. Baghera Wines, however, reserves the right to organise a private sell after

the auction, in which case the price shall not be lower than the reserve price, subject

to agreement by the Seller for a price below the reserve price.

8. BUYER’S PREMIUM AND PRICES

The buyer’s premium is 20% plus 8% Value added tax (VAT) on the hammer price and

buyer’s premium. The total amount of the hammer price of each of lot purchased, plus

the buyer’s premium, plus VAT is the final price.

This tax (VAT) is refunded to any buyer domiciled outside Switzerland if, but only if,

Baghera Wines receives from such buyer an export declaration in respect of a purchased

lot which has been stamped by Swiss customs.

Buyers from outside Switzerland should note that local sales taxes or use taxes may

become payable upon import of items following purchase. Buyers should obtain their

own advice in this regard.

9. EXCHANGE RATES

In some auctions, in order to ensure proper information for the Buyer, a currency

converter is made available. The data displayed are provided for information only and

Baghera Wines assumes no responsibility in this regard.

10. PRE-AUCTION VIEWING

Prospective buyers are encouraged to inspect the property at the pre-sale

viewing, which can be attended at no charge by appointment only (please contact

[email protected]). Bidders accept responsibility for carrying out inspections

and investigations, during previewing, to satisfy themselves as to the lots in which

they may be interested.

Baghera Wines may also provide condition reports. The absence of reference to the

condition of a lot in the catalogue description does not imply that the lot is free from

faults or imperfections.

11. NO WARRANTY

Baghera Wines only acts as agent to the Seller. The sale is passed directly between the

Seller and the Buyer. Baghera Wines shall not be responsible for any defects in the lots

nor do we guarantee the accuracy of the information concerning the producer, origin,

date, age, authenticity, provenance, weight or condition of any Lot. None of Baghera

Wines agents have authority to give any guarantees in this respect.

All statements made in catalogues, advertisements or brochures concerning Baghera

Wines sales only express opinions and are no guarantee from Baghera Wines or the Seller.

All persons concerned are expected to inquire before the auction, about the description

and condition and of the lots and of possible defects or possible damage or repairs which

have been, or need to be, carried out.

12. BIDDERS IDENTIFICATION

Bidders who have not previously participated in a Baghera Wines as a buyer or seller

must register with Baghera Wines prior to the auction, or on the day of the sale, at

least 30 minutes before the start of the sale at the place of sale.

Prospective buyers who would bid for the first time with Baghera Wines are asked to

provide the following documents, in order to register for the auction:

• Individuals: government-issued photo identification (such as a driving licence, national

identity card, or passport) and, if not shown on the ID document, proof of current address,

for example a utility bill/bank statement.

• Corporate clients: a photocopy of the company register.

• For other business structures such as trusts, offshore companies or partnerships,

please contact the Sale Administrator for advice on the information you should supply.

• A financial reference in the form of a recent bank statement or a reference from

your bank.

• Persons registering to bid on behalf of someone who has not previously bid or

consigned with Baghera Wines should bring identification documents not only for themsel-

ves but also for the party on whose behalf they are bidding, together with a signed letter

of authorisation from that party.

To allow sufficient time to process the information, new clients are encouraged to register

at least 48 hours in advance of a sale.

13. BIDDER RESPONSIBILITY

Bidding at Auction

Bids may be executed in person by paddle during the auction, in writing prior to the

sale by telephone or by live bidding.

Bidding in Person

To bid in person, you will need to register for and collect a numbered paddle before

the auction begins. Proof of identity will be required. New clients are encouraged to

register at least 48 hours in advance of a sale to allow sufficient time for us to process

your information. All lots sold will be invoiced to the name and address to which the

paddle has been registered and invoices cannot be transferred to other names and

addresses. Please do not mislay your paddle; in the event of loss, inform the Sales Clerk

immediately. At the end of the sale, please return your paddle to the registration desk.

Bidding by Telephone

If you cannot attend the auction, you may bid live on the telephone with one of our

multilingual staff members. This service must be arranged at least 48 hours in advance

of the sale, especially if you wish to bid in a language other than English. We also recom-

mend that you leave a covering bid which we can execute on your behalf just in case we

are unable to reach you by telephone. Please note that telephone bids may be recorded

(by bidding on the telephone, you consent to the recording of your conversation). We

suggest that you leave a maximum bid, excluding the buyer’s premium and VAT, which

we can execute on your behalf in the event we are unable to reach you by telephone.

Online Bidding

If you cannot attend the auction in person, you may bid online on our online live bidding

platform available on our website at www.bagherawines.auction. You must pre-register

at least 36 hours before the start of the auction in order to be approved by our bid

department. Please note that corporate firewalls may cause difficulties for online bidders.

Absentee Bids

If you are unable to attend an auction in person, you may give Baghera Wines instruc-

tions to bid on your behalf. Our member of staff will then try to purchase the lot(s)

of your choice for the lower price possible. Please note this service is free, totally

confidential and offered as a convenience to clients who are unable to attend the sale.

In the event of identical bids, the earliest received will take precedence. Although our

representative will make every effort, Baghera Wines will not be responsible for error

or failure to execute bids.

Bidding Increments

Bidding generally opens with the low estimate and advances in increments of up to 10%

subject to the auctioneer’s discretion. The auctioneer retains the right to call bids at his

own discretion – bids steps are shown on the Guide for Absentee Bidders on page 340.

Currency and Currency Converter

The sale is conducted in Swiss francs. Any other amounts shown in this catalogue and

on the currency converter are for guidance only and are not legally binding. Baghera

Wines declines all responsibility for any mistakes on the currency converter.

When bidding, the person assumes personal accountability to pay the price and any other

applicable taxes or charges, unless it has been explicitly agreed in writing with Baghera

Wines, prior to the auction, that the bidder only acts as an agent on behalf and in the

name of an third party, acknowledged and accepted by Baghera Wines, and that the said

party shall be solely responsible for payment of the Price.

The fall of the auctioneer’s hammer indicates the final bid. The auctioneer will call out

and record the name or “paddle” number of the buyer. If your written bid is successful,

you will be notified the day following the sale by email. Bidding may be re-opened at

the auctioneer’s discretion.

14. SALE RESULTS

Results for the sale are available upon request. Baghera Wines cannot accept liability

for any errors or omissions, howsoever caused. Sellers should await their settlement

statement as confirmation of any sold proceeds.

15. PAYMENT OPTIONS AND DEADLINES

The price is payable in Swiss francs in the seven days following the sale. On the eighth

day after the sale, interest at the rate of 1% per month will be added to the amount due.

Payment can also be made in foreign currencies with legal-tender status if that amount can

be converted into Swiss francs at the value date of payment. To avoid any delay in relea-

sing goods, prospective buyers should supply bank references before the auction. Please

include your name and invoice number with your instructions to the bank. Please note

that we reserve the right to decline payments received from anyone other than the buyer

of record and that clearance of such payments will be required. All expensive regarding

bank transfer are at the buyer’s charges.

Payment can be made at the sale in cash, by credit card or charge card or by bank transfer

to FERT & Cie account at Crédit Suisse.

Please note that transactions in cash or by credit card may in no case exceed

CHF 99,999.

Baghera Wines will accept American Express, Visa and MasterCard to pay for invoices - A

processing fee will apply.

The successful bidder during the auction is solely responsible for payment to Baghera

Wines. We will not accept payments for purchased lots from any party other than the

buyer, unless otherwise agreed between the buyer and Baghera Wines prior to the sale.

Goods can only be collected when payment has been cleared.

16. NON-PAYMENT

In case of non payment by the Buyer within seven days of the sale, Baghera Wines

shall try their best to carry out the Seller’s instructions as to the next steps and help

them, when possible, to reach the price or if not, cancel the sale. All damages are

expressly reserved.

Notwithstanding the above, Baghera Wines expressly reserves the right at its

discretion and expense of the Seller to accept special conditions of payment of the price,

to take adequate measures for storage and / or lot insurance, to start or pursue any legal

proceedings instituted by or against the Buyer on the terms and conditions that Baghera

Wines considers appropriate, to take all necessary measures to recover the amounts owed

by Buyer and, if possible, to return the lot to the Seller.

17. PARTIAL PAYMENT

Any partial payment by the Buyer to Baghera Wines will be considered payment through

direct deposit.In case of failure of the Buyer to pay the entire price of this deposit will be

automatically collected and lot will be relisted by public auction or at a private auction

or sale by private treaty at the discretion of Baghera Wines.

18. COLLECTION, SHIPPING, IMPORTATION AND STORAGE

Please refer to page 345 in this catalogue for detailed information regarding collection,

shipping, importation and storage facilities. Please note that Fert & Cie is open from

Monday to Friday from 8am to 12am and from 1:30pm to 5pm.

The lots with the symbol lie at the 'Ports Francs de Genève' and are in bond.

For any buyers outside Switzerland, a transit document will be needed to ship the wines.

Destination VAT, excise duty, clearance charges are at the buyer’s charge and cannot be

cancelled or refunded by Baghera Wines. For buyers inside Switzerland, excise duty and

clearance charges will be charged. VAT is already included in Baghera Wines invoice.

Be informed that express shipping companies may refuse to issue transit documents, we

strongly recommend to use a professional wine carrier.

Buyers are reminded that Baghera Wines accepts liability for loss or damage to lots for

a maximum period of thirty (30) days after the date of the auction.

19. RIGHT OF RETENTION AND DELIVERY

In order to avoid any errors in the auction process, to ensure the payment of invoices and

to proceed to – where necessary and in accordance with legal and regulatory requirements

– the required checks on the Buyer as well as the identity of the beneficial owner, No lot

may be removed during the sale.

Baghera Wines is authorized to retain the lots until all amounts due to Baghera Wines

have been paid in full or until the Buyer has performed all other obligations that Baghera

Wines, at his discretion, considers due, including anti money laundering and counter

financing of terrorism compliance.

In case a buyer does not meet the aforementioned checks to the satisfaction of Baghera

Wines, the company will be entitled to cancel the sale and take any other action required

or permitted by law. Shipping will take place after reception of payment.

20. NON-COLLECTION OR NON-DELIVERY

In case the Buyer, having fulfilled all its obligations under these conditions of purchase,

does not withdraw or fails to take delivery of the Lot, Baghera Wines will be entitled to,

upon notification to the Buyer, relist the lot by way of auction or private sale, in its sole

discretion, and charge the Buyer the entire storage costs, insurance and all other costs

that may occur. Baghera Wines will have a right of retention on the lots until payment

of all of these costs.

21. FALSE INFORMATION

If the information or documents provided by the Buyer on his identity or the identity of

the beneficial owner prove to be false, incomplete, ambiguous or insufficient, Baghera

Wines may, in its sole discretion, cancel the sale. The Buyer will be responsible for all

costs incurred.

22. IN CASE OF DOUBTS ABOUT THE AUTHENTICITY

In case there should be doubts about the authenticity of a lot, after the auction, buyers

should immediately inform Baghera Wines and provide all documents backing such doubts

about the authenticity of the Lot.

Baghera Wines will determine, in its sole discretion, whether the lot is genuine or not

and may, in its sole discretion:

a) Submit the lot to an expert or a third party in order to determine the authenticity;

b) Notify the Seller and collect his determinations;

c) Cancel the sale and return the lot to the Seller, provided that the Buyer is reimbursed;

d) Cancel the sale, take over the Lot, repay all or part of the price to the Buyer and require

the seller to reimburse the full amount.

In all cases, the Buyer can obtain cancellation of the sale only if he is able to transfer

the possession and ownership of the lot to the Seller and / or to Baghera Wines and

provided that the lot has suffered absolutely no modification or alteration since the time

of the auction.

23. LIABILITY

Any participant in the sale, in whatever capacity, namely as bidder, visitor or third party

is responsible for any damage, particularly to the lots exposed.

24. DATA PROTECTION

As required by law, or in connection with the supply of auction and related services

Baghera Wines may ask clients to provide personal data. Baghera Wines may take and

retain a copy of government-issued identification such as a passport or driving license.

We will use your personal data (i) to provide auction and related services; (ii) to enforce

these Conditions of Sale; (iii) to carry out identity and credit checks; (iv) to implement

and improve the management and operations of our business and (v) for other purposes

set out in our Privacy Policy published on our website at bagherawines.com and available

on request by emailing [email protected]. Sometimes, Baghera Wines may also

disclose this information to carefully selected third parties for their own marketing purpo-

ses. If you do not wish your details to be used for this purpose, please email office@

bagherawines.com.

If the client provides Baghera Wines with information that is defined by European data

protection laws as “sensitive”, the client agrees that it may be used for the purposes

set out above.

In the course of these disclosures, personal data collected in the European Economic Area

may be disclosed to countries outside the European Economic Area. Although such

countries may not have legislation that protects a client’s personal information, Baghera

Wines shall take reasonable steps to keep such information secure and in accordance

with European data protection principles. By agreeing to these Conditions of Business,

the client is agreeing to such disclosure.

Baghera Wines premises may be subject to video surveillance and recording. Telephone

calls for telephone bidding purposes may also be recorded. We may process that infor-

mation in accordance with our Privacy Policy.

25. MISCELLANEOUS

(a) Taxes. If any taxes or rates are applicable to any amount paid by the Buyer, the

latter is solely responsible for their payment at the rate and on the date required by the

competent administration.

(b) Severability provisions. If any provision of this agreement should be judged by a

court to be invalid, illegal or unenforceable, this provision may be waived and the rest of

the Agreement will continue to be valid and enforceable.

(c) Personal information. Without your express prior refusal, we will allow keep your

personal information and may use it to inform you of our upcoming sales, services and

events.

(d) Prohibition of Assignment. The Buyer may not assign any benefit and / or obligation

under this agreement with Baghera Wines and / or the Seller without our prior written

permission.

(e) Applicable law and jurisdiction. All contractual relations between the Purchaser, the

Seller and Baghera Wines are subject exclusively to Swiss domestic law, to the exclusion

of the rules on the conflict of laws (LDIP). Any dispute in connection with the contrac-

tual relationship shall be settled exclusively by arbitration in accordance with the Swiss

Rules of International Arbitration of the Swiss Chambers’ Arbitration Institution in force

on the date on which the Notice of Arbitration was submitted in accordance with these

Rules. The number of arbitrators shall be one. The seat of arbitration shall be Geneva.

The arbitration will be conducted in French, subject to a written agreement for the use

of another language.

HOW TO… PLACE ABSENTEE BIDS?

In order to place absentee bids, please use the dedicated form (see opposite) provided in this catalogue. Each bid form should contain the sale number. Please accurately record the lot number and the maximum price in Swiss Francs you are willing to pay for each lot (please note that unlimited bids will not be accepted).

Your bid form must be placed and sent over to us as soon as possible. In event of identical bids, the earliest re ce ive d wi l l take p re ce d en ce . Alternative bids may be indicated by using the word “OR” between lot numbers. As a result, if your bid on early lot is successful, our representative will not continue to bid on other lots on your behalf, or, if your early bids are unsuc-cessful, we will continue to execute bids for alternative lots until a bid is successful. It is important that your bids are listed in numerical order (as the lot numbers appear in the catalogue).

HOW TO… PLACE TELEPHONE BIDS?

If you cannot attend the auction, you can place bids on the telephone. We also recommend that you leave a covering bid which we can execute on your behalf just in case we are unable to reach you by telephone. As the number of telephone lines are limited please make arrangements for this service at least 48 hours before the sale. Please note that Baghera Wines only offers telephone bids in French, English, Spanish and German.

BUYER’S PREMIUM

The maximum bid price that you indicate in your absentee bid form is the hammer price only. If you are successful on a lot, a buyer’s premium of 20% will be added to the hammer price for each lot you buy. An additional VAT tax of 8% will be lieved on the hammer price AND buyer’s premium. The buyer’s premium will be the amount stated in the “Conditions of Sale” printed on pages 336-339 of this catalogue.

IMPORTATIONAll the wines are offered lying in Switzerland. Buyers

from outside Switzerland should be aware of restric-

tions imposed by various jurisdictions regarding

importation of alcoholic beverages. It is the buyer’s

responsibility to obtain any relevant export or import

licence. The denial of any licence cannot justify the

cancellation of the sale or any delay in making payment

of the total amount due.

COLLECTION Collection from Fert & Cie Transport SA will be by

appointment only and at least 7 days notice must be

given. Property will not be released until payment in

full has been received and funds have been cleared.

Authority for the release of lots to the buyer will be

a Release Order provided by Fert & Cie Transport SA.

It is Fert & Cie Transport SA policy to request proof of

identity (or your authorised representative/shippers) on

collection of a lot. All clients (or shippers) must examine

every lot or consignments in the presence of Fert’s staff

at Fert cellars premises from which they are collected.

IN BOND The lots with the symbol lie at the 'Ports Francs

de Genève' and are in bond. For any buyers outside

Switzerland, a transit document will be needed to

ship the wines. Destination VAT, excise duty, clearance

charges are at the buyer ’s charge and cannot be

cancelled or refunded by Baghera Wines. For buyers

inside Switzerland, excise duty and clearance charges

will be charged. VAT is already included in Baghera

Wines invoice. Be informed that express shipping

companies may refused to issue transit documents, we

strongly recommend to use a professional wine carrier.

Fert can assist in retrieving lots from the ‘Ports Francs’.

SHIPPING Shipping will be at Buyer’s expense, and must be

prepaid of freight collect. Shipping by commercial

means, particularly of older wines, can be risky and

it is at the buyer’s risk.

Baghera Wines will not refund any shipment charges

under any circumstances.

Switzerland deliveryFert & Cie Transport SA can arrange shipments

to Switzerland buyers. (Please refer to Fert & Cie

Transport SA conditions of services and shipping).

RE-PACKING OF WINESBuyers can require re-packing of the wines, which

are in their original wooden cases or cartons. Neither

Baghera Wines nor Fert & Cie Transport SA take

any responsibil ity for breakage of wines during

shipment, regardless of whether the wines have

been re-packed or not. At the buyer’s request Fert

& Cie Transport SA can re-pack wines into Styrofoam

cartons at the rate of CHF 15. per case of 6 bottles, and

CHF 30. per case of 12 bottles (with a minimum charge

of CHF 15.). Such fees must be paid before collection

or shipment. Original wooden cases or original cartons

will automatically be shipped unless you instruct Fert

& Cie Transport SA otherwise.

TAXATION The laws of the final destination of shipment deter-

mine taxation. It is Buyer’s responsibility to ensure

compliance with applicable tax laws shipments.

STORAGE We offer complimentary storage in Baghera Wines

facilities for thirty days after the date of the auction.

Any property for which shipping arrangements or

collection have not been made within these thirty

days will be put into Baghera Wines storage contract

and assessed a monthly storage charge and insurance

charge (Please refer to Baghera Wines conditions of

services and storage).

NOTE In all instances, neither Baghera Wines nor Fert &

Cie Transport SA is responsible for any deterioration,

damage, loss or any acts or omission of any shipper,

including, without limitation, any packing, shipping,

delivery or insurance for purchased lots.
