    “Probate” refers to theprocess of re-titlingassets from a deceased

    person to his or her heirs-at-law, orto his or her named beneficiaries.

    A person who dies without awill is considered “intestate.” Hisassets pass to those persons setout under the laws of the state in

    which he died (or, in some cases,in which he owned real estate.)These laws are called “intestacystatutes.” The persons who takeunder these statutes are called“heirs-at-law.” In Connecticut, inthe absence of a will, a share ofthe estate passes to a spouse and ashare to children of the marriageor children of a prior marriage; ifnone, then to parents; then sib-lings; then nieces and nephews,and so on to further degrees ofrelationship.

    If a person has a will, the intes-

    tacy statutes don’t apply, and theestate is considered “testate.” (“Tes-tate” comes from the Latin wordfor a writing.) Assets pass to thepersons named in the will.

    A person’s estate is normallyprobated in the court for the stateand district in which the personresided at the time of death. Theprobate proceeding consists of

    admitting, or proving, the will toprobate; appointing the executor(in the case of a will) or adminis-trator (in the case of an intestateestate); preparing and filing withthe court an inventory of the as-sets owned by the person; payingexpenses, such as funeral expenses,last medical expenses, any debtsor claims, taxes, and expenses ofadministering the estate (such asprobate, accounting, attorneys’and executors’ fees) and finally,accounting to the court for assets

    received by the executor or admin-

    istrator of the estate and obtainingcourt approval for distribution ofthe assets to the beneficiaries.

    Tax proceedings are also in-volved in settling estates of de-ceased persons. Without taxclearance from state and federalauthorities, assets are often non-transferable (or, if transferred, sub-

     ject to “inchoate” liens for possible

    taxes due.) Probating an estate,then, is required to transfer title toproperty (real estate, securities andother assets) to the persons entitledto receive them.

    “Probate” also refers to thosecourts that deal with and overseethe probate of estates, administra-tion of testamentary trusts (trustsunder wills), the interpretationof wills and trusts, conservator-ships, guardianships, commitmentproceedings and termination ofparental rights, among other mat-

    ters. Probate courts are courts of

    “limited jurisdiction.” This meansthat they can only consider thosematters assigned to them by theLegislature.

    Probate courts have been part ofConnecticut’s judicial system since1698. In their 300-plus year history,Connecticut probate courts havebeen local, informal, and easily ac-cessible. Until recently, there was a

    probate court in nearly every townin Connecticut. In 2009, financialexigency resulted in regionaliza-tion of the probate court system.There are now 54 probate courts inConnecticut.
