LAURIE DEXTERExpedition LeaderLaurie grew up in Scotland and has livedin northern Canada since 1970, includingBaffi n Island where he learned thesurvival skills of the Inuit and speakstheir language. Laurie has skied from

Russia to Canada through the geographic North Pole, skied and sled-hauled to the South Pole, and traversed the ice caps of Greenland, Baffi n Island, and King George Island in Antarctica. Laurie holds an honorary Doctor of Laws, is a Fellow of the Explorers Club, a Fellow of the Royal Geographical Society, a member of the Arctic Club, and in recognition of his international contribution the Canadian Government has honored Laurie with the Order of Canada.

SHANE EVOYExpedition LeaderShane was born and raised on GeorgianBay, Ontario, Canada. Destined to live on the water, Shane worked for 36 yearsat the family marina which he eventuallytook over. Shane is an experienced leader;

his passion for Antarctica and respect for the environment is evident in his expedition leadership. His objective on any trip is to make sure passengers have the “trip of a lifetime.”

FABRICE GENEVOISOrnithologistFor over 20 years, Fabrice has worked as a fi eld guide and lecturer leading Frenchgroups in the Antarctic Peninsula, SouthShetland Islands, the Amundsen andBellingshausen Seas and the Sub-Antarctic

islands of the Southern Ocean. In the North he has worked in the Northwest and Northeast Passages, the Canadian High Arctic, Greenland, Iceland, Svalbard, Franz Josef Land and the geographic North Pole. When not working in the Polar Regions, Fabrice leads natural history trips to the Galapagos Islands, West Africa, South America and Polynesia, and conducts fi eld research on birds with the Museum of Natural History in Paris.

SOLAN JENSENExpedition LeaderBorn and raised in coastal Alaska, Solanworks as a wilderness ranger, expeditionleader, kayak guide, and marine mammalemergency responder. His passion forwild places started at university where

he received a degree in Philosophy which led him directly to an expedition guiding career in the Polar Regions. In 2002, Solan worked at the Amundsen-Scott South Pole Station where he fi rst experienced the awesome Antarctic environment as an ironworker. The last 10 years as a kayak guide and leader, Solan has grown an enduring reverence for the unparalleled wilderness of Antarctica.

DR. TIMUR KOULIEVExpedition Doctor*Timur trained in Emergency Medicine inthe U.S. and Canada, and has practicedmedicine on all seven continents. His past experiences include medical practice and research in remote parts

of the world, helicopter and fi xed-wing medical missions, management of remote medical clinics, and standardization of services across remote or otherwise diffi cult locations. Timur has been organizing doctors for the Olympic Games since 2008. In addition to his native language of Russian, Timur speaks English, French, Chinese, Spanish and Japanese.

CHELI LARSENExpedition LeaderA Kiwi born and bred, Cheli’s whole life has been spent on water in both itsliquid and solid states. She worked in theski and scuba industries before venturinginto expedition cruising where she

has spent the past 13 years working in the South Pacifi c, Japan, Russia’s Far East, Australia, New Zealand, Greenland, Iceland, Norway, Svalbard, the British Isles and Antarctica. She managed New Zealand’s largest dive training facility, and skippered dive and fi shing charter vessels — invaluable experience when leading Polar expeditions.

NORM LASCAGeologistDr. Lasca is Professor Emeritus of Geologyat the University of Wisconsin-Milwaukee.He holds degrees from Brown Universityand the University of Michigan. Widelytraveled, he has worked extensively in the

Arctic and Sub-Arctic areas surrounding the Arctic Ocean and Antarctica for over 50 years. He is a widely published scholar and editor whose expertise lies in Earth-surface processes, especially those related to glaciers and glaciation. He serves on several national and international geological commissions, on non-profi t boards and on technical advisory committees for various municipal and state agencies. He is a licensed Professional Geologist and Professional Hydrologist, and is a Fellow of the Geological Society of America.

ALEX McNEILExpedition LeaderSince Alex joined Quark in 2007, hiscontagious passion for Polar history,anthropology, geopolitics, wildlife and exploration has enriched theexperience of our guests. A fellow of

the Royal Geographical Society, Alex was born in England and raised in Canada. He is fl uent in Spanish and for the last four years has been a tireless student of Russian. Alex has nearly 100 voyages under his belt and extensive experience in almost every corner of the Polar Regions.

DAMIEN SANDERSHistorianDamien fi rst came to Antarctica in1979 with the British Antarctic Surveyas a diving offi cer as part of their on-shore marine biological program.During this time he experienced three

Antarctic summers and two winters on bases at Signy Island, South Orkneys, and at Grytviken, South Georgia. Damien was stranded on South Georgia during the Argentine occupation in the Falklands Confl ict and was evacuated after British forces recaptured the Island. Since 2006 he has lived in Brittany, France, where he divides his time between marine archaeology, writing and working on Polar expedition ships.

DAVID “WOODY” WOODExpedition LeaderWoody comes to the Polar Regionsvia a strange path. He spent timeworking in a major pediatric hospital,has degrees in political science andlaw, and chooses to spend as much

time as possible onboard a ship heading into the ice! His love of the ocean and the wild places at the extremes of the planet has resulted in a lifetime at sea either in the North or South for the last decade. He is passionate about the landscapes, ice, wildlife and history of these special places and delights in sharing his interests with passengers.

Through this, he monitors Antarctic wildlifeusing time-lapse cameras, volunteer photos andpopulation genetics. TRAVEL INSURANCEDue to the remoteness of where we travel,an adequate medical facility could be up to72 hours away or more, dependant onweather. We do have a ship doctor on boardand basic medical facilities. Emergencymedical evacuation can be delayed orunavailable in certain areas.It is a condition of the booking that you andall members of your party have comprehensivetravel insurance coverage.

Due to the remoteness of the areas in whichwe travel, travelers must have a minimumUS$50,000 (or equivalent) of emergencymedical coverage. Quark Expeditions requiresproof of coverage prior to embarkation. Thetravel insurance policy should also cover tripcancellation insurance, trip delay (interruptionor after departure coverage), baggage andrepatriation. Quark Expeditions will not beheld responsible for delays due to forcemajeure. CANCELLATIONS AND REFUNDSAll requests for cancellation must be receivedin writing. Cancellations received 180 days ormore prior to departure, are refunded less anadministrative fee of minimum US$1000,AU$1000, £650, €800 per person. If cancellationis received between 179 days and 120 days, thedeposit is forfeited. If cancellation occurs lessthan 120 days prior to departure, all paymentsare forfeited. If full payment has not yet beenreceived, the full penalty will still apply and anyunpaid balance is due immediately. To protectthe traveler’s investment, we recommend thatyou obtain adequate trip cancellation insurance.Cancellations cannot be made online.

Changes Quark Expeditions begins planning ourvoyages many months or even years inadvance of departure. Occasionally, we haveto make changes both before and afterbookings have been confi rmed. Quark reservesthe right to change any service; including butnot limited to transfer packages (ground orair), group hotel nights and the voyage itself;prior to departure without compensation.

Adventure OptionsPrices quoted are based on group participationand no refunds will be made for any part of the program in which you choose not toparticipate, including kayaking, camping, skiing,mountaineering or ballooning (if applicable and which, at the discretion of the Captain andExpedition Leader, may or may not be used). It is understood that refunds cannot be made totravelers who do not complete the services forany reason whatsoever. All adventure optionsrequire a signed Adventure Option waiver,which will be sent to you once you havebooked your adventure option. This form MUST be completed prior to you taking part in the adventure option. The Expedition staff reserve the right to deny participation to any client who has not signed the adventure option waiver, does not follow the rules set out by expedition staff or is not medically/ physically able to participate safely.

ChildrenQuark Expeditions welcomes passengersabove the age of 8 and under the age of 16 attime of travel with a signed waiver by a parentprior to embarkation on any Quark vessel,provided they meet height and weightrequirements (weight of 64lbs or 29kg and 48’’or 1.2 m. tall) as well as the adult/child ratioon board. Children under 8 years old are notallowed to participate in the trip and childrenunder 18 years old cannot participate inadventure options. Parents must be on boardwith children under the age of 18 at all times,so participation in adventure options may belimited. If children do not meet theserequirements on embarkation, QuarkExpeditions reserves the right to refuseboarding without compensation or refund.

Pre- and Post-TravelPre- and Post-travel options arranged by Quark Expeditions may not be changeable or refundable after booked, please consultyour Polar Travel Adviser for full terms andconditions. Cancellations received less than 120 days before departure are 100% non-changeable and non-refundable.

AMENDMENTS TO BOOKINGSQuark Expeditions will make every eff ort to assist in changing your reservation; however,changes must be submitted in writing a minimumof 120 days prior to departure. If the amendment is possible it will be subject to minimum US$250, AU$250, £150, €200 per person fee plus any diff erence in fare if applicable.

TRANSFERS OF DEPOSITS ORPAYMENTS TO ALTERNATE VOYAGESShould travelers be unable to take theexpedition they originally booked but would like to travel on an alternate date, it may bepossible to transfer deposits or payments fromthe original booking to an alternate booking,subject to the following conditions: The newexpedition must occur within one year of theoriginal expedition date and a request to transfermust be made in writing to Quark Expeditionsmore than 120 days prior to the departure of the original voyage. Quark Expeditions reservesthe right to prohibit transfers on any of itsvoyages. Should a transfer request be granted, a fee of minimum US$1000, AU$1000, £650,€800 per person will be charged.

2014.15 QUARK’S ANTARCTIC EXPRESS(Fly South, Cruise North; Fly the Drake;Crossing the Circle; and Cruise South, Fly North) Programs Contingency Plan. Quark Expeditions will make every eff ort toensure the Antarctic Express programs takeplace, but due to weather conditions, fl ying inthis region can be diffi cult and is beyond thecontrol of Quark Expeditions. We stronglyrecommend that all expedition guestspurchase a travel insurance policy includingtrip delay, cancellation and interruptioninsurance. Please ask your Polar TravelAdviser about travel Insurance. In the unlikelyevent that the charter fl ight is unable to fl y onday 2 or day 3 due to weather delays, QuarkExpeditions will provide an additional night(s)hotel accommodation in Punta Arenas.

On day 4 should the charter fl ight not be ableto take off by 1400hrs, Quark Expeditions will offi cially cancel the voyage and provideletters for all clients to submit to their travel insurance providers under the tripdelay/interruption and cancellation clause.

QUARK EXPEDITIONS WILL NOT OFFER PASSENGERS A REFUND IN THEEVENT OF TRIP CANCELLATION. QUARK EXPEDITIONS WILL NOT OFFERPASSENGERS COMPENSATION IN THEEVENT OF A DELAY.

QuarkExpeditions will make every eff ort to assistpassengers with rebooking hotels or fl ights,but this will be at the cost of the passengers,and Quark Expeditions strongly recommendsthat all clients contact their insuranceprovider prior to changing any reservations.

Passengers on board the ship during thesedelays will remain on board with no additionalcost until the time in which the charter fl ightis able to arrange transport. Quark Expeditionsadvises all clients to book changeable airlines tickets along with cancellation andinterruption insurance to assist with additionalairline change fees. We advise all passengers to have fl exible travel arrangements upondisembarkation of the voyage if delays arise. Quark Expeditions will not be held

responsible for any change/cancellation fees due to weather related delays or anyother delays arising from force majeure. MEDICAL FORMSMedical forms will be sent to you via email link once the deposit has been received. Youmust review, complete and submit the formsimmediately if required. Questions that relate to your physical or mental suitability must becompleted by a medical practitioner. QuarkExpeditions cannot off er medical advice.Medical forms must be fi lled out in full,honestly and accurately, and disclose all medicalhistory and information. Should your medicalsituation change after submitting the medicalforms, it is your responsibility to advise QuarkExpeditions immediately. Quark Expeditionswill review the information submitted andreserves the right to ask for further information,clarity on information, or for documentationfrom your medical practitioner. ITINERARYThe itinerary described is subject to change at the discretion of the ship’s Master andQuark Expeditions’ Expedition Leader. This is an expedition to a remote part of the worldand Quark Expeditions reserves the right tochange the itinerary due to weather conditions,availability of anchorages, political conditionsor other factors beyond its control, withoutconsulting the travelers. Substantial changes in tariff s,exchange rates and the price of fuel, servicesand labor sometimes increase the cost ofexpedition arrangements signifi cantly. Quarkreserves the right to alter prices or introducesurcharges accordingly, even if payment hasbeen received in full. All travelers are requiredto pay for their excursion and additionalpurchases in conjunction with their excursionin the same currency.

DISCOUNTS AND PROMOTIONSQuark Expeditions has the right to limit,withdraw or change any and/or all discountsand promotions without notice and/orcompensation.

SCHEDULED FLIGHTS Tours do not include international airfare orany other fl ights unless mentioned in theinclusions.

QuotesAll quotes are in US dollars, unless otherwisestated.

Price ChangesUntil tickets are issued, Quark Expeditionsreserves the right to change prices for anyreason including but not limited to, airfareswrongfully quoted due to system error, theprice of fuel and/or currency fl uctuations orgovernment taxes or levies, or any otherreasonable cause.

Full PaymentFull payment must be received by QuarkExpeditions before the Option period expiresto guarantee the fl ight reservation at quotedprice. A guarantee of payment by the Clientis an acceptance of the travel arrangements as requested at the total price quoted.

Cancellation fees will apply if the Clientsubsequently decides to cancel after ticket has been issued.

Changes & CancellationsUnless otherwise stated, airline tickets are100% non-changeable & non-refundable oncetickets have been issued. Changes made priorto ticket issuance may be applied at QuarkExpeditions’ discretion, and will also besubject to Administrative Fees.

Flight Reconfi rmationQuark Expeditions strongly recommendsfl ight times and numbers be verifi ed orreconfi rmed by the traveler at least 72 hoursprior to departure. Quark Expeditions is not responsible for any change to airlineschedules or fl ight numbers after tickets have been issued.

Airline TicketsOnce issued, all airline tickets are non-transferable and are valid only for the datesand routings shown. If an airline ticket is lost,the client is responsible for the full cost of a new ticket and any changes that may occurin replacement.

Airline, Airport or Weather DelaysQuark Expeditions will not be held responsiblefor any additional expenses or loss that mayarise from airline, airport or weather delays.Quark Expeditions will not reimburse for anyadditional expenses incurred by the Client as a result. Quark Expeditions will not refundany unused portion of air tickets purchased in the event of such delays due to conditionsbeyond its control.

For scheduled fl ights, the fare rules of theairline carrier, including payment andcancellation conditions, apply.

CHARTER FLIGHTSCharter fl ights are at an additional cost unlessotherwise stated. Quark Expeditions reservesthe right to change charter fl ight costs based onfuel surcharges or increased charter hire rates.

COMPENSATIONCompensation for personal injury is limited in accordance with the provisions of anyapplicable International Conventions. Theseinclude, for example, in the course of roadtravel, air travel, rail travel, sea travel, or hotel accommodation and are limited to theprovisions of, respectively, the GenevaConvention 1973, the Warsaw Convention as amended by the Hague Protocol 1955, the 1961 Berne Convention, the 1974 AthensConvention and the 1962 Paris Convention.

LIMITATION OF LIABILITYQEI purchases transportation, hotelaccommodations, and other services fromvarious independent suppliers that are notsubject to its control. Neither QEI, itsaffi liates, owners, offi cers, agents, employees,nor any associate organization shall be heldliable for any act, default, injury (includingdeath), loss, expense, damage, deviation,delay, curtailment or inconvenience caused to

or suff ered by any person or their property,howsoever arising, which may occur or beincurred by any organization or person, eventhough such act, default, injury, loss, expense,damage, deviation, delay, curtailment orinconvenience may have been caused orcontributed to: (a) by the act, neglect ordefault of QEI, or of any persons for whoseacts it would otherwise be responsible, or (b) defects or failures of any aircraft, vessel,automotive vehicle or other equipment orinstrumentality under the control ofindependent suppliers. In issuing tickets fortransportation of the travel by any means andmaking arrangements for travel, hotel or otheraccommodation, QEI is not acting as principalbut only as agent for the companies,corporations, owner, public carriers orpersons providing or off ering the means oftransportation and accommodation. Youfurther understand that QEI neither owns noroperates such third party suppliers andaccordingly, agree to seek remedies directlyand only against those suppliers and not holdQEI responsible for their acts or omissions. In no event will QEI be responsible forincidental, consequential or special damage orloss suff ered by any person. QEI’s maximumliability, for any reason whatsoever, will belimited to the amount paid to QEI for itsservices. Without limitation, QEI is notresponsible for any negligent acts, or actswhich are beyond its control, including butnot limited to acts of God or force majeure,weather emergencies, breakdown, or failure of diving or mechanical equipment,government actions, inclement weather,sickness, attacks by animals, availability ofmedical care or the adequacy of the same,criminal activity of any kind, terrorism, war,civil disturbance, sanitary conditions, qualityor sanitation of food, quarantine, customs,regulations, epidemics, strikes, hoteloverbooking, safety and/or security standardsat hotels or other accommodations, or for any other reason beyond the control of QEI.You understand, agree with, and agree to belegally bound by the terms of the release andwaiver of liability set forth herein. QEIreserves the right (at their discretion) to alter or omit any part of the itinerary orchange any reservation, feature and/or meansof conveyance without notice and for anyreason whatsoever, without allowance orrefund and with extra costs, if any, resulting,said changes being paid by the travelers. We reserve the right to cancel any servicesprior to departure, in which case payment will be refunded without further obligation onits part. QEI shall not be responsible for anyinjury to person (whether or not resulting indeath) or damage to property arising out ofany act of war, insurrection, revolt or othercivil uprising or military action occurring inthe countries of origin, destination or passage.

In case of a medical problem arising duringthe voyage, either on board or on shore,which results in costs for evacuation, use ofaircraft or repatriation, the responsibility for

payment of these costs belongs solely to thetraveler if costs incurred are above that of theEmergency Evacuation Insurance. The travelercontract in use by the carriers concerned(when issued) shall constitute the sole contractbetween the transportation companies and the purchaser of these services and/or passage.By accepting the ticket, the traveler also agreesto its terms and conditions.

ACKNOWLEDGMENT OF RISK You understand and acknowledge that yourtravel in connection with and participation inthe tour arranged at your request by QEI mayinvolve risk and potential exposure to injury.You also realize and acknowledge that risk and dangers may be caused by the negligenceof the owners, directors, employees,contractors, subcontractors, offi cers or agentsof QEI or the negligence or participation ofother participants, contractors and/orsubcontractors to QEI. You also recognize andacknowledge that risk and dangers may arisefrom foreseeable and unforeseeable causes,including weather and other acts of nature.You fully understand and acknowledge thatthe aforementioned risks, dangers and hazards are a potential in connection withrecreational activities which may take placeduring your journey.

By payment of your deposit, you certify thatyou do not have any mental, physical or othercondition or disability that would create ahazard for yourself or other travelers and youconfi rm that you are physically and mentallycapable of participating in the activity andwillingly and knowingly elect to participate inyour travel package in spite of the potentialrisk of danger. By payment of your deposit,you certify that you willingly and voluntarilyassume full responsibility for any injury, lossor damage suff ered, whether caused in wholeor in part by the negligence of the owners,directors, agents, offi cers, employees,contractors or subcontractors of QEI. QEIreserves the right to remove a passenger or cancel or withdraw any reservation at any time at its sole discretion.

EXPRESS ASSUMPTION OF RISK ANDRESPONSIBILITY/PARTICIPATIONIn recognition of the inherent risk of thetravels and related activities in which you are intending to engage, you confi rm that you are physically and mentally capable ofparticipating in the activity, that you arewillingly and knowingly electing to participatein this tour in spite of the potential risk ofdanger, and you willingly and voluntarilyassume full responsibility for any injury, lossor damage suff ered by you or caused by you,whether caused in whole or in part by thenegligence of the owners, directors, agents,offi cers, or employees of QEI. You understandand acknowledge that due to the remotenessof where we travel emergency evacuationand/or search and rescue may be delayed orunavailable and that medical facilities may belimited and you acknowledge that it is your

responsibility to assess the impact suchlimitations may have on any existing medical condition(s). You understand andacknowledge that QEI reserves the right to accept or reject any participant for anyreason, and QEI or its guide has the right todisqualify you from any trip activity, if in QEI’sor such guide’s judgment, you are incapable of that activity and/or your continuedparticipation in the tour will endangeryourself or the safety of the group. It is yourresponsibility and obligation to inform QEI, at the time your reservation is made, of any medical or physical disability or limitation that might disable you or render you unable to perform or safely complete the tour or anyactivity on the tour. You further acknowledgethat you are the best judge of your ownconditions and limitations and that it isincumbent upon you to fully disclose the full extent of any such conditions or limitationsto QEI.

RELEASE OF LIABILITYIn consideration of the services andarrangements provided by QEI, you, foryourself and for your heirs, personalrepresentatives or assigns, do hereby release,waive, discharge, hold harmless and agree to indemnify QEI, and its owners, offi cers,directors, employees and affi liates from anyand all claims, actions, or losses for bodilyinjury, property damage, wrongful death, loss of services, lost profi ts, consequential,exemplary, indirect or punitive damages orotherwise which may arise out of or occurduring your travel in connection with thescheduled travel package and any activitiesconducted in conjunction therewith. YOUSPECIFICALLY UNDERSTAND AND AGREETHAT YOU ARE RELEASING, DISCHARGINGAND WAIVING ANY CLAIMS OR ACTIONSTHAT YOU MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR CONDUCT OF THE OWNERS,DIRECTORS, OFFICERS, EMPLOYEES,AGENTS OR AFFILIATES OF QEI.

EXPRESS WAIVER OFCONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGESRegardless of the situation or circumstancesgiving rise to a claim, you waive any right toseek consequential, punitive or exemplarydamages against QEI its owners, offi cers,directors, agents, contractors and employees,for any reason whatsoever.

ARBITRATIONAny controversy or claim arising out of orrelating to these Terms and Conditions or theperformance there under, including withoutlimitation any claim related to bodily injury,property damage or death, shall be settled by binding arbitration in Atlanta, GA, USA in accordance with the rules of the AmericanArbitration Association then existing, andjudgment on the arbitration award may beentered in any court having jurisdiction over

the subject matter of the controversy. Thisagreement to arbitrate does not waive ormodify the liability release contained in thisdocument. Such proceedings will be governedby substantive Delaware law. The dispute willbe resolved by a single arbitrator who must be a lawyer admitted to practice in the courtsof at least one state in the United States andhave a minimum of fi fteen years of experiencein civil litigation. The arbitrator so describedwill be selected by the American ArbitrationAssociation. Each party to the dispute shallhave the right on a single occasion to veto thedesignation of an arbitrator so selected. Theparties waive the right to rely on any state lawor statute which creates an exception toenforcement of the requirement that disputesbe resolved pursuant to arbitration in themanner set forth herein.

EXCLUSIVE GOVERNING LAW AND JURISDICTIONThese Terms and Conditions and any actionsand proceeding brought hereunder shall begoverned by the laws of the State of Delawarewithout regard to confl ict of laws principles. If the right to seek arbitration is for anyreason waived by both parties, or if judicialreview of any arbitration decision is sought,any action or legal proceeding to enforce anyprovision hereof, or based on any right arisingout of, these Terms and Conditions shall beexclusively in the courts of the State ofDelaware, or if it has or can acquire jurisdiction,in the United States District Court for theDistrict of Delaware, and all of the parties heretohereby consent to the exclusive jurisdiction ofsuch courts and of the appropriate appellatecourts in any such action or legal proceedingand waive any objection to venue or jurisdictionin connection therewith.

WAIVER OF JURY TRIALIn connection with any action or legalproceeding arising out of this agreement, theparties hereby specifi cally and knowinglywaive any rights that either party might haveto demand a jury trial.

USE OF LIKENESSTravelers extend Quark Expeditionspermission to take their photograph duringthe voyage, and release all rights over thoseimages understand and consent that QEI mayuse any likeness taken of you and any of yourcomments while on your tour for futurepublicity and promotional material. Travelerswho do not wish to be photographed duringthe voyage must inform Quark Expeditions in writing prior to the voyage.
