8.1 Scope of work of respective personnel
Detailed information on the major tasks and duties each member of the4 engineering
design team and the construction supervision team shall perform is provided as follows :

1. Lead the detailed design task team. Ensure all deliverables are
prepared in accordance with quality and time constraints.
2. Administrate and supervise site investigation and design and
documentation activities for civil and facility/Equipment
Installation works contracts.
3. Identify appropriate design codes and standards in collaboration
with IRC.
4. Assess road & bridge sections for detailed engineering, including
geometric features, pavement, intersecting roads, its
development plan interface with the main road to a certain
extent as agreed upon. Review available data relating to traffic,
axle loads and pavement strength.
5. Review the need for road safety measures based on the findings
of the feasibility study and road safety review of the road
environment. Identify, design and cost road accident mitigation
measures based on this review.
6. Develop the specifications for road construction in collaboration
with the MSRDC. Assist MSRDC to prepare construction schedules
showing anticipated progress of works by contract package. The
schedules should reflect seasonal climatic effects at the work
sites.
7. Based on the findings of the approved EIA, the road & bridge
designs should incorporate the EMP to mitigate adverse
environmental impacts including those encountered during
construction.
8. Ensure that deliverables comply with relevant GOI technical

works including specific provisions to minimize
disruption/damage to local settlements due to construction.

documentation suitable for procurement under ICB with PQ in
accordance with the procurement guidelines of

12. Assist the MSRDC to appraise bids as part of the bid evaluation
process.
13. Assist the MSRDC evaluate the capacity of contractors.

5. Assist MSRDC in monitoring the compliance with conditions stated in the EMP and the requirements under EMP and GOM/MULTILATERAL FINANCIAL INSTITUTES Environmental Guidelines;
6. Assist MSRDC in facilitating stakeholder’s participation (including focus group discussions for vulnerable PAPS) and providing feedback their comments on EMP and EMOP;
7. Provide skills transfer with respect to environment, through workshops, seminars, and on-the-job training, to MSRDC staff. Review of EMP and revise it if required so.
8. At the completion of the Project, (21) undertake final environmental monitoring and evaluation against the set indicators, (b) evaluate sustainability of environmental benefits associated with road & bridge construction, taking into account both positive and negative impacts associated with roads, and (c) prepare an evaluation report for eachsubproject.

(ii) Basic time period for Balance Pre Tender consultancy activities in Phase I&II shall be as
stipulated in Clause 13 of Appendix II of Bid volume II. Fees payable shall remain
unchanged during above basic period of 3 months and an additional handholding period
of 3 months. Fees shall be due and payable only on completion of stages as
specified in clause 3.1(i), 3.2 (ii) above. The Consultant shall provide key professional for
additional three (3) months “hand holding period” above for which no additional
payment shall be made.
During the period of consultancy, MSRDC may ask the Consultant to demobilize
and remobilize staff, in part or full, with a fifteen (15) days written notice. No extra
payment / compensation / claims shall be entertained on account of such demobilization
and remobilization.

(iii) Penalty for Delay in Phase – I & II: Pre tender Activities:
The period for pre tender activities is specified in data sheet. If the consultant
does not complete the pre tender activities within the period as stipulated in the
data sheet, then payment due towards the Phase – I & II of pre
tender activities will be reduced by 2% for every additional week unless valid
extension is given by competent authority. If subsequent additional month is
consumed for pretender activities additional 2% shall be reduced. Such reduction shall be
limited to the 10% of the total fees.
(iv) Extension of time limit (Phase – I & Phase -II):
a) If there is genuine (for reasons not attributable to the Consultant) delay to
complete the pre tender activities by the Consultant on account of reasons beyond his
control, then the consultant will be entitled to extension for further period as approved
by the MSRDC for which payment over and above fixed amount of Rs. 30 Million as per
Data Sheet, Vol. II shall be payable on account of extension of time limit for Phase I and
Phase II by mutual agreement between MSRDC and the Consultant.
b) The reduction in the fees if any for want of valid extension made for the delay may be
released only after the valid extension is granted.
c) The decision of MSRDC for granting extension and penalty shall be final and binding.
The designate authority of MSRDC for granting extension and penalty shall be as per
Data Sheet in Vol. II.

3.2 Payment for Post Tender Activities (Phase-III)
i) The post tender activities (Phase-III) shall come into effect from the date of work order
(award of construction contract) and shall be for the period as mentioned in Data
Sheet.
ii) The payment for this activity and during its period shall be at the percentage rates as
prescribed below:-

A) Time related payment
The time related payment shall be payable as below:
1) Payment to be paid every month
(a) The monthly payment shall be payable to the consultant as per the above formula for the
scheduled period of completion plus further period of 6 months if a valid extension is
given to the consultant, subject to conformance to TOR.
(b) If a further valid extension is given to the consultant, the time related payment payable to
the consultant every month beyond original time period plus six months extended period
subject to conformance to TOR, shall be, increased by 8% per annum. Other payment will
as per formula.
B) Progress Related Payment
The progress related payment would be paid as below: Payment to be paid every month
Where, the cumulative % progress of work done by agency shall exclude the payment made
towards price escalation, Extra Items/ variation, Mobilization Advance and Machinery Advance.
Similarly the recovery of Mobilization Advance and Machinery Advance will not be reflected in

3.2.2 Release of 15% withheld amount:
i) Payment of 5% amount withheld from monthly invoices against item no 2 of
payment schedule/ phase III/ post tender activities shall be released after submission of
final bills of work with as built drawings and maintenance manual by the construction
contractor.
ii) Payment of 5% amount withheld from monthly invoices against item no 3 of
payment schedule/ phase III/ post tender activities shall be paid in equal quarterly
installments over 5 years defects liability period
iii) Payment of 5 % amount withheld from monthly invoices against item no 4 of
payment schedule/ phase III/ post tender activities shall be paid at the end of defects
liability period.
iv) The payment towards monthly deployment of staff during the defects liability period
shall be made on the basis of actual deployment of professional staff.
4.00 Payment of fees after defect liability:
After the defect liability period if for the purpose of settlement of claims or cases the services
of S.R.E./ R.E. are to be made available to MSRDC. The payment for such services shall be at
0.15 times the man month rate for SRE (As quoted under variation) with including travel and other
incidental expenses per visit shall be payable to the consultants for every such visit. The
maximum period up-to which the consultant has to provide his services, for settlement of
court cases / claims shall be 5 years after defect liability period.
5.00 Payment For Work which are Not Covered under Offer of Consultancy
The following payments will be made separately if the activities are ordered:
i) Cost of any sub consultancy / appointment of expert required for the services which
are approved in writing by MSRDC.
ii) Cost of such further items as may be required by the consultants for the purpose of
the services as agreed in writing by MSRDC.
iii) Payment to the Consultant for the staff / provisional facility over and above stipulated in
Bid document by the Consultant to MSRDC shall be at the rate quoted under schedule

of variation.
6.00 Penalty for Substitution or Non Provision of key personnel
If the consultant substitutes the following key personnel without prior approval of MSRDC or
MSRDC wants the consultant to replace the personnel on ground of misconduct or
inefficiency the penalty for replacement shall be as under.
1. For Each Key Personnel except Team Leader– Reduction of Consultancy fee will be
equal to balance period in month x 10% x Rate as per schedule of variation for Senior
Resident Engineer.
2 . In case of Team Leader- if such contingency arises the reduction in fee will be twice
that of the above.
If the same Key Professional staff (as substituted) not provided for the next
month/months the reduction in monthly fees shall be increased by MSRDC and action
shall be initiated as per stipulations of the Bid Document.
6.1 If the Consultant fails to provide Key Professionals / support staff as stipulated in Clause
No.8, Appendix ‘A’ of Vol. II of the Bid Document, monthly fee for that month during
which such Key Professional / support staff was not provided shall be reduced as below.
Team Leader : 8%
Senior Resident Engineer / Senior Bridge Engineer : 7%
Other remaining each Key Professional : 2%
If the same Key / Sub Professional staff not provided for the next month/months the reduction
in monthly fees shall be increased by MSRDC and action shall be initiated as per stipulations
in the Bid Document.
8.00 i) If the work is suspended by MSRDC / Contractor, then for first 3 months, the time
related payment would be made to the agency as per the above said time related formula,
provided the consultant retains the minimum strength of the personnel as given in
data sheet for the first 3 months. Subsequently he will be paid @ 30 % of the time
related monthly payment towards the selected services which he would offer during the
period under suspension.

ii) The time related fee would be restored when the suspension is revoked.
iii) In case progress of the work during Construction period is not as per accepted time
schedule of the project, MSRDC reserves the right to direct the Consultant to curtail
key personnel / professional staff to be deployed with proportionate decrease in
Consultancy fees as per clause 8.1, Appendix ‘C’ of Vol.-III or as may be decided by
MSRDC from time to time.
9.00 Limitations of fees due to default of Consultant
If there is any extension in time limit in original schedule, to the period of completion and
valid extended period of completion is required to be granted to the contractor, because of the
default on the part of the Consultant, then for such period the provision of granting the monthly
payment as per the given formula or further increase (as stipulated for extension beyond 6
months) shall not be paid. Instead, for this period, as the consultant is under default his time
related monthly payment shall be reduced by 20 % for the period of default.
10.00 Mode of billing and payment
Billing and payments in respect of the Services shall be made as follows:
a) As soon as practicable as and not later than fifteen (15 days) after the end of each
calendar month during the period of the Services, the Consultants shall submit to
MSRDC, in duplicate, the bill for the services rendered by him. In case of additional
payment under clause 7, the necessary documents in support of claim shall be furnished.
Each such separate monthly statement shall distinguish that portion of the total eligible
costs which pertains to remuneration from that portion which pertains to reimbursable
expenditures.
b) The MSRDC shall cause the payment of the Consultants periodically as given above the
payment within thirty (30) days after the receipt by MSRDC of the bills supporting
documents. Only such portion of a monthly statement that is not satisfactorily supported
may be withheld from payment. Should any discrepancy be found to exist between
actual payments and costs authorized to be incurred by the consultants, MSRDC may
add or subtract the difference from any subsequent payments.
c) The final payment under this Clause shall be made only after the final report and a final

statement, identified as such, shall have been submitted by the Consultants and approved
as satisfactory by MSRDC. The services shall be deemed completed and finally accepted
by MSRDC and the final report and final statement shall be deemed approved by
MSRDC as satisfactory unless within ninety (90) days period MSRDC gives written notice
to the Consultants specifying in detail deficiencies in the Services, in the final report or
in final statement, the consultants shall there upon promptly make any necessary
corrections, and upon completion of such corrections, the foregoing process shall be
repeated. Any amount which MSRDC has paid or caused to be paid in accordance with
this Clause in excess of the amounts actually payable in accordance with the provisions of
this Contract shall be reimbursed by the Consultants to MSRDC within thirty (30) days
after receipt by the Consultants of notice thereof. Any such claim by MSRDC for
reimbursement must be made within (12) calendar months after receipt by MSRDC of a
final report and a final statement approved by MSRDC in accordance with the above.
d) No escalation is payable to PMC during the Post-tender services & thereafter in the extension
period if any (expect as stipulated in Clause 3.2.1 above).
e) Non provision of the staff / Facility (as per Clause No. 11, Appendix ‘A’ of Volume II of the
Bid Document) to MSRDC shall entitle reduction in payment to the Consultant as below.
1. Office Attendant – INR. 12,000/- per month.
2. Computer Operator cum Typist – INR. 18,000/- per month.
3. A/C Vehicle – INR. 45,000/- per month.
Note: - These reductions will be applicable also for approved extended period if any.
These deductions will be effected as and when fees as per payment
schedule are paid to the consultant.
