    APPEAL

    THE APPELLANT APPEALS to the Federal Court of Appeal from the Cana- dian Transportation Agency Rules (Dispute Proceedings and Certain Rules Ap- plicable to All Proceedings) , S.O.R./2014-104 (the New Rules) made by theCanadian Transportation Agency (the Agency) and published in the Canada Gazette on May 21, 2014.

    THE APPELLANT ASKS that:

    (i) this Honourable Court quash subsections 41(2)(b), 41(2)(c), and 41(2)(d)of the New Rules and declare these provisions to be ultra vires the powers

    of the Agency and/or invalid and/or of no force or effect;

    (ii) this Honourable Court declare that the New Rules are invalid becausethey are unreasonable and establish inherently unfair procedures that areinconsistent with the intent of Parliament in establishing the Agency;

    (iii) this Honourable Court refer the New Rules back to the Agency with direc-tions to revise them within 60 days by establishing rules that:

    (a) provide parties a reasonable opportunity to respond and object torequests of non-parties to intervene;

    (b) require the Agency to provide reasons in support of any of its ordersand decisions that do not allow the relief requested, or if oppositionhas been expressed; and

    (c) govern examinations of deponents and afants, oral hearings, and

    in particular, requests for oral hearings.

    (iv) the Appellant be awarded costs and/or reasonable out-of-pocket expensesincurred in relation to the appeal; and

    (v) this Honourable Court grant such further and other relief as is just.

    THE GROUNDS OF APPEAL are as follows:

    1. Section 44 of the New Rules repeals the Canadian Transportation Agency General Rules , S.O.R./2005-35 (the Old Rules).

    Ultra vires provisions

    2. Subsections 41(2)(b), 41(2)(c), and 41(2)(d) of the New Rules are ultra vires and/or invalid, because:

    (a) they purport to grant the Agency powers that Parliament neverconferred upon the Agency; and

    (b) they are inconsistent with the doctrine of functus ofcio .

    Denial of natural justice and access to justice

    3. A signicant portion of the dispute proceedings before the Agency in-volve unrepresented individuals with no legal knowledge or experienceas applicants, and airlines represented by counsel as respondents.

    4. The Agencys longstanding position has been that its rules provide acomplete code of procedure that unrepresented parties can read andunderstand.

    5. The New Rules are unreasonable and establish inherently unfair proce-dures that are inconsistent with the intent of Parliament in establishingthe Agency, because:

    (a) section 29 of the New Rules deprives parties of any opportunityto respond and object to requests of non-parties to intervene;

    (b) the New Rules abolish the requirement that the Agency providereasons in support of any of its orders and decisions that do not

    allow the relief requested, or if opposition has been expressed(section 36 of the Old Rules); and

    (c) the New Rules abolish all provisions about examinations of de-

    ponents or afants (section 34 of the Old Rules) and about oralhearings (sections 48-66 of the Old Rules).

    ALL PROCEEDINGS3. In all proceedings, one member constitutes a

    quorum.4. The Agency is to conduct all proceedings in a

    manner that is proportionate to the importance andcomplexity of the issues at stake and the reliefclaimed.

    DISPUTE PROCEEDINGS

    GENERAL

    Interpretation and Dispensing with Compliance5. (1) These Rules are to be interpreted in a man-

    ner that facilitates the most expeditious determina-tion of every dispute proceeding, the optimal use ofAgency and party resources and the promotion of justice.

    (2) Anything that may be done on request under

    these Rules may also be done by the Agency of itsown initiative.6. The Agency may, at the request of a person, dis-

    pense with compliance with or vary any rule at anytime or grant other relief on any terms that will allowfor the just determination of the issues.

    Filing of Documents and Sendingof Copy to Parties

    7. (1) Any document filed under these Rules mustbe filed with the Secretary of the Agency.

    (2) All filed documents are placed on the Agencyspublic record unless the person filing the documentfiles, at the same time, a request for confidentiality

    under section 31 in respect of the document.8. A person that files a document must, on the

    same day, send a copy of the document to each partyor, if a party is represented, to the partys representa-tive, except if the document is

    (a) a confidential version of a document in respectof which a request for confidentiality is filedunder section 31;(b) an application; or(c) a position statement.9. Documents may be filed with the Agency and

    copies may be sent to the other parties by courrier,personal delivery, email, facsimile or other elec-tronic means specified by the Agency.

    10. A person that files or sends a document by fac-simile must include a cover page indicating the totalnumber of pages transmitted, including the coverpage, and the name and telephone number of a con-tact person if problems occur in the transmission ofthe document.

    11. (1) A document that is sent by email, facsimileor other electronic means is considered to be filedwith the Agency and received by the other parties onthe date of its transmission if it is sent at or before5:00 p.m. Gatineau local time on a business day. A

    document that is sent after 5:00 p.m. Gatineau localtime or on a day that is not a business day is con-sidered to be filed with the Agency and received bythe other parties on the next business day.

    (2) A document that is sent by courier or personaldelivery is filed with the Agency and received by theother parties on the date of its delivery if it is deliv-ered to the Agency and the other parties at or before5:00 p.m. Gatineau local time on a business day. Adocument that is delivered after 5:00 p.m. Gatineaulocal time or on a day that is not a business day isconsidered to be filed with the Agency and receivedby the other parties on the next business day.

    12. (1) A person must not file a document after theend of the applicable time limit for filing the docu-ment unless a request has been filed under subsec-

    tion 30(1) and the request has been granted by theAgency.(2) A person must not file a document whose fil-

    ing is not provided for in these Rules unless a requesthas been filed under subsection 34(1) and the requesthas been granted by the Agency.

    (3) A document that is filed in contraventionof subsection (1) or (2) will not be placed on theAgencys record.

    Language of Documents13. (1) Every document filed with the Agency

    must be in either English or French.(2) If a person files a document that is in a lan-

    guage other than English or French, they must at thesame time file an English or French translation of thedocument and the information referred to in Sched-ule 1.

    (3) The translation is treated as the original for thepurposes of the dispute proceeding.

    Amended Documents14. (1) If a person proposes to make a substantive

    amendment to a previously filed document, theymust file a request under subsection 33(1).

    (2) A person that files a document that amends apreviously filed document, whether the amendmentis substantive or not, must ensure that the amend-ment is clearly identified in the document and thatthe word AMENDED appears in capital letters inthe top right corner of the first page.

    15. (1) If the Agency considers it just and reason-able, the Agency may, by notice, require that a

    person provide verification of the contents of all orany part of a document by affidavit or by witnessedstatement.

    (2) The verification by affidavit or by witnessedstatement must be filed within five business daysafter the date of the notice referred to in subsec-tion (1) and must include the information referred toin Schedule 2 or Schedule 3, respectively.

    (3) The Agency may strike the document or thepart of the document in question from the Agencysrecord if the person fails to file the verification.

    Representation and Change of Contact Information16. A person that is represented in a dispute pro-

    ceeding by a person that is not a member of the barof a province must authorize that person to act ontheir behalf by filing the information referred to inSchedule 4.

    17. A person must, if the contact information theyprovided to the Agency changes during the course ofa dispute proceeding, provide their new contactinformation to the Agency and the parties withoutdelay.

    PLEADINGS

    Application18. (1) Any application filed with the Agency

    must include the information referred to in Sched-ule 5.

    (2) If the application is complete, the parties arenotified in writing that the application has beenaccepted.

    (3) If the application is incomplete, the applicant

    is notified in writing and the applicant must providethe missing information within 20 business daysafter the date of the notice.

    (4) If the applicant fails to provide the missinginformation within the time limit, the file is closed.

    (5) An applicant whose file is closed may file anew application in respect of the same matter.

    Answer 19. A respondent may file an answer to the appli-

    cation. The answer must be filed within 15 businessdays after the date of the notice indicating that theapplication has been accepted and must include theinformation referred to in Schedule 6.

    Reply20. (1) An applicant may file a reply to the answer.

    The reply must be filed within five business daysafter the day on which they receive a copy of theanswer and must include the information referred toin Schedule 7.

    Intervention21. (1) An intervener may file an intervention. The

    intervention must be filed within five business daysafter the day on which their request to intervene isgranted by the Agency and must include the infor-mation referred to in Schedule 8.

    (2) An interveners participation is limited to theparticipation rights granted by the Agency.

    22. An applicant or a respondent that is adverse ininterest to an intervener may file a response to theintervention. The response must be filed within fivebusiness days after the day on which they receive acopy of the intervention and must include the infor-mation referred to in Schedule 9.

    Position Statement 23. (1) An interested person may file a position

    statement. The position statement must be filedbefore the close of pleadings and must include theinformation referred to in Schedule 10.

    (2) A person that files a position statement has noparticipation rights and is not entitled to receive anynotice in the dispute proceeding.

    Written Questions and Production of Documents24. (1) A party may, by notice, request that any

    party that is adverse in interest respond to writtenquestions that relate to the matter in dispute or pro-duce documents that are in their possession or con-trol and that relate to the matter in dispute. Thenotice must include the information referred to inSchedule 11 and must be filed

    (a) in the case of written questions, before theclose of pleadings; and(b) in the case of the production of documents,within five business days after the day on whichthe party becomes aware of the documents orbefore the close of pleadings, whichever isearlier.(2) The party to which a notice has been given

    must, within five business days after the day onwhich they receive a copy of the notice, file a com-plete response to each question or the requesteddocuments, as the case may be, accompanied by theinformation referred to in Schedule 12.

    (3) If a party wishes to object to a question or toproducing a document, that party must, within thetime limit set out in subsection (2), file an objectionthat includes

    (a) a clear and concise explanation of the reasonsfor the objection including, as applicable, the rel-evance of the information or document requestedand their availability for production;

    (b) any document that is relevant in explaining orsupporting the objection; and(c) any other information or document that is inthe partys possession or control and that wouldbe of assistance to the party making the request.

    Expedited Process25. (1) The Agency may, at the request of a party

    under section 28, decide that an expedited processapplies to an answer under section 19 and a replyunder section 20 or to any request filed under theseRules.

    (2) If an expedited process applies to an answerunder section 19 and a reply under section 20, thefollowing time limits apply:

    (a) the answer must be filed within five businessdays after the date of the notice indicating that theapplication has been accepted; and(b) the reply must be filed within three business

    days after the day on which the applicant receivesa copy of the answer.

    (3) If an expedited process applies to a requestfiled under these Rules, the following time limitsapply:

    (a) any response to a request must be filed withintwo business days after the day on which the per-son who is responding to the request receives acopy of the request; and(b) any reply to a response must be filed withinone business day after the day on which the per-son who is replying to the response receives acopy of the response.

    Close of Pleadings26. (1) Subject to subsection (2), pleadings are

    closed(a) if no answer is filed, 20 business days after thedate of the notice indicating that the applicationhas been accepted;(b) if an answer is filed and no additional docu-ments are filed after that answer, 25 business daysafter the date of the notice indicating that theapplication has been accepted; or(c) if additional documents are filed after ananswer is filed, the day on which the last docu-ment is to be filed under these Rules.

    (2) Under the expedited process, pleadings areclosed

    (a) if no answer is filed, seven business days afterthe date of the notice indicating that the applica-tion has been accepted;(b) if an answer is filed and no additional docu-ments are filed after that answer, 10 business daysafter the date of the notice indicating that theapplication has been accepted; or

    REQUESTSGeneral Request

    27. (1) A person may file a request for a decisionon any issue that arises within a dispute proceedingand for which a specific request is not provided forunder these Rules. The request must be filed as soonas feasible but, at the latest, before the close ofpleadings and must include the information referredto in Schedule 13.

    (2) Any party may file a response to the request.The response must be filed within five business daysafter the day on which they receive a copy of therequest and must include the information referred toin Schedule 14.

    (3) The person that filed the request may file areply to the response. The reply must be filed withintwo business days after the day on which they receivea copy of the response and must include the informa-tion referred to in Schedule 15.

    (4) The reply must not raise issues or argumentsthat are not addressed in the response or introducenew evidence unless a request has been filed to thateffect and the request has been granted by theAgency.

    Specific Requests

    Request for Expedited Process28. (1) A party may file a request to have an

    expedited process applied to an answer under sec-tion 19 and a reply under section 20 or to anotherrequest filed under these Rules. The request mustinclude the information referred to in Schedule 13.

    (2) The party filing the request must demonstrateto the satisfaction of the Agency that adherence tothe time limits set out in these Rules would causethem financial or other prejudice.

    (3) The request must be filed(a) if the request is to have an expedited processapply to an answer and a reply,

    (i) in the case of an applicant, at the time thatthe application is filed, or(ii) in the case of a respondent, within one busi-

    ness day after the date of the notice indicatingthat the application has been accepted; or(b) if the request is to have an expedited processapply to another request,

    (2) If the Agency grants the request, it may setlimits and conditions on the interveners participa-tion in the dispute proceeding.

    Request to Extend orShorten Time Limit

    30. (1) A person may file a request to extend orshorten a time limit that applies in respect of a dis-pute proceeding. The request may be filed before orafter the end of the time limit and must include theinformation referred to in Schedule 13.

    (2) Any party may file a response to the request.The response must be filed within three businessdays after the day on which they receive a copy ofthe request and must include the information referredto in Schedule 14.

    (3) The person that filed the request may file areply to the response. The reply must be filed withinone business day after the day on which they receivea copy of the response and must include the informa-tion referred to in Schedule 15.

    dispute proceeding, or to certain of their advis-ors, experts and representatives, as specified bythe Agency, after the person requesting confi-dentiality has received a signed undertaking ofconfidentiality from the person to which the

    copy is to be provided, or(iv) make any other decision that it considers just and reasonable.

    (6) The original copy of the undertaking of confi-dentiality must be filed with the Agency.

    Request to Require Party to ProvideComplete Response

    32. (1) A party that has given notice under subsec-tion 24(1) may, if they are not satisfied with theresponse to the notice or if they wish to contest anobjection to their request, file a request to require theparty to which the notice was directed to provide acomplete response. The request must be filed withintwo business days after the day on which they receivea copy of the response to the notice or the objection,as the case may be, and must include the informationreferred to in Schedule 13.

    (2) The Agency may do any of the following:(a) require that a question be answered in full or inpart;(b) require that a document be provided;(c) require that a party submit secondary evidenceof the contents of a document;(d ) require that a party produce a document forinspection only;(e) deny the request in whole or in part.

    Request to Amend Document33. (1) A person may, before the close of plead-

    ings, file a request to make a substantive amendmentto a previously filed document. The request mustinclude the information referred to in Schedule 13and a copy of the amended document that the personproposes to file.

    (2) Any party may file a response to the request.The response must be filed within three businessdays after the day on which they receive a copy ofthe request and must include

    (a) the information referred to in Schedule 14; and(b) a description of any prejudice that would becaused to the party if the request were grantedincluding, if applicable, an explanation of how theproposed amendments would hinder or delay thefair conduct of the dispute proceeding.

    (3) The person that filed the request may file areply to the response. The reply must be filed withinone business day after the day on which they receivea copy of the response and must include the informa-tion referred to in Schedule 15.

    (3) Minutes are prepared in respect of the confer-ence and placed on the Agencys record.

    (4) The Agency may issue a decision or directionon any issue discussed at the conference without fur-ther submissions from the parties.

    41. (1) The Agency may, at the request of a party,stay a dispute proceeding in any of the followingcircumstances:

    (a) a decision is pending on a preliminary ques-tion in respect of the dispute proceeding;(b) a decision is pending in another proceeding orbefore any court in respect of an issue that is thesame as or substantially similar to one raised inthe dispute proceeding;(c) a party to the dispute proceeding has not com-plied with a requirement of these Rules or with aprocedural direction issued by the Agency;(d ) the Agency considers it just and reasonable todo so.

    (2) The Agency may, at the request of a party, staya decision or order of the Agency in any of the fol-lowing circumstances:

    (a) a review or re-hearing is being considered bythe Agency under section 32 of the Act;(b) a review is being considered by the Governorin Council under section 40 of the Act;(c) an application for leave to appeal is made tothe Federal Court of Appeal under section 41 ofthe Act;(d ) the Agency considers it just and reasonable todo so.

    (3) In staying a dispute proceeding or a decisionor order, the Agency may impose any terms and con-ditions that it considers to be just and reasonable.

    42. (1) The Agency may, by notice to the applicantand before considering the issues raised in the appli-cation, require that the applicant justify why theAgency should not dismiss the application if theAgency is of the preliminary view that

    (a) the Agency does not have jurisdiction over thesubject matter of the application;(b) the dispute proceeding would constitute anabuse of process; or(c) the application contains a fundamental defect.

    (2) The applicant must respond to the noticewithin 10 business days after the date of the notice,failing which the application may be dismissed with-out further notice.

    (3) The Agency may provide any other party withan opportunity to comment on whether or not theapplication should be dismissed.

    TRANSITIONAL PROVISION

    43. The Canadian Transportation Agency Gen-eral Rules , as they read immediately before thecoming into force of these Rules, continue toapply to all proceedings before the Agency thatwere commenced before the coming into force ofthese Rules except proceedings in respect ofwhich the application filed before that time wasnot complete.

    REPEAL

    44. The Canadian Transportation Agency Gen-eral Rules 21 are repealed.

    COMING INTO FORCE

    45. These Rules come into force on June 4,2014, but if they are published after that day, theycome into force on the day on which they arepublished.
