NOTICE is hereby given to all the members of the Association that the 67th ANNUAL GENERAL MEETING of the Members will be held on Friday 20th July, 2018 at 5.00 p.m. at the GSTPAM Association Library Hall, Room. No. 104, 1st Floor, GST Bhavan, Mazgaon, Mumbai–400010, to consider the following agenda:—

AGENDA1. To read and confirm the minutes of the last Annual General Meeting held on 21st

July, 2017.

2. To receive and adopt the Audited Statement of Accounts of the Association, Sales Tax Review and Books and Bulletin for the year ended 31st March, 2018 and the Balance Sheet as on that date and to receive and adopt the Annual Report of the Managing Committee for the year 2017-18. (A copy of the report and accounts would be sent separately).

3. To appoint an auditor for the year ending 31st March, 2019 and fix his honorarium.

4. To receive the report of the Chief Election Officer and declare the results of the Election.

5. To transact any other business that may be brought with the permission of the Chair.

Highlights of the year

1. Strong representations made to the GST Council, Hon’ble Finance Minister, India, Hon’ble Finance Minister, Maharashtra State; Hon’ble Commissioners of State and Central GST on various issues in implementation of GST.

2. Representation and meeting with CGST Commissioner, Thane and CGST Commissioner, Pune on technical glitches and other issues in implementation of GST Law under the auspices of the orders passed by the Hon’ble Bombay High Court.

3. Regularly making submissions and representations on various issues in VAT and GST Administration in several Service Cell Meetings held by the Hon’ble Commissioner of State GST.

4. Representatives from GSTPAM met Mr. Hasmukh Adhia, Finance Secretary of India on 14th December, 2017 at World Trade Centre, Mumbai in an Interactive meeting held with the members of Trade, Industry & Professional Associations to discuss various issues under GST and submitted representation to him. Amendments made in Customs Law in pursuance of issues represented before Shri Hasmukh Adhia regarding sale of imported goods from bonded warehouses.

5. Based on suggestions from GSTPAM, a WhatsApp group has been formed with Hon’ble Commissioner of State GST and other Departmental Authorities wherein the day-to-day issues in filing of the returns are communicated to the group and which are further forwarded to the GSTN Portal IT committee. The restricted group also includes representatives from GSTPAM and one representative each from various districts in Maharashtra.

6. Revival of Regional Centres, wherein representatives were appointed from Tax Practitioners’ Associations in various districts of Maharashtra.

7. Meeting of the representatives of all the Regional Centres was held on 25th November, 2017 at Mazgaon Library to discuss and represent the various issues in implementation and administration of MVAT and GST law. Another meeting of the representatives of the Regional Centres of GSTPAM was held on 1st December, 2017 at WMTPA Hall, Pune.

8. GSTPAM Facebook page activated with details of all forthcoming events and photos and having around 4,000 followers.

9. GSTPAM YouTube Channel activated with more than 100 videos of presentations made by the learned faculties at various seminars/events organized by GSTPAM.

10. Commencement of Live Webcast of various Study Circle Meetings/Mega Guidance Cell Meetings across all the districts of Maharashtra.

11. For the first time, Webinars were conducted on Industry-Specific Topics under GST.

12. GST Referencer 2017-18 prepared with Alphabetical Index of GST Rates of Taxable Goods along with password protected online viewing of the Referencer on GSTPAM Website.

13. GST Referencer 2018-19 in addition to the earlier updated Referencer, contains e-Compilation of GST Acts, Rules, Notifications, Circulars, Press Releases and Chapter wise GST rates with hyperlink to the relevant Notifications.

14. Topic-wise and Industry-wise Short Publications on GST compiled and printed.

15. 21 sessions of Intensive Study Circle Meetings were conducted during the year.

16. Effective use of Sales Tax Review for communication with the Sales Tax Department and business community.

17. Publication of GSTPAM News Bulletin for Members containing Circulars, Short Notes on Tribunal Judgment, Important Judgments on Allied Laws and other information regarding programmes organised by the Association, Renewal of Membership etc.

18. Mega Guidance Cell meetings at Mazgaon Library by Department Authorities as well as by way of Panel Discussion by learned faculties.

19. Workshop on GST with Brains’ Trust Session jointly organised with AIFTP (WZ), CTC, BCAS, MCTC and WIRC of ICAI with 217 participants.

20. 42nd Residential Refresher Course at Hotel Golden Palms Hotel & Spa, at Bengaluru with 198 participants. The delegates had a unique experience of meeting and interacting with Sri Sri Ravi Shankarji during their visit to his ashram at the Art of Living International Centre at Bengaluru.

21. 17th International Study Tour at Paris, Switzerland & Austria with 37 participants conducted, organised and operated by Club 7 Holidays Ltd.

22. Record 23 Outstation seminars held at various districts of Maharashtra during the year.

23. Coaching Class & Mock Tribunal with 77 participants held for the benefit of new as well as experienced members with a view to explain the basics of GST, VAT & CST.

24. Full Day Seminar on GST organised jointly with The Malad Chamber of Tax Consultants on 12th Aug., 2017 at Aspee Auditorium, Malad (W) with a record 895 participants.

25. Orientation Course on GST for in-depth analysis was organised with 92 participants in Aug-Sep, 2017 at Mazgaon Library.

26. Full day Seminar on GST organised jointly with MACCIA, AIFTP (WZ) and TPA Nashik on 7th Oct., 2017 at Khadayta Bhavan, Vile Parle (E).

27. Half Day Seminar on GST on 21st Dec., 2017 at Mysore Association Auditorium, Matunga (E) with 139 participants.

28. Public Meeting on Union Budget, 2018 organised jointly with Ghatkopar CPE Study Circle, Forum of Free Enterprises, Chamber of Tax Consultants and various associations.

29. Triangular Box Cricket Tournament was conducted at Thakur Turf, Kandivali jointly with CTC & MCTC, wherein Team GSTPAM won the Tournament.

30. Health Check-up Camp and Musical Programme on ‘Stress Free Living’ organised on the occasion of Diwali Get-together and Foundation Day of the Association.

31. Lecture on ‘In Search of Tranquility’ by Shri Swami Swatmanandji from Chinmaya Mission under the auspices of Late Shri Arvind Thakkar Memorial Lecture.

32. With a view to formalise the vision of our Association, a formal Vision Statement was prepared and unveiled at the Mazgaon Library.

33. The Constitution Book of our Association was amended and updated.

34. International Yoga Day celebrated by conducting Session on Yoga for Members.

35. Full Day Seminar on GST on 29th June, 2018 at Swatantryaveer Sawarkar Auditorium, Dadar with 482 participants.

36. More than 1000 participants all across Maharashtra simultaneously attended Mega Guidance Cell meeting dated 4th July, 2018 through webcast.

37. GSTPAM Members were invited for celebration for GST Day on 1st July, 2018 in the August presence of Hon. Finance Minister of Maharashtra.

38. Members of GSTPAM were invited to share their expertise in the GST week celebration organized by CGST Commissionerate, Thane.

We have pleasure in presenting the 67th Annual Report of the activities of the Association during the period 2017-18 along with the Audited Statement of Accounts and Balance Sheet as on 31-3-2018.

1. Election for the year 2017-18

At the 66th Annual General Meeting held on 21st July, 2017, Shri J. D. Rawal, Chief Election Officer informed the members present that the election was not required for the year 2017-18. He announced the names of the Office Bearers and Managing Committee members who were elected. The baton of the Presidentship was entrusted to the experienced and dedicated member of the Association, CA Pranav P. Kapadia.

2. Election Committee

Elections are an important aspect of democratic functioning of any organisation. Under Article 17(1) of the Constitution of our Association, an Election Committee was formed to conduct elections for the post of Office Bearers and the members of the Managing Committee for the year 2018-19. The Committee was headed by our Past President, Shri J. D. Rawal as Chief Election Officer.

3. Managing Committee

At the first meeting of the Managing Committee Shri Mayur Parekh, Shri Pankaj Parekh, and Shri Satish Boob were unanimously co-opted as the members of the Managing Committee for the year 2017-18. With their wealth of experience in the functioning of the Association, they guided the members of the Managing Committee and the Office Bearers in the day-to-day issues arising before them.

The members of the Managing Committee for the year 2017-18 comprising young, enthusiastic and dynamic members performed their functions with great zeal throughout the year. During the year, 14 meetings of the Managing Committee were held. The details of attendance are given in Annexure ‘’B’’.

4. Law and Representation Committee

The Law and Representation Committee of the GSTPAM (erstwhile known as The Sales Tax Practitioners’ Association of Maharashtra), has the honourable task of representing around 3,500 members from all across the State of Maharashtra. Year 2017 was the year of major tectonic change in the field of Indirect Taxation. Several indirect taxes having diverse point of levies along with varied tax rates merged into a single Law colloquially called Goods & Services Tax Act (GST). The aim of undertaking such a massive transformation in the field of Indirect Taxation was to bring about uniformity and curtail the cascading effect of taxes which was the case under the earlier regime. The primary role of this Committee is to represent the legal and practical issues which are faced by the practitioners as well as the businesses during the implementation of the GST Act, VAT, Service Tax and allied law.

That being said, unsurprisingly once the euphoria of the birth of the new born child i.e. the GST Laws settled down, cornucopia of issues surfaced. At the same time, the issues under the earlier laws as well were very much live and constantly affecting several tax practitioners and the businesses alike. What was initially labelled as teething problems has in fact degenerated into extremely serious and pressing legal issues in implementation of the new law. It is in the light of such issues that the role of this Committee to act as an effective bridge between the State and Central Departments and the practitioners became extremely crucial and challenging task.

The Committee worked tirelessly to further enhance the reputation of GSTPAM in its role as the prime association representing indirect tax practitioners in the whole of Maharashtra. During the year, the Committee held frequent meetings with the several power centres which were created due to the uniqueness of the GST administration.

The Committee frequently undertook physical as well as written representations with the GST Council, Finance Minister, Commissioner of GST (State & Centre) and several other authorities. It must be noted here that while the entire spectrum of issues ranging from a completely inefficient network, impractical deadlines for filing returns, serious penal provisions to completely clueless administration, were

addressed regularly; the issues in relation to the pending matters of the previous laws were also represented from time to time.

The Committee also held several academic seminars and study circle meetings to make the practitioners aware of the new provisions and to provide them assistance in their practice by further enhancing their knowledge on the new Act. The Committee in synergy with the Website Committee also arranged to broadcast the meetings on line so as to expand the reach of such knowledge dissemination programmes.

Following is the list of 24 representations made by this Committee to address issues in relation to GST laws, MVAT, LBT, Service Tax, etc.

5 22-09-2017 In continuation of Service Cell Meeting on 7th September 2017, some issues regarding VAT and GST were brought before Hon’ble Commissioner such as (i) Assessment proceedings to be kept in abeyance; (ii) Returns under VAT regime and VAT audit turnover limit for FY 2017-18; (iii) Extension of due date of filing of VAT audit report; (iv) Incentive to backward areas; (v) Refunds etc.

6 21-09-2017 Condemning the act of Hon’ble Commissioner while he was addressing a seminar organized by Chamber of Commerce at Nashik wherein some adverse comments were passed against the tax fraternity by alleging that practitioners are deliberately procrastinating the filing of returns with an intention to increase professional fees.

9 03-11-2017 Members as well as dealers were facing difficulties in making payment of VAT/CST appeal fees and hence requested Hon’ble Commissioner to clarify the position so that appeal petition is not rejected for procedural and technical breach of law.

10 06-11-2017 Necessity to change the system of filing GST returns before Hon’ble Finance Minister, Hon’ble Chief Minister of State of Maharashtra, Hon’ble State Finance Ministers and Hon’ble State GST Commissioner so as to bring more simplicity in filing returns especially GSTR-1, GSTR-2 and GSTR-3.

11 06-11-2017 Lots of problems were faced by members in complying GST law especially in filing of returns under GST due to which dealers were liable to pay late filing fees due to technical glitches. All such problems were brought to the notice of Hon’ble Commissioner so that it can be forwarded to GST Council. Moreover, a separate representation had been submitted before Office of the Prime Minister of India, Finance Minister of India, Revenue Secretary of Finance Department of India and Commissioners of Central GST.

12 23-11-2017 Assessing officers were carrying out ex-parte assessments for the F.Y. 2015-16, these problems were brought to the notice of Hon’ble Commissioner.

13 25-11-2017 Meeting with Regional Centres of Maharashtra was held at Mumbai and Pune wherein members from Jalgaon, Dhule, Kolhapur, Solapur, Amravati and various other districts were present and the difficulties/issues faced by them were gathered and forwarded before the Hon’ble Commissioner.

14 14-12-2017 Representation for extension of date of filing of VAT audit report in Form 704 which was due on 15th January 2018 as various difficulties faced by our members as well as trade in general and urge to extend till 31st March 2018. This representation was filed before Hon’ble Chief Minister of Maharashtra, The State Finance Minister of Maharashtra and The Additional Secretary (Finance Department) Maharashtra State.

15 03-01-2018 Since the extension was not yet granted, again committee had a personal meeting with Hon’ble State Finance Minister and requested for extension of date of filing of VAT Audit Report at an early date to avoid any panic situations among members as well as trade.

16 15-01-2018 Pre-Budget Memorandum on GST17 13-02-2018 At last, State of Maharashtra, after a rigorous follow ups of

communications and personal meeting with State authorities, convinced State to extend due date of filing of audit report from 15th January 2018 to 15th February 2018. But unfortunately, there was no end to the problems to the problems of our members as now website where in annual audit have to be uploaded was giving problems and also annual revised return was also not introduced. Hence, again committee had approached the State Finance Minister and Commissioner to extend the further time period of 15 days for filing / uploading of VAT audit report.

18 01-03-2018 Representation made to Hon’ble SGST and CGST Commissioners under the auspices of Order of Bombay High Court in the Writ Petitions in the case of Abicor & Binzel Technoweld Pvt. Ltd. and Padmavati Enterprises.

19 07-03-2018 Assessment proceedings for the financial year 2013-14, 2014-15, 2015-16 and 2016-17 were carried out by the Assessing Officer and not much time limit for furnishing details/documents were provided to the dealers and it was observed and experienced by members that Assessing officers are passing “ex-parte” assessment orders. In the absence of provision to cancel an ex-parte assessment order in Form 316, dealers have no other options but to file appeal petition and such appeal petitions

were sometimes becomes a costly affair as dealers have to mandatorily pay 10% of the tax liability as part payment. Hence, it was urged before the Hon’ble State Finance Minister to ensure that provisions of Section 26(6A) and (6B), will not be applicable to Orders passed Ex-parte.

These points were also being part of the suggestions for State Budget 2018-19.

20 07-03-2018 Annual revised returns have to be filed by dealers, either before or after the completion of VAT audit reports. State authority had introduce new template on 17-02-2018, after completion of due date of filing audit report of F.Y. 2016-17 vide Circular No. 7T of 2018. New format introduced were suffering from various difficulties and hence it has been brought to the notice of the State authorities. It was suggested that the option of Single Revised Annual Return Template should be made available to the dealers an which was subsequently introduced.

21 12-03-2018 Clarifications sought with regards to LBT payable by dealers having turnover more than ` 50 Crores on Purchases with in the local limits of Municipal Corporations before Urban Development Department.

22 15-03-2018 There was a consistent problem in functioning of website of the department of Sales tax, on the last days of filing of returns websites were not working for a continuous period of 2-3 days and this had been brought to the notice of the Hon’ble Commissioner.

23 12-04-2018 In a monthly service cell meeting organized by Hon’ble Commissioner, certain points viz. (i) Short notice for calling service Cell Meeting; (ii) Refund of Voluntary Deposits of ` 25,000/- paid by the dealers at the time of obtaining registrations; (iii) Generation of Declaration forms; (iv) Issues in filing of Profession Tax Returns etc.

24 15-06-2018 In a monthly service cell meeting organized by Hon’ble Commissioner, various current issues were submitted for further clarifications.

Certain achievements

1. Due date of filing returns under GST were extended due to technical glitches in initial months of introduction of GST;

2. Reversal of levy of late filing fees while filing returns under GST due to technical glitches;

3. Revising the facility of filing TRAN-1 and extension of time limit for filing TRAN-1;

4. Extending due date of filing of VAT Audit Report;

5. Introduction of simplified Annual Return under u/s. 20(4)(b);

6. On the directions of Hon’ble Mumbai High Court, GSTPAM represented the various problems faced by the taxpayers in implementation of GST returns and filing of forms, before Hon’ble Central and State Commissioners along with GSTIN authorities;

7. Amendments made in Customs Law in pursuance of issues represented before Shri Hasmukh Adhia regarding sale of imported goods from bonded warehouses.

8. Maharashtra State Finance Minister sent proposal to GST Council for making changes in pattern of filing returns on the basis of representation given by association. The matter is pending before GST Council.

The Committee had pro-actively acted to educate the members and had organized following Study Circle Meetings during the year.

5. Journal Committee

Our prestigious publication Sales Tax Review, a Monthly Journal and mouthpiece of members was published uninterruptedly, every month under the able Editorship of Shri Vikram Mehta and Associate Editor Shri Dhaval B. Talati along with the guidance and support of the Editorial Board comprising Shri S. S. Gaitonde, Shri P. V. Surte, Shri P. C. Joshi, Shri R. S. Pathak, Shri C. B. Thakar, Shri D. H. Joshi, Smt. Nikita Badheka, Shri Vinayak Patkar, Shri Pravin Shah, Shri Ashvin A. Acharya and Smt. Sujata Rangnekar.

For the term of F.Y. 2017-18, Shri Vikram Mehta as Chief Editor and Shri Dhaval B. Talati as Associate Editor of the Sales Tax Review have rendered their esteemed services.

The Journal comprising columns, articles, GST Updates, Do you Know?, Replies to Queries, Representation & Response, Important Judgments, Income-tax Updates, Gist of Case Laws, Gist of DDQ’s, Recent Notifications & Circulars under CGST, SGST & IGST, Recent Amendments, Tax Digest, From the Courts etc. continues to be a constant companion of practitioners. The Journal Committee was headed by Shri Mayur Parekh as the Chairman and Shri Dilip V. Nathani and Shri Ishaan Patkar as the Jt. Convenors. The Committee rendered valuable assistance in the publication of the Sales Tax Review on GST.

During the year one of the most awaited events of our country, GST was introduced. Articles of prime importance on burning topics of “GST Law” and various articles on Filing of Returns, Refunds, Transitional Provisions, E-Way Bill, Place of Supply, Composite Supply, various issues in implementation of GST and its impact on various Industries as well as challenges to professionals were published during the year.

6. Library Committee

Association’s utmost priority is to provide the members with the latest publications and material on the subjects of various tax laws. The libraries situated at the Vikrikar Bhavan, Mazgaon and Suburban Vikrikar Bhavan, Bandra cater to this important requirement.

The library committee was formed under the chairmanship of Shri Dattatray V. Phad and Convenor Shri Vivekanand R. Rao.

Both the libraries were updated with latest books, Newsletters and Journals The Library Committee, looking into the modern trends of webinars, live streaming etc., has purchased new projectors and have carried out repairs in the library New sign boards of GSTPAM were installed at the Mazgaon and Bandra libraries.

“TAXMAN” software licence at Mazgaon Library is maintained to update the members with latest judgments, Amendments/Circulars/Notifications on GST, VAT, Income Tax, Service Tax and Excise Laws.

The Library Committee has installed mobile chargers in the inner and outer sections of the library for the benefit of the members.

Various meetings like Mega Guidance, Coaching Class, Study Circles etc. were held/conducted successfully during the year in the library.

7. Coaching Class Committee

Coaching Class is an important activity of the Association to provide training to new entrants in the profession through series of interactive sessions addressed by experienced members of our Association. 32nd batch of Coaching Class was organised under the able Chairmanship of our Hon. Jt. Secretary Shri Raj Shah and Jt. Convener’s Shri Sunil D. Joshi and Smt. Sonali Bapat at our Association’s library at Mazgaon. This year, being a first year of GST Law, the coaching class lectures focused more on topics of the GST law along with lectures covering practical aspects of VAT, CST and Profession Tax. The total number of participants was 77 which consisted of new entrants in the practice of taxation, students who were pursuing professional courses and considerably of the practicing professionals.

This batch of Coaching Class was inaugurated by our Past President, Adv. Shri Deepak Bapat on 22nd November, 2017 and total 22 lectures on GST, VAT, CST and Profession Tax were conducted during the course. Three lectures were conducted every week and the classes were successfully completed in a span of mere 38 days.

Mock Tribunal was organised by the Committee at GSTPAM Library Mazgaon wherein the students of the coaching class and members of Association have actively participated as appellants and defendants. Mock Tribunal was inaugurated by Past President, Adv. Shri Deepak Bapat and Adv. Shri Ratan Samal who also chaired the session as Jury Members and guided the participants.

The Committee was headed by President Shri Pranav Kapadia as Chairman and Shri Pravin Shinde jointly with Shri Jatin Chheda as Convenors. During the year, no staff has left or joined the job. The day-to-day issues of office administration have been attended by the Committee members regularly along with proper guidance given to office staff as and when required which in turn results into smooth functioning of work at our office.

The duties of the existing staff have been reorganised so as to increase work efficiency among the staff. The rotation duty of staff were also carried out during the year. The Committee has taken reports containing details of work completed and work pending from staff on regular basis. Implementation of surprise checks and various check-lists have increased efficiency of the staff.

The Mega Guidance cell Meeting dated 4th July, 2018 was held at the Mazgaon Library on “Intricacies in filing of VAT/ CST/GST/PTR Returns, Refund Application (501), obtaining Declarations Forms, J1-J2 Mismatch”. The queries on the above subject were given to the Department official in advance on which the answer were given by them. The Meeting was attended by large number of members at the library and the meeting was simultaneously webcasted across various regional centers throughout Maharashtra. We are thankful to the office bearer of each of the regional centers who had taken great efforts in arranging the said webcast through projector and screen at seminar hall of the association/Department/at their offices. More than 1,000 participants attended this meeting through webcast and were benefited by this mega guidance cell meeting. We are also thankful to CA Hiral Shah for arranging this webcast.

10. Intensive Study Circle Committee

We are witness to the introduction of “Goods and Services Tax Act (GST)”, the biggest Indirect tax reforms in India after Independence, which was proposed as “ONE NATION, ONE TAX”. Our members are required to be well-equipped with knowledge of GST.

We all are aware that several practical difficulties are being faced in implementing and applying the rules and procedures of the GST. Keeping this in mind and with the view to update our fellow members on the latest developments in law and to discuss the practical issues arising therefrom, our Association has been regularly conducting Intensive Study Circle meetings. This time entire programme was designed to cover whole GST right from Transitional provisions to Issues in GST Audit.

At the intensive Study Circle, one of the members acts as a group leader and leads the discussion on issues of the relevant subject and one of the senior in the profession, monitors the discussion. The meetings are generally arranged on 1st and 3rd Saturdays of the month (working Saturdays of Sales Tax department), during 10.30 a.m. to 1.00 p.m. at Mazgaon Library. However, this time we have scheduled some meetings of Intensive Study Circle even on week days, to provide benefit of more meetings and more discussion on subjects, at the meeting.

The Intensive Study Circle was inaugurated on Saturday, 5th August, 2017 at Mazgaon Library at the hands of CA. Deepak Thakkar, where he has also acted as the monitor of the first session.

The Intensive Study Circle committee was headed by Treasurer, Shri Dinesh Tambde as a Chairman with the Joint Convenors Shri Dilip V. Nathani and Shri Pravin Shinde. Total 21 meetings were scheduled starting from 5th August, 2017 and ending on 12th July, 2018. Total 157 record number of Participants had enrolled for the Intensive Study Circle meetings. This time the convenors were in regular touch with the participants through e-mails and messages and were updating them about the meetings and at the endeavour’s of the convenors, the study materials were mostly made available to the participants in advance before the start of every meeting.

11. Referencer Committee Parts A, B & C

The GSTPAM Referencer book has taken a move ahead and it has become now an most appreciable and a must book for every practitioner practicing in Indirect taxes. This year’s Committee was headed by Hon. Secretary Shri Aalok Mehta as a Chairman along with Shri Premal Gandhi & Smt. Sonali Bapat as Joint Convenors.

Last year we have selected the theme as “MOVING AHEAD” and in line of the same, this year our theme is “MOVING, ACCEPTING, FACING AND CHALLENGING THE CHALLENGES” for “REFERENCER 2018-19”. This year, the Committee has decided to publish combined Referencer for VAT Act, GST Act & Other allied Indirect Tax Laws. We are confident that the members will be much benefited by this combo nature of Referencer for Indirect Taxes.

Along with the Referencer 2018-19 a complementary e-Compilation of GST Acts, Rules, Notifications, Circulars, Press Releases and Chapter wise GST rates with hyperlink to the relevant Notifications will also be provided to the subscribers on our website www.gstpam.org. The Referencer and e-Compilation’s viewing will be password protected and will serve as a Digital Knowledge Bank. We acknowledge the efforts of the members of Publication Committee CA. During the year, our Association has published it’s First Referencer on GST. The GST Referencer 2017-18 contains Explanation on various provisions of GST Law in a lucid manner by various experts, Gist of Circulars, Notifications, Orders, Press Releases issued under GST Law till 30-11-17, Gist of important Judgements issued under GST, Alphabetical Index of Rate Schedule of Goods indicating the changes in rates, Index of Rate Schedule of Services, Exempted Services, Exempted Goods, Notified Goods & Services under RCM.

and frequent amendments being made in the GST Law after its implementation. The amendments made upto 15th November, 2017 had been duly incorporated in the GST Referencer 2017-18. Password protected e-version of the GST Referencer has also been made available to its subscribers in our website www.gstpam.org.

The new GST Referencer 2017-18 had an overwhelming response and around 4,750 copies were sold.

12. Residential Refresher Course Committee

Residential Refresher Course is always an eagerly awaited event of the Association since it provides an atmosphere of learning in relaxed environment. This Committee was headed by Past President Shri Sachin Gandhi as Chairman along with Convenor Shri Prashant Vora. The 42nd Residential Refresher Course was held from 15th February 2018 to 18th February, 2018 at The Golden Palms Hotel & Spa – Bengaluru.

The essence of the RRC was GST and the theme was Gaining the Edge - Strategies for Success - The Challenge of Changes. Due to the onset of a new law and several meetings having been already conducted on the provisions of law, the emphasis in this RRC was to move a step ahead and indulge in discussing the various issues prepared by the paper writers. The concept of panel discussion was also introduced in this RRC which was very much appreciated by the participants.

A unique feature of this RRC was that the Group Leaders and Mentors interacted with the respective Paper Writer and Chairman through Video Conference few days before the commencement of the RRC. This initiated the learning process for the topics covered and cleared the doubts of the group leaders on the facts mentioned in the case studies prepared by the Paper Writers. During the RRC, sufficient time was allocated for the brain storming group discussions after which the Group Leaders and Mentors had a separate reporting on the views of their groups to the Paper Writer and Chairman. Subsequently, the Paper Writers presented their paper and views on the case studies with expert comments from the Chairman after duly considering the views of the groups. This new system enlightened and enriched the knowledge of the participants.

International Centre at Bengaluru. RRC Commitee acknowledges the efforts made by our member and representative from Regional Centre Shri Rajkumar Bhambare for arranging the interactive meeting with Guruji, meditation and sightseeing for the members at the ashram. The participants also enjoyed sightseeing programme of Bannerghatta National Park with Safari excursion. 13. International Residential Refresher Course

The 17th International Residential Refresher Course of our Association was organised at Swiss/Paris/Austria under the Chairmanship of Shri Sachin Gandhi and Convenorship of Shri Sunil Khushalani from 29th April 2018 to 9th May, 2018. The International Residential Refresher Course received a good response participation of 37 delegates.

The tour was conducted by Club 7 Holiday Limited and all the delegates appreciated the service provided by the tour operator throughout the tour.

As overwhelming response was received by the members and due to the limitation of seats in the auditorium, 2 auditoriums were booked in the same venue and the speakers had given their speech at both the auditorium alternatively, one after another on the same day. This type of approach of GSTPAM was welcomed by the members and was appreciated by all.

2. During the year, the committee also organised Half Day Workshop for in-depth analysis & study of GST law. The unique feature of the workshop was that the concept of Presenter & Supervisor was introduced. The presenters had presented their views on the given subjects and the same was supervised by seniors in the profession. Participants got an opportunity to interact with the presenter and supervisor. The workshop had focused on the practical aspect as well on the procedural issues. The workshop had 4 lectures of 3 hours each and it was conducted on 28th August, 2017, 6th September, 2017, 8th September, 2017 & on 11th September, 2017 at GSTPAM Library, Mumbai. Delegates participated from different profession and industry in the said workshop. The presenters were CA. Parita Shah, CA. Aditya Surte, CA. Mayur Parekh and CA. Krunal Davda and their supervisors were CA. A.R. Krishnan, CA. Sunil Gabhawala, Adv. P. C. Joshi and CA. Parind Mehta respectively.

3. Another Full Day Seminar was organized on 7th October, 2017 jointly with Maharashtra Chamber of Commerce, Industries and Agriculture, All India Federation of Tax Practitioners (WZ) & Tax Practitioners Association, Nashik on the subject of “Challenges under GST Act” at Shri Kadayata Bhavan Mandal Hall, Vile Parle, Mumbai. The said seminar was Inaugurated by Adv. Shri P. C. Joshi and in the said seminar amendments made on 6th October, 2017 in the 22nd Council meeting of GST Council was also discussed by CA. Ashit Shah, the amendments were just announced 1 day before the seminar. Participants benefitted a lot from said seminar. 4. Another Half Day Seminar was organized on Recent Amendments and Provisions relating to Import & Export under GST Law on 21st December, 2017, at Mysore Association Auditorium, Matunga, Mumbai. The learned speakers were CA. Ashit Shah & CA. Ankit Chande. And it was participated by 139 delegates. Members present gained the knowledge shared by the speakers and also appreciated the new venue.

5. Our association had organised it’s most awaited workshop i.e. the Workshop on GST law jointly with AIFTP (WZ), BCAS, CTC, MCTC and WIRC of ICAI for the year 2017-18. This was the 9th continuous year of the joint workshop. It was organized from 17th Jan, 2018 to 14th Mar, 2018, on every Wednesday at GSTPAM Library, Mazgaon. Total 217 delegates had participated from profession & industry in the said Joint Workshop. The Joint Workshop consisted of 14 technical sessions with 14 eminent speakers and also a brain trust session at the end with 4 eminent speakers as Brains’ Trustees in the Mega Brains’ Trust Session. The topics of the workshop were selected to cover in-depth and practical understanding of GST Law and the Challenges to be faced in GST Era. The sessions were very interactive and the delegates discussed the intricacies of the subject in detail.

6. A Full day Seminar on GST law was organized on 29th June, 2018 at Swatantryaveer Savarkar Rashtriya Smarak, 252, Swatantryaveer Savarkar Marg, Near Mayor’s Bungalow, Shivaji Park, Dadar (West) Mumbai-400028. Keynote addressed was given by Hon’ble Commissioner of SGST, Maharashtra State Shri Rajiv Jalota. The Seminar had an overwhelming response and the registration for the seminar was closed 7 days before the seminar date and was attended by 482 participants. Many outstation members had also attended the seminar.

15. Finance & Accounts Committee

The Committee under the Chairmanship of Shri Mayur Parekh with Convenor Shri Dinesh M. Tambde, Hon. Treasurer along with President Shri Pranav P. Kapadia, Vice President Shri Pradip Kapadia, Jt. Secretaries Shri Raj P. Shah & Shri Aalok Mehta and Committee Members Shri Hiten Shah, Shri U. M. Loonawat, Shri R. S. Pathak, Shri Suresh Sanghavi, Shri Sachin Gandhi, Shri Janak Vaghani, Shir V. R. Ghelani, Shri K. M. Shah, Shri Pravin Shah and Shri Pankaj Parekh met at Periodical Intervals to review finance and accounts of the Association.

This is the first year when GST is implemented and therefore, it was but obvious that it would accompany several implications from the perspective of expenditure, accounting, administration etc. It was great help from the Chairman Shri Mayur Parekh, Past President Shri Sachin Gandhi and President Shri Pranav Kapadia who helped in taking every possible care in implementing adequate changes in administration and accounting.

It was great help from the members of Finance Committee who reviewed the periodic accounts minutely and suggested the required changes and precautions in income and expenditure of Association. The discussion in Finance Committee meetings have always illuminated the office bearers to think in different advantageous perspective for Association. The Finance Committee which consists of several senior members have always proven to be a great support even in administration of the Association. Keeping this in mind, here it is necessary to specifically thank Shri K. M. Shah, Shri Suresh Sanghvi, Shri U. M. Loonawat and Shri R. S. Pathak who have always shown great support in administration with their positive words and suggestions.

The audited annual accounts for the year ended 31-3-2018 is printed along with this Annual Report.

16. Regional Centres and Outstation Seminars Committee

We take proud privilege to submit our report of above committee for the year 2017-18.

Record 23 Outstation seminars held at various districts of Maharashtra during the year.

We are happy to confirm that the basic goal of the activities of the Association to enrich the knowledge of our members, non-members tax practitioners, and of the general public by conducting seminars all over Maharashtra have been triggered.

We are thankful to the President and Managing Committee members of GSTPAM who had extended their positive co-operation by attendance at various seminars.

We are thankful to all the faculties who had extended extreme support by delivering lectures, updating knowledge and providing notes to the participants.

We also feel gratitude about our all participants who had helped us to make each event a grand success.

We solicit our sincere thanks to other associations like AIFTP, WMTPA and regional taxation bodies who jointly organised seminars with us.

Meeting of the representatives of all the Regional Centres was held on 25th November, 2017 at Mazgaon Library to discuss and represent the various issues in implementation and administration of MVAT and GST law. Another meeting of the representatives of the Regional Centres of GSTPAM was held on 1st December, 2017 at WMTPA Hall, Pune.

The interaction with members of the regional centers and sharing of knowledge to the members in the districts all over Maharashtra, resulted in enhance coordination and brotherhood amounts the outstation members and also attracted many professionals to become the members of GSTPAM.

17. News Bulletin

Under the Chairmanship of Shri Dinesh Tambde and Joint Convenor Shri Sunil Joshi and Shri Jatin Chheda, the Association has periodically published News Bulletins during the year 2017-18. With the able guidance and active support of the President Shri Pranav Kapadia the committee could make the News Bulletin precise.

The News Bulletins are uploaded on GSTPAM website. The GSTPAM News Bulletin contains details of the all programmes of the Association during the month, Goods and Service Tax Updates, Sales Tax Updates, Income Tax updates, Short Notes on the recent decisions of the Maharashtra Sales Tax Tribunal, Gist of Goods and Services Tax Notifications and Circulars which were contributed on a monthly basis by experts and are useful to the members of the Association for getting important information at a glance.

18. Membership & Subscription (Local)

The Membership & Subscription (Local) Committee was chaired by Shri Raj Shah with the Joint Convenors Adv. Amol Shirode and CA. Bhaven Mehta. This year we are headed with aim to increase the membership count and standardise the renewal processes.

In current year we have informed about the activities of our association in the form of ‘About GSTPAM’ in various seminars, events and lecture meetings to the participants and it has resulted in addition of new members. This year the committee has redesigned the Membership, Renewal & Subscription forms where new forms were short and simple in structure and were easy to fill up. The forms were mailed as well as delivered by post/courier to the members with personalised details of the members, which were very useful & well appreciated by the members. In the year we had verified and updated master data of the members and corrected the details of the members whereever required. The committee has followed up with the members for renewal of their membership through e-mails, phone calls and also through text messages, which has resulted in renewal of the lapsed members also.

We are thankful to our President Shri Pranav Kapadia for giving his continuous guidance and we are also thankful to our committee member CA. Dharmen Shah for his continuous support.

We are hopeful that the efforts of the Convenors and members of committee, must have benefitted the members by getting proper updates and information of the association and also it must have resulted in effective communicating the activities of the association.

19. Membership & Subscription (Outstation) Committee

As Joint Convenor of Membership and Subscription (Outstation) Committee, task assigned to us was to increase the interaction with outstation members and to organise seminars on contemporary subjects in regions other than Mumbai. Accordingly on 8th August, 2017 two seminars were organized at Sangli and Kolhapur and on 16th August 2017 with local organised the WMTPA, Pune. The Full day seminar at Pune was inaugurated in the presence and at the auspicious hands of President Shri Pranav Kapadia. In the said seminar the President briefed about the work of the GSTPAM (erstwhile STPAM) and encouraged the participants to become the member of the GSTPAM narrating various activities undertaken by the Association in the interest and for the benefit of the members.

professionals in day-to-day practice and to draft the agenda of their grievances, joint meeting was organised in Pune. The members from different parts of Maharashtra attended the meeting held on 1st Dec., 2017. The office bearers of the GSTPAM, Mumbai including President Shri Pranav Kapadia attended the meeting and addressed the august gathering explaining the role of our association in resolving the problems faced by the members. 21. Sports Committee

Under the Chairmanship of Shri Aalok Mehta and Joint Convenor Shri Mahesh Madkholkar & Shri Ajay Talreja, Second Triangular Indoor Box Cricket Tournament (with Tennis Ball) was organised by our Association jointly with The Chamber of Tax Consultants and The Malad Chamber of Tax Consultants on 10th March, 2018 at The Turf Club, Thakur Village, Kandivali, Mumbai. Our Association won the Tournament under the captainship of Shri Aalok Mehta, We are thankful to all the members who have participated in this tournament. We are also thankful to The Chamber of Tax Consultants and The Malad Chamber of Tax Consultants for their support in organising this mega event. Further on 21st June 2018, “International Yoga Day” was celebrated by Organizing Workshop on Yoga, by Yoga Instructor Shri Sachin Dixit at our GSTPAM Library, Mazgaon.

22. Tribunal Judgments & Short Note Committee

Committee was headed by Chairman Shri C. B. Thakar and Joint Convenors Shri Aditya Surte and Shri Parth Badheka. The work of checking and chronologically listing the judgments of the Maharashtra Sales Tax Tribunal, which was commenced by this committee in the preceding year was continued and streamlined to collect and update all the judgments up-to-date. The convenors, with the help of fellow committee members Shri Vinod Mhaske, Shri Vivekanand Rao, Shri Sunil Joshi, Shri D. V. Phad, Shri Dharmen Shah and Smt. Sonali Bapat, have undertaken the work of preparation of gist of important judgments for the benefit of members at large and to display the same on the website and publish in the News Bulletin.

23. Website, Webinar and I.T. Committee

This committee was headed by Shri Pranav Kapadia as Chairman and Shri Hiral Shah & Shri Dharmen Shah as Convenors. The website is an important and efficient tool to disseminate information amongst the members all over Maharashtra. It works as a catalyst to strengthen the bond between the Association and Members.

Website Upgradation

In the current year, the website domain “stpam.org” was shifted to “gstpam.org” pursuant to change in name of our Association. The website is made more responsive to the users with increased functionality. Following new features are added to the website: -

1. New polls on GST which got 464 responses from members of Association.

2. Study Material distributed at various events of GSTPAM like Intensive Study Course, Coaching class, workshop, and other events are available on website to all members post login.

3. Massive drive of updating GST numbers of members is carried out by hosting link on website so all members can provide their GST numbers online.

4. A new functionality of self-recording seminars, workshops conducted by association was introduced which led to immediate uploading of seminar videos on website within a span of 3 days to a week.

5. Photos with captions of events conducted by Association are updated on website within 2 hours of event completion.

6. GST Referencer 2017-18 is uploaded and accessible from website.

7. RRC photos were shared in bulk with members by using google drive to maintain quality of photos so all members can have their fond remembrances of RRC.

8. Timely updation of payment links in line with providing options for advance memberships to the members at a single click from office.

9. New e-mail ID for law and representation committee was activated to enable members of Association to forward all queries immediately sitting in office without having to submit physical applications.

Due to all above functionalities on website, visitor count of website has crossed 3.7 lakhs.

Mass e-mail & Mass-SMS

The mass e-mail facility has been successfully implemented and configured to ensure e-mails reach members inbox instead of spam mail box for all communications of Association and has been effectively used for following:

1. Mailing News Bulletin to all members in a timely manner.

2. Mailing events intimation and reminders to all members so they can attend in time and block their calendars.

3. Mailing Webinars links to members for joining events.

4. Sending pre-filled membership forms to members for renewal.

5. Mass SMS is regularly being used to update all members on the go about events conducted by association.

Webinar Implementation & Live Streaming

One of the most modern concepts of Webinar i.e., attending Seminars at the convenience of sitting at home, office, or during travelling has been introduced by our Association. After conducting thorough survey of arranging webinar, a smart and the most cheapest way was chosen to ensure webinar remains free to all members. Live Meeting on the web was held for Group Leaders and Mentors of RRC so that the Geographical distance constraints of Group Leaders and Mentors was eliminated.

This new technology has revolutionised the way Association arranges regular Study Circles leading to live streaming thus enabling benefit even to those members who could not attend in person at the GSTPAM Library. This technology has enabled to bridge the distance of out-station members leading to huge saving of time.

During some important live streaming sessions, Regional Centres were involved and seminar halls were booked for members to come together and watch the webinar live and also raise queries online by show of hands to the speaker. The webinars were well-attended (approx. count going up to 500 at a time). The appreciations from members led to multiple webinars being conducted during the year.

Reactivating Facebook Page (Social Media)

1. The Facebook Page is reactivated with additional security and a sign up form is created so as to enable any visitor to fill up membership form.

2. All events to be held are regularly updated on Facebook in advance. Post events photos and videos are uploaded for each event.

3. Various members have started commenting and liking every Association event on Facebook. Comments are also received appreciating the posts and to continue the activity of posting events.

4. As per analytics report of Facebook initially after activation, members visiting facebook page has increased by more than 1000%. Our every post is viewed approximately by around 750 - 1,000 people.

5. As on date, 3,843 users are following our Facebook Page. As per Facebook report, users following Facebook Page are located across globe and from various States in India.

Re-activating YouTube Page

1. The YouTube Page has been activated to the full extent along with proper event name and speaker name which has resulted in 312 subscribers as on date.

2. Every video uploaded after revamping of YouTube channel has resulted in average 50 to 1505 views for every video.

3. This channel is linked to Facebook and our website for update on every new video uploaded resulting in further views at these locations.

GSTPAM in Newspapers (Print Media)

1. GSTPAM appeared in newspaper a number of times. Some of the instances are as below –

– When the new committee was formed, GSTPAM hit the newspaper announcing the event.

– On change of name from STPAM to GSTPAM in Mumbai Samachar.

25. Advance Ruling Compilation Committee Report

This Committee undertakes the task of publishing gist of Advance Rulings / DDQ orders under GST/ VAT laws in the Sales Tax Review and preparing and publishing the compilation of orders on calendar year basis. The Committee headed by Shri Dinesh M. Tambde as Chairman and Shri Ishaan V. Patkar as the Convenor, have taken great efforts in preparing the gist of DDQ and published in Sales Tax Review throughout the financial year for the benefit of the members of the Association.

26. Constitution Amendment Committee

Constitution is a set of fundamental principles or established precedent according to which Association or Trust is undertaking its varied useful activities.

Constitution Amendment committee was formed which was headed by one of the seniormost members of our Association, Shri P. C. Joshi Convenor was Shri Sunil G. Khushalani.

During the tenure of our Committee the G.S.T. Act was introduced. Consequently it was necessary to change the existing name “The Sales Tax Practitioner’s Association of Maharashtra’’ to “The Goods & Services Tax Practitioners’ Association of Maharashtra”.

The Committee initiated the proceedings. Subsequently a Special General Meeting was convened to approve the change of the name of Association as also other consequential changes which were not effected in the previous years were also to be considered.

Accordingly a notice was issued and the Special General Body Meeting was held on 17-3-2017 & 28-4-2017. All the proposals were approved to be carried out in the constitution of our Association.

After the approval in Special General Meeting, proper change in name & other Clauses was reported to the Hon’ble Asst. Charity Commissioner in schedule III on 18-1-2018 Hon’ble Charity Commissioner approved the name and other changes to the constitution.

Due to change in name of Association as other clauses of Constitution, the amended booklet of our Association was unveiled in the hands of our senior members Shri P. C. Joshi and Shri D. M. Gala and our President CA. Pranav P. Kapadia on 23-2-2018, in the presence of large number of members who attended “Arvind Thakker Memorial Lecture’’.

We would like to place on record our appreciation to all the members of this Committee President CA. Pranav P. Kapadia, Past President Dr. Shashank Dhond, Treasurer Shri Dinesh Tambde without whose help the task couldn’t have been completed.

We would also like to thank Shri P. C. Joshi and Shri D. M. Gala and other seniors, without their blessings/ guidance or co-operation the task would have remained incomplete.

27. Foundation Day & Diwali Get-together

The 67th Foundation Day of our Association was celebrated on 17th November, 2017. A Health Check-up and Computerised Eye-Testing camp was organised for the members and their family members on the occasion of Foundation Day. It was for the first time in the history of Association that such a camp was organised. Medical Representatives from reputed pharmaceutical companies like Cipla, Glenmark Pharma, Ajanta Pharma, Biosense etc., carried out the medical tests such as Random Blood Sugar (Diabetes), B.M.D. (Osteaophorisis-Calcium), Uric Acid, Asthama along with Dental Check-up and Eye Testing (Computerised and Manual).

The Health Check-up camp was followed by a Musical Programme on Stress Free Living by Mr. Sanjeev Shah who explained how to live stress free in a unique musical presentation by correlating his talk with Hindi Movie Songs.

A. Significant Accounting Policies

Statement of Significant Accounting Policies:

1 Method of Accounting

Accounts are maintained on accrual basis.

2 Fixed Assets and Depreciation

Fixed assets are stated at cost. Depreciation is provided on fixed assets on written down value method as prescribed under the Income Tax Rules.

3 Investments

Investments are stated at cost of acquisition.

4 Inventories

Own Publication issued during the year are valued at cost. Obsolete stock of Compilation of MVAT Rule C.D., Compilation of Gazette & Notification C.D., Circular DDQ CD-2011, DDQ CD - 2012, DDQ CD - 2013, 37th RRC Paper (Hyderabad), 38th RRC Paper (Jaipur), 39th RRC Paper (New Delhi) 40th RRC Queries Paper (Amritsar), Recent Amendments-2013, Beginners Book - 2013-14, Beginners Book - 2014-15, 17th NRRC, Short Publication - LBT, are written off and valued at token value ` 1/-each.

5 Admission Fees, Donor Membership Fees, Patron Membership Fees and Life Membership Fees

All these fees are capitalised and transferred to respective Fees a/c.

6 Previous year figures have been regrouped/ recast wherever necessary.
