F. PENDING BUSINESS 1. Water Update - (Grimm) There was discussion at the NKSA meeting about some of the

crests that occurred with the water flow in 2019. There are concerns about historic flooding in the area. Staff is engaged in emergency response planning and proactively preparing for issues should a flood occur. An informational meeting will be held the end of February.

2. Silver Lake Country Club Update (Grimm)

Sheila Bennett, Camelback Dr, talked about the recent selling of Silver Lake Country Club. Several residents also expressed their concerns about the property and future development. Mr. Grimm stated that the Township has not received any proposed plan from the developer. He also added that the public will be fully informed of this matter.

G. NEW BUSINESS 1.

Zoning Administrator/Planner Position

The committee consisting of Steve Grimm, Joe Gavan, Terry Brod and Township Planner Paul LeBlanc interviewed Andy Herrington for the position of Zoning Administrator/Assistant Planner. The committee recommended to offer the job to Mr. Harrington.

MOTION: Joe Gavan, SUPPORT: Terry Brod, to offer Andy Harrington the position of fulltime Zoning Administrator/Assistant Planner subject to a formal letter with salary and benefits. Voice vote: Yeas-7, Nays-0. Motion carried.

RESOLUTION 2020-1

Final Plat Approval for Springer Rayal Estates - 6325 9 Mile Road NE

Josh Thurkettle/Jay Schippers, Bass River Development

The final plat approval would allow for 20 total units on lots of two acres or more, connected to private wells and septic systems. The developer has provided the county with a surety bond that covers the cost of any remaining work related to storm water management infrastructure, road improvements and utilities.

MOTION: Deb Diepenhorst SUPPORT: Kim McKay, to adopt RESOLUTION 2020-1, granting final approval for the plat of Springer Rayal Estates, subject to receiving the correct surety bond. Voice vote: Yeas-7, Nays-0. Motion carried.

Davies Lift Station, Application for Payment No. 3 – Prein & Newhof Recommendation letter (1/29/2020)

Motion: Deb Diepenhorst Support: Jim Alles, to authorize Supervisor Grimm to sign the application for Payment No. 3 to Kamminga & Roodvoets in the amount of $9062.91 for the Davies Lift Station project. Roll call vote: Yeas-7, Nays-0. Motion carried.

I. COMMITTEE REPORTS 1. Road Committee 2020 Local Road Estimates (Alles) Mr. Alles presented the list of

roads and estimates for the upcoming budget year. The total cost is $1,230,000 with the Township share at $676,000. The Board indicated to submit the figures for the proposed budget.

2. Compensation Task Force Committee – Mr. Gavan presented the committee’s

recommendation for a 2.5% increase effective April 1, 2020 for the elected officials and staff. The committee also reviewed the Certification Reward Policy and made modifications to it. The specific conditions to be met are outlined in the memo dated 2/10/2020. The Board was in favor.

Ms. McKay stated the inclusion of the memo in the board packet was disrespectful to our employees. Mr. Grimm remarked, the money being spent is taxpayer dollars, everything we do is transparent, including salaries.

J. COMMENTS BY BOARD MEMBERS

Deb Diepenhorst and Kim McKay presented the first draft of the budget for the Board’s review and asked the Board to submit their figures.

To the members of the Cannon Township Board,

Thank you for your support of our family’s business: Healing Organic Garden. We have completed construction of our first building, the cultivation facility located at 6683 Cannon Center Drive. Our building is professional, our grounds are well maintained and beautifully landscaped.

We value this community and will continue to prove our worth in Cannon Township.We have thus far hired 18 employees so far, all of whom are local residents. 4 of our employees actually reside in Cannon Township. We utilize as many local contractors as possible from Cannon township. This includes our: Builder, excavator, landscaper, electrician, concrete specialist, and architect. Our staff uses the local gym, dines at nearby restaurants and frequents gas stations daily.

We have begun our family’s philanthropic journey, forming The Elms Family Foundation. We made a large donation to the Cannon Fire Department’s fund for the local Burn Camp. We filled 2 carts at Costco for a local church that started a pantry for new moms in the area. In the spring we will be donating a new grill to Cannon Fire Dept and serving them lunch. We are speaking with Lakes Elementary as we will be making a donation that will go into a general fund for teachers at the beginning of the school year. We recognize that many teachers use their own money for supplies in the classroom. We would like to help offset that cost.

Current Operations:

At Healing Organic Garden, we have a culture that demands meticulous compliance with all applicable local, state and federal laws and regulations. This is important not only for producing a high-quality product but also because satisfying the many overlapping regulations is a complex undertaking. The State’s initial and ongoing inspections have verified that we are adhering to and exceeding compliance standards set by the Bureau of Medical Marijuana regulation, the Bureau of Fire Safety, Occupational Safety and Health Agency, and the Dept of Environmental Quality. Our security system has 55 cameras per the state regulations. As a result of proper planning and meticulous execution, we began selling product to Michigan Licensed Provisioning Centers in November of 2019.

Our plants grow for approx 16 weeks, then are tested via the State licensed testing facilities. The product is then picked up by the state licensed transportation. It is then sold to the State licensed Provisioning centers around Michigan. Medical cannabis patients can then go to those provisionings and purchase the product. Every plant is tracked through every step with an individual barcode.

We cultivate with organic processes in a soil medium. Our water is re-claimed and reused on our plants. We do not use any pesticides or herbicides. We are successful thus far in producing pure, high quality medical cannabis that meets the needs of Michigan’s medical marijuana patients.

Our next step:

The existing ordinance allows us to also build a Processing facility next to our cultivation facility. We are now starting to meet with our builder and plan that building. The site plan indicates this space as a 5600 sq ft ‘future building’. The original space has already been approved by the township- as it was included on our first site plan. This building will have an open lay out and will hold the concentrate machine and a commercial kitchen. The processing license will allow us to take the plants that we grow, and make the oils and other concentrated forms that medical cannabis patients utilize.

I would like to ask for permission to include in this building an 800 sq foot Provisioning. This would be a small retail space to sell the products we make as well as non-cannabis derived CBD products. Many individuals are utilizing CBD products for symptom management. CBD products are being sold in gas stations and the convenience store in Cannon Township at this time. The city of Rockford has a CBD store located in the middle of downtown.

**Please note: Cannon Twp has opted-out of Recreational cannabis. We only grow State licensed Medical cannabis. Only Medical cannabis products and non-cannabis CBD products will be sold in this Provisioning.

This Provisioning would serve the individuals in Cannon township and the surrounding communities. Patients could purchase our products directly from Healing Organic Garden. Non-cannabis customers could purchase CBD products in the form of oils and lotions. This Provisioning will be staffed by medical professionals like my husband and I, with the goal of educating patients in a professional environment. Individuals would receive one-on-one service and have the opportunity to ask any questions. Our goal is to provide a space that patients will feel comfortable in asking questions and to have a staff qualified to answer those questions and provide education on CBD and cannabis products.

As seen on the amended site plan we would not be adding size to the building, simply framing the corner and adding a covered porch and entry. The driveway would be located at the end of our cul de sac. We would expect approximately 20 customers per day visiting the Provisioning. We will be adding 6 employees as staff. We would also be adding a parking area for patients and staff. Customers would enter a separate driveway, see the attached site plan for the proposed amendments. The location would be ideal as it is located on a side road off of Belding road- at the far end of the industrial area.

As you can see in the enclosed digital rendering, Morton is designing a beautiful building. This will be professionally landscaped and meticulously maintained. It will be dark red in color to match the brick on our first building.

Our future:

Thank you for considering this Provisioning. This industry is moving quickly in Michigan. Many companies are much larger than us and also backed by out-of-state corporations. Healing Organic Garden fits into the category of a ‘mom-and-pop’ entity. Still, we are proud of our success in the market thus far, our pure high end product is standing out to patients in the Provisionings that we sell to.

Having a Provisioning of our own will allow us security in the market, as we will be able to sell what we grow directly to the patients we serve. We sell now to other Provisionings throughout Michigan. As Health care professionals, we miss the one-on-one time with patients that we had

when we worked in the hospital and in the Army as combat medics. This would allow us to return to that one-on-one capacity and best serve and educate this area’s medical cannabis patients and customers that utilize non-cannabis CBD products.

I have spoken to Steve Grimm regarding the steps required to enable this Provisioning. At first glance, this should be a simple amendment to the ordinance- adding the wording ‘and 1 Provisioning’ to the current ordinance. This would allow only one medical provisioning center in cannon township, only in the industrial area.

We need to double check with the township attorney on the required steps to make this happen. I would like to request that the attorney is asked to advise and the required steps are laid out. I understand that the attorney’s guidance requires a fee to be paid to him. My husband and I will pay that fee if the township board decides that is necessary.

Per Cannon’s ordinance, we are required to pay a $5000 yearly fee to Cannon Twp for each license we hold. Healing Organic Garden will be paying an additional $5000 yearly when the Processing building passes State inspections. A Provisioning Center would increase Healing Organic Garden’s Township licensing fees to a total of $15,000/year.

There is also a great benefit to providing non-cannabis CBD products and education and guidance for this community.
