b) Mr. Steve Atkin, 7L89 Lakeshore Road, addressed Council to convey his graveconcerns (i.e. lot coverage, undersized lots of record, rights to a view, privacy,and the placement of the proposed house) regarding Minor Variance applicationA21/2010W (Westlake & Birrell).

Mr. Dussault addressed Council stating his opposition with regard to theproposed interim control bylaw and the negative impact it will have on localbusinesses as well as current and potential residents. Mr. Dussault wanted hisobjections recorded in the minutes should he wish to file an appeal with theOntario Municipal Board.

“WHEREAS the introduction of the Harmonized Sales Tax (H.S.T.) on July 1st, 2010 andits application to gasoline and diesel sales will result in new revenue for the Governmentof Ontario;

AND WHEREAS based on 2010 average price levels of gasoline and diesel, and 2009average consumption levels in Ontario, The Government of Ontario’s projected newrevenue will be approximately $1.53 billion annually;

AND WHEREAS the Provincial-Municipal Fiscal and Service Delivery Review identifieda transportation infrastructure investment gap between the Government of Ontario andOntario’s municipalities of approximately $3.8 billion;

AND WHEREAS a lack of sufficient funding for essential transportation infrastructureconstruction, maintenance and rehabilitation has created a situation where many ofOntario’s municipalities do not have the financial capacity to construct newtransportation infrastructure and conduct the maintenance and rehabilitation needed tosustain existing transportation infrastructure;

NOW THEREFORE BE IT RESOLVED THAT Council for the Township of Wainfleethereby requests that the Government of Ontario consider directing a portion of therevenue derived from HST charged on gasoline and diesel sales to a new predictablefunding mechanism that will allow Ontario’s municipalities to make the criticalinvestments needed to be effective stewards of transportation infrastructure;

AND THAT a copy of this resolution be forwarded to Ontario Good Roads Associationand to CAA to circulate as they see fit.”

b) Alderman Konc inquired to the progress of the parade float. Mayor Jeffs is in theprocess of contacting local businesses to find an antique truck in order to keepwith the period theme.

c) Mayor Jeffs thanked Alderman Wyatt for attending Culture Committee meetingon her behalf.

d) Mayor Jeffs and Scott Luey, Chief Administrative Officer, provided clarificationwith regard to beach testing in Wainfleet noting that beach testing is ongoing inWainfleet.

SUBJECT: File Z-02-2011Proposed “Housekeeping” Zoning Bylaw Amendment

RECOMMENDATION(S):

THAT this report be received;

THAT Council approve the amending Zoning Bylaw attached as Appendix “A” to thisreport;

THAT pursuant to the provisions of Section 34 (17) of the Planning Act, Councildetermine that no further notice of the proposed bylaw is required;

EXECUTIVE SUMMARY:

This is a report to provide a recommendation to Council regarding the approval ofproposed housekeeping zoning bylaw amendments (Appendix “A”). The proposed“housekeeping” amendments would permit the use of Fire Services in all zone categories andamend the zoning classification at the Township’s four fire stations to a P – Public Zone. Theproposed amendment would also amend the zoning on a portion of the Marshville EstatesSubdivision lands from R1-326 to EPA – Environmental Protection Area. A statutory publicmeeting was held by Council on May 10th, 2011. Notice for the public meeting was in accordancewith the Planning Act requirements. Planning staff are recommending approval of the amendingZoning Bylaw attached as Appendix “A” to this report.

DISCUSSION:

On March 22, 2011, Planning staff received direction from Township Council to initiate aprocess to undertake housekeeping amendments to the Township Zoning Bylaw. The proposed“housekeeping” amendments are as follows:

a) Amending certain general provisions to permit the use of Fire Services in all zonecategories within the zoning bylaw;

b) Amending the zoning classification at the Township’s four fire stations to a P – PublicZone; and

c) Amending the zoning on a portion of the Marshville Estate Subdivision lands from R1-326to EPA – Environmental Protection Area.

With respect to the amendments related to Fire Services, Planning Staff have determinedthat these are needed in order to allow the Township of Wainfleet Fire Department to utilize FireDepartment properties for additional buildings and structures for activities such as fire trainingand to potentially use other private and public land holdings for the purposes of providing waterto fire pump trucks to improve fire service in the Township.

With respect to the amendment required for the Marshville Estate Subdivision lands, thisamendment was required by the Niagara Peninsula Conservation Authority (NPCA) The NPCAhad requested that a portion of the site be rezoned to an Environmental Protection Area (EPA)zone that follows the boundary of the significant woodland (which will coincide with the bushline). The proposed Zoning Bylaw amendment will introduce a new Environmental ProtectionArea (EPA) zone category and amend the zoning on the site to meet the request of the NPCA.

FINANCIAL CONSIDERATIONS:

None.

OTHERS CONSULTED:

The proposed housekeeping amendments were the subject to a public meeting on May10th, 2011 and no opposition was raised with respect to the proposal.

The application was circulated for agency comment which is summarized as follows:

Being a bylaw pursuant to the provisions of Section 34 of the PlanningAct, R.S.O. 1990 to amend Zoning Bylaw No. 581-78 of the Corporationof the Township of Wainfleet with respect to all lands within theTownship.

NOW THEREFORE the Council of the Corporation of the Township of Wainfleet HEREBYENACTS AS FOLLOWS:

THAT Section 4.1 of Zoning Bylaw No. 581-78, as amended, is hereby further amended byadding “Environmental Protection Area EPA” to the list of zone and symbols.

THAT Section 7.7 of Zoning Bylaw No. 581-78, as amended, is hereby repealed and replacedwith the “Schedule A-1” attached hereto.

THAT Section 31 entitled “Exceptions” from Zoning Bylaw 581-78, as amended, is herebyrenamed Section 32.

THAT a new Section 31 entitled “Environmental Protection Area “EPA” Zone is added as shownin “Schedule A-2” attached hereto.

THAT Schedule “A” of Zoning Bylaw No. 581-78, as amended, is hereby further amended bychanging the zoning from “R1-326” to “EPA” as shown on Schedule “A-3” attached hereto.

THAT Schedule “A” of Zoning Bylaw No. 581-78, as amended, is hereby further amended bychanging the zoning from “A2” to “P” as shown on Schedule “A-4” attached hereto.

THAT Schedule “B” Map 2 of Zoning Bylaw No. 581-78, as amended, is hereby further amendedby changing the zoning from “I” to “P” as shown on Schedule “A-5” attached hereto.

THAT Schedule “B” Map 7 of Zoning Bylaw No. 581-78, as amended, is hereby further amendedby changing the zoning from “R1” to “P” as shown on Schedule “A-6” attached hereto.

THAT Schedule “B” Map 9 of Zoning Bylaw No. 581-78, as amended, is hereby further amendedby changing the zoning from “I” to “P” as shown on Schedule “A-7” attached hereto.

THAT pursuant to Section 34(17) of the Planning Act, as amended, no further public meeting isrequired.

THAT this Bylaw shall come into force, take effect and be passed on the third and final readinghereof subject to the provisions of Section 34 of the Planning Act.

7.7 “Uses Permitted in All Zones”

(a) Nothing in this By-law shall prevent the use of any land as a public street, public parkand/or fire services.

SCHEDULE “A-2”

SECTION 29: ENVIRONMENTAL PROTECTION AREA “EPA” ZONE

No person shall within any Environmental Protection Area “EPA” Zone use any land, or erect, alteror use any building or structure except in accordance with the following provisions:

29.1 Permitted Uses

(a) Conservation.(b) Flood and erosion control works.(c) Nature reserves.(d) Passive recreation uses.(e) Woodlots.(f) Public Parks and Natural Areas.

29.2 Regulations for Uses Permitted in Clause (a) of Subsection 29.1

(1) Building and Structures shall be limited to:

(a) flood and erosion control works;(b) those for essential public services; and(c) buildings for the equipment of a natural area.

(2) Setbacks: (minimum) 6m from a municipal street

SUBJECT: Budget Variance Report

RECOMMENDATION(S):

THAT this report be received for information.

EXECUTIVE SUMMARY:

Staff has analyzed the budget variance report as of June 9th, 2011and provided a copyof same to members of Council.

BACKGROUND:

At this point in time staff has noticed a significant increase in revenue from penalties ontaxes revenue. Penalties on taxes revenue is $12,000 higher this year than at the same time in2010. This increase is due to increase in taxes receivable outstanding. Staff is increasingcollections efforts to reduce the tax arrears. We are currently in the process of registering ontitle for accounts in arrears three years or more. In October staff will enlist the help of the bailiffto help with collections.

Staff has noted that we are over budget with snow plowing. The total 2011 budget forsnow plowing is $121,000 and we have already incurred expenses of just under $170,000.Other expense areas for winter control have not reached budget and depending on weatherconditions late in the year some savings may be seen in these areas. If no savings are realizedin other areas of winter control, the shortfall may need to be funded from the Winter ControlReserve.

Currently, staff has no other concerns. Staff will continue to monitor revenue andexpenses and continue to report budget variances at future meetings.

TOWNSHIP OF WAINFLEETDRAINAGE ADVISORY COMMITTEE

TERMS OF REFERENCE

NAME: Township of Wainfleet Drainage Advisory Committee

BACKGROUND: The Drainage Act, RSO 1990, Chapter D17 is a provincial statute which givesauthority to the municipality to carry out procedures of the Act. This Drainage AdvisoryCommittee is being formed to assist the municipality in identifying drainage issues andconcerns.

OBJECTIVES: The Drainage Committee shall act as an "Advisory Body" in assisting in carryingout the procedures under the Drainage Act.

MISSION: To advise on the fair and objective execution of the procedures of the Drainage Act.

The Drainage Committee will abide by any terms and conditions which may be set out by theTownship Council, CAO, Clerk, Solicitor, and/or Insurer for any activities relating to DrainageCommittee business.

COMPOSITION: The Drainage Committee shall be comprised of a maximum of five members ofthe public, the Chairman of Drainage, and the Drainage Superintendent. The Mayor will beconsidered a member of the committee, ex-officio, but shall not send an alternate in his or herabsence.

Public committee members shall be appointed by Council. Three months prior to the committee’sterm expiring, the Township shall advertise for the upcoming vacancies. Any Wainfleet propertyowner may apply. Once the application period is closed, the Director of Operations, the DrainageSuperintendent, and the Chairman of Drainage shall select and recommend to Council proposedpublic members for the next committee.

The Committee shall appoint such executive positions as it deems necessary to ensure itsoperations but shall include as a minimum a Chairman and a Secretary. It is acknowledged thatthere are no per diems for any Committee positions and it is acknowledged that none of theabove positions shall be paid for their services.

TERM OF APPOINTMENT: Unless exempted by legislation, members will be appointed to varyingterms to a maximum of a four year term to coincide with the term of Council or until apredecessor is appointed.

APPOINTMENT OF OFFICERS: The Wainfleet Drainage Committee shall, at its first meeting ineach year, elect from its membership a chairperson and a secretary.

RESOURCES: The Operations Department will provide support in the form of advice, day-to-day liaison with the Township, updates on program and promotional ideas and initialassistance in their implementation to the degree resources are available. The Department willalso assist in the preparation and submission of budget requests/grant submissions if needed.

STAFF ASSIGNED: Staff from the Operations Department will be available to assist theCommittee as outlined under "Resources" and to attend meetings of the Committee uponrequest.

TIMING OF MEETINGS: Meetings will be held on a set day and time as may be determined bythe Committee or at the request of Council.

LOCATION OF MEETINGS: The location of the meetings shall be in the Township Board room.

REPORTS: Minutes of all meetings of the Committee shall be forwarded to Council for informationpurposes in accordance with established policy.

ADMINISTRATION: Any responsibilities not clearly identified within these Terms ofReference shall be the responsibility of the Township of Wainfleet. Any changes proposed tothese Terms of Reference by the Committee shall be recommended to Council via the Directorof Operations or his delegate.

MEETINGS: The Committee shall hold a minimum of two meetings in each calendar year. TheChair shall cause notice of the meetings, including the agenda for the meetings, to be provided tomembers of the Committee a minimum of three (3) business days prior to the date of eachmeeting. Quorum for meetings shall consist of a majority of the members of the Committee,of which one member shall be the Chair of the Committee. A copy of the Agenda shall beprovided to the Clerk's office.

PROCEDURES: Meetings of the Committee shall be governed by Robert's Rules of Order,Procedural By-law and Legislation.

CONFLICTS OF INTEREST: Members shall abide by the rules outlined within the municipalConflict of Interest Act and shall, unless exempted (Section 4), disclose the pecuniary interestto the Secretary and absent himself or herself from meetings for the duration of thediscussion with respect to that matter.

ERRORS/OMISSIONS: The accidental omission to give notice of any meeting of theCommittee to its members, or the non-receipt of any notice by any member, or any error in anynotice that does not affect its substance, does not invalidate any resolution passed or anyproceedings taken at the meeting. Any member of the Committee may at any time waive noticeof any meeting.

MEETING ATTENDANCE: Any member of the Committee who misses two consecutivemeetings without being excused by the Committee, may be removed from the Committee. TheCommittee must make recommendations, by a report to Council for the removal of anymember. Meeting attendance requirement shall not apply to the Mayor due to the ex-officionature of the appointment to the Committee.

PURCHASING POLICY: The Drainage Committee shall follow the Procurement Policy of theTownship unless another purchasing policy has been endorsed by Council.

VOLUNTEER POSITIONS: Unless approved by Council, as part of the Terms of Reference orestablishing by-law, all Committee members are considered volunteer positions. Mileagecosts and other minor expenses related to committee activities may be eligible forreimbursement subject to budget approvals by Council.

ACTIVITIES AND RESPONSIBILITIES:The following are the activities and responsibilities of the Drainage Committee:

a) Advise the Drainage Superintendent of conditions of drainsb) Attend biannual Drainage Committee meeting

DISSOLUTION: At the discretion of Council or upon the mandate of the Committee beingfulfilled, the Drainage Committee may be dissolved by resolution of Council.

EXPULSION OF MEMBER: The Committee may recommend to Council the expulsion of amember for reasons as listed, but not limited to, the member being in contravention of the MunicipalAct, the Municipal Freedom of Information and Protection of Privacy Act, the ProvincialOffences Act, the Municipal Conflict of Interest Act; disrupting the work of the Committee orother legal issues.

Staff tendered for the supply and application of Calcium Chloride, as a joint tender withthe municipality of West Lincoln, in accordance with our Township Purchasing & ProcurementPolicy. The Calcium Chloride is required for dust suppression on our gravel roadways.

Calcium Chloride is applied once annually to all gravel roads in high traffic areas andthose with residences. The need and timing for dust suppression is influenced by precipitationand temperature.

RECOMMENDATION(S):

THAT Council approve renewing the existing Wainfleet Arena Concession contract oneadditional year for the period of October 12th, 2011 through to April 12th, 2012.

AND THAT Council authorize the Director of Operations to enter into a formal contractwith the Chases (Concessionaire) for the Arena Concession operation for the period October12th, 2011 through April 12th, 2012 provided that all the necessary insurance documentation isobtained in accordance with the provisions of the contract.

EXECUTIVE SUMMARY:

The existing 2010/2011 Wainfleet Arena Concession contract has a provision for a oneyear renewal upon the mutual consent of both parties. The Concessionaires have requested theextension be granted. Staff is recommending that Council approve the renewal.

BACKGROUND:

The existing 2010/2011 Wainfleet Arena Concession contract has now expiredhowever, the contract has a provision for a one year renewal upon the mutual consent of bothparties. The Concessionaires have requested the extension be granted. The existing contract isin the amount of $150.00/month (plus HST) for the six month period of October 12th, 2010through April 12th, 2011 for a total income to the municipality of $ 900.00 (plus HST). Renewalwould be at the same monthly rate for the period of October 12th, 2011 through to April 12th,2012.

OPTIONS/DISCUSSION:

It is staff’s opinion that the current rental revenues generated by the Wainfleet ArenaConcession are minimal and most likely at or below the break-even point however, it is alsostaff’s opinion that the concession provides a beneficial service to the municipality andenhances the overall operation of the area.

An alternative to renewing the contract would be to re-tender this rental. A new tendermay attract new bidders and possibly result in an increase in revenues to the Township inexcess of the current $150.00 per month.

Last year’s tender produced only one single bid (the current Concessionaire), re-tendering could potentially result in an even lower bid or possibly no bids.

EXECUTIVE SUMMARY

The purchase of bunker gear has been approved through the budget process and includedunder Purchases of Portable Fire Fighting Equipment. The fire fighting gear purchase will beoutfitting our eight (8) newest Volunteers having recently finished the probationary period andpassed final testing and is a provision of the working agreement between the Municipality andthe Firefighters Association. In accordance with the procurement policy, a Request for Proposal(RFP) would be drafted and sent out to obtain the lowest bid. Working through the NiagaraRegional Fire Chiefs Association, a sub committee was formed to research the costeffectiveness of joint purchasing.

BACKGROUND:

The Fire Departments of Wainfleet, Thorold, Lincoln, West Lincoln, Grimsby and Fort Erie, withthe Town of Grimsby acting as lead agency, worked collectively to draft and publish a Requestfor Proposal to purchase bunker gear. Combining the purchasing power of these sixdepartments has increased the volume and significantly reduced the cost per unit. The RFP waspublished in the West Niagara News on May 6, 2011 and was also posted on Fort Erie’s Post-N-Go website. In addition, the Deputy Chief from Grimsby hand delivered a copy of the RFP toevery supplier at the OAFC Conference Trade Show on May 1st and 2nd, 2011.

The RFP closed on May 12, 2011 with responses received from six (6) suppliers. Two (2) of thebids were disqualified due to incomplete bids. The qualifying bids are as follows:

The lowest bid submitted from PPE Solutions has been accepted by the sub-committee and isour present supplier of bunker gear. The resulting bid is $90.94 per unit lower than the pricequoted to us on February 28th of this year by this same supplier. As the volume increases, thesavings will increase and the pricing will drop further. As part of the RFP pricing, guaranteeswere requested for 2012 and 2013 and have been set at no more than 2.5% increase yearly.

Being a bylaw pursuant to the provisions of Section 34 of the PlanningAct, R.S.O. 1990 to amend Zoning Bylaw No. 581-78 of the Corporationof the Township of Wainfleet with respect to all lands within theTownship.

WHEREAS the Corporation of the Township of Wainfleet has reviewed Zoning Bylaw No. 581-78and deems it advisable to amend same:

NOW THEREFORE the Council of the Corporation of the Township of Wainfleet HEREBYENACTS AS FOLLOWS:

THAT Section 4.1 of Zoning Bylaw No. 581-78, as amended, is hereby further amended byadding “Environmental Protection Area EPA” to the list of zone and symbols.

THAT Section 7.7 of Zoning Bylaw No. 581-78, as amended, is hereby repealed and replacedwith the “Schedule A-1” attached hereto.

THAT Section 31 entitled “Exceptions” from Zoning Bylaw 581-78, as amended, is herebyrenamed Section 32.

THAT a new Section 31 entitled “Environmental Protection Area “EPA” Zone is added as shownin “Schedule A-2” attached hereto.

THAT Schedule “A” of Zoning Bylaw No. 581-78, as amended, is hereby further amended bychanging the zoning from “R1-326” to “EPA” as shown on Schedule “A-3” attached hereto.

THAT Schedule “A” of Zoning Bylaw No. 581-78, as amended, is hereby further amended bychanging the zoning from “A2” to “P” as shown on Schedule “A-4” attached hereto.

Being a bylaw to establish estimatesand tax rates for the year 2011.

WHEREAS the Council for the Corporation of the Township of Wainfleet has inaccordance with Section 290 of the Municipal Act, S.O. 2001 Chapter 25 prepared a budgetincluding estimates of all sums for the purposes of the municipality boards, commissions orother body;

AND WHEREAS the levy for all purposes has been set at Ten Million, Six Hundred andSeventy Seven Thousand, Eight Hundred and Eighty Nine Dollars ($10,677,889.00) whichincludes:

(a) $4,060,377.00 being the net levy required by the Township of Wainfleet as setout in Schedule “A” attached hereto.

(b) $4,294,972.00 as set out in Regional Municipality of Niagara By-law 62-2011pursuant to Section 289 (1) of the Municipal Act, 2001, S.O. 2001, C 25.

(c) $462,853.00 as levied by the Regional Municipality of Niagara for WasteManagement Services for the Township of Wainfleet (Section 2 of RegionalMunicipality of Niagara By-law 62-2011).

(d) $1,859,684.00 as calculated by applying the rates for School Board purposes asset out in Section 3 and 4 of Regional Municipality of Niagara By-law 62-2011and any amendments thereto.

AND WHEREAS certain regulations required reductions in certain tax rates for certainclasses or subclasses of property.

NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of theTownship of Wainfleet HEREBY ENACTS AS FOLLOWS:

1. THAT the estimates outlined in Schedule “A”, attached hereto, be adopted.

2. THAT a tax rate of 0.01463966 is hereby adopted to be applied against the whole of theassessment for real property in the Residential Class.

3. THAT a tax rate of 0.02751181 is hereby adopted to be applied against the whole of theassessment for real property in the Multi-Residential Class.

4. THAT a tax rate of 0.00365991 is hereby adopted to be applied against the wholeassessment for real property in the Farmlands Class.

5. THAT a tax rate of 0.03498293 is hereby adopted to be applied against the wholeassessment for real property in the Commercial Class.

6. THAT a tax rate of 0.02448805 is hereby adopted to be applied against the wholeassessment for real property in the Commercial Excess/Vacant Unit Class.

16. THAT every owner shall be taxed according to the tax rates in this bylaw and such taxesshall become due and payable in two (2) installments and the due dates shall be:

July 30th and September 30th 2011 for properties that are not subject to cappingprotection.

July 30th and September 30th 2011 for properties that are subject to cappingprotection.

The tax payable shall be the whole of the 2011 tax liability less the interim taxes dividedby two (2) where applicable with the final installment so payable in whole dollars, that iswithout cents.

17. On all taxes of the levy, which are in default on the 1st day of the month immediatelyfollowing the due date a penalty of 1.25 percent shall be added and thereafter a penaltyof 1.25 percent will be added on the first day of each and every month the defaultcontinues, until December 31, 2011.

18. On all taxes in default on January 1, 2012, interest shall be added at the rate of 1.25percent per month for each month or fraction thereof in which the default continues.

19. Penalties and interest added in default shall become due and payable and shall becollected as if the same had originally been imposed and formed part of such unpaid taxlevy.

20. The Collector shall mail or cause to be mailed the notice of taxes due to the residence orplace of business of such person indicated on the last revised assessment roll, a writtenor printed notice specifying the amount of taxes payable.

21. THAT taxes are payable at the Township of Wainfleet Municipal Offices, Wainfleet,Ontario or any major financial institution in Ontario. All payments are to be made inCanadian funds only.

22. This bylaw shall come into force, take effect and be passed upon the third and finalreading hereof.

THE CORPORATION OF THE

BYLAW NO. 019-2011

Being a bylaw to extend an interim control bylaw which regulatesdevelopment within the Boil Water Advisory Area in the Townshipof Wainfleet for a period of one (1) year.

WHEREAS Section 38(1) of the Planning Act, R.S.O. 1990, Chapter P.13, as amended,provides that:

“Where the Council of a local municipality has, by Bylaw or Resolution, directedthat a review or study be undertaken in respect of land use planning policies inthe municipality or in any defined area or areas thereof, the Council of themunicipality may pass a Bylaw (hereinafter referred to as an Interim ControlBylaw) to be in effect for a period of time specified by the Bylaw, which periodshall not exceed one (1) year from the date of the passing thereof, prohibiting theuse of land, buildings or structures within the municipality or within the definedarea or areas thereof for, or except for, such purposes as are set out in theBylaw.”;

AND WHEREAS the Regional Municipality of Niagara, the Regional Niagara HealthUnit, and the Ministry of the Environment have undertaken studies to determine the level ofcontamination to surface and groundwater sources within the Boil Water Advisory Area of theTownship of Wainfleet, and have determined that risks to health and the environment areprevalent due to contaminated water resources in the Boil Water Advisory Area;

AND WHEREAS the Township of Wainfleet and the Regional Municipality of Niagarahad undertaken an Environmental Assessment that examined the need for municipal sewer andwater services to be extended to the Lakeshore Road Area in the Township of Wainfleet tocorrect contaminated water resources and it has been determined that this project will notproceed;

AND WHEREAS the Council of the Township of Wainfleet, in its 2011 Annual Budget,authorized the Planning Department to carry out the creation of a new, updated Zoning Bylaw;

AND WHEREAS the Council of the Township of Wainfleet deems it appropriate toprovide for such interim control on the development of property within the Boil Water AdvisoryArea as denoted on Schedule “A” affixed to this Bylaw;

NOW THEREFORE the Council of the Corporation of the Township of Wainfleet HEREBYENACTS AS FOLLOWS:

1) THAT the use of lands, buildings, or structures within the Boil Water Advisory Area, asset out in Schedule “A” attached hereto and forming part of this Bylaw, is prohibitedexcept for uses existing at the date of the passage of this Bylaw;

2) THAT nothing in this Bylaw shall prevent the use of lands, buildings, or structures, whichuse is permitted as a result of the continued review and approval of any developmentprohibited by this Bylaw, if such application for development was applied in accordancewith the requirements of the Planning Act and Regulations on the date of the passing ofthis Bylaw, so long as the intent of the development continues as originally applied for.

3) THAT for the purpose of this Bylaw, development is defined as development activitiesthat:

a) require an amendment to the Official Plan or Zoning Bylaw 581-78 of the Townshipof Wainfleet,

b) require application to the Committee of Adjustment for the Township of Wainfleetregarding Minor Variances to the Township’s Bylaw 581-78 as amended or forconsents to sever lands under Section 53 of the Planning Act, R.S.O. 1990, ChapterP.13, as amended

c) or, require an application for the subdivision of lands under Part 6 of the PlanningAct, R.S.O. 1990, Chapter P.13, as amended.

4) THAT this Bylaw does not prevent:

a) the continued review and approval of any development prohibited by this Bylaw ifsuch application for development was lawfully in existence on the day of the passingof this Bylaw, so long as the intent of the development continues as originally appliedfor.

5) THAT this Bylaw shall remain in force and effect for a maximum period of one (1) yearfrom the date of final passing, or until repealed unless amended by Council to permitextension for an additional one (1) year period to a maximum of two years from date offinal passage or until repealed.

6) THAT this Bylaw shall take effect upon final passing and comes into full force and effectpursuant to the provisions of the Planning Act.

7) THAT this Bylaw shall not apply to development applications submitted by or on behalfof the Township of Wainfleet, or any other government body.

8) THAT this Bylaw may be cited as the “Boil Water Advisory Area Interim DevelopmentControl Bylaw”.

9) THAT this bylaw shall come into force and take effect on the day of the final passingthereof.
