The current maximum level of 15 μg/kg in peanuts intended for further processing applies, unless otherwise specified, to

seed or kernels, after removal of shell or husk.

The current maxim level applies for peanuts, also known as groundnuts, intended for further processing. “Destined for

further processing” means intended to undergo an additional processing/treatment that has proven to reduce levels of

aflatoxins before being used as an ingredient in foodstuffs, otherwise processed or offered for human consumption.

Processes that have proven to reduce levels of aflatoxins are shelling, blanching followed by color sorting, and sorting by

specific gravity and color (damage). There is some evidence that roasting reduces aflatoxins in pistachios but for other

nuts the evidence is still to be supplied.

The proposed level of 10 μg/kg in peanuts ready-to-eat was last discussed at the 12th Session of the Codex Committee

on Contaminants in Food (CCCF) in 2018 (see PDF pages 10-11 of the CCCF12 Report for further information).This

proposed level is currently on hold, with further consideration of the proposal not expected until 2022.

domestic and imported raw peanuts must be sampled and certified by a USDA Federal or Federal-State inspector and

tested for aflatoxin by a USDA or USDA-approved laboratory before introduction into U.S. commerce. All domestic and

imported raw peanuts intended for human consumption must be certified as “negative” (i.e., 15 ppb or less) for aflatoxins

The U.S. FDA offers no objection to the shipment of peanuts over the 25 ppb level for aflatoxin to processors if facilities

are available to remove moldy or otherwise defective nuts from the lot before incorporation into the finished product.

Lots of raw peanuts which have been shipped to processors containing aflatoxin above 25 ppb level may be subject to

appropriate action in cases where there is a lack of assurance that the finished product will comply with the current action

level.

Raw peanuts which have been sampled by USDA should not be sampled routinely on an objective basis. However,

sampling and appropriate follow-up is indicated when lots of raw peanuts are reported by USDA certificate of analysis as

exceeding 25 micrograms of aflatoxin per kilogram, and when such peanuts are destined for processors that do not have

facilities and procedures to remove defective nuts, and there is no assurance that the finished products will be below the

20 mcgs/kg guideline.

The above guideline criteria do not preclude recommending action at lower than 20 mcgs/kg levels of aflatoxin in the

finished product where there are inadequate control and sorting procedures, or deliberate attempts to dilute aflatoxin

containing lots.

The USDA limit for domestic edible raw peanuts is 15 parts per billion (ppb) total aflatoxins or less as specified in 7 CFR

Part 996, Section 996.11 . Imported raw peanuts must meet the same requirement as domestic raw peanuts. Each lot of

domestic and imported raw peanuts must be sampled and certified by a USDA Federal or Federal-State inspector and

tested for aflatoxin by a USDA or USDA-approved laboratory before introduction into U.S. commerce. All domestic and

imported raw peanuts intended for human consumption must be certified as “negative” (i.e., 15 ppb or less) for aflatoxins

The U.S. FDA offers no objection to the shipment of peanuts over the 25 ppb level for aflatoxin to processors if facilities

are available to remove moldy or otherwise defective nuts from the lot before incorporation into the finished product.

Lots of raw peanuts which have been shipped to processors containing aflatoxin above 25 ppb level may be subject to

appropriate action in cases where there is a lack of assurance that the finished product will comply with the current action

level.

Raw peanuts which have been sampled by USDA should not be sampled routinely on an objective basis. However,

sampling and appropriate follow-up is indicated when lots of raw peanuts are reported by USDA certificate of analysis as

exceeding 25 micrograms of aflatoxin per kilogram, and when such peanuts are destined for processors that do not have

facilities and procedures to remove defective nuts, and there is no assurance that the finished products will be below the

20 mcgs/kg guideline.

The above guideline criteria do not preclude recommending action at lower than 20 mcgs/kg levels of aflatoxin in the

finished product where there are inadequate control and sorting procedures, or deliberate attempts to dilute aflatoxin

containing lots.

The current maximum level of 15 μg/kg in peanuts intended for further processing applies, unless otherwise specified, to

seed or kernels, after removal of shell or husk.

The current maxim level applies for peanuts, also known as groundnuts, intended for further processing. “Destined for

further processing” means intended to undergo an additional processing/treatment that has proven to reduce levels of

aflatoxins before being used as an ingredient in foodstuffs, otherwise processed or offered for human consumption.

Processes that have proven to reduce levels of aflatoxins are shelling, blanching followed by color sorting, and sorting by

specific gravity and color (damage). There is some evidence that roasting reduces aflatoxins in pistachios but for other

nuts the evidence is still to be supplied.

The proposed level of 10 μg/kg in peanuts ready-to-eat was last discussed at the 12th Session of the Codex Committee

on Contaminants in Food (CCCF) in 2018 (see PDF pages 10-11 of the CCCF12 Report for further information).This

proposed level is currently on hold, with further consideration of the proposal not expected until 2022.

The USDA limit for domestic edible raw peanuts is 15 parts per billion (ppb) total aflatoxins or less as specified in 7 CFR

Part 996, Section 996.11 . Imported raw peanuts must meet the same requirement as domestic raw peanuts. Each lot of

domestic and imported raw peanuts must be sampled and certified by a USDA Federal or Federal-State inspector and

tested for aflatoxin by a USDA or USDA-approved laboratory before introduction into U.S. commerce. All domestic and

imported raw peanuts intended for human consumption must be certified as “negative” (i.e., 15 ppb or less) for aflatoxins

(See U.S. FDA MOU 225-19-031 for more information).

United States Aflatoxins Peanuts and peanut products 20 20 μg/kg Aflatoxins

The U.S. FDA offers no objection to the shipment of peanuts over the 25 ppb level for aflatoxin to processors if facilities

are available to remove moldy or otherwise defective nuts from the lot before incorporation into the finished product.

Lots of raw peanuts which have been shipped to processors containing aflatoxin above 25 ppb level may be subject to

appropriate action in cases where there is a lack of assurance that the finished product will comply with the current action

level.

Raw peanuts which have been sampled by USDA should not be sampled routinely on an objective basis. However,

sampling and appropriate follow-up is indicated when lots of raw peanuts are reported by USDA certificate of analysis as

exceeding 25 micrograms of aflatoxin per kilogram, and when such peanuts are destined for processors that do not have

facilities and procedures to remove defective nuts, and there is no assurance that the finished products will be below the

20 mcgs/kg guideline.

The above guideline criteria do not preclude recommending action at lower than 20 mcgs/kg levels of aflatoxin in the

finished product where there are inadequate control and sorting procedures, or deliberate attempts to dilute aflatoxin

containing lots.

The USDA limit for domestic edible raw peanuts is 15 parts per billion (ppb) total aflatoxins or less as specified in 7 CFR

Part 996, Section 996.11 . Imported raw peanuts must meet the same requirement as domestic raw peanuts. Each lot of

domestic and imported raw peanuts must be sampled and certified by a USDA Federal or Federal-State inspector and

tested for aflatoxin by a USDA or USDA-approved laboratory before introduction into U.S. commerce. All domestic and

imported raw peanuts intended for human consumption must be certified as “negative” (i.e., 15 ppb or less) for aflatoxins

(See U.S. FDA MOU 225-19-031 for more information).

The U.S. FDA offers no objection to the shipment of peanuts over the 25 ppb level for aflatoxin to processors if facilities

are available to remove moldy or otherwise defective nuts from the lot before incorporation into the finished product.

Lots of raw peanuts which have been shipped to processors containing aflatoxin above 25 ppb level may be subject to

appropriate action in cases where there is a lack of assurance that the finished product will comply with the current action

level.

Raw peanuts which have been sampled by USDA should not be sampled routinely on an objective basis. However,

sampling and appropriate follow-up is indicated when lots of raw peanuts are reported by USDA certificate of analysis as

exceeding 25 micrograms of aflatoxin per kilogram, and when such peanuts are destined for processors that do not have

facilities and procedures to remove defective nuts, and there is no assurance that the finished products will be below the

20 mcgs/kg guideline.

The above guideline criteria do not preclude recommending action at lower than 20 mcgs/kg levels of aflatoxin in the

finished product where there are inadequate control and sorting procedures, or deliberate attempts to dilute aflatoxin

containing lots.

The current maximum level of 15 μg/kg in peanuts intended for further processing applies, unless otherwise specified, to

seed or kernels, after removal of shell or husk.

The current maxim level applies for peanuts, also known as groundnuts, intended for further processing. “Destined for

further processing” means intended to undergo an additional processing/treatment that has proven to reduce levels of

aflatoxins before being used as an ingredient in foodstuffs, otherwise processed or offered for human consumption.

Processes that have proven to reduce levels of aflatoxins are shelling, blanching followed by color sorting, and sorting by

specific gravity and color (damage). There is some evidence that roasting reduces aflatoxins in pistachios but for other

nuts the evidence is still to be supplied.

The proposed level of 10 μg/kg in peanuts ready-to-eat was last discussed at the 12th Session of the Codex Committee

on Contaminants in Food (CCCF) in 2018 (see PDF pages 10-11 of the CCCF12 Report for further information).This

proposed level is currently on hold, with further consideration of the proposal not expected until 2022.
