FITNESS CENTRE ACCESS TERMS & CONDITIONS1. Membership and Access

•MembersmustpresenttheirmembershipcardoneachvisittotheFitnessCentre,andaccesstothefacilitieswillthenbeprovided.•GymaccesswillbegrantedatthediscretionoftheRACVClubFitnessCentre(RACV)management.•Classesandinstructorsaresubjecttochangewithoutpriornotification.•Gymaccessisnottransferable,exceptintheeventofthedeathoftheRACVClubmember,wheretheClubmembershipcanbetransferredtoaspouseorfamilymemberfortheremainderofthemembershipyear.

• Gym access will automatically renew on the member’s individual renewal date, unless RACV is instructed by the member to cancel Fitness CentreAccessattheendoftheClubmembershipperiod.

•SuspensionisnotavailableonFitnessCentreaccess.•Gymaccesscanonlybeusedbythepersonnamedontheapplicationform.•GymaccessincludesaccesstotheFitnessCentreanduseofitsfacilitiesduringopeninghours.Theremaybeanextrachargeforparticipationinworkshops,coursesandcoachingwhichmayberunfromtimetotime.

•UpontheexpirationofyourRACVClubmembership,allentitlementsofyourmembership,includingFitnessCentreAccess,areforfeited.•Anyapplicationtore-joinwillbeatthefullfee,currentatthattime.

2. Payment Details•SixmonthFitnessCentreaccesscanonlybetakenoutbymembersinthefirstmonthofClubmembership.•Gymaccessmustbepaidforinfullatthetimeofregistration.Partpaymentswillnotbeaccepted.•WherepaymentischargedtoyourRACVClubaccount,detailswillappearonyourstatementinthefollowingmonth.•TherearenorefundsonGymaccess.FailuretoattendandpartakeoftheFitnessCentre’sservicedoesnotrelieveyouofanyliabilityforpaymentnordoesitentitleyoutoarefund.

•FitnessCentreManagementreservestherighttoalteranyFitnessCentrefeeatanytimeinlinewithstandardeconomicindicators.•NotificationofanypriceincreasewillbemadeonnoticeboardsandbulletinsatleastonemonthinadvanceofanypaymentincreasesorchangesinthetermsandconditionsofyourGymAccess.

3. Health and Safety•BysigningthisdocumentyougivepermissionforFitnessCentrestafftoseekmedicalassistanceatyourexpenseinanemergencyifrequired.• Ifyouaremaleagedover35,orafemaleagedover45,andhavenotpreviouslybeenexercisingonaregularbasis,itisrecommendedthatyouvisityourdoctorpriortocommencingaregularexerciseprogram.

• ItisstronglyrecommendedthatallGymAccessholdersarecoveredbyambulanceinsurance.•AmedicalquestionnairemustbecompletedpriortoyourfirstusageoftheGym.ClearancemayberequiredfromadoctorbeforecommencinganyprogramwithintheGym.Allrelevantinjuries/illnessesshouldbedeclaredinthisquestionnairesothatasafeandbeneficialprogramcanbewrittenforyou.

•PleaseinformtheFitnessCentrestaffofanymedicalchangesthatmayoccurwhileyouareauseroftheGym.• FitnessCentreManagementreservestherighttorefuseuseofthefacilitiesatanytimeshoulditbeconcernedaboutamember’sstateofphysicalhealth.

4. Guests•MembersandtheirguestsarerequiredtousetheFitnessCentreinaproperandreasonablemanner.RACVClubreservestherighttorequireanymemberorguesttomakegoodorindemnifyRACVClubagainstanydamagetofacilitiesorotherpersonscausedbynegligenceorwrongfulactofsuchMemberorguest.

• Club members may bring guests in to use the facilities of the Fitness Centre but not the gymnasium (subject to availability), providing that they aresignedinandarepreparedtoacceptfullresponsibilityfortheconductoftheirguests.AllguestsmustcompletetheGuestAgreementandWaiverformpriortoenteringtheFitnessCentre.

•Pleasenotethatguestundertheageof16yearsofagecannotusethegym,spaorsauna.Iftheguestwishestouseanyofthefacilitiestheymustpaytheappropriateguestfee.ItwillbetheresponsibilityoftheClubmembertoensurethatallguestssettleanycoststheymayhaveincurredduringtheirvisit.

5. Liability• The Fitness Centre accepts no liability for any damage, loss, illness or injury resulting from the use of RACV Club facilities by members or guestshowsoeverthatmayhavebeencaused,savefordeathorpersonalinjurycausedbyitsownnegligence.

•TheFitnessCentreacceptsnoliabilityforanyillnessorinjuryresultingfromoverexertion,aggravationorrepetitionofanymedicalconditioncausedbytheuseoftheFitnessCentre’sfacilities.

•AllpersonsusethefacilityontheexpressunderstandingthatitisattheirownriskandmembersandguestsarestronglyadvisedtoseekmedicaladvicebeforetheybeginexerciseattheFitnessCentre.

6. Termination• The RACV Club reserves the right to terminate Gym (Fitness Centre) Access immediately or to refuse any application or renewal of Gym (FitnessCentre)Accesswithoutwarningifamemberhasbehavedinawaythatisriskyorseriouslyinappropriate,suchas:- Threateningorharassingothers;- Misusingamembershipcard;- VandalismordeliberatedamagetoRACVClubproperty;- Non-adherencetotheClubBylawsandFitnessCentreEtiquette;- RefusaltocomplywiththeinstructionsofClubstaffinrelationtopolicy,proceduresorsafety;or- Inappropriatebehaviourtowardsmembersofstaff.

• TheFitnessCentremaywithoutnoticeterminateamember’sGym(FitnessCentre)Access,orrefuseentryifamemberisinbreachofanyoftheseconditions.• In the case of Gym (Fitness Centre) Access being terminated for any of the behaviours listed above, it shall be at the sole discretion of the FitnessCentreastowhetheranyoftheGym(FitnessCentre)Accessfeeisrefundable.

• InappropriatebehaviourcouldresultinamemberbeingcalledbeforetheClubandResortCommitteetoexplaintheirbehaviour.

7. General•Memberswithchildrenoftheoppositegenderagedsevenyearsandoveraretouseoneofthefamilychangerooms.Pleasenotethatfamilychangeroomsmustbeusedunderadultsupervision.

8. Waiver, Release And Indemnity•YouacknowledgethattherearedangersandrisksinherentwithparticipatinginactivitiesattheFitnessCentre(including,butnotlimitedtoanyactivitythatisperformedwithintheFitnessCentreandanyspecialisedclasses,coursesandworkshopsthatisconductedwithinorexternaltotheFitnessCentre)(the“Activity”)towhichyoumaybeexposedbyaccessingtheFitnessCentre.

•YouagreethatyouareparticipatingintheActivityatyourownriskandyouvoluntarilyassumeresponsibilityforanyinjury,deathorpropertydamageyoumaysufferasaresultofyourparticipationintheActivity.

•Tothemaximumextentpossibleatlaw,youagreetorelease,holdharmlessandindemnifyRACVagainstallactions,claims,suits,costs,expenses,demandsanddamagessufferedorincurredbyRACVbyreasonoforinrespectoforinanymannerwhatsoeverarisingoutoforcausedbyyouruseoftheFitnessCentreorparticipationintheActivity.

•YouagreethatyouareusingtheFitnessCentreontheexpressconditionthatRACV:- will,undernocircumstancesbeliableorresponsibleinanymannerwhatsoeverforanydeath,loss,accident,damageorinjurytoyouorany

ofyourvisitororinviteeoranyotherpersonwhatsoever(“RelatedParty”)whichmayhappenasaresultofyouruseoftheFitnessCentre;and- willnotincurorbeunderanyliabilitywhatsoevertoyouortoanyRelatedPartyforanyloss,damageorinjurytoorinrespectofanyofyour

property or of any Related Party’s property, exceptasoccasionedbythegrossnegligence,actsoromissionsofRACVoritsservants,agents,contractors,visitorsorinvitees.•RACVisnotliabletoyouinrespectofanyindirectorconsequentialloss.Fortheavoidanceofdoubt,‘consequentialloss’meanslossor

damage arising from a breach of contract, tort (including negligence), under statute or any other basis in law or equity including, but without limitation,lossofprofits,lossofrevenue,lossordenialofopportunity,lossofgoodwill,lossofbusinessreputation,futurereputationorpublicity, damage to credit rating and indirect, remote, abnormal or unforeseeable loss, or any similar loss whether or not in the reasonable contemplationoftheparties.

9. Course Indemnity• IunderstandandacknowledgethatoutdooractivitiesconductedbyRACV(including,butnotlimitedtoactivitiessuchasbootcamp,runninggroupandpersonaltrainingconductedoutdoors)(“OutdoorActivities”)carrywithittheinherentriskofphysicalinjury,includingseriousinjurysuchaspermanentdisability,paralysisandevendeath.Suchinherentrisksinclude,butarenotlimitedto:- contactorcollisionwithpersonsorobjects(includingcontactwithotherparticipantsandcontactwithnaturalorman-madefixedobjects

orobstacles);- encounterswithobstacles(e.g.naturalandman-madewater,roadandsurfacehazards);- weather-relatedhazards(e.g.extremeheat,extremecold,humidity,ice,rain,fog);and- inadequatefirstaidandemergencymeasures.

•Tothemaximumextentpossibleatlaw,youagreetorelease,holdharmlessandindemnifyRACVagainstallactions,claims,suits,costs,expenses,demandsanddamagessufferedorincurredbyRACVbyreasonoforinrespectoforinanymannerwhatsoeverarisingoutoforcausedbyyourparticipationinOutdoorActivities.

WARNING UNDER THE FAIR TRADING ACT 19991. UndertheprovisionsoftheFairTradingAct1999severalconditionsareimpliedintocontractsforthesupplyofcertaingoodsandservices. These conditions mean that RACV is required to ensure that the recreational services it supplies to you are:

•renderedwithduecareandskill;and•fitforthepurposeforwhichtheyarecommonlyboughtasitisreasonabletoexpectinthecircumstances;and• reasonablyfitforanyparticularpurposeormightreasonablybeexpectedtoachieveanyresultYouhavemadeknowntothesupplier.

2. Undersection32NoftheFairTradingAct1999,RACVisentitledtoaskyoutoagreethattheseconditionsdonotapplytoyou.IfyousignthisformyouwillbeagreeingthatyourrightstosuethesupplierundertheFairTradingAct1999ifyouarekilledorinjuredbecausetheservicesrenderedbyRACVwerenotrenderedwithduecareandskillortheywerenotreasonablyfitfortheirpurpose,areexcluded,restrictedormodifiedinthewaysetoutintheseTermsandConditions.

NOTE: The change to your rights, as set out in these Terms and Conditions, does not apply if your death or injury is due to gross negligence on RACV’spart.“Grossnegligence”isdefinedintheFairTrading(RecreationalServices)Regulations2004.
