The Jackson Magilbry Family HomesteadSubmitted by Lisa R. Franklin Carmichael, Rt 2, Box 273A, Tallassee, AL 36078-9802

The Jackson Magilbry Franklin family home was built about 1890 when Jack married Sallie Lenora Patterson. Jack ( born 28 Apr 1861 Red Level, Covington County, AL died 8 Feb 1934 ) was the son of John A & Mahaley Celia ( Findley ) Franklin. Sallie ( born 26 Jan 1866 AL died 15 Aug 1955 ) was the daughter of George & Margaret ( McIntosh ) Patterson. The Home is located down a dirt road known as “The old Prestwood Bridge Road” just off Plywood Mill Rd on the outskirts of Andalu-sia, AL in Covington County. Jack bartered 2 oxen & yoke for the 160 acres of land the home was located on!

Magilbry is a family name. It was the name of Mahaley Celia Findley Franklin’s father.

All of Jack & Sallie’s eight children were born in the home and when daughter Sarah ( born 1901 ) was eight years old the family built a new home across the road from the old home-stead.

The new home is where Sarah lives at present. She and her sister Ethel are the only two of Jack’s children still living. They celebrated their birthdays this past February, 90 & 83 re-spectively. They are two wonderful ladies without whose help many parts of my family history would have been forever a mystery.

The picture above is that of Lisa Carmichael’s Great grandfather - William Jefferson “Bill” Franklin ( born 7 Apr 1856 Andalusia, AL died 3 Mar 1932 Mobile, AL ). Bill was the oldest child borJohn A & Mahaley Celia ( Findley ) Franklin and an older brother of Jackson Magilbry “Jack” FranklBill’s signature is on the card at the bottom of the photo. The picture was taken about 1880 and is stiloriginal frame just as it was when hanging in Bill’s home.

John A Franklin ( born 1827 ) was the son of Wilson Franklin ( born ca 1780 GA died ca 1836 LoanCovington County, AL ) and Temperance ( ? ) “Tempy” ( born 1788 died ca 1868 Loango, Covington ty, AL ). It is a shame that the “Old Franklin homestead” of Tempy & John is not still standing as sothe older folks can tell “tales” of its time. There was even a creek there called “Franklin Branch” thaalong the edge of Tempy’s property.

Editor’s MessageI sincerely hope that everyone enjoyed a wonderful & safe Thanksgiving and Christmas with family & friends. “Happy New Year” to all of our “new found” families. Our potential accomplishments in 1992an exciting thought, one I hope everyone will be a part of. Our Charter Issue was mailed prior to the Odeadline, at which Johnnye & I were delighted. She drove to El Campo early on Saturday Morning spent the entire day putting the finishing touches on the Charter Issue and excitedly discussing futur- while my husband kept us supplied with nourishment. Johnnye has many wonderful ideas and is trforce behind my “tail winds” which keeps me from blowing completely off track. We both encouragerequests and ideas as to what you would like to see first in our quarterly. A total of 97 charter issuemailed to Franklin Researchers scattered across 26 states from Coast to Coast and England. Your tells us you were pleased with its contents.

Inquiries continue to come in from those who are hearing about our United Organization for the firstIf you have names of researchers you think would be interested - please send their names and we wilthem explaining our goals & objectives. But please, we need your research, family group sheets & Pcharts.

We have a lot of research material to publish but we need your continued research contributions socan maintain a geographical balance. Some areas are more important to some than others and wepublish something for everyone. Our success will depend on everyone’s efforts in helping us to get tterial out to everyone else. If you live near a courthouse and/or library - please comb through any arecords available for the Franklin Surname. No matter how insignificant to you and submit for publicDon’t give up on us - we will publish your materials!

Cover Page for Vol 2 ( April ’92 ) will feature the home of Ralph “Rafe” Morris Franklin built about 19located near Gum Slough, Jasper County, TX. Ralph is an ancestor of Charter Member #018. He is presearching with future plans of a book. His ancestor Ralph Franklin & my ancestor Henry Franklin lieved to be brothers. Vol 3 ( July ’92 ) cover page will feature “The Lakeside Hotel” in Spring Lake,nesota managed by Wm B Franklin and his wife Susan. ( Wm is the ancestor of #048 ). If I get nfeed back, it spurs me on to either prove or disprove my theory, therefore working to my advantage, hme to improve my research.

The first week of October I was in Richland, WA. I didn’t get to go to the courthouse but I did visit the library. They had a small genealogy section and I didn’t find any FranklinS in any of their publications.were having their book sale so I brought home some history books, a little beat up but covering areaam interested in.

Book ReviewI don’t have a book to review this time but I did see one at Clayton that bears looking into. - Some Early Pioneers of Western KY - Their Ancestors & Descendants, second edition 1990 by Helen E. Hart Peyton733 Schaffer Street, Charleston, SC 29412. This is a beautifully put together book with at least twoof Franklin’s in the index.

Franklin/Cleveland descendants: If you do not have access to the Clevealand/Cleveland Genealogy pub-lished 1899, I have all three rolls of film and will be glad to search your names. There is a lot of mismation in this book, but so many great clues that it is worth the search. Send SASE and twenty fivefor each name so that I can make you a copy of what is there.

There is no certain record of Lewis Franklin before he appeared in Bedford County, VA circa 1735. Hhave come from Henrico County, VA or more likely, Chester County, PA.

Lewis Franklin patented at least three parcels of land in Bedford County, VA; in 1749 850 acres inclthe head branches of Falling River adjoining Edward Nix’s line; in 1756, 118 acres on Callaway’s Rtween the two ridges [map coordinates of this property are N 37° 17’ 54” W 78° 59’ 57” in present dCampbell County, VA]; in 1759, 215 acres on the south side of Dixon’s Creek. This land adjoined the land grant and was located some three miles southwest of Concord, VA on highway 658 and was owthe Franklin family until 1945, Charles D. Franklin being the last family owner. On 1 Oct 1751 Lewis klin conveyed some of his land to Edmund Franklin, “Jr.” by “Deed of Bargain.” Lewis and his sons amassed large tracts of land in the area, but as of 1988, all of it has been sold.

Lewis Franklin married Jane __? [family tradition says her name was Lewis] She died in 1774 and hin 1770. They both died and are buried in Bedford County, VA, location unknown. [Reference BedfoCounty, VA Will Book 1, pages 95-96 for the inventory of his estate and Will Book 1, pages 217-21his will]. They had at least seven children, as listed below. He was an ensign in the Revolutionary War; a Captain in thBedford County Militia, ( joining in 24 Feb 1778 ) and served as deputy sheriff of Campbell CoVA. In 1773 he patented 49 acres of land on both sides of Morton’s Creek, a fork of the Big FRiver. In 1778 he bought from Pleasant Branch 182 acres on the south side of Morton’s Creekthe line of his brother, Thomas Franklin, from Hall’s corner to Harris’ corner. This home was near present day Naked Creek ( some say Aker’s Crebranch of the Big Falling River. In 1973 the house was still standing at map coordinates N 7930” W 37° 17’ 45”. Thomas and Letty are buried in a family plot near their home. A cabin onestate has long since gone to dust; but around it in the fields, flowers that she imported from Estill grow. [Reference-Campbell County, VA Order Book #9, page 30 shows an order settingher dowry, 237+ acres, taken from the estate of her husband and it was set aside from the lbelonging to her son, Henry R. Franklin. Order book #23 speaks of the pension of her husbathat it to be given to her. An interesting story on the atheist wife was told to the author by Mrs. PThompson. The atheist had died ca 1889 and had been “laid out” ( prepared for buriaseveral friends. While the body was in the parlor, it ( the body ), sat straight up and gloud moan. The exit from the parlor was very quick - the corpse had an involuntary musreaction and was really quite dead, but because she was an atheist [in that day and tia very nice person], the shock on these religious people was severe! About 1870 Capt.signed a note for a friend who wanted to buy a farm and the friend absconded and Hlost his farm, which had been debt-free. After he lost his farm, he moved to Lynchburglived with his niece, Pearl Franklin ? on Church Street between 10th and 11th Streewould sit on the porch and rock and he kept a cane under his chair and if he saw any pawho had the same name as his friend who has ruined him, he would pound on the prailing with his cane and call out to the person in a loud voice and tell them that they descended from a scoundrel. She did until they all died and then she lived there by herself. When Harvey E. Henderson came back from World War II, his wife, Sarah Agnes Evans Henderson asked Mary Saunders Jones if she wanted to sell them some land: she said “No, I want to keep it in the familyAbout 1947 she sold it to her nephew, Jones Rucker, ahe built a large dairy on the farm and after four years, sold it while Mary was in the hospital with sciatica and nearly broke her heart.

and located in Danville, Montgomery County, where he worked as a mercantile clerk until 1861. He then moved to New Florence in the sacounty, opened his own store which he kept until 1864. In December 1he was appointed the railroad agent at Old Allen on the North MissouRailroad. Three years later the station was moved to Moberly, MO ancontinued as agent until 1872. He was then appointed messenger forUnited States Express and he ran on the road between Moberly and Ottumwa for two years. In 1874 he was appointed deputy sheriff of Randolph County and was elected constable of Moberly Township whhe held for four years. In 1879 he worked as a carpenter and he took chof the railroad water tank and engine. On 4 Mar 1864 he was marriedMontgomery County to Elizabeth P. “Bettie” Pew, daughter of A.D. PeThey had one daughter, Clara May Franklin. Charles Wesley was listed in the 1860 census at ConDepot as a mechanic worth $100. He lost his home, property and ironfoundry at Concord for the debt incurred when he signed a bond for awayward CSA officer who skipped out on the note. Broke and discouraghe moved his family to New Florence, MO ca 1870 and there he ekeda meager living for his family of 9 children by farming and making sorghumolasses. her growing family together. All who wished went to college and all turned out well by helping each other - a remarkable heritage! Both are buried at the New Florence Cemetery.

( From the beginning of the Texas Revolution, The Republic gave land to veterans. Texas promised to those who fought for her 320 acres for 3 months service, and up to 1280 acres for one years service. These were called Bounties. The State of Texas and Republic of Texas from 1835 to 1888 issued 7,469 bounty warrants for 5,354,250 acres of land.3 In July, 1876 Texas gave a pension of $150 a year to surviving indigent veter-ans and to the Signers of the Texas Declaration of Independence. After the money ran out land was substi-tuted.4 In 1881 there were many indigent Civil War veterans and widows in Texas. Again the state gave land to these in lieu of money. 1280 acre Confederate Scrip certificates were given to disabled surviving veterans and to widows whose husbands were killed or died in the service. No-return means no one surveyed the land given to the grantee ).

was appointed by the U.S. Court of Claims to determine who was eligible for funds under the treaties of 1835-36 and 1845 between the United States and the Eastern Cherokee. Funds in excess of $1 million was appropriated by Congress on 30 Jun 1906. In certifying the eligibility of the Cherokees, Mr. Miller used ear-lier census lists and rolls that had been made of the Cherokees by Hester, Chapman, Drennen and others between 1835 and 1884. Other enrollment records used by Mr. Miller are among the classified files of the Bureau and are designated as “33931-11-053 Cherokee Nation.” He submitted his report and roll o28, 1909 and submitted a supplementary report and roll on Jan 5, 1910.

Applicant claims through father Anderson Green Franklin who was born in SC in 1823 and Gardner Green Applicant’s Great-Great Grandfather. Applicfather is living and has filed application #1774. Neither applicant nor his father nor hgrandfather nor great-grandmother were ever enrolled. Although they were living neand within the Cherokee County and if recognized as Eastern Cherokees since 1800 othereto, some of them would certainly have been enrolled. They do not establish factscent from the Garner Green on the 1835 Roll and even if they did would not be entitthere are two generations who should have been enrolled in 1835 as they were old eand were heads of families at that time. ( Applicants herein claim only through Benjamin ). Benjamin had the fol-lowing children: John, James, William and Dicey Boyd nee Green. All of Benjamin’s dren above named and through whom claims herein are made were living in KY andmany years prior to 1835, and there is evidence also to the effect that Benjamin himseliving in KY as early as 1808 ( Miscel. Test. p. 2128-9 and p. 2125 ). Benjamin Greenborn about 1761, making him about 74 or 75 years old in 1835. ( Miscel Test. p. 213James Green, the son of Benjamin, the son of Gardner, was born in 1788, making him47 years old in 1845. ( Miscel. Test. P. 2130 ). James Green went to MO to live in 1and his sister, Dicey Boyd, and his brothers went with him ( Miscel. Test. p. 2128 ). claimed that no ancestor was enrolled, with the exception of Gardner Green, and it iclaimed that he was enrolled in 1835 at Rocky Creek, GA ( Miscel. Test. P. 2130 ). Acant #31279 states in her testimony that she saw Gardner Green in 1832 or 1833, wcame to see her grandmother, Susie Smith, who was living in Clinton County, KY attime and who was Gardner Green’s sister. At that time, Gardner Green’s sons “wereWest” somewhere. She states that Gardner Green went from her Grandmother’s hoKY “to Fannin County, GA to make treaty”. “He never came back”. Gardner Green’s s“did not go to GA with him”. ( Miscel Test P. 2129 ). Gardner Green possibly lived in in 1835. He was a very old man when he died, some say about 115, others at variou- from 75 years up, and that he died in 1835 or soon thereafter. Some say that he diprior to 1831 ( Miscel Test P. 2125, p2128-29 ). Applicant #3785 states in her testimthat she was born in 1831 in Boone County, MO and that her mother’s name was DBoyd ( daughter of Benjamin ) and was born in KY in 1808. She states that Gardner Gdied before she was born. She was born in 1831. ( Miscel Test P 2125 ). Applicant #3states that she was born in MO in 1835, her father was James Green, that he movedin 1832 or 1833 with his father Benjamin Green and his brothers John and Isaac andsister Dicey Boyd ( Miscel. Text. p. 2127 ). Applicant #37890, daughter of James Grwas born in KY in 1829 ( see her application ). There is a Gardner Green on the roll of enrolled at Rocky Creek, GA with 8 others, making a family of 3, 1 male under 18 yeamale over 18 years and 1 female over 16 years, all full-bloods. In an affidavit field heby Nancy C Martin, she states that Gardner Green, her ancestor, was a full-blood. Afffiled by William A Green states that his grandfather, Benjamin, received letters from Benjamin’s father, Gardner ) who was living in GA. That Benjamin said that he himselfthree-fourths Cherokee. That when Gardner Green died, affiant’s grandfather, Benjasaid that Gardner was buried in the family burying ground east somewhere. It seemstremely unlikely that the Gardner Green on the roll of 1835 was the same person whclaimed as the ancestor of applicants herein, as applicants’ ancestor was between 9115 years old in 1835, according to the testimony, affidavits, etc., and had a son Benwho was 74 or 75 years old in 1835, and grandchildren as old as 47, and a great granborn in 1808. The Gardner Green on the 1835 roll, however, as above stated, was enwith a male under 18, who was probably his child, although that is only supposition, it bimpossible to ascertain from the roll, the relationship of persons in any one family grSome of the applicants herein in their testimony also state that their ancestor, GardnGreen, died prior to 1835. From the above it appears that Benjamin Green and his sJohn, James and Isaac, and his daughter Dicey Boyd, were living in KY and MO longto 1835 -that they had left the Eastern Cherokee tribe, if they ever belonged to it, longto the treaty of 1835-6, and if Cherokees at all, should be classed as Old Settlers. Eveceding that the Gardner Green on the roll of 1835 is the same person who is claimedancestor of applicants herein, they would not be entitled, because Benjamin Green achildren who were the ancestors of these applicants, and through whom they claim, all heads of families in 1835, and if members of the tribe and living in the Cherokee doat that time, should have appeared on the roll of 1835, and if living as far off as MO KY, could not have been considered members of the tribe at that time. James was about 47, Dicey Boyd was 27, and the two other boys, John and Isaac, although it is impossible to ascertain the exact date of their births, were probably older than Dicey as they were always named before her in applications, affidavits, etc. Dicey Boyd was born in KY in 1808, showing that Benjamin, the son of Gardner, was living in KY as early as that date, which was hundreds of miles from the Eastern Cherokee domain. From KY Benjamin and his sons and daughter and their families moved to MO so that if they ever lived with and were members of the Eastern Cherokee tribe, they left it at least prior to 1808 and never lived or had any connection with it again. Wherefore, in consideration of the premises, the claim of all persons claiming through Gardner Green, Benjamin Green, and the latter’s sons and daughters, are hrejected. ( Miscel Test p 2122-3-5-6-7-8-9-30 and 2038. See also affidavits and lettersin the case ).

#126 Anna R Cothran & 3 children, Topton, NCRejected. It does not appear that ancestors were ever enrolled or were parties to the of 1835-36 & 1846. They show no real connection to the Eastern Cherokee. ( Miscelp 1550 ).

#3384 Norman Franklin & 2 Children, Atmore, ALRejected. Creek Case ( See Special Report #1139 )

#1139 John F McGhee , Atmore, ALRejected. There are several hundred persons who have filed applications for participin the distribution of the Eastern Cherokee fund, who for the most part, live in the extsouthern section of Alabama and the western section of Florida, who are not Cherokall, and most of them do not claim to be Cherokees, but are Creeks. Quite a number oclaims decent from such historic Creek characters as Billy Weatherford, Peggy Baileyliam and Chilly McIntosh and Alexander McGillivray, and most of these applicant’s claonly through the Hollinger, McGhee, McIntosh, Meniac, McGillivray, Franklin or Killiafamilies, which are all of Creek Origin. Some of these are recognized members of the tribe, others while not recognized as members of the creek tribe, claim as descendasome Creek ancestor. Most of them state in so many words in their applications and itestimony that they are Creeks, and they file their applications under the impression thscendants of Creek Indians are entitled to share in this fund. This idea was spread in sections of the South by some attorneys and claim agents, who were themselves unimpression that Eastern Creeks are entitled to share in this fund. Powers of Attorneysbeen received by the Special Commissioner, which provide for the payment to attornea certain percent of any money recovered from these claims of “The Eastern and EmCreeks”.

There is absolutely no connection between any of these claimants and the Eastern Cherokees andconnection is claimed by them. They never lived within the Cherokee domain. They were filed undeerroneous opinion that this fund was for Eastern and Emigrant Creeks instead of Cherokees. Thesehave all been grouped together and for convenience marked “Creek file.”

As they are not in any way connected or related to the Eastern Cherokees, and as most of them do claim to be so connected and related, of course none of them were ever enrolled with the Eastern Chnor were any of their ancestors parties to the treaties of 1835-6 and 1846. For particulars see “Creemony” pp 1-12, taken Feb 1908.

For the reasons above stated, all of these cases ( in what is marked the “Creek File” ) are rejected.

I felt the following information which was presented by Desmond Walls Allen, Arkansas Research, PO303, Conway, AR 72032 during one of the workshops, might help those of you that might not know oResearch tool, and to perhaps serve as a reminder to those more experienced researchers.

Locating Land Entry Case Files in Public Domain StatesPublic Domain States: Are all the States except the 13 Original Colonies, Maine, Vermont, West VirgiKentucky, Tennessee, Texas & Hawaii. Kentucky & Tennessee lands were used by Virginia & Northlina for Bounty Land for military services. Texas was an Independent Republic and came with its landas did Hawaii.

Therefore, locating Public Domain Land Entry Case files pertains to 30 Public Domain States that wein the jurisdiction of the Federal Government. The Federal Government acquired the land: As the Fed-eral Government acquired lands ( i.e. The Louisiana Purchase ) the first thing the United States hawas acquire a title.

A Survey was needed: The system imported from England to survey the land was ( 1 ) Leaps & Bounalso referred to as discriminate surveys. Leaps & Bounds surveys quite often named the neighborsthis method was not tied to some larger survey it is difficult to make exact location on the map. Alsodifficult to rebuild the land description.

Survey Field notes: were made by the surveyor who went out with their equipment and surveyed the PDomain Lands. These field notes still exist. If your ancestors lived on the land at that time ( Surveysafter settlement in a lot of places ); your ancestors may be mentioned in survey field notes.

All Previous Claims had to be settled: After the survey was made all previous claims to land, includinpeople who where already in the area, had to be settled.

Local land offices were set up: The Federal Government established local land offices and sales, to prindividuals, began of the land. All the paperwork was sent to Washington. Therefore, these records w

Land Patents were issued: Land patents were issued to buyers. The documents issued to the buyer stated that the buyer now owned the land and the buyer may or may not have recorded their land patent locally in the County Deed Book. When researching these recorded land patents be sure that you are researching the correct county at the time the patent would have been recorded.

Tract Books were large volumes set up and recorded, by land description, transactions involving a partic-ular piece of land.

Township plats were diagrams of Public Domain Lands that were divided up showing Rivers or natural features that were on the land. They may also have notes about earlier settlers.

Land Entry Case Files consist of Paperwork that was created when our Ancestor bought the land or oth-erwise acquired the land ( i.e. Homestead ) . In 1862 the Federal Government passed an Act that said “If you will live on the land and fulfill certain requirements about improving of that land, we will give youland.” These files are located in Suitland, Maryland.

To obtain the Land Entry Case File: The seven states indexed include: ( pre-1908 ) Alabama, Alaskaizona, Florida, Louisiana, Nevada & Utah. For these states send: State, full name, county - to Natiochives, Washington, DC 20409. Wait for instructions and pay when instructed to do so.

For unindexed states send legal description of land to: Bureau of Land Management, 350 S Pickett Alexandria, VA 22304. Ask for: land office name, type of file ( cash purchase, Credit or Homesteadfile number. After you receive a reply then write National Archives, Washington, DC 20409. If you dhave the legal land description ( Section, range & township ) these can be gotten from County deed Historical Atlas, Tax Records or Tract Books.

the United States from 1861 to 1865, and was taken by the Northern Army as a prisoner; that before the war ended, he escaped the Northern Army and made his way into the Dominion of Canada where he resided and married a Canadian women by the name of Sarah Fox and as a result of this marriage, I was born on July 15, 1877, while my father was residing in the Dominion of Canada.

I further swear that my father, Reuben Mars Franklin, did not change his citizenship while in the Dominion of Canada and did not establish any citizenship while residing there and that he returned with my mother to the United States and resided in the State of Florida from the year 1880 until his death and that as a result of this marriage my mother became a citizen of the United States and returned with my father to Florida where she too, died.

I further swear that under the laws of the United States as set out in Section 5947 of the United States compiled ____ of 1913 compact Edition ( Title XXV---Citizenship ) which reads as follows:

“Children of citizens born abroad--All children heretofore born or hereafter born out olimits and jurisdiction of the United States whose fathers were or may be at the time of their birth cithereof, are declared to be citizens of the United States; but the rights of citizenship shall not descechildren whose fathers never resided in the United States.”

In my research it was mentioned that Sarah’s last name was possibly “Brady”. With the help of othealogists, nowhere is the name Brady found. We believe from the following records that Sarah is the daof Vial Franklin ( born 1744 ) and Mrs. Lucretia Whitney Franklin ( born 1771 ).

Fellow family genealogist: Wayne Bonner, 15619 Ogram Ave., Gardena, CA 90249, has supplied tlowing information: Sarah Franklin was born in Vermont in 1799 which would have made her 51 in thecensus as indicated. It would be more than a coincidence if Sarah Brady and Sarah Franklin had bethe same year in the same state, but it is possible of course. I believe that at the time of the 1850 celeast, Lewis Elijah’s wife must have been Sarah Franklin.

The Franklins did live in Andes, Delaware County, NY as indicated by the 1820 census. ( Vial FrankLewis Elijah are enumerated on the same sheet ). Lucy Barlow, another of the Franklin daughters, lAndes in 1820 and 1830, and Lewis Elijah #2 is enumerated only two lines down from Vial Franklinimmediately before Benjamin Franklin on the 1830 census of Allen Twp. Allegheny County, NY. We tfore seem to be able to associate the Franklin and Elijah families from at least 1820 to 1830 and ag1850. Perhaps all of these are by coincidence, but it seems very unlikely to me.

Mary Herold, who were taken when young and given a home until they went out to make a home of their own. He also has 26 grandchildren and 20 great-grand-children. Mr. & Mrs. Elijah were pioneers of Newton County. Funeral services were conducted in the Mt Ayr Methodist Church, Rensselaer, Sunday Afternoon, Nov 26. He was then laid to rest in North Star Cemetery.

At a County Court began & held for Hardin County at the Court house in Elizabethtown on Wednesday No-vember 15, 1866 the foregoing Instrument of writing purporting to be the last will & testament of Bennett Franklin dec. was produced in court & proven by the oath of Macajah Madderra & Wm Madderra two of the Subscribing witnesses & on the Monday Feby 19 1866 the same was proven in due form of Law by the oath of Wm T Love the other subscribing witness & the same was established as such & ordered to be re-corded whereupon I have truly recorded the same in my office this 28 day of Feby 1866.

Memoirs of MississippiMeshack Franklin attended the University of MS at Oxford for three years and graduated in Jun 1860. He enlisted in the Confederate army in May, 1861, in the University Grays of Oxford, Company A, Eleventh Mississippi infantry, commanded by Colonel Moore, and went direct to Harper’s Ferry. His first engment was the first battle of Manassas, and soon after that he was detailed as assistant commissary serving in that capacity until the close of the war. In Jan 1865 he obtained a furlough and came homwas at Grenada, MS on his way back when the surrender came, and went from there to Memphis wwas paroled in June, 1865. He then returned to his home and the following year went to Hardeman CTN where he taught school for a year. Returning to Marshall County again he resumed the occupafarming, and in May 1866 was married to Miss Julia P Wilburn of Fayette County, TN. Their marriagbeen blessed with the birth of five children: Wilburn B., James H., Mattie E., Julia A and Meshack. Franklin owns one thousand three hundred acres of land, a nice two-story frame residence situated east of Early Grove, and about eight hundred acres under cultivation, the greater portion of it operatenants. The principal crops are corn and cotton, and of the latter his farm yielded one hundred andbales in 1890. He has a steam gin on his place, and the number of bales ginned annually are abouhundred. Mr. Franklin is a member of the Masonic fraternity, Knights of Honor and the Farmers’ AlliaHe was magistrate for four years, was a member of the board of supervisors for the same length of tiis well and favorably known all over the county. He and Mrs. Franklin are members of the Methodist CSouth, and move in the best circles of society.

Robert L Franklin was brought up to the life of a planter by his father John A Franklin, and like the maof boys, has followed in his ancestor’s footsteps, and is now one of the leading agriculturists of Clay CHe was born in Pickens County, AL in 1841, a son of John A and Seleta C Franklin, the former of wwas born in NC in 1814. When about twenty-three years of age he married to Seleta Stell, a daughGeorge and Elizabeth Stell of AL. To Mr. Franklin and his wife eleven children were born: Elmyra (

McDougald, of AR ); Tempy, the widow of Mr. Carpenter of CO; George W of AR; James R and John W also of that state; Robert L; Oliver and Mattie ( Mrs. Green ) of AR. John A Franklin came with his family to MS in 1843, and settled at Ripley in Tippah County, but afterward moved to Itawamba and finally to Nox-ubee County where he died in 1859. His widow survives him and resides at Hamburg, AR in her seventieth year. The father was a member of the Masonic fraternity, which he joined in Itawamba County and upon his death in Noxubee County was buried by that order. He was as is his widow a member of the Baptist Church. Robert L Franklin received a common school education and at about the age of twenty-five years began to make his own way in the world. In 1865 he was married to Miss Anna Goldson of Oxford County, MS a daughter of William D and Permelia A Goldson, and their union resulted in the birth of ten children: Minnie A ( Mrs. Milton ); Mary E; Edith C ( Mrs. Jones ); Willie L; John B; Charley A; Julia S and Mattie L being the only ones now living. Upon the opening of the war in 1861, he became a member of Company H, Fifth Alabama Regiment, under Jackson, and fought at the battles of Seven Pines, Yorktown, the seven dgagement at Richmond, Chancellorsville, Bull’s Run, the first and second Manassas, Sharpsburg, Pburg and Fredericksburg. He was wounded at Malvern Hill, and lay ten days in the hospital at Richmand at the battle of Chancellorsville he lost his left arm from a rifle shot. After remaining in the hospitsome time, he was honorably discharged from the service and returned to his home, where he has voted his attention to planting, and has done well. His plantation is a fertile and admirably conducteand is situated on a beautiful prairie, and he has the consciousness that it was obtained through hisdeavors, and not from inheritance. He is an enterprising and industrious planter and has proven himgood manager.
