REF: Letter No: NH-11014/8/2014-P&M, Dated: 11.06.2014, from the Under Secretary to the Government of India, Ministry of Road Transport & Highways (P&M Section), New Delhi. -oOo I am to state that the Under Secretary to the Government of India, Ministry of Road Transport & Highways (P&M Section), New Delhi, in his letter referred to above has stated that at present eight National Highways Tribunals have been set up one each at Bengaluru, Chandigarh, Chennai, Guwahati, Jabalpur, Kolkata, Lucknow and Mumbai and the Government of India have decided to make a fresh panel of candidates to fill up the post of Presiding Officer in National Highways Tribunal at Mumbai and also to fill up the vacancies existing as well arising from time to time against the posts of Presiding Officer in the remaining Tribunal as and when required. The letter of Under Secretary to the Government of India, New Delhi, was placed in the High Court Web site i.e., http://hc.tap..nic.in. I am, therefore, directed, to request you to circulate the same among the District & Sessions Judges, working in your District/ Unit and the Officers, who were eligible may download the copy of above said letter from the High Court’s Web Site and submit their willingness applications (in original), directly to the High Court, on or before 11.07.2014 by SPEED POST or any other source.     Subject: Control of National Highways (Land & Traffic) Act, 2002- Application forappointment as Presiding Officer of the National Highways Tribunal.

    I am directed to say that under the "Control of National Highways(Land &Traffic )Act, 2002, a total of eight National Highways Tribunals have been set up atBengaluru, Chandigarh, Chennai, Guwahati, Jabalpur, Kolkata, Lucknow and Mumbai. TheAct provides for control of land within the National Highways, right of way and trafficmoving on the National Highways and also for the removal of unauthorized occupationthereon. The objectives of the Act are to be achieved through the National HighwayAdministration established under Section 3 of the Act. The appeals against the orders passedby the Highway Administrations under Sections 26, 27, 28, 36, 37 and 38 shall lie before theNational Highway Tribunal established under Section 5 of the Act. The Tribunal consists ofonly one person known as Presiding Officer in the Pay Band-4[Rs.37000-67000] with GradePay ofRs. 10000/- per month.

    2. Under Section 7 of the Act, for appointment as the Presiding Officer, a person hasto be qualified to be a Judge of a High Court or he should have been a Member of the IndianLegal Service and should have held a post not less than Grade-II [Rs.l4,300-l8,300/-(pre-revised) of that service. Here it is specifically mentioned that a person has for at least tenyears been an advocate of a High Court or of two or more such courts in succession is alsoeligible. The appointment to the post of Presiding Officer at National Highways Tribunalswill be governed by the National Highways Tribunal(Procedure for appointment as PresidingOfficer of the Tribunal) Rules, 2003. The service conditions of the officers appointed asPresiding Officers of the National Highways Tribunals will be governed by the NationalHighways Tribunal(Salaries, Allowances and other condition of service of Presiding Officer)Rules, 2005. Under Rule 13 of the said Rules, a person who has completed 60 years of agebefore the appointment shall not be appointed as Presiding Officer of a Tribunal.

    3. In accordance with the aforesaid Rules, it ha-s now been decided to make a freshpanel of candidates to fill up the post of Presiding Officer in the National Highways Tribunalat Mumbai and also to fill up the vacancies existing as well arising from time to time againstthe posts of Presiding Officer in the remaining Tribunals as and when required.

    4. It is, therefore, requested that this circular may be given wide publicity amongstthe eligible persons/officers and the names of the suitable and wiling persons/officers may besent to the Under Secretary (P&M), Ministry of Road Transport and Highways, Transport

    Bhawan, 1, Parliament Street, New Delhi-I 10001 immediately and within a period of 45days from the date of publication of the relevant vacancy circular in the leading NationalNewspapers along with following documents:

    (a) Complete Bio-Data of the persons/officers along with their service particulars,experience, qualifications, posts held, etc.

    (b) Certified copy of the CR Dossiers for latest five years(ln the case of serving officers).(c) Bar Council Reports, if any, in the case of practicing advocates.(d) Vigilance clearance in the case of serving officers.(e) Income Tax Returns statement of last three years in the case of practicing advocates.,

    5. The Advocates who wish to apply for the posts may be advised to send theirapplications complete in all respects through the Registrars of the concerned High Court.

    6. Advance copy of application will not be entertained.
