Abstract:

MulRple bills passed by the 85th Legislature will have an impact on Texas lawenforcement.TherewereadministraRvechanges,changes inexisRngstatues,andnewlaws.BypursuingequalityinjusRceandensuringpublicsafety,Texas’lawenforcementprofessionals will beTer serve their communiRes by increasing their awareness ofchangesandaddiRonstostatestatutes.

Case law, especially cases handed down by the Supreme Court of the UnitedStates (SCOTUS), is of incredible importance to the administraRon of JusRce. Thiscurriculum will briefly cover recent judicial decisions that are important for lawenforcementofficers,lawenforcementadministrators,andpolicymakers.

UNITI: TRAININGREQUIREMENTSANDTCOLECHANGESLEARNINGOBJECTIVE: TheSWBAT idenEfycurrenttrainingrequirementsandTCOLEchanges.

Texaspeaceofficers are required to complete specific training requirements tomaintain licensure. Officers holding a basic proficiency cerRficate or lower must, inaddi8on to all other training mandates, complete the following courses within the09/01/2017through08/31/2021quadrennialtrainingcycle: 1

All Texas peace officers, regardless of cer-fica-on level, must complete aminimum of 40 hours of in-service training during each biennial training unit. ThistrainingmustincludeaTCOLE-approvedstateandfederallegalupdatecourse(theseareTCOLE course number 3185 for the 2017-2019 unit and TCOLE Course 3186 for the2019-2021unit,respecRvely). 2

� Two-andFour-YearTrainingRequirementsforLicensedPeaceOfficers

ApeaceofficerfirstlicensedonoraserJanuary1,2011,mustcompleteabasictrainingprogramonthetraffickingofpersonswithinoneyearoflicensure. Becauseof3

thewaytheenablingstatuteiswriTen,theHumanTraffickingcoursethatsaRsfiesthisrequirement may not be contained within an officer’s basic peace officer academytraining; it must be taken aser the officer is licensed (i.e., sworn in with a lawenforcement agency). Those peace officers first licensed on or aser January 1, 2016,must complete the “Canine Encounters” course (TCOLE #4065) within two years oflicensureifthattrainingmoduleisnotincluded(andreportedtotheCommission)inthe

Therehavebeensomerecentrulechangesofnote,too.Thesechangeswillaffectcertain groupsofofficersmore thanothers.OneparRcular rule related to instrucRon,though, is significantenough tobring toeveryone’s aTenRon.Please take theRme tonotethechangebelowasitmayhaveanimpactonhowyoudoyourjob.

§215.10:CourseInstructorRequirements

(a)Aninstructorteachingacoursemust:(1)holdavalidinstructorlicense;(2)cerRficate;or(3) be designated, in wriRng, as a subject maTer expert in the course by thetrainingcoordinator.

(b)Theinstructorisresponsiblefor:(1)ensuringcompliancewithcommissionrulesandguidelines;(2)preparing,maintaining,andsubmiungthereportsoftrainingwithintheRmeframespecifiedbytheTrainingCoordinator;(3)theadministraRonandconductofeachcoursetaught;(4) at aminimum, providing a complete lesson plan, clear learning objecRves,instructorbiography,approvedclassrosterandoriginalsign-insheet,andcourseevaluaRontothetrainingcoordinatorforthetrainingfile;

(5) enforcing all aTendance andother standards set by the commissionor thetrainingadvisoryboard;(6)maintainingthedisciplineanddemeanorofeachstudentduringclass;(7)distribuRngorpresenRnglearningobjecRvestoallstudentsatthebeginningofeachcourse;(8)ensuringthatalllearningobjecRvesaretaught;and(9) ensuring examinaRons are proctored or supervised to have fair, honestresults.

(c)TheeffecRvedateofthissecRonisMay1,2017.

SecRon215.10isdirectlyrelatedtowhomayteachcoursesforTCOLEcreditandtheresponsibiliResoftheinstructor.Pleasenotethatinstructorsnowmustbecer-fiedor licensedas instructorsbyTCOLEormustbedocumentedassubject-ma>erexpertsby the training coordinator responsible for the course. This applies to each coursetaughtbytheinstructor.NotealsothattherulenowallowstheCommissiontonowtakedisciplinaryacRondirectlyagainstinstructorswhoengageinmalfeasancewhileteachingcourses(subsecRon(b)statesthat“the instructor isresponsiblefor…”).Previously,thetrainingcoordinatorsweretheindividualswhowerenormally“onthehook”forcoursesthatwere not handled properly; §215.10 nowmakes the instructor himself or herselfresponsibleforhisorheracRons.

ThisdoesnotmeanthattrainingcoordinatorsarenowpermiTedtoturnablindeyetowardtheclassestheysupervise.Whatthisrulemeansisthatindividualinstructorsareheld responsible for the classes they themselves teachwhile training coordinatorsareheldresponsiblefortheoveralloperaRonofthetrainingprogramitself.ThischangeisdesignedtocreateamoreeffecRve,responsive,andprofessionaltrainingprogram.

SenateBill1849,theSandraBlandAct

GovernorAbboTon06/15/2017signedtheSandraBlandAct.ThisnewlawwasnamedinmemoryofanAfrican-AmericanwomanwhodiedinjailaserbeingarrestedinWallerCounty.Ms.Bland’sdeathwasruledasuicide,butthecircumstancessurroundingher passing sparked a naRonal discussion on the topics of race and lawenforcement.The SBAmakesmulRple, serious, substanRve changes across a large number of Texascodes. For purposes of this first secRon of the legal update, the following five SBA-mandatedchangestoTCOLEarelistedindigestform.Otherchangesaredocumented,asappropriate,whencoveredinthevariouscodesthatfollow.

1. Expanded Crisis IntervenEon Training. The Sandra Bland Act mandates thatTCOLEupdateandincreasetheamountofCITtrainingprovidedtoTexaspeaceofficers.Tothatend,theCITcurriculaintheBasicPeaceOfficerCourseandthestand-aloneCITin-servicecoursearenowsetataminimumof40hours.

2. De-escalaEon Training. A separate, new course on de-escalaRon skills will becreatedbyTCOLE.Thisde-escalaRoncourseisnotthesameclassastheCITcourse,butinstead focuses on common interacRonswith the general public. This new curriculum

will be included in the BPOC and as a requirement for both an intermediate and anadvancedpeaceofficercerRficate.

3. Mental Health Training for County Jailers. There will be new mental healthtraining for jailers in both the Basic County CorrecRons Course and as an in-servicecourseforthosewhoarealreadylicensedasjailers.Thein-servicemustbecompletedbytheendofthe2017-2021quadrennialcycle.

4. ChangestoRacialProfilingReports.TherewillbenomoreparRalexempRonsforagenciesusingvideoequipmenttorecordtheirtrafficstops.AllagenciesthataresubjecttoreporRngrequirementswillnowhavetosubmitafullracialprofilingreport.

5. JailAdministratorTesEng.NewlyappointedjailadministratorswillhavetotakeastatecompetencyexaminordertoqualifytoholdthatposiRon.TheexamitselfwillbedevelopedandwriTenbytheTexasCommissiononJailStandards(TCJS),buttheexamwillbehostedandproctoredbyTCOLE.

UNITII: IMPORTANTSCOTUSCOURTOPINIONSLEARNING OBJECTIVE: The SWBAT idenEfy recent court opinions that will have orhavehadanimpactontheadministraEonofjusEceinTexas.

FourthAmendmentCasesUtahv.Strieff,136S.Ct.2056(decided6/20/2016).Issue:DoesfindingavalidwarrantaseranunreasonablewarrantlessstopaTenuatethefruitofthepoisonoustreeandmaketheresultsofapostwarrantarrestsearchincidentadmissible?

Holding: In this case, yes. The court found that although the officer’s stop of Strieffoutside a suspected crack house was not supported by reasonable suspicion that astandard warrant check producing a valid warrant was an “extraordinary interveningcircumstance”thatpreventedthedoctrineof“fruitofthepoisonoustree”fromcausingdrugsfoundinthelatersearchincidentfrombeingsuppressed.TheCourtpointedoutthattheiniRalpoliceconductwasalegiRmateinvesRgaRonandnotflagrantmisconduct.

Commentary:TheCourtmadeagreatdealoutofthelackof“flagrantmisconduct.”Thisisnotabrightlinerulingthatawarrantwillalwayssaveanillegalstop.ThiscasefollowsthereasoningofseveralTexascases.

BirchfieldV.NorthDakota,136S.CT.2160(decided6/23/16).Issue:CanadefendantlawfullyarrestedforDWIbeconvictedforacrimeofrefusingabreathtestorblooddrawtotestBAC?

Holding:Yesforabreathtest,butnoforablooddraw.Thecourt foundabreathtest,beinglessinvasive,doesnotimplicatesignificantprivacyconcernsandcanbeperformedwithoutawarrant.Ablooddrawrequiresawarrant.ThereforecriminalizaRonofbreath

Commentary:ThiscaseisnotagreatshockaserMcNeelyv.Missouri.IthasveryliTleimpactinTexassincetherehasneverbeenacriminalpenaltyforrefusingeitherbreathorblood.ThecasedoespointoutonepotenRaladvantageofbreath tesRngsince thecourtfounditdidnotsignificantlyimpactprivacyconcerns.

PoliceLiabilityCasesMullenixV.State,136S.CT.305(Decided11/9/2015).

Issue:WasanofficerthatshotandkilledafleeingmotoristwhowasposingadangertoothersenRtledtoqualifiedimmunity?

Holding:Yes.TheCourtreversedthetrialcourtandthe5thCircuitandfoundthattherewas no clearly established law saying the use of deadly force in this circumstanceviolatedthe4thAmendment.

Commentary: This case was a mess. But the Court held that shooRng a car that isfleeing does not violate the 4th Amendment and without that violaRon the officerdeservedqualifiedimmunity.Don’treadatotalgreenlighttoshootfromthiscase.

WhitevPauley,137S.CT.542(decided1/9/2017).

Issue: Was an officer who shot and killed an armed suspect without first idenRfyinghimselfasanofficerorgivingawarningenRtledtoqualifiedimmunity?

Holding:Yes. There is no “clearly established Fourth Amendment right” to be free ofexcessiveuseofforcethatrequiresthefiringofficergiveawarningoridenRfyhimselfaspolice. Since the officer joined a police acRon and his fellowofficerswere under fire,sucharuleisoverlybroad.

Commentary: This case headed back to court to make sure someone idenRfiedthemselves as police. Yes, someone sRll needs to do that, but the Court (as it hasfrequentlydone)saidthecasesmustbeviewedontheirindividualfacts.

ManuelV.CityofJoliet,137S.Ct.911(decided3/21/17).Issue:Doesamagistrate’sfindingofprobablecauseandprosecuRonofacaseendtheFourthAmendmentclaimandmakeita14thAmendmentclaimwhichwouldhavebeenbarredbythestatuteoflimitaRons?InthiscaseofficershidnegaRvefieldtestsondrugsandfailedtotellprosecutors.Thissuitwasbarredbythestatuteof limitaRonsagainsttheofficers,butnottheprosector.Theonlywaythecivilsuitcouldgoforwardisiftherewasprosecutorialmisconduct.

Holding:Themagistrate’sfindingandsubsequentprosecuRonwerebotharesultoftheofficer’smisconduct.TheFourthAmendmentclaimsurvivesboth.Therewasprosecutor

misconduct although the prosecutor only became aware of the officer’s misconductaserthelabworkcameback.

Commentary:Itreallydidnothelpthattheprosecutorwaitedseveralweekstodismissthecase.Theonlywaytoholdtheofficersresponsiblewastotosstheprosecutorinwiththem.ThecaseisremandedbackformorefindingsonthestatuteoflimitaRons.Thekeyhereisdon’tframepeople.ThereisalsoapreTyclearwarningthathidingexculpatoryevidencewillgeteveryonesued,anddefensesdenied.

IMPORTANTNOTEREGARDINGTHECASEBRIEFSABOVE: Officersshouldconsultwiththeirlocaldistrict,county,ormunicipalaTorneyifthereareanyquesRonsaboutthecaseslistedabove.Thesearenot,byanymeans,theonlycasesyoushouldbeawareof,norarethebriefsanexhausEveorlegallybindingopinionasto how officers should engage in law enforcement work. It’s important for you todeterminehowyourlocalprosecutorwantstomoveforwardwithintheparametersofthelaw.

UNITIII: CHANGESTOTHETEXASPENALCODELEARNING OBJECTIVE: The SWBAT recognize selected changes to the Texas PenalCode.§20.02,UnlawfulRestraint, is amendedby adding to the F/2enhancement,when thevicRmisapeaceofficerorjudgelawfullydischarginganofficialdutyorinretaliaRonfororonaccountofanexerciseofofficialpowerorperformanceofanofficialduty.ThisisoneofmanyenhancementsduetotheaddiRonofpeaceofficersandjudgestothelistofpotenRalvicRmsofahatecrime.ENABLINGLEGISLATION:HB2908

§20A.02, Trafficking of Persons, is amended by removing the previous languageregardingthevicRm'sage(“attheRmetheactorcommitstheoffense”)andreplacingitwith“attheRmeoftheoffense.”

Thenew subsecRon (a-1) adds thedefiniRonof “coercion” as “destroying, concealing,confiscaRng or withholding from the trafficked person, or threatening to destroy,conceal,confiscate,orwithholdfromthetraffickedperson,thetraffickedperson'sactualorpurported:

• GovernmentRecords;or• IdenRfyinginformaRonordocuments.”

§22.021, Aggravated Sexual Assault, is amended by adding that the offense iscommiTed“regardlessofwhetherthepersonknowstheageofthechildattheRmeofthe offense.” It alsomodifies the language regarding so-called “date rape” drugs. (2)onthepremisesofapollingplaceonthedayofanelecRonorwhileearlyvoRngisinprogress;(3) on the premises of any government court or offices uRlized by the court, unlesspursuanttowriTenregulaRonsorwriTenauthorizaRonofthecourt;(4)onthepremisesofaracetrack;(5)inorintoasecuredareaofanairport;or(6) within 1,000 feet of premises the locaRon of which is designated by the TexasDepartment of Criminal JusRce as a place of execuRon under ArRcle 43.19, Code ofCriminal Procedure, on a day that a sentence of death is set to be imposed on thedesignatedpremisesandthepersonreceivednoRcethat:

(A) going within 1,000 feet of the premises with a weapon listed under thissubsecRonwasprohibited;or(B) possessing aweapon listedunder this subsecRonwithin1,000 feetof thepremiseswasprohibited.

(a-1)Aperson commits anoffense if theperson intenRonally, knowingly, or recklesslypossessesorgoeswithalocaRon-restrictedknife:

(1) on the premises of a business that has a permit or license issued underChapter25,28,32,69,or74,AlcoholicBeverageCode,ifthebusinessderives51percentormoreofitsincomefromthesaleorserviceofalcoholicbeveragesforon-premises consumpRon, as determined by the Texas Alcoholic BeverageCommissionunderSecRon104.06,AlcoholicBeverageCode;(2) on the premises where a high school, collegiate, or professional sporRngeventorinterscholasRceventistakingplace,unlessthepersonisaparRcipantintheeventandalocaRon-restrictedknifeisusedintheevent;(3)onthepremisesofacorrecRonalfacility;(4) onthepremisesofahospitallicensedunderChapter241,HealthandSafetyCode,oronthepremisesofanursingfacilitylicensedunderChapter242,HealthandSafetyCode,unlessthepersonhaswriTenauthorizaRonof thehospitalornursingfacilityadministraRon,asappropriate;(5) onthepremisesofamentalhospital,asdefinedbySecRon571.003,Healthand Safety Code, unless the person has wriTen authorizaRon of the mentalhospitaladministraRon;(6)inanamusementpark;or(7) on the premises of a church, synagogue, or other established place ofreligiousworship.

§46.035,UnlawfulCarryingofHandgunbyLicenseHolder.HB435establishesadefenseto prosecuRon for the unlawful carrying of a handgun by a license holder on certainspecifiedpremisesthattheactorisvolunteeremergencyservicespersonnelengagedinproviding emergency services. The first change we need to cover was by addingsubsecRon(h-1),whichsaysthatitisadefensetoprosecuRonundersubsecRons(b)(1)[the51%law],(b)(2)[aschoolsporRngevent],(b)(4)[ahospital/nursingfacility],(b)(5)[certainamusementparks],(b)(6)[religiousplace]and(c)[meeRngrooms],thatattheRmeofthecommissionoftheoffense,theactorwas:

(1)ajudgeorjusRceofafederalcourt;(2)anacRvejudicialofficer,asdefinedbySecRon411.201,GovernmentCode;or(3) the aTorney general or a United States aTorney, assistant United StatesaTorney, assistant aTorneygeneral, district aTorney, assistantdistrict aTorney,criminaldistrictaTorney,assistantcriminaldistrictaTorney,countyaTorney,orassistantcountyaTorney.

SecRon 46.035 also now has a new subsecRon (m), which reads as follows: “It is adefense to prosecuRon under subsecRons (b) and (c) that the actor is volunteeremergency services personnel engaged in providing emergency services.” Thesedefensesincludeeverythingexceptcarryingwhenintoxicated,openly(withoutabeltorshoulderholster),orwherenoRceisprovidedoncollegesanduniversiRes.ENABLINGLEGISLATION:HB435

§46.05,ProhibitedWeapons, is amendedby twobills.HB1819amends this secRon toexclude a firearm silencer possessed,manufactured, transported, repaired, or sold incompliancewithfederallawfromtheapplicabilityoftheoffenseforengagingincertainconductwithrespecttoprohibitedweapons.Specifically,

(a) A person commits an offense if the person intenRonally or knowingly possesses,manufactures,transports,repairs,orsells:

whobelievesoneormoreofthenamedenRResareacRnginviolaRonofthebill.• It requires the ATorney General to defend a local enRty, when requested, in

acRonsarisingoutofclaimsinvolvingtheenRty’sgoodfaithenforcementofthebillandmakesthestateliableforrelatedexpenses,costsandjudgments.

• It amends the Code of Criminal Procedure to require any law enforcementagency thathas custodyofapersonsubject toan ICEdetainer to complywiththe detainer and inform the person of the detainer. This is not required if thepersoncanprovideprooftotheagencythattheyareaUnitedStatesciRzenorlawfulimmigraRonstatusintheUnitedStates,suchasaTexasdriver’slicenseorsimilargovernment-issuedidenRficaRon.

• Itrequiresthejudgeinanycasewhereadefendantissentencedtoconfinement,andsubjecttoanICEdetainer,toorderthatthedefendantservethefinalporRonof the sentence in federal custody; not to exceed seven days. The federalgovernment must consent to the transfer. The judge is required to issue theorderattheRmeofsentencingunlessthedetainerrequestisnotyetavailable.Ifthe detainer request becomes available someRme aser sentencing, the judgemustissuetheorderatthatRme.
