Program Description

The Introduction to China’s Law and Legal System will be offered from 10 - 22 April

2016 inclusive.

The Program will be conducted at East China University of Political Science and Law

(ECUPL) in Shanghai. It covers various aspects of Chinese Law and Society, including

Constitutional, Civil, Criminal, Intellectual Property and Corporate Law. Seminars are

conducted by ECUPL academics. Also included are excursions to the People's Court, a

major international law firm, a legal aid centre, and other attractions around Shanghai.

Financial relief may be available if Federal Government funding is granted and the

students meet certain criteria.

LLAW 3270

Introduction to China's law and legal system (4.5 units)

China has emerged as a major economic power over the last 20 years. What is less well

known is that China has also reconstructed its legal system. This topic will introduce you

to the history of China's legal system as well as the main institutions of its contemporary

legal system. The topic will examine the role and structure of the court system, and the

recruitment, training and role of the judiciary, procuracy and legal profession. China's law

making process as well as a number of important laws including civil, criminal,

administrative and constitutional laws will also be examined.

A Flinders University academic will be in residence at ECUPL for the duration of the

Chinese Law Program.

Content

The topic will be taught in English by Chinese professors from ECUPL and a Flinders

University lecturer. You will be provided with English language materials in Shanghai to

complement the lectures.

The content of the topic may include:

China's legal history

Constitutional law

Administrative law

Intellectual Property law

Criminal law and procedure

Civil law and procedure

Chinese legal personnel, including judges, procurators and lawyers

Law making

Company and contract law

The following may also be included: a Shanghai orientation tour, and visits to a court, law

firm, legal aid centre, and other cultural attractions in Shanghai.

Assessment

For those wishing to enrol in the topic for credit towards their degree, the assessment will

comprise:

Examination in Shanghai at the conclusion of the Chinese Law Program (50%) Research assignment to be submitted after students return from Shanghai (50%)

Eligibility for enrolment

Enrolment is available to current undergraduate and postgraduate law, legal studies,

commerce, business, arts and international studies students at Flinders who meet the

prerequisite requirements. Students currently studying at other universities who meet the

enrolment criteria are also welcome.

Prerequisites

The following two criteria must be satisfied:

1. 36 units of first level topics.

2. LLAW2212 The Constitution and the Australian Federation [International/

Comparative 1].

A general information session regarding off-shore electives (including China) will be held

on 15 September 2015, 12 noon in the Moot Court, Room 0.03, Law & Commerce

Building, Bedford Park.

Students interested in enrolling in the China Law Program for 2016 must then submit an

Expression of Interest by 5.00pm, 23 October 2015. If your Expression of Interest in

participating in LLAW3270 is accepted, you will be invited to enrol. The deadline for

enrolment and deposit payment is 27 November 2015. The balance of the payment is

due by 22 February 2016.

A Briefing Session prior to departure for Shanghai will be held on 9 March 2016 at Flinders

Law School. If possible this session will be recorded and uploaded on FLO. You will be

provided with the LLAW3270 Topic Guide prior to departure.

Program Dates

The Program will run from Sunday 10 - Friday 22 April 2016 inclusive. You will need to

arrive in Shanghai by Saturday 9 April 2016. A group booking of accommodation at ECUPL

will be made for the period 9 - 22 April 2016. If you intend to arrive earlier, you may need

to find your own accommodation prior to the commencement of the program.

Program fees and other costs

Program fee

The Program fee covers campus accommodation, certain meals and group activities.

Australian students enrolled as Commonwealth supported students in their undergraduate

law or other degree course will be charged the student contribution amount for the topic.

International students will be charged their normal tuition fee. In addition, there will be

a charge of AUD 1,950 to cover the cost of twin share accommodation1, ECUPL tuition,

certain meals2, transportation and admissions for visits to various sites in Shanghai, and

additional administrative expenses directly incurred.

This amount is payable in two tranches:

deposit $500 Pay by 27 November 2015

balance $1,4503 Pay by 22 February 2016

Please note that credit card is the preferred method of payment.

Note: If the Australian dollar/Chinese RMB exchange rate changes and leads to

an increase in the $1,950 charge prior to departure in April 2016, you will be

advised of the increase and will also be required to meet the additional cost.

All money paid will be returned if the topic is cancelled due to insufficient enrolments or

other reasons beyond the control of Flinders University. If you decide to withdraw your

enrolment, any money paid will be returned less 10% for administrative costs incurred up

to the time of your withdrawal.

Subsidisation of the Program fee

Application has been made to the Federal Government for New Colombo Plan Mobility

subsidisation of the Program fee. If granted, that subsidy would cover a substantial

amount of the Program fee. Please be aware however that certain age restrictions apply

to be eligible for the New Colombo Plan Mobility subsidy. For details see:

Other costs

Note: The Program fee does not include your airfare, visa, departure taxes, medical and

travel insurance, and telephone and other communication charges you may incur, or daily

living costs in China (including some meals).

Airfare

Once accepted for enrolment, you will need to organise your own travel booking. The

current average airfare from Adelaide to Shanghai return is approximately $1,000 to

$1,500 depending on when you travel and which airline you choose.

A particular flight will be recommended once enrolments are determined. Students who

travel on the recommended flight will be provided with airport transfer to and from

ECUPL. Students who arrive or depart at other times will have to find their own way to

and from ECUPL.

Visa

The current visa fee is $109.50. Provided the visa fee is paid to Flinders University by 22

February 2016, Flinders Law School will forward your passport and visa application,

together with a letter of invitation obtained on your behalf from ECUPL, to the Chinese

Embassy for approval. If you choose not to provide your passport and visa application by

22 February 2016, your letter of invitation will be forwarded to you and you will be

responsible for obtaining a visa.

Accommodation

You will learn, eat and sleep in the Guest House at ECUPL’s Shanghai Campus. Rooms are

shared (although single rooms are available at an extra cost) and have heating, linen,

blankets, and television. The rooms are serviced each day. A basic laundry service is

available at low cost. The building also has wireless access to the Internet.

Weather in Shanghai

In April in Shanghai, sunny spring days are common. The average temperature range is

between 11°C and 19°C. The day-time weather is warmer, but the daily temperature

range can fluctuate. Light rain occurs from time to time. The temperature is cooler in the

morning and night, so bring jumpers and rain proof coats. Long-sleeved shirts are

advisable for April. Summer clothes are sufficient in the middle of a sunny day in late

April. An umbrella is always handy as the weather is unpredictable.

Current passport

You will require a current passport with a minimum of 6 months validity on the day you

arrive in China including two blank pages for your visa.

You may provide your passport, a completed application form, and visa fee to Flinders

Law School by 22 February 2016.

You can apply for 2 types of financial assistance for this topic.
