INDUSTRY COMMITTEES FOR MINIMUM WAGE REVIEW
The Governor pursuant to rule-making authority under P.L. 11-22 and in accordance with 1 CMC $j 9102, 9104 (a) and 9105 hereby gives public notice of this intent to adopt regulations from the procedures of the Special Industry Committees created by P.L. 11-22. These regulations set forth the procedures to be followed by the committees in formulating their recommendation to the Legislature.
PUBLIC COMMENTS: All 'interested persons may submit written comments about the proposed amendments to the Governor's Office, Caller Box 10007, Saipan, MP 96950, on or before June 15,1999.

PROPOSED RULES REGULATIONS FOR SPECIAL INDUSTRY COMMITTEES I

1. Biennial economic report Every two years, the Governor shall direct the preparation of an economic report containing such data as
can be assembled pertinent to the cornrnittee(s) determination of an appropriate minimum wage rate
consistent with the purposes of P.L. 11-22. The Governor shall, and the Administrator of the Wage and
Hour Division, US Department of Labor may, submit to the committee(s) from time to time economic and
statistical data pertinent to the matters to be considered by the committee(s). Copies of the economic
report will be promptly provided to the committee(s). The committee may conduct further investigation,
gather additional pertinent data, and hold any hearings it may deem necessary or helpful to gather further
information and public comment. The Governor shall furnish the committee with necessary staff to
complete the required economic report and to advise the Committee(s) on issues of law.
2. Public hearings. (a) The committee(s) may hold public hearings and take testimony, oral and written, to gather additional
information and public comment to assist in making its recommendation to the Legislature.
(b) The public notice for such a hearing shall give reasonable notice of: J
\ (1) the time and place of the commencement of the hearing of such witnesses and receiving of such
evidence as may be necessary or appropriate to enable the committee to perform its duties under P.L. 11-
(2) the general nature of the proceedings and the subjects and issues involved; and
(3) that all members of the public will have an opportunity at the hearing to present oral and written
testimony, as well as any data or information for the Committee's consideration
3. Committee Report to the Legislature Following receipt of economic report required in Section 1 of these regulations, and the conduct of any
public hearings the committee(s) holds, the Committee shall prepare a written report to the Legislature
including its recommendation for minimum wage rates, as provided by statute. If the Committee is unable
to reach agreement on its recommendation as provided by the statute, the Committee shall report to the
Legislature on its findings, activities, the different recommendations considered by the Committee, and the
number of votes forthe different recommendations.
4. Compensation of Committee Members. The members of the committee(s) shall serve without salary, but shall be entitled to compensation pursuant
to 1 CMC $8247.

I. REQUIRED DOCUMENTS: The following documents must be submitted prior to the review and granting of a license to sell tobacco and tobacco products in the Commonwealth:
1. Tobacco Control License Application; 2. Current Police ClearancelCriminal Record; 3. List of names of employees or agents authorized to sell tobacco items (must be
18 years or older) with a valid photocopy of their official identification; 4. Public Health Sanitation Permit (if applicable for other business purposes); 5. Copy of Business License; 6. Copy of Lease or Rental Agreement, or Title or Deed (if a property owner); 7. Map of exact business location, and; 8. Payment receipt (Application Fee of $5.00, and License Fee depending on
license sought by the applicant).
I II. GRANT OR DENIAL OF LICENSE: Following receipt of the necessary documents,
a thorough inspection will be conducted by the Alcoholic Beverage and Tobacco Control Division ("ABTC"). The ABTC shall, through the Secretary of Commerce, issue a decision, upon findings and adequate investigation, whether to grant or disapprove an application within fifteen days. If disapproved, the person aggrieved by such a denial shall be entitled to a review of the decision pursuant to the Administrative Procedure Act, provided the person so aggrieved provides a written appeallrequest for a hearing to the Secretary of Commerce within thirty days of the receipt of the notification of denial.
Ill. ABSOLUTE PROHIBITION ON ISSUANCE: The Department of Commerce, Alcoholic Beverage and Tobacco Control Division, shall not issue a license of any class to any applicant that falls into one of the following restrictions:
(a) The applicant is not the real party in interest;
(b) The applicant is under eighteen (1 8) years of age;
{c} Except in the case of a license revoked for non-payment of the renewal fee, the applicant is a person or establishment that held a tobacco license of any class that was revoked within the prior year by the Department of Commerce, Alcoholic Beverage and Tobacco Control Division.
(d) The applicant is a retail establishment located within a distance of 300 feet from
I any public or private school building.

IV. REQUIRED SIGNS: Any business applying for a license to sell any tobacco product andlor preparation shall clearly and conspicuously post signs reading:
"TOBACCO SALES PROHIBITED TO PERSONS UNDER THE AGE OF 18"
next to any cash register or any other place(s) where such items may be purchased. These sign(s) shall be at least eleven (1 1) inches by eight and one-half (8.5) inches in dimension, and the letters on said sign(s) shall be printed in a bright color, with large, capitalized letters, printed in a plain, easily read font or lettering style.
V. CONDITION OF PREMISES: All applicants must have an English written billboard (sign board) mounted or displayed outside the business premises as indicated on the proposed (d.b.a.) on the application form. Retail establishments shall ensure that cigarettes are displayed behind a glass partition and any other tobacco products behind the cashier's counter or in a locked cabinet that can be opened only by the owner or an agent of the retail establishment. In addition, the sale of cigarettes from vending machines is prohibited unless the vending machine is located in a bar, cabaret, or any enclosed establishments for which the minimum age for admission is eighteen (18) years. All licenses issued shall at all times be conspicuously posted and exposed to view for inspection on the licensed establishment.

PROPOSED RULES AND REGULATIONS TO THE MUSEUM'S ADMISSION FEES
The Board of Governors of the Commonwealth of the Northern Mariana Islands, pursuant to its rule making authority under 2CMC$4474(b) and (1) and in accordance with the provisions of lCMC$9102, §9104(a) and $9105, hereby gives notice to the general public of its intention to include regulation on a group rate to the Museum's schedule of admission fees. Title 2CMC§4874(1) provides that the Commonwealth Museum, through its Board of Governors, may impose and collect reasonable fees for the use of the Museum's facilities and to view its collections. The proposed inclusion to the schedule of fees for admission into the Museum is herewith published.
All interested persons may examine the proposed regulation and submit written comments, position, or statement for or against the proposed regulation to the Executive Director, Commonwealth of the Northern Mariana Islands Museum of History and Culture, Caller Box 10007, Saipan, MP 96950, no later than thirty (30) calendar days following the date of publication of this Notice in the Commonwealth Register.

The Commonwealth Ports Authority proposes to make further amendments to its Airport Rules and Regula- tions with respect to the Schedule of Fees and Charges, pursuant to its rule-making authority under 2 CMC
2122U) and 1 CMC § 9102,9104(a), and 9105.
The amendments being proposed to the Airport Division Schedule of Fees and Charges would increase the fuel flowage fee (Part 12.8), increase the ground handling permit fee (Part 12.9), impose a taxicab permit fee (new Part 12.14), and institute a public parking fee (new Part 12.15) The proposed amend- ments would provide additional revenue needed for airport operations and generate additional revenue needed to senrice the debt payments required to be made under the Airport Revenue Bonds 1998 Senior Series A indenture agreement.
The proposed amendments would increase the fuel flowage fee from 1 '/a cents to 2 Ya cents per gallon; would increase the ground handling fee from $5,000 per calendar quarter to $10,000 per calendar quarter; would impose a taxicab permit fee of $25.00 per month per vehicle; and would institute a public parking fee at the airports.

OF THE AIRPORT RULES AND REGULATIONS
The Commonwealth Ports Authority, pursuant to its rule-making authority under 2 CMC § 2122U), and in accordance with the provisions of 1 CMC 8 9102, 9104(a), and 9105, hereby gives public notice of its intention to make further amendments to Part 12 (Schedule of Fees and Charges) of the Airport Rules and Regulations. The proposed amendments would increase the fuel flowage fee set forth in Part 12.8, increase the ground handling permit fee set forth in Part 12.9, impose a taxicab permit fee (new Part 12.14), and institute a public parking fee (new Part 12.15). The proposed fees would enable the Authority to generate additional revenue to service the debt payments required to be made under the Airport Revenue Bonds 1998 Senior Series A indenture agreement, and to adequately meet airport operation and maintenance expenses.
All interested persons may examine the proposed amendments and submit written comments, position, or statement for or against the proposed amendments to the Executive Director, Commonwealth Ports Authority, Saipan International Airport, P. 0. AIRPORT RULES AND REGULATIONS
Part 12: Schedule of Fees and Charges of the Airport Rules and Regulations is hereby amended by the Commonwealth Ports Authority as follows:
1. Part 12.8 pertaining to Fuel Flowage Fee shall hereafter read:
12.8 Fuel Flowage Fee
A fee equal to one and one-half cents (0.015) for each gallon of aviation gasoline and jet fuel delivered to the Airport is hereby imposed. Effective July 1, 1999, the fuel flowage fee shall increase to two and one-half cents ($0.025) per gallon. The fuel flowage fee shall be paid by the seller thereof, upon the delivery of aviation gasoline and jet fuel to the Airport. The seller shall deliver to the Authority, no later than the 1 5 t h day of every month, the fuel flowage fee payable for deliveries made to the Airport during the previous month, together with appropriate documentation evidencing such fuel deliveries.
2. Part 12.9 pertaining to Ground Handling Permit shall hereafter read:
12.9 Ground Handling Permit Fee
The fee for a ground handling permit shall be FIVE THOUSAND DOLLARS (U.S. $5,000.00) per calendar quarter. Effective July 1, 1999, the ground handling permit fee shall increase to TEN THOUSAND DOLLARS (US. $10,000.00) per calendar quarter.

3. A new Part 12.14 imposing a Taxicab Operator Permit Fee is hereby promulgated to read as follows:
12.14 Taxicab Operator Permit Fee
All taxicab operators authorized by the Executive Director to operate a taxicab at the airport shall pay a monthly taxicab permit fee of $25.00 per vehicle, payable upon issuance of the taxicab permit.
No vehicle or taxicab may operate a t the airport without a valid taxicab decal issued by the Authority on an annual basis. This fee shall become effective July 1, 1999.
4. A new Part 12.15 instituting a Public Parking Fee is hereby promulgated to read as follows:
12.15 Public Parking Fee
All vehicles owned by members of the general public shall park their vehicles in designated public parking areas, and shall pay a public parking fee, as follows:

Each additional hour (or fraction of an hour) ................................................. $1.00

No fee is imposed for CPA vehicles, for vehicles owned by CPA employees and officials, for car rental vehicles, and for CNMI Government vehicles.
The foregoing Public Parking Fees shall become effective July 1, 1999.

The Rules and Regulations of the Commonwealth of the Northern Mariana Islands Board of Elections governing the conduct of elections of the Commonwealth of the Northern Mariana Islands, as promulgated by the Board of Elections, is hereby amended as follows:
1. Section 3 of Part VII of the Rules and Regulations pertaining to the conduct of elections is amended to read as follows:
Section 3. Any person appearing at the polling place to vote shall report his legal name, in full, and his date of birth to the election officials. An election official shall clearly and audibly announce them. Another election official shall then check the register of voters as to whether or not the person appearing is a registered voter, and if so, shall announce the name and date of birth appearing in the register. Voting shall then proceed in accordance with procedures prescribed by the Board, however, all voting shall be by secret ballot.
Each qualified voter whose name appears on the register has a right to vote and shall not be denied a ballot. The Board shall not hear any challenges to a voter's residency or qualification to vote in any election at any time.
Any challenge to a voter's residency or qualification to vote in any election shall be deemed an election contest and shall be resolved pursuant to applicable CNMl law.

AMENDMENTS TO DEVELOPER TAX REGULATION NO. 1600
The Secretary of Finance hereby adopts the amendments to the Developer Tax Regulations No. 1600 which were published in the March 18, 1998, Commonwealth Register, Volume 21, Number 03, pages 16621-16626. The Amendments to Developer Tax Regulation No. 1600 are promulgated by virtue of the authority and directions given to the Secretary of Finance as set forth in the Commonwealth Code 1 CMC $2553, 1 CMC $2557, 4 CMC $1946, and the Commonwealth Administrative Procedures Act, 1 CMC $9 10 1 et seq.
The Amendments to the Developer Tax Regulation No. 1600 provide procedures and provisions for the enforcement of Public Law 8-23, the Developer Tax Act of 1993, Public Law 9-14, an amendment to Public Law 8-23, and Public Law 11-37, p amendment to Public Law 8-23. Public Law 11-37 provides for revised requirements for the issuance of an occupancy permit for large development projects. No comments to these amendments were received. No changes were made to the Amendments to the Developer Tax Regulation No. 1600. Copies of these Amendments to the Developer Tax Regulation No. 1600 may be obtained from the Office of the Secretary of Finance, located at the Joeten Commercial Building, Dan Dan or by mail at P.O. Box 5234, CHRB, Saipan, MI? 96950.
The Amendments to the Developer Tax Regulation No. 1600 become effective on May 29, 1999.

The Marianas Visitors Authority Chairman and Managing Director notifies the Public that MVA has adopted the amendments to the Vendor Site Regulations, which were published in the Commonwealth Register Volume 21, Chapter 2, dated February 18, 1999.
