    Committee Report Nr. EDUC-2015-004

    Letter dated 15 April 2015 of Dr. Ronaldo A. Paraan and Bishop Carlito J. Cenzon, Chairman and Treasurer

    respectively of the Baguio Heritage Foundation, Inc., reiterating among others their request to hold in abeyancethe ongoing fencing and improvement of the City Hall grounds until the National Historical Commission of the

    Philippines ( NHCP) responds to their letter dated 14 April 2015.

    The Committee on Education, Culture and Historical Research recommends that the matter be NOTED

    in the light of the "cease and desist order" issued by the National Commission on Culture and Arts

    (NCAA) on June 3, 2015, the fact that works in the project had to stop notwithstanding the issuance by the

    NHCP of a letter manifesting no objection to the same and the actions the city has taken to set aside the

    cease and desist order and to further clarify procedures that seem to have caused confusion and

    misunderstanding on a matter or area of supposed common interest and cooperation.

    2a. Committee Report Nr. EDUC-2015-007Proposed Resolution Nr. PR 0047-15 introduced by Hon. Edison R. Bilog co-authored by Hon. Isabelo B.Cosalan Jr. entitled, "Requesting the National Commission for Culture and Arts and the various cultural agencies

    attached to said office to coordinate with the City Government of Baguio for its information and guidance beforethe declaration as Historical and Cultural Heritage Sites any place, location or building in the City of Baguio."

    The Committee on Education, Culture and Historical Research recommends that the matter be NOTED

    without prejudice to any proper or appropriate action that may be taken after a final resolution of the

    case relating to the suspension of the implementation of the fencing and improvement of the City Hall

    ground as per "cease and desist order" from the National Commission on Culture and Arts (NCCA) that

    is being sought by the city to be reconsidered.(Item 2a, 10 August 2015 Agenda)

    2b. Committee Report Nr. EDUC-2015-006Oral motion of Hon. Betty Lourdes F. Tabanda as amended during the 13 April 2015 Regular Session torefer to the Honorable City Mayor and the Committee on Education, Culture and Historical Research all

    issues raised during the discussion of the ongoing construction project at the City Hall ground which was

    declared as one of the national heritage sites of the Philippines.

    The Committee on Education, Culture and Historical Research, taking into consideration developmentsfollowing the issuance by the National Commission on Culture and Arts (NCCA), particularly the

    manifested no objection by the National Historical Commission of the Philippines (NHCP) on the

    implementation of the subject project that is seen to provide factual understanding in the resolution of the

    pending motion for reconsideration filed by the city with the NCCA to lift the cease and desist order,

    recommending that all issues arising from the deliberations of the Council be simply NOTED.

    For clarification though, committee recommends to further note in advance the following observations, to

    wit:

    1. City Hall was marked as an important cultural property in 2009 as shown from the list submitted

    by Atty. Ludovico D. Badoy, Executive Director III of the National Historical Commission of the

    Philippines, in compliance to the request made by the city for the same; from the said list, only

    Mansion House will appear as a declared historical landmark or cultural property in the city;

    2. Burnham Park is not a declared heritage site as stated in the letter of Dr. Ronaldo A. Paraan of 29

    April 2015. The letter of Atty. Badoy of 17 April 2015 to the Honorable City Mayor referred to in

    the letter of Dr. Paraan was merely to inform the city that the National Historical Commission of

    the Philippines has recognized the national historical significance of the park that it will be

    installed with a historical marker, the text of which was attached to the letter received by the cityfor information;

    3. It is hoped that the resolution of the motion for reconsideration filed by the city with the NCCA

    will also resolve all other issues, including the scope or limitation of restrictions or protection

    under the heritage act and the need of environment impact under Presidential Decree No. 1586,

    that arose in the deliberations that were all aimed for the protection and conservation of national,

    as well as, city cultural heritage for a clearer understanding and interpretation of the provisions

    and processes of Republic Act 10066, better known as the "National Cultural Heritage Act of

    2009".

    3. Committee Report Nr. EDUC-2015-003Letter dated 29 April 2015 of Dr. Ronaldo A. Paraan, Chair, Baguio Heritage Foundation, Inc., regarding

    the declaration of Burnham Park as national heritage site by the National Historical Commission of the

    Philippines. Attached is the letter dated April 17, 2015 of Executive Director Ludovico D. Badoy,National Historical Commission of the Philippines, informing among others that the Commission has

    recognized the national historical significance of Burnham Park.

    The Committee on Education, Culture and Historical Research recommends that the letter be

    returned to the Baguio Heritage Foundation, Inc. for the simple reason that the information

    intended to be relayed, that is the declaration of Burnham Park as a national heritage site, is not

    accurate as will be noted in the attached letter of Executive Director Ludovico B. Badoy of the

    National Historical Commission of the Philippines (NHCP) which simply mentions of the NHCP

    recognizing the national historical significance of Burnham Park through a proposed installation of

    a historical marker. The Committee thus further recommends that the Baguio Heritage Foundation

    be requested to clarify the declaration of Burnham Park as a national heritage site it manifested or

    to otherwise provide the Sanggunian a copy of the appropriate resolution or document showing

    such declaration as to merit further action on the matter.(Item 3, 10 August 2015 Agenda)

    4. Committee Report Nr. LAWS-2014-0041st Indorsement dated 18 November 2013 of the Office of City Mayor Hon. Mauricio G. Domogan,

    forwarding for information and appropriate action the Supplemental Memorandum of Agreement between

    the City Government of Baguio represented by Hon. City Mayor Mauricio G. Domogan and R & R

    Management and Sanitary Services represented by its General Manager, Ruperto V. Alvar, for theproposed putting up of comfort room at Block 4, Baguio City Public Market.

    The Committee on Laws recommends confirmation of the above stated Supplemental Memorandum

    of Agreement.(Item 4, 10 August 2015 Agenda)

    5. Committee Report Nr. UPLH-2014-010SECOND READING BEFORE PUBLICATION

    Proposed Ordinance Nr. PO 0038-14 authored by Hon. Leandro B. Yangot Jr. entitled, "Requiring allpersons operating or doing business within the territorial jurisdiction of the City of Baguio for the

    mandatory submission of environmental sustainability action plan upon securing or renewing business

    and/or Mayor's permit and providing penalties for violations thereof."

    (NOTE: [a] FIRST READING - 09 June Regular Session [Agenda Item Nr.78]; and

    [b] Rule IV, Sec. 2A of the Internal Rules of Procedures states "On second reading before publication of anordinance shall be open for discussion, proposals and amendments to know whether or not the proposed ordinance

    will be approved before publication. Amendments may be allowed prior to publication.")

    The Committee on Urban Planning, Lands and Housing recommends APPROVAL of the above

    proposed ordinance on SECOND READING BEFORE PUBLICATION.

    Hon. Joel A. Alangsab, Member of the Committee, signified "clarifications on some issues".

    6. Committee Report Nr. LAWS-2014-0403rd Indorsement dated 17 July 2014 from the Office of the Honorable City Mayor Mauricio G. Domogan,forwarding to the Hon. Vice Mayor Edison R. Bilog, inviting attention to the advice of the Legal Office,

    for information and appropriate action on the 2nd Indorsement dated 16 July 2014 of Atty. Melchor Carlos

    R. Rabanes, OIC- City Legal Office, Re: Draft Memorandum of Agreement (MOA) on the Program to

    Grant the Sale of Rice on Credit between the National Food Authority and the City Government ofBaguio.

    The Committee on Laws recommends that a City Council Resolution be adopted to authorize the

    Hon. Mayor Mauricio G. Domogan, to enter into the above stated Memorandum of Agreement in

    behalf of the City Government.(Item 6, 10 August 2015 Agenda)

    7. Committee Report Nr. LAWS-2014-041Oral motion of Hon. Leandro B. Yangot Jr. during the 14 July 2014 Regular Session requesting theCommittee on Laws to look into the pending issue whether or not resolutions should be signed by the

    City Mayor.

    It has always been the position of the Committee on Laws that Resolutions may or may not be

    signed by the City Mayor considering that these Resolutions are used as vehicles for legislative

    action and to express the sentiment of the City Council on important public policy issues.

    To put the matter into rest, the Committee on Laws recommends that the word "APPROVED" by

    the City Mayor, which appears in the final form of the Resolution, be changed to "NOTED" by the

    8. Committee Report Nr. LAWS-2014-044Letter dated 11 July 2014 of Ms. Pita S. Picpican, USTD, DOST USTC-Baguio to Honorable City Mayor

    Mauricio G. Domogan, furnishing a copy of the signed and notarized Memorandum of Agreement for theeffective collaboration between DOST-CAR, DILG-CAR and the City Government of Baguio in support

    of the Science and Technology for the Enhancement and Advancement of Municipalities/Cities (STEAM).

    The Committee on Laws recommends confirmation of the above stated Memorandum of

    9. Committee Report Nr. TOURISM-2014-019Letter dated 12 August 2014 of Ms. Cordelia C. Lacsamana, City Environment and Parks ManagementOfficer, City Environment and Parks Management Office to Hon. City Mayor Mauricio G. Domogan,

    forwarding for adoption, approval and as basis for funding purposes the Master Development Plan of the

    Baguio Centennial and Botanical Park prepared by Saint Louis University, School of Engineering and

    Architecture, Department of Architecture Engineering Urban Planning Research Laboratory withArchitect Maria Criselda Perez-Soriano as Project Coordinator and Architect Joseph M. Alabanza,

    Environmental Planner as the Principal Consultant.(NOTE: Res. No. 152, s. 2014 requested the City Environment and Parks Management Office to submit thedevelopment plan of the Botanical Garden to the Sangguniang Panlungsod (City C ouncil), among others.)

    The Committee on Tourism, Special Events, Parks and Playgrounds recommends that the

    aforementioned Master Development Plan of the Baguio Centennial and Botanical Park be

    approved and adopted. The committee further recommends that this be included among the priority

    projects of the city to be funded for the Year 2015.(Item 9, 10 August 2015 Agenda)

    10. Committee Report Nr. HEALTH-2014-010Proposed Resolution Nr. PR 0113-14 introduced by Hon. Betty Lourdes F. Tabanda entitled, "Urging theCongress of the Philippines, through the Hon. Nicasio M. Aliping Jr. to initiate the repeal of RA 4653, or

    'An act to safeguard the health of the people and maintain dignity of the nation by declaring it a national

    policy to prohibit the commercial importation of textile articles commonly known as used clothing andrags."

    The Committee on Health and Sanitation, Ecology and Environmental Protection recommends

    APPROVAL of the above proposed resolution.(Item 10, 10 August 2015 Agenda)

    11. Committee Report Nr. MARKET-2014-010Proposed Resolution Nr. PR 0111-14 introduced by Hon. Leandro B. Yangot Jr. entitled, "Calling on His

    Excellency President Benigno S. Aquino III, President of the Republic of the Philippines, to spare the

    "ukay-ukay" or "wag-wag" business in the City of Baguio from the crackdown being done by the Bureau

    of Customs."

    The Committee on Market, Trade and Commerce suggests that the resolution be subjected to

    further discussion to consider the following:

    1. Setting the rules or guidelines on what resolutions or matters are to be forwarded to the attention

    of the Office of the President or to the President directly;

    2. Directing the resolution instead to the Bureau of Customs to protest the action;

    3. Forwarding a copy of the resolution to be finalized to the Hon. Nicasio M. Aliping Jr.,

    Congressman, Baguio City, to support his announced intention to call for an inquiry by the House

    of Representatives on the action taken by the Bureau of Customs;

    4. Adoption of a resolution urging or asking Congress thru the Office of Congressman Nicasio M.

    Aliping Jr. for the amendment or repeal of Republic Act No. 4653 (An Act to Safeguard the

    Health of the People and Maintain the Dignity of the Nation by Declaring it a National Policy toProhibit the Commercial Importation of Textile Articles Commonly Known as Used Clothing and

    Rags) as reported being proposed by the Hon. Betty Lourdes F. Tabanda which should include

    repeal or amendment also of similar or related laws like the provision of the Implementing Rules

    and Regulations of PD 856 (Sanitation Code of the Philippines) Section 8.9.1 which consider as

    other types of nuisance the distribution or sale of articles such as clothes, shoes, linens, towels,

    bedding materials, blankets, pillows, and anything used for sleeping or resting, which are second

    hand or made of second hand materials that are offered for sale to the public.

    11a. Committee Report Nr. MARKET-2014-014Proposed Resolution Nr. PR 0120-14 introduced by Hon. Betty Lourdes F. Tabanda and Fred L.

    Bagbagen entitled, "Supporting House Bill No. 4055, 'An act legalizing the importation of second-hand or

    used clothing and rags into the Philippines, repealing, for that purpose, Republic Act 4653, otherwiseknown as 'An act to safeguard the health of the people and maintain dignity of the nation by declaring it a

    national policy to prohibit the commercial importation of textile articles commonly known as used

    clothing and rags'."

    The Committee on Market, Trade and Commerce recommends APPROVAL of the above statedproposed resolution.

    Hon. Peter C. Fianza, Member of the Committee signified, "with certain concerns for discussions." (Item 11a, 10 August 2015 Agenda)

    12. Committee Report Nr. EMPLOY-2014-016Proposed Resolution Nr. PR 0103-14 introduced by Hon. Isabelo B. Cosalan Jr. entitled, "Requesting the

    Office of the Honorable Nicasio M. Aliping Jr., Representative of the Lone District of Baguio City toallocate or source out funds in the amount of Ten Million Pesos (Php10,000,000.00) for the construction

    of a Baguio City Livelihood and Entrepreneurial Development Center Building for micro entrepreneurs

    and barangay-based livelihood groups in the City of Baguio."

    The Committee on Employment, Livelihood, Cooperatives and Persons With Disabilities (PWD),

    recommends APPROVAL of the above proposed resolution.(Item 12, 10 August 2015 Agenda)

    13. Committee Report Nr. HEALTH-2014-011Proposed Resolution Nr. PR 0052-14 introduced by Hon. Peter C. Fianza entitled, "Requiring the

    submission of a feasibility study as a matter of course in the evaluation of proposed waste managementtechnologies to the city."

    The Committee on Health and Sanitation, Ecology and Environmental Protection recommends

    15. Committee Report Nr. UPLH-2014-014Proposed Resolution Nr. PR 0128-13 introduced by Hon. Vice Mayor Daniel T. Farias entitled,

    "Requesting the Office of the Solicitor General to file the appropriate case/s for the declaration of the

    nullity of Original Certificate of Titles No. 018-0-162 and all its derivative titles issued by the Register of

    Deeds of Baguio City covering portions of Busol Forest Reservation in Baguio City, including the filingof the appropriate administrative and/or criminal charges against all those responsible in the issuance of

    the said titles."

    The Committee on Urban Planning, Lands and Housing deems it proper to adopt the legal opinion

    forwarded by OIC-City Legal Officer contained in his 5th Indorsement dated 18 August 2014 that

    the proposed resolution has to be passed considering its urgency.

    Attached is a copy of the 5th Indorsement of Atty. Melchor Carlos R. Rabanes, OIC-City Legal

    Office, Baguio for the information, guidance and consideration of the Honorable Members of the

    City Council.

    In view thereof, the Committee on Urban Planning, Lands and Housing reiterates its previous

    recommendation for the approval of the above proposed resolution with the committee members as

    16. Committee Report Nr. WAYSA-2014-044Proposed Ordinance Nr. PO 0055-14 introduced by Hon. Vice Mayor Edison R. Bilog, Hon. Elaine D.Sembrano, Hon. Joel A. Alangsab, Hon. Fred L. Bagbagen and Hon. Peter C. Fianza entitled,

    "Appropriating the amount of P10,000,000.00 or so much thereof for the construction of a collapsible

    parking facility in the City of Baguio."

    Hon. Faustino A.     The Committee on Ways and Means and Finance, Cluster A, recommends that the above mentioned

    proposed ordinance be APPROVED on SECOND READING. (Item 16, 10 August 2015 Agenda)

    17. Committee Report Nr. HEALTH-2014-014Proposed Resolution Nr. SCOFAD 14-14 of Hon. Senior Citizen Councilor Adoracion N. Rulloda

    entitled, "Requesting the City Government of Baguio to encourage all residents of Baguio to plant

    flowering plants and flowering trees such as bougainvillas, sunflowers, fire trees etc. along both sides of

    roads, streets and highways of Baguio to enhance the title of Baguio as the City of Flowers."

    The Committee on Health and Sanitation, Ecology and Environmental Protection suggests to

    change the title of the above to read anew and hence shall be entitled as "Encouraging the residents

    of Baguio to plant flowering plants and trees such as bougainvillas, sunflowers, fire trees, etc. along

    the sides of the streets, roads and highways within the city's jurisdiction to project Baguio as theCity of Flowers", so that the tenor of the proposed resolution be more direct to the citizenry, and

    thus recommends APPROVAL of the proposal.(Item 17, 10 August 2015 Agenda)

    18. Committee Report Nr. HEALTH-2014-015Proposed Resolution Nr. SCOFAD 09-14 of Hon. Senior Citizen Councilor Jane A. Tayab entitled,"Strongly endorsing organic backyard gardening to augment the nutritional needs of the elderly and the

    family."

    The Committee on Health and Sanitation, Ecology and Environmental Protection recommends

    APPROVAL of the above proposed resolution.(Item 18, 10 August 2015 Agenda)

    19. Letter dated 17 October 2014 of Hon. Vice Mayor Edison R. Bilog, seeking clarification pertaining toResolution No. 224, series of 2014.

    "Urging the Department of Transportation and Communications (DOTC), Land Transportation Office(LTO) and the Land Transportation Franchising and Regulatory Board (LTFRB) to strictly implement

    their policy of not registering or non-renewal of registration of motor vehicles without showing actual

    proof of the presence of a garage by its owner."

    The Committee on Public Utilities, Transportation and Traffic Legislation recommends approval of

    the proposed resolution and the same be forwarded to the Offices of Department of Transportation

    (NOTE: The above matter is related to the letter dated 28 April 2014 of Atty. Elenito M. Bagalihog, Chief,Water Rights Division, National Water Resources Board, requesting the following:

    a. that the Notice/s of Water Permit Application of Bases Conversion and Development Authority at HappyHallow, Greenwater and Hillside Barangays be posted on the bulletin board of the office concerned andshall remain posted for a period of thirty (30) days from receipt hereof; and

    b. issuance of a certification that it was posted pursuant to the rules. This was referred to the Committee

    on Public Utilities, Transportation and Traffic Legislation on 18 June 2014.)

    City of Baguio on the basis of religion, ethnicity, sexual orientation and gender identity, health status,disability, and age providing penalties for violation thereof and for other purposes."

    (NOTE: a] FIRST READING - 02 September 2013 Regular Session [Agenda Item Nr. 12]; and

    b] Rule IV, Sec. 2A of the Internal Rules of Procedures states "On second reading before publication of an

    34. Committee Report Nr. HEALTH-2014-017Letter dated 14 November 2014 of Dr. Minda S. Manantan, Executive Director, National Meat InspectionService, Quezon City, seeking cooperation in ensuring the safety of meat consumers during this holiday

    season and submitting copy the handbook on Meat Regulations which will help the Sanggunian in the

    adoption of local ordinances in regulating meat trade.

    As contained in the letter, it requests the City Government of Baguio to:

    "1. Direct your personnel involved in market regulations for heightened visibility and

    enforcement of applicable regulations in particular AO 5 and AO 6 which provide for thehygienic handling of meat in the markets:

    . Sale of frozen meat is NOT allowed in the market when the stall is not equipped with

    temperature controlled storage (freezer, chillers, refrigerators, etc.);

    . Prohibit entry and sale of "hot meat" (those not coming from legitimate slaughterhouses

    and did not pass government inspection);

    . Confiscate "botcha" or meat from double dead animals.

    2. Display tarpaulins and posters calling for consumer vigilance (provide consumer

    complaint hotlines or contact numbers)".

    Considering that the holiday season is already underway, the Committee on Health and Sanitation,

    Ecology and Environmental Protection recommends APPROVAL of the request of the National

    Meat Inspection Service (NMIS), and refer the matter to the City Mayor's Office for appropriate

    action. The different instrumentalities of the City Government of Baguio who shall be charged to

    oversee and implement the foregoing and apposite ordinances and national laws regarding food

    46. Committee Report Nr. EDUC-2015-002Proposed Resolution Nr. PR 0059-15 introduced by Hon. Vice Mayor Edison R. Bilog entitled,

    "Requesting the Commission on Higher Education (CHED), through Secretary Luistro for the immediaterelease of the educational benefits of the family members of the SAF 44."

    The Committee on Education, Culture and Historical Research recommends discussion en banc of

    the proposed resolution to consider the following observations, to wit:

    1. While DepEd Secretary Armin A. Luistro was directed by the President to assist in

    providing the relatives and families of the SAF 44 also with college educational benefits,

    the program that was identified and coordinated for the purpose is with the Commission

    on Higher Education (CHED) that the request may have to be directed to CHED

    Chairperson Dr. Patricia B. Licuanan;

    2. The financial assistance that may be extended will be in the form of a scholarship in which

    dependents may be found to qualify to or a grants-in-aid or "Tulong Dunong" of

    P12,000.00 each under the Student Financial Assistance Program (STUFAPS);

    3. The release of the financial assistance or benefit will therefore be in accordance with the

    scholarship program to which the dependent may qualify to or with the "Tulong

    Dunong" program;

    4. To avail of the benefits, dependents will have to file their respective applications with the

    Regional Offices of CHED where they reside which will collate all the applications and

    transmit the same to the central office of the CHED;5. In the Cordillera Administrative Region (CAR), eight (8) of the nine (9) applications were

    transmitted to the central office on May 28, 2015. The last application that was

    accordingly received recently was likewise transmitted to the CHED, also recently;

    6. It will further appear that the processing of the applications will require the applicant to

    first enroll in a chosen school. His enrolment form and a certification of enrolment will

    then have to be submitted to the CHED. In short, the financial assistance will be in the

    nature of a reimbursement;

    7. The immediate release of the financial assistance to the dependents of SAF 44 will not

    therefore be in accordance with the CHED system or program which the Committee finds

    will be destructive to the cause of SAF 44 for reasons that need not be mentioned;

    8. The financial assistance being provided by the CHED is in addition to educational aids or

    grants being provided the dependents of the SAF 44, including from funds being
