MESSAGEThe Twelfth Congress was born following a period of politicalupheaval and deep social divisions, and amid uncertainty about the

future.Challenged by these difficult circumstances, we in the House of

Representatives carried a torch for national unity—and a commitmentto get our nation moving again to bring palpable developments to thelives of Filipinos.

The reforms we sought did not come about easily. There wereepisodes of crisis that we weathered, and times of great necessitywhen we stood our ground to keep the country on an even keel. Andeach time, we moved away from acrimony and discord to build astrong consensus on the issues that matter most.

We crafted, deliberated and approved a total of 1,128 measures inthe chamber—a proud legacy perhaps unmatched in our legislativehistory. The national bills were part of a wide-ranging and far-reachingeconomic, political and social platform we initiated in response to theurgent needs of our people.

Foremost of those reform measures are the Special PurposeVehicle Act and Securitization Act, both intended to finance therequirements of economic recovery; the Government ProcurementReform Act, aimed at dramatically reducing government corruption;the amended Dangerous Drugs Act, the toughest anti-drug law in Asiaalready responsible for the destruction of billions of pesos worth ofmajor shabu laboratories in the country; the Dual Citizenship Act andAbsentee Balloting Act that allowed qualified overseas Filipinos tocast their vote for the first time in a national election; and theAlternative Dispute Resolution Act, aimed at unclogging the courtdockets of close to a million unresolved cases.

With pride and humility, we offer to the Filipino people the fruitsof our legislative labors. We did our best—yet we know much remainsto be done, beyond the lifetime of the Twelfth Congress, to lift up ourpeople’s lives and win the battle against poverty and terrorism.

Three years ago at the inauguration of the Twelfth Congress, theMembers of the House of Representatives pledged to get this

nation moving again—to lift the pall of gloom and doom that oppressedthe national life—and craft a strategy to fight off the twin scourges ofterrorism and poverty.

Speaker Jose de Venecia framed the House’s historictask when he stated, “we must make good our claim thatpolitics is not about winning elections—but aboutmaking governance work for our people.” A House longin vision and achievement and decisive in action waspromised, in order to make a difference in our people’slives.

At the close of the Twelfth Congress, the House ofRepresentatives is proud of what it has achieved, with theapproval of vital legislative measures supportingPresident Gloria Macapagal-Arroyo’s medium and long-

term national agenda to fight poverty, maintain peace and order andpromote a strong republic.

A record number of House bills approvedThe House of Representatives of the Twelfth Congress approved on

third and final reading a total of 1,128 bills, the highest number ever inPhilippine legislative history. However, only 139 of these bills becamelaws of the land—a tragic illustration of paralysis and gridlock in abicameral Senate-House legislature.

Still, the House takes pride in its comprehensive andwide-ranging reform program of legislation. Thechamber initiated meaningful economic, social, politicaland electoral reforms to strengthen Philippine recovery,battle the illicit drug trade, and confront terrorism behindan alliance of nations in Southeast Asia.

Landmark reform lawsA number of reform-oriented measures were enacted

into law.

The Government Procurement Reform Actpromotes transparency and good governance in

government procurement of public works, supplies and services. Thisnew law encourages a shift to electronic commerce in governmentprocurement, greatly reducing graft and corruption in the public sector.

The Special Purpose Asset Vehicle (SPAV) Act is designed tostimulate the sluggish housing and real estate industries, rehabilitatedistressed businesses and enable the country’s banks to solve theiralmost 500 billion pesos of non-performing loans and foreclosed realestate mortgages.

The Securitization Act, the companion bill to the SPAV, aims todevelop capital market instruments such as asset-backed securities toraise domestic savings and finance investment growth.

The Anti-Money Laundering Act, which ensured Philippinecompliance with the strictures of the Financial Action Task Force, nowassures the steady inflow of dollar remittances from Filipino overseasworkers averaging 7 billion dollars annually.

The Removal of Documentary Stamp Taxes (DST) on SecondaryTrading Transaction rationalizes the coverage of documentary stamptaxes, projecting incremental revenue generation of P7.86 billion for thegovernment while removing the key impediment to increased volumeof trading in the secondary capital markets.

The Act Restructuring the Excise Tax on Automobiles removesthe bias against smaller cars with a seating capacity of less than ten (10)passengers. This law is expected to generate additional governmentrevenues of up to 1.4 billion pesos.

Jumpstarting the economyThis House gave priority to rural development and agricultural

modernization, support for the country’s service industries, andprotection of our natural heritage.

The 747 Economic Action Plan unveiled in 2001 bySpeaker Jose de Venecia as a strategy to defeat povertywas adopted by President Gloria Macapagal-Arroyo andher economic advisers, with its target growth rate of 7percent every year. Under this action plan, millions ofpoor Filipinos are projected to begin to ascend to theranks of the middle class by the end of the seventh year.

Such a rapid pace of growth no longer seemsimpossible to attain. During the first quarter of this yearthe Gross Domestic Product grew by a robust 6.4percent, boosted by the agricultural sector, which rose by6.7 percent. The enactment of new laws could furtherstrengthen this economic growth.

The Amendment to the Agriculture and FisheriesModernization Act (AFMA) makes sure that this growth will besustained, mandating the appropriation of at least 15 billion pesosannually for agriculture and fisheries modernization programs up to2015. The tax incentives under the AFMA are likewise extended foranother 11 years.

The package of economic reformlaws passed by the 12thCongress boosts the ArroyoAdministration’s agenda for astrong republic.

The Magna Carta for Micro-Enterprises nurtures small village-based enterprises by opening them to credit and capital, technicaltraining and marketing assistance thus assuring jobs and incomes in thecountryside.

The Domestic Shipping Modernization Act provides fiscalincentives to shipping and calls for the construction of new publicsafety infrastructure such as lighthouses and navigational aids—as wellas new sea vessels for the Coast Guard. This will also reduce the highcost of transport that has beset our farmers and traders for years.

The Philippine Plant Variety Protection Act further promotesintellectual property rights, granting protection to newly developedplant varieties, whether breeding is done through conventional means,genetic engineering or biotechnology. The Reorganization of theVideogram Regulatory Board adds muscle against the widespreadvideo piracy in the country.

The Chainsaw Act promotes ecological balance by regulating theuse of chain saws and preventing illegal logging while providing stifferpenal sanctions for offenders. The Philippine Clean Water Actconserves the country’s aquatic resources—a timely step in light of theincreasing pollution and deterioration of our water bodies.

A break for overseas FilipinosOn the electoral front, the House approved into law the long-

awaited Absentee Voting Act, allowing for the first time in our historyhundreds of thousands of Filipinos overseas to vote in a nationalelection to choose the country’s president, vice-president and 12senators.

Also approved by the 12th Congress is the Dual Citizenship Act,which encourages our countrymen who have adopted other citizenshipto return home and invest in our country.

Legislation for the less privilegedThe Twelfth Congress’ unrelenting focus on the

interest and welfare of the less-privileged segments ofour society was highlighted with the passage of majormeasures in the areas of housing, public health, andhuman resource development.

The Rental Reform Act of 2001 extends rent controlfor another three years, giving economic relief to low-income families.

The National Government Center Housing andLand Utilization Act of 2003 enables some 55,000

urban poor families living at the National Government Center (NGC) tobecome legal owners of their lots in a housing area covering 422hectares.

HOUSING ACT SIGNED. ThePresident signed the NationalGovernment Center Act seen tobenefit 55,000 urban poorfamilies.

The Philippine CleanWater Act conserves thecountry’s aquaticresources—a timelystep in light of theincreasing pollutionand deterioration ofour water bodies.

The Amendment to the National Health Insurance Programextends Philhealth coverage to the poorest of the poor, mandating localgovernment units to shoulder health insurance contributions forindigent citizens.

The New Free Patent Law provides for the expeditious andefficient administrative titling of lands and extends by ten years theperiod for filing applications for free patent.

The Act Prohibiting Employment ofChildren in Hazardous Areas imposes stiffpenalties on those who employ children below 15years of age in risky work places.

The Act Regulating the Packaging, Use,Sale, Distribution And Advertisements OfTobacco Products, aims to reduce the hazards oftobacco while protecting the livelihood of tobaccofarmers, growers, and workers. It imposes anabsolute ban on smoking in public places andrestricts the packaging, use, sale, distribution, andadvertisement of cigarettes and other tobaccoproducts. So significant is this legislative measure that it has beencalled perhaps the most significant legislation in health andenvironment in the new century.

The Quarantine Program on Severe Acute RespiratorySyndrome (SARS) establishes safeguards to combat the SARSepidemic. The National Meat Inspection Code, on the other hand,protects consumers from the dreaded foot-and-mouth disease (FMD),bird flu and other similar health hazards.

The Anti-Trafficking in Persons Act of 2003 is an affirmativeaction measure to protect our women and children against trafficking,independent of the present provisions in criminal law.

The Magna Carta for Older Persons grants more privileges tosenior citizens, lessening for them the cost of food, medicine, healthcare and other necessities.

The Act Increasing the Base Pay Rate of Officers and Personnelof the AFP provides for continuing education for all officers andenlisted personnel of the Armed Forces and scholarships for theirchildren, as well as hospital care, social services and other non-cashbenefits.

The Amendment to the Philippine Deposit InsuranceCorporation (PDIC) Law, now awaiting approval by the President,increases the maximum insured bank deposit from P100,000 toP200,000, safeguarding the interest of some 25 million depositors andpromoting the stability of the banking system.

HERO OF THE DESTITUTES.Speaker Jose de Veneciapresents to 90-year-old Rev. Fr.Pierre Fritz, a French-FilipinoJesuit priest, the CongressionalMedal of Achievement andcitation for his fifty years ofselfless dedication and effortsto sustain the education ofmore than 100,000 streetchildren in Metro Manila.

The National Service Training Program promotes civicconsciousness among the youth and develops their physical, moral,spiritual, intellectual and social well-being.

The Creation of the Film Development and Incentives Board isaimed at upgrading the country’s film industry and raising the quality ofPhilippine movies.

Recognizing the national significance of historical events and toenhance unity among Filipinos, we declared the Muslim Celebrationof Eidul Fitri, the End of Ramadhan, as a National Holiday.Likewise, December 4 to 10 is now National Human RightsConsciousness Week and June 30 the Philippine-Spanish FriendshipDay.

Promoting peace and orderThe Amendment to the Dangerous Drugs Act of

2002 exempts drug-related offenses from probation andwarrants the imposition of maximum penalty on alowered volume of drugs caught. This makes it thetoughest illegal drug law in Asia.

The Act Increasing the Penalties for IllegalGambling seeks to stop the proliferation of the illegalnumbers games like jueteng—a source of corruption andmoral erosion—and thereby promote the value ofperseverance and dignified work.

Key judicial reformsThe Twelfth Congress will also be recognized in history as having

addressed key reforms needed in our justice system.

The Act Rationalizing the Compensation of Justice, Judge andLawyer Positions in the Judiciary streamlines the compensationstructure in the Judiciary to enable the government to recruit and retainthe best and the brightest in the Bar.

The Court of Tax Appeals Administration upgrades the positionof CTA Judges to Justices and gives the CTA exclusive originaljurisdiction over all revenue and customs-related cases.

The Alternative Dispute Resolution Act seeks to reduce the closeto a million backlog of court cases by establishing the Philippine Centerfor Alternative Dispute Resolution as another venue for civil cases andminor criminal offenses prior to cognizance by the courts and thefiscal’s office.

Speaker de Venecia endorsed astronger anti-terrorismcampaign through theupgrading of military andpolice intelligence capability.

Turning around public opinion on Charterreform

The House fought for reforms in our financialsystem, reforms in our electoral system, reforms in ourjudicial system and reforms in our political party system.

And when most did not want to be counted, theHouse stood up and took the lead in fighting forconstitutional reform—convinced that amending the1987 Constitution is our best hope to propel the country’spolitical system and economic development into the 21st Century.

A Joint Resolution was endorsed by more than two-thirds of theentire membership of the House to amend the 1987 Constitutionthrough a Constituent Assembly of Congress, only to be thwarted by theSenate, which failed to rise to this historic task.

The House succeeded in turning around publicopinion—from outright rejection to a strong endorsementof Charter reform, specifically toward changing thepolitical structure of government to a unicameralparliamentary system, and eventually to a Federal Systemwithin a fixed transition period.

The House argued that charter reform is the last hopefor the country, the best way to make governanceeffective, transparent, achievement-oriented andperformance-driven. This is a hope shared by many tounleash the potential of the regions.

The House is poised to bring this reform—the mother of allreforms—to its rightful conclusion and complete the unfinished task ofthe Twelfth Congress.

US President Addresses Joint Session of CongressFor the first time in more than four decades, an American President

graced the Plenary Hall of the House to address a Joint Session ofCongress—and extol the Philippine role as a major non-NATO ally ofAmerica in the international coalition fighting terrorism.

President George W. Bush made a firm commitment that Americawill help rebuild Mindanao once peace with Muslim separatists isachieved, pledging almost 40 million dollars in a new economic aidpackage for southern Philippines alone, to benefit Muslim and Christiancommunities alike.

Reaching out to the political parties of AsiaEven as a unifying multi-party Sunshine Coalition was established

in this House, the House also cast its vision abroad, across the politics,cultures and peoples of Southeast Asia, South Asia, East Asia, andCentral Asia to build a strong foundation for regional and multi-lateralcooperation and understanding.

REFORMS CAN’T WAIT. SpeakerJose de Venecia initiated adialogue on the need toconstitute Congress into aConstituent Assembly topropose Charter amendments.

In August last year, Speaker Jose de Venecia waselected president of the Association of Asian Parliamentsfor Peace or AAPP, an association of 40 parliamentspledged to the pursuit of regional peace and cooperation.The House leadership succeeded in having the AAPP’sFourth General Assembly adopt in its Manila Declarationthe transcendental theme of “a hundred years of peace inAsia,” which was offered to combat internationalterrorism, crush its local linkages, and free the peoples ofAsia from the grip of undefined terror.

Likewise, the House sustained the historic initiative itlaunched in October 2000 with the first International

Conference of Asian Political Parties. Seventy-seven political parties—both of the ruling governments and of the opposition—remain in thefold of the Conference of Asian Political Parties, with Speaker deVenecia being reelected as chairman of the Standing Committee of thishistoric Conference.

The House has thus succeeded in bringing to the highest leaders ofAsia’s major political parties its dream of an eventualAsian economic and political integration—in thetradition of the European Union.

The Twelfth Congress has had as much success withhomegrown political parties.

In May 2002, the House convened the FirstPhilippine Political Parties Conference, the first suchsummit in history which attracted senior leaders from 23national and regional political parties and party-listgroups. This historic summit erased doubts that evenrival political parties have shared political ideals andcould stand on common ground.

A UN Interfaith Council to mediate religiousconflicts

One other vision appeals to the side of our culturesthat values peace and condemns violence in any form.This is the proposal for an Interfaith Council as a neworgan of the United Nations. As envisioned, the InterfaithCouncil would help contribute to the mediation of thehistorical conflicts between religions and cultures andbridge the great divide between cultures and civilizationsthrough continuing dialogue and cooperation.

In a world forever changed by the September 11,2001 terrorist attacks, there is a strong argument for cultures tomutually reach out to each other in order to eliminate the prospect ofmutual destruction.

Iran has endorsed Speaker Josede Venecia’s proposal for apermanent UN Inter-FaithCouncil to institutionalizedialogue among religions andcivilizations.

Speaker de Venecia acceptedthe Presidency of theAssociation of AsianParliaments for Peace (AAPP)from Chairman Wu Bangguo ofthe National People’s Congressof the People’s Republic ofChina.

Unfinished businessThe House records show that the chamber initiated action on a total

of 1,168 bills. Of the total, 1,128 were approved on third reading ofwhich 953 are pending in the Senate (158 of national application and795 local).

Three (3) measures are pending in Conference Committee and 33other measures (29 national and 4 local) are awaiting final action orsignature by the President. Another 40 bills were passed on secondreading.

The records show that the Senate passed and transmitted to theHouse a total of 77 bills, of which only three (3) are still pending in theHouse, while three (3) others are pending in Conference Committee.

The Senate, while moving rapidly to launch investigations in aid oflegislation, was deliberately slow-footed on a number of House-approved or initiated measures to which the lower chamber assignedthe highest national priority and treated with utmost urgency andpriority.

Among the LEDAC priority measures left pending by the Senateare: The Omnibus Housing and Urban Development Bill intended torevolutionize the provision of housing for the masses; the NationalRailways Modernization Bill aimed at building a rail transportationbackbone interconnecting the entire country; the Billion Trees Billseeking to reforest at least a million hectares of denuded public lands inLuzon, the Visayas and certain areas of Mindanao; and the CampaignFinance Reform Bill mandating state funding for political parties toremove dependency on moneyed interests that has encouraged graft andcorruption in public office.

Also gathering dust in the Upper Chamber are the new Universityof the Philippines Charter strengthening the premier state university;the new Philippine Cooperative Code seeking to induce the growth ofcooperativism; the bill mandating the interconnection of publictelecommunications entities; the proposed National Land Use Code;and the bill reallocating certain areas of the Tala Estate in CaloocanCity as housing sites.

Looking aheadThere are goals the House continues to seek, with Charter reform at

the top of the agenda. We seek a unicameral, parliamentary, federalform of government at the earliest possible opportunity.

Perhaps the most pressing of these challenges is to bring to amanageable level the government’s huge budget deficit and tame theforeign exchange crisis brought about by the burgeoning foreign debt.

Finally, with the House fulfilling its constitutional duty ofcanvassing the presidential and vice-presidential votes, it is hoped thatthe President of the Republic will move rapidly to heal and unite thenation, and create the structure for a Government of National Unity, tobring together the best and brightest elements from the political partiesand party-list groups and the leaders of civil society to defeat thesemost difficult challenges.•
