11 Be it ordained by the City of Warwick: 12 13 Section I. Chapter 40 of the Code of Ordinances of the City of Warwick is hereby amended to 14 add the following: 15 16 Sec. 40-32 Littering. 17 18 No person shall throw, drop, deposit, discard, or otherwise dispose of litter upon any public property 19 or private property not owned by him or her located in the City of Warwick (City) or in the waters 20 of this state or upon private property in this City owned by him or her except: 21 22 (1) When the property is designated by the state, any of its agencies or the City for the disposal of 23 solid waste or litter, and the person is authorized to use the property for that purpose; or 24 25 (2) Into a litter receptacle in a manner that the litter will be prevented from being carried away by 26 the elements. 27 28 For the purpose of this ordinance provision, the term "Litter" means garbage, trash, waste, rubbish, 29 ashes, cans, bottles, wire, paper, cartons, boxes, automobile parts, furniture, glass, or anything else of 30 an unsightly or unsanitary nature thrown, dropped, discarded, placed, or deposited by a person on 31 public property, on private property not owned by the person, or in or on waters of the state, unless 32 the person has: 33 34 (i) Been directed to do so by a public official as part of a litter collection drive; 35

36 (ii) Discarded, thrown, dropped, placed, or discarded the material in a litter receptacle in a manner 37

that prevented the material from being carried away by the elements; or 38 39 (iii) Been issued a license or permit covering the material pursuant to Chapters 18.9 and 19.1 of 40

Title 23 of the General Laws. 41 42 Any person convicted of a first violation of this ordinance provision shall, except where a penalty is 43 specifically set forth, be subject to a fine of not less than eighty-five dollars ($85.00) nor more than 44 five hundred dollars ($500). 18 WHEREAS, a person was hired into the position of City Council Auditor prior to the 19 adoption of the Fiscal Year 2015 City Budget; and 20 21 WHEREAS, the Fiscal Year 2015 City Budget that was approved by the City Council 22 contained funding for the City Council Auditor position that was staffed by the person hired prior to 23 the adoption of the Fiscal Year 2015 City Budget; and 24 25 WHEREAS, Sec 2-9 of the Code of Ordinances provides that The internal auditor shall be 26 an employee of the city and appointed by a majority of the city council.; and 27 28 WHEREAS, procedural questions have arisen about the City Council approval of the 29 appointment of Catherine K. RESOLUTION OPPOSING THE CITY OF WARWICKS PARTICIPATION IN THE 11 KENT COUNTY PREP MAYORAL ACADEMY 12

WHEREAS, the health, safety and welfare of the citizens of the City of Warwick are 16 matters of paramount importance to the City Council; and 17

18 WHEREAS, the Rhode Island State funding formula significantly underfunds the City of 19 Warwick; and 20 21 WHEREAS, the fiscal resources allocated to the Warwick School district through the 22 Warwick budget process should be used to further the education and development of our children 23 as they reside within the City limits; and 24 25 WHEREAS, the Warwick School District currently expends over one million dollars for 26 children whose parents choose to have them educated in specialized charter schools located 27 outside of the City of Warwick; and 28 29 WHEREAS, the funding apportioned for each student follows the child to his/her 30 enrolled school but remains with the school should the child transfer out after the October 31 deadline which creates further underfunding for the schools; and 32 33 WHEREAS, the Warwick School Committee has passed a Resolution opposing the City 34 of Warwicks participation in the Kent County Prep Mayoral Academy because it has a 35 detrimental effect on the education of our children in that the removal of these funds from the 36 Warwick Public Schools will have a negative impact on existing programs for students, on 37 maintaining of our public school facilities and on extracurricular activities. 38 39 NOW THEREFORE, BE IT RESOLVED, that the Warwick City Council joins the 40 Warwick School Committee in opposing the City of Warwick involvement in the Kent County 41 Prep Mayoral Academy, and 42 43 BE IT FURTHER RESOLVED, that the Warwick City Council supports a progressive, 44 robust academic environment within our Public Schools that affords all of our students a 45 blended learning opportunity within the local community. 46 The City Clerk is hereby directed to forward a copy of this Resolution to the Mayor and the 47

A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A LEASE FOR THE CHRISTOPHER RHODES ELEMENTARY SCHOOL BY GATEWAY TO CHANGE,

INC., d/b/a ARTISTS EXCHANGE RESOLVED THAT:

WHEREAS, the City of Warwick (City) is the owner of the Christopher Rhodes Elementary School, so-called, located in the Pilgrim neighborhood off Post Road (the Rhodes School); and

WHEREAS, the Mayor executed Executive Order 2012-03 to establish a Study Committee to

consider re-use options for the Rhodes School since its return to the City by the School Department; and

WHEREAS, the re-use study committee considered several re-use options for the Rhodes School that best benefit the neighborhood and the City; and

WHEREAS, the study committee issued an RFP to solicit proposals for the re-use of the

Rhodes School and after careful consideration and extensive investigation of several options unanimously recommends a lease between the City and Gateway to Change, Inc., d/b/a Artists Exchange; and

WHEREAS, Artists Exchange envisions re-use of the Rhodes School for visual and

performing arts activities, theatrical productions, instructional classes and summer art camps, to mention a few intended activities; and

WHEREAS, the City and Gateway to Change, Inc. wishes to execute a lease for the use of

the Rhodes School to allow for the use of the building as set forth in Artists Exchange detailed response to RFP 2014-299; and

WHEREAS, the parties have drafted a lease which outlines the obligations and rights of the

parties; and

WHEREAS, execution of the lease is in the best interest of the taxpayers, the neighborhood and the general public.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Warwick,

Rhode Island that:

SECTION 1. The Warwick City Council assents to the Mayor executing the lease between the City and the Gateway for Change, Inc., d/b/a Artists Exchange for the re-use of the Rhodes School in the form and substance on the attached Exhibit A. Resolved that, WHEREAS, the health, safety and welfare of the citizens of the City of Warwick are matters of paramount importance to the City Council; and WHEREAS, there is an increasing traffic problem in the vicinity of the Warwick Mall and Rhode Island Mall on Route 2 at Route 295 and the Pawtuxet River; and WHEREAS, increased occupancy of the Malls will increase traffic flow in the area; and WHEREAS, the roads in the area are in dire need of an upgrade; and

WHEREAS, upgrading the roads in the area will facilitate

NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby requests the Rhode Island Department of Transportation to upgrade the roadways in the vicinity of the Warwick Mall and Rhode Island Mall on Route 2 at Route 295 and the Pawtuxet River.

The City Clerk is hereby directed to forward a copy of this Resolution to the Director of the State Department of Transportation. This Resolution shall take effect upon passage.
