1. DIGITAL PHONE SERVICE - RETIRED SERVICE PLANS AND CHARGING

1.1 CHARGES

Unless we expressly say otherwise, charges for outgoing calls using Digital Phone Service are

based on one-minute intervals over the Chargeable Calling Time and are rounded to the

nearest cent. Charges for part of a one-minute interval will be rounded up to the next one-

minute interval.

1.2 PRICING OPTIONS

Service Plans may, in addition to discounts and bonuses, impose Plan Fees that contain a

component of prepaid or included calls (or events) as a usage credit. These credits, discounts

and bonuses cannot be accumulated beyond the month in which they are accrued. The value

of these credits, discounts and bonuses cannot be transferred between customers or an

individual customer’s accounts, or redeemed for cash, even at account closure.

Where offered on a monthly invoicing period basis, credits, discounts and bonuses are pro-

rated according to the portion of the invoicing period over which the service was active, or the

Service Plan applied, as appropriate.

Some call and event types, including international voice calls; calls to special numbers

(including but not limited to un-timed calls which are not local calls); calls to premium

numbers (e.g. 1-900), where available; operator assisted calls; calls to Directory Assistance;

and surcharges for the use of certain features are always ineligible for discounts and inclusion

in prepaid calls or included calls unless we expressly say otherwise.

1.2.1 Service Plan Options

Where you have chosen to apply a Service Plan Option (‘Plan Option’) to your Service Plan

we will charge you a recurring Plan Option Fee each month. The Plan Option Fee is in

addition to any other fees that apply to your Service Plan and is applied in advance.

The Plan Option Fee is pro-rated according to the portion of the invoicing period over which

the Plan Option was active. Charging ceases at midnight of the day that you request we

deactivate the Plan Option from your Service Plan.

The available Plan Options and the relevant monthly fee are set out in the Pricing Tables to

this Service Description.

You may request the activation or deactivation of a Plan Option only once per invoicing

period. Where you make such a request more than 3 times in any 12 months period (as

measured from the date we first activate, connect or install your service) we will apply an

administration charge as follows:

1.3 FEATURE CHARGES (VALUE-ADDED SERVICES)

Access to various features is dependent upon the type of service and the feasibility of

providing the feature. You will be charged an access charge per monthly invoicing period for

each value-added service (“Feature Charge”) activated for your service. The relevant charge

is applied in advance and is outlined in the table below.

The relevant Feature Charge is pro-rated according to the portion of the invoicing period over

which the Feature was active. Charging begins on the day that we complete all necessary

steps to activate the Feature, and ceases at midnight on the day we complete all necessary

steps to terminate the Feature for your service.

1.4 UNLIMITED CALLING

Where you choose a pricing option that provides Unlimited Calling you may be eligible for

discount pricing on local calls, national long distance calls, and/or international long distance

calls (to specified eligible destinations).

Unlimited Calling discounts are only available once Unlimited Calling is activated for your

service. There may be a delay in transferring, connecting or registering your service to ACN.

We are not responsible for any delay.

Unlimited Calling discounts do NOT apply to calls to special numbers (including but not

limited to un-timed calls which are not local calls), calls to global or satellite services, or

operator-assisted calls.

1.4.1.1 Restrictions on Unlimited Calling

We aim to provide a quality service and competitive offer to all our customers and ensure that

no customers are disadvantaged by the behaviour of others. Our offer and your use of

Unlimited Calling applies only to ordinary personal and home use of the service in Australia

and is subject to the conditions as set out below:

a) Where we determine, in our sole, reasonable discretion, that your use is does not

constitute ordinary personal and home we may, at our discretion, choose to apply

standard call rates to the excessive calls or minutes of use (as applicable) or refuse you

access to the offer. If we refuse you access to the offer we will then charge you our

standard rates for all call or minutes of calling which otherwise would have been eligible

for the offer.

b) We supply the Service for the purpose of you making and receiving for your own

personal use. We will consider your use to be unreasonable if you:

i) make or receive calls on our network other than for your personal use;

ii) wholesale usage (including transit, refile or aggregate domestic or international

traffic) on our network; or

iii) use the service in connection with a device that switches or re-routes calls to and from

our network or the network of any Supplier;

without first obtaining our written consent. We may give or withhold our consent, or

make consent subject to conditions, in our discretion.

We will also consider your use of the service does not constitute ordinary personal and

home use if you set up switch devices which may potentially allow a line to be kept open

limiting the ability of other customers to access our network.

Without limiting our rights under the General Terms or our rights under this Service

Description, where we consider your use of the offer does not constitute ordinary

personal and home use then we may suspend or cancel your service, in each case

immediately and without notice to you.

Please note that our right to suspend or cancel the service without notice to you under this

clause over-rides any requirement we may have to give you notice in other parts of this

SFOA.

1.4.1.2 Unlimited ACN-2-ACN Video Calling

Where you choose a Service Plan which offers Unlimited ACN-2-ACN Video Calling you

will be eligible for discount pricing on video calls from your service to other active ACN

Digital Phone Service customers with Australia (and certain overseas destinations, see 1.4.1.4

below). For video call to be eligible for Unlimited Calling the service to which the call is

terminated must be active with ACN at the time of the call. We are not responsible for any

delay in transferring or registering these services to ACN. You are not responsible for

identifying other active ACN Digital Phone Service customers. Such identification is handled

by our facilities and systems

Where we determine, in our sole, reasonable discretion, that your use of the service does not

constitute ordinary personal and home use, as stated above, we may choose to apply standard

call rates to the excessive calls or refuse you access to the offer. If we refuse you access to the

offer we will then charge you our standard rates (as per your Service Plan) for all minutes of

use which otherwise would have been eligible for the offer.

1.4.1.3 Unlimited Local and National Long Distance Calling

Where you choose a Service Plan which offers Unlimited Local and National Calling you will

be eligible for discount pricing on local and national long distance calls from your service.

Where we determine, in our sole, reasonable discretion, that your use of the service does not

constitute ordinary personal and home use, as stated above, we may choose to apply standard

call rates to the excessive calls or refuse you access to the offer. If we refuse you access to the

offer we will then charge you our standard rates (as per your Service Plan) for all minutes of

use which otherwise would have been eligible for the offer

1.4.1.4 Unlimited ACN-2-ACN International Calling

Where you choose a Service Plan which offers ACN-2-ACN International Calling you will be

eligible for discount pricing on direct-dial international long distance voice and video calls

originated from your Digital Phone Service to other ACN Digital Phone Service customers in

the following countries:

• Austria

• Canada

• Denmark

• Finland

• France

• Germany

• Republic of Ireland

• Italy

• Netherlands

• New Zealand

• Norway

• Poland

• Portugal

• Puerto Rico

• Spain

• Sweden

• Switzerland

• United Kingdom; and

• United States.

For an international long distance call to be eligible the Digital Phone Service to which the

call is terminated must be active with ACN at the time of the call. We are not responsible for

any delay in transferring, connecting or registering these services to ACN.

Unlimited Calling discounts do NOT apply to calls to standard home and business phones,

calls to special numbers, calls to cellular mobile services (including some fixed network

services which are treated as mobile termination) and global or satellite services.

1.5 SERVICE CHARGES

1.5.1 Connection Charges

Where we agree to connect a new Digital Phone Service the following connection charges

apply:

1.5.2 Number Usage Fee

We may charge you a recurring fee each month for the right to use your phone number for

each of your Digital Phone Services. The Number Usage Fee is applied according to the

service type and the relevant Service Plan, and is applied in advance.

The Number Usage Fee is pro-rated according to the portion of the invoicing period over

which the service was active. Service charging ceases at midnight of the day that we

terminate the physical service.

Applicable Number Usage Fees for Digital Phone Services are set out in the Pricing Tables to

this Service Description.

1.5.2.1 Service Plan Fees

Where you have chosen a Service Plan that attracts a Service Plan Fee (‘Plan Fee’) we will

charge you a recurring fee each month for access to certain pricing features of that Service

Plan. The Plan Fee is in addition to the feature and usage charges that apply to your Service

Plan and is applied in advance.

The Plan Fee is pro-rated according to the portion of the invoicing period over which the

Service Plan was active and is applied irrespective of your usage of the service during the

invoicing period.

The Plan Fee begins on the day that we complete all necessary steps to activate the service, or

from midnight on the day a Service Plan change is effected.

The Plan Fee ceases at midnight on the day that we complete all necessary steps to terminate

the physical service, or at midnight on the day a Service Plan change is effected.

Service Plans which attract a Plan Fee (and the relevant charge) are outlined in the Pricing

Tables to this Service Description.

Plan Fees may include a usage credit component (“Pre-Paid and Included Calls”, see 1.5.2.2

below) in arrears.

1.5.2.2 Prepaid and Included Calls

Plan Fees may include a call credit component (“Included Calls”) applied in arrears.

The maximum value of the call credit included in the Plan Fee for each Service Plan is

outlined in the Pricing Tables.

Call credits do not accrue in any invoicing period where the Plan Fee is waived or reduced.

The value of Included Calls is pro-rated according to the portion of the invoicing period over

which the Service Plan is applied. Included Calls include only specific call and event types as

follows:

• ACN-2-ACN video calls

• Local calls

• National long distance calls

• National Call Diversion

• ACN-2-ACN international long distance calls.

All other call and event types are excluded. Recurring charges for value-added services are

also excluded.

Call credits not used in a monthly invoicing period are forfeited.

1.6 CALL CHARGES

1.6.1 Call Types

1.6.1.1 Standard Call Types

ACN-2-ACN Video Call - a call from a Digital Phone Service within Australia to another

ACN Digital Phone Service within Australia with a Certified Device capable of receiving

video calls.

ACN-2-ACN International Call - a call from a Digital Phone Service within Australia to

another ACN Digital Phone Service overseas with a Certified Device capable of receiving

voice and/or video calls.

You are not responsible for identifying other active ACN customers. Such identification is

handled by our facilities and systems.

There may be a delay in transferring, connecting or activating your service, or another

customer’s service to ACN. We are not responsible for any delay.

ACN-2-ACN calls do NOT apply to local calls, national long distance calls, calls to mobiles,

calls to special numbers (e.g. 1-300, 1-800), call diversions, voicemail deposits, voicemail

retrievals, international long distance calls or calls to global or satellite services.

Local Call – a call generally defined as a call where:

i) the calling party and the called party are both located in the same Charging Zone; or

ii) the standard Charging Zone in which the calling party is located is adjacent to the

standard Charging Zone in which the called party is located; or

iii) the Charging Zone in which the calling party is located has designated local call access

to the Charging Zone in which the called party is located.

Please note that some local calls are excluded, e.g. operator assisted local calls.

Calls to 13 and 1300 numbers, while un-timed calls, are NOT local calls.

National Long Distance Call - a call from a Digital Phone Service within Australia to an

Access Line elsewhere in Australia that is not a local call.

International Long Distance Call - a call from a Digital Phone Service within Australia to

a called number outside Australia.

Calls to Mobiles - a call from a Digital Phone Service within Australia to an Australian

mobile phone number.

Calls to Special Services - are calls to services such as 13, 1300, 114(0-3), 1800, 18500,

18555, Operator Services, and Directory Assistance (1223). For technical reasons, calls made

to some ‘13’ numbers in regional areas will not always be terminated by the 13 Supplier at the

desired answering point. However, the call will be answered by the company to whom the

‘13’ number has been assigned in a capital city of Australia. We are not responsible for the

particular routing of calls to ‘13’ numbers.

Diverted Calls - are incoming calls you have diverted to another phone (or to a messaging

service such as Voicemail, in which case these calls are classified as Voicemail Deposit

calls). There are some restrictions on diverting calls, e.g. you cannot divert calls to numbers

which cannot be terminated using the Service.

Calls to Retrieve Voicemail - are calls to your voice mailbox to process your messages.

1.6.2 Operator Assisted Calls

It is also possible to make certain calls to an operator. You are not able to access certain

operator services offered by other Suppliers.

Operator Assistance – is available 24 hours a day, every day of the year and may be sought

in the following ways:

(ii) for national directory assistance, by dialling “1223’; or

(iii) for international directory assistance, by dialling ‘1225’.

A charge applies for accessing the operator.

1.6.3 Operator Connected Calls

An operator connected call, including local, national and international calls, cannot be

accessed by using the Service.

1.6.4 Restrictions on Collect Calls

International and National Long Distance Calls, Calls to Mobiles and Local Calls made by

reversing the charges (calling ‘collect’) cannot be terminated using the Service, nor can a

collect call be made using the Service.

1.6.5 Unsupported Numbers

The Service cannot be used:

(i) for some data and fax services (including to make international fax calls using the

prefixes 0015 or 0019); or

(ii) to call information services such as premium number services (including, for

example, calls to 1901 or 1902 prefix numbers; or

(iii) to call a satellite phone connected to the Singtel Optus MobileSat service; or

(iv) to call Global and Satellite services including mobile satellite terminals located within

the beam coverage of the Inmarsat satellites; Iridium or Globalstar Global Mobile

Satellite System services with Australia or overseas; or Thuraya satellite wireless

phones located within the Thuraya Regional Mobile Satellite System’s network

footprint.

1.7 CALL CHARGING

We do not charge for calls to Instant Balance Announcement (‘*88’) or for calls to the

Emergency Services operator (“000”).

1.7.1 Local and National Long Distance Calls

All local and national long distance calls, unless specified otherwise, incur the charges based

on the Service Plan and the duration and the origin and destination of the call.

Charging commences at the time a connection is established and stops when a call is

terminated. Each call includes the charge per increment multiplied by the duration of the call

(rounded to the nearest charging increment and cent). The charge rates for each call type and

time period are listed in the Pricing Tables to this Service Description.

For the purposes of determining the time at which a call is placed, the time used is the local

time in the state (and Australian time zone) to which the local exchange’s Charging Zone has

been allocated. This will not necessarily be the local time at the place at which your service is

located.

The total call is charged in the time category current when the call is established.

Local and national long distance calls are charged in increments of one minute (or part

thereof).

1.7.2 Calls to Mobiles

1.7.2.1 International Calls

All international call charging commences at the time a connection is established and stops

when a call is terminated. Each call includes the charge per one-minute increment or part

thereof (Table 1) multiplied by the duration of the call and rounded to the nearest cent.

Mobile Termination Surcharge

Calls to cellular wireless services (including some fixed network services which are treated as

mobile termination) to those destinations marked with an asterisk (*) will incur a 20¢ per

minute (inclusive of GST) surcharge in addition to the standard rate. The Mobile Termination

Surcharge is charged in one-minute increments and rounded to the nearest cent.

1.7.3 Calls to 13, 1300 numbers

Calls to 13 and 1300 numbers are charged at a fixed call charge per call regardless of the

duration of the call. The charge rates for calls to 13 and 1300 numbers are listed in the Pricing

Calls to 1800 numbers are free from your Digital Phone Service.

1.7.5 Operator Assisted Calls

Calls to the Operator where available are charged at a fixed call charge per call regardless of

the duration of the call. The charge rates for calls to the Operator are listed in the Pricing


1.7.6 Unsuccessful Calls

We will not charge you for calls that are not successfully connected to a called number

(including a number to which a called number diverts), including where:

• the called number is busy, disconnected or out of order,

• the called number cannot be accessed using the Service, or

• there are network or other service failures that have caused temporary interruptions to the

Service.

1.8 MINIMUM SERVICE TERM

The Service Plan you choose is subject to a minimum service term. You must connect to the

Service Plan for the minimum term, as shown in the table below. Where you do not maintain

your service for the minimum service term or you request a Service Plan change during the

minimum service term period, you agree to pay the relevant Early Termination Fee (see 1.9

below).

1.9 EARLY TERMINATION CHARGE

Where your Digital Phone Service is subject to a minimum service term and is cancelled,

either by us or by you, or you request a Service Plan Change within your minimum service

term, an Early Termination Charge will apply (in addition to any usage charges incurred up to

and including the date of cancellation). The Early Termination Charge applicable is calculated

by multiplying the Early Termination Unit Charge by the remaining months of your minimum

service term. For purposes of calculation of the Early Termination Change part months will

be rounded up to a full month. The Early Termination Unit Charge for each relevant Service

Plan is outlined in the Pricing Tables to this Service Description.

1.10 ADMINISTRATION

Change Service Plan - You may be eligible to change to another pricing plan depending on

the eligibility requirements of the pricing plan that you want to change to and subject to our

normal credit checking procedures. You will need to refer to the terms of the pricing plan

you are moving to for this information.

We may charge you a fee if you move from one Service Plan to another before the end of

your minimum term. The amount of the fee will depend on various factors, including the

terms of your current pricing plan, your call spend under your current pricing plan and the

terms of the new pricing plan you are moving to. You should call our Customer Contact

Centre for further information on the fee that may apply in your case.

If you change your Service Plan to a new Service Plan at any time, or renew your agreement

and choose a new Service Plan we will apply the charges set out in your new Service Plan

from the date of effect of the change. The dare of effect of a change will be advised to you at

the time you request a change (and agree to any fees associated with that change.)

Temporary Suspension - you may request your service be temporarily suspended. We may

charge a fee for temporarily suspending the service. The maximum suspension period is 6

months unless we agree to extend the suspension. If you wish to extend the suspension period

for longer than 6 months, you must contact us before the end of the 6 month period or we may

reactivate or cancel your service (at our discretion).

Please note: Where your service is subject to a minimum monthly commitment (as defined by

a monthly Plan Fee or minimum monthly spend requirement, or both) that minimum

commitment will continue to apply for the duration of the suspension, unless we agree

otherwise.

Change of Call Diversion Conditions - you may change your call diversion conditions at

any time either via your handset, online via MyAccount or alternatively by calling our

Customer Contact Centre. We will not charge you a fee for changing call diversion

conditions.

Change Phone Number - you may have your Digital Phone Service phone number changed

upon request. Except in legitimate cases of unwelcome calls (where you have reported the

matter to the relevant law enforcement agency) a change of phone number will incur a once-

off administration charge.

2. FIXED LINE - RETIRED SERVICE PLANS AND CHARGING

2.1 SERVICE PLANS

2.1.1 MyCircle Home

Where you have chosen a MyCircle Home pricing option and maintain Full Service (you

acquire and continue to acquire Local Access Resale from us, and preselect us and maintain

that preselection choice for your preselectable long distance calling) you may be eligible for

discount pricing on local calls, national long distance calls, fixed-to-mobile calls and/or

international long distance calls (to specified eligible destinations) from your service to other

active ACN fixed line and mobile customers, including ACN business customers (‘ACN-2-

ACN Calling’).

ACN-2-ACN Calling discounts are only available once both Local Access Resale (via

transfer or new connection) and long distance preselection have been activated for your

service. There may be a delay in transferring, connecting or preselecting your service to ACN.




Where we are notified by any one of our Network Providers that we are no longer your

carriage service provider of choice (i.e. you no longer acquire Full Service by transferring

your Local Access service to another carriage service provider, and/or preselect another

carriage service provider’s long distance service) we will immediately deactivate the ACN-2-

ACN Calling discount features of your Service Plan.

ACN-2-ACN Calling discounts do NOT apply to local calls where those calls are carried on a

network other than that of the Local Exchange Carrier, calls to special numbers (including but

not limited to un-timed calls which are not local calls), calls to global or satellite services, or

operator assisted calls.

2.1.1.1 ACN-2-ACN Calling Reasonable Use

We aim to provide a quality service and competitive offer to all our customers and ensure that

no customers are disadvantaged by the behaviour of others. Our offer and your use of ACN-2-

ACN Calling is subject to ACN’s ACN-2-ACN Calling Reasonable Use Policies (RUP) as set

out below:

a) Where we identify that your use is excessive, as defined in clauses 0, 1.4.1.3

and 2.1.1.4 below, we may, at our discretion, choose to apply standard call rates

to the excess calls or minutes of use (as applicable) or refuse you access to the

offer. If we refuse you access to the offer we will then charge you our standard

rates (as per your Service Plan) for all call or minutes of calling which

otherwise would have been eligible for the offer.

b) We supply the Service for the purpose of you making and receiving for your

own personal use. We will consider your use to be unreasonable if you:

i) make or receive calls on our network other than for your personal use;

ii) wholesale usage (including transit, refile or aggregate domestic or

international traffic) on our network; or

iii) use the service in connection with a device that switches or re-routes

calls to and from our network or the network of any Supplier;

without first obtaining our written consent. We may give or withhold our

consent, or make consent subject to conditions, in our discretion.

We will also consider your use of the service to be unreasonable if you set up

switch devices which may potentially allow a line to be kept open limiting the

ability of other customers to access our network.

Without limiting our rights under the General Terms or our rights under this

Service Description, where we consider your use of the offer to be unreasonable

then we may suspend or cancel your service, in each case immediately and

without notice to you.


RUP over-rides any requirement we may have to give you notice in other parts of this SFOA.

2.1.1.2 ACN-2-ACN Local Calling

Where you choose a MyCircle Home Plan which offers ACN-2-ACN Local Calling you will

be eligible for discount pricing on local calls from your service to other active ACN

customers who maintain Full Service, including ACN business customers.

ACN will consider your use of ACN-2-ACN Local Calling to be unreasonable if your local

calls exceed 1000 calls in any month.

Where we identify that your use exceeds the reasonable usage, as stated above, we may

choose to apply standard call rates to the excess calls or refuse you access to the offer. If we

refuse you access to the offer we will then charge you our standard rates (as per your Service

Plan) for all calls which otherwise would have been eligible for the offer.

2.1.1.3 ACN-2-ACN National Calling

Where you choose a MyCircle Home Plan which offers ACN-2-ACN National Calling you

will be eligible for discount pricing on national long distance calls from your service to other

active ACN customers who maintain Full Service, including ACN business customers.

ACN will consider your use of ACN-2-ACN National Calling to be unreasonable if your

accrued minutes of ACN-2-ACN national long distance exceed 3000 minutes in any month.

When we identify that your use exceeds the reasonable usage, as stated above, we may choose

to apply standard call rates to the excess calls or refuse you access to the offer. If we refuse

you access to the offer we will then charge you our standard rates (as per your Service Plan)

for all minutes of calling which otherwise would have been eligible for the offer.

2.1.1.4 ACN-2-ACN Home to Mobile Calling

Where you choose a MyCircle Home Plan which offers ACN-2-ACN Home to Mobile

Calling you will be eligible for discount pricing on fixed to mobile calls from your Fixed

Wire service to active ACN GSM Mobile services, regardless of the Service Plan to which the

GSM service to which the call is terminated is subscribed.

ACN-2-ACN Home to Mobile Calling is an offer whereby the first five minutes of certain

eligible fixed-to-mobile calls are free and you will only pay for the minutes of duration

beyond the first five minutes. For a fixed-to-mobile call to be eligible for ACN-2-ACN

Calling discounts the GSM Mobile service to which the call is terminated must be active with

ACN at the time of the call. There may be a delay in transferring, connecting or activating a

service. We are not responsible for any delay.

ACN will consider your use of this offer to be excessive if your accrued minutes of free

calling under this offer exceeds 1000 minutes in any monthly invoicing period.

Where we identify that your use is excessive, as stated above, we may, at our discretion,

Where you choose a MyCircle Home Plan which offers ACN-2-ACN Calling to New Zealand

you will be eligible for discount pricing on direct-dial Trans-Tasman international long

distance calls originated from your Fixed Line service to other ACN customers in New

Zealand. For an international long distance call to be eligible for ACN-2-ACN Calling

discounts the New Zealand toll (long distance) service to which the call is terminated must be

active with ACN at the time of the call. We are not responsible for any delay in transferring,

preselecting or registering these services to ACN.

ACN-2-ACN Calling to New Zealand provides discounted calling to a maximum of sixty (60)

minutes of duration per call. Standard rates apply to all minutes of duration thereafter. An

Points to note in relation to charging for Fixed Line are:

• Fixed charge calls are charged a flat charge specified for the call type.

• Timed calls are charged in the time increments specified for the call type (rounded up

to the next increment and cent) for the chargeable calling time.

• You will not be charged for unsuccessful calls (e.g. a call unanswered because the

called number is busy).

• Call charges, except fixed call charges, include an initial “call connection fee” charge

according to the call type and are dependent on the Service Plan to which your

service is subscribed, unless specified otherwise.

• Operator services typically include a surcharge on the call charge.

• There is no charge for calls to the Emergency Services numbers.

2.3 RECURRING CHARGES

The Plan Option Fee is pro-rated according to the portion of the invoicing period over which

the Plan Option was active. Charging ceases at midnight of the day that you request we

deactivate the Plan Option from your Service Plan.

2.5.2 Resale Access Fee

We will charge you a recurring fee each month for the right to use your Resale Access Line

for each of your Fixed Line services. The Resale Access Fee is applied according to the

service type and the relevant Service Plan, and is applied in advance.

The Resale Access Fee is pro-rated according to the portion of the invoicing period over

which the service was active. Service charging ceases at midnight of the day that our Network

Provider terminates the physical service.

2.6.2 Timed Call Charges

The calculation of call charges for timed calls varies depending on the call type.

c) International Long Distance Calls

The charges for international long distance Calls (‘International calls’) are set out below.

Charges are based on the Service Plan (and Service Plan Option, if applicable), the

destination and the duration of the call.

All international call charging commences at the time a connection is established and

stops when a call is terminated. Each call includes the initial charge (Table 1) plus the

standard international call charge per 30 second increment or part thereof (Table 2)

multiplied by the duration of the call and rounded to the nearest cent.

Where your service is subscribed to the World 30 Plan each call to a Headline

Destination as specified in Table 3 includes the initial charge (Table 1) plus the

charge per 30 second increment or part thereof (Table 3) multiplied by the duration of

the call and rounded to the nearest cent. All calls to destinations not specified in Table

3 are charged at the standard international rates (Table 2).

Where the International Bonus Option is applied to your Service Plan each call

includes the initial charge (Table 1) plus the charge per 30 second increment or part

thereof (Table 3) multiplied by the duration of the call and rounded to the nearest

cent.

Mobile Termination Surcharge

Calls to cellular wireless services (including some fixed network services which are

treated as mobile termination) to those destinations marked with an asterisk (*) will

incur a 40¢ per minute (inclusive of GST) surcharge in addition to the standard rate

(or International Bonus Option rates, as applicable). The Mobile Termination

Surcharge is charged in 30 second increments (at $0.20 per 30 seconds) and rounded

to the nearest cent.

Capped International Call Rates

Calls to fixed line services to selected international destinations will be charged at the

standard rates (or International Bonus Option rates, as applicable) to a capped

maximum charge (according to the destination) for the first 30 minutes of the call

(including the initial charge). Standard rates (or International Bonus Option rates, as

applicable) apply to all minutes of call duration thereafter.

Note: Capped call rates do NOT apply to calls where the Mobile Termination

Surcharge applies. Capped call rates do NOT apply where your service is subscribed

ACN-2-ACN Calling to New Zealand

Where your Service Plan offers ACN-2-ACN Calling to New Zealand, calls to certain

fixed line services in New Zealand will be charged at the initial charge (according to

your Service Plan) for the first 60 minutes of the call. Standard rates (or International

Bonus Option rates, as applicable) apply to all minutes of call duration thereafter.

Note: The ACN-2-ACN Calling to New Zealand offer provides for a maximum

aggregate of 200 minutes of free ACN-2-ACN Calling per service, per monthly

invoicing cycle. All minutes of duration beyond the maximum aggregate allowance

2.7 FIXED LINE OPERATOR CONNECTED CALL CHARGES

There are a number of different types of Operator Connected Calls available and the charges

for these are the same as those set out in Telstra’s Customer Terms for Basic Telephone

Service.

3. MOBILE (GSM) - RETIRED SERVICE PLANS AND CHARGING

3.1 PRICING OPTIONS

Different pricing options (‘Service Plans’) are available with variations in the service charge

and call charges. The various Service Plans, which are outlined below, may offer discounts or

bonuses as specified and are available according to your customer classification. Service

Plans may, in addition to discounts and bonuses, contain a component of prepaid or included

calls (or events) as an airtime credit. These credits, discounts and bonuses cannot be

accumulated beyond the month in which they are accrued. The value of these credits,

discounts and bonuses cannot be transferred between customers or an individual customer’s

accounts, or redeemed for cash, even at account closure.

Where offered on a monthly invoicing period basis, credits, discounts and bonuses are pro-

rated according to the portion of the invoicing period over which the service was active, or the

Service Plan applied, as appropriate.

Should you choose a Service Plan for which you are not eligible, or your eligibility for a

Service Plan changes we may automatically change your Service Plan to a similar Service

Plan for which you are eligible, without notice to you.

Some call and event types, including international calls, international roaming calls; calls to

special numbers (e.g. 1-900); premium and third party SMS, calls to special 1-300 and 13

numbers not charged at Service Plan specific rates; operator assisted calls and calls to

Directory Assistance (1223) are always ineligible for the discounts, including free calls,

prepaid calls, included calls and minimum monthly spend requirements unless we expressly

say otherwise.

Unless we expressly say otherwise, charges for outgoing calls using GSM are based on thirty-

second intervals over the Chargeable Calling Time and are rounded to the nearest cent.

Charges for part of a thirty-second interval will be rounded up to the next thirty-second

interval.

3.1.1 ACN-2-ACN Calling Bonus

Where you choose a Service Plan which offers the ACN-2-ACN Calling Bonus and your

service meets any special pricing conditions assigned to that particular Service Plan you will

be eligible for discount pricing on national voice calls from your mobile service to other ACN

customers, as follows:

• Active Fixed Line customers who maintain Full Service, regardless of the Service

Plan to which their Fixed Line service is connected; and

• Active GSM Mobile customers, regardless of the Service Plan to which their GSM

Mobile service is connected.

3.1.2 ACN-2-ACN First5Free#

Where you choose a Service Plan which offers ACN-2-ACN First5Free you will be eligible

for discount pricing on national voice calls from your mobile service to other active GSM

Mobile services which are billed to you on the same ACN account number, regardless of the

Service Plan to which the GSM service to which the call is terminated is subscribed.

You are not responsible for identifying other active GSM Mobile services on the same ACN

account number. Such identification is handled by our facilities and systems.

For a national voice call to be eligible for ACN-2-ACN First5Free discounts the GSM Mobile

service to which the call is terminated must be associated to same ACN account number at the

time of the call. There may be a delay in transferring, connecting or activating a service. We

are not responsible for any delay.

The ACN-2-ACN First5Free discounts do NOT apply to calls made by you to other ACN

services billed to you on the same ACN account number which are not GSM Mobile services.

any Supplier;

3.1.3 ACN-2-ACN Talk Free

Where you choose a Service Plan which offers ACN-2-ACN Talk Free you will be eligible

for discount pricing on national voice calls from your mobile service to active ACN Fixed

Line and other active ACN GSM Mobile services, regardless of the Service Plan to which the

service to which the call is terminated is subscribed.

ACN-2-ACN Talk Free is an offer whereby the first five minutes of eligible national voice

calls are free and you will only pay for the minutes of duration beyond the first five minutes.

Your Service Plan will determine the maximum number of minutes to which the discount is

applied each month. For a national voice call to be eligible for ACN-2-ACN Talk Free the

Fixed Wire or GSM Mobile service to which the call is terminated must be active with ACN

at the time of the call. There may be a delay in transferring, connecting or activating a service.

3.1.4 Retired Service Plans

Retired Service Plans are pricing options which are no longer available for new connections.

Reconnection to a Retired Service Plan is not available to an existing customer when

3.2.8 ACN-2-ACN Calling Bonus

Your GSM Mobile service may qualify for an ACN-2-ACN Calling Bonus (“Calling Bonus”)

credit where you have chosen a Service Plan that offers the Calling Bonus.

The Calling Bonus allows you to receive free ACN-2-ACN National Call Minutes up to a

maximum of 25% of the value of your total National Call Minutes each monthly invoicing

period. The Calling Bonus is applied as a rebate credit against the charges for ACN-2-ACN

National Call Minutes and will not exceed the total value of ACN-2-ACN National Call

Minutes within the monthly invoicing period.

The maximum rebate allowance the Calling Bonus will vary depending on the Service Plan

that applies to your service as follows:

3.2.15 Zoo Content

The charges for Zoo Content are the same as those set out in Appendix Y of Optus’ Standard

Form of Agreement for Digital Mobile Service as amended from time to time.

Usage or carriage charges associated with the delivery or request of content over GPRS will

also apply. These data transfer charges are applied according to the amount of data you

upload and download to your mobile phone in requesting or receiving the content and are set

out in the table at clause 3.2.14 (iii) above.

3.2.17.1 24 Month Minimum Service Term

Where your service is subject to a 24 month minimum service term and is cancelled, either by

us or by you, or you request a Service Plan Change within your minimum service term, an

Early Termination Charge will apply (in addition to any usage charges incurred up to and

including the date of cancellation). The Early Termination Charge applicable is calculated by

multiplying the Early Termination Unit Charge by the remaining months of your minimum

service term. For purposes of calculation of the Early Termination Change part months will

be rounded up to a full month. The Early Termination Unit Charge for each relevant Service
