HC directs authorities not to demolishslum at GhazipurNEW DELHI

The Delhi High Court has directed the authorities,including DMRC, not to evict the slum dwellers atGhazipur Dairy Farm in east Delhi nor demolish theirhomes till the next date of hearing on their plea seekingprotection from any move to demolish them.

Justice Rajiv Shakdher, while putting on hold the pro-posed demolition as apprehended by the slum dwellers,also issued notices to Ministry of Housing and UrbanPoverty Alleviation, city government, DMRC, EastDelhi Municipal Corporation, city police and DUSIBand sought their responses by May 13.

It also appointed a local commissioner who wouldvisit the place and report back to the court about the sit-uation at the slum.

The plea, filed by one of the slum dwellers, has allegedthat officials of Delhi Metro Rail Corporation (DMRC)have been threatening to evict them and demolish theirhomes and has sought protection from any such move bythe authorities.

The petition, filed through advocate Kamlesh KumarMishra, has submitted "there are immediate needs ofpublic toilets and Anganwadi Kendra and other civicamenities for the welfare of the economically and social-ly deprived women and children of the above cluster".

It has said the residents of the area have been livingthere for more than 20 years now and comprise of morethan 12 families.

It also claims that they have various proofs of resi-dence and identity including ration cards, election IDcards, Aadhar cards, BPL cards and electricity bills.

According to the slum dwellers, who primarily do thework of 'kabaadi', ownership of the land allegedly lieswith DMRC. Phase-IV of DRMC's metro line is expect-ed to go through this area.

First RAW officer appointed in UPSCNEW DELHI

Arvind Saxena, in-charge of Aviation and ResearchCentre of external snooping agency RAW, was on Fridayappointed as a member of UPSC becoming the first offi-cer of 32-year Research and Analysis Service to benamed to the commission.

After the appointment of Saxena, who was due toretire in August, Union Public Service Commission(UPSC) is left with only one vacancy. The UPSC is a 10-member body besides a Chairperson.

According to the order, Saxena's tenure will com-mence from the date he assumes the office of member,UPSC. After formation in 1983 of RAS service, all offi-cers who were with Research and Analysis Wing (RAW)were given option of either going back to their service orjoining the newly formed RAS along with their seniori-ty. Post-quake measure: NDMCCommissioner orders demolition driveNEW DELHI

Keeping in mind Delhi's high seismicity, the NorthDelhi Municipal Commissioner today directed all sixzones under NDMC to conduct special demolition driveagainst illegal structures in its areas on Saturdays, start-ing tomorrow.

North Delhi Municipal Commissioner Praveen KumarGupta directed Deputy Commissioners (DC) of all thezones to adopt a "zero-tolerance" approach and takestrict action against unauthorised constructions andencroachments on public land.

"Delhi is a high-seismic zone and prone to high-inten-sity earthquakes. In that situation, it becomes veryimportant to curb illegal constructions from safety pointof view, specially in densely populated areas. The spe-cial demolition drive would be conducted on Saturdays,"he said.

He added that the drive would be undertaken after con-ducting random survey by field engineers in all wards inthe six zones -- Narela, Rohini, Civil Lines, Karol Bagh,Sadar Paharganj and City.

"The Commissioner suggested that ward-wise teamsmay be constituted for detection of unauthorised con-structions so that action against the same may be takenat the ongoing stage and no such construction should beallowed to come up under any circumstances," he added.

The Commissioner further directed that the DCsshould personally ensure that at least "five major demo-lition actions" should be taken in their respective zone ina month, the NDMC quoted him as saying in a state-ment.

On April 25, after the 7.9 Richter Scale earthquake hitNepal, several aftershocks were felt in the national cap-ital.

Experts have warned that if a quake of such high inten-sity originates in Delhi, it could spell doom for the city,where unauthorised constructions abound in severalparts.

In consonance with the NDMC's direction, illegallyconstructed portions of properties, mostly commercial,Sukhlal Market, Pitampura Pepsi Rood, HimgiriEnclave, Majlis Park, Sanjay Nagar, Ram Pura, MalkaGanj, among others were demolished.

From January 1, 2014 to March 31, 2015, a total of2,377 unauthorised constructions were booked, out ofwhich demolition action was taken against 876 proper-ties. Out of 1,856 demolition actions during the ongoingstage of illegal construction, two properties were fullydemolished while rest 1854 were partly demolished, itsaid.

next week its admission policy for theupcoming academic session with majorchanges likely on the cards, including forbringing the admission process online andintroducing a centralised policy for sportsquota admissions.

"A 23-member committee was formedby the varsity last month to review theadmission criteria ahead of admissions.

"After three extensive meetings anddeliberations on the proposed changes, thecommittee today submitted its recommen-dations to the university which will bereviewed by the Vice Chancellor," a seniorvarsity official said.

"Some major changes are expected inthe pattern and guidelines and the finalpolicy is likely to be announced nextweek," he added.

While DU is looking to make the entireadmission process online from the upcom-ing academic session, the policy for

admissions under sports quota is also setto be revamped.

"The committee has recommended thatinstead of colleges conducting separate fit-ness tests for admissions under sportsquota, the same should be centralised andbe conducted by the university," a com-mittee member said.

The admission process is likely to beginfrom June 2 and will be winded up byAugust 14.

DU had constituted the 23-membercommittee comprising the registrar, deansof various faculties, principals of variouscolleges and its Academic and ExecutiveCouncil members to look into the processof admissions for the various undergradu-ate courses for academic session2015-16.

The committee had in its earlier meet-ings decided to do away with any disad-vantage to the gap year students and saidthey will be treated on a par with freshschool pass-outs.

"It's a suggestion," a sen-ior Union minister saidwhen asked about the pos-sibility of referring theland bill to a joint commit-tee of Parliament afterintroduction.

Government earlier hadplans to bring the bill in

Lok Sabha today as it wasseeking to give anotherpush to the controversialbill despite not having thenumbers in the UpperHouse.

The bill, which waspassed by Lok Sabha inMarch, could not be taken

up in the Rajya Sabha fol-lowing which the relatedOrdinance had to be re-promulgated after prorogu-ing the Upper House.

A copy of the re-promul-gated ordinance wasplaced in the Lok Sabha onApril 20 and in RajyaSabha on April 23, theopening days of both theHouses in the second phaseof the budget session.

As part of the plan, gov-ernment yesterday hasextended the session ofLok Sabha by three days,after a meeting of CabinetCommittee onParliamentary Affairs.

Sources in governmentsaid that they will firstmake an attempt to get thebill passed in both Houses.

Aircraft project, in the worksfor over three decades, cameunder severe criticism fromCAG on Friday as it pointedout that its Mark-I version has53 "significant shortfalls"which have reduced its opera-tional capabilities as well assurvivability.

Not only that, IAF would be"constrained" to induct thefighter LCA without availabili-ty of a trainer model, thereby"adversely impacting pilot

training", the audit body said ina report tabled in Parliament.

The CAG noted that it wasdue to the delay in the manufac-ture and supply of LCA thatIAF had to go for alternativetemporary measures such asupgrading its MIG BIS, MiG-29, Jaguar, and Mirage aircraftat a cost of Rs 20,037 crore andrevise the phasing out of MiG-21s.

"LCA Mark-I, whichachieved Initial OperationalClearance (December, 2013)has significant shortfalls (53

permanent waivers/conces-sions" in meeting ASR (AirStaff Requirements) as a resultof which it will have reduced

operational capabilities andreduced survivability, therebylimiting its operational employ-ability when inducted into IAF

squadrons," the report said.Listing the shortcomings, the

CAG said that the LCA Mark- Ifails to meet the electronic war-fare capabilities sought by IAFas the Self-Protection Jammercould not be fitted on the air-craft due to space constraints.

Also, it said that the RadarWarning Receiver/CounterMeasure Dispensing Systemfitted on the aircraft had raisedperformance concerns whichare yet to be overcome tillJanuary this year.

It added that the shortcom-

ings in the Mark-I (increasedweight, reduced internal fuelcapacity, non-compliance offuel system protection, pilotprotection from front, reducedspeed) are expected to be over-come in the Mark-II model.

"LCA Mark-I does not meetthe ASR. The deficiencies arenow expected to be met in LCAMark-II by December 2018,"the CAG said.

While DRDO has alwaysshowcased LCA, christenedTejas, as an indigenously-developed aircraft and the

indigenous content of the LCAwas estimated by ADA to be 70per cent, the CAG said it "actu-ally worked out to about 35 percent" as of January this year.

Systems such as Kaveriengine, Multi-Mode Radar,Radome, Multi-FunctionalDisplay System and FlightControl System Actuators takenup for indigenous developmentcould not be developed suc-cessfully, resulting in LCA'scontinued dependence on theimport of these systems, CAGsaid.

NEW DELHIIndian Railways has not

been able to meet its opera-tional cost of passenger servic-es during the last five years,incurring a loss of nearly Rs.11,000 crore over this period,according to a report by theComptroller and AuditorGeneral of India (CAG).

The CAG in its latest reporttabled in Parliament today saidthe state-run transporterincurred losses in all categoryof passenger classes barringthe AC 3-Tier.

The loss incurred on opera-tional cost of passenger servic-es increased from Rs.15,268.41 crore in 2008-09 toRs. 26,025.46 crore in 2012-13, it said.

Railways was unable tomeet its operational cost ofpassenger services, increasedby 46.12 per cent during thelast five years as of 31 March2013, however, the expendi-ture under this head increasedby 55.31 per cent during thesame period, the report said.

The national auditorobserved that during 2012-13,there was a loss of Rs.

26,025.46 crore on passengerand other coaching services.The freight services earned aprofit of Rs. 33,221.24 crorewhich was utilised to compen-sate the loss of Rs. 26,025.46crore on operation of passen-ger services.

However, the Railways wasable to retain 21.66 per cent ofthe profit on freight earningafter subsidising the loss on

passenger services in 2012-13as compared to (-) 2.46 percent in the previous year,showing an improvement inthe operational profit.

It has found that all categoryof passenger services exceptAC 3-Tier incurred losses in2012-13.

All classes including AC-1,AC-2, AC Chair Car, Sleeper,Second Class, Ordinary and

EMU surburban servicesincurred losses during thisperiod barring AC-3. The pub-lic transporter earned profit inAC-3 class only. It earned Rs.494.99 crore profit in 2012-13.

Railways also witnesseddecline in operating ratio (per-centage of working expensesto traffic earnings). It deterio-rated to 93.60 per cent in2013-14 from 90.19 per cent in

2012-13.Net Surplus after meeting

dividend liability decreased toRs. 3,740.40 crore in 2013-14as compared to Rs. 8,266.25crore in 2012-13. It was lessthan the budget estimates by71.55 per cent.

The fund balances had alsodeclined from Rs. 15,654.68crore in 2008-09 to Rs.6,025.28 crore in 2013-14.

Indian Railways (IR) main-tains Depreciation ReserveFund (DRF) for replacementand renewal of existing assets.

Contribution to DRF was notmade on the basis of historicalcost, expected useful life andresidual life of the assets butwas dependent on the amountwhich the working expendi-ture could bear.

CAG has found a huge back-log of over aged assetsamounting to Rs. 47,310.94crore as on April 1, 2013, outof which railways had spentRs. 7,119.91 crore in 2013-14on replacement/renewal. Theremaining over aged assets inthe railway system wererequired to be replaced for saferunning of trains.

The report of theComptroller and AuditorGeneral (CAG) mentionsthat in April last yearIREDA management hadinformed the CAG thatPSKL settled its entire loanoutstanding as per OTS

(one time settlement)norms, he added.

"While settling therepayment of the loan asper the OTS norms withIREDA, PSKL furnishedall necessary documentsand replied to all theirqueries to their satisfac-tion," he said.

Earlier this month, thegovernment's auditor hadflayed state-run IREDA for"violation of financial

guidelines" in connectionwith a Rs 48.65-crore loanto the Nagpur-based PSKLfor which its promotersand directors includingunion Minister of RoadTransport, Highways &Shipping Nitin Gadkarihad given "personal guar-antee".

However, a source saidthat if opposition moves anotice on the issue, theMinister will reply on thefloor of the house and clearhis stand.

"He has nothing to hide.There has not been anyfinancial irregularities,"the source added.

On the charge thatIREDA could recover onlyRs 71.35 crore out of thetotal amount of Rs 84.12crore, Dive said the firmpaid over 84 per cent com-pared to an average recov-ery of 46.75 per cent of thetotal outstanding amount.

"The audit was conduct-ed on 29 firms, which hadsettled their loans throughthe OTS route. The recov-ery is low to an extent thatnot a single rupee of inter-est has been recovered in20 cases and in 9 cases theprincipal was also notrecovered," Dive said.

On disbursement of 25per cent of the loan amountin the first installment vio-lating IREDA's financialguidelines, Dive said it isIREDA's internal checksand balances and "how canPSKL be aware of them."

Mr Parsekar told PressTrust of India that theindustrial investment in thestate also includes twomarinas in Zuari river.

The local fishermen haveobjected to the marinas,fearing to lose their liveli-hood.

"We have allowed mari-nas with the condition thatthey should get all therequired clearances," thechief minister said.

The investment propos-als which have beencleared, include invest-ments in pharma, manufac-turing and tourism sector,he added.

With the total 38 propos-

als, the investment of Rs.2,138 crore has beenapproved which will gen-erate 6,500 jobs, MrParsekar said.

The state government, hesaid, has "made it manda-

tory that the industriesshould have at least 80 percent of its total employeesfrom Goa."

The chief minister saidthat the state governmentalso intends to promote theinvestment in theInformation Technology(IT) sector.

"We have organised anIT conference on May 22and 23 when state ITinvestment policy will alsobe released," he said.

Narendra Modi has defended hisgovernment`s decision to ban acontroversial documentary filmabout the fatal gang rape of awoman in New Delhi, saying itwas to ensure the dignity of thevictim was protected.

The film "India`s Daughter" -which features an interview withone of the men who raped andtortured a 23-year-old woman ona bus in December 2012 - wasbanned in March as his com-ments were considered to bederogatory towards women.

The director of the documen-tary, Leslee Udwin, said the banobstructed free speech, and crit-ics have said the move wasaimed at concealing widespreadmisogynistic attitudes in India.

In his first remarks about thecase, Modi told Time Magazinethat broadcasting the documen-tary would have "violated thedignity of the victim".

"I do not think it is a questionof freedom of speech, it is more aquestion of law and respectingthe victim and the judicialprocesses in this particular case,"told the magazine in an interviewpublished on Thursday.

The Narendra Modi Government clearly shares theproblematic relationship that its predecessor govern-ment of the UPA, especially towards the end of its

tenure, had with non-governmental organisations and peo-ple’s movements in general. What began primarily as acrackdown on organisations protesting against the nuclearpower projects in Kudankulam and Jaitapur, has since thenacquired a sharper edge. If UPA II barred a dozen NGOsfrom receiving foreign donations and contributions, the BJPgovernment has not only frozen their accounts but alsoblamed them for economic ills. An Intelligence Bureaureport apparently blamed them for the slump in India’sGDP. In other words, NGOs are the major stumbling blocksto the government’s avowed pursuit of development. Aclaim that some NGOs — make that Christian NGOs — areengaging in proselytisation has also been floated. The pres-ent government and its leading spokespersons never tire ofreiterating their strange position on conversions, also pro-jecting the possibility of bringing forward a law to curbthem. The crackdown on NGOs in terms of putting a freezeon foreign donations they receive, on the ground of ForeignContribution (Regulation) Act (FCRA) violations, is but amanifestation of the dim view the government has ofNGOs. U.S. Ambassador to India Richard Verma spoke atan event organised by a Delhi-based think tank of the chill-ing effect the government’s actions on this front may haveon civil society. Must all those who may have a dissentingview be identified as enemies of the state? By freezing theiraccounts, the government has almost forced the closure ofthe operations in India of Greenpeace, which was spear-heading the movement against a power plant in MadhyaPradesh. Bank accounts of the Ford Foundation and the Billand Melinda Gates Foundation and others are also seeming-ly under scrutiny. In a country, which as Ambassador Vermaestimates has some two million registered NGOs, the badpennies among them of course have to be tackled firmly.They should be held accountable for their actions underIndian law if any law is violated. Yet, as a nation India mustalso acknowledge the innumerable positive interventionsmade by NGOs, and their imprint on landmark Acts passedin Parliament. Whether it is about the Right to Food, Rightto Education or the National Rural Employment GuaranteeScheme, and the most fundamental of them all, the Right toInformation — which seeks to make the governmentaccountable to the public on its decisions — several keypieces of legislation owe in no small measure to NGO inter-ventions. The sledgehammer treatment now being metedout to NGOs does not behove this government. The clamp-down is nothing short of an extreme step. It will have thesame kind of chilling effect that a clampdown on freespeech will have.

The Fourteenth FinanceCommission’s recommenda-tion to increase tax devolution

to 42 per cent of the shareable pool oftaxes has increased the flow of untiedresources (or resources transferredwithout condition) to States.Estimates show that post the 14thcommission award, the untied statu-tory transfers would be more than 70per cent of the aggregate resourcetransfers from the Union to theStates. Although this increase in theshare of untied funds is a markedimprovement in the structure of atransfer away from a conditional toan unconditional one, it is time thatattention is paid to reform the transfersystem by focussing on non-FinanceCommission transfer to enable Statesto effectively utilise the enhanceduntied fiscal space. This can only bedone by reforming the coverage, con-tent and architecture of the non-Finance Commission transfers and afurther consolidation of schemes.This article discusses this importantissue and provides a possible wayforward keeping in view the recom-mendations made by the 14th com-mission in this regard.

Budget and non-FC transfers

A major issue, post Budget 2015-16, is the sharp decline in allocationsto the social sector in the form of var-ious conditional grants to the States.This decline has happened to accom-modate a large increase in tax devo-lution. As per the Budget estimates,enhanced tax devolution shouldresult in an increase in the flow ofuntied funds to the tune ofRs.1,86,150 crore and a reduced flowof grants to the tune of Rs.87,730crore.

This decline in grants has happenedin two categories: in a specified listof schemes where the Centre’s contri-bution has been reduced, implying acorresponding increase in contribu-tion by the States and for a set ofschemes where Central support hasbeen withdrawn. Important schemesin the first category are the Rashtriya

Krishi Vikas Yojana, the IntegratedChild Development Services (ICDS),Swacch Bharat Abhiyaan and alloca-tion for elementary education underthe midday meal schemes and theSarva Shiksha Abhiyan (SSA)financed by the Gross Budgetary

Support (GBS). Major schemesdelinked from Central support are theJawaharlal Nehru National UrbanRenewal Mission, the BackwardRegions Grant Fund and NormalCentral Assistance. The UnionBudget does not provide the detailsof the additional contributions Stateshave to make for schemes whereCentral support has been reduced.This change in the structure of grantshas also to be viewed in the contextof a restructuring of Centrally spon-sored schemes (CSS). Despite thisemphasis on restructuring and recom-mendations made by various commit-tees in this regard, nothing much hashappened on the ground. In fact, CSSand other conditional grants as a per-centage of GDP have increased from0.67 per cent in 2000-01 to 1.39 percent in 2015-16. Post the 14thCommission’s recommendation, thereduction in grants to accommodate alarge increase in tax devolution — ofwhich many are CSS — is certainly astep in the right direction. However,this reduction in grants in quantumwithout clarity on the design, archi-tecture and sharing pattern betweenthe Union and States has the follow-ing implications for States: a) reduc-ing the share of contribution of the

Centre to CSS has the potential toreduce untied fiscal space availablefrom higher tax devolution as Stateshave to make a higher contribution tothese schemes now; b) this reductiondoes not automatically imply thatStates are insulated from the condi-

tionalities and ‘one size fits all’ CSSintervention and the uncertaintiesassociated with CSS fund flow.

Why restructuring is critical

In the last decade, the proliferationof big-ticket CSS has emerged as thekey fiscal strategy to transfer grantsto States to achieve a certain outcomein a specific sector, especially inhealth, education, agriculture andrural development. Though themoney allocated under CSS hasdeclined, these schemes, if notreduced in numbers, and, in manycases, consolidated and restructured,may result in States having to fundthese schemes with a higher match-ing contribution. And, they may haveto bear the same burden of CSS con-ditionalities, reducing fiscal autono-my and the available untied fiscalspace.

Restructuring is not only importantfrom the perspective of Statefinances. It is also about getting theexpenditure priorities right for boththe Union and the State governments.As articulated in the 14th commis-sion’s report, “between 2002-05 and2005-11, revenue expenditure by the

Union Government on State List sub-jects increased from an average of 14per cent to 20 per cent, and onConcurrent List subjects from anaverage of 13 per cent to 17 per cent.This implies a reduction in expendi-ture, in percentage terms, on Union

List subjects. Expenditure functionsunder the Union List fall predomi-nantly under General and EconomicServices. The share of expenditure onthese has progressively declined from66.3 per cent in 2001-02 to 53.2 percent in 2014-15(BE).” One of the pri-mary reasons for this is the prolifera-tion of CSS, especially in the socialsector and on right-based spending.For better service delivery outcome,these need to change as most of thesefunctions are primarily in the func-tional domain of the States. TheUnion government should move itsfocus from spending on overlappingfunctional domain to subjects thatsquarely fall in the functional domainof the Union, as in the Union List,and limit its intervention on the ‘StateList’ and ‘Concurrent List’ on sub-jects of national priority having aconsideration of externality.

Kind of restructuring

There are 34 schemes listed in thecategory where Central support isfully provided for in the Budget. FullCentral support is not 100 per centCentral funding. In these schemes,States have to make a matching con-tribution as per the existing fund

sharing arrangement. The distribu-tion of resources allocation acrossthese schemes shows that out of 34schemes, the aggregate share of 15schemes works out to be 1.72 percent of the total grants, with a totalallocation of Rs.2,039 crore and anindividual share of less than 0.5 percent of the total grants. Schemes withan allocation of less than one per centare five and their aggregate share intotal grant works out to be 4.09 percent, with a total allocation ofRs.4,849 crore. There are 10 schemeswith an allocation of less than 10 percent and their aggregate share in totalworks out to 24 per cent of the totalallocation, where the total allocationis Rs.28,000 crore. In other words, 70per cent of the total allocation is forfour schemes, namely, the NationalSocial Assistance Programme, exter-nally aided projects, schemesfinanced from the PrarambhikShiksha Kosh and the MahatmaGandhi National Rural EmploymentGuarantee Scheme with a total allo-cation of Rs.82,775 crore. The num-ber of schemes with a changing shar-ing pattern is 20. But in many ofthese schemes, the number of pro-grammes under each category as anumbrella programme if considered,would total 56. In this case also,seven schemes account for 85 percent of the total allocation. The majorschemes in this category are theNational Health Mission, the ICDS,and schemes for agriculture and sani-tation. Since resources are thinly dis-tributed with a tiny allocation acrossmany schemes, it is time theseschemes are consolidated and madeinto a few national schemes in keysectors; minor schemes can bedevolved down to the States withfunds.

Principles of restructuring

Also, with a significantly highertax devolution to the States, much ofthe expenditure priorities would haveto align in a manner as envisaged inthe Constitution. Sectors where sig-nificant State spending rather than a“one-size fits all” Union governmentscheme would be more appropriate

are health, education, agriculture andrural development. Now, the largerquestion crops up. When States arethe major spending entities in thesesectors, as these functions fall prima-rily in the functional domain ofStates, should they not be given thefiscal autonomy to carry out theirown programme to address differen-tial needs? In this context, should onebe too worried about the decline inspending in the Union Budget forsome of these sectors? Instead, thefocus should be to reform the non-finance commission transfers tomake the transfer system transparent,efficient and fiscally non-intrusiveunless required. It is also time wetake a comprehensive view of spend-ing by taking the Union and Stateinterventions in sectors where Statesare the primary provider of servicesrather than focussing on what is allo-cated by the Union Government.

Finally, this is not to argue thatCentral intervention does not have arole to play in development spending.Rather, such interventions should belimited to a few national priorities.As articulated in the 14thCommission report, the Union gov-ernment is currently transferringaround 63 per cent of the shareablepool of taxes to States in the variousforms of transfers. The commission’srecommendations have left a fiscalspace to the tune of around 15 percent of the shareable pool for theUnion government’s intervention onsubjects of a national priority in thesocial and economic services. Thisfiscal space, as argued in the report,should be used in the framework of“cooperative federalism” with theactive involvement of States on thedesign, architecture and implementa-tion framework of such schemes toavoid the proliferation of a ‘one sizefits all’ CSS, as was the practice inthe past.

One of the more perplexingmoments on Season Four ofKoffee with Karan was when

Salman Khan made his first appearanceon the show and declared, “I am a virgin”.Host Karan Johar’s eyes popped, as dideveryone’s who’s read about the star’ssexual exploits. But Khan remainedgrave, as if he’d just announced he wasretiring from acting. Sneakily, Johar let usknow that Khan may not have beenentirely truthful. Earlier, he’d asked Khanabout girlfriends and the star had said hehad none. Johar smirked. Later, when heasked Khan how he handled ex-girl-friends if he bumped into them, Khan,forgetting he had none, said, “Some Iignore totally...” And we laughed.

But Balram Gehani didn’t. In BeingBhaijaan, a fascinating documentarydirected by Shabani Hassanwalia andSamreen Farooqui, this Salman Khan fanfrom Nagpur reveals that he liked theword “virgin” very much because Khanaccepted that’s what he was. As proof,Gehani said: Khan has never done a kiss-ing scene. And Gehani added, “I am 100per cent virgin and will remain one.”

The fact that a fan models his behaviouron a star is disturbing, but there’s more.Gehani believes India’s population isunder control because Bhai (Salman’spopular moniker) fans haven’t married.“That’s because Bhai himself hasn’t mar-ried. If Bhai gets married, at least 3-4crore men will get married. A year later,they will have children. The earth willtopple over and the world will end. He islike Vishnu’s avatar, who is balancing thewhole world on his finger.”

Gehani is exaggerating, but not much.Khan has been more or less god so far. Hewas god to the industry, balancing the boxoffice on his finger, summoning up block-busters out of thin air, thinner material.And he is certainly god to fans like ShanGhosh, who answers his phone with a ‘JaiSalman’.

After listing out the qualities of an idealwife, Ghosh says he doesn’t believe inlove. Bhai, after all, said that he wanted agirl just like his mother, and according toGhosh, “The marriage market doesn’t

have those kinds of girls anymore.”

Ghosh is from Chhindwara, about 3 anda half hours from Nagpur. His life hasmore bromance than romance. In the film,he tells Gehani he will come to Nagpur towatch the new Salman film with him. It’spractically a date. On his way there,Gehani wonders nervously, “How do Ilook? Will he be smarter than me?”

When Ghosh watches the Fevicol senumber from Dabangg 2, he is askedabout Kareena Kapoor. “I can’t even seeher,” he says. “If Salman Bhai is onscreen, I can only see him.” Ghosh notonly looks like Khan, he has chiselled hisphysique like Khan’s.

Gehani believes that building a Bhai-like physique is about masculinity. “If aman shows his body, he is successful. Itmeans he’s a man. If somebody beats up

two men, he’s a man. A man needscourage, and what gives him courage ishis masculinity”.

I asked Gehani if Khan’s sentencing hadmade him re-evaluate his fandom. He saidno. He explained what happened as“ooparwale ki marzi,” (god’s will.) Whichgod, he didn’t say.

wounded when Khan's Toyota Land Cruiserran over them while they were asleep on apavement outside a bakery in suburbanBandra on September 28, 2002.

"The normal rule is that when an appeal isadmitted and the sentence is under sevenyears, it (the sentence) is suspended. Why doyou (prosecution) want to depart from thisnorm?" Justice Thipsay said, rejecting prose-cution's contentions against the suspension ofsentence.

Since the term of the interim bail was toexpire this evening, the judge asked Khan tosurrender before the trial court, execute afresh bond of Rs 30,000 and furnish a suretyof the like amount for obtaining regular bail.

Anywhere between Rs 200 crore and Rs250 crore was said to be riding on the popu-lar actor and the court's order would come asa huge relief to the jittery Hindi film world,which kept its fingers crossed sinceWednesday's judgement of the trial court.

Hundreds of Khan's anxious fans had col-lected outside the high court and the actor'sBandra residence since early morning andthe mood was sullen.

Police contingents in riot gear deployed inboth places had a tough time regulating thecrowds that waited with bated breath for a'positive' outcome on Khan's appeal in thehigh court.

As the word came out that the high courthad stayed the sentence pending disposal ofKhan's appeal, exultant fans burst firecrack-ers, broke into a wild jig, hopped, jumpedand carried each other on shoulders, throw-ing traffic into disarray for a while.

Sweets were kept ready for celebrations inthe event of his prayer for bail being granted.Khan, who was at his Galaxy Apartmentsresidence in suburban Bandra, soon steppedout to loud cheers from delirious fans.

As the superstar, dressed in blue jeans,white shirt and sporting sunglasses, left forthe sessions court in his Mercedes SUV at thehead of a convoy of vehicles, jubilant sup-porters were seen sprinting in pursuit.

The crowds that had parked themselvesoutside the star's residence left only after hegestured them to return to their homes. Hefolded his hands in gratitude and waved atthem for a brief while before retreating fromthe balcony. His father, scriptwriter SalimKhan, mother Salma, brother Arbaaz and sis-ter Arpita also made a brief appearance onthe balcony with him.

While ordering Khan to be enlarged onbail, Justice Thipsay said he would expeditethe hearing on his appeal and posted the mat-ter for June 15.

While setting out the bail conditions, thejudge said Khan will have to obtain the per-mission of the court before travelling abroad.Khan's passport is with the Bandra police sta-tion and he hitherto he used to seek police'spermission before going abroad.

During the arguments on admission ofKhan's appeal, defence counsels Amit Desaiand Shrikant Shivade said the trial court hadfailed to appreciate the fact that four prosecu-tion witnesseses, including the investigatingofficer, had maintained there were four per-sons present in the Toyota Land Cruiserwhen the accident took place and that it wasthe family driver Ashok Singh who was at thewheel.

Prosecutor Sandeep Shinde, while insistingon denial of bail to the actor, countered thedefence's argument, saying it was only at thefag end of the trial that Salman Khan hadmade a statement under section 313 of CrPCin which he claimed it was Singh who wasdriving the SUV.

The actor has challenged the findings ofthe trial court that he was drunk and wasdriving under the influence of liquor. Salmanhas also pleaded that the trial court hadwrongly convicted him under the culpablehomicide charge because he had no knowl-edge that he would meet with an accident.Sessions judge D W Deshpande had on May6 held Khan guilty of "all charges" levelledagainst him by the prosecution.

"All charges have been proved againstyou...What you have to say? the judge askedSalman who was in the dock.

"I hold that you were driving the vehicle.You were intoxicated. I also do not agreewith your plea that the person who had diedhad received fatal injuries after a cranedropped the car on the persons underneathwhile removing it," the judge had said.

He was apparently referring to thedefence's claims that Singh was driving thevehicle at the time of the accident and thatthe victims had received injuries after a cranecalled to lift the SUV had failed to haul it upin one go and dropped it on them.

Apart from being convicted of culpablehomicide, Khan was also found guilty ofoffences under section 279 IPC (rash andnegligent driving) and sections 337 and 338IPC (causing hurt by acts endangering life orpersonal property of others), which pre-scribes six months jail.

Besides, he was sentenced to undergo jailfor six months under sections 181 (drivingwithout licence) and 185 of Motor VehiclesAct (drink driving).

was found guilty under the BombayProhibition Act under section 66 (a) and (b)for which he received two months imprison-ment and fine of Rs 500. All sentences willrun concurrently.

Reacting to the high court order, the wife ofNoorullah Shaikh, the lone person to havebeen killed in the accident, said she has nocomplaint against it but insisted that the fam-ily should be rendered help.

"The order is right. The accident hasalready happened, whatever should have nothappened has already happened and the per-son once gone will never come back. Wehaven't got justice. Nobody is coming to us,they should help us. I had to work in homesto feed my children and raise them," she said.

Her son said,"I think the verdict is fine.Now that Salman has got bail he is happy. Heshould then do something to eradicate ourpoverty."

Bollywood celebrities like Rishi Kapoor,Sajid Khan and Rohit Roy welcomed theBombay High Court's decision to suspendKhan's sentence and grant him bail.

Industry veteran Rishi Kapoor, back onTwitter after a very short absence due to theonline trolls, said, "Back. Welcome reprievefor Salman. Unprecedented reaction to thisnews."

Filmmaker Sajid Khan tweeted,"@BeingSalmanKhan bollywood, fans andhis critics will all have to agree to this..Salman Rules Fridays... I am very happy forthe Khan family," Sajid Khan said.

"Looks like someone up there heard all ourprayers," actor Rohit Roy posted. ActressAmeesha Patel, who visited Salman at hisresidence yesterday, posted, "So happy tohear the good news that @BeingSalmanKhanhas got bail. Prayers of all have beenanswered."

As Bollywood heaved a sigh of relief, for-mer Mumbai police Commissioner and nowBJP MP Satyapal Singh struck a discordantnote.

"I had said even yesterday, it is very diffi-cult for the poor to get justice in this coun-try," Singh said, adding "it is very difficult topunish those who wield influence".

been using OCR(optical character

recognition) technology toallow scanned documentsuploaded to the cloud stor-age service to be editedand indexed. Google onWednesday expanded theOCR capabilities withinGoogle Drive by addingsupport for over 200 lan-guages.

Google stressed that thereason to expand the OCRcapabilities is that most ofthe information in theworld is still stored inphysical forms (books,newspapers, and maga-zines among others) andnot digital. For the uniniti-ated, optical characterrecognition converts a dig-ital image with text intodigital documents usingcomputer algorithms.Images can be processed in(.jpg, .png, and .gif) files orin PDF documents.

The IS can rely on "avery large number of peo-ple" to promote their mes-sage online and "it canafford to have 2,000 peoplewho tweet 150 times aday," said J.M. Berger, afellow at the BrookingsInstitution.

"It can afford to have aratio of two or threerecruiters to every onepotential recruit who mightcarry out a lone wolfattack," Berger, who has

tracked the IS and otherextremist groups online,told the Senate HomelandSecurity committee.

The United States or oth-ers opposed to the IS willneed to deploy similarnumbers, and declassifyphotos, videos or otherintelligence that canexpose the failures of thejihadists in areas under itscontrol, Berger and otherexperts said.

Daveed Garstein-Ross, asenior fellow at theFoundation for Defense ofDemocracies, said "the USgovernment has to be ableto be more quick to react,to be able to respond at thesame kind of speed" as thejihadists online.

In some cases, falseclaims by the IS have beencarried by news media, andthe US government neededto quickly release informa-tion to show an accuratepicture that could undercutthe jihadists, hesaid.

letes, who survived an attemptedsuicide bid after alleged harass-ment by seniors at the SAI Centrein Kerala, are stable now even asa medical board was constitutedby the Sports Ministry to investi-gate the incident.

"We have constituted a medicalboard (for the inquiry into theincident) and our priority is tosave the lives of those athletes(girls)," Sports MinisterSarbananda Sonowal said on thesidelines of a conference inDelhi.

In a tragic turn of events, ayoung athlete AparnaRamabhadran died and three ofher colleagues were battling forlife after they ate a poison fruitunder an apparent suicide pactfollowing alleged harassment byseniors at the Sports Authority ofIndia centre in Kerala.

All the four were undergoingtraining at the Water SportsCentre of the SAI in Alapuzha.

A stunned Sports Ministryswung into action by ordering aninquiry and directing SAIDirector General Injeti Srinivasto rush to Kerala for an on thespot assessment.

The condition of the three ath-

letes, who survived the attempt,is said to be stable. Kerala HomeMinister Ramesh Chennithala,

who visited the girls at the hospi-tal, promised an unbiased probe.

Alapuzha Medical collegeHospital superintendent SantoshRaghavan told PTI that the threegirls continue to be critical, buttheir condition had stabilised.However, there is no specificantidote for the poison they con-sumed.

Aparna, the girl who lost her

life, had been undergoing train-ing at the water sports trainingcentre of Sports Authority of

India for the past five years.Her mother Geeta said her

daughter continued in the hosteldespite the harassment becauseof the family's circumstances.

Aparna wanted to get a job toprovide a better life to heryounger brother, an eighth stan-dard student at a local school.While her father is a worker in ahouse boat, her mother is an

anganwadi worker. All the fami-ly's hopes rested on the rowingchampion, who had brought lau-rels to the state.

Geeta said Aparna had told herabout the "mental and physicalharassment" meted out to themby seniors at the SAI hostel whilefighting for life at the hospital.

"Mother please forgive me. Idid this due to harassment of sen-ior 'chechis' (elder sisters). Will Inot survive?," Aparna was quotedas saying by her mother hoursbefore she breathed herlast.

Geeta also said her daughterhad no intention of committingsuicide, but took the extreme stepas there was no other optionbefore her following the continu-ous harassment. "My daughterhad come home for 'Vishu' festi-val on April 15 and had told me itwas difficult to share a room withthe seniors. When the hostel war-den was informed, she had prom-ised to shift her to another roomwithin three months".

But Geeta said her daughterlater gave the impression that allwas well at the hostel as she didnot want to cause any worry toher parents. "But in the hospitalbed, while battling for her life,my child told me the truth about

the seniors. Two seniors used toconstantly harass Aparna and theother girls, due to which theyconsumed the poisonous fruit,"Geeta said. The senior athletes,who have been accused ofharassment by the girls, claimedthat they did nothing that couldhave caused any stress.

"They are saying that weragged them and gave them a lotof trouble. On Saturday, we hadkept a small party to celebratewinning medals at the NationalGames. At night, some of theseathletes brought beer into theirrooms. The girl who died, someof her friends gave them beer.None of us even knew about itbut the word spread that thesegirls were drinking and somehowour madam found out," said oneof the senior athletes.

Meanwhile, Kerala HomeMinister Ramesh Chennithalasaid the matter is being investi-gated but the priority remainssaving the survivors.

"The priority is to look afterand give all medical facilities tothe girls. second part is the inves-tigation and it's not proper on mypart to say anything at this time.But there will be an impartialinquiry which will reveal the rea-sons of this suicide.

If you feel tired and drowsythe whole day even after agood night's sleep, it could be

due to obesity and depression, anew research has found.

Obesity and depression -- notonly lack of sleep -- are underly-ing causes for regular drowsi-ness, the findings showed.

"Obesity and weight gain pre-dicted who was going to havedaytime sleepiness," said JulioFernandez-Mendoza, assistantprofessor of psychiatry at thePenn State College of Medicinein the US.

"Moreover, weight loss predict-ed who was going to stop experi-encing daytime sleepiness, rein-forcing the causal relationship,"Fernandez-Mendoza noted.

The association between bodymass index and sleepiness wasindependent of sleep duration,meaning obese people may be

tired during the day, no matterhow much they sleep at night.

The primary underlying mech-

anism that makes obese peoplefeel overly tired is likely low-grade chronic inflammation. Fat

cells, particularly from abdomi-nal fat, produce immune com-pounds called cytokines that pro-

mote sleepiness, among othereffects.

The researchers measured self-reporting of excessive daytimesleepiness (EDS) at baseline andagain an average of 7.5 yearslater in 1,395 men and women.

Depressed individuals in thestudy also had high incidence ofEDS. Physiologic sleep distur-bances, including taking longerto fall asleep and waking up inthe middle of the night, explainedtheir daytime drowsiness.

Feeling overly tired during theday can reduce job productivityand increase errors and absen-teeism and may lead to more seri-ous issues like automobile acci-dents.

These findings could lead tomore personalized sleep medi-cine for those with EDS.

The researchers published theirfindings in the journal Sleep.
