1. The Lord Mayor opened the meeting by expressing sympathy on her own behalf and on behalf of the City Council to Councillor Bill Tormey on the recent death of his father, Philip. The City Council observed a minute’s silence as a mark of respect. Councillor Tormey expressed his appreciation of this gesture of sympathy.

The Lord Mayor then welcomed the members of the Youth Group from the Bay Centre in Ballyfermot who were in the public gallery observing the meeting as part of their project on democracy.

She then congratulated the Fire Brigade, Gardai and City Council staff on their conduct over the Hallow’een weekend, commending the performance of all three. She also expressed appreciation of the tremendous effort put in by many Community Groups and City Council staff to provide safe alternative activities. The City Council agreed to suspend Standing Orders to take the following Emergency Motion without debate. This motion was submitted in the names of Councillors D Ellis, C Burke, L O'Toole and S McGrattan :- “That this Council praises the courageous work and commitment of Dublin Fire Brigade, City Council staff and the Gardai over the Halloween period and sends our best wishes to anyone injured in the line of duty. This has resulted in a reduction in the number of instances and a decrease in the number of bonfires due to the vigilance and good work of everyone concerned”

2. Ceisteanna fé Bhuan Ordú Úimhir 16 -– It was moved by Councillor C Burke and

seconded by Councillor L O’Toole “That Dublin City Council approves the Dublin City Manager answering the questions lodged”. The motion having been put and carried, written answers to the 142 questions lodged for the City Council meeting of the 2nd November were issued. The Questions and Answers are set out in Appendix A attached.

3. Submitted Letter dated 18th September 2009 from Superintendent John McCaughan

of the Police Service of Northern Ireland in response to a motion from 7th September 2009 City Council Meeting. It was moved by Councillor G Breen and seconded by Councillor C Ni Dhalaigh “That Dublin City Council notes the contents of this letter”. The motion was put and carried.

4. Submitted Letter dated 1st October 2009 from Clonmel Borough Council conveying

the terms of a motion agreed at their September Meeting calling on the government and Minister for Social and Family Affairs to reverse the decision not to pay the Christmas bonus to Social Welfare recipients. It was moved by Councillor G Breen and seconded by Councillor C Ni Dhalaigh “That Dublin City Council notes the contents of this letter”. The motion was put and carried.

5. Submitted Letter dated 9th October 2009 from Muinebheag Town Council conveying

the terms of a motion agreed at their October Meeting calling on the Taoiseach and Minister for Social and Family Affairs to publish the National Carers Strategy as committed to in the Social Partnership Agreement – Towards 2016 and in the programme for government as a matter of principle. It was moved by Councillor G Breen and seconded by Councillor C Ni Dhalaigh “That Dublin City Council notes the contents of this letter”. The motion was put and carried.

6. Submitted Letter dated 13th October 2009 from South Tipperary County Council

conveying the terms of a motion agreed at their October Meeting calling on the government to waive VAT on specialised items of medical equipment where the purchase is being funded through voluntary fundraising. It was moved by Councillor G Breen and seconded by Councillor C Ni Dhalaigh “That Dublin City Council notes the contents of this letter”. The motion was put and carried.

7. Submitted Letter dated 14th October 2009 from Shannon Town Council conveying

the terms of a motion agreed at their October Meeting calling on the government to set up a separate redress scheme for women detained in Magdalene Laundries as demanded by the survivors. It was moved by Councillor G Breen and seconded by

the terms of two motions agreed at their October Meeting – one calling on the ESB to resume the previous practice of Meter Readers leaving cards for absent householders to enter their meter reading and post same to the ESB; and the second motion opposing the threat to the existence of Town Councils as proposed by an Bord Snip Nua (McCarthy Submitted Report ) and sentiments of Minister John Gormley on the same subject. 16. To appoint Members of the City Council to the bodies, as listed below, where

vacancies remain to be filled following nominations approved by the Area Committees in September/October:

• Appointment of Councillors John Gallagher and Eric Byrne to the Dublin City Joint Policing Committee from South Central Area following their October Area Committee Meeting.

• Appointment of Councillor Mannix Flynn to the Dublin City Joint Policing Committee from South East Area following their September Area Committee Meeting.

• Appointment of Councillor Gerry Breen to the Dublin City Joint Policing Committee from North Central Area following their October Area Committee Meeting.

30. Submitted Report No. 447/2009 of the Chairperson of the Transportation and Traffic

Strategic Policy Committee (Councillor A. Montague) – With Reference to Draft Bye-Laws Entitled “Dublin City Council Parking Control for Major Events (Croke Park) Bye Laws 2009” While the Members acknowledged that there is support from some local residents for this proposal, they were also aware that an opposing view is held by many other residents in the wider surrounding area. Many Members expressed the concern that adopting these Bye-Laws would only serve to push the parking problems further back into the surrounding hinterland. It was felt that this solution might create a new set of problems for the area. The need to encourage the use of public transport on ‘Match Days’ was highlighted and the introduction of special fares was suggested. It was further suggested that all stakeholders, including the GAA, Gardai, and Residents should come together to work on finding a solution to the problem. A roll call vote was agreed to by the City Council and the proposal to make Bye-laws Entitled “Dublin City Council Parking Control for Major Events (Croke Park) Bye Laws 2009 was defeated. At this point, the City Council agreed to take Motion No 61 referred from September South East Area Committee Meeting “That Dublin City Council will work with Lansdowne Road Stadium and other major event venues in the city to bring about the acceptance of match day tickets or concert tickets for travel on Dublin Bus, Luas and Dart on match day or concert day. This could be financed by putting a small additional charge on tickets. Yet it would make a significant reduction in traffic, parking and improve the environmental sustainability of these venues” The motion was agreed without debate.

32. Submitted Report No. 491/2009 of the Assistant City Manager (P. Maguire) –

Report of the Dublin City Joint Policing Committees. It was proposed by Councillor D Lacey and seconded by Councillor G Breen “That Dublin City Council notes the contents of Report No 491/2009 and hereby appoints the nominees to the Joint Policing Committees as outlined in the report” The motion was put and carried. The City Council commended the contribution of Councillor Marie Metcalfe who was a member of this committee in a voluntary capacity before becoming a Member of the City Council.

33. Submitted Report No. 452/2009 of the Dublin City Manager – Report on Bus Priority

Scheme at College Green. It was proposed by Councillor A Montague and seconded by Councillor K Humphreys “ that Dublin City Council adopts Report No. 452/2009 of the Dublin City Manager – Report on Bus Priority Scheme at College Green”

During the discussion on the motion, Members welcomed the increase in safety for cyclists and the increase in the numbers cycling and especially using the Dublinbikes. While the concerns of the local traders were taken very seriously, it was felt that there was not enough evidence to link this to the introduction of Busgate and that there were other contributory factors to the reduction in trade such as the general economic downturn and parking costs. It was pointed out that trade is down on Saturdays when Busgate does not operate. The reduction of travel times that has resulted from this initiative has been in the region of 30/40 minutes and this was very much welcomed by several Members.

Some Members were concerned about loss of jobs in the City Centre if trade in the Christmas shopping period did not improve and felt that suspending the operation of Busgate for the suggested period would be seen to be a favourable step. It was accepted that this was a suspension only for the specified time and that the traffic situation would revert to normal on the 15th January 2010. The motion was put to a roll call vote and carried. The City Manager assured the Members that the re-instatement of the Busgate would be automatic in January and that the opening of Macken St Bridge would greatly relieve any traffic congestion. He also informed the Members that the Busgate Review would now take place later to accommodate the 8 weeks gap in operation.

and it went to Glassco for €400,000. The 4 men effected in Oxigen whose job at the moment is to do this work are seeking the TUPE (transfer of undertakings). There appears to be a problem with the new contract fully recognising the TUPE. The new contractor has issued a contract that is in line with the TUPE agreement in practically everything EXCEPT their service in Oxigen. On Friday the new contracter declared in writing that "the employees do not have any right to TUPE and therefore he will not allow it to apply". It should be noted that the recent contractor for the green bin collection recgonised TUPE for over 200 workers from Oxigen. This Council does not accept this race to the bottom and workers losing their jobs because the contract went to one of the lowest tenders. Dublin City Council will not force redundancy upon any of its directly employed workers and will use all available methods of retaining its employee” The motion was put and carried.

this City Council calls upon the City Manager to provide "children at play" signs free of charge and erect them in areas where needed. Why is it that dog litter signs can be put up free of charge all over the city but residents associations have to pay for "children at play" signs. In light of present attitudes to children and the rights of the child what message is this sending out from a public authority? The motion was put and carried.

90. The City Council agreed that a report be sent to Councillor M Conaghan on the

following motion standing in his name at Item no 54 on the Agenda Paper “That this City Council calls on the Manager to withdraw the letter to tenants notifying them of the new seriously restricted housing maintenance arrangements as these proposed arrangements are impractical, unwise, unworkable and have far reaching health and safety implications for tenants and would, if implemented, undermine a very valuable asset of the City Council, i.e. its significant housing stock”

The 3 other Dublin Councils would have similar or more housing in this condition That this is done on the grounds that it costs approximately €20,000 per year for every worker forced into unemployment because of the current economic crises. In Dublin City Council there are over 7,000 housing applicants residing in private accommodation. The rent supplement from the state would be at minimum €800 pm per dwelling. That is approx €10,000 per dwelling per year. The savings accrued by the state and monies accrued by the

CITY MANAGER’S REPLY: In response to the question raised, this Department has analysed the questions for July, September and October 2009 inclusive. On average approximately 59% of the questions submitted during these 3 months could have been dealt with by the Area Committee as they relate to local issues to a large extent. However it is clear that submitting questions to City Council meetings provides Councillors with an opportunity to clarify issues of a local nature, having regard to the fact that they may have already used their quota of questions to their respective Area Committee meetings. There is no additional cost to Departments with the exception of staff time (carried out during normal working hours) and routine printing costs. No overtime is approved for this purpose.

Q2. COUNCILLOR RUAIRI MCGINLEY To ask the City Manager to URGENTLY liaise with CIE on obtaining factual

data on impact of Dublin Bus of Busgate introduction and in particular if Dublin Bus revenue has improved or disimproved over the period from July - October indications are that Dublin Bus revenue has disimproved, contrary to what might have been expected.

Q6. COUNCILLOR TOM BRABAZON Can the Manager give a breakdown of the budget allocation for tree pruning

for Dublin City, and break it down for the 5 administrative areas in the City and say how much of it has been spent this year on tree pruning operations? CITY MANAGER’S REPLY: Tree pruning is carried out both by direct labour and contracting. During the dormant season, when grass cutting is not a major part of the Works Programme, many of the Parks Direct Labour staff are engaged in tree works including pruning. It is not possible to accurately provide an estimate of the cost of these direct labour works on a city or area-by-area basis. The budget for tree pruning carried out by contract is expended on those parts of the city where need is greatest as determined by the number, scale and condition of trees. The Budget is not allocated on a geographical basis but on the basis of arboricultural criteria. As a guide approximately €100,000 was expended on contract tree pruning in 2009, with €20,000 being expended on average in the 5 administrative areas.

Q7. COUNCILLOR TOM BRABAZON Can the Manager give an update on progress for the installation of proper

dishings on the footpaths at (details supplied)? CITY MANAGER’S REPLY: Road Maintenance Division examined this location. There are no works scheduled for (details supplied). However, we will inspect this location when selecting works for the 2010 Road Maintenance Major Works Programme.

Project selection is based on footpath / carriageway condition and on budget restrictions.

Q8. COUNCILLOR SEAN KENNY To ask the Manager to demand an explanation from Greyhound Recycling as

to why their green bin collections at Redmonds Court, Kilbarrack, has repeatedly failed to take place on the dates notified to residents. CITY MANAGER’S REPLY: The City Council has instructed Greyhound Recycling as a matter of urgency to ensure that the collections at Redmonds Court take place on the scheduled dates. In addition the Council has requested a detailed report on the matter and this will be forwarded the Councillor. The City Council would like to apologise to the residents concerned for the

inconvenience caused.

Q9. COUNCILLOR CHRISTY BURKE To ask the City Manager that there will be no cuts in the funding for disabled

persons grants in the 2010 Budget.

CITY MANAGER’S REPLY: Dublin City Council is currently in the process of preparing the estimates for 2010. The funding available is reliant on the allocation that Dublin City Council receives from the Department of Environment, Heritage and Local Government. It is not foreseen at this stage that there will be less funding in 2010.

Q10. COUNCILLOR CHRISTY BURKE To ask the City Manager if Dublin City Council will be in a position to

complete the Homeless List by 2010 and if the City Manager will include the homeless staff at Civic Offices in any works in this homeless area.

CITY MANAGER’S REPLY: One of the main points in the “Pathway to Home” document to assist long-term homelessness is the Housing First model which requires that Homeless Persons be housed in the first instance with the Housing Support/Tenancy Sustainment built in to ensure that the person/family unit is capable of sustaining the tenancy. This is a common approach throughout Europe and parts of America and has/is proving very successful. This system has never been used on any real scale in Ireland to date. The contract for the support services is about to be awarded. In determining to use the Housing First model it means that all large Transitional Projects as we know them will be phased out. All Transitional providers have been interviewed and informed of the position. It is proposed to interview them again in the next few weeks to determine how quickly they can reconfigure their service into long-term support accommodation. It is expected that upwards of 380 family units will be reconfigured into long-term supported accommodation in the next 2-3 months. The placement of Homeless Persons in either temporary or more long-term accommodation is clearly a statutory function of the local authority. Discussions are ongoing with the management and representatives of the Community Welfare Section of the HSE, which currently provide the service on behalf of the local authority, for a satisfactory and client focused transfer of this section back to Dublin City Council and the other local authorities in the Dublin area. Circular AHS1 2009 from the Department of the Environment, Heritage and

Local Government outlines measures to deal with unsold Affordable Homes in response to the challenge posed in selling such homes.

The strategy being undertaken is that unsold Affordable Homes will transfer to

social housing for a period of five years. It is not intended that the units transferred would by default become social housing and they will be subject to review after the five-year period.

This transfer will be implemented in two phases. Phase 1 will entail the transfer of 148 homes, with 52 assigned to RAS and 145 to Social. Phase 2 will entail the transfer of a further 153 homes, with 8 assigned to RAS and 145 to Social. It is currently proposed that 34 of these homes will be reserved for applicants from the Homeless List. The remainder will be allocated to applicants from the Housing and Transfer Lists. As you can see from the above the use of unsold affordable housing stock to eradicate Homelessness will be only a very small percentage of the unsold affordables transferred over to the Social Housing stock. It is expected that outside of the reconfigured Private Emergency Accommodations and Transitional Housing, leasing will be the main provider in ending the use of Private Emergency Accommodations at a very high cost to satisfy the needs of long-term Homelessness. As can also be seen from the above large numbers of unsold affordables that would not have otherwise been available to the Social Housing list except for the downturn are being assigned to deal with the housing list. The Homeless situation where upwards of 1,000 to 1,200 peoples are in emergency accommodation at a huge cost to the state, in some cases for upwards of 8 years, is totally unacceptable. No value long-term is being gained in the financing of private emergency accommodation and this approach is the stated policy of the Minister for the Environment with responsibility for housing and, indeed, at the highest level in the Department of Environment, Heritage and Local Government.

Q11. COUNCILLOR CHRISTY BURKE To ask the City Manager how many flats, houses and S. C. units are vacant in

the City of Dublin and when the City Manager hopes to have units back in housing stock given the large increase in housing applicants this year.

CITY MANAGER’S REPLY: At present there are 760 dwellings vacant out of a total housing stock of

26,795. Vacant dwellings represent 2.83% of the total housing stock. The figure of 760 can be broken down as follows:

Apartments 353 Houses 161 Senior Citizen 235 Maisonettes 11 The condition of the dwelling determines the length of time it is under repair. The average turn around time is 21.5 weeks. Bedsit units can remain vacant for long periods of time as some are difficult to let. Dwellings for Demolition and Refurbishment have been excluded from the above figures.

Q12. COUNCILLOR CHRISTY BURKE To ask the City Manager if funds for road reinstatement will be made

available for works on reinstatement off Castleforbes Road, Dublin 1. CITY MANAGER’S REPLY: There are a number of trenches on Castleforbes Road that require permanent reinstatement. The reason for not permanently reinstating them thus far was due to the LUAS Works and also the amount of construction works in the area.

Q15. COUNCILLOR DAMIAN O’FARRELL I met with Declan Wallace and Mike Ryan recently regarding the disposal of

some land to the rear of, (details supplied). I accept that the disposal has been passed by DCC and contracts have been exchanged. However I would like to ask the following question: Would the City Manager not be concerned (for the reasons set out below) with the sale by DCC of this plot of land for development that has both the following conditions attached? • Subject to receiving planning permission from DCC. • For a sale price of € 40,000 to DCC. Would it not be possible that any objectors to the planning application who, not being aware of the conditions and having paid their objection fee in good faith, might feel that DCC is attempting to influence the planning process? i.e. if the Planning Dept of DCC doesn’t pass the application in some form, DCC will not receive any money (and furthermore could risk losing the land for nothing as the applicant may have an ownership claim on such land in any case.)

CITY MANAGER’S REPLY: The Planning Department considers planning applications on their merits having regard to the City Development Plan and the proper planning and development of the land in question. Any terms and conditions attached to a proposed disposal are not considered by the Planner dealing with the application. In the event of planning permission not forthcoming for development on this site, the method and nature of the proposed disposal can be revisited to reflect that reality.

I understand in this case additional information has been sought by the planner from the applicant. If and when the information is received a decision on the application will be made based solely on the proper planning and development of the area.

Q16. COUNCILLOR ERIC BYRNE Will the Manager please follow up on residents’ complaints that rats are to be

seen in the area of Stanford Green/ Balfe Road, Walkinstown, Dublin 12, and that the source of the infestation be located and dealt with. And will he make a statement on these requests?

CITY MANAGER’S REPLY: The Environmental Health Section in Dublin City Council has no statutory powers in relation to rats. The Rats and Mice (Destruction) Act 1919 is enforced by the Environmental Health Section of the Health Service Executive, located at Block E, Westland Park, Nangor Road, Dublin 12, Complaints, inspections and subsequent enforcement action in relation to rats are a matter for the HSE to investigate and take the appropriate action. This complaint has been referred to them for their attention and appropriate action.

Q17. COUNCILLOR RUAIRÍ MCGINLEY To ask the Manager to take further steps to deal with the rat infestation at

(details supplied).

CITY MANAGER’S REPLY: The Area Maintenance Officer has called on a number of occasions to this dwelling and remedial work has been carried out. He will also make a further call. However it should be noted that the dwelling next door is a privately owned house and, therefore, Housing Maintenance does not have access to inspect, or have responsibility for, carrying out any works to this dwelling, which may assist our tenant.

Q18. COUNCILLOR KEVIN HUMPHREYS To ask the Manager for the provision of a bicycle rack at the ramp at the

beginning of the Nature Walk.

CITY MANAGER’S REPLY: Roads and Traffic Department are currently surveying the location, number and condition of cycle stands cross the city. The survey has yet to reach the Sandymount area. Demand for additional cycle parking facilities is clearly evident in many areas of the city. It is our intention to apply to the Dublin Transportation Office for funding for a significant expansion of bicycle parking before the end of the year.

Q19. COUNCILLOR ERIC BYRNE To ask the Manager, in light of the increased awareness and need for the

heating welfare of our Senior Citizens' and in the light of the Q & A of his in 2005 (See attached, details supplied), will he please agree to have installed the insulation to this mans' roof and will he make a statement on this request?

All School Warden uniforms conform to EN471 standards and are made of breathable waterproof fabric to best international practice.

All School Wardens are supplied with the uniform upon appointment and issued thereafter with additional protective clothing upon request by the School Warden and Area School Warden Supervisor.

Q25. COUNCILLOR CRĺONA Nĺ DHÁLAIGH To ask the City Manager what, if any, is the City Council’s regard to rehousing

victims of domestic abuse and if none exists could a policy or code of practice be put into place to deal with victims of domestic abuse in need of rehousing? CITY MANAGER’S REPLY: Dublin City Council recognises that the issue of domestic violence is a complex social issue, and the needs of abused women cannot be addressed by any one sector. Dublin City Council is therefore committed to working with a number of other agencies to develop an appropriate response to the accommodation needs of women who have experienced domestic violence.

Dublin City Council’s Allocations Officer is a member of The Eastern Regional Planning Committee on violence against women, which was established in 1997 as part of the first national strategy to address domestic violence. The committee produced its report “Housing Policy and Practice for Women Experiencing Domestic Violence” in March 2006. A Dublin City Council representative also meets regularly with the three other Dublin Local Authorities, the HPU and the Homeless Agency to discuss the implementation of Action S14 from “ A Key to the Door – The Homeless Agency Partnership Action Plan on Homelessness in Dublin 2007 – 2010” which states: - “The four Local Authorities will clarify and co-ordinate a shared definition of homelessness in consultation with the voluntary service providers and the Health Service Executive, including consideration of issues relevant to domestic violence, in relation to the policy and practice relevant to applications from homeless people for priority on local authority housing lists”

The majority of women leaving home because of domestic violence initially present to a Refuge; there are currently three Refuges in the Dublin area, which provide a total of 24 spaces for women leaving domestic violence. However as an area of last resort some women will be referred to B&B accommodation.

Dublin City Council recognises that an offer of permanent accommodation is not always the most appropriate response to the issue of Domestic Violence; a number of women return to the family home following a period of respite in a refuge, others will re-establish their relationship once they have been re-housed by a Local Authority. It is therefore vital that women have access to appropriate supports.

To this end Dublin City Council maintain a close working relationship with Sonas Housing Association, a transitional housing provider who specialise in providing support and accommodation for women who have experienced domestic violence. Sonas Housing has six sites in Dublin comprising 63 housing units, 22 of which are permanent. Dublin City Council are committed to providing move on accommodation for families who have completed the Sonas programme and to date house approximately ten families moving on from Sonas each year.

Q26. COUNCILLOR CRĺONA Nĺ DHÁLAIGH To ask the City Manager why, (details supplied), has been given the run around by the Council with regard to his request to go on the housing list. He is separated from his wife and has returned to his family home which is severely overcrowded. He cannot afford to rent privately and cannot go into a hostel as he works shifts. He is trying to get permission to reside but accepts that as the complex is due for demolition that he will not be considered for housing under detenanting. All he wants is to be able to go on the housing list in order that he can be considered for a voluntary housing unit somewhere.

CITY MANAGER’S REPLY: According to our records, the last application to reside at the above-mentioned address from the applicant (details supplied) was in January 2006. The applicant should be advised to make a new application to reside at this address at his earliest convenience. Alternatively, the applicant will have to source private rented accommodation or register on the Homeless List so as to enable his application to be considered for housing/voluntary accommodation.

Q27. COUNCILLOR CRĺONA Nĺ DHÁLAIGH To ask the City Manager if there is policy in place in the Council to disallow

single/separated fathers with part custody of their children to be considered for a house and only to be considered for a flat/apartment. If he could also confirm that a single/separated father who has 2 children and a new partner where given the right information when a Council Official told them that they will only be considered for a one bed flat as they only had the children part/time?

CITY MANAGER’S REPLY: The City Council’s Scheme of Letting Priorities outlines policy in this regard.

There is provision within the Scheme for applications from estranged parents for suitable accommodation to facilitate access to their children to be considered by the City Council. Applicants in this particular category who are in genuine need may be awarded bedroom shortage points up to a maximum of 32 where lack of suitable accommodation prevents access to children. The City Council would have to be satisfied of the need on a case-by-case basis and at its discretion the letting of suitable accommodation will be made.

This approach ensures that the City Council adheres to its policy of appropriate allocation and full utilisation of all its housing stock. To expand on a Council Official’s reply and to give a definitive answer on a specific case the court custody document would need to be examined. If the Councillor wishes to discuss this case please contact Allocations for further assistance.

Q28. COUNCILLOR VINCENT JACKSON Can the Manager please indicate when replacement works for the roof of

Ballyfermot Library will commence as I feel we need a definite time span of when the Library will re-open? I am aware funding is down dramatically but can some funding be provided to re-paint the facility, new floor coverings etc.

CITY MANAGER’S REPLY: Access improvement works are scheduled to begin in November which, as well as improving access, will also provide a refurbished main entrance to the library. As yet, a number of options are being considered in relation to the roof repairs required. At this point the timescale for the works has not been finalised. However it is hoped that roof works will follow on as soon as possible after the completion of access works at the branch. Libraries Section have been advised that carrying out decorative works, such as new flooring and painting prior to the roof repairs, could result in such improvements being damaged. Painting and decorating to augment the investment made in new furniture and equipment prior to the closure can be carried out once the roof repairs are complete.

Q29. COUNCILLOR VINCENT JACKSON To ask the City Manager that Dublin City Council please ensure that ZEBRA

crossing outside the Main Entrance of Tesco, Ballyfermot is repainted as it is very badly worn. In addition, all the traffic islands along Ballyfermot Road from Cherry Orchard Hospital to Sarsfield need re-painting as it very hard to see them in bad weather. All the road ramps in the adjoining estates have very badly worm markings again needing attention.

CITY MANAGER’S REPLY: The Zebra crossing in question is not within the jurisdiction of Dublin City Council and is the responsibility of Tesco as Dublin City Council has not taken this road in charge. However, the Ballyfermot Area Office will contact Tesco with a request to repaint the crossing. Regarding the repainting of traffic islands along Ballyfermot Road from Cherry Orchard Hospital to Sarsfield Road, this matter has been referred to the Area Traffic Officer for inspection and re-painting as required.

Q30. COUNCILLOR VINCENT JACKSON In view of the fact head injury from cycling is increasing as more use cycling

as a form of transport, that Dublin City Council ask the Minister for Transport what the legal requirements are for the wearing of safety helmets and hi-visibility jackets. These simple measures would save many peoples lives and potential life threatening injuries.

CITY MANAGER’S REPLY: There is at present no legal requirement for the wearing of safety helmets or hi-visibility jackets by cyclists. A copy of the Councillor’s question has been forwarded to the Minister for Transport for comment.

Q31. COUNCILLOR VINCENT JACKSON To ask the City Manager that Dublin City Council try and ensure that the Park

on Drumfinn Park is repaired and subject to regular maintenance. It was re-furbished approx. 8 years ago and since then has had little ongoing repairs.

CITY MANAGER’S REPLY: Drumfinn Park is maintained by Parks and Landscape Services Division to a reasonable standard with litter removed on a twice-weekly basis. Repair work to the park is undertaken as required.

Q33. COUNCILLOR KEVIN HUMPHREYS To ask the Manager when will the Pipe Assembly Area be returned to its

The Pipe Assembly Area in question is owned by Dublin Port Company and was used by Laing O’Rourke until May of this year for a Water Rehabilitation

Project. Any works now required at the site are a matter for the Dublin Port Company.

Q34. COUNCILLOR REBECCA MOYNIHAN To ask the City Manager to supply the breakdown of

- occupied and unoccupied private units in Herberton project, - occupied and unoccupied affordable units in Herberton, - occupied and unoccupied City Council dwellings in Herberton. CITY MANAGER’S REPLY:

refused access to him to inspect the reported crack in the fireplace. He also confirms that the glass will be replaced in the front window.

regarding path repairs at (details supplied).

CITY MANAGER’S REPLY: 1. & 2: Road Maintenance Services carried out a condition survey of the entire tarmac verge at (details supplied) between house number 56 and 92. Based on this condition survey the area in need of repair was marked out on the tarmac between number 66-68, 74-76 and 80-82. Concrete repairs were marked out at 84 and 86. These works have been scheduled to be completed within 2 weeks. They have been delayed previously due to poor weather. This type of repair is standard practice for road maintenance on tarmac and concrete footpaths. No further works are necessary at this location.

3. The Area Engineer will investigate parking at the school and will issue a report directly to the Councillor.

CITY MANAGER’S REPLY: The twenty-one units on this site are being acquired by the Dockland Housing Trust. The units are earmarked for social housing. The Department of the Environment, Heritage and Local Government allocated funding to the Docklands Housing Trust to acquire the units. To date the Trust has not requested Dublin City Council to draw down the money for these units. A letter was sent to the Docklands Housing Trust on the 30th September 2009 seeking a report on the matter. To date no reply has issued. Dublin City Council would not be in a position to take over these contracts as the funding for the units has been allocated to the Docklands Housing Trust. The Dublin Docklands Development Authority (DDDA) negotiated the acquisition of these units for the Trust.

At present, no other allotments are available to the public on lands that the Parks and Landscape Services Division has in charge.

Depending on the success of the pilot in St Anne’s Walled Garden it is hoped that a similar model may be rolled out in other areas within the City.

Q53. COUNCILLOR PAT CRIMMINS Can the Manager request that the Parks Department investigate a tree which

is causing structural damage to the front wall of house No. 49 St. Assam’s Park, Raheny, Dublin 5? If the tree roots grow any bigger in years to come, this will cause the wall to collapse, which will have to be repaired by the DCC.

CITY MANAGER’S REPLY: The roadside tree outside No. 49 St Assam’s Park, Raheny, Dublin 5 has been inspected by the Parks & Landscape Services Division. There is visual evidence of a root problem developing here and further investigation will be required to identify and remove offending roots. This will be scheduled to be carried out during the dormant period.

In the context of this correspondence can the Manager also ask the IPS to confirm that the Inspector of Prisons, Judge Michael Reilly's recommendations in his report on the conditions in Mountjoy will be implemented?

CITY MANAGER’S REPLY: A letter was posted to the Director General of the Irish Prison Service on 8th September 2009 requesting a response to the Councillor’s previous question. To date, no response has been received. A second letter will be sent incorporating the above request and asking that a reply be issued directly to the Councillor.

Q57. COUNCILLOR CRĺONA Nĺ DHÁLAIGH To ask the City Manager why (details supplied), has had her points reduced

just as she had gained enough points to be considered for a transfer from her flat to house that had become vacant near by. She and her daughter have been trying for years to be transferred and as they have lived at their present address for over 20 years they have stopped getting time on record points which means they will never now have enough points to be considered for a house.

CITY MANAGER’S REPLY: I can confirm that the applicant (details supplied) is on the City Council’s Housing Transfer List with 88 points for Area L (James Street/Newmarket) and 83 points for Area K (Crumlin/Walkinstown). Unfortunately, these points are insufficient for an offer of accommodation at present. Under the scheme of Letting Priorities, these points reflect the applicant’s current housing need, having been re-assessed to acknowledge the fact that the applicant’s son no longer resides at the above-mentioned address.

CITY MANAGER’S REPLY: (a) In the event of the draft Bye-Laws being adopted, enforcement will be

undertaken by the Council’s parking enforcement contractor which will take the form of clamping illegally parked vehicles, and by An Garda Siochána. Enforcement by the Gardaí would consist of the issuing of parking tickets. Enforcement by the Council’s parking enforcement contractor will be subject to the resources available in accordance with the existing parking enforcement contract.

CITY MANAGER’S REPLY: An extension to this dwelling on medical grounds was approved in 2005 but subsequent to our architect calling to commence with the plans for the proposed extension, the works were cancelled by the tenant in January 2006.

Although an extension was originally approved in 2006, if alternative less extensive works meet the tenant's needs and are the most recent recommendation of the Occupational Therapist, these are the works which will be provided.

An occupational therapy report was received at our offices in March 2009 recommending the provision of a stairlift and a walk in shower and it is these specific works (a stairlift and a shower in the existing bathroom) that were subsequently approved for this tenant in March 2009. A letter was forwarded to the tenant advising him of this.

No further works are being carried out under this scheme in 2009 due to budgetary constraints and it is not possible, at present, to indicate when any works may be provided at this dwelling until our funding allocation for 2010 is established and the cases currently on the waiting list longer than this tenant have been dealt with.

If the tenant wishes to submit further medical evidence, this case can be re-examined in order to establish the exact nature of the works required that would meet the current and long term needs of this applicant. It is necessary to submit updated information from his occupational therapist that can clarify if the installation of a stairlift and a walk-in-shower is required in this case or if an extension is the only viable option.

of total payroll cost for the year 2008 and to date 2009. CITY MANAGER’S REPLY: The total cost of overtime in 2008 was €27.7m which represented 7.8% of total payroll €356.7m.

The cost of overtime at 27th September 2009 is €12.4m which represents 4.8% of payroll €256.5m. It is anticipated that savings of approximately €11m will be achieved in 2009 compared to 2008, following the implementation of cost saving measures.

Q66. COUNCILLOR EDIE WYNNE To ask the Manager to consider the installation of a handball alley in an

appropriate location in Terenure, or minimally, the construction of an upright concrete wall with appropriate ground surface for use for practice of ball skills in Bushy Park as part of the refurbishment plan for the Park.

CITY MANAGER’S REPLY: The installation of a handball alley in Bushy Park was mooted during the compilation of The Management and Development Plan of Bushy Park during 2008. The idea was not considered feasible within the park itself as the addition of extra activities in the restricted sports area would cause further pressure on existing facilities. Dublin City Council having consulted the various internal service departments have confirmed to the Department of Education and Science that we have no objections in principle to their submitted proposal for the provision of a permanent Gaelscoil for Gaelscoil Bharra on a portion of the site currently occupied by St. Finbarrs GAA Club on Fassaugh Avenue subject to Planning etc. Furthermore Dublin City Council had asked St. Finbarrs GAA Club if they were now prepared to enter into tri-partite negotiations to move the process forward. However St. Finbarrs GAA Club has now indicated to Dublin City Council that they have serious reservations with this proposal, particularly with regard to the provision of car parking. The City Council has advised St. Finbarrs GAA Club that the Department’s proposal remains the only option available at present and, unless the Department and St. Finbarrs GAA Club can reach agreement, the matter cannot proceed in the context of this site.

Q74. COUNCILLOR AINE CLANCY To ask the City Manager if he will assist in the provision of CCTV cameras in

Sheriff Street.

CITY MANAGER’S REPLY: The drainage network at this location is a combined drainage network whereby foul effluent and storm water drainage are collected in the same pipeline. Modern Drainage practice, from around the 1960’s onwards, is to construct separate pipelines which increases the capacity of the system, particularly during adverse weather conditions.

A drainage catchment analysis is required to be carried out for this area to identify the improvement works required. The Strategic Planning and Project Management section have been requested to commence such a study in 2010.

The neighbour affected by this noise has also been advised in writing of the outcome of this investigation.

Q88. COUNCILLOR KEVIN HUMPHREYS To ask the Manager why easy accessible showers for the homeless have not

been provided even though provision was made in the Budget two years ago for them.

CITY MANAGER’S REPLY: Initially it was proposed to locate accessible showers in Amiens Street. The building in question is owned by Dublin City Council and, allowing for the refurbishment necessary to bring the building to a quality standard, it was agreed that the provision of any showers should be incorporated into the overall development of the building. The Architects section was asked to examine a proposal for the re-development. This was delayed by the lack of a replacement building to house the clients during the re-development at a time when beds were at a premium. In the meantime three things happened which caused a stop to be placed on any re-development: -

1. A trial for one month in the provision of showers for Homeless persons not able to access same readily was put in place in 3 of Dublin City Council’s hostels with the availability of such showers being communicated to all rough sleepers. However during the month nobody took up the offer. This offer has remained available after the trial with little or no take up.

2. There is now a lack of funding to carry out the development.

3. The arrival of the comprehensive set of recommendations to deal with

the Homeless situation in the Greater Dublin Area and the subsequent practical document “A Pathway to Home” to deliver the recommendations has meant that at this time and over the next couple of months a complete re-examination of all Homeless Services is underway to arrive at a comprehensive quality delivery of service meeting completely the needs of the Homeless clients which is at the centre of the reconfiguration. Access to showers along with all other necessary services is a consideration of this reconfiguration.

CITY MANAGER’S REPLY: The Manager of the Housing Maintenance Heating Section reports that the last repair request received from this tenant in relation to the heating system in his dwelling was made in February 2009. This request was responded to immediately and the heating was restored. No request in relation to a breakdown has been received since that date. However, due to the size of the living room, it has been agreed that an

additional radiator should be installed. This work will be completed within a week. Q91. COUNCILLOR PAUL MCAULIFFE Can the Manager urgently address the following issue, (details supplied).

CITY MANAGER’S REPLY: An application for a downstairs bedroom, adaptations to the existing downstairs bathroom and ramped access to this dwelling was approved in principle in 2008 and awarded a high priority. However at the time of approval there were a number of high priority cases ahead of this applicant on our waiting list for extensions. There are currently approximately 12 cases ahead of this tenant on our waiting list and, to uphold the fairness of the scheme, these cases will be dealt with first.

Due to current budgetary constraints no further building works are being carried out under this scheme in 2009. No commitment can be made as to when these works may commence for this tenant, until the extent of any future budgets has been established and all those people currently ahead on our waiting list have been provided for.

CITY MANAGER’S REPLY: A cost-benefit analysis was carried out in line with Department of Finance and Department of Transport project assessment guidelines. The scheme was assessed under the headings of Economy, Environment, Accessibility, Safety and Integration. The outcome of the analysis was positive.

Submissions were invited from interested parties during a period of public consultation that ran for 8 weeks up to 27th October 2009. The scheme drawings were available for inspection in Phibsborough Library, Cabra Library, the Civic Offices and online. A large number of submissions were received during this time. In addition, staff from the QBN Project Office attended a number of meetings with local residents and business people to directly answer questions on the scheme.

Q97. LORD MAYOR, COUNCILLOR EMER COSTELLO To ask the City Manager if funding has been made available for the purchase

of the designated residential units in the Castleforbes development in North Wall, Dublin 1.

CITY MANAGER’S REPLY: The twenty-one units on this site are being acquired by the Dockland Housing Trust. The units are earmarked for social housing. The Department of the Environment, Heritage and Local Government allocated funding to the Docklands Housing Trust to acquire the units. To date the Trust has not requested Dublin City Council to draw down the money for these units. A report on the matter has been sought from the Docklands Housing Trust.

CITY MANAGER’S REPLY: This development was initially permitted by the Dublin Docklands Development Authority through Section 25 Certification. The certificate was subsequently quashed by the High Court. The development was granted retention planning permission by Dublin City Council on 2nd January 2009. This permission is on appeal to An Bord Pleanála since 29th January 2009. An Oral Hearing on the appeal was held on 5th May 2009 and a further information request was issued by the Bord. The response to further information is due to be submitted on 2nd November 2009. The Bord’s decision will be issued at some stage after that date.

Q102. COUNCILLOR CIERAN PERRY To ask the City Manager to detail the Dublin City Council response to the

decisions of the High Court which have found that the Council breached fair procedures and a tenant’s right to housing by seeking the eviction of anti social tenants under section 62 of the Housing Act, 1966. I am aware that these decisions have been appealed to the Supreme Court. Have DCC any plans to counter these decisions by referring further evictions to an Independent tribunal?

CITY MANAGER’S REPLY: Dublin City Council is appealing the recent “Pullen v DCC” decision to the Supreme Court. There are three (3) cases now awaiting the Supreme Court to determine the constitutionally/compatibility of section 62 of the Housing Act 1966.

The current legal advice from Senior Council is for Dublin City Council to continue to apply The Housing Acts up to and until the outcome of the Supreme Court as the relevant legislation remains lawful and valid.

CITY MANAGER’S REPLY: When this site was inspected in June, the condition of the site did not warrant action under the Derelict Sites Act 1990 at that time. However, the Derelict Sites Section will inspect the site and report directly to Councillor Upton. The issue of rats has been referred to the Health Service Executive to investigate and respond directly to Councillor Upton.

CITY MANAGER’S REPLY: Joint Policing Committees have been established and re constituted following the 2009 local elections. There are no proposals at present to review the JPC scheme or to carry out annual audits.

The 5 Area Managers were contacted during the Summer with a view to setting up Policing Fora in their respective areas and a copy of the guidelines relating to their establishment was circulated; they are currently in operation in both the Central and North central Areas. There is no separate budget for the operation of the Joint Policing Committee. These are operated as part of the duties of the Councillors, Deputies, Managers, Senior Police Officers and Community Volunteers involved.

Q108. COUNCILLOR HENRY UPTON To ask the City Manager if they would carry out a "once-off" clean-up and

removal of plastic tags on lamp posts throughout the city, which were used to hang posters; if they can consider some means whereby individuals/political parties can be identified and required to remove the tags they have left in place; and if he will make a statement on the matter.

CITY MANAGER’S REPLY: The litter warden service removes any illegal posters with their plastic tags and issues appropriate fines. Where tags alone are left on lampposts it is not practical to attempt to prove ownership and accordingly issuing of fines is not possible in such cases. The onus for removal of tags rests with the individual/individuals who erected the posters in the first place and it is reasonable to expect all responsible people/parties to remove tags with the posters. Arrangements will be made between Waste Management and Public Lighting Services to have cable ties removed.

Q109. COUNCILLOR JOHN REDMOND Will the Manager arrange to reinstate the railings that were damaged and

removed by the Council, (details supplied), as this area is a black spot for anti-social behaviour.

Q111. COUNCILLOR JOHN REDMOND With regard to the new changes in the assessment of Rent Supplement, will

the Manager set out proposals on how the Council intends to process Housing and Need Assessment applications, which are now compulsory under the new rule change; if such applications can be fast tracked, and if an application in the name of, (details supplied), can be assessed without delay.

CITY MANAGER’S REPLY: All Rent Supplement applicants, referred to the City Council by Community Welfare Officers, are fully informed of the process and timescale involved to process a housing application and establish the applicants housing need. The City Council have also engaged with and continue to liaise on an ongoing basis with Community Welfare Officers in this regard. Due to the large volume of housing applicants overall it would not be

appropriate to prioritise one category of application over another. However, the City Council has taken a number of measures to reduce the overall processing time of applications from all applicants and will continue to monitor this area of activity and introduce further measures if necessary.

Notwithstanding the above, the City Council is aware that on occasion applicants with particularly acute circumstances require a more urgent assessment of their housing need. Such applications are examined on a case-by-case basis, taking all the circumstances into consideration and, if deemed necessary and appropriate, are processed on a priority basis. I can confirm that the applicant (details supplied) applied to be included on the City Council’s Housing List on the 15th of September 2009. The applicant’s application is currently postponed pending submission of income details in respect of his partner and proof of residence at the above-mentioned address. A letter requesting these particulars was recently sent to the applicant’s address. The applicant should be advised to submit these details at his earliest convenience so as to enable this application to be properly assessed.

This money will be included in the grant allocation for 2009. Dublin City Council does not propose to reopen (at this time) the application process to new applicants.

CITY MANAGER’S REPLY: A 60sq. metre ground floor apartment with adaptations to suit the needs of the tenant’s son was offered to the tenant, but she refused this allocation because it was an apartment. The tenant was insistent that she be offered a bungalow. There was only one unallocated bungalow on the site and, as the building works were nearing completion, the adaptations could not be done. The tenant viewed the dwelling and accepted it as was.

A reduction has been achieved in rent paid to landlords this year compared to Year 2008. Rent reviews this year have resulted in an average 16% reduction in the rent amount. Absenteeism data for the year to September 2009 indicates that levels of absenteeism will reduce further. It is anticipated that the average days of absence on sick leave (combined across Certified and Uncertified Sick leave) per employee will fall below 11 days for 2009.

The results of tests for Total Coliforms, Faecal Coliforms and Enterocci were posted each week on the notice boards for the public to view in order to comply with the regulations. Other analyses such as temperature, ph and salinity are not posted on the notice board but are kept in the City Council central laboratory on file. A sample of the water will be taken next week and the results of chemical analysis will be posted on the notice board.

Q121. COUNCILLOR MARIA PARODI To ask the Manager to look into ways of repairing the condition of the sea wall

along Beach Road, Sandymount as there are holes in it and stones are missing.

CITY MANAGER’S REPLY: The sea wall on Beach Road has been inspected by the Parks Division and no significant damage was found. Any work required will be carried out as part of the normal parks works programme. If however, the Councillor is aware of a specific location where significant repairs are required, she can contact the Senior Executive Parks Superintendent who will arrange to inspect the area and have any urgent repairs carried out.

Q122. COUNCILLOR MARIA PARODI To ask the Manager if any steps have been taken to ensure that the pipe

assembly site that was used for the Ringsend Wastewater Treatment Plant on the Poolbeg peninsula will be restored to its original condition as a wetland area for local wildlife.

CITY MANAGER’S REPLY: The Pipe Assembly Area in question is owned by Dublin Port Company and

was used by Laing O’Rourke until May of this year for a Water Rehabilitation Project. Any works now required at the site are a matter for the Dublin Port Company.

Q123. COUNCILLOR JOHN GALLAGHER To ask the City Manager further to question 67 of the October 21st South

Central Area Committee who made the decision to halt the process to list the chapel at St. James’s Hospital onto the Record of Protected Structures; since the reply has stated that “the addition or deletion of a building on the record of Protected Structures is a reserved function of City Councillors”, what actions are proposed to be taken in respect of the person or persons who the made decision to halt the process; on what authority did they make this decision; and if he will make a statement on this matter?

CITY MANAGER’S REPLY: The decision was made to halt the process as it became clear that there were major developments proposed for the site, developments that would greatly benefit the economic rejuvenation of the area. It was felt that the Councillors should consider whether to initiate the process for listing with the benefit of the full knowledge of the proposals for the site. A planning application has been lodged for a co-located private hospital on the grounds of St. James’s Hospital, which includes the demolition of the Chapel. Additional information has been requested including an evaluation of the feasibility of moving the Chapel to another part of the site and a full architectural and conservation report on the Chapel. This additional information has not been received to date.

Proceedings related to staff are a matter for the Council Executive and no comment will be made in relation to internal City Council procedures.

Q124. COUNCILLOR JOHN GALLAGHER To ask the City Manager investigate the feasibility of providing a park in

Dolphin’s Barn on the Players Wills site, which is currently in receipt of planning permission, but on which no development has taken place.

CITY MANAGER’S REPLY: Due to a lack of resources and funding at the moment, Parks and Landscape Services Division would not be in a position to develop a new park on this site. Acquiring the area for public use would also raise problems as it is in private ownership.

Q125. COUNCILLOR JOHN GALLAGHER To ask the City Manager the current status of plans for the redevelopment for

the area known as "the pitch" in Bulfin estate; if he will provide an expected timeline for the development of this area; and if he will make a statement on this matter.

CITY MANAGER’S REPLY: The City Council prepared draft plans for “the pitch”. These plans will go on public display on Tuesday 3rd November 2009. The plans involve an informal kick about space, new lighting, new street planting, traffic calming, connection to canal side and play facilities. The final scheme will be prepared taking on board the suggestions made by the local community at the public display. At this stage is it not possible to provide a timeline for the commencement of development but it is not expected to be before 2011.

CITY MANAGER’S REPLY: I. The public right of way was extinguished in February 2008. II. The normal way to access the lane for residents who are adjacent and

users of the lane is to use keys for access. Dublin City Council does not get involved in the distribution or issuing of keys amongst residents with the exception of the requirement for utility companies to be supplied with keys if they have specified the need for same.

III. Regarding the provision of gates, residents who are signatories on the petition to have the laneway closed normally contribute to the cost of gates/closure and are issued with keys. Again this is a local arrangement.

IV. The general arrangement is that residents who are living adjacent to the lane are provided with keys as are utility companies who have specified their requirement for same. All residents in the surrounding area are not issued with keys. Local arrangements are made in conjunction with those who have submitted an application for extinguishment and who take responsibility for the closure, purchase and erection of gates etc.

V. In this area there is an alternate route for residents opposite no.30 (details supplied) which leads into (details supplied) Road i.e. leading to the same destination.

VI. Contact will be made with the resident concerned. Q130. COUNCILLOR MANNIX FLYNN Can the Dublin City Manager issue a statement of apology to those who were

detained in residential institutions under the non-attendance of school act? The administration of this act, i.e. the school inspectors was carried out by the then Dublin Corporation many children were brought before the courts by Dublin City Council school inspectors, many were incarcerated in the Letterfracks and Daingeans of this State.

CITY MANAGER’S REPLY: There were five City of Dublin School Attendance Committees and each committee employed a school attendance officer. These committees operated independently of each other and each school attendance officer reported directly to the Minister for Education on how they implemented their duties under the act. The School Attendance Committees were considered to have a ‘semi-detached’ relationship with Dublin Corporation. They were not an integrated part of the Corporation’s structure and the school attendance officers were each employed directly by one of the five committees. However, the School Attendance Committees were funded by Dublin Corporation until 1977 (when domestic rates were abolished) and after that date, funding was provided by central government, channelled through Dublin Corporation. The Corporation also provided office accommodation for the School Attendance Committees and the mechanism for payment of officers’ salaries, which were linked into the Corporation’s superannuation scheme.

Under the Education Welfare Act 2000, School Attendance Committees were removed from the local authority framework and were replaced by the National Education Welfare Board, which was established in 2002 under the direct authority of the Minister for Education. The former School Attendance Officers became National Educational Welfare Officers and are based in

In summary, while Dublin Corporation was legally obliged to pay the bills, these School Attendance Committees were legally & factually independent from the Corporation in the discharge of their functions; neither the Elected Council of the day nor the City Manager of the day had any powers to control or direct these independent Committees or the School Attendance Officers who worked for them.

Q131. COUNCILLOR MANNIX FLYNN Can the City Manager inform all Dublin City Council Tenants by letter of their

entitlement under the freedom of information act to access information concerning them held by the Dublin City Council? CITY MANAGER’S REPLY: The Council has comprehensive information on the Freedom of Information Acts on its website, DUBLINCITY.IE. Application forms are also available on the website. Currently, approximately 45% of all FOI requests are housing related. In the circumstances, it is not considered necessary to write to tenants.

Q132. COUNCILLOR MANNIX FLYNN Can the City Manager in honour of the inauguration of Fianna Eireann on

Camden Street and in honour of its founders and its members rename Camden Street Citizen Street?

CITY MANAGER’S REPLY: In order to change the name of a street the City Council must, by resolution, adopt a proposal to change the name of a street. If the proposal is adopted by the City Council a draft list of qualified electors must be prepared and notice of its preparation must be advertised in the public press. The list of qualified electors must then be formally adopted by the City Council and a plebiscite must be carried out of these qualified electors.

If the majority of electors consent to the change then a declaration is made by the Lord Mayor specifying the new name of the street and when it comes into operation.

Q133. COUNCILLOR MANNIX FLYNN Has the City Manager given his utmost attention to the urgent needs of small

business and enterprises and can he call on the Minister Mr Gormley for reduction in the rates of at least 20%.

CITY MANAGER’S REPLY: The City Council recognises the importance of the role that business, small or otherwise, plays in the economy and is committed to it. On a macro level the City Council, through a number of initiatives e.g. implementation of the the “Economic Development Plan for the Dublin City Region” and participation in the “Creative Dublin Alliance”, is leading and progressing an economic agenda that aims to secure growth in the Dublin Economy. On a micro level

the City Council, through the delivery of its many key activities, assists businesses on a daily basis and is now establishing a Business Support Unit (BSU) that will further enhance this service. This unit, which is an initiative of the Economic Development Department, will provide information on, and co-ordinate access to the range of Dublin City Council services that are required for setting up or growing a business. The unit will also provide a referral service to other business support agencies and to this end the Economic Development Department, in cooperation with the City Enterprise Board, has launched a ‘Guide to Enterprise in Dublin City’. The Guide is a comprehensive compilation of advice and information, including a directory of services and is accessible online. The City Council is acutely aware of the importance of funding for businesses and so the unit will also develop a funding support website for businesses which will provide comprehensive details of government and EU funding opportunities including grants, loans etc. The setting of the annual rate on valuation for 2010 is under consideration as part of the 2010 Budget process.

Q134. COUNCILLOR MARY FITZPATRICK Will the Manager please advise on the following;

a. For what reasons has Dublin City Council undertaken work on a proposal for a QBC on Berekley Road, D7? What is the rationale behind the proposal?

b. What resources either internal or external to DCC have been engaged in this project, for what period of time and at what cost?

c. What will the QBC cost, if approved for implementation? d. Where will funding come from for the QBC? e. What benefits will the QBC bring? f. What is the approval process for this project and final decision? CITY MANAGER’S REPLY: a. The Blanchardstown QBC Enhancements scheme, of which the proposed Berkeley Road QBC scheme forms one element, is part of the Quality Bus Network Project which is being rolled out by Dublin City Council in line with the objectives of the Dublin City Development Plan and the Dublin Transportation Office strategy document “A Platform for Change”. Berkeley Road has been identified by Dublin Bus as one of a number of pinch point locations on Dublin’s bus network where buses experience delays due to traffic congestion. These pinch point locations are being prioritised for improvement works. The elimination of these pinch points, and the development of a city-wide Quality Bus Network, will expand the level and extent of public transport services and will have significant implications in relation to the future sustainable development of the city. b. To date €35,000 has been expended on external resources for site investigation, survey costs and safety audits. The scheme design has been developed in-house by the QBN Project Office. The QBNPO have been working on enhancements to the Blanchardstown routes over the past two years. c. Preliminary scheme costs at present are estimated at €700,000. This figure is subject to change depending on a number of factors, including the

layout of the final approved scheme and the results of site investigation works. d. The scheme will be funded through a grant from the Dublin Transportation Office. e. The scheme will provide reduced bus journey times and a more reliable level of bus service. Buses will be insulated from existing and future traffic congestion on the road network. Road and footpath resurfacing will also be included, as well as bicycle parking and landscaping.

f. The scheme is being progressed under the statutory provisions of Part 8 of the Planning and Development Regulations 2001. A period of public consultation has recently been completed during which a number of submissions were received. The QBN Project Office will now prepare a report detailing the submissions, responses and any proposed modifications to the scheme as a result of the submissions. The report will then be presented for noting at the December meeting of the Central Area Committee, and for decision at the January meeting of the City Council.

Q135. COUNCILLOR MARY FITZPATRICK Did the Department of Transport request Dublin City Council provide

proposals for the investment of public funds in cycle lane infrastructure in Dublin City this year or next? If so can the Manager please advise how many proposals did Dublin City Council submit to the Department of Transport? Can the Manager please advise how the proposal for an on-street Southside Grand Canal to Clontarf cycle path was prioritised over off-street route from Ashtown to IFSC along the Royal Canal? Was a cost benefit analyses undertaken on each route? If so can the Manager please provide a copy? Does the Manager acknowledge that due process was not followed as the proposal to commence Part 8 was not presented to or approved by either the Central Area Committee or the Traffic SPC in advance of being initiated? CITY MANAGER’S REPLY: The Roads and Traffic Department presented a document entitled City Centre Transport Plan to the Transportation and Traffic SPC in April 2009. This document included a proposal for a cycle route from Rathmines to Fairview. The proposal was developed as it links the three largest cycle routes into the city to the south east city centre, the area with the largest employment. It also provides the city centre section of the Sutton to Sandycove route.

Subsequently, the newly established Smarter Travel Section in the Department of Transport approached the Roads and Traffic Department seeking information on proposals to meet the targets outlined in Smarter Travel. In particular they were seeking proposals capable of early implementation. When informed about the above scheme they expressed interest and advised they would be willing to fund the above scheme subject to delivery in 2010.

The scheme was presented to the Central Area Committee and to the South East Area Committee and these Committees were advised that it was proposed to proceed to Part 8.

At present there is no detailed proposal for an off road cycle route from Ashtown to the IFSC along the Royal Canal and there is no agreement with Waterways Ireland on such a route. We are committed to developing such a route along the Royal Canal, however, due to staffing constraints, work on this must await completion of the Rathmines to Fairview Route.

Q136. COUNCILLOR MARY FITZPATRICK Can the Manager please detail what efficiencies have been achieved in the

Housing Maintenance Department in 2009?

CITY MANAGER’S REPLY: Given the overall cost of the Housing Maintenance service, the growing number of repair requests and the ever increasing cost of overtime, a Review of the operation of the Housing Maintenance Section commenced in 2008 with detailed terms of reference, under the direction of a Steering Group. 1. Areas Examined

The following were some of the areas examined by the Review Group –

• Management Structure of Housing Maintenance

• Attendance Management of staff

• Increasing levels of overtime over the years

• Management of the Citywide Business Units e.g. Joinery Workshop

• The process of modernising empty housing units (Voids)

• Increasing levels of repair requests received

• Management of the disposal of waste by Maintenance depots

• Level of Financial Management Information

A number of preliminary actions have been carried out on foot of the Review to date with the following results –

• Attendance record of staff in Housing Maintenance has increased

by 7 %

• Pilot programme for segregation of waste has produced a saving of € 140,000 over the period Jan – July 2009

• Re-examination of work practices leading to a projected decrease in the

need for overtime by 50 % in 2009

• Set out below are the detailed works carried out in the areas of Empty Dwellings (Voids), Repair Requests and the Management Structure.

2. Empty Dwellings (Voids) 2.1 Void Monitoring Groups In Autumn 2008 a Voids Monitoring team was set up in each of the five Council Areas. Each team consisted of all the relevant personnel involved in empty properties, including the Area Manager, Area Housing Managers, Area Maintenance Officers, Housing Development, Allocations and Housing Maintenance management staff. The purpose of these teams was twofold

– to map a transparent process for the handling of empty properties and the identification of blocks in the system, and

– to individually examine the progress of each empty housing unit to ensure as speedily a turnaround as possible.

A number of meetings of the five area teams took place in the second half of 2008 and the table below sets out the improvement in the number of voids as a percentage of the overall stock. • The number of repair requests received from our tenants in 2002 was

36,768. This amount has increased year-on-year since then so that in 2008 a total of 60,496 requests were logged. This equates to an increase of 64.5 % over that time period.

• A detailed analysis of the repair requests received in 2008 revealed

that 24.6 % of repairs carried out by Housing Maintenance were repairs that are the responsibility of the Tenant in accordance with the Tenant’s Handbook.

• Despite the fact that the Tenants Handbook specifically states that

only emergency repairs will be carried out where rent accounts are in arrears, the City Council continued to carry out these works in a positive economic environment.

• Following an examination of the after-hours calls being received by the Council over a two-month period across the city, it was clear that 38 % of the requests made were not emergency situations and could wait until the next working day.

3.3 Action taken on foot of Analysis 3.3.1 Repairs The following measures were put into effect from 22nd June 2009 to correct practices that have evolved over a number of years –

• Repairs that are the responsibility of the Tenant will not be carried out

by Dublin City Council.

• Tenants who are over 6 weeks in rent arrears will no longer have routine repairs carried out to their home.

• The Housing Maintenance After-Hours service is to be restricted to

emergencies only. The following table sets out the decrease in the number of valid repair requests received by Housing Maintenance since the introduction of the above efficiencies –

• A meeting was arranged in May 2009 with the Craftworker Unions who were

told that the operation of the After-Hours service in its current format was no longer sustainable and that an alternative arrangement would need to be put in place.

• A proposed shift-working arrangement whereby a small number of staff will work until 9.30 pm Monday to Friday and from 8.30 am to 6.00 pm Saturday and Sunday was implemented in August 2009.

• The two teams of three staff who operate the shift arrangement will only respond to requests where the repairs to be carried out cannot wait until the next day. Where they are satisfied that the repair is not of an emergency nature, they will refer the request to the relevant depot the following day.

• A voice-mail service is in place for requests received after 9.30 pm, weekdays and 6pm weekend nights and these are referred to the relevant depot on the next working day.

• In the first four weeks of the shift pilot, there was an average reduction of €12,860 per week in the cost of On-call overtime.

3.3.3 Tenants Handbook The Tenants Handbook has been revised and modernised, legal advice has been received on its contents and the tenancy agreement is currently being examined to ensure that it and the Handbook are compatible.

Q137. COUNCILLOR MARY FITZPATRICK Will the Manager please arrange to have the road carriageway at 10/12

Connaught Street and the carriageway on Ashington Park between Ashington Avenue and Riverston repaired? Please advise when the work will be completed.

CITY MANAGER’S REPLY: 10/12 Connaught Street Road Maintenance investigated this location & found the carriageway to be in a satisfactory condition. Ashington Park Road Maintenance is aware of the condition of this section of road. We are monitoring it on an ongoing basis & will attend to potholes as necessary. We plan to include this section of road in for the 2010 Works programme, finance permitting.

Q138. COUNCILLOR DERMOT LACEY To ask the Manager if he could confirm the accuracy of the report that the

City Arts Centre received funding of €200,000 from Dublin City Council “Community Gain” fund and to clarify where the grant was discussed by elected members and the basis on which the grant was allocated.

CITY MANAGER’S REPLY: A special meeting of the HARP Monitoring Committee was held on 22nd June 2007 to consider and adjudicate on the applications made for Major Grants from the HARP Community Gain Fund. The Committee deemed that a number of the applications, including the application made by City Arts, complied with the objectives of the Integrated Area Plans and met the conditions for community gain funding. The grant of €200,000 is a contribution towards the refurbishment and fit out costs of the premises held by City Arts at No. 15 Bachelors Walk and is conditional on City Arts meeting certain criteria. The total cost of the works was estimated at €900,000 and the balance is being met by the Department of Arts, Sports and Tourism, the Arts Council and from City Arts own reserves. Work is substantially advanced at this stage and is expected to be completed by the end of this year. The grant was made on the basis that City Arts will provide the local community access to its newly refurbished premises, will work with the local community on programmes and it will enhance the arts and cultural facilities in the city. The successful applications were discussed and noted by the Central Area Committee at its meeting held on 10th July 2007.

Q139. COUNCILLOR NAOISE O’MUIRÍ Can the Manager give me an update on my tree-pruning request for the trees

outside 107 Collins Avenue East as raised with the North Central area office in July 09?

CITY MANAGER’S REPLY: The Parks & Landscape Services Division carried out tree pruning of this roadside tree during summer 2009. Further follow up pruning works will be carried out in the vicinity of Collins Avenue East during the 2009/2010 dormant season.

Q140. COUNCILLOR NAOISE O’MUIRÍ Can the Manager report on options for dealing with the problems with the

Pear Trees on the public path on Philipsburgh Avenue? Fruit once fallen from these trees cause a hazard for local pedestrians, particularly the elderly.

CITY MANAGER’S REPLY: Where problems associated with falling fruit from ornamental pears or other fruit bearing roadside trees arise, this is addressed by a combination of the Parks & Landscape Services Division, Waste Management Services Division and the Public Domain Officer for the North Central Area maximising available resources to remove fallen fruit from the footpaths and roadways as these available resources permit. These works are targeted for those areas where the volume of such fruit is highest, which includes roads such as Philipsburg Avenue.

Q141. COUNCILLOR NAOISE O’MUIRÍ There is a regular water build up/flooding problem during heavy rain on the

Malahide Road just north of the pedestrian lights at the exit point from Donnycarney Road. Can the Manager:

- clarify if flooding at this spot has ever been reported to Dublin City Council,

- examine all gullies in this area and ensure that they are clear and operational, - take any other remedial measures as appropriate to relieve water build up. CITY MANAGER’S REPLY: Drainage Division have no record of flooding at this location and have not received any complaints regarding the same. Our gully cleaning crew visited the above on the 29th of October last and inspected gullies in the area, all of which were in good order at the time. A build up of debris was found during a survey of the pipeline, which connects these gullies to the public sewer. This pipe has been pressure cleaned and the debris removed. Flooding should now be alleviated at this location; our crews will, however, continue to monitor the area during times of rain to ensure ponding does not recur.

CITY MANAGER’S REPLY: Roadside tree planting at this location is done by the Parks & Landscape Services Division staff using the same techniques as tree planting throughout the area. The failure of such planting can be down to a number of factors that are variable. The replacement planting will be carried out during the tree-planting season.
