1.1 Programme: IPA National Program 2012

1.3 Title: Strengthening of the Albanian Civil Aviation Authority

1.4 Sector: Transport

1.5 Beneficiary country: Albania

2. Objectives

2.1 Overall Objective(s):

The overall objective is to improve the social and economic development of Albania, by upgrading its civil aviation standards and practices in compliance with those in use in the EU framework.

2.2 Project purpose:

The purpose of the project is to support the Albanian Civil Aviation Authority to:

- consolidating, sustaining, strengthening, extending the staff competence and the adoption of EU safety oversight standards in continued airworthiness (CAW), operations (OPS) and licensing (FCL)

- complementing the adoption of EU standards and the staff competence in air navigation services (ANS), airports (APT) and security (SEC)

2.3 Contribution to National Development Plan/Cooperation agreement/Association Agreement/Action Plan

As set out in the Stabilisation and Association Agreement (SAA), the European Partnership and the Opinion, specific transport sector objectives aim at modernising all transport modes in Albania; improving access to the transport market and facilities; supporting the development of multi-modal as well as balanced and sustainable transport infrastructure related to the main Trans-European networks, notably to reinforce regional links; achieving operating standards comparable to those in the EU; developing a transport system in Albania compatible to, and aligned with, the EU system and; improving environmental performance of transport and road, maritime and air safety, and maritime security.

The Annual Progress Report for 2011 concluded that while there was progress in the area of road and maritime transport, progress has remained limited in the fields of rail and air transport. Aviation safety legislation has yet to be implemented effectively. Albania's administrative structures in the different transport sectors need to be made more effective. Overall, preparations are not very advanced.

The National Strategy for Development and Integration (NSDI) states that it is Albania’ vision to establish transport systems and infrastructure to achieve a single economic space within Albania and beyond, i.e. with the region and Europe.

The Transport Sector Strategy sets a number of strategic priorities in these areas, such as aligning the legislative framework with the Acquis, improved road rail and air safety, rehabilitation of ports,

modernization of railway infrastructure, amongst others.

The project will help in resolving the deficiencies identified by the international aviation controlling agencies (ICAO, EASA) and therefore in avoiding the risk of black list for the aviation system, allowing continuation and development of free movement of passengers and goods to/from Europe and Albania.

3. Description

3.1 Background and justification:

In the latest years there has been progress in the air transport sector and the commercial air operations have increased, especially to/from EU countries.The construction of new infrastructure at Tirana International Airport was completed in mid-March 2007. Also the Kukës airport has been build and other eight civil aviation fields are present in the Republic of Albania. In the framework of the development of tourism and of internal air transport, the construction of the airport of Saranda and Vlora is also in focus. Exhibitions and air shows are increasing as well.In addition some undertakings are showing interest in setting up flying schools.

The Ministry of Public Works, Transport and Telecommunication is in charge of the development and modernization of air transport in the Republic of Albania.

Albania ratified, by law no. 9658 dated 18.12.2006, the European Common Aviation Area Agreement (ECAA) and undertook to gradually integrate into the EU internal aviation market and to apply EU aviation standards. The implementation of the aviation acquis under the ECAA is underway, but further efforts are needed in the fields of aviation safety, air traffic management, security and airports, because Albania needs to continue addressing and resolving the deficiencies identified within its Civil Aviation Authority by the international monitoring organizations such as ICAO and EASA. This has to be done for complying with the requirements imposed by Albania's obligations deriving from the Multilateral Agreement (ECAA) as well as Albania’s membership in other relevant international organizations such as Eurocontrol, ICAO and ECAC.

The set up of the aviation legal framework in line with the international and European standards has started, along with the reinforcement of the staff and their competence and skill, by means of the EU Twinning Project n. AL 08 IB TR 01. The implementing period of that project was from Sept. 2010 to Sept. 2012 (two years) which is however too short to complete the build of a stand alone institution and ensure the necessary change in the staff mentality.

As far as safety oversight of air operators is concerned, a series of contracts, including an international tender, has been signed as a temporary solution to contract some foreign experts as inspectors.In addition a Memorandum of Cooperation (MoC) has been signed by ACAA and ENAC (the Italian Aviation Authority) for Technical Assistance in the field of Aviation Safety Oversight for Air Operator Certifications and Certifications of Airworthiness.Therefore the safety oversight activities are currently carried out by those foreign experts, jointly with, and under supervision of, an ENAC team (MoC).

The Air Safety Committee (ASC) of the EU Commission, which is in charge for the assessment of operators to be included in the so called "black list", is monitoring the Albanian civil aviation system. The ASC, among other conditions which were the basis to avoid the black list, encouraged Albania to make decisive progress in the construction of the technical and administrative capacity of

ACAA.

Again, that progress implies not only the completion of legal framework but also the achievement of qualified and competent staff, through proper recruitment and proper theoretical, practical and on-the-job training.

Finally it is anticipated that in the forthcoming months, most of the EU aviation regulation will be modified and all the Aviation Authorities will have to extensively amend their national standards and provide the relevant training for further upgrade of the staff competence.

So the strengthening of the Albania's institutions capacity in the field of air transport is still outstanding.The consolidation and the support of the results achieved by the previous twinning project n. AL 08 IB TR 01, along with their strengthening and extension, are therefore necessary:- to continue complying with ECAA obligations - to continue filling the deficiency identified by ICAO/EASA- to prevent further findings by ICAO, EASA and Air Safety Committee- to continue approaching the final target of an Authority independent by foreign experts- to properly face the forthcoming extensive changes in the EU aviation Regulations- to continue providing theoretical, practical and on-the-job training

The project will strengthen the Albanian Transport Sector, and specifically the Albanian Civil Aviation Authority (ACAA), for further development of the legislative/institutional framework and further development of competences of the staff, in harmony with the EU Acquis.

The project is intended to sustain, stabilize and extend the results achieved by the Twinning Project n. AL 08 IB TR 01, in order to continue resolving the deficiencies identified by the international aviation controlling agencies (ICAO, EASA).

The project is therefore aimed to advancing Albania’s accession to full EU membership, through enhanced approximation with the Aviation Transport Acquis and enhanced ACAA capacity in the operational framework.

3.2 Linked activities (other international and national initiatives):

ACAA is involved in the Implementation of Single European Sky in South East Europe Programme (ISIS Programme), an initiative funded by the European Commission (DG-MOVE) and developed in the framework of the extension of the Trans-European networks to South East Europe, as well as in support to the European Common Aviation Area (ECAA) agreement. One of the deliverables of this Programme is a National Supervisory Authority (NSA) Handbook which should be adapted and integrated into the ACAA standards.

The Twinning project n. AL 08 IB TR 01, named "Support to Albanian Civil Aviation Safety Management Systems to the requirements of the Council Regulation (EC) 787/2007", between ACAA and the Italian Civil Aviation Authority (ENAC), has been funded by EU.

It has been aimed to start the implementation of the international and European aviation standards into the Albanian legal framework and to start the relevant training for the ACAA staff. That initiative, thanks to its long-term presence, joint activities, daily transfer of know-how and information, culture-oriented approach rather than task-oriented approach, has so far got the following results:

• improvement and stabilization of the staff• improvement of daily standards in terms of knowledge, willingness, presence at work and

proactivity3

• rules and procedures closer to the EU acquis• inspectors starting doing simple tasks autonomously• inspectors available to learn, to attend training and to face examinations• inspectors able to pass examinations also at JAA-TO (the Dutch school providing aviation

training to many European Aviation Authorities)• big cultural change in attitude, mentality and behavior of the staff

A Memorandum of Cooperation (MoC) has been also signed between ACAA and ENAC (the Italian Civil Aviation Authority) for Technical Assistance in the field of Aviation Safety Oversight for Air Operator Certifications and Certifications of Airworthiness.By means of this MoC, ENAC provide supervision and recommendations for the safety oversight activities. That supervision by ENAC represents one of the conditions agreed by ACAA and the EU Commission (Air Safety Committee) to allow Albanian air carriers to fly in Europe.

ACAA signed contracts with foreign experts consultants as well, acting temporarily as inspectors for the management of daily oversight activities.

In terms of membership in international institutions, Albania is an ICAO member, an ECAC member, and a member of the European Organization for the Safety of Air Navigation (EUROCONTROL).

3.3 Results:

1. Regulatory and technical aviation legal framework in compliance with EU legislation and ECAA obligations

2. Technical manual and procedures necessary for implementing the aviation legal framework reviewed and upgraded in compliance with EU standards

3. ACAA organizational structure and documents upgraded in accordance to the aviation legal framework and relevant procedures

4. Initial, recurrent and practical/OTJ training of ACAA staff upgraded and delivered

5. Ability of ACAA staff to accomplish in autonomy some entry level oversight activities.

3.4 Activities:

1. To assist the ACAA staff in order to identify and to review all procedures and the technical guidance in accordance with EU latest standards.

2. To develop proposals for upgrading the regulatory legislation and technical procedures in compliance with EU latest standards.

3. To assist the ACAA staff to fulfill the responsibility to implementation of the legislation

4. To develop training plans

5. To deliver theoretical training courses (initial and recurrent)

6. To provide practical and on-the-job training in the respective authorities or providers of the Member State.

7. To coach/assist ACAA staff in the accomplishment of oversight/licensing/certification activities

8. To assist ACAA in the standardization audits carried out by the monitoring organizations (e.g. ICAO, EASA, ECAA) and relevant follow-up

All activities will be accomplished as co-operative tasks between MS experts and the beneficiary institution ACAA.

3.5 Means/ Input from the MS Partner Administration:

3.5.1 Profile and tasks of the Project Leader

The Member State organisation should provide a Project Leader experienced in civil aviation policy formulation, regulations, and organisation management.

The Project Leader will act as the Member State representative on a Project Steering Committee, which will meet in Albania on a quarterly basis.

Profile: Minimum 10 years of experience in the civil aviation or equivalent field relevant to the

nature of the project. At least 5 years working experience in a leading management Long-term civil official from an Member State civil aviation administration; Wide knowledge of related good practice/EU acquis. Educated and experienced in the field of management and organization ; Proficiency in spoken and written English (notation 1 to 2 in the scale from 1 to 5, being 1-

excellent 5-basic) Excellent computer skills (oral and written)

Tasks: Assists the RTA with the project management: The management of the project administration. Overviews the development of all key project outputs and the corresponding

procedural/operational manuals, plus the provision of related skills development activities. Coordination of work with other relevant institutions in Albania for the implementation of

the project.

3.5.2 Profile and tasks of the RTA

The Member State organisation should provide a long term expert as Resident Twinning Adviser (RTA) experienced in the civil aviation policy formulation and regulations, and organisation management.The RTA will be mobilised for the entire duration of the project. The RTA has the responsibility to implement the above-listed components and to guide the work of the team. The medium/short term experts will work in close cooperation with the RTA and the staff in order to meet the specific objectives as set out above. He/she will work on a day to day basis with the beneficiary and should have the following qualifications and the experience.

Profile: Relevant University degree and trained in the regulatory oversight disciplines (e.g.

Airworthiness, Flight Operations) Minimum 7 years of experience to include policy-making and inspection within a Government

civil aviation department engaged in the planning and delivery of an aviation safety regulatory management system.

Broad knowledge of International Aviation Regulations Sound comparative knowledge of relevant EU Aquis and institutional requirements related to

the various components of the project. Sound management, leadership, communication and coordination skills. Good training, public speaking and written communication skills.

Additional assets: Sound background in drafting and/or implementing strategies, policies or regulations Previous experience as project coordinator/project manager in similar projects; Some relevant working experience in the new Member States and the Western Balkans or

States with similar development issues;

Tasks: Overall supervision of the project implementation and coordination of all activities, as well as

management of the project administration; Coordination of the activities of the team members in line with the agreed work programmes

to enable timely completion of project outputs; Preparation of project progress reports; Permanent contact with the beneficiary RTA counterpart; Liaison with EC Task Manager; Liaison with other relevant projects. Assistance with management of technical decision making and problem solving on a day to

day basis

The RTA is expected to ensure, together with the beneficiary administration, the achievement of the objectives listed in 2.1 and 2.2. In order to meet these purposes, and if fully justified, the RTA may propose alternative and/or complementary project activities and/or outputs to those identified in the section 3.4.

3.5.3 Profile and tasks of the short-term experts

All experts mobilised under this contract must be proficient in English, have good communication and analytical skills, be proficient in report drafting and have good team working abilities.

Short term experts will be required on an ad hoc basis to provide on-site assistance to the beneficiary. The need for the short-term experts will become apparent as the Project matures and in particular as EU Regulations may develop or events dictate (e.g. changes to EU Regulations, specific training needs, follow-up of standardization audits, etc.). Short term experts shall have the following qualifications and experience.

The Terms of Reference for short-term adviser(s) will be elaborated by Project Leader/RTA at the work plan preparation stage.

The actual duration of the assignments of each of the short-term experts will be defined during the drafting of the twinning agreement. The short term experts will work in close co-operation with the RTA and the Beneficiary in order to meet the specific objectives as set out above.

The short-term experts are expected to have: Professional background in management of Regulatory civil aviation issues Solid training skills and experience in organizing training courses Sound knowledge of relevant EU legislative and institutional requirements related to the

various components of this project Proficiency in spoken and written English (notation 2 in the scale from 1 to 5, being 1-

4. Institutional Framework

The beneficiary institution is the Albanian Civil Aviation Authority (ACAA).

The ACAA is the designated Civil Aviation Authority of Albania, as prescribed by the national Air Code and by the Law n. 10233 (as revised by Law n. 10479).The ACAA is an independent public regulatory institution with financial autonomy under the supervision of the Ministry of Public Works and Transport (MPWT).

The ACAA is in charge for the daily implementation of aviation regulations and the safety oversight on air transport.

The supervision on ACAA is accomplished by the Ministry of Public Works and Transport (MPWT). MPWT is responsible for the overall policy and main air transport legislation in Albania. MPWT is in charge for proposing the legal instruments such as laws, decision of the Council of Ministers and bylaws. Also is particularly responsible for the negotiation and ratification of bilateral and multilateral agreement, international conventions and protocols (on international civil aviation and signing bilateral air agreements with foreign States).

The Project Steering Committee will be composed in accordance to the indications of the EU Twinning Manual, therefore the memberships is supposed to be as follows:

8. Sustainability

The achievements of the project (mandatory results) should be maintained as a permanent asset to the Beneficiary administration even after the end of the project implementation. This presupposes inter alia that effective mechanisms, like systematic application of procedures, stabilization of the staff and recurrent training, are put in place by the Beneficiary administration to consolidate and disseminate the results of the project.
